- 3:03Speaker 3: I'm so happy for you guys to be joining me
- 3:06Speaker 3: on tonight. Tonight our topic is going to be what
- 3:12Speaker 3: is wrong with the justice system, probation and parole board.
- 3:20Speaker 3: I have a special guest and I always love when
- 3:25Speaker 3: he comes by and stop by. We're gonna even touch
- 3:27Speaker 3: on his case too. And of course you know, my
- 3:30Speaker 3: co host Cornell is with us. My special guest is
- 3:35Speaker 3: James Legate. We haven't heard from James Legate in about
- 3:38Speaker 3: a month. Mister Lugate, how are you.
- 3:43Speaker 6: Doing, Jette, Well, I'm glad. Thank you for having me
- 3:48Speaker 6: back all less because I am I mean, no matter
- 3:53Speaker 6: what the situation I'm making it, thank you for having me.
- 3:56Speaker 3: Oh you are very very welcome. And my co host,
- 4:02Speaker 3: the one and only col Male, go ahead, Thank.
- 4:07Speaker 6: You, ma'am, Thank you, ma'am. Tell us man my name
- 4:09Speaker 6: is doing to thank you pretty much now always having
- 4:12Speaker 6: me on your show. I enjoy the moments to be
- 4:14Speaker 6: able to sit here and to be able to talk about,
- 4:17Speaker 6: you know, issue that will thank our criminal justice system
- 4:19Speaker 6: and take people's lives. So thank you for having me
- 4:21Speaker 6: on your shore.
- 4:23Speaker 3: You are very welcome. The topic is what's wrong with
- 4:27Speaker 3: the criminal justice system. I did a little research on
- 4:32Speaker 3: just I'm not gonna say I just been doing research.
- 4:37Speaker 3: I did a quick research search, probably about fifteen minutes ago,
- 4:42Speaker 3: and what I came up with is the experts expert
- 4:52Speaker 3: estimate between six percent and sixteen percent of people were
- 5:02Speaker 3: convicted given the approximately three okay, approximately twenty three million
- 5:11Speaker 3: people are currently incarcerated. Between one one hundred and thirty
- 5:18Speaker 3: eight thousand and three hundred and fifty four thousand people
- 5:30Speaker 3: are currently incarcerated wrongly. Those are the statistics. That's what
- 5:38Speaker 3: I pulled up. You can go and you can research
- 5:44Speaker 3: it yourself. The number one wrongful conviction is identification. I'm
- 5:55Speaker 3: getting yes, identity. So with my special guest, mister Legate,
- 6:03Speaker 3: because it's also in his case identity identity where they
- 6:10Speaker 3: say they seen him and then they said they seen
- 6:14Speaker 3: somebody else running. So I'm going to give him the
- 6:18Speaker 3: opportunity to start off with that to speak on identity.
- 6:24Speaker 6: Well, thank you, thank you. It's crazy because of like
- 6:30Speaker 6: for instant in my case, you know, they identify a
- 6:33Speaker 6: few people as running from the scene, that person in
- 6:36Speaker 6: the white going straight across the parking lot. But they
- 6:40Speaker 6: also deified a guy wearing black where the shake my
- 6:45Speaker 6: way right following trying to grab him before he tells
- 6:48Speaker 6: to the ground and around to the corner of the building.
- 6:54Speaker 6: But during my job, he never brought up anything other
- 6:58Speaker 6: than well he was willing white shirt. But they identify
- 7:01Speaker 6: people on black, so they're trying to identify me and
- 7:06Speaker 6: the same person. How that happens? I have no idea.
- 7:10Speaker 6: I mean, why is white black and black come to
- 7:13Speaker 6: the high You look at it, so you see two
- 7:15Speaker 6: different people running and the clothes are different. How can
- 7:20Speaker 6: you tag it on somebody else? And the whole thing
- 7:23Speaker 6: is is that you had to diseased the victim chase
- 7:28Speaker 6: seems the guy in the black shirt trying to grasp them.
- 7:32Speaker 6: You wouldn't buy it. Was testified to my aide and
- 7:35Speaker 6: the hopeful soles are and he had kicked up his car.
- 7:38Speaker 6: He witnessed it and uh and like me, they said,
- 7:42Speaker 6: oh yes, well he looked at the club. Didn't look
- 7:45Speaker 6: at the club.
- 7:46Speaker 7: They did.
- 7:47Speaker 6: They used me to convict me Matther. They're trying to
- 7:51Speaker 6: find some guy and dark clothing. And it's crazy because
- 7:54Speaker 6: everything that they testified to want about me, you know. So,
- 8:01Speaker 6: But what so ironic is during my investigation, will I
- 8:06Speaker 6: don't know what happened. Everything happened so bad. I can't
- 8:08Speaker 6: tell you something I really don't know. All I know
- 8:11Speaker 6: was there was a guy that came in after me
- 8:14Speaker 6: and he's like shot after the tea over the table,
- 8:19Speaker 6: and he was wearing dark clothing and I had like
- 8:22Speaker 6: a fu red over his head and I couldn't everything
- 8:24Speaker 6: happened so and I can't sit there and give you
- 8:28Speaker 6: every detail. I have been a red. Okay, So what's
- 8:34Speaker 6: crazy is that the little did I know that these
- 8:39Speaker 6: people were testifying he wol They were saying that guy
- 8:43Speaker 6: has black both we called too. So how I know
- 8:46Speaker 6: the person was wearing black was coincided with what goodnesses
- 8:51Speaker 6: testified to me. I had a white shirt, well, it
- 8:53Speaker 6: was an Ivory colored shirt. It was a very yellows
- 8:56Speaker 6: Ivory colored shirt with like all three pass and boots,
- 9:01Speaker 6: so that too decent colors. So being misidentified it's easy.
- 9:08Speaker 6: And it's crazy because no matter no matter what, I've
- 9:12Speaker 6: put numerous cases where the detectives can't have the witnesses
- 9:18Speaker 6: come in and the accused. What they're gonna do is
- 9:21Speaker 6: they're gonna walk them right, find the witnesses so that
- 9:25Speaker 6: they can look at that person. So this way, when
- 9:28Speaker 6: they go and identify this person, oh yeah, that's the
- 9:31Speaker 6: guy I see, because it's already inflected in their mind.
- 9:34Speaker 6: She were saying, it's crazy because they use this tactor.
- 9:38Speaker 6: They use this tactic a lot, and it's wrong, it's
- 9:41Speaker 6: not right. And that's where I'm mis identifications come from.
- 9:46Speaker 3: And in my opinion, Okay, I know mister Cornell knows. Yeah,
- 9:51Speaker 3: I was getting ready to ask him, Cornell, what do
- 9:55Speaker 3: you think about that?
