- 2:35The voice of the Thundering, he heard, Steve Cotton, will join us
- 2:37to talk about that a little bit later on in the show. Now,
- 2:39as you know, if you're a long time listener to the show, and
- 2:42even if you're not a long time listener, you know the main sponsor for
- 2:45the show is the Thornhill Otter Group. This is a company I personally have
- 2:49had a long standing relationship going back twenty five years or more, if not
- 2:53longer. They signed on pretty much from day one to sponsor the show,
- 2:57and they had some big goings on at their Toyota dealership which is located on
- 3:01the Thornhill Motormle US one nineteen and Chapmanville. Wally Thornhill joins us now to
- 3:06talk about it. Good morning, welcome to the show. Wally. Hey,
- 3:08good morning, Dave, Dave in the morning. I've been doing this
- 3:12a long time. Yeah, that's that's going back to the old days.
- 3:15There the David of the morning, if you believe it or not. I've
- 3:16been gone from Logan for ten years and people in Charleston are trying to send
- 3:21me back every day. Wally, Well, you know it will take you
- 3:23any time, you know, of course always once day. Welcome to the
- 3:25motormile. Yeah, it's all exciting things going on. But I go way
- 3:30back with Yeah, we're rubbling early, you're on the radio early, we're
- 3:32going to the races. Nathan I taking off. Where are you going today?
- 3:36You know, it's a lot of fun. We had a lot of
- 3:38good conversations. But today's exciting day. Yeah, indeed it is. And
- 3:42again I want to say thank you for being a sponsor of this little song
- 3:45and dance here. But I started doing the show mayor twenty twenty, and
- 3:49you folks signed up from day one to be a sponsor. For that,
- 3:52I'm forever grateful. So I want to help you celebrate this Momentu's Day for
- 3:55your company and for the entire community, really, the entire state of West
- 3:59Virginia as far as the auto industry goes. Tell us swally about this all
- 4:01new thorn Thornhill Toyota in Chapmanville. Well, we're really excited. We had
- 4:06our builders took this old beat up store that used to even be my old
- 4:12Ford store. We got back into it at the Toyota store here, but
- 4:15they took it apart. I was much left and refurished it and brought it
- 4:19to modern day standards, all the way to the electrification for our evs.
- 4:25It is amazing store. It's amazing repairs fixed and renewed. If you see
- 4:30it doesn't look like an old building. It is a new building. Well,
- 4:33I'm looking forward to seeing it again. We'll be all of our stations.
- 4:36It's not often that we all go out to one location, but all
- 4:40of us, all of our sister stations will be there broadcasting live. I'm
- 4:44actually going to be doing double duty today as I'll be broadcasting on this station
- 4:46also on our classic rock station nine eighty seven of the Mountain. I want
- 4:50to give the listeners while he a little background on the Thornhill Outer Group in
- 4:55general. And I won't get into the exact years and dates because I know
- 4:58I could get it wrong and I can jump in any time if I'm wrong.
- 5:01But back in the nineties, you and your company took over what was
- 5:04then Honeycut Pontiac GMC and Logan, which eventually morphed into what is now Thornhill
- 5:11GM Superstore in Chamanville. You'd later acquire the Ford Dealership there from the late
- 5:15Mike Farrell, as well as the Toyota dealership which we're talking about today from
- 5:17Mike Farrell, and the Chrysler Dodge Jeep Ram dealership there. Along the way,
- 5:20you picked up the mitsubishie line. So for those keeping track at home,
- 5:25you now have Thornhill GM Superstore in Chamanville, the Thornhill Ford location in
- 5:29Chamanville, Thornhill Mitsubishi, also the Chrysler Dodge Jeep Ram location that's at the
- 5:33Fountain Play Small in Logan. So I think I got all that right?
- 5:38Is that right? You got one left out, one left out since I
- 5:42left to tell us about that one. Yeah, that's our used car outlet.
- 5:46We're in Belfrey, Kentucky. Oh yeah, yeahcky, And we're really
- 5:49proud of our Kentucky store. I always say, we've got cars on the
- 5:53motor mile from miles and miles of cars from West Virginia to Kentucky. Now,
- 5:57maybe you should change it to the Thornhill Motor Miles miles. Put the
- 6:00ass on that's right now. One of the things I love about the Thornhill
- 6:03Otter group is you guys really believe in giving back to the community. And
- 6:08this thing is going to start I think around ten thirty. So this morning
- 6:11you've got refreshments, and you've got prizes and so on and so forth.
