- 0:46Speaker 1: anyway from me. You didn't not tell him? Now get home,
- 0:51Speaker 1: but God get hold I rove l h lies. Oh
- 1:15Speaker 1: somebody done me wrong? On me from me wrong. After
- 1:21Speaker 1: the syling of.

- 1:45Speaker 2: show starts in line eight seven six five four shoot.
- 2:05Speaker 1: Cool, good evening, Good evening, and welcome to another episode
- 2:20Speaker 1: of Let's Talk About It. I am your Hostnett Johnson.
- 2:24Speaker 1: I know it's been a while since we since you
- 2:28Speaker 1: guys seen me on here. I've been having so much
- 2:33Speaker 1: going on with school and working, so I haven't been
- 2:41Speaker 1: able to come on as regular as I would like.
- 2:46Speaker 1: Today's segment on Let's Talk About It, we will be
- 2:52Speaker 1: talking about post conviction scams and how can came up
- 3:00Speaker 1: with this The topic for the show. Well, the discussion
- 3:06Speaker 1: discussing of the show tonight was that I was on
- 3:10Speaker 1: social media one day and I came across this this
- 3:18Speaker 1: advertisement advertising for relief with post conviction that if you
- 3:28Speaker 1: have a family member that's going through that's in prison,
- 3:34Speaker 1: and they looking for relief with post conviction that they
- 3:37Speaker 1: would you know, look over the case and they would
- 3:42Speaker 1: get it, you know, handle the paperwork. And then you
- 3:47Speaker 1: have family members on their asking did they have have
- 3:52Speaker 1: anybody ever heard of this person or dealt with this
- 3:58Speaker 1: person and the only how you can get in contact
- 4:02Speaker 1: with them was through email are texts. So I said, hmm,
- 4:12Speaker 1: we need to bring awareness to this because I never
- 4:20Speaker 1: ever heard of a lawyer or a paralegal state that
- 4:32Speaker 1: to contact them through email our text message. So that's
- 4:38Speaker 1: what I want to discuss because there's millions of people
- 4:42Speaker 1: that's going through post conviction that has been wrongfully convicted,
- 4:47Speaker 1: and a lot of family members that's trying to find
- 4:51Speaker 1: relief to get to help get their family members back
- 4:56Speaker 1: in court to have their cases overturned. So that's what
- 5:02Speaker 1: my that's what the discussion is going to be today.
- 5:06Speaker 1: I'm not going I probably may not be on here
- 5:11Speaker 1: long because I need to get some homework did and
- 5:16Speaker 1: I need to get some rest cause, like I said,
- 5:19Speaker 1: I've been working two jobs and my main du the
- 5:25Speaker 1: one that I just got off of just morning at
- 5:30Speaker 1: nine o'clock in the morning. I work ten hour shifts,
- 5:33Speaker 1: so you know, I'm a little tired, so let's get
- 5:37Speaker 1: into this post. Conviction refers to a process that happened
- 5:43Speaker 1: after a person has already been convicted in court. This
- 5:51Speaker 1: may includes appeal, motion, petitions, sentence challenges, innocent claim, you know,
- 6:01Speaker 1: whatever it may be. I don't know what stage that
- 6:06Speaker 1: your loved one is in, but I do know you
- 6:11Speaker 1: don't text and you don't email no paperwork to nobody,
- 6:21Speaker 1: absolutely nobody. My husband, he was sharing with me because
- 6:29Speaker 1: as you know that he's incarcerated in Denver wrongfully and
- 6:36Speaker 1: when yes, we're still fighting and hopefully we'll have some
- 6:40Speaker 1: we're having we'll have some good news for you guys soon.
- 6:44Speaker 1: But I can share that the Innocent Project, the Corey
- 6:49Speaker 1: Wise Foundation is working with him and has been working
- 6:54Speaker 1: with him for the last two going on three years.
- 7:01Speaker 1: Also we had some good news coming out of Denver
- 7:09Speaker 1: my memes. He was one of the first ones that
- 7:15Speaker 1: I talked to when I started the podcast, and he
- 7:19Speaker 1: came on as he was seeking He wanted to tell
- 7:24Speaker 1: his story how he has he was incarcerated as a
- 7:29Speaker 1: juvenile and he had medical and what was going on
- 7:34Speaker 1: with him receiving medical care. He has since been released.