- 9:58Speaker 6: Okay, madam? Well, unto the study right from the Exoleational
- 10:03Speaker 6: Registry catalog, right, this is a fact they So I'm
- 10:06Speaker 6: quite sure that the numbers have changed since team it
- 10:09Speaker 6: said that just over forty percent of mon for conviction
- 10:11Speaker 6: were based on the second out bring this identification. Seventy
- 10:15Speaker 6: nine percent of the session of few caps altomis needed
- 10:19Speaker 6: for pendic evidence was involved in twenty two the Center
- 10:22Speaker 6: of on for Fictions. Boss of sessions occurred in fourteenth
- 10:25Speaker 6: percent of the exis. So the issue is that, ma'am
- 10:29Speaker 6: we have a very serious crisis and our criminals here
- 10:34Speaker 6: in Texas, Texas leagues to nation and both executions and
- 10:40Speaker 6: economications nineteen seventy six. Ma'am, it has been our semified
- 10:45Speaker 6: ma'am that uh nearly can for the people on Deathbot
- 10:49Speaker 6: has defended for misidentification to smification of evidence, rocket critical
- 10:55Speaker 6: misturned up because your manipulation. So the point of being
- 11:02Speaker 6: made about the mess identification, ma'am, is the fact that
- 11:05Speaker 6: thousands and thousands and thousands of menical people are sitting
- 11:08Speaker 6: in our prison system. Sometimes they did not commit. And
- 11:12Speaker 6: how do we process of Madama's fall beyond me? But
- 11:15Speaker 6: right now we have our thought is heard and the
- 11:17Speaker 6: only way man that I can assume that we need
- 11:20Speaker 6: to know fix that you haveing our thought.
- 11:23Speaker 3: Exactly identification now and you know with forensic scientists, uh
- 11:30Speaker 3: a lot of evidence being mishandled across contamination are the
- 11:40Speaker 3: the forensic is not there but yet and still they
- 11:44Speaker 3: still get a conviction. Mister Legate, with your case, you
- 11:51Speaker 3: didn't have no DNA, you didn't have anything, so you
- 12:00Speaker 3: didn't even have guns shot residue on you. So how
- 12:04Speaker 3: did basically they get a conviction?
- 12:09Speaker 6: Well well as it turned out they basically had a
- 12:12Speaker 6: condition based on a soft testimony or the propecuting you
- 12:16Speaker 6: that the their star witness, which identified himself as Jeff Hernandas,
- 12:22Speaker 6: was not actually Jesse Hernandez, but in fact, why not
- 12:25Speaker 6: told you Hernandeze. Every time somebody gets arrested, the first
- 12:29Speaker 6: thing they both do is they take your fingerprints. When
- 12:32Speaker 6: they hunt your fingerprints, they hunt for the antip peta
- 12:35Speaker 6: face which is gonna come out with your identification of
- 12:38Speaker 6: who you are or your birthday, any agent as you use,
- 12:41Speaker 6: I don't know who you actually are because that's what
- 12:44Speaker 6: you've been locked up before. So this being known, they
- 12:48Speaker 6: continue to use this uh, this Jackie to fabricate evidence,
- 12:54Speaker 6: such as uh when he personally overheard the first safe
- 12:59Speaker 6: which Federl Simona telling me I needed to go on
- 13:02Speaker 6: hurt their so called lawyer, which the state argued was
- 13:06Speaker 6: to decease the big one now as I did before,
- 13:12Speaker 6: and my other's uh interviews uh mis Eathus Romero from
- 13:18Speaker 6: Kate at twelve News did a documentary she she investigated
- 13:22Speaker 6: her and the team because Denil was actually know to
- 13:25Speaker 6: be dead, so all their case was based on Jesse
- 13:29Speaker 6: Hernandez right. This is the false testimony which meant to
- 13:32Speaker 6: talse evidence with the misrepresentation of facts and giving a
- 13:37Speaker 6: false impression to the court and the jurors to believe
- 13:41Speaker 6: that Fredersima did in tract had me to commit this
- 13:44Speaker 6: crime during trial, he was he was, I was was fulled.
- 13:50Speaker 6: So did its testifying. We weren't able to get him
- 13:54Speaker 6: or nothing like that. SAPA in marketing. So that's just
- 13:57Speaker 6: what we based the case on. And if any and
- 14:00Speaker 6: it goes and reached the Court of appealse case, they
- 14:03Speaker 6: identify the fact that difficult was the cases about us.
- 14:07Speaker 6: It talks about the motives, They talked about everything, which
- 14:11Speaker 6: identifies what Jesse Hernan satisfied to until they discovered Federal
- 14:15Speaker 6: Salona Live twenty years later. Now they changed their tu
- 14:19Speaker 6: says well, there's really no independent cooperation to bring a
- 14:23Speaker 6: case against it. And I'm like, well wait a minute.
- 14:26Speaker 6: Jesse Hernandon testified and he personally overheard this man me, hey,
- 14:32Speaker 6: we need to go hurt this guy. But now the
- 14:35Speaker 6: state to change it no independent operation, So in other words,
- 14:42Speaker 6: testimony is no longer ballot. Although he did say there
- 14:46Speaker 6: was two other guys there were also of this so
- 14:50Speaker 6: called meeting right then over her pedros Amona say this also,
- 14:55Speaker 6: I did find the directors that one of the guys
- 14:57Speaker 6: which is said this Robert fault was Phi. But the
- 15:01Speaker 6: States ever unitive to collaborate and have this testimony. And
- 15:07Speaker 6: I always wondered why, But now if everything came up
- 15:10Speaker 6: not why, I'm realized that if Robert most has probably
- 15:14Speaker 6: even told them, Look, I don't know what y'all talking about.
- 15:17Speaker 6: I don't know why y'all are still to be this
- 15:19Speaker 6: because I wouldn't don't know anything now and the tennant
- 15:22Speaker 6: todios I hadn't what they called it the epoxicant photo time. Right.
- 15:29Speaker 6: The prosecution got report which they give was detective. They
- 15:33Speaker 6: they combined all their investigative reports and they put it
- 15:36Speaker 6: in this one which is the prosecution got report, and
- 15:39Speaker 6: they give it to the prosecutors where they filled their
- 15:42Speaker 6: case well in the prosecution guide report through in a
- 15:47Speaker 6: testimony where they went and talked to a Robert Punson
- 15:50Speaker 6: and Robert Moses was nevern't asked about anything about the
- 15:53Speaker 6: case or if he overheard, and they didn't learn anything
- 15:55Speaker 6: like that. Now they had a lot of stuff talk
- 15:58Speaker 6: Jessie her head and all the shows that it And
- 16:01Speaker 6: five days after my after I was arrested, he was
- 16:05Speaker 6: arrested for cocaine. And so then they found out as
- 16:09Speaker 6: you went by, that that same cocaine charge was dismissed
- 16:15Speaker 6: for his testimony. Now how how how vadid is his testimony?
- 16:22Speaker 6: Now he now he had a regional line. They were
- 16:25Speaker 6: either going to get it for the cocaine charges. They
- 16:28Speaker 6: chant a speed which he tried to follow up for
- 16:32Speaker 6: me for instan for show. Like you said, there was
- 16:34Speaker 6: no song, There wasn't no DNA found, There was no
- 16:37Speaker 6: finger prints on anything. They found the gun with no
- 16:40Speaker 6: fingerprints on it. They me for chest because not even
- 16:46Speaker 6: twenty twenty five minutes after the shooting, they took a swap.
- 16:50Speaker 6: They all these testing everything came back negative. Even thought
- 16:54Speaker 6: they found some blood white shirt, but even the sorology
- 16:58Speaker 6: tests concluded that it was meg If there was no blood,
- 17:01Speaker 6: there is no physical evidence I can shay I shot
- 17:05Speaker 6: a gun, handed a gun or anything like this because
- 17:08Speaker 6: everything was negative. So that time, because I thought my
- 17:12Speaker 6: commission be based on false testimony. Cornell, why yes, ma'am.