- 6:14I think the Chamber of Commerce there is going to be involved. So it
- 6:16really is a big deal, not only for that area, but while I
- 6:19mean, let's face it, you sell a lot of cars in Charleston and
- 6:23in Huntington and every place that this and all of our radio stations go.
- 6:29Beckley, Pipeful, Presensburg. We know with City's marketing, she's actually at
- 6:35it, and our digital marketing people come here for the deals the trade,
- 6:42the inventory and the service, you know, our Thornhill family and getting with
- 6:47Nathan and City involved in the business. We're really excited. We've got the
- 6:50future laying out in front of us. You know, I'm not going to
- 6:54be here forever, but they will take over and run these stores and run
- 7:00and they just take it off like we did when I was younger with enthusiasts,
- 7:04and we still believe in this community and we believe in West Virginia.
- 7:10Want to talk about the brand name Toyota. I mean, you know,
- 7:14you sell a lot of different cars, all makes and models that you're different
- 7:16dealer's just plus yousel just about everything as far as pre own goes too.
- 7:19But man, when you talk about Toyota and you talk about the signature vehicles
- 7:24of Toyota, you know from Tacoma Is to the to the fore Erunner to
- 7:28Camery. I mean, it is a solid, solid name, Wally,
- 7:32it is. You know, Toyota was a great asset to the group.
- 7:36And as we do, we feel the places that we don't have you know,
- 7:40you take a Corolla or camera, we don't have some dands at the
- 7:45other stores now and that feels a void that you know, you don't have
- 7:48to travel somewhere to get it. And the thing about it is, we're
- 7:50going to do the deals or we're going to take care of people. You
- 7:54know, then you get into your forerunners, your Tacoma's, you know,
- 7:58your mainstays, your Rabs. It is really good to go along with,
- 8:01you know, with our other stores. It's a great blea. But you
- 8:03know, today I'm talking about toyot and I really appreciate the cat team that's
- 8:07the centralantic Toyota team, believing in us. That's saying that, you know,
- 8:11not just anybody can get a Toyota store. We had to go through
- 8:15a lot of hoops and one of them was to redo this facility and it
- 8:20had been needing it for a while, but we brought it into the main
- 8:22stay that we had the newest facility in West Virginia, and we're really excited
- 8:26about it. And again, when you talk about where you're located, you
- 8:28know, we're in downtown Charleston, but I mean to get to the dealership
- 8:31in Charles in Chapmanville, You're talking like a forty five minute drive from downtown
- 8:35Charleston. If even that absolutely, unless you're Martha, if you get there
- 8:39real quickly. That's while he's wife Martha these throwing under the bus this morning
- 8:43for driving a little bit of a you know, of the lead foot at
- 8:46times, you know, it happens. And as I said, Wallder,
- 8:50We've got a lot of great things going on down there. There's all kinds
- 8:52of prizes. All of our stations were going to be there. I saw
- 8:54them out in the parking like getting ready. I know that Jenny's from V
- 8:58one hundred and sent it down Woody Woods from the be to setting down.
- 9:01As I said, I'll be doing double duty with the Mountain and also a
- 9:03WCCHS rob reel from our morning show on Superstar Country ninety six to one KWS
- 9:09is going to be heading down there as well. So it gonna be like
- 9:11a family reunion for me to get to come down and hang out with you
- 9:13guys. Because I was texting back and forth with the Sydney earlier this morning.
- 9:18I've done a couple of live broadcasts from Thornhill over the years. Wally
- 9:22can imagine that we've a lot of they sold a lot of cars. But
- 9:26you know, Sidney and I were here at midnight last night. We're up
- 9:28early she's up early and we're really taking a lot of pride in today.
- 9:33I think if people come and join us, they'll see why we're so excited,
- 9:37and you know, we're ready for the next level and when joy having
- 9:41anybody stop by just check us out. Don't have to buy a car.
- 9:45We got food, we got gifts, we got prizes, and we're gonna
- 9:48have a great time. It is going to be a great things get rolling
- 9:50about ten thirty to again, all of our stations will be there broadcasting live.
