Transcript
- 0:00What is up, everybody? Charlie Marlowe reporting live
- 0:03from my back patio, giving you a nice backdrop there of the tree
- 0:08and some bushes. You see the headline.
- 0:10We're going to break it down. We're going to talk about it
- 0:13breaking. This is about two hours ago, but
- 0:16breaking news, NASCAR scores legal win versus Michael Jordan
- 0:21and 2311 racing also Front Row Motorsports.
- 0:24But of course, 2311 Racing the big team with Denny Hamlin with
- 0:30Michael Jordan as Co owners. And we have some huge news here
- 0:34in the NASCAR lawsuit. So look, I was I was editing the
- 0:40Kenny conversation with Robin Pemberton, which is great.
- 0:43That's right now on Dirty MO media podcast.
- 0:45It'll be on the Kenny Wallace YouTube channel later.
- 0:48But I saw on X, I'll go right to X here, all the NASCAR reporters
- 0:53weighing in about two hours ago. So Bob Pockras.
- 0:56He tweets. U.S. court of Appeals has ruled
- 1:00in favor of NASCAR and vacated the injunction requiring NASCAR
- 1:06to treat 2311 and Front Row as chartered teams.
- 1:11So here's what's going on here. Bob Hochrist continues to tweet.
- 1:16The teams get 14 days to petition for a rehearing or
- 1:22hearing in front of all the appeals judges. 7 days after
- 1:27that deadline passes is the earliest this judgement would
- 1:31take effect. So what could happen here is
- 1:34that 2311 Racing and Front Row Motorsports could race.
- 1:38They could be forced to race as non chartered teams for the rest
- 1:43of the year. Here we have a statement also
- 1:46from the attorney for 2311 in Front Row Motorsports.
- 1:51This is Jeffrey Kessler. He says, quote, we are
- 1:55disappointed by today's ruling by the 4th Circuit Court of
- 1:59Appeals and are reviewing the decision to determine our next
- 2:03steps. This ruling is based on a very
- 2:05narrow consideration of whether a release of claims in the
- 2:10charter agreements is anti competitive and does not impact
- 2:14our chances of winning at trial scheduled for December 1st.
- 2:18We remain confident in our case and committed to racing for the
- 2:22entirety of this season as we continue our fight to create a
- 2:26fair and just economic system for stock car racing that is
- 2:32free of anti competitive monopolistic conduct.
- 2:36End Quote. That is the statement from 2311
- 2:39Front row Motorsports attorney Jeffrey Kessler.
- 2:43So got 189 of you guys here live on the Kenny Wallace YouTube
- 2:48channel. Thank you so much.
- 2:50We'll talk about it, get your comments in, get your questions
- 2:52in and CJ Gildner says looks like we found Dodges charters
- 3:00for the inevitable return to cup now.
- 3:02And you probably saw the news too.
- 3:04The report from Adam Stern of the Sports Business Journal that
- 3:08maybe Dodge Ram coming into the Truck Series 2026 potentially
- 3:13that was the report with our guy Cletus McFarland.
- 3:17So we'll see about that. Thank you for joining us 210 of
- 3:20you watching live on the Kenny Wallace YouTube channel.
- 3:23What do you guys think about this news?
- 3:25All the NASCAR reporters weighing in.
- 3:28So look, I'm not just going to sit here and and plagiarize Bob
- 3:32Pockras on X, but this is a lot of legalese.
- 3:35So it's something that look, the reporters, Bob Pockras, Jeff
- 3:39Glock that have been that have been covering this the whole
- 3:41time these guys are locked in. So I would go to their their ex
- 3:45feeds and all that. So what Bob Parker's also
- 3:48tweeted was that federal procedure allows 14 days for a
- 3:54request that all judges on the appeals panel hear the case.
- 3:58The mandate enforcing the judgement is issued 7 days after
- 4:02that deadline or if there is a pending request to rehear the
- 4:07case, then seven days after any denial of that decision.
- 4:12So basically what he's trying to say there, I know this is a lot
- 4:14of legalese, but potentially in three weeks 2311 racing OK, in
- 4:20front row Motorsports, all these cars could be open cars, meaning
- 4:27they would have to qualify their way in to each and every race
- 4:31would not be guaranteed a spot like the chartered teams are OK.
- 4:37So and Bob Hockers goes on to tweet NASCAR hasn't said what it
- 4:41would do with their six charters.
- 4:43There could just be 30 chartered teams, OK.
- 4:48And those cars also would get less money.
- 4:50So that's that's the big part of this too, is that if they're not
- 4:54running as chartered teams here in 2025, they wouldn't get that
- 4:59charter money cut. Now.
- 5:01They'd have to qualify their way in if there was more cars in the
- 5:05field trying to qualify. But look, folks, this is clearly
- 5:10a a pretty big legal win for NASCAR in this lawsuit that
- 5:15started what, last fall? I feel like right towards the
- 5:18end of the season, this was a big story.
- 5:20Haven't heard a ton about it this year.
- 5:23Seems like we always get these these new updates whenever it is
- 5:26Wednesday, Thursday at the end of some of these weeks.
