- 0:17We are now in week two of the desperate search, a national
- 0:23search. I would even say an
- 0:26international, not really an international search, but
- 0:29there's certainly interests spread far and wide
- 0:31internationally across the fruited plains and beyond of 84
- 0:36year old Nancy Guthrie. Nancy Guthrie happens to be the
- 0:42mother of T VS Today Show Co host Savannah Guthrie, which I
- 0:50think probably has brought probably.
- 0:52There's no doubt that that has brought way more attention to
- 0:55the case than it otherwise would have had.
- 0:58I, I am not so cynical that I believe that it has brought more
- 1:02law enforcement action than the case otherwise would have, but
- 1:08certainly attention in the media and that has helped as well.
- 1:12A lot of happened over the weekend, a lot happened today.
- 1:15So we're going to get into that a little bit as well as read
- 1:20your comments that you've shared with me on social media as well
- 1:25as here on the live stream. Stick with me.

- 2:20And we have been working so hard to try to get as much.
- 2:25I'm, I'm talking you and me trying to get as much attention
- 2:29on this case as possible because I believe that the more
- 2:32attention that is on the case, the better.
- 2:35Now I live stream Monday through Friday.
- 2:38On Saturday and Sunday, I take the old day off.
- 2:41But over the weekend there law enforcement, nor did the neither
- 2:47law enforcement nor the Guthrie family rested.
- 2:50They continued their search and and they released this video
- 2:59over the weekend. And I want to I want to play it
- 3:01for you. I just need to get to the right
- 3:02button here. Let me.

- 3:25celebrate with her. This is the only way we will
- 3:29have peace. This is very valuable to us and

- 3:40So I mean, what has happened since then, though, is that
- 3:44Savannah Guthrie has released another video today.
- 3:49This happened a couple hours ago.
- 3:51She did it via her Instagram and her Facebook page.
- 3:55This one is about a minute 42. Let's let's have a look see.
- 4:01Hi there everybody. I wanted to come on and just
- 4:08share a few thoughts as we enter into another week of this
- 4:15nightmare. I just want to say first of all,
- 4:21thank you so much for all of the prayers and the love that we
- 4:30have felt, my sister and brother and I, and that our mom has felt
- 4:38because we believe that somehow, someway she is feeling these
- 4:42prayers and that God is lifting her even in this moment and in
- 4:45this darkest place. We believe our mom is still out
- 4:51there. We need your help.
- 5:00I want to just pause this for a second.
- 5:04I shouldn't, I shouldn't interrupt, but I get it's my
- 5:06show so I'm going to interrupt right?
- 5:08But they believe that their mother, that Nancy is still out
- 5:14there. Now, when I started asking
- 5:18people on my Facebook page what they thought, I think a lot of
- 5:22us are starting to lose a little hope or the little hope that we
- 5:25had. And it, it seems from this
- 5:28anyway, that there is a belief that their mother is still
- 5:32alive, that, that they have a chance to get her back.
- 5:37And one thing that I need to remind myself of is I haven't
- 5:41seen any of the evidence. Like there's only three or four
- 5:46things that we know. Everything else is being
- 5:51withheld from us. And I, and I think probably a
- 5:56lot of it, most of it's being withheld from the Guthrie's too.
- 5:59But there will be some things like the ransom notes that are
- 6:02not and and having more information than us.
- 6:07She she thinks that her mom is still out there.
- 6:09Let's continue. Law enforcement is working
- 6:12tirelessly around the clock, trying to bring her home, trying
- 6:15to find her. She was taken and we don't know
- 6:19where, and we need your help. So I'm coming on just to ask
- 6:28you, not just for your prayers, but no matter where you are,
- 6:31even if you're far from Tucson, if you see anything, you hear
- 6:36anything, if there's anything at all that seems strange to you
- 6:42that you report to law enforcement, we are at an hour
- 6:48of desperation and we need your help.
- 6:52This is a departure from what she has said before, which is
- 6:58what we need from you is your prayers.
- 7:00Now she's saying, no, we need more than that.
- 7:03This is our hour of desperation. If somebody knows something, say
- 7:06something. And this is reminding me of a
- 7:08conversation that I saw online where actually I think I shared
- 7:13it with you guys. I think it might.
- 7:14It was on CNN or Fox News or one of the one of the cable networks
- 7:19where a retired FBI guy was like, I can't believe that
- 7:22they're only offering $50,000 in reward money.
- 7:27They got to offer enough to make it so that the the people that
- 7:34have her will start to turn on one another.
- 7:38And it doesn't seem like it's happening now, but Savannah
- 7:40Guthrie is specifically asking all of us, hey, if we see
- 7:44something, if we know something or if we think that we know
- 7:48something, call it in. Call it in to the Tucson Police
- 7:51Department. Call it in to the FBI.
- 7:53The FBI is number is 800. Call FBI.
- 7:55It's really easy to remember 1800.

