- 0:03Speaker 1: This is a Bramble Jam podcast this week on your
- 0:13Speaker 1: gabble gabble.
- 0:14Speaker 2: If someone waxes your skin off instead of just the hair,
- 0:18Speaker 2: can you sue them for the damages?
- 0:20Speaker 1: Judge Gino is gonna get into legal sauce. And if
- 0:22Speaker 1: you're get in a fight with somebody and they take
- 0:25Speaker 1: your glasses and cut you with a knife, can you
- 0:28Speaker 1: assume them. Yeah, Judge mapthis tells us real people you
- 0:31Speaker 1: cases say justice. This is go everybody, Let's dance, Let's dance,
- 0:39Speaker 1: Let's dance. I said, let's go, everybody, Let's dance, Let's dance.
- 0:43Speaker 1: Hi everybody, Welcome back to you. Oh boy, it is
- 0:46Speaker 1: great to be here and it want to be anywhere else.
- 0:48Speaker 1: Back in the House of the Lord of the Chamber
- 0:51Speaker 1: of the Chambers. Very simple show. If it is your
- 0:54Speaker 1: first time joining us, thanks for coming. I'm gonna tell
- 0:57Speaker 1: my buddy Dan about a TV courtroom case that I
- 1:00Speaker 1: watched and he's going to try to guess the verdict.
- 1:02Speaker 1: The Dan's gonna be exact same thing to me. And
- 1:05Speaker 1: that's the program. That's the program. I went to mathis,
- 1:08Speaker 1: you went to Mathis. That's my go to I knew
- 1:11Speaker 1: that you weren't attached to mathis, which is rare, and
- 1:14Speaker 1: so I figured this is my chance.
- 1:15Speaker 2: I'm always that's my default. You want to go for
- 1:18Speaker 2: your sort first, I had a personal injury. I want
- 1:23Speaker 2: Eric robertson. Okay, so I want to introduce you to first.
- 1:25Speaker 1: He is suing Julie Johnson Julie Johnson for two thousand,
- 1:30Speaker 1: nine hundred and thirteen dollars big Boy, and Julie Johnson
- 1:34Speaker 1: is countersuing for six hundred and thirty dollars. Okay. Eric
- 1:39Speaker 1: walks in with a tape recorder in his hands, and
- 1:43Speaker 1: I'm very intrigued. The tape recorder is not coming to
- 1:45Speaker 1: play here. Oh and I'm not really sure it looked
- 1:49Speaker 1: like a tape recorder. But whatever it was, it doesn't matter.
- 1:55Speaker 1: He says that he met Julie through his witness his
- 1:57Speaker 1: witnesses there, yes, and they hung out a few times.
- 2:03Speaker 1: But the more that they hung out and got to
- 2:05Speaker 1: know each other, the more he saw her as a
- 2:08Speaker 1: violent drunk. Oh no, he saw her that way, yes, okay.
- 2:13Speaker 1: At this point, Julie lets at a sound this kind
- 2:15Speaker 1: of like this, okay, and matthis says, did you just burp?
- 2:21Speaker 1: And she says, no, no, it's just completely untrue. I
- 2:23Speaker 1: think it was a laugh, like a math scoff but
- 2:27Speaker 1: Matthis thought it sounded like a burpi, which it did.
- 2:32Speaker 1: Eric says, for instance, we had some friends come over
- 2:36Speaker 1: and some of them got drunk. He claims that Julie
- 2:39Speaker 1: reached under the couch, I don't know what it is,
- 2:42Speaker 1: and grabbed a gun before waving it around, saying, I'm
- 2:50Speaker 1: gonna bust a cap in someone. This seems like it's
- 2:52Speaker 1: a bigger deal than mathis. It does, but oh well,
- 2:59Speaker 1: it's in Mathe's I'm saying, fascinated at the countersuit if
- 3:01Speaker 1: she admits she did this, and Matthis asks if they
- 3:07Speaker 1: were ever romantic, and he says no, we were never roomant.
- 3:10Speaker 1: Julie says that in the few weeks that I knew Eric,
- 3:13Speaker 1: he completely turned my life upside down. Not in a
- 3:17Speaker 1: good way, Okay, not in a good way. She met
- 3:20Speaker 1: him through a mutual friend and they realized that they
- 3:22Speaker 1: had the same birthday, and so she invited Eric over
- 3:26Speaker 1: for a barbecue that her friend was throwing at one
- 3:32Speaker 1: of their houses, and that's where he showed his true colors,
- 3:35Speaker 1: because in the evening he assaulted me. Oh boy. And
- 3:39Speaker 1: I have no idea, no idea. Why is this after
- 3:42Speaker 1: the gun incident. I don't know the order of these events.
