  There was a press conference earlier today that we're going

  to get into and I'm keeping my eye on my other monitor for, you

  know, when anything happens at the LA courthouse.

  The arraignment was scheduled for today at 4:30 PM Eastern,

  1:30 PM Pacific Time and no cameras were allowed in there.

  We understand that the arraignment has taken place

  already, but reporters and media are are waiting around for any
• 2:17
  comments that might come our way.

  First, why don't we do a quick little recap of the case, OK,

  back in September of last year. So what are we five months and
• 2:32
  six months out? September, October, seven months
• 2:36
  ago, I guess a Tesla was towed from where it was parked on the
• 2:43
  street in the Hollywood Hills. It was impounded and then the
• 2:47
  police were called because of a extreme smell of decomposition.

  When they got there they found 2 bags in the front trunk area of
• 2:57
  the Tesla, one of which we understand from court documents
• 3:00
  was a body bag, like a corner style body bag with a zipper on
• 3:06
  it. And that one was most of Miss
• 3:10
  Rivas, little 14 year old girl from Riverside County.
• 3:16
  And then a bag beneath it had her arms.
• 3:20
  We understand from court documents now more is going to
• 3:23
  come out. We don't we don't have all of
• 3:25
  the details. Obviously.

  We just, you know, little things get trickled out here and there.

  Earlier today there was a press conference because Mr. Mr. Burke

  has been, well, he's been a person of interest since the
• 3:43
  very beginning. But where has he been?

  Why hasn't he been arrested? We understand there's been a
• 3:47
  grand jury convened and it didn't seem like anything was
• 3:52
  happening until Friday when the Los Angeles police issued a
• 3:56
  statement on their ex account, which is like 2 sentences long

  saying, hey, David Burke has been arrested.

  We will refer the case to the district attorney's office on
• 4:06
  Monday. Then this morning, local time in
• 4:11
  in LA, the the district attorney's office and the LAPD
• 4:17
  had a joint press conference talking about the case.

  Dateline Los Angeles singer David has been charged with

  murder in the death of a 14 year old girl who was last seen or

  last known to be alive nearly a year ago and whose dismembered

  and decomposed body was found in September and his apparently

  abandoned Tesla, prosecutors said Monday.

  The charges revealed key details and were among the first
• 5:45
  concrete public moves made in a grisly and horrific case that

  had been under the largely secret investigation in the

  seven months since the body of Celeste Celeste Rivas Hernandez

  was found, the Los Angeles County District Attorney's

  office said the 21 year old David, whose legal name is David

  OK Authorities allege the Houston born all pop singer

  killed Rivas Hernandez to protect a career on the rise.

  His debut album Withered was released just two days after
• 8:21
  they said she was known to be alive.

  She was reported missing by her family in 2024 when she was 13.

  That was her age when, according to allegations in a criminal
• 8:34
  complaint, which I have not seen yet but apparently will be
• 8:39
  released, the singer engaged in continuous essay of her for at
• 8:44
  least a year, from September 2023 to September 2024.

  California law penalizes abuse of a child under 14 especially
• 8:55
  harshly, as it should. Authorities who described her
• 8:59
  Monday as a runaway said she was 14 when she was killed with a

  sharp object on or around April 23rd, 2025, and was headed to

  the singer's house in the Hollywood Hills, prosecutors

  allege Burke, By the way, we have a mug shot of Mr. Burke.

  Prosecutors allege Burke mutilated her body about two

  weeks later, so they they put her date of death as April 23rd,

  2025. She was.

  Her body was found September 8th, so almost five months

  later. OK, so prosecutors allege Burke

  mutilated her body about two weeks later.

  The murder charges included special circumstances.

  And these were the special circumstances, lying in wait,

  committing crime for financial gain and murdering the witness

  in an investigation that could carry the DP.

  Prosecutors haven't announced whether they will seek it or

  not. Now, real quick, let me let me

  Rivas Hernandez and he was not the cause of her death.

  They said we will vigorously defend David's innocence.

  I don't mind them saying that. I think that he should have a

  good vigorous defense. Our, our system of our, our

  judicial system requires that. We don't want kangaroo courts

  around here, right? Burke was arrested at a home in

  Hollywood Thursday and was being held without bail.

  He's expected to make his first appearance in court later

  Monday. Of course, this was written

  before he did that. A missing child in the grisly

  discovery of a body. Los Angeles County District

  Attorney Bethan Hochman called the case, quote, apparent
• 11:47
  nightmare In what I thought was probably the best part of the
• 11:51
  press conference, which we will get to quote.

  Celeste, a 14 year old at the time, went to Mr. Burke's house

  and just bring this up so you guys can see it went to Mr.

  Burke's house in the Hollywood Hills.