- 7:42Speaker 1: I think he did, like twenty plus years and he
- 7:49Speaker 1: is home now. Good evening, ms Elma, thank you for
- 7:54Speaker 1: tuning in in. Also Glenn Kemp, he has not been
- 8:06Speaker 1: released yet, but he he has a lawyer that's working
- 8:14Speaker 1: with his case because the d A forensic scientists. I
- 8:21Speaker 1: believe Missy Woods is on the investigating her because she
- 8:29Speaker 1: had did some things with then you know, lied about
- 8:39Speaker 1: DNA is in these in a lot of people cases,
- 8:44Speaker 1: misleading the jury. It's so much so now she's under investigation.
- 8:52Speaker 1: So every case that she works worked on is i'll
- 8:59Speaker 1: see it's is under investigation. So he received a letter
- 9:07Speaker 1: stating that they're looking into his case since she works
- 9:11Speaker 1: on it. And it was a quite a few people
- 9:15Speaker 1: cases in Denver that Missy Woods worked on that received letters.
- 9:20Speaker 1: One that case that I know of so far has
- 9:24Speaker 1: been overturned and he has been since res resentenced. We
- 9:31Speaker 1: have another one, Glenn Gilbert. He been incarcerated wrongfully for
- 9:47Speaker 1: thirty like I believe thirty plus years he have been
- 9:53Speaker 1: since they granted clemency. But we gonna I'm gonna tell
- 10:01Speaker 1: you a little more about his case and his clemency
- 10:07Speaker 1: a little later after we finished this post conviction, so
- 10:13Speaker 1: I just wanted to reenterate. Do not ever send legal
- 10:20Speaker 1: mail to anyone families listen to anyone without doing your research.
- 10:31Speaker 1: You can go and check if they first, we want
- 10:35Speaker 1: to ask them for their if they claiming at their
- 10:40Speaker 1: lawyers or pair of legals, We're going to ask them
- 10:48Speaker 1: for their bar number, anything that we can go at
- 10:54Speaker 1: any number that they have so we can research to
- 11:00Speaker 1: make sure that they're legit. Because we're not sending no
- 11:05Speaker 1: more money out to anyone that just claims that, oh
- 11:12Speaker 1: I can do paperwork. You know, you have a lot
- 11:14Speaker 1: of people that's in prison. I'm sorry, you have a
- 11:18Speaker 1: lot of people that's in prison that some know how
- 11:25Speaker 1: to do the paperwork, and some would take just out
- 11:30Speaker 1: they know that the family's out there just looking for
- 11:32Speaker 1: the release. They would just you know, have a family
- 11:36Speaker 1: member or somebody come on and act to be act
- 11:40Speaker 1: like they know up here legal or oh I can
- 11:42Speaker 1: do the paperwork for you and just send me this
- 11:46Speaker 1: amount of money. Now them days is over. We know
- 11:51Speaker 1: how much that you want to give relief for your
- 11:54Speaker 1: family member that's incarcerated. ODO too, but we're gonna start
- 12:01Speaker 1: going through the proper channels. You know, we don't have
- 12:07Speaker 1: money like that just to give to anyone. And then
- 12:11Speaker 1: the people don't you know, they're not who they are.
- 12:16Speaker 1: You know. I read that one of the family said
- 12:20Speaker 1: that when they went to court, the judge laughed and
- 12:26Speaker 1: was like, the paper look, the paperwork looked like someone
- 12:30Speaker 1: in kindergarten felt this out. You know, if you see
- 12:37Speaker 1: that the legal forms are not being filled outright, don't
- 12:43Speaker 1: go to court just to have the judge to tell
- 12:46Speaker 1: you something like that. And now you mad and upset
- 12:51Speaker 1: that you don't give this person almost one thousand dollars
- 12:55Speaker 1: or whatever it may be to do some paperwork and
- 13:00Speaker 1: it's not done right and it doesn't look professional, or
- 13:06Speaker 1: it's done on a piece of notebook paper. No, we're
- 13:11Speaker 1: not doing that. So we're gonna we're gonna investigate. We're
- 13:18Speaker 1: gonna do our research from now on. We do we
- 13:25Speaker 1: if we sit it on Facebook and they saying text
- 13:29Speaker 1: or email your email the paperwork, let me look over
- 13:33Speaker 1: the look over their cases. No, we're not doing that.
- 13:38Speaker 1: We're gonna do research to make sure we know that
- 13:41Speaker 1: them people are who they are who they are. We
- 13:47Speaker 1: got gas prices going up, we got food going up,
- 13:50Speaker 1: we got so much stuff going up now, we can't
- 13:55Speaker 1: afford just to give away money. So you know, let's
- 14:01Speaker 1: let's family, let's do our research. You know, sometimes we
- 14:08Speaker 1: go about word of mouth. Okay, even if somebody dealt
- 14:13Speaker 1: with uh, someone that can do post convictions and stuff,
- 14:19Speaker 1: you still do your research. Everything now is research. Do
- 14:29Speaker 1: your own research. I know, we I mean, we can
- 14:37Speaker 1: get lazy sometimes where we don't want to do it.