- 3:46Speaker 1: They're all random. Matthis is like, well, so he just
- 3:51Speaker 1: came up to you out of the blue and hit you.
- 3:54Speaker 1: And she says, kicked me, but yes, for no reason.
- 3:57Speaker 1: She says that Gerald was there to witness it. Gerald
- 4:01Speaker 1: is Eric's witness. It's Eric's witness. Yes. So Ma asks
- 4:06Speaker 1: Gerald to stand up, and Gerald says that never happened.
- 4:09Speaker 1: Oh my gosh, I don't know where she's getting any
- 4:11Speaker 1: of that. You can't do that. She has a witness.
- 4:15Speaker 1: It's very interesting. Anyway. Julie claims that, uh, that was
- 4:19Speaker 1: just the beginning. Eric says that here's what happened that night.
- 4:23Speaker 1: A group of us went to the deli to get
- 4:26Speaker 1: some gyros. That's what he says, though I'm not correcting it.
- 4:30Speaker 1: I'm just reading what he says, to get some gyros.
- 4:34Speaker 1: They they got gyro's. I didn't get a gyro. And
- 4:38Speaker 1: Matthew said, is that why you hit her? God math
- 4:42Speaker 1: has come on and he says, you should have gotten
- 4:47Speaker 1: the man of gyro. Please, people, can we just call
- 4:51Speaker 1: it what it Is, and so I gotta be honest,
- 4:54Speaker 1: I don't know how this event is related to this
- 4:56Speaker 1: story at all. Okay, we don't come back around, no,
- 4:59Speaker 1: they all right. Eric says that I don't believe in violence,
- 5:02Speaker 1: especially towards women in Mathis says, I I don't think
- 5:06Speaker 1: that you could take her anyway. Okay, all right, and
- 5:10Speaker 1: Eric sticks up for himself and this oh and says,
- 5:14Speaker 1: well that's not true. I could take her. You don't
- 5:16Speaker 1: say that's He's just Mathis has just got you now,
- 5:19Speaker 1: and math Is like, okay, okay, let it go, let
- 5:22Speaker 1: it go. Eric says that it's two twenty in the
- 5:25Speaker 1: morning one night, and me and Gerald's are ready to
- 5:28Speaker 1: go home, and he claims that Julie wanted to go
- 5:30Speaker 1: to what he calls an after hours establishment, which Mathis
- 5:34Speaker 1: gets a big kick out. Of course, Jerald wanted it
- 5:39Speaker 1: to be dropped off at his house on the way
- 5:41Speaker 1: because he didn't want to go to the after hours establishment. Suddenly,
- 5:45Speaker 1: Julie jumps out of the car for no reason. So
- 5:50Speaker 1: I rolled the window down to look back to see
- 5:52Speaker 1: where she's at, and she's already on the other side,
- 5:55Speaker 1: right by me. She claws my face and pulls my
- 5:58Speaker 1: glasses off, so I get out of the car to
- 6:01Speaker 1: get my glasses, but they're broken. Then I see her
- 6:05Speaker 1: pull a knife out of her purse. She swings at me,
- 6:10Speaker 1: cuts my hand which I was using to block my
- 6:14Speaker 1: face as one does. And next thing you know, I'm
- 6:17Speaker 1: bleeding like a pig. And Gerald corroborates all this maybe
- 6:21Speaker 1: not the big part. I gotta be honest. He never
- 6:23Speaker 1: we never hear from Gerald. He just shows up to
- 6:24Speaker 1: say she's lying. I don't know. I don't know. But
- 6:28Speaker 1: Gerald was there for what it's worth, and he has
- 6:31Speaker 1: pictures of his hands and hospital bills, it's important and
- 6:34Speaker 1: all that stuff. Julie says, what happened that evening was
- 6:39Speaker 1: this he went to get He wanted to go get
- 6:41Speaker 1: some more drinks. So we all get in the car
- 6:44Speaker 1: and Eric said that he wanted me to go back
- 6:47Speaker 1: to his place, and I said no. So Eric tells
- 6:50Speaker 1: me to get out of the car. It's not very
- 6:54Speaker 1: gentleman like, and he starts freaking out. He's shaking his
- 6:58Speaker 1: face and his glass has come off his face, which
- 7:00Speaker 1: I pick up. And I did keep those from him,
- 7:02Speaker 1: I'll admit it. Yeah, I kept the glasses from him,
- 7:05Speaker 1: which is very smart because he's driving, but whatever. She
- 7:08Speaker 1: then says that Eric began to reach towards into the
- 7:11Speaker 1: center console of the car, which made her very nervous,
- 7:16Speaker 1: and so she begins to jump out of the car,
- 7:19Speaker 1: right okay, And he stops the car gets out, and
- 7:23Speaker 1: he has some sort of he has a knife. So
- 7:26Speaker 1: I begin to call nine to one one and once
- 7:30Speaker 1: he finds out that I'm calling nine one one, he
- 7:33Speaker 1: runs away. And I didn't know a little guy like
- 7:34Speaker 1: that could run that fast. But before he ran away,
- 7:38Speaker 1: he did cut. He cut me, and I have pictures
- 7:40Speaker 1: showing that my thumb was cut. Okay, But does she
- 7:46Speaker 1: admit to cutting his hand? No, that story doesn't like.
