- 1:29SPEAKER_04: And we have our professionals, Lisa Miller with First Choice Realty Pros, coming to talk to us today, continuing the dark side of real estate conversation.
- 1:39SPEAKER_01: Doot doo.
- 1:41SPEAKER_04: I love it.
- 1:42SPEAKER_04: I love it.
- 1:42SPEAKER_04: Yeah, and this is where we're going to be talking about what sellers don't tell you.
- 1:48SPEAKER_04: So, Lisa, walk us through what do you mean, what sellers don't tell us.
- 1:52SPEAKER_02: Sometimes sellers know things about the home and they don't want anyone else to know.
- 1:59SPEAKER_02: And that's what we'll get.
- 2:00SPEAKER_02: The secrets of the home.
- 2:01SPEAKER_02: Yeah, the secrets of the home.
- 2:03SPEAKER_02: You know, they they might say, Oh, well, we knew that this was there was a leak, or we knew that's why they need a professional to go through the house with them to tell them right what they need to start taking care of.
- 2:15SPEAKER_02: Because me as a professional, and we'll get to that a little bit later, I have to disclose what I do know.
- 2:21SPEAKER_04: Right.
- 2:21SPEAKER_04: Yeah.
- 2:21SPEAKER_04: Right.
- 2:22SPEAKER_04: Yeah.
- 2:22SPEAKER_04: And and so that's one of the things that we hope that sellers being honest with us.
- 2:26SPEAKER_04: Right.
- 2:27SPEAKER_04: Yeah.
- 2:27SPEAKER_02: Material defects.
- 2:29SPEAKER_02: Yeah.
- 2:29SPEAKER_04: Right.
- 2:30SPEAKER_04: Right.
- 2:30SPEAKER_04: And that and that's a thing.
- 2:31SPEAKER_04: But you know, every experience a real estate professional eventually runs across situations.
- 2:37SPEAKER_02: Like a convenient rug put somewhere you're in.
- 2:41SPEAKER_04: That looks like a brand new rug.
- 2:42SPEAKER_04: Why is it out in the middle of this walk area?
- 2:44SPEAKER_02: Yes, because there's a big stain in the middle of the floor.
- 2:47SPEAKER_02: So, you know, I have my clients roll up that rug and see what's underneath there.
- 2:52SPEAKER_04: But what if you have like you walk into the basement and there's one wall freshly painted but the rest aren't?
- 2:58SPEAKER_04: Then you Is that a red flag?
- 2:59SPEAKER_02: It maybe.
- 3:00SPEAKER_02: It can be.
- 3:01SPEAKER_02: It could be that I've been in houses where uh people have allowed their children to have a wall and they've painted their names and they've done all kinds of things.
- 3:09SPEAKER_02: So that wall has been painted for that reason.
- 3:13SPEAKER_02: But it raises a question.
- 3:14SPEAKER_04: But if you don't ask, it may be something else.
- 3:16SPEAKER_04: Right.
- 3:17SPEAKER_04: Because I know growing up, uh my sisters and I we'd always fight over who had the bedroom in the basement, right?
- 3:22SPEAKER_04: And it wasn't a real bedroom.
- 3:24SPEAKER_04: I mean, we we were in an unfinished basement and we would literally hang bed sheets from the rafters to create walls.
- 3:30SPEAKER_04: Right.
- 3:30SPEAKER_04: And it was the bedroom, right?
- 3:31SPEAKER_04: And we got to paint the basement wall whatever we wanted, similar to what you're saying.
- 3:35SPEAKER_02: Yeah.
- 3:35SPEAKER_04: So it could be that instance.
- 3:37SPEAKER_02: It could be, it could be, but it could be something more.
- 3:39SPEAKER_04: It could be a freshly repaired crack in the wall.
- 3:42SPEAKER_02: It could be.
- 3:43SPEAKER_02: And if it was freshly repaired by a DIY or a professional.
- 3:47SPEAKER_02: Or a professional.
- 3:48SPEAKER_02: There's there's your questions.
- 3:50SPEAKER_04: True, true.
- 3:51SPEAKER_04: Yeah, and I know it doesn't automatically mean it's an issue.
- 3:53SPEAKER_02: No.
- 3:54SPEAKER_04: It's just but asking the communication.
- 3:56SPEAKER_04: Because I know you guys at First Trust Really Pros are professionals at communication.
- 4:01SPEAKER_04: And that's what we love about having you guys as our 10x partners.
- 4:04SPEAKER_02: We definitely try.
- 4:05SPEAKER_04: Yeah, exactly.
- 4:06SPEAKER_04: But what are some of the questions that you might want to ask, you know, well on stuff?
- 4:10SPEAKER_02: You just start if you see something that makes you wonder, you know, you just have that feeling in your gut, you're like, hmm.
- 4:17SPEAKER_02: If you start going, hmm, then ask the question.
- 4:20SPEAKER_02: Hey, could you ask the seller or the seller agent why this or that?
- 4:24SPEAKER_02: That is, you know, why did why were two of the walls painted in the in the basement, right?
- 4:30SPEAKER_02: But the other ones were not.
- 4:32SPEAKER_02: Right.
- 4:32SPEAKER_02: Are they hiding something?
- 4:33SPEAKER_02: Was there a water issue?
