- 0:17Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:21The topic is answers in family law matters and this
- 0:25episode today is based on an article on our blog,
- 0:28Familylawheadquarters dot com and the title of the article is
- 0:32What's an answer to Initial Pleadings? So it's a follow
- 0:36up to the episode today. Go on over to familawheadquarters
- 0:39dot com and read this article for more information on
- 0:42this topic. But let's go ahead and jump on in.
- 0:45When a divorce or family law case begins, the reality
- 0:48is one party has to start the cause of action
- 0:51or start the litigation, and they do that by filing
- 0:54a petition. Of course, with the petition, there can be
- 0:57other documents that have to be filed as well, So
- 1:00typically it's a petition, and some jurisdictions it could be
- 1:04a motion, so it could be a petition for dissolution
- 1:08of marriage, could be a paternity petition, could be an
- 1:12adoption petition, It could be a motion to modify, could
- 1:15be a motion for contempt, and of course there's various
- 1:19other types of family law matters as well, But regardless,
- 1:23one party has to begin the case by filing either
- 1:27a petition or filing a motion of some kind. And
- 1:31obviously how this takes place is going to vary based
- 1:35on the jurisdiction a little bit. So definitely talk to
- 1:37a lawyer who's license and practice incompetent to practice law
- 1:42on your jurisdiction and they can give you more detail
- 1:45on this. But generally, after this original petition emotion is filed,
- 1:50the clerk will then attach a summons to the petition
- 1:53or the motion. They'll give it to the lawyer who
- 1:57filed the case, and then service has to be obtained,
- 2:00all right. Service can be obtained through a sheriff or
- 2:04a private process server sometimes known as a special process server,
- 2:09and then this has to be served on the other party.
- 2:12And for service to be obtained, we're typically talking about
- 2:16personal service, where the petition or the motion is handed
- 2:20to the other party, and obviously there can be some
- 2:22nuances there. Sometimes it can be handed to an adult
- 2:26member of the household who isn't the party. Again, this
- 2:29is going to vary based on the jurisdiction you're in.
- 2:32But once service is obtained, typically the clock begins ticking. Okay.
- 2:38And in other words, there is a timeline for the
- 2:41party who's been served to file an answer to the
- 2:45petition or the motion. And the timeline can vary based
- 2:49on the jurisdiction. Okay, it can be a little bit different.
- 2:52In Missouri, where I have predominantly practiced throughout my career,
- 2:56it's generally thirty days. So party has thirty days to
- 3:00respond to what has been served upon them, and this
- 3:04is called an answer. Right. So a party files an
- 3:07answer to the petition or the motion that they've been
- 3:11served with, Okay, and it's supposed to take place within
- 3:15the time frame. Now, there could be the ability for
- 3:18a party to request leave for additional time from the judge,
- 3:23but for that to occur, it's typically pessed to request
- 3:26that before the timeline expires. Okay. And so what a
- 3:29party has been served a petition or emotion. The reality
- 3:33is they need to act quickly to hire an attorney
- 3:37and to make sure an answer is filed to what
- 3:41was served upon them. Okay. And now look the nuances
- 3:44of an answer. You know this is what attorneys go
- 3:47to law school to learn. And this is the kind
- 3:49of thing you know, attorneys learn about and legal research
- 3:53and writing and maybe in trial practice and litigation courses
- 3:57or whatnot. But what a party has to do in
- 3:59an answer is respond to each paragraph of the petition
- 4:02of motion. All right, so they either admit the allegation,
- 4:06they either deny it, or they say they have insufficient
- 4:09information to admit or deny the specific allegation. Okay, So
- 4:13party's got to go through each paragraph and either admit, deny,
- 4:16or say they have insufficient information to admit or deny
- 4:20the allegation of that paragraph. And sometimes you can get
- 4:23into some real nuance here where maybe part of a
- 4:27paragraph a party can admit and then part of it
- 4:30they deny, or part of a paragraph they admit and
- 4:33part of it they just don't know they don't have
- 4:35enough information to admit or deny the specific paragraph. And
- 4:39then in addition to going through each paragraph, a party
- 4:42can raise affirmative defenses and their answer And again this
- 4:45is very much in the weeds, and this is very
- 4:48much law school type stuff. This is why lawyers go
- 4:52to law school for several years. But they can allege
- 4:55things like latches, unclean hands, a stopp a waiver, and