- 7:49Speaker 1: But he has pictures in hospital bills. Yes, she says
- 7:54Speaker 1: that it was all him. Okay, so he cut his
- 7:56Speaker 1: own hand. I don't know all. And so she admit
- 8:00Speaker 1: that she was charged with a misdemeanor when the cops
- 8:05Speaker 1: showed up. She was charged with a misdemeanor. She admits
- 8:08Speaker 1: to that, but that she and she pled guilty. But
- 8:11Speaker 1: that's only because you just wanted this traumatic event to
- 8:14Speaker 1: be over. That's all matthis needs to hear, and mathis
- 8:16Speaker 1: is right to rule. Yeah, mathis we like to believe
- 8:18Speaker 1: women around here. It's a pretty good practice. Math has
- 8:20Speaker 1: hurt all he needed to hear. You were charged with
- 8:22Speaker 1: a misdemeanor and pled guilty. That is the beginning and
- 8:26Speaker 1: end of this sentence. Matthis is ruling in favor of
- 8:29Speaker 1: the dude getting the twenty nine hundred dollars for his
- 8:31Speaker 1: hospital bills, no way around it. Yes, but he's not
- 8:34Speaker 1: getting the full them ount really some reason, I don't know,
- 8:36Speaker 1: he says. When you plead guilty in court, there's not
- 8:38Speaker 1: much that I can do. I'm giving Eric the medical
- 8:41Speaker 1: bills of four hundred and fifty seven dollars, the glasses
- 8:45Speaker 1: of five hundred and forty six dollars, and then I
- 8:49Speaker 1: guess the rest of it was for like pain and suffering.
- 8:51Speaker 1: He said, I'm going to give you another five hundred
- 8:53Speaker 1: dollars for the cuts, fourteen hundred and thirteen dollars to Eric.
- 8:58Speaker 1: To Eric, this was a very much a he said.
- 9:01Speaker 1: She said situation. Uh, but she pled guilty. So yeah,
- 9:06Speaker 1: as soon as she did that, it was over. And
- 9:08Speaker 1: I know how this rolls. Uh.
- 9:11Speaker 2: We gotta go to the not the people's court, not
- 9:12Speaker 2: even a little bit we're gonna go to personal injury
- 9:15Speaker 2: court with Judge Gino. Now, brand you and I know
- 9:18Speaker 2: that he never gets it right right, He never gets
- 9:21Speaker 2: he never gets it right, which makes these cases fun
- 9:22Speaker 2: because you get really frustrated at Gina. This is a
- 9:26Speaker 2: fun one. This is a fun one. Marco Ricci, Marco Ricci. Uh,
- 9:31Speaker 2: it's R I C C I. But Gina says mister
- 9:35Speaker 2: Ritchie the whole time. Mister Richie is suing the Elizabeth
- 9:39Speaker 2: Gray salon for ten thousand and medicamouth Gray, the Elizabeth
- 9:43Speaker 2: grayce that's my mom. It's not the same Elizabeth Gray. Though,
- 9:47Speaker 2: that's my mom. Elizabeth Gray's in the courtroom. It is
- 9:50Speaker 2: not your mom.