- 9:52Wally, I will see you at about an hour and a half or
- 9:56so. Thanks, good luck with everything today. We'll talk soon. Thanks
- 9:58a lot, well, absolutely and good morning. See ya all right,
- 10:03Wally. Thornhill again from the Thornhill Outer Group and again the grand opening celebration
- 10:07of the all new Thornhill Toyota starts at ten thirty this morning. All of
- 10:11our stations will be there. I'll be, as I said, representing the
- 10:13Mountain, our Classic Rock Station ninety eighty seven, a Mountain rob reel there
- 10:18from Superstar Country ninety six to one. KWS Woody Woods will be there for
- 10:22the beat. I'll also be there for WCCHS as well. It's a pretty
- 10:26big deal down there. Love to have you come down and join us today
- 10:28again, Wally said, how often do you hear a car dealer say you
- 10:31don't have to buy a car, just make that short drive down to Thornhill
- 10:35today Again, it's only about a forty five minute drive from downtown. Charleston
- 10:39had some snow, especially in that area. It look pretty bad. I
- 10:41was looking at the pictures on social media. Pretty bad last night from that
- 10:45area. Not so much here in the Charleston area, but it was down
- 10:46that way. But things are clear, So come on out and join us.

- 11:09Dave, We've had Toyotas for years in a family, and I'll always wonder
- 11:13why anyone would buy anything other than a Toyota. That text by the way,
- 11:16did not come from wal You're Sidney Thornhill. I don't know who it

- 14:13about that a little bit later on in the show, the newly appointed Serga
- 14:16Judge her Kanawuh County Dave Hardy joins us. Now, Dave, good morning,
- 14:20How are you? Good morning? Dave, good to be here?
- 14:22Is it officially Judge Hardy yet? Have you gone through the swearing? So
- 14:26you're not that's why you didn't wear the robe in this morning? Right?
- 14:28Indeed it is, and that's why I had Jeff Jenkins call me Dave,
- 14:31not Judge, might be a little bit cold to wear that robe today,
- 14:33You're right. So when there's the swearing, is there is there a date
- 14:37set for the swearing? Yet? The Supreme Court has pointed out that there's
- 14:39a state statue that requires three weeks from the time the governor appoints you to
- 14:46the time that you're sworn in. At least three weeks so that would put
- 14:48me into the first week of January, and then I'm working on scheduling now
- 14:52about when the actual swearing in ceremony will be. My daughter's hoping to come
- 14:56in from California. Oh, that'll be great. Asked me for something I
- 15:01usually I usually said, that's all, as a good dad should do.
- 15:03And you know, Dave, we just had you on the show a couple
- 15:05of weeks ago to talk about your candidacy for the bench and you told me
- 15:09then you were hoping to get that appointment to fill out the rest of the
- 15:11term of the Believe Judge Habit and you got us a congratulations. Well,
- 15:15thank you, Dave. And I've said up before and it's not It's absolutely
- 15:18true. I will never be as good a judge as Judged Habit was.
- 15:22She was that good. I'm just trying to be the best I can be,
- 15:26and I'm really looking forward to it. I got talked to Judge Tabit's
- 15:30secretary and her folks this morning, and I plan to go down tomorrow and
- 15:35meet with them. So it's it's going to be a bettersweet moment. It
- 15:37was quite a legacy the Judge Tabit had, and you know, there's those
- 15:41people in any community across America, Dave, and you know this as well
- 15:46as I do. There are those people that truly make their mark on the
- 15:48community. Maybe people that may have been touched by Judge Tabitt, that never
- 15:56think for her. Maybe we're involved with her in some sort of a social
- 16:00setting or some sort of a charitable event or whatever. And I did not
- 16:04know her very well, wasn't friends with her, so to speak, by
- 16:07I didn't know who she was. And she just was one of those people.
- 16:11I mean that seemed that everybody liked. Nobody really had a bad word
- 16:15to say about not only what she did in the courtroom, but more importantly,
- 16:18Dave, what she did out of the court room. Absolutely, no
- 16:22question, completely and totally a community servant. And that's a word the words
- 16:26that often get overused, not overused in Judge Tabit's case at all. So
- 16:32you had been serving a state revenue secretary. That job now goes to former
- 16:34delegate and special advisor to the Governor, Larry Pack. Had Larry on the
- 16:38show yesterday and he told me that you and he had graduated from East Bank
- 16:42High School together in the same graduating class. But he couldn't remember which one
- 16:48was older, So please state for the record, sir, who is older.
- 16:52Larry pack is older, Okay by about six months I had Packer.
- 16:56If you're listening, you're older. It's been verified. I believe he's already
- 17:00had his birthday in November. And I will see how good my memory is.
- 17:03And he said, yesterday talk I told him you were going to be
- 17:07on the show. He said, not bad for a couple of boys from
- 17:10that part of the world. That's right, Pratt And where's Larry from?