- 17:21Speaker 6: First of all, madam, it was never really identified that
- 17:27Speaker 6: DNA evidence would be one of the number one thos
- 17:30Speaker 6: in the United States to food would individual won't be
- 17:35Speaker 6: until Perry shake them went to had a case done
- 17:38Speaker 6: where they come to learn that DNA evidence control as
- 17:41Speaker 6: a person he did not commit a crime. Okay, from
- 17:45Speaker 6: twenty from nineteen ninety four to twenty fourteen saw prison
- 17:49Speaker 6: of the generated after DNA evidence revealed that they did
- 17:53Speaker 6: not commit the crime for which they had been convicted
- 17:56Speaker 6: and sentners. According to the nishi's project mccount of Marble
- 18:00Speaker 6: convictions includens was not involve in the day evidence and
- 18:03Speaker 6: I have been two hundred and fifteen confirmed the gnerations
- 18:07Speaker 6: here in the state of Texas well. Since then they
- 18:10Speaker 6: have regis a guy called Michael Martin. We have a
- 18:14Speaker 6: act called the Michael Martin back right now. Michael Martin
- 18:17Speaker 6: was convicted for a crime that he did not commit.
- 18:21Speaker 6: My secutors the Michael Morton's case, mister Anderson K Anderson.
- 18:26Speaker 6: He knew that mister Michael Morton had not committed to
- 18:29Speaker 6: crist Wow, because he had a commission and the record
- 18:32Speaker 6: showing that mister Michael Morton did not commit the crime
- 18:35Speaker 6: for what he did not do, he did not reveal
- 18:38Speaker 6: the evidence to the defense. Therefore, mister Michael Mordon was
- 18:42Speaker 6: convicted in the life in prison and he had twenty
- 18:45Speaker 6: five years in prison for crime he didn't commit. Until
- 18:49Speaker 6: it came out that the business determiney announced that he
- 18:53Speaker 6: knew mister Michael Morton from Hellison. But he said this,
- 18:58Speaker 6: it is not my job to prove mister Michael Morton
- 19:02Speaker 6: for killis it's my job to prove that he heals me.
- 19:06Speaker 6: That's what he's not supposed to do. So, And the
- 19:10Speaker 6: Michael Martin came it became an example whether the act.
- 19:14Speaker 6: Now he feels the fact that the field makes propecure
- 19:17Speaker 6: the criminal novel for the person and prove with to
- 19:20Speaker 6: be evident in the United States here in Texas. Anyway,
- 19:25Speaker 6: will you with that.
- 19:27Speaker 3: Go ahead? Go ahead, I'm gonna hold my thought at the.
- 19:34Speaker 6: Only problem with the Michael Martin field, Madam, is the
- 19:37Speaker 6: fact that they did not make the reston acts to
- 19:41Speaker 6: active me. That it goes back and apply to everybody
- 19:44Speaker 6: who has not the critical misconduct in their cases. It's
- 19:48Speaker 6: only talks on two thousand and eleven until the day
- 19:53Speaker 6: from now what people like myself while they bothered me
- 19:56Speaker 6: convicted me on polific of the Okay, what they thought
- 20:00Speaker 6: to convicted him with no or what about the ten
- 20:04Speaker 6: the bobblems of people that's putting their wants to compicted
- 20:06Speaker 6: it upon no biological evidence.
- 20:09Speaker 3: Of food that they were conted exactly.
- 20:13Speaker 6: Well, that's where I'm at with that.
- 20:14Speaker 3: We can also add Sebastian into that. Into that category.
- 20:20Speaker 3: We can also add Yron Johnson. It's a lot of
- 20:23Speaker 3: men we can add in that that I had spoke to.
- 20:26Speaker 3: We can also add Marcellus Williams into it, but it's
- 20:33Speaker 3: too late for him. The state of Missouri, Missouri executed
- 20:38Speaker 3: him about a week or two ago, and they knew
- 20:43Speaker 3: they did not it was not his DNA. The prosecution
- 20:50Speaker 3: that put him in there came to his defense. Once
- 20:55Speaker 3: they found out that it was not his DNA, they
- 21:02Speaker 3: went to his defense. They tried to get him on
- 21:05Speaker 3: order and stay again. They tried to get him life
- 21:10Speaker 3: in prison. But why would he take life in prison
- 21:14Speaker 3: when he didn't do it? They put an innocent man
- 21:18Speaker 3: to death. The State of Missouri, the governor could have
- 21:22Speaker 3: stopped it, the Supreme Court could have stopped it, but
- 21:25Speaker 3: they didn't. They let an innocent man be put Well,
- 21:31Speaker 3: they killed and we just gonna call it what it is.
- 21:33Speaker 3: They killed it. The state of Missouri did they killed
- 21:36Speaker 3: that man. They didn't have no evidence. The family, the
- 21:43Speaker 3: victim family also didn't release a statement. They didn't want
- 21:50Speaker 3: the execution to happen because they knew. I read that
- 21:53Speaker 3: the family knew that he was innocent, but the governor
- 22:00Speaker 3: and the Supreme Court didn't want to listen. So to me,
- 22:06Speaker 3: this is my opinion that his death is on their hands.
- 22:12Speaker 3: They should be held accountable cords. And if I was
- 22:16Speaker 3: his family member, I would keep pushing it in the
- 22:21Speaker 3: keep pushing the envelope until his name is a until
- 22:25Speaker 3: he's exonerated, just like the young the family did. After
- 22:31Speaker 3: seventy years late, seventy years later, I forgot the young man.
- 22:38Speaker 3: He was the youngest man to be executed. He went
- 22:43Speaker 3: to the electric chair. After seventy years, he was exonerated.
- 22:54Speaker 3: He was thirteen when they when they executed him, when
- 22:57Speaker 3: they killed him, he was thirteen years old.
- 23:00Speaker 6: Wow, okay, you can't you know if you're not tell me,
- 23:05Speaker 6: But if I may, if I made, okay, mister go ahead.
- 23:12Speaker 6: If I mean there was there was a case here
- 23:15Speaker 6: of the Willington case. I don't know if you remember
- 23:16Speaker 6: that or that word, they accused him of sending the
- 23:19Speaker 6: house and fire and killing his children. Right well, you
- 23:23Speaker 6: literally they found it. It wasn't actually his fault. They
- 23:26Speaker 6: trying to say on accelerate there that they called them say, well,
- 23:30Speaker 6: the fire chiefs and everybody will saying no, you know what,
- 23:33Speaker 6: we were wrong, We were wrong, we were wrong everything,
- 23:36Speaker 6: Like you guys innocent, but nobody wanted to hear it.
