- 0:00Speaker 1: I'm going to sponsor it by this text we just
- 0:02Speaker 1: got Okay. I met Wade Taylor once when I was
- 0:06Speaker 1: dropping something off to my attorney. Wade was absolutely the
- 0:09Speaker 1: most lovely person and even took a few minutes out
- 0:12Speaker 1: of his busy day to chat with me. I really
- 0:14Speaker 1: appreciated that chat as I was going through a difficult
- 0:17Speaker 1: time and Wade made me feel seen and cared for.
- 0:20Speaker 2: And look, he's here right now. So apparently this person
- 0:24Speaker 2: was well, it's cheaper to keeper.
- 0:26Speaker 3: Yeah, So apparently Wade was just sitting there and this
- 0:33Speaker 3: person didn't decide.
- 0:34Speaker 2: I think I'd rather have Wade for to be my attorney.
- 0:37Speaker 3: I've got great partners too, so I can't do them all.
- 0:40Speaker 2: Wade Taylor.
- 0:42Speaker 3: We've known Wade for a long long time and has
- 0:45Speaker 3: always handled divorces and family family law, state law, state planning,
- 0:51Speaker 3: wills and all of that sort of thing. But recently
- 0:55Speaker 3: you've decided to sort of branch out or to you
- 1:00Speaker 3: configure things.
- 1:01Speaker 2: Or yeah, I do both. I still do the litigation side.
- 1:04Speaker 4: But after all these years of fighting with people, I
- 1:06Speaker 4: realized that attorneys are part of the problem, and so
- 1:11Speaker 4: we came up with a company called Salt.
- 1:12Speaker 2: Mediation where we do mediation.
- 1:16Speaker 4: And divorce cases, CASSI cases, but typically it's not represented
- 1:19Speaker 4: by attorneys.
- 1:20Speaker 3: Now, is divorce as popular as a result, as popular
- 1:24Speaker 3: as it's ever been.
- 1:25Speaker 2: It is still popular and it's not going away. Okay,
- 1:28Speaker 2: so it's uh.
- 1:31Speaker 3: Now, when I got a divorce, I did it. We
- 1:34Speaker 3: did it through a mediator. And that was a long
- 1:36Speaker 3: time ago. Yeah, that was, and it was it was
- 1:39Speaker 3: so long ago that I just vaguely remember it. I
- 1:42Speaker 3: remember just sitting in an office with somebody and yeah
- 1:45Speaker 3: and and they and with my soon to be ex wife,
- 1:48Speaker 3: said okay, do you agree to this and you'll pay
- 1:49Speaker 3: for this, and you'll pay for that and you and
- 1:51Speaker 3: she gets this and you get that. And I went, yeah, yes,
- 1:54Speaker 3: all sounds great to me. That's fine. And we signed
- 1:56Speaker 3: the papers and that was in and it was cheaper,
- 2:00Speaker 3: and it was cheap, and it was hassle free for
- 2:03Speaker 3: the most part, I mean, still emotional.
- 2:05Speaker 1: Absolutely, tell us, tell us why it's beneficial and why
- 2:09Speaker 1: it's preferable.
- 2:10Speaker 4: I think the biggest reason is you get to decide
- 2:13Speaker 4: it without having attorneys have a vested interest at times
- 2:19Speaker 4: in the litigation side of it. Obviously they're getting paid
- 2:22Speaker 4: for it. And yes, they zealously represent and I will
- 2:26Speaker 4: zealously represent someone if I'm doing that. But there's there
- 2:30Speaker 4: can be a vested interest in fighting an issue, whereas
- 2:33Speaker 4: with parties they get a talk one on one, they
- 2:36Speaker 4: know their situation better. No matter what an attorney knows
- 2:40Speaker 4: about you, they're not going to know it as well
- 2:42Speaker 4: as you do.
- 2:43Speaker 3: Now does mediation become more and more of a thing.