- 17:14Marmot? Pratt and Marmette, So not too bad. Did you call him
- 17:18what you call the Marmette Flash or speak him all the time? Larry used
- 17:22to be the recorder of Marmett way back back in the eighties. And I
- 17:26always tell Larry, you know, I'll always remember your first elected office.
- 17:30It was Marmette recorder because that was his hometown. And Larry and I met
- 17:33in the fall of nineteen seventy three at eastpank High School. We're sophomores.
- 17:38We went three years of high school together. Then we both went to West
- 17:41Virginia Tech and we both majored in accounting, so we had a lot of
- 17:45classes together over that period of time as well. And I would imagine your
- 17:48paths crossed professionally outside the political realm as well, that you guys kind of
- 17:53your paths kind of went together too well. Larry. Larry went sort of
- 17:56the CPA entrepreneur route and I went the law pres disrect but we would periodically
- 18:02run into each other. Now our paths have intersected in a very good way
- 18:04here at the Capitol. It's been a lot of fun talking to Dave Hardy
- 18:08again. Talk. I want you were just on the show a couple of
- 18:11weeks ago, but I want to talk about the different life experiences that you've
- 18:15had, either personally or professionally, that you think will make you a good
- 18:18judge. Okay, well, let me say this. I think Commissioner Carper
- 18:22mentioned it the other day was appointed. He mentioned it in the newspaper number
- 18:27one. I'm very proud of where I'm from, Pratte, West Virginia,
- 18:30population four hundred and eight. If you haven't been there, you got to
- 18:33go there, Dave. You've been there, I've been there. I've been
- 18:36there, and from that you get a real strong feeling of what true West
- 18:41Virginia is, and what people are and what people do and what people get
- 18:45up in the morning and go to work. My mother was a housewife and
- 18:48then she became a school cook ade at Pratt Elementary School, which was a
- 18:52block from our house. My dad worked forty years at the Glasgow Kenora River
- 18:56Plant Team fifty two to nineteen ninety two. I know what it means to
- 19:00be a working West Virginian and I'm very proud of that. We then went
- 19:06to college at West Virginia Tech, which was four miles away, so all
- 19:08my formative time was spent in the Upper Kennall Valley. When I came back
- 19:12here from law school in the fall of nineteen eighty three, I said,
- 19:17I need to make my mark as an attorney in Charleston, West Virginia.
- 19:19This is now my new hometown, and I've been here ever since. I've
- 19:23represented miners, I've represented Umwa District seventeen, and I've represented some of the
- 19:30largest companies that have ever done business in the state of West Virginia and everything
- 19:33in between, plaintiff and defense side. The other thing I'm very proud of
- 19:38is I've been a college professor for twenty three years and I've taught at West
- 19:42Virginia Tech University of Charleston, and now I currently teach at West Virginia State
- 19:47in the Master's program. So why do I bring up all this stuff.
- 19:51It's perspective. It's perspective. I've been here a long time, and I
- 19:56feel like I understand the community from the South Hills to Saint Albans to Clintonen
- 20:03to Montgomery and all points in between. I feel like I have a very
- 20:07good understanding of the community. And there's some things that are going on in
- 20:10the community now that make me sad. Like everybody else, I often say,
- 20:14I can't go through the South Ridge Walmart and not come out set on
- 20:18the other end and feel sad because I see a lot of things that indicate
- 20:22that children are being neglected, that the drug issue has really basically inflicted a
- 20:30terrible, terrible price on our nuclear families here in West Virginia. And now
- 20:34I'm going to see that at ground level. I saw it at the Capitol
- 20:38from a policy level. Now I'm going to see it at ground level,
- 20:41and I'm going to see what not having a job and being on drugs looks
- 20:47like. And it's not going to be pretty. And I understand that.
- 20:49In addition, though at the same time, you have plenty of other cases
- 20:52that go on in the kenaw County Circuit Court that involve multimillion dollar disputes,
- 20:57medical malpractice, commercial disputes. You have criminal cases that have constitutional issues involved
- 21:04where you have right to a speedy trial. This is a very diverse docket,
- 21:08so it's easy to focus in on the abuse and neglect docket, which
- 21:11has now become almost all consuming for all the circuit judges Abuse and neglected Children'll
- 21:18let that sink in a minute. But at the same time, you've got
- 21:21multimillion dollar cases that need to be heard as well. So it's going to
- 21:25be very diverse. But part of what I think I bring to the bench
- 21:29is I'm diverse. I've been around a long time, and I think I
- 21:32have a good understanding of the local bar in the fabric of this community.
