  murder of the 14 year old Celeste Rivas Hernandez, the

  Lake Elsnor teenager who was lured away from her family in a

  an act of predation in what I think is just a disgusting

  predatorial act. But he hasn't been convicted of
• 5:06
  anything yet. This is all alleged by this guy,

  a man named David Anthony Burke. And we refer to him not so
• 5:15
  lovingly around here as Deformada with props and
• 5:19
  admiration to Pascal, who kind of coined that, at least for me.

  I I think he he probably is the one.

  He's the one. I got it for sure.

  So Deformada, this guy right here who is used to the public
• 5:34
  seeing him all polished, you know, be costumed and all, all
• 5:44
  just beautified and everything. But these days, not so much.

  He in jail. He in jail and he in court
• 5:54
  sometimes, but most of the time he in jail.

  And I think I'm just going to say this caveat, right?

  If he did the things the prosecutors say he did, then he

  going to be in jail a long time and I hope for the rest of his

  life. Celeste was found.

  She was discovered September 8th, 2025, a day after her 15th
• 6:24
  birthday, in the trunk of Mr. Burke, Mr. de Forvide Burke's

  car. She was dismembered.

  She was badly decayed. She was unceremoniously and
• 6:41
  unlovingly torn apart and and stored away, hidden from
• 6:51
  everybody that was looking for her.

  And and yeah, she was a child. She she was lured into this from

  the age as early as 11, we understand she began
• 7:04
  communicating with Mr. Vada and, you know, got kind of sucked

  into his gravitational pull and eventually got past the old

  event horizon and could not get out.

  And prosecutors allege that Mister Vada stabbed her to

  death, let her bleed out, then with a chainsaw, divided her

  asunder and stuck her into bags and eventually into his car.

  It's it's a disgusting, disgusting case.

  That is, I mean, this should not only horrify, but it should

  messages. So if they have tons of digital

  activity and forensic evidence and, and all that stuff,

  especially the concealment part of things, then I think that

  this defense is really hard to sustain.

  But I think from the defense perspective, this is probably

  the most likely. This is the most likely defense

  in my opinion. Now, there are a couple like who

  are the classic people or cases that kind of prevailed on this

  or at least tried. The the one that comes to mind

  that's the most obvious is OJ Simpson, right?

  The defense didn't have to prove that somebody else killed Nicole

  Brown Simpson and Ron Goldman, but they were able to create

  doubt about the timeline. They were able to attack the

  integrity of the police. I mean, this actually happened

  in the Karen Reed case, right? Go after the police little bit

  they were able to suggest manipulation of the crime scene,
• 32:56
  contamination of the crime scene and imply or outright just say
• 33:03
  alternative possibilities. So the, I mean, the key to the

  OJ Simpson acquittal is they were basically they convinced
• 33:14
  the jury, hey, you cannot or the the prosecution did not
• 33:18
  conclusively prove that OJ committed the murders beyond a
• 33:21
  reasonable doubt. And that is very similar to what
• 33:26
  defense attorneys might be able to say.

  You can't conclusively prove what happened after she left.

  And I have the benefit of having been in a jury room deliberating
• 33:39
  with 11 other people on a homicide.

  And I'm telling you, there are people that make it onto a jury

  that are absolute idiots. They're stupid.

  They don't. They didn't listen to the

  evidence. They, they draw conclusions that

  they just have to leap to. So, you know, conclusivity does

  Another example that I thought about was Casey Anthony, right?

  public opinion, but it's not the case, right?

  And he did. Let's see, jury convicted him in

  2003 sentencing, sentencing him to life without parole, but it

  was overturned and then he he entered a plea of voluntary

  manslaughter. It it was, it was weird.

  Another another one I I think kind of applies here might be

  the Karen Reed trial, right, where prosecutors claim that

  that she murdered him by running him over.

  But the defense argued no, that this happened very differently

  And the physical evidence, according to the defense,

  Walters was poisoned to death by Brandon Wells and then stuffed

  cover up the crime. The idea was to take that drum

  and to bury it in the woods, but he injured himself, I think it

  was his shoulder or something, and could not carry that out

  there. And when he was discovered, he
• 46:39
  told police, I put her in that drum in the bedroom and locked
• 46:44
  the door, 'cause I didn't want the children to see their mom
• 46:49
  like this. That was the defense.

  I didn't do it. And I sat through that entire
• 46:57
  trial in the courthouse with my little notebook and pen and I
• 47:05
  watched the prosecution tear that apart and basically go,

  guys, jury, are you going to let him get away with this?

  Are you honestly use your common sense?

  Who puts a woman in a barrel? Who does that?
• 47:21
  A guilty person does that. Somebody trying to cover up a
• 47:23
  crime does that. And then they had evidence of

  him buying the food that was laced and growing the the
• 47:30
  mushrooms that that she was poisoned with the whole thing.

  So, yeah, that, I mean, that's a, that's a very good example of

  that. The third, the third, I guess

  defense, we've kind of touched on it, but I was thinking about

  this and I have seen this happen and successfully sometimes.

  And the defense is investigators jumped to a conclusion that it

  investigators because he was the closest one and they needed.

  They were under pressure, they were under public scrutiny,

  international attention on this and and they just jumped to that

  conclusion and, you know, they were emotionally charged.

  There was all this Internet pressure.

  There was social media narratives.

  They were they were the investigators were influenced by
• 48:40
  the public outrage over Deforevida's behavior.

  You know, they, they would focus on tunnel vision on think I

  don't know if this is true, but like incomplete testing or
• 48:55
  incomplete forensics or, you know, inconsistent statements,
• 49:02
  chain of custody issues, you know, basically they will just
• 49:06
  go after the investigation gaps in forensics, media
• 49:11
  contamination. They might, the defense might
• 49:15
  argue, hey, you, you shouldn't convict somebody because they're
• 49:18
  creepy because they make music videos of themselves covered in
• 49:23
  blood. You can't, you can't convict
• 49:27
  people because the evidence, you know, proves guilt or doesn't
• 49:33
  prove guilt beyond a reasonable doubt.

  It's reasonable to doubt this, right?

  And this actually is a surprisingly effective way to

  argue. Actually, you know what?

  At least partially, that was Cory Richen's defense, right?

  They just they just honed in on her because she was the last

  person with Eric Richens. They just honed in on her and

  that was wrong of them to do. That was at least part of the