- 4:35SPEAKER_02: Yeah.
- 4:35SPEAKER_02: What's going on?
- 4:36SPEAKER_02: Um, if you go down and you see the uh drywall that's been uh cut two feet above, right, you know, right?
- 4:45SPEAKER_04: But they're saying we've never had water in our basement.
- 4:47SPEAKER_02: We've never had water.
- 4:49SPEAKER_02: Yeah.
- 4:50SPEAKER_02: A story.
- 4:50SPEAKER_02: The disclosure said no water in the basement.
- 4:53SPEAKER_04: Right.
- 4:53SPEAKER_02: Okay.
- 4:54SPEAKER_02: I go down the basement.
- 4:55SPEAKER_02: There's a crack, probably two inch crack down the basic.
- 4:58SPEAKER_02: That's a big crack.
- 5:00SPEAKER_02: Okay.
- 5:00SPEAKER_03: Wow.
- 5:01SPEAKER_02: With a garden hose in the crack, with the garden hose leading to the drain.
- 5:07SPEAKER_02: The drain.
- 5:07SPEAKER_04: So the garden hose was their their funnel.
- 5:09SPEAKER_02: The yes, leading the water to that.
- 5:12SPEAKER_02: But the disclosure said, no water in the basement.
- 5:15SPEAKER_02: I went back to the selling agent and said, What the heck?
- 5:18SPEAKER_02: What the heck?
- 5:19SPEAKER_02: Yeah.
- 5:20SPEAKER_02: I I took a picture of it and said, the disclosure says this.
- 5:24SPEAKER_02: What about this picture?
- 5:25SPEAKER_02: And they definitely changed that disclosure after that.
- 5:28SPEAKER_04: Wow.
- 5:29SPEAKER_04: Yeah.
- 5:29SPEAKER_04: Another telltale is if their personal belongings are sitting up off the floor several inches, right?
- 5:34SPEAKER_02: Yeah.
- 5:34SPEAKER_04: Just above the water line.
- 5:36SPEAKER_02: Just above well, you go down and you see the the wood, the framing of maybe they were gonna put up a wall.
- 5:43SPEAKER_02: Right.
- 5:44SPEAKER_02: And that wood is all do dirt.
- 5:46SPEAKER_04: Yeah.
- 5:46SPEAKER_02: Yeah.
- 5:46SPEAKER_02: Or it could have growth of some sort.
- 5:48SPEAKER_04: Right.
- 5:49SPEAKER_02: Um, or the drywall, what's it gonna do?
- 5:51SPEAKER_02: It's gonna wick up in there.
- 5:53SPEAKER_02: If you've had water standing, even on a concrete wall, there will be a discoloration of that wall to show you, yeah, there's been something.
- 6:04SPEAKER_02: Your furnace is up two feet, you know, off the ground.
- 6:08SPEAKER_04: That's high.
- 6:08SPEAKER_04: Yeah.
- 6:09SPEAKER_02: Yeah.
- 6:09SPEAKER_02: I mean, it could be that there's been some problems.
- 6:12SPEAKER_04: That's true.
- 6:13SPEAKER_04: That's true.
- 6:14SPEAKER_04: And I know another telltale sign that people don't think they're the efflorescence, the the bubbling of the block, which is the moisture coming through.
- 6:24SPEAKER_04: Yes.
- 6:24SPEAKER_04: And it's like a calcium-like and it just brushes off like powder.
- 6:28SPEAKER_04: Yeah, that's moisture.
- 6:30SPEAKER_02: Deteriorates the wall, which deteriorates the strength of the foundation.
- 6:34SPEAKER_04: Yeah, and like you were saying earlier too, about if it's a DIY, DIY or or professional about the the DIY surprise.
- 6:40SPEAKER_04: Yes.
- 6:41SPEAKER_04: Oh, my brother-in-law did that because he can.
- 6:44SPEAKER_04: Or he wanted to, right?
- 6:46SPEAKER_02: Yeah.
- 6:46SPEAKER_04: Um does that make you nervous at all when you hear that line?
- 6:49SPEAKER_02: Depends on the brother-in-law.
- 6:50SPEAKER_02: If if the brother-in-law is a con construction.
- 6:54SPEAKER_02: Yeah.
- 6:54SPEAKER_02: I mean, it would be like, okay, well, your brother-in-law, does he have, you know, is he does he have a business?
- 7:00SPEAKER_02: Is this what he does?
- 7:01SPEAKER_03: Right.
- 7:01SPEAKER_02: Um, but once you have those inspections, the inspector will come back and yeah, yeah.
- 7:07SPEAKER_02: And then when work is being done off of those inspections, then I ask for it to be by a contractor.
- 7:13SPEAKER_04: Gotcha.
- 7:14SPEAKER_04: Yeah.
- 7:14SPEAKER_04: Which is great because we always you always refer revert back to that, which is phenomenal.
- 7:18SPEAKER_04: Because leave it to the professionals that to inspect your home that you're going to purchase.
- 7:24SPEAKER_02: Absolutely.
- 7:25SPEAKER_04: And and we want to take everyone at face value in their word.
- 7:28SPEAKER_04: But sometimes we have to let the property speak for itself, right?
- 7:31SPEAKER_02: Right.