- 21:37Talking with Dave Hardy again, the newly appointed circuit judge here in Kanawha County.
- 21:40Dave Allen Show on five eighty Live is brought to you by bright Way,
- 21:42the Maze Agency of tays Valley. Buy an auto insurance can be complicated.
- 21:45That's why you need a local person to look out for you. At
- 21:48bright Way the MAZE agency that can customize your policies with coverages that you need
- 21:52and want, called John and Sherry Mays three zero four eight one four to
- 21:56two fives A right way MAAIS dot com. So what kind of preparation are
- 22:00you doing, Dave, to get ready for this new role? I mean,
- 22:03you know, for somebody that's obviously a total novice of this, are
- 22:07you, I mean are you? Are you studying past cases? Are you
- 22:11looking at statistics? Because you talked about the problem with abuse and neglect here
- 22:14in the area. What kind of prep goes into preparing for you now on
- 22:18abuse and neglect? I had my prep already at the Capitol. I got
- 22:21to hear about the fact that there are about sixty six hundred children at any
- 22:25given time in the custody of the state of West Virginia, and that we
- 22:30had a serious situation with the lack of child protection workers in Kinaw County.
- 22:36So I've gotten my prep on that and we addressed a lot of that through
- 22:38the reforms at DHHR and the budgets. As far as the day to day
- 22:44operation of being a judge, I've talked to Judge Row, the judge from
- 22:49Greenborough County that's now mining the docket and has been since August first Judge Unfortunately,
- 22:55Judge Tabitt had to take a leave of absence and Judge Rowe took over
- 22:57her docket. I've talked talk to the circle clerk, Kathy Gatson to make
- 23:02sure I understand the mechanics of how things work. I've talked to Judge Tabit's
- 23:06secretary to be sure that I understand the mechanics of the docket. And then
- 23:11of course I've talked to retire Judge Duke Bloom as well, and I plan
- 23:14to talk to retire Judge Kaufman, and then I plan to talk to my
- 23:18colleagues there I Judge Webster, Judge Selango, and Judge Acres particularly. I'm
- 23:26planning to talk to all of them, and Judge Ballard, all of them
- 23:30if if I missed anybody. But but I'm really looking forward to going down
- 23:33there. I'm going to be at the courthouse tomorrow and I planned to go
- 23:37down there and I'm going to close my mouth and open my ears. Yeah,
- 23:41go down with legal pad no pun intended in hand, and just start
- 23:42taking some notes because it's what you have to do sometimes. And so let's
- 23:48talk about because you are you You had said that you hope to be appointed
- 23:52to this and uh and you were, But you still got to run if
- 23:56you want to keep the job that you haven't started yet. That makes any
- 23:59sense. Yeah, so let's talk about I mean, how's the campaign going
- 24:03to look for you? Because by the time that you really start campaigning,
- 24:07you know, and we get because again and we start insanely early now with
- 24:11campaigns, but by the time that you really get into the heart of it,
- 24:14you will have already had some experience. So what's the campaign? Look?
- 24:17That's right, As you have pointed out, the appointment that I received
- 24:19from the governor is for calendar year twenty four, so the term ends a
- 24:25year from now twelve thirty one, twenty four. So I do. I
- 24:27am running standing for re election to the court for an eight year term on
- 24:32May fourteenth. The way the judges are elected, it's a nonpartisan election.
- 24:37There's no primary in general, you just run one time. It's like the
- 24:38school board. I've already gotten out early. I filed for pre candidacy papers
- 24:44on November one. I had a couple of very successful fundraisers And you say,
- 24:48well fundraisers, you know, is that just about money. No,
- 24:52it's not. If you can have successful fundraisers, that means you have support,
- 24:56and that's I equate the fundraiser with support. I've been out to the
- 25:02bar. I've went very very aggressively to the Kennaugh County Bar. I've been
- 25:06a member of the Kanak County Bar for forty years. I've been into every
- 25:10law firm in town that will have me and done what we call meet and
- 25:12greet, where I set around and did a round table to try to understand
- 25:17what the expectation is from the bar as a judge. And you know what's
- 25:22surprising, and it's really not surprising, but it kind of was to me,
- 25:26is it doesn't matter your political persuasion or your philosophical viewpoint about the law.