- 23:38Speaker 6: Nobody wanted to hear it, and they still excuse in
- 23:41Speaker 6: the state of Texas he wasn't. In Man also where
- 23:45Speaker 6: every party was saying that he was innocent. I don't
- 23:48Speaker 6: know if you remember that case. And that reminded me
- 23:51Speaker 6: of that case because I mean it happens. That's where
- 23:54Speaker 6: the brooician system is. You know sin they con you
- 23:58Speaker 6: know what crazy they They go to law schools to
- 24:02Speaker 6: learn to say them all learn the constitutional rights of everybody,
- 24:07Speaker 6: to know how the procedures and everything. Why they graduate,
- 24:12Speaker 6: what do they do? Some of them go to the
- 24:14Speaker 6: prosecuting office and it's like if they have their own class,
- 24:17Speaker 6: like this is what you're gonna do, this is how
- 24:19Speaker 6: you're gonna do. Don't worry if you don't give them
- 24:21Speaker 6: just to worry you don't get up there for your
- 24:23Speaker 6: job and to convict them. Well, according to to the
- 24:26Speaker 6: objective of the Code to Criminal Procedure the city, which
- 24:30Speaker 6: should be real effective is to ensure that justice is
- 24:34Speaker 6: done to not just to mere begin a conviction, to
- 24:38Speaker 6: assure that I'm sure trial is to assure that any
- 24:42Speaker 6: witnesses or evidence and given to the accused so that
- 24:47Speaker 6: they can prepare defense. But according to the way they
- 24:51Speaker 6: teach the prosecutors and ain't like that no more. Why
- 24:55Speaker 6: do you think now the majority of justice are ex consecutors.
- 25:00Speaker 6: You will never see a sense attorney as a judge.
- 25:04Speaker 6: If you're going to look at all all the judges,
- 25:07Speaker 6: they're basically all as prosecutors, which missed them like the
- 25:11Speaker 6: third child, because they know other prosecutors. There's their buddies,
- 25:16Speaker 6: they funny, go eat lunch, they body gods, mother to god,
- 25:20Speaker 6: father to their kids, their want to go to school, theater.
- 25:23Speaker 6: So where is where is the PREADI where do you
- 25:28Speaker 6: draw the line? If you did, you have all these
- 25:31Speaker 6: principal discovers to play. So that's how I like you that. Okay,
- 25:38Speaker 6: well thank you for that. Listen, look, uh that's gonna
- 25:41Speaker 6: be my next topic. Might say why because in the
- 25:45Speaker 6: past twenty years we have a tentifie the fire they
- 25:49Speaker 6: don't need your campaign, the DA favorite system campaign, the
- 25:54Speaker 6: simple Beautiess camp. The part of that right is evident signals,
- 25:58Speaker 6: cancel grand jury, the juryman is coming to grand jury, recscumers,
- 26:04Speaker 6: racial jury feet bought the processes. Take the law parties
- 26:08Speaker 6: crime no, I mean law parties gets you the second
- 26:11Speaker 6: of the juvenile people certain skas of chuvenile being prosecuted
- 26:15Speaker 6: as a sol and we have a parole forts systems
- 26:18Speaker 6: running on a water now here's an article called attorney apartments.
- 26:24Speaker 6: Thanks for player arrangements in the Texas County. It has
- 26:27Speaker 6: been a tell a fact art of a counting the
- 26:30Speaker 6: twenty nine five, six and half the county twenty seven
- 26:33Speaker 6: and five, the twenty eighteen have a relationship of us
- 26:38Speaker 6: a sign a lawyers to more than any any any
- 26:41Speaker 6: attorney in the state of Texas. This game that are
- 26:45Speaker 6: being paid by silasis. A fine of them Jesus if
- 26:48Speaker 6: they go they to the judges campaign. If you show
- 26:52Speaker 6: us that defense when the jug campaign will more likely
- 26:57Speaker 6: to be given more cases than any of the A
- 26:59Speaker 6: turn in the state of pat but this being saying
- 27:02Speaker 6: attorneys are being paid off to help the judge. They
- 27:05Speaker 6: have to pay prosecuted pure convictions are killings the people
- 27:11Speaker 6: because of this now we have but there's no net
- 27:13Speaker 6: you campaign. It's being a lack of the take the
- 27:16Speaker 6: bargain so partners they did not meeting, saying thalds and
- 27:22Speaker 6: thousands and thousands of people are day being wrapped up
- 27:25Speaker 6: the top from the distances and down a broke a
- 27:27Speaker 6: pretty baggain free. I'm just one of the other issues
- 27:30Speaker 6: with the law for it.
- 27:32Speaker 3: I'm a jump right back. I'm a jumping right, I'm
- 27:35Speaker 3: a jumping right quick, mister legate, thank you for joining us.
- 27:41Speaker 3: Do you have anything to say before you have a.
- 27:45Speaker 6: I just want people to just realize it. Look the
- 27:48Speaker 6: way the river is, there is a lot of people
- 27:51Speaker 6: that are ruptly convictions and they need your help. They
- 27:53Speaker 6: need you to shoot the true y'all be blessed, make
- 27:56Speaker 6: you get and I wish they could stay, but I
- 27:58Speaker 6: can so I'll be glad because love y'all, y'all be
- 28:04Speaker 6: good and uh okay, all right, all right, but they
- 28:10Speaker 6: all right, okay, thank you.
- 28:13Speaker 5: M The caller had hung up.
- 28:16Speaker 3: Okay, so it's just me and you. It's just me
- 28:20Speaker 3: and you now co hosts.
- 28:23Speaker 6: Okay, well guess what man? That anything? Okay, My, I'm
- 28:26Speaker 6: gonna cut off on you. I'm gonna call you, Mike
- 28:28Speaker 6: back there, because we have something to talk about on
- 28:31Speaker 6: the show.
- 28:31Speaker 3: Yes, we have a like we got we got a
- 28:34Speaker 3: lot of stuff to talk about. So I'm gonna ask
- 28:36Speaker 3: miss Angela can she take us to uh break a commercial?
- 28:44Speaker 7: Thank you?
- 28:44Speaker 6: Man'll let me call back.
- 28:46Speaker 5: Okay, turn off the legs a candle.
- 29:12Speaker 8: Tonight a man a Martin, Let's take a shower shower together.
- 29:28Speaker 7: I was abonded, you was the somewhat wealthy.
- 29:44Speaker 3: And save.
- 29:49Speaker 6: Ja.
- 29:50Speaker 7: Turn off the.
- 29:54Speaker 2: Y let as we walk.
- 30:40Speaker 3: And we're back and I'm still waiting on my co
- 30:42Speaker 3: host to call me back. It takes a little time
- 30:46Speaker 3: for us to reconnect for them to get back. Well,
- 30:52Speaker 3: we don't heard about the number one, how they're getting
- 30:58Speaker 3: their conviction and the numbers, the statistics were done. Talked
- 31:05Speaker 3: about Marcel Williams with y'all that that is unbelievable. How
- 31:14Speaker 3: you want to put someone how you're gonna kill somebody
- 31:18Speaker 3: and there's no BNA evidences. The family is against it.
- 31:23Speaker 3: The prosecution that tried them came to their defense and
- 31:30Speaker 3: yet still we didn't. They went on and put him
- 31:37Speaker 3: putting a sleep Cornell.
- 31:43Speaker 6: Oh yes, yes, Lam, I'm here, ma'am.
- 31:47Speaker 3: Okay, welcome back. Let's do the second half and let's
- 31:52Speaker 3: let's get it out there. Let's finish talking.
- 31:56Speaker 6: Okay. Well, the night show was about what's wrong with
- 31:59Speaker 6: our from of those justice probations and role board system, okay,
- 32:04Speaker 6: and the fact fire something that we have witness a
- 32:07Speaker 6: broken similar justice system. Now we have putness out there
- 32:10Speaker 6: some people to being wrong for conviction of crimes they
- 32:13Speaker 6: did not commit. We have witness process to what does
- 32:16Speaker 6: have a don't judge donation campaign. We have Witness for
- 32:19Speaker 6: corruption and Broxley for based on from We have a
- 32:23Speaker 6: system where turn is a fan paid oh you know
- 32:26Speaker 6: by course, the system to help bet convictions on their time.
