- 0:00Speaker 1: Let's get to our top story.
- 0:01Speaker 2: A federal trade court has blocked many of President Trump's tariffs.
- 0:05Speaker 2: A three judge panel on what's called the International Court
- 0:09Speaker 2: of Trade found.
- 0:10Speaker 1: That Trump's use of the.
- 0:12Speaker 2: Decades old International Emergency Economic Powers Act did not quote
- 0:18Speaker 2: delegate an unbounded teriff authority to the president. The judges
- 0:23Speaker 2: who heard the case were Reagan, Obama, and Trump appointees.
- 0:27Speaker 2: The case stemmed from two lawsuits, one from several small businesses,
- 0:33Speaker 2: the other a multi state coalition led by the attorneys
- 0:37Speaker 2: general in Arizona and Oregon and Willie.
- 0:41Speaker 3: I've got to say this is something so many people
- 0:43Speaker 3: probably woke up this morning and said, what court's up.
- 0:46Speaker 3: I mean, it's not a court that you really hear
- 0:48Speaker 3: that much about. But it is interesting two Republican appointees,
- 0:52Speaker 3: one Democratic appointee and handing down the decision saying that
- 0:58Speaker 3: these weren't emergency. It's interesting. You also have Congress that
- 1:02Speaker 3: has sort of seeded their power to the president. So
- 1:05Speaker 3: you have three branches right now very much engaged in
- 1:10Speaker 3: these tariffs. It's going to be interesting to see how
- 1:12Speaker 3: it shakes out.
- 1:13Speaker 4: Yeah, and as we pointed out a minute ago, the
- 1:14Speaker 4: markets love this news because they don't want tariffs to
- 1:17Speaker 4: be imposed in the way that Donald Trump has imposed them.
- 1:20Speaker 1: Or at all.
- 1:20Speaker 4: So there's a rally in the futures markets this morning.
- 1:23Speaker 4: Let's bring in two Democratic Attorneys General, Dan Rayfield of
- 1:27Speaker 4: Oregon and Chris Mays of Arizona.
- 1:31Speaker 1: Good morning to you both.
- 1:33Speaker 4: Let me start with you, General Rayfield, and just talk
- 1:37Speaker 4: about the lawsuits you brought and what you expect to
- 1:39Speaker 4: see from it.
- 1:42Speaker 5: Well, fruciate, thanks for having us. It's very exciting day.
- 1:45Speaker 5: This is a very important ruling for all Americans. And
- 1:49Speaker 5: the genesis of this lawsuit for us was really simple.
- 1:52Speaker 5: It's about people, it's about small businesses, It's about the
- 1:55Speaker 5: impacts that we're having in our states. This was going
- 1:59Speaker 5: to be a thirty eight dollar increase for everyday households,
- 2:02Speaker 5: and I don't know a lot of families that can
- 2:04Speaker 5: afford that, and so really the loss it was simple.
- 2:07Speaker 5: It was like no president in the history of the
- 2:09Speaker 5: United States had ever used this emergency power to set tariffs.
- 2:13Speaker 5: President Trump himself didn't use this. He used the normal
- 2:17Speaker 5: statutes that Congress gave him power to do, which puts
- 2:20Speaker 5: safeguards in for our economy. And that's what has been
- 2:24Speaker 5: used in the history of these statutes, and President Trump
- 2:26Speaker 5: tried to go around that because he didn't want to
- 2:28Speaker 5: use those things. He didn't want those safeguards. We were
- 2:30Speaker 5: really seeing the impacts on our daily lives, and so
- 2:33Speaker 5: great ruling yesterday. We're tremendously excited, and I couldn't be
- 2:36Speaker 5: more thankful to have an amazing partner in AJ May's
- 2:39Speaker 5: down in Arizona.
- 2:40Speaker 6: To our General Mays. Let me let me turn to you.
- 2:42Speaker 6: Obviously your reaction to the news last night from this
- 2:45Speaker 6: court that we could acknowledge most Americans perhaps have not
- 2:48Speaker 6: heard of, but we should know. The trumpministration has already
- 2:51Speaker 6: said they will file and appeal, So give us your
- 2:54Speaker 6: thoughts as this matter seemingly far from being finished.
- 2:59Speaker 7: Sure well, let me just start by echoing what A. G.
- 3:02Speaker 7: Rayfield said, And we are so pleased not just on
- 3:07Speaker 7: behalf of you know, our states, but just all states
- 3:12Speaker 7: and all consumers and especially small businesses that were on
- 3:16Speaker 7: the verge of being hammered by these tariffs, which really
- 3:20Speaker 7: are taxes and tax increases. So we're very happy about
- 3:25Speaker 7: this decision. But you're correct, the Trump administration has already
- 3:29Speaker 7: indicated that they're going to try to get a stay
- 3:32Speaker 7: on the Court of International Trades decision which was very
- 3:36Speaker 7: sweeping and put a halt within ten days to all
- 3:40Speaker 7: of these tariffs.
- 3:41Speaker 1: Essentially, we'll see.
- 3:43Speaker 7: What the court does. The court really issued a very
- 3:48Speaker 7: strong opinion. They essentially made a decision on the merits
- 3:53Speaker 7: of the case and what is essentially a final decision
- 3:58Speaker 7: by them, even though this we were asking for a
- 4:01Speaker 7: preliminary injunction, so they actually went a little further than
- 4:05Speaker 7: we were even asking for. So they're very strong in
- 4:09Speaker 7: their decision. We'll see what they say. When the Trump
- 4:12Speaker 7: administration asked for us.