- 25:32Most attorneys just want the very same things out of a judge. They
- 25:34want you to be prompt, They want you to hold your hearings when you
- 25:38say you're going to hold them, and they want you to rule on the
- 25:42case, no procrastination, rule on the case. They need that continuity,
- 25:49they need that certainty, and their clients need that. And those are the
- 25:53things I can say I can do as a judge. You know, when
- 25:56you run for judge. There's a special set of rules that apply to the
- 26:00state bar. I can't be out here promising any particular thing other than what
- 26:04I just said that I can do. I will be the best judge.
- 26:07I will work as hard as I possibly can. I'll apply all my experience
- 26:11of forty years, and I will be prompt, and I will rule.
- 26:15I want to talk about your time in the classroom for a little bit.
- 26:18What kind of professor is Dave Hardy. I'm a to be honest, I'm
- 26:22a comical, fun professor. And I'll tell you why. I have seven
- 26:26years of undergrad school in law school. I have to say I had some
- 26:30really good ones and I had some really bad. Sure, just like any
- 26:33profession is exactly. And when I became a college professor, it's only twenty
- 26:36seven years old. When I started being really professor, yeah, nineteen eighty
- 26:38six, and I said to myself, I want to be the professor that
- 26:42kids will listen to, and to do that you have to almost be a
- 26:47little bit of a performer. And so I'm a fun professor. But I
- 26:51also I'm not afraid to raise expectations and make sure that young people are challenged
- 26:56in the classroom. So I have this thing where I call people out by
- 27:00name. I have the class roster in front of me, much like law
- 27:03school, and I will say, well, Dave Allen, since you clearly
- 27:07weren't paying attention there, why don't you tell me why you weren't paying attention
- 27:10trying to have flashbacks here? Yeah, this has happened before. Bring this
- 27:14is PTSD for me. Man, this has happened before. You'll have a
- 27:17bad dream. And I actually challenge the students. And I've done everything from
- 27:22very large classes business law. I taught business law West Virginia Tech for years.
- 27:26We'd have seventy kids in the class. Now I do master's level and
- 27:30I'm teaching the master's Public Administration program at West Virginia State, which is a
- 27:33great program, by the way. And the students I have are mainly young
- 27:38adults, so I've seen it always. But the theme in my teaching is
- 27:44I challenge you in the classroom. Okay, got a text here, and
- 27:48I'm almost hasn't to bring this up, but it is a question that came
- 27:52in from a text or to well, let you address hoever you want.
- 27:55It says, we'll judge for beIN employed I plan to meet with Judge Tabit's
- 27:59former stuate, and I had her favorable reviews about all all her former staff,
- 28:04and I was very sensitive to that because they've been through a lot.
- 28:07Well yeah, I mean, this isn't like somebody that you know, beat
- 28:11in an election or something. This is somebody that tragically passed away. So
- 28:14it's kind of a different, different situation, very much. And I wanted
- 28:17to wait until the governor appointed me before I went down and met with the
- 28:22staff and saw the office and that kind of stuff. So I'm planned to
- 28:26do that at nine am tomorrow morning. Uh Tex says it was very good
- 28:30to hear Dave Hardy on the air. I went to school with Dave and
- 28:32Larry. Of course, I'm much younger this one. I know who it's
- 28:37coming from because this was actually a text of my personal phone here from somebody
- 28:40I know. I'm a you need to wrap this person at Vicky Jackson.
- 28:42Oh my god, Vicky Shoemate Jackson. Yes, mate, Vicky and I've
- 28:48been friends for a number of years. And sorry, Vicky, you just
- 28:49got rated out on the air. So but that was a taxi gid to
- 28:52my personal phone, all right. So first day on the bench. Let's
- 28:56say first day tomorrow. It's not, but let's just say your first day
- 28:59tomorrow. What are you doing day one? What am I doing? Day
- 29:02one? The first thing I want to do is make sure I understand the
- 29:06docket. What's the breath and scope of the docket. What cases are going
- 29:11to be urgent that need to be heard now? What cases do I need
- 29:14to put time frame orders in on to keep them moving, and what cases
- 29:18I need to start trying to figure out how to get them to settle.
- 29:22So that'll be the first thing I do. I'll take a global look at
- 29:25the docket. Okay, Well, Dave, Merry Christmas to you and your
- 29:29family, and I hope you have a happy New Year. Best of luck
- 29:33on day one and you're swearing in and things of that nature. And then
- 29:36you have to turn right around and start campaigning a little bit as well as
- 29:38best you can, because again the rules are a little bit different for judicial
- 29:41candids. I will give you the last thirty seconds just to thank anybody or
- 29:47just talk about whatever you want to last thirty second, George, number one,
- 29:51I want to thank the Kennall County Bar for being so positive and open
- 29:55to me. When I said that I was interested in being a judge.