- 32:29Speaker 6: We have a broken pity ball, the system where kids
- 32:32Speaker 6: are being and they had to see fifty and the
- 32:34Speaker 6: quarter of roll behind the scenes for crimes they could
- 32:37Speaker 6: not commit. We have a system where a brand jury
- 32:40Speaker 6: Process Act and secrecy to process and against sequel with
- 32:45Speaker 6: that support the wellness. So now with all of these issues,
- 32:49Speaker 6: these issues amounts to convictions on uh possibly other people
- 32:53Speaker 6: sending wrong for convicted us of people to death row
- 32:56Speaker 6: to be executed crimes they did not commit. Bas So,
- 32:59Speaker 6: right now, the question and how can we from now?
- 33:05Speaker 6: If anybody have any questions? You know what I'm saying
- 33:09Speaker 6: going to you know, how can we process? And you know,
- 33:13Speaker 6: enjoying you to call in, You're saying to give your
- 33:15Speaker 6: opinion about right because they need to be well.
- 33:20Speaker 3: Number one, they need to get out there and vote.
- 33:25Speaker 3: You need to when your when your ballots come, you
- 33:29Speaker 3: need to do your research. Look over the judges, look
- 33:33Speaker 3: over the the DA. Look who's going to be representing
- 33:38Speaker 3: the youth residing over their cases. We first we got
- 33:44Speaker 3: to start doing our research. Just don't go because we're
- 33:46Speaker 3: getting ready to vote though it's up upon us. We're
- 33:49Speaker 3: almost there. So you know, you guys, don't just go
- 33:55Speaker 3: on there and vote because you like the candidate. Do
- 33:59Speaker 3: your research. Search. We always got to do research, research
- 34:04Speaker 3: and stuff. Don't go off anybody else's word or you know,
- 34:08Speaker 3: I'm voting for this judge because of you know, they
- 34:11Speaker 3: tough on law and all of this, and they probably
- 34:14Speaker 3: ain't tough on nothing, probably just sitting back there just
- 34:17Speaker 3: in the back of potato chips, is like, you know,
- 34:20Speaker 3: because they already know how they gonna vote. In Wine's case,
- 34:25Speaker 3: we talked about Yan Johnson case when he went when
- 34:32Speaker 3: he the day he was picking his jury, let me
- 34:35Speaker 3: go back, let me go back his first when his
- 34:39Speaker 3: first trial he was the it was deadline. It was
- 34:45Speaker 3: a mistrial because it was one juror that said that
- 34:50Speaker 3: they didn't prove their case and they wasn't going to
- 34:53Speaker 3: send She wasn't going to vote for conviction to send
- 34:58Speaker 3: an innocent man to prison and for the rest of
- 35:00Speaker 3: his life. She wasn't gonna do that. So going to
- 35:06Speaker 3: trial number two, the day they were selecting the jury,
- 35:12Speaker 3: it was a big protest. Now you can go you
- 35:17Speaker 3: can google Wan Johnson's name because you can google anybody
- 35:22Speaker 3: anybody named that been on this show that I don't
- 35:25Speaker 3: talked to, and you will see it that it's public
- 35:28Speaker 3: record what they're talking about. So with one, when they
- 35:33Speaker 3: was picking up Trotton picking his jury, the DA put
- 35:40Speaker 3: on a rally and it was titled how to put
- 35:46Speaker 3: Away Murderers for Life. The day they released Doves, the
- 35:54Speaker 3: family gave impact statements all out there on the court
- 35:59Speaker 3: stairs doing lunch. So when they came back in from
- 36:07Speaker 3: resets from lunch, they lunch. His lawyer questioning, uh, you know,
- 36:13Speaker 3: sent the motion to the judge saying it needs to
- 36:16Speaker 3: be missed, dismissed. The jury's tainted. We can't use it
- 36:20Speaker 3: because they've seen this. Do you know that judge only
- 36:27Speaker 3: dismissed three people out of that and half when she
- 36:32Speaker 3: pulled the jury, all of them raised their hand said
- 36:36Speaker 3: that they seen the protests out there. She still set
- 36:42Speaker 3: that jury after that. I know that that jury was
- 36:48Speaker 3: supposed to have been thrown away. Took the thrown out
- 36:52Speaker 3: because it was tainted. It was tainted. So now you
- 36:58Speaker 3: have a judge just allowing, you know, just allowing anything.
- 37:03Speaker 3: And she allowed jurors to sleep, and she waited till
- 37:10Speaker 3: they woke up, and she would say, oh, I was
- 37:16Speaker 3: wondering when you was gonna wake up. You just nodded
- 37:18Speaker 3: it off for a minute.
- 37:20Speaker 1: This is the judge.
- 37:23Speaker 3: So this is what's going on in the courtroom. This
- 37:25Speaker 3: is going on with the men and women that are
- 37:29Speaker 3: currently incarcerated. I'm wrong for conviction. This is what's going
- 37:36Speaker 3: on doing their trial. Do you have jurors falling asleep.
- 37:39Speaker 6: You have.
- 37:41Speaker 3: In Sebastian case, you had his lawyer call him the
- 37:45Speaker 3: wrong name. You had a judge that's not paying attention.
- 37:48Speaker 3: They just looking for that conviction. I'm gonna let my
- 37:53Speaker 3: co hosts jump in real quick, go.
- 37:58Speaker 6: Ahead, okay, okay, With that being incident, ma'am. You know,
- 38:02Speaker 6: we already know that they go to lunch together, they
- 38:04Speaker 6: eat together. Matter of fact, they ticked together.
- 38:07Speaker 7: Man.
- 38:07Speaker 6: So when they turn, turn for address, and of a
- 38:10Speaker 6: generous duties and obligations to the traditional system matter, but
- 38:14Speaker 6: just on a nine times out of ten, give the
- 38:16Speaker 6: prosecutor the need way to get a conviction. Why because
- 38:20Speaker 6: this is what our system is fear for corruption and bribery, ma'am.
- 38:25Speaker 6: In the past thirty years now, corruption and bribery has
- 38:28Speaker 6: been the number one foundation of secutor of local commissions.
- 38:32Speaker 6: As you mentioned earn, we have something number three thousand
- 38:35Speaker 6: people here in the United States texts a matter of fact,
- 38:39Speaker 6: us a convicting the ground station not committed. So with
- 38:42Speaker 6: this be intended, ma'am. You know, and mister brother one's case,
- 38:46Speaker 6: you know I just stept that case with you earlier.
- 38:48Speaker 3: Yes, and you had brought.
- 38:50Speaker 6: Up some very important topics to me about this case. Now,
- 38:54Speaker 6: the number one thing that I want to touch on
- 38:56Speaker 6: mister Warren's case is the fact that he cannot be
- 39:02Speaker 6: incarcerated for a capital to murder case from life without paroles.
- 39:07Speaker 6: Then the jury found that he did not commit the murder.
