Davina: Welcome back to the Wealthy Woman Lawyer Podcast. I'm your host, Devina Frederick, and I am glad you're here with me today. Recently, as I was engaged in a conversation with several women law firm owners, the subject of hiring associates came up as it often does, and someone asked the question that is on every solo or small firm owner's mind, How do I compete with bigger law firms when it comes time to hire an associate attorney? If you have ever thought some version of that yourself, then you'll like today's episode because I'm going to address that very question. I conducted a little research into what legal recruiters are telling us right now in 2026 about how solo and small firms attract good associate attorneys.
• 1:32
The answers may surprise you, or maybe not. By the end of this episode, hopefully, you'll have a new way of thinking about your next hire, including the offer you make, the way you talk about your firm, and your decision making process. Let's get into it. Most solo and small firm owners assume that hiring is a compensation contest and that they have already lost it before it starts because they can't possibly compete with big law or even mid sized firms when it comes to salary. They picture a talented young associate with two competing offers on the table, one from a firm like theirs and one from a bigger shop with a recognizable name and a bigger number attached.
• 2:14
And they assume the bigger number always wins. But that is not what the data shows. And it is not what recruiters are telling their law firm clients right now. The legal job market in early twenty twenty six is extremely tight. Unemployment for attorneys has been sitting around 1.5%, which means recruiters aren't sorting through a stack of desperate applicants.
• 2:37
Instead, they are competing to reach people who are already employed and, as far as they know, reasonably content. That changes the calculus. In a market like this, dollars often are not the only lever. And for a lot of candidates, it's not even the biggest one. What recruiters are seeing instead is that younger attorneys, and honestly, attorneys at every career stage now, are weighing an offer against a different set of questions.
• 3:04
Questions like, will I learn something here? Will someone invest in me? Will I have a life outside of work? Will I be trusted with real responsibility, or will I spend three years doing document review? Is this a place where the person running it treats the team like human beings, or will they only see dollar signs?
• 3:25
Most times, a small firm cannot win a pure salary bidding war against a big firm, but a small firm has never done so. A small firm competes in a completely different way. Once you understand that, you will stop feeling like you'll never be able to make a competitive offer. Remember, if Big Law only hires the top 1% from the top tier law schools, that leaves 99% of us. Sure, some go into government jobs, some in house, and a few hang their own shingle right out of law school.
• 3:56
But that still leaves a pretty large percentage who need to find a good paying job doing work they enjoy, at least most of the time. That doesn't include the attorneys who have been out of law school for years and are looking for better opportunities in work environments. Let's talk specifically about what legal recruiters say is attracting good candidates to smaller firms right now. Once I talk through these five advantages, I think you'll recognize that you already have access to most of them, but maybe you just haven't shared them with potential candidates. The first is flexibility.
• 4:29
What used to be considered a nice perk is now more of a baseline expectation. Recruiters describe flexible and hybrid work arrangements as something candidates now assume they'll be offered, not something they're grateful to receive. If you're a solo or small firm owner, you may already have the structural advantage here. You don't have a real estate committee. You don't have 40 partners who all need to agree on a remote work policy.
• 4:56
You can simply decide this week what flexibility looks like at your firm and include that in your offer. When I speak with women law firm owners, many, many tell me the reason they started their own law firm was that they needed flexibility in their schedules, mostly because of their children. If you can provide flexibility in your firm for your associates, they likely would not go start their own firm but take a position within your firm. This doesn't have to include remote work, but it can. It could also look like being able to leave early to attend children's events or to freely make personal appointments during work hours so long as they make up the time.
• 5:36
Flexibility can come in many different shapes and sizes, so think creatively about it and determine what works for you and your firm. The second is client contact and responsibility. This is one of the sharpest contrasts between big firm life and small firm life, and it is a compelling selling point. At a big firm, a junior associate can spend years on document review and due diligence with almost no direct client interaction. At your firm, a new associate can be in a client meeting in month one.
• 6:07
They can watch a negotiation happen in real time. They can see a case from intake to resolution instead of touching just one slice of it. Attorneys who are excited about doing the real work of lawyering hear that and lean in. The third is mentorship, and specifically personal direct mentorship from someone who is invested in their growth. This is something recruiters point to repeatedly as a small firm advantage because it's often hard for a big firm to deliver.
• 6:37
You cannot get individual mentorship from a partner who bills three thousand hours a year and has 40 other associates competing for his attention. But you, as the owner of a small firm, can sit across the table from your new hire and teach her how to prepare for a deposition, or how to talk to a grieving family, or how to read a courtroom. That is not a lesser experience. For the right candidate, it's the entire reason they want to work for you instead of a bigger law firm. The fourth is culture and fit.