- 7:31SPEAKER_02: Right.
- 7:32SPEAKER_02: And when you get into electrical and plumbing, that's a little bit different.
- 7:36SPEAKER_02: Um, foundation, you know, you want to make sure that, you know, if you don't have a good foundation, what do you got?
- 7:41SPEAKER_04: Right.
- 7:41SPEAKER_02: And if you turn the light switch on and it flickers or the the furnace kicks on and the lights dim, that could be something that's going on.
- 7:49SPEAKER_02: So those things take it.
- 7:50SPEAKER_04: Loose connection and the box and yes.
- 7:53SPEAKER_04: When it has a large amp draw, it's pulling across to everything else and making it right.
- 7:57SPEAKER_02: Right.
- 7:58SPEAKER_02: Yeah.
- 7:58SPEAKER_04: Or that little buzzing sound when you turn a light switch on.
- 8:02SPEAKER_02: Right.
- 8:03SPEAKER_02: No, no, yeah.
- 8:04SPEAKER_02: I don't want instant perm when I turn the light switch on.
- 8:06SPEAKER_02: No.
- 8:07SPEAKER_04: Perm.
- 8:07SPEAKER_02: I don't want that.
- 8:08SPEAKER_04: People pay good money for that, Lisa, and you get it for free.
- 8:10unknown: Yeah.
- 8:11SPEAKER_04: I mean, I don't know why you're complaining, right?
- 8:13SPEAKER_02: I don't want the zap.
- 8:14SPEAKER_04: Tingle through your body.
- 8:15SPEAKER_04: What are some other things that that a seller on the dark side may not tell someone, you know, um, especially if it's in the neighborhood or something?
- 8:25SPEAKER_02: Well, they might be in a conflict with their neighbor about a driveway.
- 8:30SPEAKER_02: We talked about that before.
- 8:31SPEAKER_02: Shared driveway.
- 8:32SPEAKER_02: Shared driveway and then neighbors change, and then it's not you might have a patch of land in the back that the neighbor has been mowing for years for you and you've never said anything, but now you're getting ready to sell, and that neighbor kind of feels like that's his now.
- 8:47SPEAKER_02: So when you sell it, the neighbor comes over to the new buyer and says, Hey, by the way, I just wanted you to know I've been doing this for, you know, 10, 15 years.
- 8:56SPEAKER_02: I feel like it's mine.
- 8:57SPEAKER_02: Yeah.
- 8:57SPEAKER_02: Of course, mean legal battle.
- 9:00SPEAKER_02: Legal, yeah.
- 9:01SPEAKER_04: Yeah.
- 9:02SPEAKER_02: So have those surveys if you feel like something like that's gonna happen.
- 9:06SPEAKER_04: Surveys are key.
- 9:07SPEAKER_04: I I my personal and professional construction opinion, not real estate professional opinion.
- 9:13SPEAKER_04: Mike, professional construction is if you're buying a piece of property, commercial, residential, whatever it is, or just a patch of land, have it surveyed.
- 9:21SPEAKER_04: Know your corners, know your boundaries.
- 9:23SPEAKER_02: Yeah.
- 9:23SPEAKER_04: That way, before you even attempt attempt to do it, you know who owns what.
- 9:29SPEAKER_02: Right.
- 9:29SPEAKER_02: Right.
- 9:30SPEAKER_02: And a lot of people don't because they're like, I'm not gonna put up a fence right now.
- 9:34SPEAKER_02: I'll do that down the, you know, down the path.
- 9:36SPEAKER_02: And um, so if you're going to you have to have that survey.
- 9:41SPEAKER_02: Because your neighbor's gonna say, hey.
- 9:42SPEAKER_04: Or, well, I'm not gonna have it done because there's already a fence up, you know, the neighbor's got up, and then you do get it surveyed later and you realize that the neighbor's fence is two feet on your property.
- 9:51SPEAKER_02: Yes.
- 9:52SPEAKER_04: Then you're like, Yes, uh, now you could potentially be in that, like we talked several episodes ago about if someone has been maintaining and put a fence up, that can be determined a new property line.
- 10:01SPEAKER_02: It can.
- 10:01SPEAKER_02: If they can prove if they've it can grandfather it in or something like that.
- 10:06SPEAKER_04: The built it, maintain it, and all that.
- 10:07SPEAKER_02: Yeah, or there's an easement that the the buyer didn't know about, which I tell you, that's why the title work is so important.
- 10:14SPEAKER_04: It is.
- 10:15SPEAKER_04: Because they will find those what Sam and them do up there is is phenomenal to make sure that all that, you know.
- 10:21SPEAKER_02: I just had a call with them and they said we ha it took so long because we had to go back to 1956, you know.
- 10:27SPEAKER_04: Just that?
- 10:28SPEAKER_04: Just to 1956.
- 10:30SPEAKER_04: Yeah.
- 10:30SPEAKER_04: I mean, they had to go back further on few houses.
- 10:32SPEAKER_02: So yeah.
- 10:32SPEAKER_02: On property we bought, they went back to the 1800s.
- 10:35SPEAKER_04: Yeah.
- 10:35SPEAKER_02: And that's just crazy to me.
- 10:37SPEAKER_02: But but it's worthy of of the time that it takes because then you don't have headaches down the road.