- 5:28But look, make no mistake here, this is clearly a big legal win
- 5:35for NASCAR with potentially this preliminary injunction being
- 5:40overturned. So let's go to the chat and see
- 5:45what y'all are saying. Thank you so much for weighing
- 5:47in 243 of you watching live right now.
- 5:50If you're just joining us again, got the headline breaking NASCAR
- 5:54scores legal win versus Michael Jordan and 2311 racing and also
- 5:58front row Motorsports. So Jeffrey King says crazy.
- 6:04Would they not be allowed to win the championship?
- 6:07So they can still win the championship, right?
- 6:09They would not get the same payments, they would not get the
- 6:13same type of monetary benefits as the chartered teams get
- 6:17though with the new TV contract and all that with with the money
- 6:21coming in, they would not get those benefits running as open
- 6:25teams, Rex Dowell says. I think it's a crock if you know
- 6:31what, that NASCAR won the case and now they're pulling what
- 6:33they said for the season. Hamilton and 2311 could run as a
- 6:38charter team. Just so everybody knows though,
- 6:40NASCAR has not won the case though this is this is kind of
- 6:44the legal battles before the legal battles, right?
- 6:47This trial, if you have a trial could take place in December.
- 6:51But this is just the latest in this if we call it a war.
- 6:55This is the latest battle that NASCAR has has obviously won in
- 6:58this in this long legal war. Casey Rigsby Foray says, wow, a
- 7:05blow, I am sure. Yes to the teams, absolutely.
- 7:10Here we go. Benjamin Lewis says let's go.
- 7:13I think 2311 has a leg to stand on.
- 7:15I'm surprised this was overturned.
- 7:17Take it all the way to the Supreme Court.
- 7:20How about that? Nicholas says, well, that's
- 7:22unfortunate. Caleb Burnett already changing
- 7:26the subject. Different subject, but glad to
- 7:28see Kyle Larson is now leading merch sales over Chase Elliott.
- 7:32LOL. There you go.
- 7:33Hey, you can weigh in on any topic you'd like.
- 7:36Let's see. Would love to hear Kagan and
- 7:37Thomas agree on something. We're talking politics now with
- 7:40the Supreme Court. Do you think I, I don't think, I
- 7:43don't think this NASCAR lawsuit will get to the Supreme Court,
- 7:46although you never know. Let's see, Justin Moore asks.
- 7:51My worry is that there won't be any teams open for new drivers
- 7:54like Reddick, Wallace and Gregson, right?
- 7:57And that's what those teams argued before, right?
- 8:01They said, look, if we don't have a charter, you have these
- 8:04drivers who are under contract or want to be under contract and
- 8:08that would be detrimental to to them and their careers in terms
- 8:13of a Tyler Reddick, Bubba Wallace, Riley Herbst, and then
- 8:16also like you said, Noah Gregson, front row Motorsports
- 8:20drivers as well. Let's see.
- 8:23Hey, I'm Eric. Dodge posted a video of their
- 8:25truck, but in the background there's a Ram 2026 Truck Series
- 8:30truck. How about that?
- 8:31Going back to the the potential news with Cletus MacFarlane
- 8:35running NASCAR trucks in 2026 with with Dodge that hasn't been
- 8:40confirmed yet. That was reported by Adam Stern
- 8:43earlier in the week. That was what, Monday?
- 8:46Let's see, it's me says time to start a competing series.
- 8:50How about that? Let's be honest here.
- 8:53NASCAR has bigger, better lawyers than 2311 racing.
- 8:57Look, I, I would think that they both have very strong legal
- 9:00teams. NASCAR has been around the block
- 9:02before though. You got friends in high places.
- 9:06You got maybe some judges. Hey, look, judges are also more
- 9:09favorable to one side or the other too.
- 9:11So you've had legal wins where in this ongoing war, like we're
- 9:15like, we're talking about 2311 in front row, right?
- 9:19They got the preliminary injunction.
- 9:21You felt like, OK, this battle was going their way.
- 9:24Now, clearly it's going the way of NASCAR with this latest
- 9:28wrinkle and they've won the the overturning of the preliminary
- 9:32injunction. Ronald Kerouac saying great for
- 9:34NASCAR. Let's see.
- 9:38I'm not surprised from Chris BL33P.
- 9:43I'm very involved in NASCAR from Eric.
- 9:45OK, Adam Thurman says recap. I missed the update.
- 9:49OK, let's let's do a little recap.
- 9:51So the title breaking news, NASCAR scores legal win versus
- 9:56Michael Jordan and 2311 Racing, of course, also owned by Denny
- 9:59Hamlin. Front Row Motorsports also in on
- 10:02this lawsuit. And so what's happened is NASCAR
- 10:06has won this latest legal battle versus the teams.
- 10:11The preliminary injunction has been overturned.
- 10:15OK, let me find exactly. It was the US Court of Appeals,
- 10:19they've ruled in favor of NASCAR and vacated the injunction
- 10:24requiring NASCAR to treat 2311 racing and front row as
- 10:28chartered teams for the 2025 seasons.