- 10:23When I posted today what we would be talking about, there
- 10:27are a couple of comments that stood out to me, Paige Walker
- 10:30says I've been following this case very closely, even to the
- 10:33point if I get up in the night, I have to check the case to see
- 10:37if any updates before I can go back to sleep.
- 10:39I think a lot of us are feeling that way.
- 10:41Paige, let me zoom up so you guys can see this.
- 10:46You know, I'm just an armchair detective, but if you abducted
- 10:50an elderly woman with what sounds like a serious some
- 10:53serious health conditions, then why wouldn't you leave a ransom
- 10:56note there at her house or contact them right away?
- 10:59It just feels off. I pray she is OK and I'm wrong,
- 11:03but I don't have a good feeling about this situation.
- 11:05The authorities know a lot more than they are telling and that
- 11:08is exactly how it should be. Just like Coburger, the police
- 11:11said we have no suspects but had his DNA and followed him across
- 11:14the country and arrested him in Pennsylvania.
- 11:16Everyone is saying the police had never seen anything like
- 11:19this in this little town and have botched the case.
- 11:21Well that wasn't the case. I'm curious to the outcome and
- 11:25to see what was truly what has truly happened.
- 11:27Prayers for protection for Nancy and strength for the Guthrie
- 11:30family. That's a terrific comment,
- 11:33Winona says. I feel that she was deceased
- 11:36when she left her home on Sunday morning.
- 11:39I found it very odd that she had ubered 4 miles to her daughter's
- 11:42home. Why would they not pick her up?
- 11:44The photos being taken in the dark at Annie's home could have
- 11:47been from luminol being sprayed. At this point I think they're
- 11:50trying to get her body back. Yes, I do believe someone that
- 11:53knew her well orchestrated the entire situation.
- 11:56Any outcome is going to be tragic at this point.
- 11:59And then a lot of people echo those sentiments saying don't
- 12:04think that they're alive anymore.
- 12:06Pat Longbert is our former admin of the Fish Tank and a frequent
- 12:12correspondent. I think it was someone in the
- 12:14family, she says someone very familiar with her and her home.
- 12:17They took their time. When they were there, it was
- 12:19over 45 minutes. They knew where everything was,
- 12:22where all the cameras were, that she had a doorbell Cam, and no
- 12:25one in the surrounding area saw any unusual vehicles on the
- 12:28street that night. They said when she was dropped
- 12:31off the garage door open and closed, she wasn't driving.
- 12:34I believe that the family member had her go through the garage to
- 12:37get in the house and then made sure the door was unlocked when
- 12:39they left. OK, if I'm right, there's no way
- 12:42she would still be alive anyway. Lots of lots of comments like
- 12:47that. I'm holding on to hope myself.