- 29:59I want to thank the Judicial Vacancy Commission for putting me through a very strenuous
- 30:03process, including a twenty four page application and a length in a twenty minute
- 30:07interview, for recommending my name to the Governor. And of course I want
- 30:11to thank the Governor for the past seven years that we've worked together to make
- 30:15West Virginia better. We've had a very good financial picture in the last seven
- 30:21years, and I certainly am grateful to the Governor for giving me this opportunity.
- 30:25All right, wish it a best of luck of everything and congratulations,
- 30:29end appointment again, Good luck out on the campaign trail. We'll talk soon,
- 30:30Dave. Thanks Lon, Thank you, Dave. Special Olympics embodies the

- 34:01his TV show or those available on YouTube. I'll have to go back and
- 34:05try to find those. Well. Tonight, it's bull night for the Marshall
- 34:07Thundering Herd as they get set to take part in the Scooters Coffee Frisco Ball
- 34:13in Texas. The voice of the thunder and Heerd, Steve Cotton, joins
- 34:15US Now live from Texas. Steve, good morning, how are you?
- 34:19Good morning? Dave? Doing well? Thank you for taking time out of
- 34:22your bull prep to be here. Now. You know, we can always
- 34:24talk about the weather. We've had cold champs and snow squalls over the last
- 34:29twenty four hours here in the canalf Valley make us feel bad. Steve.
- 34:32How's it looking in Texas? Well? It has been pretty warm. Yesterday
- 34:38the high was about sixty and you know, relatively warm. The day before
- 34:44I think it hits seventy. Now it cools down quite a bit at night.
- 34:46Kickoff is not until nine o'clock Eastern time tonight, so it's going to
- 34:50be a bit chilly for the folks sitting in the stands at the Pro Soccer
- 34:53Stadium here in Frisco, Texas, just north of Dallas. That's where they
- 34:58play this Bowl game in a soccer facility. And talk about that stadium,
- 35:01Steve, very nice, well done. It's a bit unusual in that it's
- 35:07not necessarily built for football. The field's fine. The field is just like
- 35:13anything any other football field. I'm talking about things like the skyboxes and all
- 35:17that sort of thing. In fact, they really don't have radio facilities,
- 35:22so the Marshall broadcast and the UTSA broadcast are in sky suites. The things
- 35:31that are used for you know, the big dollar donors. In the soccer
- 35:35seats. Nobody was in there, and it's very it's fine. It's it's
- 35:38a little bit unusual kind of space, but it's it's fine and it will
- 35:43cause no problems for the broadcast. But so it's it's a little different,
- 35:45but it's nicely done and it's been in first class experience down here for the
- 35:51players I've only been here a couple of days since we stuck around and did
- 35:55the basketball game Saturday night. But they, you know, the players got
- 36:00to go yesterday on a big tour of the Dallas Cowboys. Now you're talking
- 36:04my lage. Yep. They really enjoyed that. They've had other, you
- 36:08know something every day for the teams, up and up through it yesterday and
- 36:13then all of a sudden you get the it's found the business of a bowl
- 36:15game. So it's been kind of a normal road trip kind of atmosphere the
- 36:21last couple of days. See if I was looking at my Marshal history,
- 36:24I don't know if you're aware of this or not. You probably are,
- 36:27but on this date back in nineteen ninety two, this was the day that
- 36:31Marshall beat Youngstown State for the one DOUAA championship in Huntington. Do you know,
- 36:37Dave, that is the last Marshall game. I was not at.
- 36:40I came from Yep. How about that. Yeah, what a great day
- 36:45though. I know so many people who were at that game and just talking
- 36:50about the emotions and sitting there in the stands crying, tearful, joyful.
- 36:54Tier you know, what a national championships. Shouch moment for anybody. Now,
- 37:00let me jump back for just a second. You may have seen this
- 37:05stadium in Frisco. That's where they've been playing what is now the FCS and
- 37:08the one double A national championship game for the last several years. So if
- 37:12you've checked out any of those recently, that's where Marshall and UTSA will be
- 37:16tonight. Okay, well, I can tell you I was a Marshall student.