- 9:50Speaker 1: Okay, yeah, uh, the Elizabeth Gray salon for ten thousand medical,
- 9:55Speaker 1: seventy thousand pain and suffering total of eighty large brand
- 9:59Speaker 1: eighty large. Marco Ricci's suing Elizabeth Gray. Here we go. Uh.
- 10:04Speaker 1: Marco's a portly fellow, like he's a big dude.
- 10:07Speaker 2: Okay, he us got glasses, button down, shirt on, and
- 10:10Speaker 2: he says, your honor is a software engineer.
- 10:12Speaker 1: I don't get the chance to meet a lot of women.
- 10:15Speaker 2: Okay, He's like I met this wonderful woman named Debbie,
- 10:20Speaker 2: and we started dating. She wanted to go to the beach.
- 10:23Speaker 2: Brett is Brett, It isn't. I don't know that first name,
- 10:26Speaker 2: not Debbie Debbie, that would be crazy up in the house.
- 10:30Speaker 2: I met this wonder a woman named Debbie. We started dating.
- 10:32Speaker 2: She wanted to go to the beach for a weekend.
- 10:34Speaker 2: It's a big deal.
- 10:35Speaker 1: In our relationship. Okay.
- 10:36Speaker 2: So I started getting self conscious about what he calls
- 10:39Speaker 2: my organic sweater. And then you see a picture of
- 10:42Speaker 2: him shirtless and he's got he's pretty hairy on his body.
- 10:45Speaker 1: Okay, organic, that's funny.
- 10:48Speaker 2: And he's like, my buddy said I needed some manscaping,
- 10:51Speaker 2: and he knew this salon. He set up an appointment
- 10:53Speaker 2: for me to get it taken care of. So now
- 10:55Speaker 2: we meet Elizabeth Gray. Elizabeth says, I'm the owner of
- 10:59Speaker 2: the Grays Alone. We specialize in facial hair and sorry,
- 11:04Speaker 2: in facial and hair removal. I've been in business for
- 11:07Speaker 2: ten years. We do laser, we do electrolysis, we do
- 11:10Speaker 2: sugar waxing. We have a lot of different sugar waxing
- 11:13Speaker 2: for getting the hair off of here.
- 11:15Speaker 1: What's a sugar waxing? I think it's just to make it. It's
- 11:18Speaker 1: not hot wax like, it's a little different. I don't
- 11:19Speaker 1: know sound. She says. Seventy five percent of my clients
- 11:21Speaker 1: are women, but men are more and more coming into
- 11:24Speaker 1: her for grooming, and it's starting to be more of
- 11:26Speaker 1: a cocky thing. She's like, I really believe that I can.
- 11:28Speaker 1: If I can help men and women look beautiful that inside,
- 11:32Speaker 1: it'll help them feel better about themselves. And we go
- 11:34Speaker 1: every over, every step with them before removing any hair.
- 11:37Speaker 1: All right, Marco says, Well, they took me to this
- 11:40Speaker 1: back room with no windows or anything, which I would
- 11:42Speaker 1: contend Marco, is where you want to get your body waxed.
- 11:45Speaker 1: That's true, you don't really want it to be on
- 11:47Speaker 1: like foot traffic. I don't think windows.
- 11:49Speaker 2: Maybe I could be wrong, He's like, all I mean
- 11:52Speaker 2: is my boxer's in my robe. The waxer asked me
- 11:55Speaker 2: what my pain tolerance was, and I said average. And
- 11:59Speaker 2: they started with one patch of skin and it hurt
- 12:03Speaker 2: really badly. But I thought it would get easier as
- 12:06Speaker 2: we went on. But that was just not the case.
- 12:08Speaker 2: I was trying to power through. But the third, I think,
- 12:11Speaker 2: he said, the third, The third time she pressed the
- 12:13Speaker 2: paper in, something just felt wrong and I just I
- 12:17Speaker 2: knew it wasn't right. She ripped off the paper. My
- 12:20Speaker 2: skin came off with it.
- 12:21Speaker 1: I looked for the first time my skin came off
- 12:23Speaker 1: with it. It was a mess. I asked if this
- 12:27Speaker 1: was normal. I asked if it was normal. The person
- 12:31Speaker 1: the esthetician said, quit being a baby, and that's what
- 12:35Speaker 1: she said. Now, this seems like it seems like it
- 12:38Speaker 1: should be something that's pretty easy to prove.