- 10:31So again, we're talking in three weeks or so if this holds up.
- 10:36So look, the teams get 14 days, according to Bob Parkers, for
- 10:42the case to be heard by the entire appeals court.
- 10:44They get at least two weeks, OK? The ruling today wouldn't go
- 10:49into effect until seven days after that deadline passes at
- 10:52the earliest. So what we're talking is, if
- 10:54this holds up potentially 3 weeks from now, what's today,
- 10:58Today's June, what is it, June 5th?
- 11:02So potentially at the end of June, if this were to happen,
- 11:06these these teams would be racing, could be running as non
- 11:10chartered teams, meaning they have to qualify their way into
- 11:14the field. And then potentially, if you
- 11:16have more cars trying to get into a race, then teams looking
- 11:20to qualify, some of these big drivers, big teams, right,
- 11:24whether it be Tyler Reddick, Bubba Wallace, Riley Herbst,
- 11:27whoever it is, Noah Gregson, those those drivers could not be
- 11:31in the show if if things didn't go their way in qualifying,
- 11:35right? I mean, that wouldn't happen
- 11:36very often. There's not so many races where
- 11:38you have so many more drivers trying to enter the show.
- 11:42But you get what I'm saying. So this is a a big legal win,
- 11:46though for NASCAR in this ongoing battle.
- 11:49So here's here's basically what the judge said.
- 11:54It says, in short, because we have found no support for the
- 11:57proposition that a business entity or person violates the
- 12:01antitrust laws by requiring A prospective participant to give
- 12:06a release for past conduct as a condition for doing business, we
- 12:10cannot conclude that the plaintiffs made a clear showing
- 12:14that they were likely to succeed On the merits of that theory,
- 12:17and without satisfaction of the likelihood of success elements,
- 12:21the plaintiffs were not entitled to a preliminary injunction.
- 12:25C Winter, 555 US at 20. If you're going to check the
- 12:29legal, the legal proceedings there, the precedents right.
- 12:35So there you go and look, I'm no lawyer.
- 12:38The the folks that have been covering this non-stop, Bob
- 12:40Parkers and Jeff Clock and all those guys.
- 12:43Let's see let's see what Jeff clock has to say about this.
- 12:45And one more time by the way, for folks just joining us 'cause
- 12:49I know people are just jumping on 278 of you and Adam Thurman
- 12:53says recap. I missed the update.
- 12:55So there you go. So I'll do another little little
- 12:57recap. I, I read it earlier, but here's
- 13:00the statement from 2311 and front row Motorsports attorney
- 13:04Jeffrey Kessler. He says, quote, we are
- 13:06disappointed by today's ruling by the 4th Circuit Court of
- 13:09Appeals and are reviewing the decision to determine our next
- 13:13steps. This ruling is based on a very
- 13:15narrow consideration of whether a release of claims in the
- 13:19charter agreements is anti competitive and does not impact
- 13:23our chances of winning at trial. So the trial is scheduled for
- 13:26December 1st. We remain confident in our case
- 13:30and committed to racing for the entirety of this season as we
- 13:33continue our fight to create a fair and just economic system
- 13:38for stock car racing that is free of anti competitive
- 13:41monopolistic conduct. So there you go.
- 13:46And Bob Pockras goes on to say. Basically, let's see.
- 13:50Somebody asked him, Bob, if a 2311 Front Row Motorsports
- 13:53driver wrecks in practice and qualifying, theoretically not
- 13:56qualifying for the race and go on to make or win into the
- 14:00playoffs with the driver, need a waiver for the playoffs?
- 14:03Bob Hocker says no. The playoff eligibility rule
- 14:06states if a starting position was not earned, then the drivers
- 14:09and team owners must have attempted to qualify.
- 14:14So there you go. And again, Bob Parker's is all
- 14:16over this. Jeff Glock.
- 14:18Let's see what Jeff Glock. Let's see if he has any other
- 14:21information on his Twitter feed of what's going on here.
- 14:26Basically same stuff, yeah. Jeff Glock tweets major NASCAR
- 14:31lawsuit news. This is 3 hours ago.
- 14:33The preliminary injunction that allowed 2311 Racing and Front
- 14:36Row Motorsports to race as chartered teams has been
- 14:38overturned by a federal appeals court.
- 14:41Appeals court. The teams could now lose their
- 14:43charters, both existing and the ones they got from Stewart Haas
- 14:47Racing. Remember those?
- 14:49Those charters were sold. That was an issue as well with
- 14:52the Stewart Haas Racing charters being sold over the winter and
- 14:56they could race as open teams 2311 in front row Motorsports.
- 15:01So there you go that's from from Jeff Gluck.
- 15:05Bob Parkers has been all over this.
- 15:07We'll go back to the chat here 327 of you guys watching and I
- 15:12appreciate that we're just kind of we're kind of going through
- 15:15the news here. I'm no lawyer, but let's go down
- 15:20here and see what you guys are saying here.
- 15:22NASCAR is legalized mafia. Look, I've said all along I
- 15:27thought NASCAR was going to have to budget a little bit.