  She was never heard from again, Hockman said at Monday's press

  conference. The long dead body of Rivas

  Hernandez was found inside a Tesla that was towed from the
• 12:15
  Hollywood Hills on September 8th when Burke was on tour in

  support of his album. It was a day after she would
• 12:20
  have turned 15. I find this part extremely
• 12:26
  disturbing, this part of it. OK, so he allegedly police
• 12:32
  alleged that he murdered her on April 23rd and then a couple
• 12:40
  weeks later dismembered her body.

  I'm curious how they make that timeline.

  But they do say that there's digital evidence, that there's

  forensic evidence, there's physical evidence.

  And when when we talked about this on Friday, just a few days

  ago, we learned that the majority of her body was found

  in a zip up cadaver bag. And I just did a quick little

  search on Amazon while we were live and sure enough, you can

  buy cadaver bags. Who knew?

  grand jury looking into the death.

  The probe was officially secret, but its existence and his

  designation as its target was revealed in February when his

  mother, father and brother objected in a Texas court to

  subpoenas demanding they testify The 2023 Tesla Model Y and some
• 16:50
  documents it says Tesla Model X was registered in the singer's
• 16:54
  name at their address. According to court filings.

  Authorities did not publicly acknowledge him as a suspect

  until his arrest. Josh Rudder actually brought

  something up that I, I thought was terrific in the live stream

  over on Surviving the Survivor today about the difference

  between interviewing a potential witness as a police officer or

  having the the witness respond to a subpoena by a grand jury,

  right? There's no dodging a grand jury.

  The, the singer's family has been trying, but I don't think

  they're ultimately going to be successful.

  I'm curious if the grand jury is going to continue on this

  because it was mostly investigative, right?

  No, no indictment was handed down here.

  The the arrest was made without an indictment in, in California,

  you don't need an indictment to make an arrest.

  But I'm curious if that will continue to, you know, if that

  father, mother, brother will be required to testify or if it is

  moot at this point. You know, if, if you're just

  being interviewed by, by police, you can invoke your rights to

  remain silent, right? You don't have to.

  You don't have to speak. But when you're subpoenaed and

  you're underoath as a witness, it's a different thing.

  Police investigators searching the Tesla in a tow yard found a

  cadaver bag quote, covered with insects and a strong odor of

  decay, close quote. Court documents said detectives

  partially unzipped a bag and found a head and torso.

  Investigators from the Los Angeles County Medical

  Examiner's Office removed the bag and quote discovered the

  arms and legs had been severed from the body, according to

  Celeste, and their grief is incalculable as to what happened

  to their daughter. Hochman said.

  disallowed unless you're 7 or your Prince gained popularity

  with the hit Romantic Homicide, which peaked at #4 on

  in 2023. The Associated Press confirmed

  that David was dropped by Interscope last year when the

  body was discovered. The singer continued his North

  American tour, but when reports of his possible involvement

  spread widely, he cancelled the final two shows and a European

  Tour that was to follow. On April 11th, about two weeks

  before the killing, he made his debut appearance at the

  Coachella music festival, where he talks to the AP Quote.

  I was such an Internet kid. The Internet is really what I

  claim is my home, he said. My neighborhood was Instagram

  and the society was the Internet.

  Well, his neighborhood now, because this has special

  circumstances attached. There is no bail for Mr. Burke.

  So his neighborhood and his society, his civilization is

  going to be the Los Angeles County jail or wherever it is

  that they hold him while he awaits trial.

  Now, I don't know. I don't know, man, statistically

  speaking, right, Most cases and in some sort of plea bargain and

  the prosecution, the district attorney's office believe that
• 21:54
  they've, they can, they can clear the hurdle of reasonable

  doubt. They think that they've got the
• 22:00
  evidence. They think that they've got
• 22:02
  digital forensic physical evidence tying Mr. Burke to her
• 22:06
  murder. And the, the OR, let's see, the
• 22:13
  fact that Celeste's body was found in the trunk area of the
• 22:19
  singer's car is an indication to me of dilaholidness, of complete
• 22:26
  and utter stupidity. If we're going to be a little
• 22:31
  more grace, Grace giving, right? I would say maybe inexperienced
• 22:39
  in crime, perhaps. But that to me is an indication
• 22:44
  that they likely were dumb. I bet there is so much digital
• 22:49
  evidence. I bet there are text messages, I
• 22:51
  bet there are DMSI bet I bet there there's photography, maybe

  even videos on this. Like, I, I mean, I'm just

  speculating here, but just the fact that somebody decided, hey,

  we're just going to store this cadaver bag and the other black

  bag in the front trunk area of this Tesla while we go on tour.

  That is an indicator to me that these just aren't the sharpest

  tools in the shed. And by the way, this is a great

  time to invoke my iron law of criminal mastermindry.

  And to me, that just signals help, signals collaborators,

  victims that there are people, there are predators, mostly men,

  not not exclusively, but mostly men who have a capacity for

  They're good at covering up what their intentions are.