- 2:49Speaker 3: So in Utah, mediation is actually mandatory if you're going
- 2:52Speaker 3: to go to trial. So everybody require is required at
- 2:56Speaker 3: least one time to go through mediation.
- 2:58Speaker 4: In family law, you know, if you resolve it without mediation,
- 3:01Speaker 4: that's fine, but if you're planning on going to trial,
- 3:03Speaker 4: the court requires you to mediate at first.
- 3:06Speaker 2: In the hopes that you won't go to trial.
- 3:08Speaker 4: Yes, the idea behind it and it is been born
- 3:13Speaker 4: out by the investor or.
- 3:15Speaker 2: You know, everything is statistics.
- 3:16Speaker 4: Yeah, the statistics is that most cases will resolve through
- 3:20Speaker 4: mediation and not require.
- 3:22Speaker 5: And stuff points out you don't even have to be
- 3:25Speaker 5: in the same room with your strange spouse during a
- 3:28Speaker 5: mediation session and that.
- 3:29Speaker 2: Yeah, a lot of what we do now is zoom mediation.
- 3:32Speaker 4: And whether there will do we've done them for people
- 3:35Speaker 4: in another country where one person's here and the other
- 3:38Speaker 4: person's in another country, will still do it and that
- 3:41Speaker 4: allows for them to get it done without the worry
- 3:44Speaker 4: of being in court.
- 3:45Speaker 5: Right, here's a text question. How do I change the
- 3:48Speaker 5: amount of my child support if I lose my job.
- 3:52Speaker 4: There's two options on child support. One is you can
- 3:55Speaker 4: go through ours. That's the Office of Recovery Services, that's
- 3:58Speaker 4: the state agency. You have to be able to show
- 4:02Speaker 4: though that it is a permanent loss of employment, not
- 4:06Speaker 4: just a temporary three to six months, because the court
- 4:08Speaker 4: is going to say six months is temporary.
- 4:11Speaker 2: Go out find a job.
- 4:13Speaker 4: But if it is a permanent change in your income
- 4:15Speaker 4: when you get a new job, then go in either
- 4:18Speaker 4: through the Office of Recovery Services or you can file
- 4:21Speaker 4: yourself and or have an attorney file to do.
- 4:24Speaker 6: That, because they'll say, those kids, whether you have a
- 4:27Speaker 6: job or not, they need food and shelter and medicine,
- 4:31Speaker 6: and their needs don't go on hold just because you
- 4:34Speaker 6: lost your job.
- 4:35Speaker 2: Yeah, the child support is the right of the child.
- 4:37Speaker 4: So it's really hard to go in and say I
- 4:39Speaker 4: don't have a job, because you're exactly right, they still
- 4:42Speaker 4: got to eat.
- 4:43Speaker 2: Yeah, so they're going to say, go find a job
- 4:44Speaker 2: and figured it out. Got a call online one.
- 4:48Speaker 5: They will have to do it quick because we're coming
- 4:50Speaker 5: up on the break.
- 4:51Speaker 2: Christy is here. Christy, what's your question?
- 4:54Speaker 7: Hi, thanks for going to call. Hey. I am in
- 4:57Speaker 7: the middle of a divorce and the petition has been
- 5:00Speaker 7: filed but no response has been received and I am,
- 5:05Speaker 7: to put it mildly, not happy with my representation. Can
- 5:09Speaker 7: you change who your attorney is sort of mid petition?
- 5:14Speaker 2: Absolutely? Absolutely.
- 5:15Speaker 4: It's kind of like dating if you don't like your
- 5:18Speaker 4: part I guess kind of like marriage too.
- 5:20Speaker 2: If you don't like your partner, you can change your partner.
- 5:22Speaker 3: So you don't like your representation as an attorney, except
- 5:25Speaker 3: you can't say to your partner you're fire.
- 5:26Speaker 2: Yeah, exactly. There's consequences there.
- 5:29Speaker 4: But if you want a new representation, absolutely call whoever
- 5:32Speaker 4: you want. You got to make sure you're comfortable with
- 5:35Speaker 4: what they're doing.