- 10:44SPEAKER_04: Exactly.
- 10:44SPEAKER_04: Yeah.
- 10:45SPEAKER_04: The other things in neighborhoods, I I bet that I mean, I've lived in neighborhoods and I've moved into neighborhoods, and I was like, Oh, it looks so peaceful because we're there during the middle of the day, but at night it's like party central.
- 10:56SPEAKER_02: Yeah.
- 10:56SPEAKER_02: And that's one that segment that we did on go outside and listen before you purchase.
- 11:01SPEAKER_04: Yeah.
- 11:02SPEAKER_02: Go outside at different times of the day.
- 11:04SPEAKER_02: Drive by at different times of the day.
- 11:07SPEAKER_02: Because if you don't, you could be in for a heck of a surprise.
- 11:11SPEAKER_04: So, and talking about the dark side on the on the sellers, right?
- 11:14SPEAKER_04: You know, a seller is truly being what they're called.
- 11:18SPEAKER_04: They're selling the agent on their home, their neighborhood.
- 11:22SPEAKER_04: Oh, it's beautiful.
- 11:23SPEAKER_04: I mean, they're literally being a car salesman.
- 11:25SPEAKER_04: Nothing against car salespeople don't send me hateful messages, but they're selling, oh, look at our beautiful neighborhood.
- 11:31SPEAKER_04: It's all beautiful, blah, blah, blah, blah, blah.
- 11:32SPEAKER_04: Just don't come around after midnight.
- 11:34SPEAKER_04: You know, right.
- 11:36SPEAKER_02: I had one house we, you know, the neighborhood was decent and and but when we got upstairs, we looked out the window, and the backyard of the neighbor's house had a fence around it.
- 11:47SPEAKER_02: They had three junk cars in there.
- 11:50SPEAKER_02: They had a pool that had turned black.
- 11:53SPEAKER_02: So you know that's a mosquito infestation.
- 11:55SPEAKER_02: Oh, yeah.
- 11:56SPEAKER_02: So, you know, once you look at that, is that where I want to be?
- 12:00SPEAKER_02: No, it's not.
- 12:01SPEAKER_04: Do you want to see that every morning waking up in your master bedroom?
- 12:03SPEAKER_04: No.
- 12:04SPEAKER_02: No, no.
- 12:05SPEAKER_04: And and that's good.
- 12:06SPEAKER_04: So again, when we're talking about that dark side, you've got to do your homework.
- 12:11SPEAKER_02: Yes.
- 12:12SPEAKER_04: And in this case, with first choice reality pros, you guys are the professionals that you're helping your potential buyers do the homework.
- 12:18unknown: Yes.
- 12:19SPEAKER_04: And or digging deeper with the seller that is on the list with you.
- 12:23SPEAKER_02: Absolutely.
- 12:23SPEAKER_04: And so if you feel confident about the product you're selling for them.
- 12:28SPEAKER_02: Absolutely.
- 12:29SPEAKER_02: I would never, yes, I would never want to sell somebody something that they call later and said, This is not what we expected at all.
- 12:37SPEAKER_04: Right.
- 12:38SPEAKER_04: Right.
- 12:38SPEAKER_04: And so all of this gets tied up into a document or part of a document, right?
- 12:43SPEAKER_02: The residential real property disclosure.
- 12:45SPEAKER_04: Correct.
- 12:45SPEAKER_02: And what is that the seller has to fill that out to tell what they do know about the property.
- 12:56SPEAKER_02: So if they've had something fixed recently, then they feel that that has been fixed.
- 13:02SPEAKER_02: Right.
- 13:02SPEAKER_02: So they don't have to disclose that.
- 13:05SPEAKER_03: Right.
- 13:05SPEAKER_02: But if they know something, hey, uh, does the basement get some seepage on the northeast wall?
- 13:11SPEAKER_04: Right.
- 13:12SPEAKER_02: I say if you knows, you disclose because it will save you a court date later on.
- 13:19SPEAKER_04: It definitely.
- 13:20SPEAKER_02: Yes.
- 13:20SPEAKER_02: So story.
- 13:21SPEAKER_02: Here we go.
- 13:22SPEAKER_04: I will I love the stories.
- 13:23SPEAKER_02: I sold a property.
- 13:24SPEAKER_02: There was nothing on the disclosures about the the furnace or anything being wrong.
- 13:30SPEAKER_02: The people move in on the hottest day of the summer and the air conditioner goes out.
- 13:34SPEAKER_03: No.
- 13:35SPEAKER_02: Now this is a geotherm.
- 13:36SPEAKER_03: Oh, that's even worse.
- 13:37SPEAKER_02: They had said, you know, they used a certain person to work on it.
- 13:41SPEAKER_02: So we called.
- 13:42SPEAKER_02: I they called me after the fact and I said, Hey, call them out there.
- 13:45SPEAKER_02: Let's see what's going on.
- 13:46SPEAKER_02: They go out, and the person that has always been working on it said to the new buyer, here's what you never want to hear.
- 13:53SPEAKER_02: And this is why you fill these disclosures out so that you know.
- 13:56SPEAKER_02: I have been coming here for five years and I've told them that there was a leak in the line.
- 14:00SPEAKER_04: Yep.