- 12:56This one, it says February 7th, but it was updated a couple
- 13:00hours ago. Latest from authorities is the
- 13:03search for Savannah Guthrie's mother.
- 13:05This is NBC News. This is the very network that
- 13:08Savannah Guthrie works at. I'm going to yadda yadda.
- 13:15Here's what we know. And I just actually the reason I
- 13:18want to show you this is we just don't know much, right?
- 13:22There's the timeline. 5:32 PM she left in her home in an Uber
- 13:26to go to family members house for dinner and playing games.
- 13:30And 9:48 PM she was dropped off where she lives alone.
- 13:33The garage door opened at that time, closed 2 minutes later,
- 13:371:47 AM. The doorbell camera, we went
- 13:39over this, but you know, the doorbell Cam, the pacemaker
- 13:43disconnects and she didn't go to church and family goes to check
- 13:49in on her. She's not there.
- 13:51And then what they said is what they put here is what the
- 13:54investigation has uncovered so far, it's very little that has
- 13:58come out. The blood on the porch.
- 14:00Her cell phone was left at home. No suspect or person of interest
- 14:04has been identified. It we did see that her car was
- 14:09being towed from her residence over the weekend.
- 14:12We know that she has heart health issues.
- 14:17We really just don't know much at all.
- 14:20We understand that the deadline for the ransom is in 45 short
- 14:26minutes if my math is correct. I might be wrong on this.
- 14:29Like 5:00 PM mountain time today is that second Monday deadline.
- 14:37Couple things from CNN. Ransom letter demands $6
- 14:40million. We learned over the weekend new
- 14:46details have emerged about the ransom demands for Nancy Guthrie
- 14:49safe return, with CNN affiliate K Gunn reporting that the
- 14:53purported kidnapper or kidnappers have demanded
- 14:566,000,000 and threatened Guthrie's life if a 5:00 PM.
- 14:59Monday deadline isn't met, citing a ransom note sent to the
- 15:03station. So purported ransom notes sent
- 15:06to Kagan and other media outlets demanded millions in Bitcoin in
- 15:10exchange for a return, CNN previously reported.
- 15:14And then of course, they said that they would pay.
- 15:18So $6 million is what we, what we understand is the ransom.
- 15:25This does bring up questions of should we be paying ransoms and
- 15:32is this just encourage other behavior like this?
- 15:39You know, to my memory, to my knowledge, the idea of
- 15:43kidnapping for ransom is an old practice here in the United
- 15:47States. I know it's not so old in other
- 15:50in other countries, but here in the United States, it just
- 15:52doesn't happen very often. OK, so the next thing I wanted
- 16:00to bring was from. CNN says what experts believe
- 16:03the latest video means for the apparent ransom demands.
- 16:08The 4th video posted to social media by the Guthrie family as a
- 16:11direct appeal to the public and could indicate a shift in the
- 16:15investigation as a second purported ransom deadline
- 16:18approaches, experts tell CNN Today.
- 16:22Hosts Savannah Guthrie posted a video Monday today saying the
- 16:26family believes Nancy Guthrie is still out there.
- 16:30Guthrie's possible abductors are demanding $6 million by 5:00 PM
- 16:34today, CNN affiliate K Gun previously reported, citing A
- 16:38purported ransom note sent to the station.
- 16:41The note included a threat to Guthrie's life if the deadline
- 16:43is not met, according to K Gun. Rallying the eyes and ears of
- 16:47people across the country is 1 objective of the video,
- 16:50according to CNN's chief law enforcement and intelligence
- 16:53analyst John Miller. Regardless if the ransom demands
- 16:56are real or not, what she's really saying is we need
- 17:00everybody in the game here. Miller told CNN.
- 17:03We don't want everybody to stop looking.
- 17:06And that actually is a danger here, right?
- 17:09That I mean, when let me just this sounds so self-serving.
- 17:14But last week when we were talking about Nancy Guthrie, we
- 17:17were getting 2000 people watching the show.
- 17:21Right now we have 824 according to my little stream deck here,
- 17:27right? So it we are in danger of losing
- 17:31interest nationally. And that video from Savannah
- 17:36Guthrie saying we need more than your prayers here.
- 17:39We need your eyeballs. And I think this analyst is is
- 17:44spot on. Meanwhile, the Guthrie family
- 17:47has likely not received a response to previous videos
- 17:50directly addressing possible captors amid purported ransom
- 17:53demands, according to CNN senior law enforcement analyst Andrew
- 17:57McCabe. This message does not sound like
- 18:00the message that you would expect to hear from a family
- 18:02that is currently negotiating the return of their loved one,
- 18:06McCabe told CNN. Also a possibility investigators
- 18:10may now believe the ransom demands are not legitimate,
- 18:13according to Frank Filiusi, former assistant director of the
- 18:19FBI Counterintelligence Division.
- 18:21So we're still, we're still wondering, hey, are these are
- 18:26these real or not? Are these demands real?
- 18:33This one from KOLD Savannah Guthrie post new message calling
- 18:37search for her mother. An hour of desperation, man.
- 18:43Certainly we watched the video. I just, I just want to let's
- 18:50see. Oh, yeah.
- 18:54There, there are a couple items in here that I think are
- 18:56important beyond just the video that we watched.
- 18:58OK, so let me just read this. Savannah Guthrie posted another
- 19:00message to social media today, February 9th as the search for
- 19:04her mother Nancy Guthrie continues into its second week.
- 19:08Thank you so much for all the prayers.
- 19:10Savannah said in the video. She also said we believe our
- 19:12mother is still out there, we need your help and added we are
- 19:15at an hour of desperation. The Pima County Sheriff's
- 19:18Department says it will continue to maintain a presence at the
- 19:21home of Nancy Guthrie for security reasons.
- 19:24PCSD says this is at the request of the Guthrie family.
- 19:28I know that there's been some criticism of leaving the scene,
- 19:33releasing the scene, going back to the scene, securing the
- 19:36scene, leaving the scene, going back to the scene, and so forth.
- 19:41Now it appears that they're out there just for security.
- 19:45So that from Kold, I have a couple more.