• 7:11
And this matters more the smaller your firm is. In a firm of 1,000 attorneys, one difficult personality gets absorbed into the system. In a firm of three, one wrong hire can easily wreck the vibe. Recruiters who work with small firms consistently say that personality fit is often the deciding factor once baseline competence is established. A candidate who likes how you run your firm, who feels comfortable with your communication style, who can picture herself sitting across from you every day, will often choose that feeling over an extra $15,000 a year somewhere else.
• 7:47
And the fifth is transparency. Recruiters say that firms who describe their culture accurately, including the negatives, build more trust during the hiring process than firms that oversell. If you tell a candidate exactly what a normal week looks like, exactly what's expected, exactly where the firm is headed, and how she fits into that, You are doing something most firms, big and small, still fail to do. Being transparent is one of the fastest ways to convert a good candidate into a committed one. To be clear, I'm not suggesting you air your dirty laundry to everyone, but I think it's become increasingly important to be direct during the hiring process about your expectations and to ask the candidate you are considering whether what you want match their expectations.
• 8:36
I want to add one more layer to this because it comes up in almost every conversation I have with recruiters who place mid level and lateral candidates specifically. Once an associate has a couple of years under her belt, expectations tend to shift. If someone has already lived the big firm grind or she has watched a friend live it, she knows what it costs. At that stage, recruiters say candidates get far more discerning about leadership style, partner accessibility, and whether feedback is consistent or comes only once a year at a review. Poor management, not low pay, is what recruiters point to as the single biggest driver of attrition at the mid level.
• 9:18
Which means that for you, being present, being direct, and being a genuinely good manager isn't a soft skill on the side of running your firm. It is itself a recruiting and retention benefit. This next piece of legal recruiter advice is the one I find interesting, and it's the one small firm owners often skip because we are usually in a hurry when we finally sit down to write the job posting, and we just want to get something posted. Recruiters recommend that before you post anything, you write what's sometimes called a one page success profile. It's not a job description.
• 9:55
A success profile answers three specific questions. One, what outcomes do you need this person to deliver in their first ninety days? Two. What matters will they touch? Three.
• 10:07
And how will you know the difference between a good hire and an exceptional hire? What is required to meet that standard? Here's why this could be important for a firm your size. A vague posting attracts vague applicants, and it slows down your own decision making because you don't have a clear standard to measure candidates against. Worse, if you have a partner, a spouse, or a trusted advisor weighing in on the hire, everyone is likely picturing a slightly different candidate, which is exactly how good people get passed over in committee.
• 10:39
So before you write a single word of a job posting, answer those three questions for yourself. What does this person need to be doing successfully by month three? Which files, which clients, which parts of your practice will be theirs? And what does She's a Keeper look like to you specifically, not generically? Once you can answer those questions, a single page will do.
• 11:01
You're ready to write a posting. And it should sound a lot different than a generic Seeking Associate Attorney, two plus years experience listing that is currently on every job board getting scrolled past by exactly the kind of candidate you want to attract. Here's the part that surprises a lot of firm owners. In a market this tight, your hiring process itself is part of your pitch. Recruiters are telling law firms of every size the same thing right now.
• 11:31
If your process stretches across many weeks with long gaps between the interview and the follow-up, and the follow-up and the offer, you will lose strong candidates to someone who moved faster. This works in your favor as a small firm if you take advantage of it. You don't have a nine person hiring committee. You don't need three rounds of partner interviews and a formal offer letter that must route through legal and HR. You can meet a candidate on Tuesday and decide by Thursday.
• 12:01
Audit your own process. How many days elapse between a resume landing in your inbox and a candidate hearing back from you? How many separate interviews do you need before you know? Every extra week you take is a risk. You don't want to move so fast that you take the next warm body, but you also want to be ready when the right candidate shows up.
• 12:23
I've seen it before where an owner interviews, finds a candidate they like, but since they don't have a draft offer letter prepared and ready to tweak, they get caught up in client work and suddenly a week or two has gone by. The candidate never receives the written offer, so they accept another one from someone who was more prepared. Okay. Next, let's discuss something practical you can use in your very next interview because most solo and small firm owners are asking the wrong interview questions. We ask about experience, about practice areas, about why they left their last job, none of which tells us whether this particular person will thrive at a firm our size.
• 13:05
Here are three questions you should consider adding to your hiring process. First, tell me about a time you had to figure something out with very little supervision. What did you do? A small firm cannot handhold the way a big firm can, so you need someone who is comfortable with autonomy, not someone who says she wants autonomy, but in reality needs a lot more guidance and instruction. Second, what does a bad week look like for you and how do you handle it?