- 14:01SPEAKER_02: So the new buyer says, looks at me and says, What shall we do?
- 14:05SPEAKER_02: You need to get a lawyer because the disclosure they did not disclose, right?
- 14:10SPEAKER_02: But they knew.
- 14:12SPEAKER_02: And so they went to a lawyer and the lawyer said that they did have a case.
- 14:16SPEAKER_02: And so that's why it's so scary.
- 14:18SPEAKER_02: So this is why I always say, if you know's, disclose, because it will save you time later on.
- 14:24SPEAKER_02: Right.
- 14:24SPEAKER_02: Just disclose it or fix it.
- 14:27SPEAKER_04: Right.
- 14:27SPEAKER_02: And get past it.
- 14:29SPEAKER_02: So anyway, they did not go ahead and sue because they didn't want to be the new people coming in town.
- 14:34SPEAKER_02: Doing that.
- 14:35SPEAKER_02: They did not, but they knew that they had the right to, and these disclosures are for a purpose.
- 14:42SPEAKER_02: And they will get you in the court of law.
- 14:45SPEAKER_04: Well, and you know, my son out of court.
- 14:48SPEAKER_04: My son had that happen.
- 14:49SPEAKER_04: Because when they when they went to have the unit looked at, oh yeah, we've been having we've been working on this for a while.
- 14:56SPEAKER_04: It needs a new motor.
- 14:57SPEAKER_04: They knew that.
- 14:57SPEAKER_02: Yeah.
- 14:58SPEAKER_04: But because of the dollar amount, it's not worth going through.
- 15:01SPEAKER_02: Yeah.
- 15:02SPEAKER_04: Well, it's not worth going through the legal thing on that to get it repaired.
- 15:04SPEAKER_02: Yeah.
- 15:05SPEAKER_04: It's just like just get it repaired.
- 15:06SPEAKER_02: Now geotherms can$25,000 or something.
- 15:10SPEAKER_04: Yeah, if you got a main line leaking, yeah.
- 15:12SPEAKER_04: Serpentine or a well.
- 15:13SPEAKER_04: Yeah.
- 15:13SPEAKER_04: Yeah.
- 15:14SPEAKER_04: That's not fun.
- 15:15SPEAKER_02: You know, that's yeah, not fun at all.
- 15:17SPEAKER_02: But this is why we we say, please fill this out, disclose what you know, or get it fixed so that you don't have to worry about it.
- 15:25SPEAKER_04: Right.
- 15:25SPEAKER_04: No, and that's and that's good.
- 15:27SPEAKER_04: And I'm so glad you guys, I mean, there are, how do I put this?
- 15:32SPEAKER_04: This I don't want this to come off wrong.
- 15:33SPEAKER_04: There are there are goodie two shoes that we gotta do it this way.
- 15:37SPEAKER_04: It has to be this.
- 15:38SPEAKER_04: We don't do it.
- 15:39SPEAKER_04: We're not doing it.
- 15:40SPEAKER_04: And there's others like, hey, let me give you the lowdown.
- 15:43SPEAKER_04: Let me give you the lowdown of why why we at first choice really pros do this.
- 15:47SPEAKER_02: Yes.
- 15:48SPEAKER_04: And that's what I'm saying.
- 15:48SPEAKER_04: You guys do that.
- 15:50SPEAKER_02: Everybody in our packet gets the disclosure document that says why you fill this out and how to fill it out.
- 15:58SPEAKER_02: So that nobody can say, Oh, I didn't know what this was all about.
- 16:02SPEAKER_02: Exactly.
- 16:02SPEAKER_02: No, we're gonna walk through that with you so that you have now we cannot fill that out as an agent.
- 16:07SPEAKER_04: Correct.
- 16:08SPEAKER_02: We cannot, I don't even put my pin on it.
- 16:10SPEAKER_02: Okay.
- 16:11SPEAKER_02: It goes over to the seller, they fill that out.
- 16:14SPEAKER_02: It is on them.
- 16:16SPEAKER_02: They cannot come back to the agent and say, Well, the agent didn't tell me.
- 16:20SPEAKER_02: So it goes back to make sure that you know what you're disclosing.
- 16:24SPEAKER_04: Exactly.
- 16:25SPEAKER_04: And so are there where do things get uncomfortable?
- 16:29SPEAKER_02: If a seller comes to me and says, Hey, Lisa, I don't want certain type of people coming through my house.
- 16:35SPEAKER_03: Ooh.
- 16:36SPEAKER_02: If I've got I know that this is wrong, but I don't want you to say something about it, that's where I say, now look, anybody can come through this house.
- 16:43SPEAKER_02: If I list it, anybody, right?
- 16:45SPEAKER_02: I am not going to uh prejudice anywhere.
- 16:48SPEAKER_02: Right.
- 16:49SPEAKER_02: Nope.
- 16:49SPEAKER_02: They can all come through here.
- 16:51SPEAKER_02: If that is not what you want, then you better do a for sale by owner.
- 16:54SPEAKER_04: Or find another agent.
- 16:55SPEAKER_04: Well, yeah, but most agents would have to say that because they are correct, because by law they're bound by the the real estate code of ethics basically.
- 17:04SPEAKER_04: Yeah.
