  our background, OK? On September 8th, workers at a
• 7:14
  Hollywood impound lot reported a strong odor coming from a Tesla
• 7:18
  that had been towed in after someone called it abandoned in
• 7:22
  the Hollywood Hills. Inside the front trunk, police
• 7:24
  found a bag containing human remains.
• 7:26
  The body was so badly decomposed it took more than a week to
• 7:29
  identify. The Los Angeles County Medical
• 7:32
  Examiner eventually identified the victim as 14 year old
• 7:35
  Celeste Rivas Hernandez. The vehicle is registered to
• 7:39
  musician David, legal name David Anthony Burke.
• 7:44
  Reporting since then has included the following details.
• 7:47
  A matching tattoo with Celeste. A mother who had who said her
• 7:50
  daughter's boyfriend was named David.
• 7:52
  An unreleased love song with the name Celeste in the working
• 7:55
  title. A police with the name Celeste
• 7:58
  in the working title. A police raid at the residence
• 8:00
  connected to David. His subsequent move from that
• 8:03
  residence and after initially continuing his tour, the
• 8:06
  cancellation of remaining dates. So, yeah, authorities have
• 8:12
  repeatedly said he has not been arrested, charged or named as a
• 8:16
  suspect. And you know, there's, there's a
• 8:21
  whole bunch here that you can, we're going to watch this video
• 8:24
  here in just a bit. Those on the podcast will hear
• 8:26
  the audio. But this is something this
• 8:28
  there's a 14 year old girl. She would have been 15 by the
• 8:31
  time she was found. I think that's split in hairs.

  I don't think it really matters all that much, but.

  And he himself is 20 now. I want to go over to this
• 8:43
  article by it was on Men's Journal.

  It's titled Police standing by their statement in David case,
• 8:51
  Celeste Rivas. Yeah, in David Celeste Rivas
• 8:55
  case. OK, over 2 months ago,
• 8:59
  authorities made a grim discovery when they found the
• 9:01
  dismembered and decomposing body of 14 year old Celeste Rivas in
• 9:05
  the trunk of a vehicle belonging to 20 year old singer David
• 9:10
  Again David Anthony Burke. Over the past two months,
• 9:13
  months, authorities have continued to investigate the
• 9:15
  death and how the body ended up in the car, but authorities have
• 9:18
  had very little information to share on the case over the past
• 9:21
  several weeks. Recently, the Los Angeles Police
• 9:24
  Department issued another statement on the matter in which
• 9:27
  it essentially stood by another statement it made back in
• 9:30
  September. Let's go to that statement,
• 9:35
  shall we? This is the statement from
• 9:37
  September 29th from media relations of the Los Angeles
• 9:42
  Police Department, Dateline Hollywood.
• 9:44
  The Los Angeles Police Department's Robbery Homicide
• 9:47
  Division, RHD, has been diligently investigating the
• 9:51
  death of Celeste Rivas Hernandez over the past several weeks.
• 9:54
  At this time, we can confirm that Celeste Rivas Hernandez is
• 9:58
  deceased and her body was found in the front trunk area of a
• 10:02
  Tesla belonging to David Burke. The vehicle had been parked at
• 10:07
  the location from which it was towed for several weeks, so Miss
• 10:11
  Rivas Hernandez may have been deceased for several weeks prior
• 10:16
  or before the discovery of her body.
• 10:19
  The Los Angeles County Medical Examiner has not yet determined
• 10:22
  the cause or manner of Miss Rivas Hernandez's death.
• 10:25
  As such, it remains unclear whether there is any criminal
• 10:30
  culpability beyond the concealment of her body.
• 10:33
  So at least there is that. RHD is thoroughly examinating
• 10:39
  every aspect of the case to uncover the truth and seek
• 10:43
  justice for Celeste Rivas Hernandez and her family.
• 10:46
  We appreciate the public's patience and understanding as we
• 10:49
  continue this investigation. Further updates will be provided
• 10:52
  as appropriate, but at this time we are unable to answer
• 10:55
  additional questions. So that was the original,
• 10:59
  original release their statement.