• 13:35
This tells you how someone behaves under pressure, which matters enormously in a firm where there's no bench of 40 other associates to absorb a rough patch. Also, it helps identify what types of situations or activities may rattle them. Let's say someone answers that question with a trial and you own a litigation firm. That could be a problem. I'm only half joking here because believe me, I've heard some stories.
• 14:01
I'm sure you have too. And third, my favorite, what part of practicing law do you actually enjoy? You would be amazed how many candidates have never been asked that question and how much it tells you. The candidate who lights up talking about being in a courtroom or sitting across from a client at the worst moment of their life and actually helping them may be telling you she wants exactly what your firm can give her. The candidate who can't answer that question with anything specific is telling you something too.
• 14:33
Now let me tell you a story about Renee, we'll call her, who ran a family law practice with about $650,000 in annual revenue. Renee had been telling herself for two years that she couldn't hire an associate because she couldn't offer anywhere close to what the litigation boutique across town was paying its junior attorneys. When we sat down together, the first thing we did was write that one page success profile. Renee realized she didn't need a generalist. She needed someone to take over her custody and parenting plan matters within ninety days so she could focus her own time on the higher value divorce and asset division cases that were paying her firm's bills.
• 15:16
That clarity alone changed the job posting entirely. Instead of seeking family law associate, it became a posting about stepping directly into meaningful client facing custody work within the first month. In the posting, instead of leading with salary Renee led with her firm's strength. Every associate hire got direct, weekly one on one mentorship with her. The firm's billable hour requirement per associate was relatively low compared to other local firms.
• 15:50
And the associate she hired would be in mediation sessions and court appearances within the first thirty days, not just drafting. She also reduced her hiring timeline. Instead of a three interview process spread across six weeks, she moved to two conversations and a working interview completed within ten days. The candidate she ultimately hired had another offer on the table from a larger firm at a higher salary. Renee asked her directly, near the end of the process, what would make the difference.
• 16:22
The candidate told her she had two young kids, she was tired of being one of several associates competing for a partner's attention, and she wanted to practice law, not just function as a glorified paralegal. Renee's offer, with its flexibility and its direct mentorship and its real client contact, won. A year later, that associate was running the firm's entire custody caseload independently, freeing Renee to spend her time on the highest fee matters in the practice. Revenue grew by almost 30%. And Renee, for the first time in two years, took a full week of vacation without her phone.
• 17:00
What I want you to notice about Renee's story is what she didn't do. She didn't raise the salary to a number she couldn't sustain. She didn't panic and take the first warm body that applied. She got specific about what she really wanted for this role, and she told the truth about what made her firm different. She then moved fast once she found the right person.
• 17:22
Now we do need to be real here. If your offer is meaningfully below market for your geography and practice area, none of this fixes that on its own and recruiters will tell you the same thing. You do need to know your local market rate and get reasonably close to it. But reasonably close is not the same as matching a big firm dollar for dollar. Recruiters increasingly talk about total compensation value instead of base salary alone, meaning the full package a candidate is evaluating includes benefits like a faster and more transparent path to partnership or equity, meaningful annual bonus structures tied to firm performance, flexibility, real professional development, and a workload that lets an attorney have a personal life.
• 18:10
When you add those together, a lot of small firms are more competitive than they think, even against a bigger base number. There's also another option more and more small firms are using in 2026 flexible or contract legal talent. Rather than committing to a full time associate salary before you're certain of the volume to support it, some firms are bringing on part time or project based attorneys to handle overflow work, testing the fit and the caseload before extending a full time offer. It's not the right move for every firm, but if you are unsure whether you can sustain a full salary commitment yet, it's a great way to start building capacity without overcommitting. One more thing geography matters here, and it works in your favor more often than owners realize.
• 18:57
A solo practitioner in a mid sized market is not actually competing against Big Law salaries in Manhattan or Chicago. She's competing against the local market rate, which recruiters consistently describe as far more variable and often far more reasonable than owners assume when they're anchoring on national headlines about first year associate pay at the country's largest firms. Before you decide you can't compete, find out what competitive means in your specific market for your specific practice area. It is very likely a smaller gap than the number you've been carrying around in your head. In our programs at Wealthy Woman Lawyer, we teach you exactly how to create your own hiring system, one you can turn to repeatedly when you are ready for your next hire instead of starting from scratch each and every time.

You are not losing a compensation war. You were never in one. The attorneys who will thrive at your firm, who will stay, who will grow into the kind of associate who runs a full caseload and frees up your time and your income, They are not out there ranking firms by salary alone. They're looking for exactly what a well run small firm can offer real responsibility, real mentorship, a real life, and transparency. Until next time, this is Devina Frederick reminding you that you don't need to be the biggest firm in town.
• 21:10
You just need to make the most compelling and complete offer. See you next week.