- 22:56been accompanied by specific instructions on the return
- 22:59exchange. I guess I'm just not an expert
- 23:02on ransom notes. The, I think the instruction
- 23:10they gave them was on the on the deposit, right?
- 23:17And we understand that the second note had something about,
- 23:21no, the first note had something about bringing her back to
- 23:26Tucson. So I don't know that we know if
- 23:30they, if there weren't any specific instructions, we
- 23:33haven't seen the note. We've just seen
- 23:35characterizations of the note. Just my two cents.

- 23:42Does the pacemaker disconnecting mean it stopped working or just
- 23:45not able to monitor any longer? What keeps a pacemaker working?
- 23:48I'm not medically smart, nor am I.
- 23:53However, from what I understand it was a dis a Bluetooth
- 23:57disconnection, probably due to distance.
- 24:01It probably wasn't. It disconnected because her
- 24:03heart stopped beating. If the heart stopped beating or
- 24:07there was some sort of arrhythmia, the pacemaker would
- 24:10do its job, right? It would shock the heart.
- 24:14So I I think that from everything that I can tell, it
- 24:19is that her person was taken far away from her phone and her
- 24:26watch. Chasing Sunshine says today's
- 24:30post from Savannah is heartbreaking, but more hopeful.
- 24:32Nancy is alive. Let's see, they could use some
- 24:37good press. And if they can, if they can
- 24:42grab Venezuela's president, then they can find Nancy.