- 14:39Speaker 1: We just want to get this person said they can
- 14:43Speaker 1: help our loved ones. No we're not doing that, no more.
- 14:46Speaker 1: We're not doing that no more. If we can't and
- 14:52Speaker 1: we can't find their their numbers through the bar or
- 15:02Speaker 1: or let's see, yep, check it. We're gonna check the
- 15:09Speaker 1: state bar website. If we can't find it there, no,
- 15:14Speaker 1: that's a huge. If we ain't find we ain't finding
- 15:16Speaker 1: nothing on the on the the State Bar Association website
- 15:23Speaker 1: for their license, that's a red flag. We know that
- 15:28Speaker 1: right there. Along will say nah mmm, if you need
- 15:34Speaker 1: me to help you do some research, contact me, cause
- 15:40Speaker 1: I love doing research on this stuff. If their full
- 15:46Speaker 1: name does not match, if they're using something, oh my
- 15:53Speaker 1: my friends allowing me to use their license, No, we're
- 15:57Speaker 1: not doing that we're not using nobody. They can't use
- 16:02Speaker 1: nobody else's number. Everything has to line up, Everything has
- 16:09Speaker 1: to line up. If they don't have no office address
- 16:14Speaker 1: and they say they're out of state, no, we're not
- 16:19Speaker 1: doing that either, because now want we want to sit,
- 16:23Speaker 1: come and sit and talk face to face. We're not
- 16:30Speaker 1: sending none through email, text, message, mail, photocopy, whatever, whatever
- 16:40Speaker 1: how they send the paper. We're not doing that no more.
- 16:45Speaker 1: We have to stop being so trustworthy. We love them
- 16:52Speaker 1: and we are trying to get them home, but we
- 16:54Speaker 1: have to protect them and protect ourselves as well, because
- 16:59Speaker 1: we don't know who well, you don't know who you
- 17:03Speaker 1: sending them papers to. You don't know who that and
- 17:08Speaker 1: in many of their cases are very sensitive. You have
- 17:16Speaker 1: one shot. With post conviction, you don't have as many shots.
- 17:24Speaker 1: You only have one shot to get it right, to
- 17:31Speaker 1: get them back in court. And if that and if
- 17:36Speaker 1: you mess up that one shot, you gonna have to fight.
- 17:44Speaker 1: And we all know that this justice system is not fair.
- 17:50Speaker 1: It's not fair to the to our men exploit, especially
- 17:57Speaker 1: the black men. Do your research, Do your research on
- 18:09Speaker 1: these people when they time, when it's time for payment,
- 18:17Speaker 1: how do you want to see we don't do We
- 18:19Speaker 1: don't do cash at we do not do PayPal. We
- 18:23Speaker 1: do not do Venmo. If you can't send them, if
- 18:31Speaker 1: you can't deliver them a check from your bank, our
- 18:42Speaker 1: credit union where you have paper trail, we don't do that.
- 18:49Speaker 1: You want to be conscious of sending money through the
- 18:54Speaker 1: apps because, as you know, some of them won't give
- 18:59Speaker 1: you back your money. US is gone and it's hard
- 19:02Speaker 1: to trace. And that's how scammers get away with your money.
- 19:11Speaker 1: They're close that account and now you you out of money.
- 19:16Speaker 1: So be cautious of that. Be cautious of how we're
- 19:21Speaker 1: gonna I'm gonna keep repeating myself becauseus of how they
- 19:24Speaker 1: asked you to send the paperwork. No, we're sitting down.
- 19:29Speaker 1: We're gonna'm gonna walk this into you. I see you know,
- 19:35Speaker 1: I see it on social media, hundreds of people. It's
- 19:42Speaker 1: hundreds of comments. I want you, I need your help.
- 19:47Speaker 1: I'm interested, and the person is, oh, text me send
- 19:53Speaker 1: the paperwork through email, and you have people, Well, I
- 19:58Speaker 1: live over here in Iowa. Can you help me?
- 20:03Speaker 2: Yeah?