- 39:11Speaker 6: That's number one. Number two, there is no underlying office
- 39:16Speaker 6: of accravated wrongfu Therefore the murder cannot be elevated to
- 39:20Speaker 6: the capitalist element. With that being said, that's the one's
- 39:25Speaker 6: conviction and his symtoms is plassified as disproportionate, which means
- 39:31Speaker 6: that his conviction is boys. He cannot be imprisoned for
- 39:35Speaker 6: a crime that is disproportionate to the office charged. The
- 39:40Speaker 6: number of years he got cannot amount to the crime
- 39:44Speaker 6: because if you're convicting him for the lesson included office,
- 39:47Speaker 6: which is abelody murder, a feb murder is not the
- 39:51Speaker 6: same as an intentional and normal murder. Man element's the
- 39:55Speaker 6: difference you have to prove from elements. So with this
- 39:58Speaker 6: being said, ma'am, and the one's case, you know, I
- 40:01Speaker 6: found a lot of holes in the case were as
- 40:04Speaker 6: his interrogation process. He never has the reputation of an attorney,
- 40:08Speaker 6: nor did he have the reputation of family members that
- 40:10Speaker 6: finds him. But was right to remain. Not only that
- 40:15Speaker 6: the other individuals who justified against him were different deals. Yes,
- 40:19Speaker 6: and not only that, going to the drund and Urpey process.
- 40:22Speaker 6: If there's any information coming from a criminal detective about
- 40:26Speaker 6: three people committing a crime, that information that has to
- 40:29Speaker 6: go for the grand service. Because this case deals with
- 40:33Speaker 6: the fact that the queer jury only indicted as you're
- 40:36Speaker 6: an individual who is allegedly the party to the office.
- 40:40Speaker 6: What's happened to the principal, which is a guy who
- 40:43Speaker 6: pens the death of the victims. Now, according to the fact,
- 40:47Speaker 6: they did not even charge him with cling. It just
- 40:51Speaker 6: sits the crown another case against him and offer him
- 40:54Speaker 6: to testify against mister warm Jumps, which is an illegal process.
- 40:59Speaker 6: There is the other not even get charged because they
- 41:01Speaker 6: gave them qualified the unity prosecuting. So the question where
- 41:08Speaker 6: is approved that list the one that has committed a
- 41:12Speaker 6: crime him to be sitting in prison with a capital
- 41:19Speaker 6: rights without.
- 41:20Speaker 3: It's no evidence. There's no evidence, and he was acquitted
- 41:27Speaker 3: murder after deliberation he was acquitted of that. And then
- 41:31Speaker 3: with the with the fella a murder. He doesn't have
- 41:35Speaker 3: an underlying predicate offense. They they kept saying during the trial,
- 41:44Speaker 3: and he mentioned that he The judge kept throwing it
- 41:47Speaker 3: out there trying to get the prosecution to pick it
- 41:52Speaker 3: up that hey, you you don't have no underlying element
- 41:58Speaker 3: to go with this. She kept throwing out rivalry, robbery,
- 42:01Speaker 3: robbery one number one. They didn't. He was never charged
- 42:05Speaker 3: with robbery and he was never given the chance to
- 42:09Speaker 3: forget to defend against the robbery charge. He was only
- 42:15Speaker 3: his defense was only towards the murder section, the murder
- 42:21Speaker 3: part in which he was acquitted up.
- 42:25Speaker 6: Okay, so that's like that then it self now mix
- 42:29Speaker 6: the war Dorthin actually wow, because there was no perdict
- 42:34Speaker 6: far for acclavator robbery and toward Jonathan Kate call for
- 42:37Speaker 6: security to be able to come back for the determination
- 42:41Speaker 6: as to whether or not they will convict him for robbery.
- 42:45Speaker 6: And with the capital governal there's no first farm.
- 42:50Speaker 3: Boards, No, No, the issue was this.
- 42:53Speaker 6: This is becausified that judicial manipulation left. The judge is
- 42:57Speaker 6: just as much a part of this as the district
- 42:59Speaker 6: attorney and mister WARN's lawyer. Mister Warn lawyer was appointed
- 43:03Speaker 6: in father states mister Warren's lawyer could have done weighed
- 43:07Speaker 6: more than enough to be able to get the chess
- 43:09Speaker 6: to refuse himself from this case. Wow, because the judge
- 43:13Speaker 6: allowed this kid to go forward for the jury charge
- 43:16Speaker 6: that the judge knew was the false that they're The
- 43:21Speaker 6: jury charge of mister Warren's case contain a worknesses names,
- 43:26Speaker 6: not the the not the the not to be hided
- 43:31Speaker 6: witness in any case, and it was the wicked and
- 43:35Speaker 6: the charge of the jury. Yes, therefore, the jury could
- 43:40Speaker 6: not have fined mister ware Here's to be on the
- 43:42Speaker 6: reason without but that fire Why because the jury jar
- 43:46Speaker 6: from the money expected because it fails the outline the
- 43:49Speaker 6: evidence of the officer with mister warn Johnson Field cut
- 43:54Speaker 6: to mind yourself at state, ladies and gentlemen, the jury
- 43:58Speaker 6: it's too fine. The evidenced the reason of doubt right.
- 44:04Speaker 6: This means that any evidence in the case happens to
- 44:06Speaker 6: be patrige to prove that mister Johnsons offense and then
- 44:11Speaker 6: mister Johnson's case there is no evidence to prove. Therefore,
- 44:15Speaker 6: the jury could not have been legally instructed this devironment.
- 44:18Speaker 6: Mister Johnson Houston that being did there, it's still a
- 44:22Speaker 6: talent charge. The just WoT the hospital individuals who are
- 44:28Speaker 6: accused of this crime. Well, the judge and the dis
- 44:31Speaker 6: cot turning himsel a note fascinated to say, were not
- 44:33Speaker 6: even judge because that was not enough.
- 44:35Speaker 3: Evidence exactly himself, exactly.
- 44:41Speaker 6: The individuals or the criminal investigators investigated. It will be
- 44:46Speaker 6: important to mister Wallan Johnson and the detection himself, said
- 44:51Speaker 6: mister Warren Johnson, or the parties of the crime, not
- 44:54Speaker 6: the perpose rate, not the actual shooter. So now just
- 44:58Speaker 6: make me wonder what Germany and to come back with
- 45:03Speaker 6: an indictment of mister Jumps. There's no way possible. No,
- 45:09Speaker 6: no boy, go jury and mister wall Johns no good,
- 45:20Speaker 6: well you have no good.
- 45:22Speaker 3: I want to jump in before before I get this,
- 45:26Speaker 3: before I'll leave my mind real quick, because he told
- 45:30Speaker 3: me that when the jury, I guess, they sent out
- 45:36Speaker 3: a note saying that they they didn't come to a.
- 45:46Speaker 2: A comment.