- 37:20I was just wrapping it up there in ninety two, and I can
- 37:22tell you what it was like. You know that that Collingstown State game there
- 37:27at the JONT tonight's game, Steve Marshall by will be without Cam Fancher,
- 37:30the quarterback who's into the transfer portal. Cole Pennington will get the start for
- 37:35the Herd. You think this young man is up to the task. He
- 37:37has played two games as the starting quarterback during the season, was when Fancher
- 37:44was injured, so he has that behind him, and a big difference for
- 37:47him for this game is that he had a the full you know time since
- 37:54Fancier went into the portal as Marshall's starting quarterback. In his head, you
- 37:59know, he was kind of we weren't sure if he was going to play
- 38:00or not when Panshin was injured and he ended up going in there. But
- 38:05it's a little different now that for a good three weeks he has known he's
- 38:08QB one and he's had all the first team reps and all that kind of
- 38:13thing, So that stip. Now here's a big contrast though. You have
- 38:19Cole who's making his third start and has yet to throw his first collegiate touchdown
- 38:23pass. The guy on the other sideline name is Frank Harris Dave. He's
- 38:29a seventh year senior who has thrown ninety two career touchdown passes and run for
- 38:35another twenty eight touchdowns. So seven years. We had guys like that in
- 38:40high school too. We called it getting held back back then. Yeah,
- 38:45I think after the game he's supposed to go straight into an aarp. He's
- 38:50still in the remake of Golden Girls there. Yeah. Any more notable absences
- 38:55tonight for the Herd Steve Well also in the transfer portal have Trent Holler,
- 39:00one of the starting offensive linemen, Caleb Coombs the number one receiver in terms
- 39:07of a number of catches. Now, Marshall rotated so many receivers, you
- 39:09wouldn't think that that's going to affect them as much as you know, your
- 39:14starting quarterback or even an offensive lineman who's been out there most of the time.
- 39:17So other than that, and you also never really know. Bull season
- 39:22is so different. Guys opt out, and even if you don't opt out,
- 39:29if you're thinking about trying to get to the NFL Draft, you tweak
- 39:32your big toe and maybe maybe I shouldn't do this, like I don't want
- 39:37to get hurt and you know, ruined by chances to prepare for the combine
- 39:40or anything like that. So you know, and that's not completely new.
- 39:45People have been opting out of bowl games so I guess more than a decade
- 39:49now, but it's certainly more common. I think all over the nation people
- 39:53are wondering, even on game day, who's going to be out there and
- 39:55who's not one more reason to have to tune in to Shay of what does
- 40:00actually happen. Yeah, and we'll actually have coverage of that game to night.
- 40:02Again, it is a late kickoff nine o'clock from Frisco, and we'll
- 40:06have coverage of that game following in our coverage of high school basketball tonight.
- 40:08See before we let you go. Put a kind of rap on the on
- 40:10the regular season. You know, it started out with so much promise under
- 40:14coach Huff, and then the Herd stumbled mightily at various points about the season,
- 40:17had some bright spots later in the season as well, a lot of
- 40:22people's eyes a bit of a disappointment. I know it's not exactly what the
- 40:27Marshall faithful and coach Charles Huff wanted, but here we are. Yeah,
- 40:30and you had the great start four and oh now I'm not and included to
- 40:37win over Virginia Tech. I'm not sure though that the Herd was ever as
- 40:40good as four and oh felt you had to come from behind in those first
- 40:45two games. You had the win over Virginia Tech, very nice, but
- 40:52then yet a couple of things. The team might not have been quite as
- 40:54good as people were thinking based on the record, And you had a few
- 41:00injuries but all in the same spot, mainly on defense. Your two starting
- 41:05safeties were out, your two inside linebackers, and all of a sudden you're
- 41:07getting gashed up the middle, and it took a while to get that righted.
- 41:12And as much as anything, now, guys got healthy and returned to
- 41:15the field, but those freshmen who were backing them up, inexperienced guys got
- 41:20more experience, and I think that, as much as anything, help the
- 41:22team at the end, even when you still had the so called youngsters out
- 41:27there, they had a lot of game experience, So that was something to
- 41:30feel good about. They were backed into a corner, had to win two
- 41:34out of the last three and did so, had to win the last game
- 41:37to become Bowl eligible. And I think they've had you just watching the team
- 41:40the last couple of days they're here. They it looks like a regular regular
- 41:45season road trip at this point, and they want to go out and win
- 41:47a football game. So being able to keep the team together through that much
- 41:51adversity, I think speaks pretty well for what Marshall's had going this year.
- 41:55I I agree, Steve. I was watching some of the TV coverage of
- 41:59local stations last night and they were doing the showing the press conferences and whatnot.
- 42:02The majority of players, at least the ones they showed on local television,
- 42:05Y're Steve, they all had on cowboy hats. Any chance we're gonna