- 17:05SPEAKER_02: So we cannot discriminate, and I will not.
- 17:07SPEAKER_02: The other one is if I take the story I told you about the big crack in the wall.
- 17:12SPEAKER_02: Okay, I'm not going I'm going to read that disclosure once they fill it out.
- 17:16SPEAKER_02: And I can go back to the seller and say, I have a question about this.
- 17:21SPEAKER_02: When I went down the basement, this is what I saw.
- 17:24SPEAKER_03: Right.
- 17:24SPEAKER_02: So, and this says that there's not.
- 17:27SPEAKER_02: Would you like to change that and say, due to the age or whatever, would you like to change something about your story here?
- 17:36SPEAKER_02: And a lot of times they might go, you know what?
- 17:39SPEAKER_02: I forgot all about that.
- 17:40SPEAKER_04: You know, not as momentum as most times it's honest for honestly, yes, and not shady, the dark side.
- 17:47SPEAKER_04: Yeah.
- 17:48SPEAKER_02: Right, right.
- 17:49SPEAKER_02: Say uh a husband has passed away and the wife is filling that out.
- 17:52SPEAKER_02: And she didn't take care of any of that stuff.
- 17:54SPEAKER_02: No, and she's like, I really don't know.
- 17:57SPEAKER_02: Well, she's gonna fill that out.
- 18:00SPEAKER_02: She does not know.
- 18:00SPEAKER_02: Yeah.
- 18:01SPEAKER_02: If it's a person that um is just an executor to the estate, they're not gonna know either.
- 18:07SPEAKER_02: If they have not lived, and that first question says, Have you lived in this home for the last 12 months?
- 18:14SPEAKER_04: Right, right.
- 18:15SPEAKER_02: If the answer is no, then you have no idea what's going on.
- 18:18SPEAKER_04: So then it's gonna be on the buyer to do their inspections.
- 18:21SPEAKER_04: To do the inspections and and and rely on that, right?
- 18:24SPEAKER_04: Yes.
- 18:24SPEAKER_04: So so basically, you guys have a great BS meter, right?
- 18:28SPEAKER_02: We try to.
- 18:29SPEAKER_02: Yeah.
- 18:30SPEAKER_04: A BP meter.
- 18:31SPEAKER_04: Bull poop.
- 18:31SPEAKER_04: Bull poop meter.
- 18:32SPEAKER_04: You know what I mean?
- 18:33SPEAKER_04: Yes.
- 18:33SPEAKER_04: To to kind of, and you've been doing this long enough to know.
- 18:36SPEAKER_04: Almost 20 years.
- 18:37SPEAKER_04: That you know, like I'm walking into the dark side here.
- 18:40SPEAKER_02: Yes.
- 18:41SPEAKER_02: Well, and and I am one that that will come to somebody and say, can we have a discussion?
- 18:46SPEAKER_02: Because I'm not just gonna say, Hey, you did you filled this out wrong, or hey, I think you're lying.
- 18:51SPEAKER_02: You know, can I ask you a question?
- 18:54SPEAKER_03: Sure.
- 18:54SPEAKER_02: I'm gonna open the door, we're gonna talk about this and discuss why or why not.
- 18:59SPEAKER_04: Right.
- 18:59SPEAKER_04: Right.
- 19:00SPEAKER_04: And so uh a a question that I see out there all the time is an as is a home being sold as is.
- 19:07SPEAKER_04: Yeah.
- 19:07SPEAKER_04: Does that mean I can hide it?
- 19:08SPEAKER_04: Nope.
- 19:09SPEAKER_04: Is that what that means?
- 19:10SPEAKER_04: No.
- 19:10SPEAKER_04: It says Do you still have to do a disclosure if you're selling as is?
- 19:13SPEAKER_02: Yes.
- 19:14SPEAKER_02: Disclose what you know about the house, but I'm not doing any more work.
- 19:18SPEAKER_02: I'm telling you up front there is seepage in that basement.
- 19:22SPEAKER_02: I'm not doing any foundation work.
- 19:24SPEAKER_02: I'm telling you up front that there are whatever.
- 19:28SPEAKER_02: Yeah, there's issues with the home, but I am not doing any more work.
- 19:32SPEAKER_02: I'm not adding any more warranties to this.
- 19:35SPEAKER_04: Right, right.
- 19:36SPEAKER_04: This is not paying for anything, just here it is.
- 19:39SPEAKER_02: But as is doesn't always mean as is, because as the seller is putting this out there, they've disclosed what they do know.
- 19:47SPEAKER_02: The buyer still has the opportunity to do their inspections.
- 19:51SPEAKER_03: Right.
- 19:52SPEAKER_02: They come back and they find that there is a sewer issue.
- 19:55SPEAKER_02: The seller didn't know it.
- 19:57SPEAKER_02: The buyer didn't know it.
- 19:58SPEAKER_02: Right.
- 19:59SPEAKER_02: Now we come back and we say, Mr.
- 20:00SPEAKER_02: Seller, I understand that you have said that you're selling this as is.
- 20:05SPEAKER_02: Did you know?
- 20:06SPEAKER_04: Right.
- 20:07SPEAKER_02: Because I'm not gonna buy it right now, or I'm gonna ask for more money off.
- 20:11SPEAKER_02: Right.