- 45:47Speaker 3: Uh you know what I'm trying to say. They didn't
- 45:50Speaker 3: come to a resolution. So the so the judge sent
- 45:55Speaker 3: back a note to them told them that if they
- 45:59Speaker 3: didn't come back with a verdict, that they was coming
- 46:04Speaker 3: back on Monday so really the verdict was rushed because
- 46:08Speaker 3: the jury didn't want to come back. They didn't want
- 46:12Speaker 3: to come back Monday, so they went on and they
- 46:17Speaker 3: went on and rushed the verdict after knowing that the
- 46:22Speaker 3: other witness, the other two witnesses, the other people that
- 46:25Speaker 3: were supposed to be involved, was they said that it
- 46:30Speaker 3: wasn't no evidence. You didn't have no evidence on why
- 46:35Speaker 3: you never searched, you never sent to search, you never
- 46:39Speaker 3: you never searched his home. When you arrested him, you
- 46:47Speaker 3: didn't even have you said you have problem probable calls,
- 46:52Speaker 3: but you didn't have an arrest warrant. You didn't have
- 46:57Speaker 3: a warrant for his arrests. So when you took him
- 47:02Speaker 3: in to interrogate him and you found out that basically
- 47:09Speaker 3: he didn't he didn't have nothing to do with it,
- 47:12Speaker 3: now you go hurry up and get a rest warrant
- 47:15Speaker 3: so you can build a case. So that's what I'm
- 47:19Speaker 3: thinking that you know, are these wrongful convictions where you
- 47:23Speaker 3: know they don't have warrants for these got these men
- 47:26Speaker 3: and women arrests and they hold them and just to
- 47:32Speaker 3: try to build a case, just to get people to say, oh, yeah,
- 47:37Speaker 3: they was there just like in Sebastian Roy case, someone
- 47:43Speaker 3: sent the message saying that if you was close to
- 47:47Speaker 3: Sebastian and you got in trouble and you had something
- 47:50Speaker 3: going on in the court system, they'd come to you
- 47:53Speaker 3: and tell you the Oh, if you come with us
- 47:58Speaker 3: and testify against him, we'll make all these charges go away.
- 48:06Speaker 3: That that right there is that that is just mind
- 48:10Speaker 3: blowing that this is what they doing.
- 48:12Speaker 6: Case. Thanks, well, that's the certain thing that happened with
- 48:17Speaker 6: mister Jarn Johnson. You can't know, ma'am that his case
- 48:22Speaker 6: is basically a share case. Why because there's no others
- 48:26Speaker 6: to make him to the choir Number one the set
- 48:29Speaker 6: off phone represents Drake basically saying that their phone was
- 48:32Speaker 6: in the general carrier. Let's indicate that the two people
- 48:36Speaker 6: who mistake dis misstake cases, and that's Warren Johnson's case,
- 48:41Speaker 6: if all these phones was in the same general areas.
- 48:44Speaker 6: So how is this that if you could fix mister
- 48:46Speaker 6: Warren dilicenentions on a cell phone reference, how are you
- 48:49Speaker 6: just missing the case against these other two initials because
- 48:52Speaker 6: you're classified them as saying perpetrating of the same choir.
- 48:58Speaker 6: So with that being said, the issue was that mister
- 49:00Speaker 6: Johnathon has been made a victim of what we call
- 49:03Speaker 6: traditional manipulation man. So the giants has allowed to dispatilties
- 49:08Speaker 6: offers his computer and indig mister Johnson. But that was
- 49:12Speaker 6: no evidence to prove that he even committed crimes. Now
- 49:16Speaker 6: the conviction that he got, it does not mean the
- 49:20Speaker 6: time man its center. It is for capital mother life
- 49:24Speaker 6: with our parole. He can't have a life with our
- 49:27Speaker 6: grown center for capital offers. When the jury found him
- 49:30Speaker 6: not guilty for that the issue was at work. They
- 49:33Speaker 6: feel that the stay's supposed to come back and drop
- 49:36Speaker 6: the capital elements off the table and navignse goes to
- 49:39Speaker 6: the differ jigs. The Blue bargain a five ninety nine
- 49:43Speaker 6: to life and stated they allowed the jury to come
- 49:47Speaker 6: back and propecute him under flight with our parole for
- 49:51Speaker 6: pellamy murder and you can't hear the life with our
- 49:53Speaker 6: parole for a felony murder man. Now for his conviction
- 49:57Speaker 6: right now is no good has to stand. So he
- 50:01Speaker 6: is actually innocent, because he's actually Innocomewhere here is the
- 50:06Speaker 6: jury act for an alan charge to find out where
- 50:10Speaker 6: are the other two people who committed the crime? The
- 50:12Speaker 6: stake that we don't have enough evidence. Well, if we
- 50:15Speaker 6: said and mister woman did not commit the murderer, that
- 50:18Speaker 6: makes them actually innocing man. But you know, right now,
- 50:23Speaker 6: go ahead, come on, So right now, the main thing
- 50:28Speaker 6: that could be done with the one case in order
- 50:31Speaker 6: to prove that he is actually interfol it to come
- 50:34Speaker 6: back and for an application on the actual interests and
- 50:39Speaker 6: showing everything that he has developed in this case, showed
- 50:42Speaker 6: him that the jury concluded in their desiparation that he
- 50:47Speaker 6: did not commit the overhaul and send them on and
- 50:50Speaker 6: knowing murder, which can only be elevated capital murder. We're
- 50:54Speaker 6: the underline of offense with just an aggravated Roberts because
- 50:59Speaker 6: they don't have that he's actually in put off the
- 51:02Speaker 6: curent this right here, open the door. They have to
- 51:06Speaker 6: grant him here in honer for him to be able
- 51:10Speaker 6: to be able to come back, and they have to
- 51:12Speaker 6: make a record in the determined whatever do you have?
- 51:16Speaker 6: Get barn jumps from the pool.
- 51:19Speaker 3: Well, co host, can I jump in? Could I jump
- 51:22Speaker 3: in right quick?
- 51:24Speaker 6: Yes, ma'am.
- 51:27Speaker 3: They deny him a hearing, they did just supreme. They
- 51:31Speaker 3: deny him the the hearing because they said that his
- 51:36Speaker 3: lawyer should have brung it up in the in the
- 51:42Speaker 3: uppeal that there was no underlying offense to go with
- 51:47Speaker 3: the felony. So they saying that no, you won't, you won't,
- 51:51Speaker 3: you won't sit here. That's what they're saying. You know,
- 51:54Speaker 3: they deny.
- 51:55Speaker 6: Okay, but look at what you're saying. We are talking
- 52:00Speaker 6: about challenging something totally different. They right, because the issue
- 52:06Speaker 6: is a substantial violation issue. We're talking about super process
- 52:10Speaker 6: violation issues, which is a civil rights violation issue. He
- 52:15Speaker 6: has to raise actual eversis, which is to gave me
- 52:20Speaker 6: in part for him to get an evitension area here
- 52:23Speaker 6: because everything he's challenging to the Supreme Court, he already
- 52:26Speaker 6: challenged it. And that's point because they have to have
- 52:29Speaker 6: the opportunity can address that. But if he now come
- 52:33Speaker 6: back and fillow Rich on actual entsis that open the
- 52:37Speaker 6: rue to get a hearing on his flame event actually
- 52:41Speaker 6: answer for the corn for how because number one, his
- 52:44Speaker 6: senses and support to the offense. Because he got seventy murder,
- 52:48Speaker 6: he don't have intentional murder. Man, he cannot be in
- 52:52Speaker 6: prison for a life without parole for murder without an
- 52:56Speaker 6: underlying of offense his lawyer, miss have not defended him.
- 53:00Speaker 6: I don't know.
- 53:01Speaker 3: And that's what that's what he keeps. That's what you know.