- 15:30Maybe I'm wrong, though. I could easily be wrong.
- 15:32Look, NASCAR may maybe the legal precedent is on their side.
- 15:37I just feel like, I just feel like it seems like everything is
- 15:42getting better for NASCAR in the tracks.
- 15:45And to me, NASCAR is the only sport.
- 15:48You tell me, folks, what other sport are the athletes getting
- 15:52paid less than they used to get paid, right?
- 15:55NASCAR is the only sport that's happening.
- 15:57Look at quarterbacks are making $60 million a year.
- 16:00Baseball players, Shohei Otani, what are they making now?
- 16:025040? Whatever, it's deferred money.
- 16:04I think Shohei Otani's making $70 million per year with
- 16:07deferred money, of course. But still, NASCAR drivers are
- 16:11now making less than they made at the peak, early 2000s, mid
- 16:162000s. So, so that's where that doesn't
- 16:18seem fair to me. That doesn't seem write to me if
- 16:22you're if you're literally and you tell me if I'm wrong.
- 16:24Name any other sport where the athletes are now making less
- 16:28money than they made 20 years ago, 15 years ago, whatever it
- 16:32is to me, NASCAR is the only sport where that's happening.
- 16:36Let's see turbo 14. Hi, Charlie.
- 16:37More cleats and less MJS. Oh, you know, I mean, I, I love
- 16:42Michael Jordan and I and I like the fact that even though I'm
- 16:45more of a LeBron guy, not going to lie, I'm from Ohio.
- 16:48We can get into that debate later, but all I'm saying is I I
- 16:52think look, I'm I'm fine with the teams trying to get more out
- 16:56of NASCAR. This happens in every sport,
- 16:59every sport going back to Curt Flood and the the Cardinals
- 17:04outfielder going after MLB for free agency.
- 17:08You have strikes and lockouts in every sport.
- 17:10It happens in every single sport.
- 17:12So this is it's new to NASCAR, but it's not it's not really
- 17:16new. Eventually you're going to have
- 17:18a team, a well funded team, somebody like Michael Jordan, a
- 17:22billionaire who has seemingly end endless money to go after
- 17:25NASCAR and see if they can get a better deal.
- 17:28And look, maybe they don't. I mean, clearly this is a big
- 17:31win for NASCAR with this injunction being overturned.
- 17:36Charlie, the teams pay the athletes, correct.
- 17:39But what I'm saying is the teams are clearly getting less money.
- 17:43And if you don't believe me, I mean, just just listen to the
- 17:45owners, right? And and we all know sponsorship
- 17:48is not what he used to be. 2530 years ago, every Fortune 500
- 17:53company wanted into NASCAR. You were getting you're getting
- 17:56knocks on your doors. Kenny Wallace always talks about
- 17:58the fact that what was it? Was it Square D or whoever
- 18:01knocked on his door wanting to sponsor him.
- 18:03That doesn't happen anymore. Look at look at Denny Hamlin,
- 18:05co-owner of 2311 Racing in on this lawsuit.
- 18:09Obviously he has FedEx for what, 20 years loses that monstrous
- 18:14sponsorship. Now he gets progressive for
- 18:17about half the races, but still the sponsorship dollars are just
- 18:21not even close to what they used to be.
- 18:22So I, I get what you're saying that the teams pay the drivers,
- 18:26but the point is the teams are making less money so they have
- 18:29less money to pay the drivers. That's that's my point.
- 18:32And that's the only sport where this is happening right now.
- 18:34No other sport. I mean, heck, basketball players
- 18:37are getting $50 million a year, quarterback $60 million a year.
- 18:41Baseball players, 20, five, $30 million a year.
- 18:44Hockey's also, I have to say hockey is a sport where they
- 18:48were making a little more, don't you think?
- 18:49What, 1015 years ago, I guess there's still some guys making
- 18:53twelve, $13 million a year. Hockey's in a similar, a similar
- 18:57boat as NASCAR, but also hockey needs to grow in the same way
- 19:01that these other sports have grown to allow their athletes to
- 19:05make more money. And I guess you could make that
- 19:06case for NASCAR as well. NASCAR is trying though.
- 19:09They're trying to go international.
- 19:11You are a a regional sport, a national sport, but it helps to
- 19:14get into Mexico City and it helps to potentially go
- 19:17international to bring in more TV dollars and all that.
- 19:20Let's see. McGrath 2O2 says a win for
- 19:24NASCAR. It's not NASCAR's fault that
- 19:262311 in front row thought they're better than any other
- 19:29team that actually signed the agreement in the beginning.
- 19:32Big Jordan fan when he played in the NBA, right?
- 19:34But I, I think all the other teams also were happy that this
- 19:38lawsuit went through. I mean, you heard you heard
- 19:40everybody, all the big, all the big owners, right?
- 19:45I mean, Rick Hendrick, what was his quote?
- 19:47He got tired of arguing about it, right?
- 19:49Richard Childress basically said he was kind of forced to sign
- 19:53it. He was like, I have all these
- 19:54employees. I felt the need I had to sign
- 19:56it. I have all these employees who
- 19:58who work here and I got to worry about them.