- 20:04Speaker 1: Where are you at? Oh, I'm over here in Georgia. No,
- 20:08Speaker 1: we need to be in the same state. We need
- 20:14Speaker 1: to be in the same state. You need to be
- 20:17Speaker 1: able to make sure that they are licensed and they
- 20:23Speaker 1: can practice in the state that you are in. Even
- 20:31Speaker 1: if you even if they have a little storefront, Oh,
- 20:36Speaker 1: you can meet me over here because you can rent
- 20:39Speaker 1: a little storefront. Throw something up real quick and take something. No,
- 20:42Speaker 1: we're still gonna We're still investigating. Like I said, they
- 20:50Speaker 1: have one shot to get this paperwork right, and it
- 20:56Speaker 1: goes before the judge and and some you know, so
- 21:00Speaker 1: a lot of cases the judge will deny it, and
- 21:05Speaker 1: that's it. That's it. I'm just telling you what I
- 21:14Speaker 1: was told for men that are incarcerated, that you have
- 21:21Speaker 1: one shot with your post conviction and then after that
- 21:30Speaker 1: you have to fight. You have to find ways you
- 21:33Speaker 1: have to They now they're in the up law off
- 21:37Speaker 1: the law library, looking up cases, trying to come up
- 21:41Speaker 1: with stuff to get before the judge because someone that
- 21:48Speaker 1: the family trusted or they trusted to do their post
- 21:54Speaker 1: conviction relief to get before the court. So today, family,
- 22:01Speaker 1: I'm asking you guys, please please through your research on
- 22:08Speaker 1: these people. If we don't have money to throw away,
- 22:12Speaker 1: no more, we don't. They want to come home and
- 22:18Speaker 1: these men's is doing and women are doing thirty plus years.
- 22:26Speaker 1: They're sitting behind the bar. It's thirty plus years wrongfully,
- 22:35Speaker 1: and we're not doing that no more. We're checking license
- 22:41Speaker 1: number with the state bar. Federal you go through, I
- 22:49Speaker 1: believe you're going through federal anything. We're checking licenses. We
- 22:57Speaker 1: checking making sure that name match with their life license.
- 23:01Speaker 1: We're making sure that they're in our states and that
- 23:05Speaker 1: they can practice there, and that they know the law
- 23:13Speaker 1: and that this law can help my loved one out
- 23:22Speaker 1: word of mouth. Were still checking them out. As somebody say,
- 23:28Speaker 1: oh Becky Sue can help you, or Willie Ray or
- 23:34Speaker 1: whoever can help you, were still gonna check them out.
- 23:42Speaker 1: Don't just go off of what I'm saying you guys,
- 23:47Speaker 1: please do your research. I'm seeing in it on social
- 23:53Speaker 1: media where they coming out of the woodworks. I have
- 23:59Speaker 1: somebody and they thought I was crazy that that said,
- 24:07Speaker 1: oh you know, I can help your husband out. And
- 24:10Speaker 1: you know what I did. I let that person talk.
- 24:15Speaker 1: I let them talk because one thing you not gonna do.
- 24:19Speaker 1: You not fins to play with me and minds, that's
- 24:22Speaker 1: what you're not gonna do. I like to do research.
- 24:27Speaker 1: I like standing up all night, even when I'm even
- 24:33Speaker 1: when I'm at work and I have some downtime, I
- 24:37Speaker 1: am doing research to see who this person is, to
- 24:41Speaker 1: make sure this person is who they say they are.
- 24:47Speaker 1: Because when my husband say, hey, we only got one
- 24:51Speaker 1: shot at this, I'm gonna make sure that this is
- 24:55Speaker 1: my best shot, this is our best shot, and we
- 25:02Speaker 1: gonna do I mean, we we gotta, we gotta wake up.
- 25:09Speaker 1: And yes, we're we're so trustworthy because we want our
- 25:13Speaker 1: loved ones song, we want a home. We w I mean,
- 25:19Speaker 1: I know, I know, I know how you feel. Some
- 25:26Speaker 1: of you guys probably saying, oh, she don't know how
- 25:27Speaker 1: I feel because they got the Innocent Project. Baby, do
- 25:33Speaker 1: you know what it took to get the Innocent Projects?
- 25:38Speaker 1: How many letters that my husband had to write until someone, finally,
- 25:47Speaker 1: a student finally looked at his case and was reading
- 25:51Speaker 1: his case and was like, hey, we need to we
- 25:56Speaker 1: need to look into this. So now you know, I
- 26:01Speaker 1: fly to fly over there when I go to Denver,
- 26:07Speaker 1: and I sit down and I talk to his defense
- 26:10Speaker 1: team to see where we're at. And yet we we
- 26:14Speaker 1: we have some good news and hopefully we have any
- 26:18Speaker 1: We have more news than I can share with you guys.
