  from Mr. Investigates is that he has an issue.

  He has allegations against him from Jamie Phillips, his former

  girlfriend, saying that he was abusive.

  And of course, these are allegations only, they are not
• 5:12
  proven. But why don't we start with the

  document that we got from from the Circuit Court out in
• 5:22
  Arkansas. This is a what do we call this
• 5:28
  is a transcript of a very, very short hearing that took place on
• 5:36
  the 17th same day, by the way, that they pushed a hearing to
• 5:43
  the 21st of next month. I'm not quite sure on that.

  I I do have a call in to the court, but anyway in so the
• 5:51
  court this document says on the 17th.

  Again, this is a transcript Jamie Phillips versus Jonathan

  Rich's 26 Dr. 2651 Division 2. Council is present with

  petitioner. That would be Jamie Phillips and

  counsel is present with respondent that would be

  Jonathan Lee Rich's All right, Would you like to read your

  I believe I believe this is counsel for the petitioner, also

  hearing. So what has happened here is the

  judge continued the hearing until April 21st because they

  have to file this agreement, right?

  This this agreement that neither party will contact the other for

  a period of three years. They have to get it on the
• 7:57
  calendar for the court and it will be taken off the calendar
• 8:01
  once that agreement is official. Got the little stamp O approval.

  So we probably won't see Mr. Rich's nor will we see Miss
• 8:13
  Phillips in court on the 21st is my guess.

  Basically, it boils down human behavior always boils down to

  incentives, right? Judge, one of the incentives

  that judges work under is a is whether they are efficient at

  getting through their work, clearing the docket, so to

  speak, right? So a judge will continue cases

  as long as there is a good reason to continue cases.

  There's no statutory maximum that I'm aware of and any place
• 10:42
  here in the fruited plain. But they also don't want to be
• 10:48
  looking at cases forever. They're like, let's clear this
• 10:51
  docket. I got 18,000 cases we need to
• 10:54
  get through. So that is the balance that

  we're going on here. In the case of Mr. Riches and

  and Jamie, AKA Magnolia, I don't think this will be continued

  ever again. I think they will, their lawyers

  will file their agreement for a PFA from each other for three

  years and that will be the end of it.

  Anyway, when they asked me if I wanted to go up in the air, I

  actually had to kind of say to myself, do you have enough

  useful load in your plane to take a big old fat fatty like me

  So I'm well over 100 lbs overweight.

  So I got my act together. I'm not taking any medication.

  I simply am exercising a lot. I am moving a lot because I have

  naturally pretty sedentary lifestyle and I am counting

  calories. I'm living in a calorie deficit.

  I, I'm never hungry, but I make sure that I don't surpass what

  my caloric budget is in a day. At the same time, I'm growing
• 14:07
  out my hair and it is completely changed my look.
• 14:10
  But thank you very, very much. That is, that is why I look the

  way I do. And I, oh, today on the scale, I
• 14:18
  was 205.6 lbs. So, yeah, well over 80 lbs lost

  on my way. Well, I'm also building muscle,

  paradigm from 1 of blaming the victim to understanding the
• 16:31
  complicated nature of DV, the coercive nature of it, the
• 16:36
  abusive nature of it beyond just the violent part of it, right.

  This is very important for us to understand because there are so
• 16:46
  many and it's the reason that I decided to cover this case in
• 16:48
  the 1st place. You guys can ask the mods in our

  happened with JLR. Do we really want to tread into

  as a motivator for someone not to act in their own interests,

  well, that's let me correct that in in in saying that fear is a

  motivator for many different things.

  But in this example, I think this will clarify what fear

  ago, I saw ATV show either on The History Channel or the

  Learning Channel, I can't remember.

  It might have been the military channel, but it was a show about
• 19:33
  prisoners of war, military prisoners of war.

  And in that show they talked about.

  Whoa, whoa, whoa. Let's pause for a second and
• 19:40
  let's just stop and think about this, OK?

  Stop and think. A person who is a victim
• 19:47
  survivor of DV is like a prisoner of war.

  Oftentimes they're prisoners in their own lives, in their own,
• 19:55
  sometimes in their own heads, sometimes in their own hearts,
• 19:58
  in their own homes. It is like being a prisoner of
• 20:03
  war, continuing with O'Brien said.

  Different disciplines within the military, pilots, special
• 20:07
  forces, people in combat situations particularly, and
• 20:13
  these are individuals who have gone through something called
• 20:16
  SEER training, which is escape and evasion school and what is
• 20:20
  designed to do. The military has poured in
• 20:22
  billions and billions of dollars to specifically train various
• 20:27
  soldiers in specific disciplines to how to evade capture and if
• 20:34
  they are captured, how to deal with the trauma, the terror, the
• 20:40
  manipulation, psychological torture, physical torture in
• 20:44
  those situations. And again, billions of dollars
• 20:47
  have been spent doing this. By the way, I am a child of an
• 20:52
  Air Force veteran and I've heard the stories of the Vietnam era
• 20:58
  and I've heard the stories that my dad has told me about this
• 21:02
  kind of training, right, all the way back in the 60s, this kind
• 21:06
  of training on how to escape, evade capture and so forth,
• 21:11
  right? So what what Brian is talking
• 21:13
  about here. And by the way, I have loved,
• 21:17
  I've loved all the comments about Brian's hair.