  So basically what happened was the LAPD issued a statement to
• 11:08
  the a local local news organization saying our
• 11:14
  statement from September still stands.
• 11:20
  So there's no crime here except for concealing Celeste's body so
• 11:28
  far, right? OK, while this obviously
• 11:32
  continues the article in what is it again, Men's Journal?
• 11:41
  While this obviously does not provide any new information, one
• 11:45
  expert explains why it is still a telling statement to make.
• 11:51
  We can get past the what we know so far kind of thing.
• 11:54
  We all know that, OK? Two months after the body was
• 11:58
  discovered in David's vehicle, KTLA 5 in Los Angeles reached
• 12:01
  out to the LAPD seeking an update on the case.
• 12:04
  However, the department did not have any substantial update to
• 12:08
  offer, telling the outlet that its news release stands on its
• 12:11
  own. That news release was dated
• 12:15
  September 29th, weeks ago, the one that we just read and weeks
• 12:18
  after the body was discovered, quote, the Los Angeles Medical
• 12:22
  Examiner, we just read this, but we'll do it again.
• 12:24
  The Los Angeles County Medical Examiner has not yet determined
• 12:27
  the cause or manner of Miss Rivas Hernandez's death.
• 12:30
  As such, it remains unclear whether there is any criminal

  culpability beyond the concealment of her body, the

  September 29th news release reads.

  And then it continues. RHD is thoroughly examining

  Aside from that week's old news release, the LAPD has been

  largely silent on the investigation.

  Men's Journal that the LAPD is standing by a statement from

  weeks ago. Private investigator Steve

  Fisher explains why this statement is telling in and of
• 13:07
  itself. Now, remember Mr. Fisher, We

  remember him from this video that we watched.

  Maybe we'll watch it again tonight.

  We watched it on, I don't know, in the last episode that we did
• 13:21
  on this case. It is a clip from Vinny Politan

  Investigates, I think anyway, it's Vinny Politan and Mr.

  Fisher was hired by the owner of the Hollywood Hills home.
• 13:36
  I don't have a picture of that show you guys, but he was, he
• 13:39
  was hired by the owner of the Hollywood Hills home that David
• 13:42
  had been leasing or some, I think his agent or his, his
• 13:47
  label had been leasing for him to investigate things in the
• 13:55
  house. And so Mr. Fisher did that and
• 13:58
  he said in this, in this interview with Vinny Politan, I
• 14:02
  think we should just go ahead and watch it.

  But he basically said there were some other things in there that
• 14:09
  in and of themselves are not illegal to own, but are telling
• 14:13
  of what was going on there. Let's just watch.

  This is 8 minutes long. It was David's, but the question

  is who was driving the car? Who had access to the car?
• 14:22
  Who left the car abandoned on the side of the road?

  To me, that's an important question in all of this.

  It might not. That person may not be the
• 14:31
  killer, but that person may have some information that could lead
• 14:36
  you to the answer to what happened to this teenage girl.

  with all of this involving a video apparently that you were

  to get your hands on. Give us the back story on the

  video, what you can tell us about the video and what that

  video revealed to you and what you've done with the video.

  So it's from it's from the neighborhood, it's right down
• 15:35
  the street from the house that you know, David was staying in
• 15:39
  that is manager leased. And it's video of the Tesla, you
• 15:43
  know, being moved on the 29th, July 29th about midday.

  And it's the same day that. By the way, this guy, Steve
• 15:54
  Fisher was a guest today on Surviving the Survivor that I
• 15:57
  got to catch a few minutes of. I'm going to see if Mr. Fisher

  would join us for a conversation as well.

  on a tour bus to begin the tour. The first day of the tour on the

  tour bus go in San Francisco. So the the Tesla at that point

  is actually already in as dirty state as it is in the pictures

  that we obtained, you know, right when it was towed.

  So it's it looked like you've been sitting again for a while

  and it looks like they just made one last move with it before
• 16:32
  they they set out for this part of the tour.

  Now as you, as you describe that everyone at home is saying,

  well, who is they? Do we know who?

  Day is you know that's something that right yeah, I know who I

  know who was driving it on that last little you know move that
• 16:56
  it made to that parking spot there but that's something that

  I'm not going to disclose yet. I think that would be, you know,

  stepping on LAP DS toes, which we don't we don't want to do.

  We we just want to make sure that, you know, some of these

  things are known and and that, you know that there's justice in

  this case. Because that statement that they
• 17:16
  came out with LAPD came out with not too long ago was a little
• 17:19
  concerning. It made it seem like really

  culpability of concealment of a body might be the extent of the
• 17:24
  charges. Of course he is talking about
• 17:29
  the statement that we just read, the September 29th statement.

  So what what and, and I just want to get a clearer picture

  here. The house where this was, would
• 17:40
  there be a reason for the for the car to not be at the house?