- 26:22Speaker 1: But I just wanted to come on here and tell
- 26:26Speaker 1: you guys, please please be aware of these people that
- 26:32Speaker 1: out that's out here saying that they can help you
- 26:36Speaker 1: with post come with your loved one's post conviction, because
- 26:42Speaker 1: they only have one shot. And you know, I mean,
- 26:48Speaker 1: if we don't have money for these the lawyers, these
- 26:53Speaker 1: big time loisers, and and they're out there charging money
- 26:56Speaker 1: and some even some of the lawyers, it's getting over.
- 27:02Speaker 1: They're not doing what they're what you're paying them for.
- 27:06Speaker 1: I know a man that's coming out of Denver and
- 27:12Speaker 1: his mother paid over ten thousand dollars and didn't get
- 27:20Speaker 1: no release. So you gotta beware of these lawyers. To
- 27:25Speaker 1: do your research on these lawyers just don't start would
- 27:31Speaker 1: stop at one. Oh they my friend said, oh this
- 27:34Speaker 1: one can this this is a good lawyer. No, we're
- 27:38Speaker 1: gonna we're researching everybody, everybody, because some of them would
- 27:49Speaker 1: just get your money and just you know, and my
- 27:53Speaker 1: my heart broke once I found out how much that
- 27:57Speaker 1: mother that lawyer and didn't get no type of relief.
- 28:08Speaker 1: Like I said, they have one shot at this, and
- 28:15Speaker 1: you made sure that this this that one shot that
- 28:19Speaker 1: you're gonna bring him down. And they come and they
- 28:22Speaker 1: walk in free. So lastly, I said, I wanted to
- 28:27Speaker 1: tell you about Gilbert, I mean Jean Gilbert. So I'm
- 28:36Speaker 1: so happy for him. He did thirty plus years wrongfully
- 28:45Speaker 1: and he met with they grant him. They gave him
- 28:49Speaker 1: clemency just last just the other day, and you know,
- 28:58Speaker 1: we're we're happy, you know. But on the other hand,
- 29:09Speaker 1: the governor, it's this lady that was convicted of tampering
- 29:21Speaker 1: with the.
- 29:23Speaker 2: With the.
- 29:25Speaker 1: The voter ballots or voter machines, and they gave her
- 29:34Speaker 1: nine years. So she done did four years. Governor Polish,
- 29:45Speaker 1: he's this is his last term in office in Denver.
- 29:50Speaker 1: He's a Democrat. He granted granted this lady clemency and
- 30:04Speaker 1: she's been released. If she's not already released, she will
- 30:08Speaker 1: be released June first. And you probably saying, you that
- 30:16Speaker 1: what that got dough? We are happy, okay, yeah, but
- 30:19Speaker 1: look at it. We have men and women sitting in
- 30:26Speaker 1: prison wrongfully, and some of them just want to come home.
- 30:32Speaker 1: They just like, okay, you know that we're gonna go
- 30:34Speaker 1: to the governor. We're gonna do this to get clemency.
- 30:38Speaker 1: You would have think after you read these men cases
- 30:47Speaker 1: that asked for clemency, that asked for some type of reliefs,
- 30:51Speaker 1: that did almost for decades. You would have think that
- 30:59Speaker 1: they would be coming home before someone that was guilty
- 31:08Speaker 1: of tampering with voter with the voter things, ballads, machines,
- 31:16Speaker 1: voter machines. Excuse me. Four years within into her sentence,
- 31:24Speaker 1: she was glimed, granted clemency. I don't like, Well, you
- 31:36Speaker 1: people gonna call me whatever you wanna call me. You're
- 31:38Speaker 1: gonna call me ras racist or whatever. Good, good evening, Trevida,
- 31:44Speaker 1: thank you for stopping by. You can you can call
- 31:48Speaker 1: me racist, you can call me whatever you want to
- 31:50Speaker 1: call me. But I'm gonna tell you the truth. People
- 31:56Speaker 1: of color is getting short end. These men, we are
- 32:02Speaker 1: known to serve the longest years. Our men, our women
- 32:07Speaker 1: are known to serve, serve the longest year in prison.
- 32:12Speaker 1: Do your research, set the tip of your finger to
- 32:17Speaker 1: tell you nine years. And she get to come home
- 32:25Speaker 1: in June, and he get to come home. His release
- 32:31Speaker 1: date is next year. We're happy and we're thankful that

- 40:06Speaker 1: and we're tired of these people getting up in office
- 40:09Speaker 1: saying they gonna do this. We're gonna research and we're
- 40:13Speaker 1: gonna put the people in there that's gonna help the