  That has been so much fun. But what Brian is talking about
• 21:26
  here is absolutely true that that the military spends so many
• 21:35
  resources teaching people how to escape from situations of being
• 21:41
  a prisoner of war, right? And remember, being a victim
• 21:46
  survivor is often you are a POW. And real quick before I I
• 21:50
  continue the video, Jenny, thank you very much for that super

  And one of the things they discussed during the program is
• 22:02
  they talked with prisoners of war who had been, you know, PO
• 22:05
  WS in various conflicts. World War 2, Korea, Vietnam was
• 22:09
  primarily the the framework that they used.
• 22:12
  And some were prisoners of war for years, some just days.
• 22:16
  But they asked them this question.
• 22:18
  They said, did you ever try to leave?
• 22:22
  And by the large majority, most of them said no.
• 22:28
  And it was for two very particular reasons.
• 22:31
  One reason given was I had a pretty good idea that I could
• 22:35
  escape, but I was afraid of what would happen to me if I got
• 22:38
  caught. The other answer was I saw
• 22:42
  opportunities to escape, but I was afraid of what would happen
• 22:46
  to my buddies that were left behind.
• 22:50
  If this is the conversation that trained military professionals
• 22:54
  with billions of dollars of training have with themselves
• 22:58
  making a decision to stay in a, in a, in a violent terror filled
• 23:03
  situation and they can't do it. You know, they're, they're,
• 23:08
  they're, they're making a decision to not do it for good
• 23:10
  reasons. Why would we expect a domestic
• 23:13
  violence victim who's a prisoner of war in their own home to make
• 23:15
  to make any other decision? Very good point, yeah.
• 23:19
  You know, and, and obviously the point is, is that these
• 23:23
  individuals in their homes have a lot less resources and a lot
• 23:26
  less training than these military professionals who are
• 23:30
  by most accounts, people would say, well, the military
• 23:32
  professionals are trained to be tough and, you know, pushed
• 23:35
  through adversity and deal with pain and, and discomfort.
• 23:40
  And still react the same way to the same incentives.
• 23:42
  Still react the same way because of fear.
• 23:45
  Yeah, so that is the clip that I have.

  world, especially when you and I kind of make a hobby out of out

  of focusing on kind of the bad stuff.

  DV victims are isolated, gas lit and told over and over it's
• 25:50
  their fault. Often DV victims come from homes
• 25:53
  where DV occurred. The victims have a misbelief
• 25:56
  that this is normal. I think that is true.

  Cindy, RN retired, says I've been out of my situation for 35
• 26:03
  years but still carry the trauma bond.

  Gavin, back then, the state didn't press charges.

  They made the victim tough, tough.

  I'm I'm I'm glad that things are changing, Shawnabo says.

  I'm a forensic nurse in Washington state.

  I've only ever seen the state file charges.

  I've only ever been subpoenaed for the state.

  Yeah, I would. I don't think that she, I don't

  think that she has char or filed like private criminal charges.

  I know some states allow that, but typically there has to be
• 26:42
  charges filed by an agency that is empowered to to enforce the
• 26:49
  law and ADA has to pick it up, right.

  So, yeah, we'll see what happens.

  Generally victims stay because the fear of leaving is greater
• 29:34
  than the fear of staying. Fear of the unknown can be a
• 29:38
  powerful reason for staying put. Also, victims are often
• 29:42
  threatened with physical harm if they try to leave.
• 29:45
  It is well documented that victims are at the most risk of
• 29:48
  injury when they are leaving. They fear for their safety and
• 29:52
  the safety of those who helped them.
• 29:54
  That reminds me, do you know about this case?