- 4:59other quitable defenses. And again generally these need to be
- 5:03put in any answer and it needs to be filed
- 5:06by the deadline. All right, So let's say a party
- 5:08doesn't file an answer. What may happen. Well, Look, if
- 5:12a party doesn't file an answer and they don't do
- 5:14it within the deadline and theory, they could be held
- 5:16in default. And if they're held in default, I mean
- 5:19in essence, it's like forfeit in a sports game. It's
- 5:21like you lose. So the other party can then file
- 5:24a motion for default and try to get all the
- 5:27relief that they requested, so they know if they want
- 5:30a divorce or if they want paternity established, and they
- 5:33want specific things in the divorce that the paternity case,
- 5:36like custody orders or child support orders, or division of
- 5:39property and debt and these things, and they typically get
- 5:42what they want. And so look, the reality is for
- 5:45individuals who've been served papers in a divorce of family
- 5:48law matter, it is vital to get an attorney to
- 5:51file an appropriate answer. Of course, in addition to an answer,
- 5:55a party can file their own cross petition or counter
- 5:58motion and request specific things themselves. But at the end
- 6:01of the day, it's not a good thing to be
- 6:03served papers and not file an answer, Okay. And so
- 6:07the other thing I want to talk about is where
- 6:09can a responding party go wrong when they've been served
- 6:13paperwork and again, not file an answer within the timelines
- 6:18is one way in which they can go wrong, right.
- 6:20I mean, if a party doesn't respond at all, they
- 6:23can be held in default. If they respond but they
- 6:26don't do it in the proper format, then the answer
- 6:29is really not appropriate. Right, It's not an appropriate answer
- 6:33to the petition, so they could still be held in default. Again,
- 6:38a party's got to respond and file that answer within
- 6:41the time deadlines and the jurisdiction or they could be
- 6:44held in default again. Judges can sometimes get parties extra
- 6:48time to file an appropriate answer, but it's best to
- 6:51do that before the deadline expires, versus waiting until after
- 6:55and then hoping to get leave after the fact. So
- 6:58look for individuals who've been served petitions or motions and
- 7:02the divorce or family court, hire an attorney, get an attorney,
- 7:05do it within the time deadlines, and make sure you
- 7:08get that answer filed. Where a lot of parties go
- 7:10wrong too, is just taking their time, letting the clock tick.
- 7:15You know, they spend a lot of time trying to
- 7:16figure out what to do, and then that deadline passes,
- 7:19and based on their inaction, then they can ultimately be
- 7:22held in contempt. So look for parties who've been served
- 7:25divorce or family law petitions or motion. It is really
- 7:29vital to hire an attorney. To hire an attorney right
- 7:31away and make sure the appropriate response is filed and
- 7:35know the answer is just one piece to it. Sometimes
- 7:38parties have to file other things too, like proposed parenting
- 7:41plans or proposed child support schedules, or financial statements or
- 7:46other things based on the jurisdiction. So it's really important
- 7:50to get in there and get an attorney. Now. I
- 7:52know for some parties, maybe they didn't want the case,
- 7:55they didn't want it to be filed, maybe they didn't
- 7:57see it coming. They've been taken a little bit by surprise.
- 8:00I hear that, and I understand it. But ultimately it
- 8:04is really vital for a party to move quick and
- 8:08not let that deadline pass. If that deadline passes again,
- 8:12they can be in big trouble. And again, simply filing
- 8:16some kind of answer that doesn't comply with the deadlines,
- 8:19or it doesn't comply with the deadlines, doesn't comply with
- 8:22the requirements. Oftentimes that has no real legal effect if
- 8:25somebody tries to file something of their own volition without
- 8:28hiring an attorney. So you know, this is where having
- 8:31legal counsel who knows what they're doing, who's competent, license
- 8:35to practice in your jurisdiction, and who focuses on family
- 8:39law can be really really important. All right, So this
- 8:43is the topic again, answers in family law matters. It's
- 8:46definitely important. It's definitely something that a party wants to
- 8:50do and not miss the deadlines, and they want to
- 8:52make sure that they've done it right. Okay, very very important.
- 8:56If not, a party can be held in default and
- 8:58ultimately they can end up on the loose using side
- 9:00of the case. It's just by not filing the right
- 9:03paperwork within the time requirements that are set forth in
- 9:07your jurisdiction. All right. So again, as a follow up