- 12:40Speaker 2: We see pictures. It is not normal. Now, I've never
- 12:44Speaker 2: had my body wax, but I am sorry. The skin
- 12:47Speaker 2: is gone. Yeah, you can tell the epidermis is gone.
- 12:51Speaker 2: It is not red because the hair has been ripped out.
- 12:54Speaker 2: It is clearly patches of flesh are gone, like clearly
- 12:59Speaker 2: and judged Gino's like, Miss gray House is supposed to work.
- 13:02Speaker 2: This isn't right, Miss gray says, your honor, That's not
- 13:04Speaker 2: what it's supposed to look like. That's not how it works.
- 13:06Speaker 1: Okay. Right at the time of the incident, I was
- 13:08Speaker 1: in my office. One of my estheticians came to me, Uh,
- 13:12Speaker 1: is that gonna We're gonna be okay, power there, Okay.
- 13:15Speaker 1: One of my aestheticians came to me saying she'd provided
- 13:18Speaker 1: a service for a client that he had run out
- 13:21Speaker 1: the door without pink. So he took off running out
- 13:23Speaker 1: the door without pink. Uh, genusis but it's not supposed
- 13:27Speaker 1: to be that way. He's not supposed to look that
- 13:29Speaker 1: way now, she says, your honor is not supposed to
- 13:31Speaker 1: be that way. But it can't happen with that type
- 13:33Speaker 1: of hair move. He just wanted hot wax.
- 13:36Speaker 2: We tried to offer him other options for this removal,
- 13:39Speaker 2: laser Electroli says, sugar wax.
- 13:40Speaker 1: He didn't want anything. I want to be in and out.
- 13:42Speaker 1: Marco says, your honor, I was getting pulled into that
- 13:44Speaker 1: appointment so fast. I was not giving those options. Elizabeth said,
- 13:47Speaker 1: he was given those options, he was not listening, and
- 13:51Speaker 1: he's also not being forthcoming with the entire truth. We
- 13:54Speaker 1: sat him down to make sure he understood his choices,
- 13:57Speaker 1: and he would not listen. Okay, but the choice either,
- 14:02Speaker 1: any choice, shouldn't leave you without says, but hot wax
- 14:05Speaker 1: isn't supposed to do that. Records.
- 14:08Speaker 2: Elizabeth says, we tested a portion of his skin and
- 14:10Speaker 2: it was fine, and he said his pain tolerance was average.
- 14:13Speaker 2: After that test, Marco says, what's your scale of pain?
- 14:17Speaker 2: The Spanish inquisition, so his medical is for second degree burns,
- 14:27Speaker 2: permanent scars. He unbuttons his shirt for the good of us, all.
- 14:33Speaker 1: I guess, and it's still, it's still.
- 14:35Speaker 2: And then he almost breaks down in tears and says
- 14:37Speaker 2: this line, which is just a home run if somebody
- 14:39Speaker 2: scripted this, it's great, your honor. A guy like me
- 14:42Speaker 2: doesn't get too many chances with Debbie's so unburns his
- 14:48Speaker 2: shirt shows the scars. He's like, these scars might keep
- 14:51Speaker 2: me from ever meeting another Debbie Stars Make You Beautiful.
- 14:55Speaker 2: Apparently Debbie was cool with Marco until he had the scars.
- 14:58Speaker 2: I guess, we don't hear anyth more about it. Maybe
- 15:01Speaker 2: kept his shirt on during the day. He's like, and
- 15:02Speaker 2: I want to be clear.
- 15:03Speaker 1: I asked her if this was normal, and the estheticians said,
- 15:06Speaker 1: quit being a baby.
- 15:07Speaker 2: So wed is the excess. No, but we get an
- 15:11Speaker 2: expert esthetician to come into the room to the plasma.
- 15:13Speaker 2: She brings in a shirtless dude to actually remove hair
- 15:17Speaker 2: right in the in the thing, so she says, and
- 15:21Speaker 2: all estheticians shake the temp of the wax.
- 15:23Speaker 1: We usually put it on ourselves first. That way we
- 15:26Speaker 1: know exactly what the client is feeling. So that's what
- 15:28Speaker 1: they think. The wax was too hot. Yeah, I try
- 15:30Speaker 1: to understand each client's threshold for pain. There's a twist coming,
- 15:33Speaker 1: don't worry.
- 15:34Speaker 2: I try to understand each client's threshold for pain in
- 15:37Speaker 2: the In the questionnaire that he filled out, he said
- 15:40Speaker 2: that his average for pain and was not in any medication.