- 20:11SPEAKER_02: So what can we do here?
- 20:13SPEAKER_02: Now we're open to more negotiations.
- 20:15SPEAKER_02: That makes sense.
- 20:16SPEAKER_02: Which is okay.
- 20:17SPEAKER_04: Yeah, which we talked about in early on episodes.
- 20:19SPEAKER_04: That's really fine.
- 20:20SPEAKER_02: Yeah.
- 20:20SPEAKER_04: So sidebar from First Choice Realty Pros, if a home is being sold by the owner.
- 20:25SPEAKER_02: A for sale by owner.
- 20:27SPEAKER_04: For sale by owner.
- 20:28SPEAKER_04: Do they have to fill out the disclosure?
- 20:29SPEAKER_02: If I show it, if they allow me to show it, so I call them and say, I know it's for sale by owner.
- 20:36SPEAKER_02: I'm asking you if you will work with me.
- 20:38SPEAKER_02: I'm gonna bring a buyer in.
- 20:40SPEAKER_04: Right.
- 20:40SPEAKER_02: Okay.
- 20:41SPEAKER_02: Now I'm going to ask you to fill out these disclosures for my partner.
- 20:46SPEAKER_04: Do they have to?
- 20:47SPEAKER_02: They could say no, but I'm not going to show it because yeah.
- 20:50SPEAKER_02: Yeah.
- 20:51SPEAKER_04: So see, my sidebar from First Choice brought First Choice back in.
- 20:53SPEAKER_04: Yes.
- 20:54SPEAKER_02: Thank you for this.
- 20:55SPEAKER_02: I'm not going to show it because I need my buyer to be educated.
- 20:58SPEAKER_04: That's great.
- 20:58SPEAKER_04: And but and about being educated, as we're getting wrapping up on the segment, what the buyers, what things should they be looking for to make sure they're not being pulled to the dark side.
- 21:09SPEAKER_02: Pay attention to all the little things.
- 21:11SPEAKER_02: Okay.
- 21:11SPEAKER_02: Like I said in the beginning, if you feel something in your gut, say, hmm, wonder why that's there.
- 21:16SPEAKER_02: A section of drywall that's newer.
- 21:18SPEAKER_02: The the ceiling is got the um stomped ceiling in this area, but in the same room, it's not over here.
- 21:26SPEAKER_02: There might have been a link.
- 21:27SPEAKER_04: Or the pattern doesn't match as well, right?
- 21:29SPEAKER_04: Yeah.
- 21:29SPEAKER_02: If there's a bucket under a pipe, you know, under the sink.
- 21:33SPEAKER_02: Why is that there?
- 21:34SPEAKER_02: If trying to think of some other things.
- 21:36SPEAKER_02: Oh, boxes stacked along one of the walls in the basement.
- 21:39SPEAKER_02: But not another.
- 21:40SPEAKER_02: But not another.
- 21:41SPEAKER_02: It could be that that's just where they chose to stack them, but it could be that it's hiding something.
- 21:46SPEAKER_02: So in that case, I would ask the seller for the buyer's inspection.
- 21:51SPEAKER_04: Right.
- 21:51SPEAKER_02: Please move those out so that the inspector can inspect.
- 21:55SPEAKER_04: Right.
- 21:55SPEAKER_04: Can an inspector move those things?
- 21:57SPEAKER_02: No.
- 21:58SPEAKER_02: They can't move anything.
- 21:59SPEAKER_04: Can't move anything.
- 22:00SPEAKER_04: So a seller light gas, they can't so a seller can put things strategically placed.
- 22:06SPEAKER_02: They could.
- 22:07SPEAKER_02: They shouldn't, but they could.
- 22:08SPEAKER_04: Correct.
- 22:09SPEAKER_04: Like if the seller has a rug on the floor, the the inspector doesn't move rugs.
- 22:14SPEAKER_04: He walks over them.
- 22:15SPEAKER_04: He just Okay.
- 22:16SPEAKER_02: And if your real estate agent is rushing you through the house and just saying, Oh, this is great.
- 22:22SPEAKER_02: This is great.
- 22:23SPEAKER_04: Yeah.
- 22:27SPEAKER_04: Right.
- 22:27SPEAKER_04: Which I know that firsthand.
- 22:29SPEAKER_04: Like one of the homes that we looked at.
- 22:30SPEAKER_04: We we were there quite a while looking through, opening doors, looking at stuff.
- 22:34SPEAKER_04: Yeah.
- 22:35SPEAKER_02: And I'm pointing things out.
- 22:36SPEAKER_02: Yeah.
- 22:37SPEAKER_04: Not professional inspectors, we're buyer inspectors.
- 22:39SPEAKER_02: Yeah.
- 22:40SPEAKER_02: Yeah.
- 22:40SPEAKER_04: Okay.
- 22:40SPEAKER_04: Yep.
- 22:41SPEAKER_04: Well, no, that's the and that's good.
- 22:43SPEAKER_04: I'm glad you bring it up because the buyers need to pay attention to those things.
- 22:46SPEAKER_02: Oh, absolutely.
- 22:47SPEAKER_04: Which again, the professionals at First Trust really pros make sure they're like, We will hold their hands.
- 22:52SPEAKER_04: Yes, this and this.