  Like were they abandoning the house and they were never going
• 17:48
  to return to the house? Do we know anything about
• 17:51
  information like that? I don't think that was the plan
• 17:56
  because they left a lot of stuff behind the house.

  They did, you know, after this all went down, they moved some

  of it out, but even then they left a ton behind.

  So I think it was just, you know, maybe that psychological

  factor of just a, you know, a little distance gets it a
• 18:11
  little, you know, further away from, you know, from the house.

  I, I think it was not a permanent solution, obviously,

  but I think that they did have a plan down the road.

  I think it just the towing really upended that that plan.

  Let me ask you Steve, is is there any indication of what is

  the last known proof of life of Celeste?

  So the last that that I have and then I don't know, you know what

  LAPD has, but there was some media left behind at the house
• 18:46
  and there's photos from a camera that David was using.

  And the last photo of Celeste is January 2nd of 2025.

  Wow, Now without revealing what you found, right, because some

  things you may not be able to reveal and what you went through
• 19:07
  in the house, did you find any evidence of criminal behaviour?

  So, you know, it's not a crime to think about doing certain
• 19:16
  things, but we found some things that had been delivered to the
• 19:19
  house that just don't belong there, don't belong in any type
• 19:23
  of environment like that. And they are things that you
• 19:26
  could use to get rid of a person if you wanted to.

  And they're really, you know, people say, oh, it's got to be
• 19:32
  tools and stuff. It's beyond that.

  It's, it's, it's really, it's really sadistic stuff.

  Now, LAPD didn't take it, but they have told us that they
• 19:41
  photographed it. But again, you know, that's not
• 19:44
  a crime, just ordering these things, you know, But I think it
• 19:47
  does. I am so curious what those
• 19:50
  things are. He called them sadistic.

  Beyond tools. Beyond just tools.

  You know, show that there was some intent and you know.

  Yeah, well, right. It's not illegal to have.

  OK, so let's just we don't need to watch the rest of it there.

  That that's the part that I wanted to cover, right?

  Where it's like he's like, I am concerned.

  I am concerned that the LAPD really, in that statement from
• 20:17
  the 29th, really is only worried about the concealment of the
• 20:20
  body when all this stuff was left behind.

  That really indicates that they were looking to do something
• 20:28
  more than that. Right?

  OK, let me go back to the Men's Journal article here real quick.

  Let's go back over here. All right, so getting back, so

  Fisher, the voice that we just heard, the face we just saw who
• 20:45
  has been investigating the case after he was hired by the owner
• 20:48
  of the Hollywood Hills home where David was living,
• 20:50
  explained that the statement suggests that the LAPD still
• 20:55
  does not have any evidence proving or suggesting that any
• 20:59
  crime other than the concealment of a body ever took place.

  LAPD quote, LAPD confirmed KTLA news on November 6th that their
• 21:08
  prior news release stands on its own.

  That release stated that no crime other than concealment of
• 21:14
  a body may have occurred in the Celeste Rivas Hernandez case
• 21:18
  involving David Fischer wrote in a post on X.
• 21:20
  We're going to read that entire post, OK.

  The LA County District Attorney's Office also confirmed
• 21:25
  that no case has yet been presented to their office for
• 21:29
  consideration. Statement also neglects to
• 21:33
  mention another aspect of the case that Fisher thinks is worth
• 21:36
  investigation. It's worth noting that nowhere
• 21:41
  in the press release this is a quote from Fisher or in any
• 21:45
  official statement has there been mention of an investigation
• 21:48
  into the relationship David had with Celeste.

  Yes, that could be a difficult case to prove because Celeste is
• 21:54
  no longer here to testify, but that does not mean it should not
• 21:58
  be pursued, Fisher added, continuing the quote.

  Hopefully law enforcement and the DA's office will do their
• 22:08
  job and take on a case, even if it's challenging.

  Even if people close to Celeste are unwilling to cooperate
• 22:14
  because it would expose their knowledge of the illegal
• 22:16
  relationship, charges should still be filed.

  We must prove we will protect children from predators.

  So David Fisher is coming out full and saying, yeah, so

  David's a predator. He he definitely, I mean, I'm
• 22:33
  reading between the lines here, but he had a sexual relationship

  with a 14 year old girl. And from what I can tell, she
• 22:44
  was 12 when they started their relationship.

  I don't know if it was sexual back then, but him being an 18
• 22:52
  year old boy slash man and her being a 12 year old girl not OK

  with that. And then the article finishes

  out. David has never been arrested,

  charged or even named as a suspect.