- 15:42Speaker 2: That's this guy in the room that they're doing wax, okay,
- 15:45Speaker 2: and not the other guy who also said average. She
- 15:47Speaker 2: rips off a piece of his hair from his chest
- 15:49Speaker 2: and he she really does it, like and he is
- 15:52Speaker 2: like eyes watering. Yes, but again, and I don't want
- 15:56Speaker 2: to keep harping on this, but even if I say
- 15:58Speaker 2: my pain, holler a tent of ten, you cannot take
- 16:01Speaker 2: off my skin.
- 16:01Speaker 1: Yeah. So that's so.
- 16:03Speaker 2: Gino says, is Marco's reaction typical? And she says, no,
- 16:06Speaker 2: it's not typical. But there are things that he could
- 16:09Speaker 2: have done that could have affected his hair removal. Was
- 16:11Speaker 2: he out in the sun before his appointment, did he
- 16:13Speaker 2: go out drinking the night before? Did he go to
- 16:16Speaker 2: tanning bed for an extended period of time. These things
- 16:18Speaker 2: would make that happen that are not necessarily the wax
- 16:23Speaker 2: being too hot? Interesting okay, So he asked Marco, were
- 16:28Speaker 2: you drinking, taking beds or at the beach beforehand?
- 16:30Speaker 1: Marcus says, no, your honor, So you need to tell
- 16:32Speaker 1: me if you've been drinking. Your skin can get ripped off?
- 16:36Speaker 1: Could it could be could affect the waxing process. So
- 16:41Speaker 1: here's where things get a little murky. Elizabeth has a
- 16:44Speaker 1: disclosure form and a witness with her. Uh uh. The
- 16:47Speaker 1: disclosure form asked the following questions, Uh, have you been
- 16:51Speaker 1: exposed to the sun or considering spending more time in
- 16:54Speaker 1: the sun soon? He put no.
- 16:56Speaker 2: Are you exposed to the sun regularly for your job?
- 16:59Speaker 2: He put no, he's a technician.
- 17:01Speaker 1: Did you use a tanning bed recently for an extended
- 17:04Speaker 1: period of time? He said no. Did he use a
- 17:07Speaker 1: tanning bed because he wanted to be tanned for Debbie? Yes? Ah.
- 17:11Speaker 1: Elizabeth A brings in a witness. See, you don't come
- 17:15Speaker 1: across many debbies that you don't listen. Listen a guy
- 17:18Speaker 1: like me, So he said no to all those things.
- 17:21Speaker 1: The witness comes in and says she was in the
- 17:23Speaker 1: waiting room with him. She overheard him on the phone
- 17:25Speaker 1: saying specifically he had just gone to the tanning bed. Oh,
- 17:30Speaker 1: so he went the appointment to wax, saying, man, Debbie
- 17:34Speaker 1: must have been really something.
- 17:36Speaker 2: Jim tan rip your skin off. Marco was like, I
- 17:41Speaker 2: didn't have time to read that whole question he or
- 17:42Speaker 2: they were dragging me back there. I to signed it
- 17:44Speaker 2: so quickly they rushed me through the process. Elizabeth said,
- 17:47Speaker 2: you're on our esthetician tested the wax on his skin
- 17:52Speaker 2: and asked if it was too hot. He said, no,
- 17:55Speaker 2: Judge Gina is ready to rule.
- 17:57Speaker 1: Listen, I ten, my experience with TV courtroom shows that
- 18:04Speaker 1: questionnaire that that legally binding contract is all you need here.
- 18:09Speaker 1: He wasn't forthcoming about the fact that he had just
- 18:13Speaker 1: come from the tanning bed, and so to me, this
- 18:18Speaker 1: the the ownership here falls on his shoulders because he
- 18:23Speaker 1: wasn't honest. The judge gino fricking if I know. I
- 18:28Speaker 1: don't know, man, but I'm gonna go with my guy
- 18:31Speaker 1: and I'm gonna say he doesn't deserve any money. He
- 18:35Speaker 1: went to the tanning bed. He did not read through
- 18:37Speaker 1: the documentation and listen, even if what he is saying
- 18:41Speaker 1: is true about them rushing and rushing him back. You
- 18:44Speaker 1: are filling out a legally binding contract. You tell them
- 18:48Speaker 1: to wait, let me read through this. But like most people,
- 18:52Speaker 1: especially us men, we don't typically read through it. All
- 18:56Speaker 1: that's on us one. He does, you get a dime?
