- 0:10Speaker 1: Facts comment all causes of action. Plaintiff Jane Doe repeats
- 0:14Speaker 1: and re-alleges the above allegations that the occurrence complained of
- 0:18Speaker 1: herein took place within the Chi Phi National Chapter Fraternity
- 0:22Speaker 1: House located upon Cornell's campus. at the address given where
- 0:27Speaker 1: Plaintiff was drugged and raped by multiple members of Chi
- 0:30Speaker 1: Phi's national fraternal organization. At all relevant times, Plaintiff was
- 0:35Speaker 1: attending Cornell as a full-time undergraduate student and was residing
- 0:40Speaker 1: on Cornell's campus with Tri-Delta's national Alpha Beta Chapter sorority house.
- 0:45Speaker 1: On the evening of October 19th, 2024, into the morning
- 0:47Speaker 1: of October 20th, 2024, Plaintiff Doe was the victim of
- 0:48Speaker 1: one or more criminal sex acts at the hands of
- 0:56Speaker 1: defendant Ingalls, Newell, Lees, Lopez, Sarabia, Norris, and Kretschmar. Plaintiff
- 1:02Speaker 1: Doe was in a very vulnerable situation when she was
- 1:04Speaker 1: sexually assaulted by defendant Ingalls, Newell, Lee, Lopez, Sarabia, Norris,
- 1:10Speaker 1: and Kretschmar, of which the student defendants were fully aware.
- 1:14Speaker 1: On October 19th, 2024, Tri Delta Nationals Alpha Beta Chapter
- 1:18Speaker 1: was hosting a social event at Mooney's Bar and Nightclub.
- 1:22Speaker 1: On October 19th, 2024, Prior to the event at Mooney's,
- 1:26Speaker 1: Plaintiff consumed Tito's vodka with Tri-Delta National Alpha Beta Chapter
- 1:30Speaker 1: Sorority House, located on the campus. Thereafter, around 8.30 p.m.,
- 1:36Speaker 1: Plaintiff took an Uber from Alpha Beta Chapter Sorority House
- 1:39Speaker 1: on Cornell's campus to Mooney's Bar and Nightclub, accompanied by
- 1:43Speaker 1: the Chapter Sorority House mother, Jade. When Plaintiff arrived at
- 1:47Speaker 1: Mooney's around 9 p.m., the bouncer placed an X on
- 1:50Speaker 1: each of her hands. to signify that she was under
- 1:53Speaker 1: 21 years old. Despite having underage marks on her hands,
- 1:57Speaker 1: Plaintiff was served and consumed at least one alcoholic beverage
- 2:01Speaker 1: at Mooney's. Within Mooney's, Tri-Delta's National Alpha Beta Chapter had
- 2:06Speaker 1: designated sober monitors tasked with ensuring the safety and well-being
- 2:09Speaker 1: of attendees and monitoring their fellow sorority sisters for signs
- 2:14Speaker 1: of excessive intoxication and or disruptive behavior. Around 10 p.m.,
- 2:18Speaker 1: Plaintiff and other sorority sisters left the event at Mooney's
- 2:22Speaker 1: and walked to another bar nearby, known as Lot 10
- 2:25Speaker 1: Bar and Lounge, located at 106 Cayuga, Ithaca. At Lot 10,
- 2:32Speaker 1: Plaintiff was given an under-21 wristband. Around 11 p.m., Plaintiff
- 2:36Speaker 1: decided to leave Lot 10 and stumbled alone to Chi
- 2:39Speaker 1: Phi National Chapter Fraternity House on Cornell's campus. When Plaintiff arrived...
- 2:46Speaker 1: and was led into the chapter fraternity house by three
- 2:48Speaker 1: or four members of the fraternity who had been standing
- 2:51Speaker 1: by the front door. Therein, plaintiff saw defendant Ingalls, who
- 2:55Speaker 1: greeted plaintiff and gave her a beer. Plaintiff and defendant
- 2:58Speaker 1: Ingalls then danced together in the main room of the
- 3:01Speaker 1: fraternity house. After dancing, defendant Ingalls pulled plaintiff off to
- 3:05Speaker 1: a quieter area and propositioned her with having a threesome
- 3:09Speaker 1: with her and another one of his fraternity brothers. In
- 3:12Speaker 1: her drunken state, plaintiff was incapable of consenting to the proposition,
- 3:17Speaker 1: Despite being incapable of consent, defendant Ingalls then led plaintiff
- 3:21Speaker 1: to the upstairs of the fraternity house and left her
- 3:25Speaker 1: with Alex Vega, another chapter member. After speaking with Alex
- 3:29Speaker 1: for some time, defendant Ingalls returned and led plaintiff to
- 3:32Speaker 1: another room down the hall where defendant Newell was sitting
- 3:35Speaker 1: on a couch. While on the couch, defendant Ingalls and
- 3:39Speaker 1: Newell began passing around a plastic bag containing a white
- 3:42Speaker 1: powdery substance claimed to be ketamine. a disassociative anesthetic with
- 3:47Speaker 1: hallucinogenic properties. Defendant Ingalls and Newell then pressured plaintiff into
- 3:52Speaker 1: snorting the alleged ketamine with them, a drug she had
- 3:55Speaker 1: never done before. During this time, Defendant Ingalls and Newell
- 3:59Speaker 1: also applied plaintiff with marijuana and Jamaican liquor, believed to
- 4:03Speaker 1: be some type of high-proof rum. Soon after, Defendant Ingalls
- 4:07Speaker 1: and Newell began engaging in sexual acts with plaintiff, all
- 4:10Speaker 1: without her consent. During the assault, Defendant Ingalls forced oral
- 4:14Speaker 1: sex on plaintiff while defendant Newell forced vaginal intercourse on
- 4:18Speaker 1: her from behind. Throughout the assault, defendant Newell slapped plaintiff
- 4:22Speaker 1: on the buttocks multiple times, resulting in bruising. At one point,
- 4:26Speaker 1: defendant Ingalls could no longer maintain an erection, so he
- 4:29Speaker 1: stopped participating and told the other two that he's going
- 4:32Speaker 1: to take a nap and proceed to get up, move
- 4:34Speaker 1: to the bed and sleep. Defendant Newell then began reaching
- 4:38Speaker 1: for her vagina with his hand multiple times, and each
- 4:41Speaker 1: time plaintiff pushed his hand away. Soon after, Defendant Lopez
- 4:46Speaker 1: entered the room, grabbed Plaintiff away from Defendant Newell, and
- 4:49Speaker 1: began kissing her, while Defendant Newell groped her from behind,
- 4:52Speaker 1: specifically reaching for her vagina. Defendant Lopez and Newell then
- 4:57Speaker 1: placed Plaintiff on a bed, and the two men began
- 4:59Speaker 1: having sex with Plaintiff, initiating another assault, all without Plaintiff's consent.