- 22:53SPEAKER_04: Let's take a look at the I did spot that.
- 22:55SPEAKER_04: Did you?
- 22:55SPEAKER_04: What's your thoughts on that?
- 22:57SPEAKER_04: Yes.
- 22:57SPEAKER_04: Yes.
- 22:57SPEAKER_04: Well, you know, the other side of this is we also need to have those fair sellers, right?
- 23:03SPEAKER_03: Yeah.
- 23:03SPEAKER_04: Not every defect is something the seller knew about.
- 23:06SPEAKER_04: Right.
- 23:06SPEAKER_04: Which we've talked about today.
- 23:08SPEAKER_04: A home can have a problem that nobody discovers until the inspection.
- 23:11SPEAKER_04: Yep.
- 23:12SPEAKER_04: Which again, as long as the communication stays open, there's still a chance to negotiate and make this sell happen.
- 23:18SPEAKER_04: This buy, this seller.
- 23:19SPEAKER_02: We're all trying to get to the closing table.
- 23:21SPEAKER_04: And just because an inspector finds something doesn't mean the seller was dishonest.
- 23:25SPEAKER_04: So, and I'm sure buyers have that.
- 23:27SPEAKER_04: Like, well, why didn't they disclose that?
- 23:29SPEAKER_04: You know, and again, they legit may not have known that.
- 23:32SPEAKER_04: They may not have known it.
- 23:32SPEAKER_04: And that's why we don't immediately point fingers.
- 23:34SPEAKER_04: We gather the information first.
- 23:36SPEAKER_02: Yep.
- 23:36SPEAKER_04: What did the seller know?
- 23:37SPEAKER_04: What does the disclosure say?
- 23:39SPEAKER_04: Yep.
- 23:39SPEAKER_04: What did the inspection uncover?
- 23:41SPEAKER_04: Do we need another professional to evaluate it?
- 23:44SPEAKER_04: Right.
- 23:44SPEAKER_04: Yes.
- 23:45SPEAKER_04: Then you guys can help your client decide what to do next.
- 23:48SPEAKER_02: Yeah.
- 23:48SPEAKER_02: Right.
- 23:48SPEAKER_02: Yeah.
- 23:49SPEAKER_04: So any final thoughts on it?
- 23:51SPEAKER_02: Well, we don't just want to say don't ever trust a seller.
- 23:54SPEAKER_02: Right.
- 23:54SPEAKER_02: Because that's not what it is.
- 23:56SPEAKER_02: It's called do your due diligence.
- 23:58SPEAKER_02: Make sure you pick the right agents to uh help you walk through this process.
- 24:04SPEAKER_02: You don't have to do it alone.
- 24:05SPEAKER_02: It's nothing scary.
- 24:06SPEAKER_02: Correct.
- 24:07SPEAKER_02: If you like it, you like it.
- 24:08SPEAKER_02: And if you don't, we keep moving and we find something else.
- 24:11SPEAKER_02: But it's, you know, trying to keep you out of the dark side once you've already invested in it.
- 24:16SPEAKER_04: Correct.
- 24:17SPEAKER_04: That's that's what we read the disclosures, get the inspections, pay attention when something doesn't make sense, right?
- 24:23SPEAKER_02: Yes.
- 24:24SPEAKER_04: Why is that rug there?
- 24:25SPEAKER_04: That was a great analogy you brought up on that, right?
- 24:27SPEAKER_04: And work with the professionals who aren't afraid to ask the uncomfortable questions.
- 24:31SPEAKER_04: Because again, as professionals, I'm I've been asked to go in and look at houses before as a professional.
- 24:35SPEAKER_04: And I'll ask the questions, well, why is this this way?
- 24:38SPEAKER_04: Because it's not natural to where it's at.
- 24:40SPEAKER_02: Right.
- 24:41SPEAKER_04: Or what what it looks like based on if the home was just built, right?
- 24:44SPEAKER_02: Right.
- 24:45SPEAKER_04: Because sometimes the most important thing your real estate agent at first real first choice reality pros does isn't finding you the house, it's noticing the things you didn't see.
- 24:55SPEAKER_04: So let that sink in.
- 24:56SPEAKER_04: They're there to help you.
- 24:57SPEAKER_04: Right.
- 24:58SPEAKER_04: Right.
- 24:58SPEAKER_04: As a seller and a buyer.
- 25:00SPEAKER_02: As another set of eyes.
- 25:01SPEAKER_04: And it's that's it's another look at it, right?
- 25:03SPEAKER_02: On the seller side, we're trying to make that very smooth so that we don't have those hiccups.
- 25:09SPEAKER_04: Correct.
- 25:10SPEAKER_02: So when that buyer comes, it's smooth sailing, we get to the closing because that's what the seller's looking for.
- 25:15SPEAKER_04: Exactly.
- 25:16SPEAKER_02: On the buyer side, we're making sure that everything is done to their whatever specifications, I guess I should say their specifications that they're looking for so that they feel like they have made a good choice.
- 25:30SPEAKER_04: Exactly.
- 25:31SPEAKER_04: Exactly.
- 25:32SPEAKER_04: And you know what?
- 25:33SPEAKER_04: If people want to get a hold of our professionals at first choicerealtypros.com.com, right?