- 28:49remains empty as deadline approaches.
- 28:52Remember that it's a bit point Bitcoin account that they that
- 28:55they gave to three media outlets, which includes TMZ and
- 29:03they were able to verify that the account was real.
- 29:06This was just reported a couple hours ago.
- 29:09A Bitcoin account allegedly set up to accept funds in exchange
- 29:12for Savannah Guthrie's missing mother, Nancy, is still sitting
- 29:16empty Monday morning, with time quickly winding down on an
- 29:20alleged deadline, which is about 31 minutes from now.
- 29:23Over the weekend, Savannah and her family responded to a ransom
- 29:27message saying they will pay the $6 million demand to have their
- 29:31mother returned to them. The alleged note requested
- 29:34payment by last Thursday, but it also listed a second deadline of
- 29:38today at 5:00 PM local Tucson time, which is Mountain time to
- 29:43my understanding. It's unclear how long it
- 29:47typically takes for accounts to update, but as of now, the
- 29:50confirmed balance in the publicly viewable account stands
- 29:53at zero with no transactions recorded.
- 29:57On Sunday, the Pima County Sheriff's Department said the
- 30:00investigation is ongoing, said they still have no suspects or
- 30:04person of interest in the case. Also on Sunday, investigators
- 30:07were seen searching a septic tank behind Nancy's Tucson home.
- 30:11And I, I have heard commentary on that that is stated.
- 30:14Well, maybe, you know, they're probably following multiple
- 30:23parallel investigative lines, right?
- 30:29As you know, Nancy was reported Mia February 1 after failing to
- 30:33show up to church. Her daddy and her daughter Annie
- 30:35and her husband Tomaso Sione were the last ones to see her
- 30:39just the night before. So that's what that's what TMZ
- 30:44has said. And then the last, the last
- 30:48article that I wanted to bring to you guys is just illustrative
- 30:53of the fact that we know very little publicly.
- 30:55OK, the headline is Nancy Guthrie case key evidence
- 30:59released so far from Safia Sami Ali.
- 31:05OK, so here are the things that we know so far.
- 31:07Surveillance camera was removed from Nancy Guthrie's home.
- 31:12A Ring camera mounted at the front of the home appears to
- 31:14have been removed, a detail investigators are now examining.
- 31:18The camera recorded a person on the camera alert at 2:12 AM on
- 31:22Sunday. However, they were not able to
- 31:25get that video. Item number 2, Nancy's pacemaker
- 31:30stopped syncing. Authorities said Guthrie's
- 31:32pacemaker stopped syncing with her Apple devices on 2 at 2:28
- 31:35on Sunday. Guthrie is considered a
- 31:38vulnerable adult, officials said, noting that she has
- 31:41difficulty walking, has a pacemaker and requires daily
- 31:44medication for heart condition. The third item is there was
- 31:49blood found on the porch and it belongs to Nancy Guthrie. 4th is
- 31:54ransom letters were sent to news outlets.
- 31:56And that is all. That's all that we really know
- 32:01in this case. And so, guys, we're just going
- 32:04to have to, I mean, listen, I, I don't want to be passive about
- 32:09this. I don't, I want us to be
- 32:10proactive. We want to live life
- 32:15purposefully. We don't want to just passively
- 32:17watch as news passes us by, right?
- 32:21So if you see something, let's watch that video one more time

- 33:34is lifting her up in her darkest day.

- 33:39like that. We believe our mom is still out
- 33:42there. We need your help.
- 33:50Law enforcement is working tirelessly around the clock,
- 33:54trying to bring her home, trying to find her.
- 33:57She was taken and we don't know where, and we need your help.
- 34:05So I'm coming on just to ask you not just for your prayers, but
- 34:10no matter where you are, even if you're far from Tucson, if you
- 34:14see anything, you hear anything, if there's anything at all that
- 34:18seems strange to you that you report to law enforcement, we
- 34:26are at an hour of desperation. Yeah.

- 34:38they think maybe time is running out.

- 35:07that makes the lead, says former FBI agent Brianna Fox, a former
- 35:14FBI agent and professor of criminology at the University of
- 35:17South Florida lauded Savannah Guthrie's decision to ask for
- 35:20help from the public after the shocking disappearance of her
- 35:23mother over a week ago. Often times it is the public
- 35:26that makes the lead that leads to the end of the case, she told
- 35:31CN NS Jake Tapper Monday. She pointed to the Brown
- 35:35University shooting in which a tipster who spotted the suspect
- 35:38and his vehicle helped crack the case open for investigators.
- 35:42The arrest of suspects in the shootings of conservative media
- 35:45personality Charlie Kirk and United Healthcare CEO Brian
- 35:48Thompson also relied on the broad dissemination of
- 35:51information to the public and tips, Fox said.
- 35:54I really think that is what's going to break the case open.
- 35:58So let's, let's take that to heart and call law enforcement.

- 42:02So I went down, I went down with a couple of my coworkers, couple
- 42:07of my colleagues, and we met at this at this restaurant in
- 42:12Beverly Hills that was packed to the gills, man.
- 42:15And I didn't, I mean, I didn't think it was bad, but I didn't
- 42:18think it was all that right, especially considering what the
- 42:22bill was crying out loud. But when the server came over to
- 42:26our table, she was like, so are you here because you've seen us
- 42:30on whatever the Housewives of Beverly Hills was?
- 42:35No, I'm just grabbing something to eat and I'm going to have a
- 42:38meeting in the morning. It was so obnoxious.
- 42:42It was so obnoxious to me that it, it just put me off of all
- 42:46the, I mean, I'm not like I'm not the, the key demographic of
- 42:52those shows anyway. But yeah.