- 5:05Speaker 1: At approximately 1.42am, Defendant Newell sent a message into the
- 5:10Speaker 1: chapter's member Snapchat group, entitled KaiPaiActives, in which the active
- 5:15Speaker 1: fraternity members are present, claiming that there was free pussy upstairs,
- 5:19Speaker 1: referring to plaintiff thereafter. In doing so, defendant Newell organized
- 5:25Speaker 1: and encouraged other chapter members to join in on the
- 5:28Speaker 1: gang rape of plaintiff in the chapter fraternity house. At
- 5:32Speaker 1: this point, multiple other members of the chapter entered the
- 5:35Speaker 1: room and plaintiff retreated under the covers of the bed
- 5:38Speaker 1: to hide her naked body from the frat men. Soon after,
- 5:41Speaker 1: defendant Sarabia approached plaintiff, grabbed her face, and started kissing her,
- 5:45Speaker 1: all without consent, and plaintiff pushed them away. At that point,
- 5:49Speaker 1: plaintiff's phone was on the other side of the room,
- 5:52Speaker 1: and she felt as if there was no way for
- 5:54Speaker 1: her to escape this room full of predatory fraternity men.
- 5:58Speaker 1: Defendant Newell then poured a line of ketamine on his
- 6:00Speaker 1: erect penis and commanded that plaintiff snort it off, which
- 6:03Speaker 1: he did. Defendant Newell then got on the bed with
- 6:07Speaker 1: plaintiff and began groping her and reaching for her vagina again.
- 6:11Speaker 1: While plaintiff was lying on her back on the bed,
- 6:14Speaker 1: defendant Ingalls, Newell, Lee, Lopez, Sarabia, Norris, and Kretschmar then
- 6:19Speaker 1: began pouring lines of ketamine all over her body and
- 6:21Speaker 1: snorting them. Eventually, defendant Newell, Lopez, Sarabia, Norris, and Kretschmar
- 6:27Speaker 1: decided to exit the room, and plaintiff was removed by
- 6:29Speaker 1: defendant Ingalls and Lee to another, smaller room, believed to
- 6:33Speaker 1: be the fraternity president's office. Once inside, defendant Ingalls and
- 6:37Speaker 1: Lee made more lines of ketamine and instructed plaintiff to
- 6:40Speaker 1: snort one, which he did. By this point, plaintiff was
- 6:44Speaker 1: completely incapacitated. Thereafter, defendant Ingalls and Lee initiated another assault
- 6:50Speaker 1: of plaintiff, forcing oral and vaginal sex upon her simultaneously.
- 6:55Speaker 1: At around 5.45 a.m., this assault concluded and plaintiff lost consciousness.
- 7:01Speaker 1: When plaintiff awoke later that day, on October 20th, 2024,
- 7:05Speaker 1: plaintiff returned to her residence within the Alpha Beta Chapter
- 7:08Speaker 1: sorority house. At this point, plaintiff was in a state
- 7:12Speaker 1: of shock. At her residence, plaintiff noticed a large bruise
- 7:16Speaker 1: and formed on her buttocks and took preemptive medication for
- 7:19Speaker 1: a urinary tract infection. Later that day, plaintiff became aware
- 7:23Speaker 1: of what happened to her at the house the previous
- 7:26Speaker 1: night and it was becoming public knowledge on Cornell's campus.
- 7:31Speaker 1: With the encouragement of her friends, on or about November 8th, 2024,
- 7:35Speaker 1: plaintiff reported the incident to Cornell's private police force, known
- 7:39Speaker 1: as Cornell University Police Department, located in Cornell. On or
- 7:45Speaker 1: about November 8, 2024, the chapter was placed on a
- 7:48Speaker 1: temporary suspension for alleged violations of the Student Code of Conduct.

- 8:36Speaker 1: Cornell commenced a Title XI investigation in response to plaintiff's
- 8:41Speaker 1: formal complaint filed with Cornell's Title XI coordinator. From May 2,
- 8:46Speaker 1: 2025 up and through May 29, 2025, Cornell's Title XI
- 8:52Speaker 1: office conducted numerous, at least 12, hearings regarding plaintiff's allegations herein.