- 5:36Speaker 2: Okay, sure, okay, all right, so much Wade Taylor divorce.
- 5:41Speaker 5: Now let's see AsSalt Mediation was wonderful to work with,
- 5:49Speaker 5: save me a lot of money.
- 5:50Speaker 3: Murray was a great I got the impression from that question.
- 5:53Speaker 3: For some reason that. If so, this person is saying,
- 5:58Speaker 3: I get a certain amount of child tot now, but
- 6:01Speaker 3: I'm starting.
- 6:01Speaker 2: To make more and more money.
- 6:04Speaker 4: But I'm saying yes, and both parties incomes impact child support.
- 6:09Speaker 4: They look at both parties incomes and the amount of
- 6:11Speaker 4: overnights and that's how we calculate child sport. So if
- 6:14Speaker 4: the recipient starts to make a bunch of money, it
- 6:17Speaker 4: could impact the child's port. But children are entitled to
- 6:21Speaker 4: their portion of the support from each parent.
- 6:24Speaker 2: Right.
- 6:25Speaker 5: Uh, Let's see, my ex wife has not paid child
- 6:27Speaker 5: support in two years, refuses to pay half of the
- 6:31Speaker 5: children's costs. I have a judgment against her for debts
- 6:34Speaker 5: and assets. What options do I have?
- 6:37Speaker 4: Your best option is to go in on a motion
- 6:40Speaker 4: to enforce for contempt. Once you go in, and I
- 6:43Speaker 4: would suggest you hire an attorney if you're going to
- 6:45Speaker 4: have to do this, go in, get a judgment on
- 6:48Speaker 4: the child support, get a judgment on these other things,
- 6:50Speaker 4: and then have the attorney collect on it. It just
- 6:54Speaker 4: then becomes a collection issue. They can go garnish wages,
- 6:57Speaker 4: they can go into bank accounts. But that's going to
- 7:00Speaker 4: be your best option. I have a couple of questions
- 7:02Speaker 4: about that.
- 7:03Speaker 3: First of all, if this person is, you know, seeking
- 7:06Speaker 3: this child supportment, I'm guessing they don't have a lot
- 7:09Speaker 3: of money to hire an attorney. Do attorneys ever work
- 7:12Speaker 3: on contingents in that kind of thing? In fact, a
- 7:14Speaker 3: personal injury attorney. Yeah, in family law you cannot work
- 7:17Speaker 3: on contingency. No, it's actually under the bees that makes sense.
- 7:21Speaker 3: They don't want you to say, hey, if you get
- 7:23Speaker 3: this much of the house, then I get this.
- 7:25Speaker 2: No, they can't do that. But there are different options.
- 7:28Speaker 4: They can go down and talk to different attorneys that
- 7:31Speaker 4: will help them fill out that motion.
- 7:33Speaker 3: And handle it as a pro say litigant. So there
- 7:36Speaker 3: are options and then do the other thing? Is I
- 7:38Speaker 3: wonder so my mother never really got any child support
- 7:42Speaker 3: when she divorced my dad all those years ago, never
- 7:45Speaker 3: really got any child support and with some ridiculously small
- 7:48Speaker 3: amount like one hundred bucks a month or something, never
- 7:51Speaker 3: got And I would just want does anybody ever go
- 7:54Speaker 3: to jail for not paying trials? You can the state
- 7:57Speaker 3: if oors is involved in collection. It depends that there's
- 8:01Speaker 3: there's set amounts that once you fall behind this much
- 8:04Speaker 3: and they will pursue you. The biggest thing that the
- 8:07Speaker 3: legislature passed that we found is most effective is taking
- 8:10Speaker 3: their driver's license or taking taking their hunting license.
- 8:14Speaker 2: Oh that is done.
- 8:17Speaker 7: Now.
- 8:17Speaker 2: People will pay more than even the threat of jail.
- 8:21Speaker 2: That's amazing. I just am shocked that people.