- 43:12I do not limit my screen time because I make my living and
- 43:17always have on screen. I, I require screens.
- 43:21I am a bit of a workaholic from the time that I'm up to the time
- 43:26that I go to bed. I, I typically, of course, you
- 43:31know, there are breaks in between there, there's family
- 43:33time and dinner time and stuff, but I'm typically at working in
- 43:35front of a screen. Our kids on the other hand, we
- 43:41we definitely limit that we don't, we don't like our kids to
- 43:46just be slaves to the old screen.

- 44:13limit my screen time. We do limit the screen time of

- 44:46couple headlines that I want to bring to you today.
- 44:48Just just two. Headline number one comes to us
- 44:52from floridatoday.com. Anna Kepner's mom says
- 44:55stepbrother to face first degree murder charge is written by
- 44:59Michelle Spitzer and this came out on Saturday.
- 45:04The stepbrother of Anna Kepner, the Florida teen found dead on a
- 45:07cruise ship, is being charged with first degree murder,
- 45:09according to Kepner's mom. Remember, this is not according
- 45:13we we don't. So far this case is sealed.
- 45:17But anyway. Kepner, an 18 year old
- 45:19cheerleader from Titusville, FL was found dead under a bed
- 45:22November 7th by a person cleaning the cabin she shared
- 45:25with her stepbrother and another sibling aboard the Carnival
- 45:29Horizon. Her death was ruled a homicide
- 45:32and she reportedly died by strangulation.
- 45:35FBI officials confirmed they are investigating the case, however
- 45:38they have not released any information about potential
- 45:41suspects. The FBI did not return a call
- 45:43seeking comment. Court documents related to a
- 45:46custody case involving the stepbrother's parents had
- 45:49earlier revealed the 16 year old was being mentioned as a
- 45:52suspect. And the 16 year old's
- 45:54stepbrother reportedly appeared before a federal magistrate in a
- 45:57locked Miami courtroom on Friday.
- 46:01Quote, they are going to charge her 16 year old stepbrother with
- 46:05first degree murder and they're going to be some other charges
- 46:08brought but I'm not sure what they are yet.
- 46:10Until they tell me, I don't know more.
- 46:12Kepner's biological mom, Heather Wright, posted on her Tiktok
- 46:16account. The roughly 32nd video does not
- 46:20mention where she is getting her information.
- 46:23I wonder if that links over to Tiktok.