- 4:13Speaker 2: Day, well, that's sort of procedurally. I'm curious, Attorney General Raphael,
- 4:19Speaker 2: what is next? What do you predict and what are
- 4:21Speaker 2: you prepared for in terms of the challenges ahead.
- 4:26Speaker 5: Well, first off, we wouldn't have brought this case if
- 4:28Speaker 5: we didn't think it was a righteous case. And we
- 4:30Speaker 5: wouldn't have brought this case if it wasn't impacting Americans
- 4:33Speaker 5: across this country. So we feel very confident as we
- 4:36Speaker 5: moved through the appeals process. If you actually listened to
- 4:40Speaker 5: what the Trump's lawyers were arguing in court, it is befuddling.
- 4:44Speaker 5: They were saying that any emergency order cannot be reviewed
- 4:48Speaker 5: by any judge. Then they said any of the relief
- 4:51Speaker 5: that they put out into the world as a result
- 4:53Speaker 5: of that emergency order cannot be reviewed by a judge. Effectively,
- 4:58Speaker 5: you could tax maple serve in Canada to try and
- 5:01Speaker 5: impact fentanyl in the US.
- 5:03Speaker 1: Absurd stuff, and.
- 5:05Speaker 5: No judge can review it. And as Agma's pointed out,
- 5:08Speaker 5: these tariffs trickle down to US, So they could put
- 5:11Speaker 5: in one thousand you know what, a one thousand percent
- 5:14Speaker 5: tariff on any good, which would trickle down to US
- 5:18Speaker 5: without any congressional approval and without any court being able
- 5:22Speaker 5: to strike it down. That's how powerful the judge's order
- 5:26Speaker 5: was yesterday and really a rebuke of the Trump administration's
- 5:30Speaker 5: belief that they are immune to review by the courts.
- 5:34Speaker 3: So, Claire mccaskll, we've learned this morning that this court,
- 5:38Speaker 3: the US Court of International Trade, is an Article three court,
- 5:42Speaker 3: that it was that were given its power from Article three.
- 5:45Speaker 3: I'm curious had you a lot of people look up
- 5:49Speaker 3: this morning going okay, what's the court, wat's its jurisdiction?
- 5:53Speaker 3: Where have you had any dealings with this Court before,
- 5:56Speaker 3: when you were in when you were in the Senate,
- 5:58Speaker 3: had it heard any actions from this court before? Are
- 6:02Speaker 3: is this the one offer you as well?
- 6:05Speaker 1: Well?
- 6:05Speaker 8: No, we when you work on policy issues surrounding trade,
- 6:09Speaker 8: those decisions come into play.
- 6:11Speaker 1: And I certainly was aware of the court.
- 6:13Speaker 8: But you know, I think this does expose something that's
- 6:16Speaker 8: really important. One of the things Trump has done is
- 6:19Speaker 8: he's gotten away with stuff because many Americans don't know
- 6:22Speaker 8: any better that he is violating the law.
- 6:27Speaker 1: And this is a good example.
- 6:29Speaker 8: Most Americans just assumed he had the power to unilaterally
- 6:33Speaker 8: decide he was going to wipe out the whole sectors
- 6:36Speaker 8: of the economy on declaring these these across the board
- 6:40Speaker 8: tariffs on every country in the world.
- 6:43Speaker 1: But I have a question for General Mays.
- 6:46Speaker 8: You all, as attorney generals in democratic states, really have.
- 6:52Speaker 1: An important role right now.
- 6:54Speaker 8: Can you talk a little bit about how the attorneys
- 6:58Speaker 8: generals in the United States, the democratic elected people in
- 7:03Speaker 8: your position, how you all are deciding what cases to
- 7:08Speaker 8: bring against the Trump administration And is there some kind
- 7:12Speaker 8: of process you're going through or are individuals deciding we're
- 7:16Speaker 8: going to sue on.
- 7:17Speaker 1: This and then asking the others to join you.
- 7:20Speaker 8: I think this is really a missed part of the
- 7:23Speaker 8: scenario right now, the really important role you guys are
- 7:26Speaker 8: playing in trying to make this administration respect the rule
- 7:30Speaker 8: of law.
- 7:32Speaker 7: Thanks Claire, and yeah, I totally agree with you. And
- 7:34Speaker 7: we are working very closely together. All twenty three Democratic
- 7:39Speaker 7: attorneys general are working together on these cases. We have
- 7:43Speaker 7: now brought I think a little bit north of twenty
- 7:46Speaker 7: lawsuits all together essentially as a coalition. A few states
- 7:52Speaker 7: like in this situation, Oregon in Arizona led this case,
- 7:57Speaker 7: but we had other states like New York and I
- 7:59Speaker 7: think total of twelve states that join together. We are
- 8:03Speaker 7: working as a coalition together on these lawsuits and the
- 8:09Speaker 7: lawsuits that we're bringing. And I'll let Dan Way in here,
- 8:14Speaker 7: but these are lawsuits where the president has clearly overstepped
- 8:18Speaker 7: his authority. These almost all of thems are about the
- 8:22Speaker 7: separation of powers and making sure that we protect Americans
- 8:27Speaker 7: from the increased costs associated with the actions that the
- 8:32Speaker 7: president is taking.
- 8:36Speaker 2: All right, I Democratic? Sorry, go ahead, sir, go ahead.
- 8:41Speaker 2: Attorney General Rayfield, Oh.
- 8:44Speaker 5: No, absolutely, it's pretty simple. I think the question is
- 8:46Speaker 5: when you have Oregonians being impacted and you have a
- 8:50Speaker 5: president that's violating the Constitution or the law. It's an
- 8:53Speaker 5: easy decision to sit there and jump in and file lawsuit.
- 8:59Speaker 1: The Democrats