- 19:59So I get it. But I think deep down all of the
- 20:02teams are actually happy that 2311 in Front Row Motorsports
- 20:07have filed this lawsuit, even if they don't end up winning in the
- 20:10end. I think all the teams were slash
- 20:13are on the side of 2311 in Front Row Motorsports.
- 20:16What do you guys think? You disagree.
- 20:18Let's see. Dodge has some news coming out
- 20:21on Sunday. Is that the, the Cletus news?
- 20:24Is that what you're saying would be interesting?
- 20:27That was reported earlier from Adam Stern Sports Business
- 20:30Journal. We'll see if it's true, right?
- 20:32I, I haven't seen Adam Stern being wrong really ever.
- 20:36I mean, I'm not saying he's never been wrong, but with a big
- 20:38story like this, I, I haven't seen him.
- 20:41Plus, he said there was a document that that he and some
- 20:45other people actually have viewed.
- 20:47So we shall see. Let's see.
- 20:51Got my daughter one second. I'm almost done.
- 20:55I'm outside here. My daughter's ready to go to
- 20:57lunch. I get it.
- 20:58I'll wrap up. I promise.
- 20:59OK. Let's see.
- 21:02Eric says like and subscribe to the channel.
- 21:04Yes, please. We love that Jordan did not
- 21:08spearhead this lawsuit. I wonder why he's the face of
- 21:11this lawsuit now. What do you mean by that?
- 21:12I mean, Michael Jordan, I think did spear spearhead this
- 21:15lawsuit. He Denny Hamlin, you have
- 21:19thermal Motorsports, which is what Bob Jenkins.
- 21:21No, I I think Michael Jordan in 2311 absolutely did spearhead
- 21:24this lawsuit. Let's see.
- 21:27Richard Hall says NASCAR's model is broken.
- 21:30They have become WWE with four tires.
- 21:34Let's see, Chip. Ferguson says if this holds up,
- 21:38Reddick will find a ride next year.
- 21:39Don't care about the other two. Yeah, but don't you think Tyler
- 21:42Reddick wants to drive for 2311 racing?
- 21:45You have the big three, you have Penske, you have Hendrick, you
- 21:50have Gibbs. I think it's fair to say it's
- 21:54fair to say 2311 racing is is the 4th track house knocking on
- 21:58the door. Ross Chastain won at Charlotte
- 22:02for the Coke 600. I feel like Track house has
- 22:05taken a little a little step back the last year or two.
- 22:09That's really just because Ross Chastain did so well.
- 22:12What was that was that three years ago with the the Hail
- 22:15Melon finishing second? But look, Tyler Reddick was in
- 22:18the final four last year. Bubba Wallace is having a nice
- 22:22season this year as well. A lot of stage points.
- 22:27So I don't think, look, I understand this is this is bad
- 22:30for 2311 racing in front of Motorsports right now.
- 22:34But if you're Bubba Wallace or or Tyler Reddick, do you really
- 22:38want to leave Michael Jordan and Denny Hamlin and all those
- 22:41sponsors, right? I mean, McDonald's, Jordan
- 22:46brand, what do you got? You got beast.
- 22:49How about Chumba Casino? I love that because on the
- 22:53Herman Trader show, Kenny Wallace does so many ads, so
- 22:55many reads for Chumba Casino. It was cool to see the Chumba
- 22:58Casino car last week. That was the Bubba Wallace car.
- 23:02To see that at Nashville Chumba Casino, it's like an online
- 23:06gaming type deal. You get the coins and all that.
- 23:09I have not played it, but we do a ton of ads for Chumba Casino,
- 23:12so it was fun to see that car for Bubba Wallace at Nashville.
- 23:16Let's see. Richard Hall says if 2311 loses,
- 23:21is it? Let's see, hold on, Chip
- 23:24Ferguson, Tyler will get another ride.
- 23:27The other two can go kick rocks. I don't think any of them are
- 23:29leaving the team, though. Richard Hall.
- 23:31Yeah, he says. If 2311 loses, is it a death
- 23:35nail or death nail to the team as a whole?
- 23:37No, I don't think it is at all. I don't think it is at all.
- 23:39I I think big picture, NASCAR wants Michael Jordan in the
- 23:43sport. They don't like that they're
- 23:45being sued by him. But I think this will get taken
- 23:49care of, whether it's through trial, who knows, You know, will
- 23:53they be able to sign the charter agreement or a new charter
- 23:56agreement in 2026? We'll, we'll see what happens.
- 23:59We're now 6789 months, whatever it is, into this and we're still
- 24:03going. And NASCAR won today's battle.
- 24:07So at this point, don't you think there's going to be a
- 24:09trial in December? That's what it's looking like
- 24:11right now. Let's see.
- 24:15NASCAR collector, I'm not sure what to think about this.
- 24:20I get you. But I think I think right now,
- 24:22look, you don't have to think too much except for the fact
- 24:24that today's news is very big for NASCAR.