- 53:05Speaker 3: He keep asking is how is he in there? And
- 53:10Speaker 3: it's no, the charges doesn't doesn't match. It's no, he
- 53:15Speaker 3: wasn't never charged with a robbery or anything. And then
- 53:19Speaker 3: the witness said that he did not work up him,
- 53:25Speaker 3: he did not drive him.
- 53:26Speaker 6: So told you made you just said it. That's the
- 53:31Speaker 6: actual claim. All he has to do is follow one
- 53:34Speaker 6: grown actual Chemothy. He can file two grounds. He can
- 53:39Speaker 6: follow actual boy judgment. The boy does the fact that
- 53:43Speaker 6: his capital life serves without parole. It does not put
- 53:47Speaker 6: the clime of fell anymore. Now, for his judgment is
- 53:50Speaker 6: a boy's judgment. But he can't be in prison like that.
- 53:55Speaker 6: And you can raise the boy judgment at any time
- 53:58Speaker 6: for what he do and take a put actual and disproportion.
- 54:03Speaker 6: That's the whole run like that. And they got to
- 54:06Speaker 6: open the door for him to be able to get
- 54:08Speaker 6: his cake and other stuff. They know they got him man.
- 54:13Speaker 3: So and I just I want to have I just
- 54:16Speaker 3: got this one question for you. Why is it so
- 54:21Speaker 3: hard to get a hearing, an evidentiary hearing? Why is
- 54:28Speaker 3: it so hard. I hear it in James Legate, I
- 54:32Speaker 3: hear it in some fashion, you know.
- 54:35Speaker 6: And.
- 54:37Speaker 3: Glenn Kemp. They are denying them these hearings, and then
- 54:43Speaker 3: they tell them that when they ask for legal legal representation,
- 54:49Speaker 3: they deny them that. But I thought that you are
- 54:55Speaker 3: entitled to legal representation and they telling me. You know,
- 55:01Speaker 3: from what Wants told me is that they told him, no,
- 55:06Speaker 3: you're not not when it comes to certain post conviction
- 55:13Speaker 3: you're not entitled to legally legal represents. Since representation when
- 55:21Speaker 3: it's when it's for post conviction.
- 55:26Speaker 6: Okay, the only time we've got and the right reputation
- 55:33Speaker 6: is on Director Peal. That's why the phrase border said
- 55:37Speaker 6: mister Ward. That's the issue that he raised him. His
- 55:39Speaker 6: attorneys would have brought this issue on even direct appeal
- 55:43Speaker 6: because he got a right to counter on our rector.
- 55:46Speaker 6: He don't have a right to counter on post conviction.
- 55:48Speaker 6: Lin that's the latter attack. So now with that being said,
- 55:53Speaker 6: you have to push the why it is so hard
- 55:55Speaker 6: to get a hearing. The deepden are hearing is the
- 55:59Speaker 6: process of coming out on attack. The proof is on
- 56:02Speaker 6: mister Warren to bring enough evidents in to show that
- 56:06Speaker 6: he is worthy of the course. So now this is
- 56:12Speaker 6: what I'm saying. The actual is that key that opens
- 56:15Speaker 6: the door. Must the want to get that evident to
- 56:18Speaker 6: her hearing? Anything else to set aside as Director Field issues,
- 56:23Speaker 6: He's a fish already issues have to repeat. So now
- 56:32Speaker 6: the only issue in the United States right down that
- 56:34Speaker 6: has the sport just the ever actual fright. So right
- 56:40Speaker 6: now all he has to do is actual evisis on
- 56:44Speaker 6: the on the whatever process they choose. If that right
- 56:47Speaker 6: there is the course kind of hath rest that and
- 56:50Speaker 6: they got to quant him and ever get to their
- 56:52Speaker 6: hearing because of every hearing and to make a record.
- 56:57Speaker 6: Making a record mean that they got to become the
- 56:59Speaker 6: court that have to talk about whatever. The court jood
- 57:07Speaker 6: have to recommend him to be in Congress, that's what
- 57:10Speaker 6: you have to do. And you have enough fact and everything,
- 57:21Speaker 6: because of course they're not going to let them in
- 57:22Speaker 6: like that.
- 57:23Speaker 3: Yeah, you have to raid. And then so well, you know,
- 57:29Speaker 3: we got four minutes and uh wow, and I had
- 57:33Speaker 3: one more question to ask you, and I'm gonna think
- 57:36Speaker 3: I'm gonna see if you can answer it real quick
- 57:39Speaker 3: for me, you know, So when they do resentencing, because
- 57:43Speaker 3: he was asked the Innocent Project is listening looking into
- 57:49Speaker 3: his case. They're actually representing him, and they asked him
- 57:55Speaker 3: about resentencing. Would he go ahead? Would he take a deal? Well,
- 58:00Speaker 3: he would take it, uh a plead if they offered
- 58:04Speaker 3: him the resentence, and he was like first he was like,
- 58:09Speaker 3: he just want to come home, you know, and then
- 58:11Speaker 3: he came back and he said no, because I didn't
- 58:14Speaker 3: do this. Why should I had to admit to something
- 58:19Speaker 3: that I didn't do? So my question is why do
- 58:24Speaker 3: they do that? Why do they want you to admit
- 58:26Speaker 3: to something just to come home and they know you're innocent.
- 58:33Speaker 6: Okay, well let's look at the fust damn mess. That
- 58:37Speaker 6: don't work in walm cake wow, because war got in
- 58:40Speaker 6: life without capital like our role that's only for the jury.
- 58:45Speaker 6: The only way Walt can get He'll think is that
- 58:48Speaker 6: they have to wait and that didn't do that, wow,
- 58:53Speaker 6: because you got capital right without role. So now with
- 58:56Speaker 6: that fair thing, the only way that walk can get
- 58:58Speaker 6: that cake to the dove to have this question is
- 59:01Speaker 6: that they have to take it back on an EVIDENTI
- 59:04Speaker 6: area here and therefore he has to overturn the death
- 59:07Speaker 6: centers left. That's the only way to get it to
- 59:11Speaker 6: get through an EVIDENTI are here because right now you
- 59:14Speaker 6: can't do that because the don't have no dispression because
- 59:17Speaker 6: of the capital offense. And that's to the jury only,
- 59:21Speaker 6: not to the tu look at it like this. The
- 59:23Speaker 6: only way he get through the judge. But if I
- 59:27Speaker 6: choose the way to test unency down, the judge can
- 59:29Speaker 6: give me my roles on life with the role of
- 59:33Speaker 6: fifty years. But it got to be I have to
- 59:35Speaker 6: wait for death under they off the pace. So that's
- 59:38Speaker 6: where we at. He has to get evident their hearing
- 59:40Speaker 6: and the only way he can do it right now
- 59:42Speaker 6: is the file actualis. Man, that's where we att So
- 59:46Speaker 6: he wanted to have travel. You need to be help
- 59:48Speaker 6: to let me know.
- 59:49Speaker 3: Okay, So we got two we got two minutes to
- 59:52Speaker 3: wrap it up. So I'm gonna give you give you
- 59:54Speaker 3: a minute and I'm gonna take a minute.
- 59:58Speaker 6: Okay, man, But you want who's listening to this podcast tonight,

- 1:01:22Speaker 3: which is in a few days for a crime that
- 1:01:27Speaker 3: he didn't convient. It was debunked. The Innocent Project is