- 8:24Speaker 1: It's one thing if you don't want to be married
- 8:25Speaker 1: to this person anymore.
- 8:27Speaker 6: The child's sport thing, this should not be an issue.
- 8:30Speaker 2: Why don't you want to take the beause because I
- 8:33Speaker 2: didn't like them either.
- 8:35Speaker 1: Arguing about I really don't understand. And this is a
- 8:38Speaker 1: lot of what you deal with.
- 8:39Speaker 3: It's the idea that you're giving it to your ex
- 8:43Speaker 3: and they think that, oh, well, you're not using the
- 8:45Speaker 3: money for the kids.
- 8:46Speaker 2: You have plenty of money, and that's what we see.
- 8:49Speaker 5: I'm not gonna take my new girlfriend to Las Vegas
- 8:53Speaker 5: if I'm paying you child support.
- 8:55Speaker 3: Besides, I didn't like them, damn kids anyway, Salt Mediation
- 9:00Speaker 3: and so what happened. I'm just curious what happens when
- 9:03Speaker 3: you call for a free consultation. You can go to
- 9:06Speaker 3: asaltmediation dot com.
- 9:08Speaker 4: Yeah, if you go there, they'll set up the media
- 9:11Speaker 4: or the consultant. We like to meet with both parties
- 9:14Speaker 4: so that we can explain how we go through mediation.
- 9:17Speaker 4: We will then set up a mediation date with you.
- 9:21Speaker 4: Typically we'll resolve it in one or two visits, and
- 9:25Speaker 4: then we'll actually do all the final paperwork for you.
- 9:27Speaker 4: So that's the biggest thing is we're not just providing
- 9:29Speaker 4: the mediation. A lot of mediators that's what they do,
- 9:32Speaker 4: but we go from start to finish. We will get
- 9:34Speaker 4: all the documents, we'll fill them out for you, file
- 9:36Speaker 4: them with the court. So it's kind of like a
- 9:38Speaker 4: one stop shop and can be done fairly quickly.
- 9:41Speaker 5: Here's a tricky one. I want my kid's dad to
- 9:44Speaker 5: get the new Utah alcohol restriction driver's license in order
- 9:48Speaker 5: to have our daughter.
- 9:50Speaker 2: Can this be done?
- 9:52Speaker 4: I don't know if the Driver's License Division will do
- 9:56Speaker 4: that without an actual criminal charge.
- 10:01Speaker 2: Yeah, I don't know if they'll they'll do that at all.
- 10:03Speaker 4: I understand the request, but I don't know that the
- 10:05Speaker 4: Driver's Licensed Division will cooperate with you as they're not
- 10:08Speaker 4: a party to the case.
- 10:10Speaker 5: How do you open up a case again to change
- 10:13Speaker 5: child visitation.
- 10:14Speaker 4: Schedule called the petition to modify, you have to show
- 10:18Speaker 4: that there's been a change in circumstances. But it's very
- 10:22Speaker 4: similar to your initial divorce, except that it's just focused
- 10:24Speaker 4: on that one issue. You go in and file it,
- 10:27Speaker 4: have him served, and go through the same process.
- 10:29Speaker 5: All right, let's see there are currently no temporary orders,
- 10:35Speaker 5: but we have been following lapsed temporary orders and my
- 10:38Speaker 5: ex hasn't lived in the home since June. Can he
- 10:42Speaker 5: now change the lot? Can he now change the locks
- 10:45Speaker 5: to my home? Or can I stop him from doing that?
- 10:48Speaker 3: Well, you're going to probably need to go in and
- 10:52Speaker 3: get some renewed temporary orders.
- 10:54Speaker 2: I mean, if you have, if you're on the home, they're.