  Burke, the musician known as David, spelled D4 VD in

  connection with the brutal and horrific murder of Celeste, a 14

  year old at that time. These charges include the most

  serious charges that ADA's office can bring.

  That is first degree murder with special circumstances.

  The special circumstances being lying in wait, committing this
• 34:46
  crime for financial gain or murdering a witness in an
• 34:50
  investigation. I'm just going to pause it here

  for a second because, and this is kind of what I do, it's not

  about it along the way. This was brought to us by the

  AP, by the way, the the the witness special circumstance,

  The basically, Celeste was a witness to her own abuse.

  She was sexually abused by David, allegedly alleged by

  police and prosecutors, and she was the witness of that abuse.

  abuse. The special circumstances carry
• 36:04
  with it, along with the first degree murder charge, a maximum
• 36:08
  sentence of life without the possibility of parole or the
• 36:12
  death penalty. The determination on whether or

  not the district attorney's office will seek the death
• 36:18
  penalty will be made at a later time before I get into the
• 36:24
  actual charges. And there are additional charges

  against Mr. Berg, including continuous sexual acts, lewd and
• 36:33
  lascivious sexual acts with it, with an individual under 14
• 36:38
  years old and mutilating a human remains of a body.

  Before I get into the description of these charges and
• 36:47
  their seriousness, I want to look at this as a parent.

  I am a parent. Of three children.

  And a parent's nightmare is a situation where your daughter
• 36:58
  goes out one night and never comes back, as we will show in a

  court of law. And what I also want to make
• 37:05
  sure about that the understanding of these charges

  is clear is my description of these charges is not evidence
• 37:12
  that we are going to present in court.

  These charges in fact will not be evidence in the in the court

  Evidence will be the witness testimony, the documents and
• 37:23
  different types of admissible testimony that we will admit

  into court in the prosecution. And if it leads to the eventual

  trial of Mr. Berg to convince a jury of 12 people beyond a

  reasonable doubt that each and every one of these charges is

  true as well as the special allegations and circumstances

  that have been alleged. Now back to this being a

  parent's nightmare on April 23rd, 2025 has been alleged by

  the complaint. Celeste, a 14 year old at that

  time, went to Mr. Burke's house in the Hollywood Hills.

  2025 as alleged in the complaint at his invitation and again was

  circumstance being that these this murder was committed for

  financial gain as the evidence will show in court.

  The financial gain was for Mr. Burke to maintain his very
• 41:24
  lucrative music musical career that Celeste was threatening on

  that particular night. The third charge, in addition to

  lying in wait and for financial gain, is murdering a witness to

  an investigation in this particular case as the evidence

  will come out in court. The the in the witness to the

  investigation was Celeste and the investigation was into the

  lewd and lascivious sexual acts committed by Mr. Burke.

  Throughout the seven month investigation, this department

  has faced criticism for how we handled the case and for our

  decision not to provide details. I want to be clear about

  something. My duty is not to fuel

  speculation. It's to deliver justice, and

  that requires patience and discipline on everybody's part.

  This investigation was driven by a single purpose, to secure

  justice for Celeste Rivas and for those who loved her.

  We had to be certain that nothing we did or said would

  ever jeopardize this case. Miss Rivas was a reported

  runaway from Riverside County. During the course of our

  investigation, detectives learned that she had been

  involved in a sexual relationship with Mr. Burke when

  she was a minor and he was an adult.

  On April 23rd, 2025, Miss Rivas arrived at Mr. Burke's home in

  the Hollywood Hills. That's the last time she was

  known to be alive. On September 8th, 2025, Miss

  Reavis's dismembered and badly decomposed body was discovered
• 59:35
  in the front trunk of Mr. Burke's impounded Tesla.

  From that moment for this is a great question from Kay Bling.

  How in the heck can they tell a sharp instrument was used with

  Died in April in a bag until September.

  And so that little roller coaster, the daily roller

  coaster has been challenging. And sometimes it's been really a

  downer, right? It's been almost depressing.

  Some days we're like, wait a minute, how did I gain half a

  pound today? When when I did the same thing

  that I do everyday. And you know, if I can maybe

  just show you guys this screen because I track everything.

  You know, when you look at this screen, you can see that there

  are there's a downward trend, but there are ups and downs,

  right? So that has been the most

  challenging part. It's been sometimes depressing

  on a day where I'm like, wait, what?

  The other thing that's been challenging is I decided that I

  am not going to that, that I'm going to participate fully in,

  in traditional, you know, holidays like Christmas and

  And so I just have to know that I am, I'm going to eat lots of

  And that means that I am elongating my journey out by a

  certain amount of time. But I also know that when I

  reach my goal, I then need to live the rest of my life

  maintaining that. And there will be ups and downs