- 24:28This is a big legal win for NASCAR 2311 racing and Front Row
- 24:32Motorsports will get to appeal this and potentially about 3
- 24:37weeks from now. If they were to lose this appeal
- 24:40about 3 weeks from now, 2311 and Front Row Motorsports, they
- 24:44could be racing as open teams and have to qualify their way
- 24:49into the races. They wouldn't be looked upon as
- 24:51chartered teams for 2025 and they wouldn't get all the
- 24:54benefits, all the the monetary benefits of being a chartered
- 24:58team. Yes, Chris says they've won the
- 25:01battle, not the damn war. That's what I'm saying right
- 25:04now. I'm sorry, couldn't resist.
- 25:06No, I think that's the perfect way to sum it up.
- 25:09Again, I'm no lawyer. I'm going through Bob Hochrist
- 25:13and what he's tweeting and what he's writing.
- 25:15Just like everybody else. He's the expert.
- 25:17I'm just jumping on here and chatting with you guys because
- 25:20it's a pretty big story in NASCAR, so.
- 25:24Let's see. Chip Ferguson says Amen, Caleb.
- 25:29Look at the mess in the NBA. So I understand if you're down
- 25:33in the NBA and ratings wise, but what I was saying earlier was
- 25:36about how much the athletes are making.
- 25:39And that's where NASCAR to me is about the only sport where the
- 25:42drivers are making less than what they used to make.
- 25:45Hockey is, is in that boat. But I think hockey and hockey
- 25:50and NASCAR, they kind of fight the same battle there.
- 25:54I mean, look at GG splits up. But those live guys making just
- 25:59insane amounts of money. And that's, let's be real,
- 26:01that's foreign money, that's Saudi money.
- 26:03That's how they're getting that that type of money in those
- 26:08contracts. That money's coming in from
- 26:09Saudi Arabia. So NASCAR to get on the same
- 26:13page as some of these other sports, they, they will need
- 26:16more international TV deals. But the TV deal they just
- 26:19signed, what was it, 7 years, $7.7 million.
- 26:23So that's one point. Excuse me, $7.7 billion.
- 26:27So that's $1.1 billion per year. You're on all these different
- 26:31networks, FOX and NBC, you're doing Turner now.
- 26:36They're streaming with Amazon Prime Video.
- 26:39So they're kind of they're kind of doing a little more of the
- 26:41NFL model. I mean, for years, one of the
- 26:43reasons the NFL is king, I mean, for many reasons.
- 26:46But for TV, they've always been represented by all the networks.
- 26:49You got Monday Night Football with ABC and ESPN.
- 26:53Obviously Fox has the package for Sundays, CBS has the package
- 26:57for Sundays, NBC has the Sunday Night Football package.
- 27:02They all get some playoff games, they all rotate for the Super
- 27:05Bowl. And then what?
- 27:06Just what this past year or two, whenever, when, when Prime
- 27:10jumped in for the the Thursday Night Football.
- 27:13So NASCAR is is following a a similar model.
- 27:17So there you go. I'm going to put Chris's comment
- 27:20up again. I think this sums it up
- 27:21perfectly. They've won the battle, not the
- 27:24damn war. Talking about NASCAR, yeah,
- 27:26NASCAR clearly has won today's legal battle versus 2311 racing
- 27:31and front row Motorsports. But the war wages on Chip
- 27:36Ferguson. Top NBA players make $250,000
- 27:39per game. I think it's more than that,
- 27:42dude. Think about it.
- 27:44If NBA players are making $50 million a year, that means
- 27:48they're making more than $500,000 per game.
- 27:52I mean what's the the biggest NBA player?
- 27:54The the highest paid? Aren't they making like 60?
- 27:57I'm going to Google it real quick.
- 27:59Highest paid NBA player. Let's see.
- 28:06OK, I got Steph Curry at 56,000,000, Joel Embiid 51
- 28:11million, Djokic at 51 million. That's more than $500,000 per
- 28:18game. We're talking at 81, we're
- 28:21talking about 82 game schedule. And if Steph Curry's making $56
- 28:24million per year, Dang, that's Dang close to he's getting close
- 28:28to like $700,000 per game. I'm no mathematician, but that
- 28:34seems about right. Let's see.
- 28:37Chip Ferguson's got to go. Anybody but 11 or 23.
- 28:43OK, so you're saying anybody but Danny and anybody but Bubba.
- 28:47All right, so now so, so is that just on the track?
- 28:50What about the lawsuit that that means?
- 28:52I would think you're on NASCAR's side for the lawsuit as well.
- 28:56I'm just always, if you look at this kind of ongoing battle
- 29:00between capital and labor, I always tend, I want everything
- 29:05to be fair. I always tend to lean towards
- 29:07labor and I understand it's hard to look at labor as $1,000,000
- 29:13drivers or $50 million basketball players or $40
- 29:17million baseball players. But it's still, it's still the
- 29:21the workers versus the owners. And again, everybody needs to
- 29:24eat. It needs to be fair for
- 29:26everybody. But if it's a tie in baseball,
- 29:29tie goes the runner, as you say, tie goes to to labor, tie goes
- 29:32to the to the workers. In my opinion.
- 29:34That's how I look at these things.