- 10:57Speaker 4: Not supposed to lock you out. So I would say
- 11:00Speaker 4: do something. I understand what you're saying. With lapse temporary orders,
- 11:04Speaker 4: that means your decree must have or your case must
- 11:07Speaker 4: have been dismissed. Otherwise, temporary orders don't lapse. So if
- 11:12Speaker 4: it has been dismissed, then file something. Otherwise you're both
- 11:16Speaker 4: both owners now home. I like that this question. Do
- 11:19Speaker 4: you ever mediate between parents who have never officially married?
- 11:24Speaker 4: We do, We do, and we do that with a
- 11:26Speaker 4: lot of com Either it's going to be under common
- 11:28Speaker 4: law marriage and divorce or just a custody case. In Utah,
- 11:34Speaker 4: the legislature has yet to pass laws that allow custody
- 11:41Speaker 4: cases to handle property division because they don't seem to
- 11:45Speaker 4: think that you're going to have kids and not get
- 11:47Speaker 4: married and own property together. So it's a little bit
- 11:50Speaker 4: difficult because a lot of times we'll just reach an
- 11:52Speaker 4: agreement between them, but there is no statue that specifically
- 11:55Speaker 4: governs that. But we will just mediate those same time
- 11:59Speaker 4: and take the same approach to it.
- 12:02Speaker 2: Does I guess both parties have to agree to mediation? Yes?
- 12:06Speaker 2: Mediation is a voluntary process. You can't I'm mediating this,
- 12:09Speaker 2: you go ahead and go to trial.
- 12:12Speaker 1: Here's a question, Yeah, say I want to get a
- 12:15Speaker 1: mediation divorce.
- 12:16Speaker 2: Can I call you and say, will you.
- 12:18Speaker 1: Call my ex and ask him if he'll do this?
- 12:21Speaker 2: Or do we have to agree to it beforehand.
- 12:23Speaker 3: We typically will require you, guys, to reach out to
- 12:26Speaker 3: your own partner. We have tried that in the past,
- 12:29Speaker 3: and they often just tend to ignore us, and so
- 12:32Speaker 3: we say, you know, have this conversation. At least have
- 12:35Speaker 3: them come and listen to the initial consultation. Once they
- 12:39Speaker 3: hear that initial consultation, if they decide they want to
- 12:41Speaker 3: go towards an attorney, because now they understand the process.
- 12:45Speaker 3: But we found that that's not very effective for us
- 12:49Speaker 3: to reach out to.
- 12:49Speaker 2: The can you tell tell people or give them a
- 12:52Speaker 2: rough idea? Really?
- 12:53Speaker 3: How much more just in terms of practical money saving,
- 12:58Speaker 3: is a mediation as opposed to a hiring lawyers?
- 13:01Speaker 2: You bet, A typical.
- 13:02Speaker 4: Mediated divorce if we do from start to finish, costs
- 13:05Speaker 4: right around three twenty five hundred dollars if I litigate
- 13:09Speaker 4: a case, my typical and this is not.
- 13:11Speaker 2: What the trial is about ten thousand.
- 13:14Speaker 4: If I go to trial, I tell clients every day
- 13:17Speaker 4: in trial is about ten to fifteen thousand dollars.
- 13:19Speaker 2: Wow.
- 13:20Speaker 1: So there's a reason to make it happen mediation wise, and.
- 13:24Speaker 4: That's the biggest reason is because the majority of things
- 13:27Speaker 4: can be resolved without a trial, but when you go
- 13:29Speaker 4: to trial, it is significantly more expensive. And it's not
- 13:32Speaker 4: just because of the one day. It is you're spending
- 13:35Speaker 4: four or five six days prepping for one day in
- 13:38Speaker 4: court by working with witnesses and exhibits. So it is
- 13:41Speaker 4: a large savings and the time savings is the big thing.
- 13:45Speaker 2: Salt Mediationgroup dot.
- 13:46Speaker 5: Com and you know, again we're out of time and
- 13:50Speaker 5: all of the good questions are starting to roll in
- 13:52Speaker 5: and we don't have time.
- 13:53Speaker 1: Well we'll have way back, Yeah, we will, or just
- 13:56Speaker 1: call a text or go to Salt Media