- 46:32I got some news today on my daughter's case.
- 46:35They are going to charge Timothy, her 16 year old
- 46:41stepbrother for first degree murder and there's going to be
- 46:45some other charges brought but I'm not sure what they are yet.
- 46:48Until they tell me I don't know. So as of right, that is one of
- 46:54the charges and as soon as I know more, I will let you guys
- 46:56know. Thank you.
- 46:57OK, Okie dokie. So that's how that's how we
- 47:03learned about that. Second came to us also on
- 47:07Saturday is Luigi Mangione facing double jeopardy.
- 47:11Here's what experts say. Double jeopardy is a legal, what
- 47:17do we want to call it, concept. In the United States, you can't
- 47:22be put on trial for the same crime after you have been
- 47:27acquitted of that crime, basically is kind of how that
- 47:29goes. Luigi Mangione made rare public
- 47:33comments on Friday at New York State Supreme Court after a
- 47:36judge declared that his state murder trial will start in June,
- 47:40just months before his federal trial is set to begin.
- 47:43Mangione has been charged with stalking and murdering United
- 47:46Healthcare CEO Brian Thompson and faces multiple firearm
- 47:49charges. He has pleaded not guilty on all
- 47:51counts. As he was being LED, cuffed and
- 47:54shackled out of the courtroom, Mangione turned to the gallery
- 47:57and spoke. It's the same trial twice, he
- 48:00said, firmly surprising the audience since he has barely
- 48:03ever spoken in court before. 1 + 1 is 2 double jeopardy by any
- 48:08common sense definition. Mangioni's remarks came after a
- 48:13tense pretrial hearing in Manhattan, where Justice Gregory
- 48:16Caro set a June 8th date for a state trial.
- 48:19Last month, Judge Margaret Garnett, who's presiding over
- 48:22the federal case, announced that the federal trial would begin in
- 48:26September of this year. If the federal date changes,
- 48:29Caro said he would push the state trial to September.
- 48:32Mangioni faces murder and firearms charges in New York
- 48:35State and stalking charges in federal court.
- 48:37He also faces firearms and forgery charges in Pennsylvania.
- 48:41Mangione's defense team vehemently objected to the
- 48:44summer state trial date. Mr. Mangione is being put in an
- 48:48untenable situation because this is a tug of war between two
- 48:52different prosecution offices, his lead defense attorney, Karen
- 48:55Friedman Agne Filo, told the judge on Friday.
- 48:59She said Assistant District Attorney Joel Seidman wants this
- 49:02case to go forward because he does not want the potential of
- 49:05his case being double jeopardied out because he did all the work
- 49:08on this case. Seidman responded that if
- 49:11Mangione's defense were to argue double jeopardy, they'd be
- 49:14seeking to deprive the prosecution agency, the
- 49:17prosecuting agency on a local crime, a murder that happened in
- 49:20midtown on our streets of a guest to our city.
- 49:23He added that Brian Thompson's family has asked federal
- 49:25prosecutors to let the state go first after court.
- 49:30He told the press double jeopardy is meant to protect
- 49:33people and they're using it as a weapon here.
- 49:35It's unfair. So what exactly is double
- 49:37jeopardy and how does it and does it apply to Mangioni's
- 49:40cases? Put simply, the Double Jeopardy
- 49:43Clause of the 5th Amendment is meant to protect a person from
- 49:46being prosecuted twice for the same offense.
- 49:49This was in Rolling Stone, by the way.
- 49:51According to lawyers who spoke with Rolling Stone, double
- 49:53jeopardy can't officially come into play until someone has been
- 49:56convicted or acquitted of a crime.
- 49:58Meaning if Mangioni was found guilty in one trial, his team
- 50:01could argue double jeopardy to try and get the second
- 50:03indictment dismissed ahead of a second trial.
- 50:06Right now, Mangione has not been convicted in any of his three
- 50:09cases. So, oh, let me just do this.
- 50:15These next two and the double jeopardy protections come with
- 50:18nuances. For example, the separate
- 50:20sovereigns doctrine allows the federal and state court to
- 50:22prosecute the same defendant for the same act if the ACT breaks
- 50:26both federal and state laws. This doctrine was used during
- 50:29the civil rights area era. If a white defendant was found
- 50:32not guilty of murdering a black victim in state court in the
- 50:35South, for example, he could still be tried for a civil
- 50:37rights violation in federal court.
- 50:40Plus, if the crimes are considered substantially
- 50:42different and are distinguishable from one
- 50:44another, even if they come from the same act, they can still
- 50:47both be prosecuted. In this case, Mangione's state
- 50:50charges are murder and firearms offenses, and his federal
- 50:54charges involve Interstate stalking, which led to conduct
- 50:57that caused the death of Thompson.
- 50:58So I guess they will argue that the closer Well, they'll have to
- 51:05argue it if he gets convicted, I guess.
- 51:08And those are your headlines, true crime headlines.

- 54:06active and ongoing. We understand the significant
- 54:08public interest in this case. However, investigators need time
- 54:11and space to do their work. If and when relevant information
- 54:15becomes available, it will be shared.
- 54:17They say there's going to be no press briefing scheduled right
- 54:20now unless something happens. And then they say many of you
- 54:23observed an active law enforcement presence at the
- 54:26Guthrie residence over the weekend.
- 54:27Yes, we did. That activity will continue
- 54:30tonight and into tomorrow as part of the ongoing
- 54:32investigative process, including the expansion of the search and
- 54:35follow up on new leads. So that's interesting there.
- 54:39I don't know if we're going to see them coming back out here.
- 54:42This is all part of the investigative process as the
- 54:44search for Nancy expands and new leads come in to preserve the
- 54:48integrity of this criminal investigation.
- 54:50Details of that process are not being released at this time.
- 54:53It's interesting that they say new leads are coming in.