- 19:01Speaker 1: You think that wouldn't branle Come on, come on, Gino,
- 19:09Speaker 1: You can't. Can't You have to do two things blah
- 19:14Speaker 1: blah blah. Prove the defendant was wrong, the wrong cause
- 19:16Speaker 1: by injuries blah blah blah, fifty percent or more. You
- 19:17Speaker 1: get it.
- 19:19Speaker 2: He says, you have a responsibility to take care of
- 19:20Speaker 2: yourself long before you look to someone else for care.
- 19:23Speaker 2: And part of that is being truthful on a form.
- 19:25Speaker 2: Who do you have all the time in the world
- 19:26Speaker 2: to fill out that form. The other part of anything
- 19:30Speaker 2: in this realm I don't remember what we said, is
- 19:32Speaker 2: professional judgment. It is why an esthetician has to be licensed.
- 19:38Speaker 2: The esthetician did not put the wax on her own arm.
- 19:43Speaker 2: We had a witness come in and say, the esthetician
- 19:45Speaker 2: practice is to put the wax on your own arm.
- 19:48Speaker 2: The esthetician didn't do that. Her professional judgment is not
- 19:52Speaker 2: relieved based upon his personal misrepresentation. You still must exercise
- 19:58Speaker 2: professional judgment and determin whether the wax is too hot
- 20:01Speaker 2: or not. This is your fault. He gets it all,
- 20:05Speaker 2: he gets it all. This guy tanned all morning, went
- 20:10Speaker 2: to get hair waxed off, lied on the form and
- 20:13Speaker 2: is getting eighty thousand dollars.
- 20:16Speaker 1: I'm done with Gino. I'm done with him. You said
- 20:18Speaker 1: it so many times. You'll be going back next week.
- 20:22Speaker 1: I'm done. Wow, you can't, you can't, you can't. So
- 20:28Speaker 1: because one ecstasis esthetician eespetitian estetian esthetician that's right, comes
- 20:36Speaker 1: in and says that she's supposed to put it on
- 20:38Speaker 1: her arm. That that's it. The esthetician didn't exercise professional judgment.
- 20:44Speaker 1: You should. It's like giving a tattoo. If someone's drunk,
- 20:47Speaker 1: like or or serving as someone that's been overserved, you
- 20:51Speaker 1: should have professional judgment. And if you didn't follow the rules,
- 20:53Speaker 1: then it's your professional judgment. My problem is is that
- 20:56Speaker 1: it was tested. Yeah, and he lied on the form
- 20:59Speaker 1: by his own own a mission like in court says yeah,
- 21:01Speaker 1: I went to the taming bit. Yeah, that's the killer
- 21:04Speaker 1: for me. I'm one hundred percent with you know is wrong. Listen,
- 21:06Speaker 1: if if you were to show me paperwork or something
- 21:11Speaker 1: that from this salon that says, here are the steps
- 21:15Speaker 1: by step, and the step by step is to put
- 21:17Speaker 1: it on your skin and not the skin of the
- 21:19Speaker 1: person that you're doing. That would be something. We have
- 21:21Speaker 1: one expert that comes in and says, here's how I
- 21:24Speaker 1: do it, and that's the end. All be all crazy crazy, Yeah,
- 21:30Speaker 1: only night next time, another one till then all rise,
- 21:33Speaker 1: Get out, Get out Yo. Gabble Gabos, the Bramble Jam
- 21:36Speaker 1: Podcast produce fire and Shamee. The Bramble Jam Podcast Network
- 21:38Speaker 1: studio is a Greenville, South Carolina holes on the socials
- 21:40Speaker 1: at Yogaba Gabble. We never post there. Go to bramble
- 21:42Speaker 1: jamp plus dot com to listen to these episodes early
- 21:45Speaker 1: and add free.
- 21:47Speaker 2: Leave us a rating review on Apple and SIDS five
- 21:48Speaker 2: by as soon as you possibly can.
- 21:49Speaker 1: Please please, please, fricking ridiculous. You're about to hear some
- 21:56Speaker 1: ads that helped keep the lights on here in the
- 21:58Speaker 1: old studio. Thanks for listening or don't listen. It's really
- 22:03Speaker 1: up to you at this point. It's at the end
- 22:06Speaker 1: of the show. I mean, you're listening to me, Hi,