- 29:36Let's see, Chris says good news or what?
- 29:38It is not good news for 2311 racing.
- 29:40It is not good news for Front Row Motorsports.
- 29:43It is good news for NASCAR though, with this preliminary
- 29:46injunction being overturned. So for folks, just join us.
- 29:51We're having more people jump on 348 of you watching live on the
- 29:55Kenny Wallace YouTube channel. I appreciate that.
- 29:57Please give us a subscribe if you haven't yet.
- 30:01And if you like this video, if you've liked this video, give us
- 30:04a like. But yeah, NASCAR has this legal
- 30:07win today, the preliminary injunction overturned.
- 30:12So the teams 2311 racing for Motorsports, they can appeal.
- 30:17And from what I gathered from Bob Parkers, his reporting is
- 30:21basically you have about a three-week period, you have a
- 30:24couple week period and if they appeal and if they were to lose
- 30:28their appeal, then a week after that.
- 30:30So basically if 2311 Racing and Front Row Motorsports, if they
- 30:36lose their appeal about 3 weeks from now, so late June, you
- 30:40could have 2311 Racing and Front Row Motorsports running as open
- 30:46cars, as non chartered teams. They would have to qualify their
- 30:52way in. So there is a chance if there's
- 30:54races, obviously the Daytona 500, Daytona 500 is the one race
- 30:58where everybody wants to get in, right?
- 31:00I think you had, well, you had like 7, seven cars trying to
- 31:04qualify for the number of spots, whatever it was.
- 31:06So I haven't looked at all the races and how many people are
- 31:08trying to qualify. But there is a chance if you had
- 31:11a really bad qualifying, if you crashed out and practiced
- 31:13qualifying, whatever it is, you can get squeezed out there.
- 31:17There is a chance that these teams could not be running some
- 31:20of these races, which is just terrible for their sponsors.
- 31:23And look, that's the benefit of being a chartered team.
- 31:26And I understand if you're on the side of NASCAR, you're
- 31:29saying, well, how are you able to sue us and also still run as
- 31:33a chartered team? I get that I tend to side with
- 31:36the teams in this particular case, but that doesn't mean
- 31:40they're going to win. And and clearly NASCAR has
- 31:43scored a huge win today. Let's see, we have the retired
- 31:49tech says, what does this do to the money won this year?
- 31:54Well, that's another part of this, a huge part of this moving
- 31:56forward. If you're not a chartered team,
- 32:00then you don't get the monetary benefits that these chartered
- 32:03teams get, right? I mean, the chartered teams get
- 32:07the guaranteed spots, they get the revenue sharing of the, of
- 32:10the TV money and all that. So that's, that's the incentive
- 32:13to be a chartered team. Obviously you don't, you don't
- 32:17own it. You're not an owner, It's not a
- 32:19franchise. That's the difference between,
- 32:22that's the difference between between a charter and a
- 32:25franchise owning a franchise in the NBA or Major League
- 32:28Baseball, whatever it is. But yeah, 2311 racing, front row
- 32:32Motorsports, they would lose out on all those monetary benefits
- 32:35that chartered teams get. And this could happen as quickly
- 32:39as three weeks from now if they lose their appeal.
- 32:43Let's see, yes, Ram is back for 2026.
- 32:47That's been reported by Adam Stern in the Truck Series and
- 32:50maybe Cletus McFarlane on board for that.
- 32:53I'm sure we'll hear some more news on that moving forward.
- 32:57Let's see. You think those two drivers
- 33:00think about it during the week? You talking about Bubba Wallace
- 33:04and Tyler Reddick? What are you talking about?
- 33:06Let's see. It doesn't matter who wins, JC
- 33:11Beckner says. The fans will not be among the
- 33:13winners. Now, why do you say that?
- 33:16I also think I don't think this is a huge distraction.
- 33:19I think for the most part, I mean, what, we're Dang near
- 33:21close. Are we halfway through the
- 33:22season? We're close to halfway through
- 33:25the season, whatever it is. I don't feel like this has been
- 33:27a big distraction. I feel like the racing's been
- 33:31pretty good lately. You had a stretch there of three
- 33:34or four bad weeks in a row. I think the season started out
- 33:36great. Then you had some of the short
- 33:38tracks weren't great. Last three weeks or so I think
- 33:41have been really good racing for the most part, or at least good
- 33:45shows. I think Amazon has added to the
- 33:49to the races with with their broadcast coverage.
- 33:52But what the All Star race was was really, really good.
- 33:55Going back to Kansas was really, really good.
- 33:57I think night races just also look better.
- 34:00So I think your night races Charlotte for the 600,
- 34:03Nashville, I don't know, I'm just talking about on TV.
- 34:07Even though some of those races you can't pass, like Nashville,
- 34:09you couldn't pass. The drivers are saying that.
- 34:11But I feel like the shows look good.
- 34:14You know, Ryan Blaney wins. He's a fan favorite.
- 34:16He deserved to win. He was the best car.
- 34:18He's had terrible luck this year.
- 34:20All those things I think go into the perception of of what's
- 34:24going on here. Let's see.