  Is this a case that you know about?
• 30:03
  This is Ellen Greenberg. Ellen Greenberg was a 27 year
• 30:08
  old elementary school teacher who in my opinion, was living in
• 30:14
  an abusive relationship. The the evidence to me shows her
• 30:18
  body was bruised all over the place.
• 30:20
  She had strangulation marks on her neck.
• 30:22
  She had hemorrhages inside her neck.
• 30:25
  And at the time when I believe she was attempting to leave was
• 30:30
  the time that she was killed. So, yeah, it's the most
• 30:35
  dangerous moment. The the most dangerous moment in
• 30:41
  an abuse victim's life is that moment when they're trying to
• 30:46
  leave. What's another reason victims
• 30:48
  try to stay? Promises of reform.
• 30:50
  The abuser promises that it will never happen again.
• 30:53
  And the victim wants to believe that this is true.
• 30:56
  And they're, and they're convinced of it.
• 31:00
  Control. Many victims feel they have more
• 31:02
  control by remaining in an abusive relationship.
• 31:05
  They know their abusers whereabouts and moods and
• 31:08
  therefore know how to act in the way that will be least likely to
• 31:13
  trigger their temper. The victim fears that if they
• 31:16
  attempt to leave, the violence could extend to their family or
• 31:19
  friends who are helping them escape.
• 31:21
  The victim's identity has been lost because for the duration of
• 31:24
  their relationship, the abuser has made many of their life
• 31:27
  choices for them. The the abuser has encouraged or
• 31:31
  completely forbidden the victim to see their friends and perhaps
• 31:34
  even keep their job, which means they're completely reliant on
• 31:38
  the abuser for financial and emotional support.
• 31:43
  This article says guilt may be a reason that somebody might stay.
• 31:47
  The victim may believe that the abuser is sick and needs their
• 31:49
  help. The idea of leaving can thus
• 31:52
  produce feelings of guilt, Right.
• 31:55
  Sometimes it's lack of self esteem, sometimes it's children.
• 31:58
  Being a single parent is a strenuous experience under the
• 32:01
  best of circumstances, and for most victims, conditions are far
• 32:05
  from the best. The enormous responsibility of
• 32:08
  raising children alone can be overwhelming.
• 32:11
  Often the abuser may threaten to take the children away from them
• 32:13
  if the victim leaves or attempts to leave.
• 32:17
  Then love and finances. Most people enter a relationship
• 32:20
  for love and the emotion does not simply disappear in abusive
• 32:23
  relationships. And a lack of money can make
• 32:27
  these situations even harder because many options for leaving
• 32:30
  require payments such as a hotel fee or a plane ticket.
• 32:35
  If the victim does not have the means to do these things, many
• 32:37
  of their options disappear. And add into that that the
• 32:41
  abuser may take away their financial, you know, their
• 32:46
  credit cards, their, their debit cards may empty their account
• 32:51
  may do all sorts of financial abuse towards them.
• 32:59
  Let's see a couple, couple of other things that I found.

  relationships for many different reasons and it can be very

  difficult for a woman to leave an abusive partner even if she

  wants to. Like any other relationship,

  when the ends in abuse began with falling in love and being
• 34:58
  in love. Abuse rarely starts at the
• 35:00
  beginning of a relationship, but when it is established and often
• 35:05
  harder to leave. When the relationship is
• 35:08
  established, a woman may still be in love with her partner and
• 35:12
  believe him when he says he's sorry and it won't happen again.
• 35:15
  She may be frightened for her life or for the safety of her
• 35:18
  children. If she leaves, she may have
• 35:20
  nowhere to go. She may have no financial
• 35:22
  independence. She might not be sure what will
• 35:25
  happen to her immigration status.
• 35:28
  Abusers often isolate their partners from family and friends
• 35:32
  in order to control them. Remember Micah's list guys?

  for an abused woman to exit the relationship.

  Leaving can be the most dangerous time for a woman.

  Careful planning is important because abusers can become more

  think about ways to keep safe while leaving and afterwards.

  first, right? Could I be a good father if I

  I I, I that is not possible because I would be setting the

  example to my children that it's OK to violently attack my wife

  and it's obviously not. Yeah, reality.

  Non abusive family members often go to great lengths to try to
• 37:24
  shield children from the effects of domestic abuse.

  Unfortunately, in most cases, children will be fully aware of
• 37:31
  the abuse and evidence shows that children are acutely aware
• 37:35
  of the controlling behavior of adult perpetrators of abuse and
• 37:38
  themselves attempt to manage the effects of this abusive
• 37:42
  behavior. And that is absolutely 100%
• 37:48
  true. OK, there is one other I was
• 37:53
  trying to find. There was one that I found that
• 38:01
  had to do with making excuses for people who are not pure as
• 38:09
  the wind driven snow. But I don't, I don't see it.

  Now let me see if I can find it real quick because this one's

  means that we are blaming the woman and relieving the abuser

  alone. If someone confides in you that

  they are experiencing domestic abuse, there's some simple

  things you can do to support them.

  However, if the person you are worried about has not directly

  disclosed the abuse to you, it can be more difficult to support

  them. But it's good to understand how

  service or whatever it was scheduled to do that day.

  and then depending on where we were, like some, some areas

  everything closed down. And so we would take a siesta.

  We'd get up in the early afternoon, we'd go back out and

  work until late, late, late, late, late, late.

  It was not uncommon to be out at 1011, you know, midnight, kids

  still out on their porch drinking matte and stuff like

  but a celebration of our 25th anniversary.

  let's check out Spain. So we went and we rented a car.

  It drives me crazy. Every time I go to Europe, I

  want to be able to drive a manual transmission car and they

  But both Kimberly and I grew up poor.

  We, we went up into another part of Portugal to see some other

  making a move to Portugal at the time, just like a year long kind

  of radical sabbatical. So but by the time we got into

  Spain, it's like noon the entire country is just crickets, man.