- 34:27Cletus for president running on beer debt forgiveness, I think.
- 34:31I think Americans could get behind that for sure.
- 34:35Let's see, the owners have to pay all the crew members, truck
- 34:37drivers, office people. There's only so much money to go
- 34:39around. I agree, but let's be real, the
- 34:42drivers are the superstars. The drivers and the cars are the
- 34:46superstars of NASCAR. Let's see.
- 34:50And we got Richard Hall hypothetically speaking at Front
- 34:52Row Motorsports in 2311 lose out totally.
- 34:54How does this impact their partnerships with Toyota, Ford
- 34:57Performance and team partnerships, Joe Gibbs Racing,
- 35:00Roush Fenway, etcetera? Look, I don't think these teams
- 35:03are going to be leaving the sport even if they lose.
- 35:05I think they'll hammer out a deal.
- 35:07I, I think eventually they'll, and this is down the road if
- 35:10they were to lose the lawsuit, you know, NASCAR wants Michael
- 35:15Jordan in the sport, NASCAR wants Denny Hamlin in the sport,
- 35:18NASCAR wants front row Motorsports in the sport.
- 35:21I, I think even if they lost, they'd be able to maybe sign the
- 35:24agreement moving forward. I think they would work those
- 35:26things out. That's that's the way I see
- 35:28this. Like, I don't think NASCAR,
- 35:31NASCAR is clearly pissed at Michael Jordan and Denny Hamlin.
- 35:34You really think they're going to kick those guys out of the
- 35:36sport? Denny Hamlin is a first of all,
- 35:39you couldn't kick him out of the sport.
- 35:40But I think what I'm saying is you want them in the sport.
- 35:43Even though they're suing you, you still want Michael Jordan is
- 35:46great for the sport. Denny Hamlin is great for the
- 35:49sport. Even if you don't like him, he
- 35:51keeps things interesting. His podcast, he speaks his mind.
- 35:54To me, he's he's arguably the most interesting person in
- 35:56NASCAR. So there you go, here we go,
- 36:02let's see, McGrath 2O2 says. Just a dumb question because I
- 36:06don't really keep up with how the play offs work.
- 36:07If 2311 in front row do end up losing in the long run, are non
- 36:11chartered cars eligible for play offs, championships, etcetera?
- 36:15Yes they are eligible for the play offs in the championship.
- 36:19Yes they are. Absolutely.
- 36:21Let's see, Rex Dowell says. I think NASCAR just needs to
- 36:25make 750 horsepower for all the tracks and stop with the Games
- 36:29550 on the superspeedway and just make it 7:50 for all the
- 36:32tracks. Let's see.
- 36:37And Chris says, I don't think there'll be any bad blood
- 36:39between the two entities going forward.
- 36:41Well, I think there's bad blood right now.
- 36:43What I'm saying is I think there's always going to be bad
- 36:46blood and, and people pissed off.
- 36:48I don't think it's going to cause 2311 and Michael Jordan to
- 36:52leave the sport. That's what I'm saying.
- 36:54If they win, clearly they're going to win.
- 36:56They're going to get some more money for the teams from NASCAR
- 36:58if they lose. Look, they just built, look at
- 37:01the, what do they call it, airspeed?
- 37:03They just built this unbelievable racing facility.
- 37:062311 racing did. They're not leaving the sport
- 37:08and NASCAR doesn't want them to leave the sport.
- 37:10So what I'm saying is even if they were to lose the lawsuit, I
- 37:15don't, I don't see them leaving the sport.
- 37:18I think they'll be able to sign some type of charter agreement
- 37:20moving forward. I think NASCAR wants this to be
- 37:23over. They obviously want to win.
- 37:25But but when it's said and done, if NASCAR wins, I think they'll
- 37:29they'll try to, to bring it in a in a respectful way.
- 37:34They'll try to bring 2311 in front of Motorsports back into
- 37:38the sport in, in a way where they have an equal footing with
- 37:42the other teams, right? That that's the way I see it.
- 37:45Got 342 of you guys watching right now on the Kenny Wallace
- 37:48YouTube channel. Really appreciate that.
- 37:50Thank you so much. I want to see how many people
- 37:53are watching total. Looks like we have 2200 people
- 37:59have been watching this live stream total.
- 38:01So I really appreciate that. All right, we're going on 38
- 38:04minutes here. Cletus news is all hearsay for
- 38:08now, right? Yeah, nobody said it's
- 38:10confirmed. This is just a report.
- 38:13If you don't know, it's a report from Adam Stern of Sports
- 38:16Business Journal that potentially Cletus McFarland and
- 38:21Dodge Ram will be in the Truck Series next year.
- 38:25OK, one second. My daughter's trying to ask me a
- 38:27question. You ready for lunch?
- 38:30All right, time to go. My daughter's ready for lunch.

- 38:59OK, End stream. End stream.
- 39:02Big NASCAR victory. Big victory for NASCAR in this
- 39:07ongoing legal battle versus 2311 racing in Front Room
- 39:10Motorsports. We'll see you say goodbye,
- 39:12sweetheart. Bye.
