- Ben: Good morning and welcome to your short-term rental bulletin on the 6th of October. So we're in Ireland today. If you're working to a 14-day rule in Ireland, you are working to a number that was repealed around seven months ago. So since the 1st of March, the planning definition of short-term letting has been letting for quote, a period not exceeding 21 consecutive nights. It came in under section 30 of the residential tenancies. Act of 2026 and was switched on by the statutory instrument of 67 of 2026. The same change deleted the rent pressure zone limit. So short term letting is now a material change of use anywhere in Ireland. Planning and register finally count in the same way and both say 21 nights. Last Tuesday Ireland added the form to go with it. Statutory instrument 500 of 2026 creates Form 24. this accompanies an ordinary application for retention and change of views to short-term letting. The council can come back for further information only on an environmental impact assessment, appropriate assessment or matters raised in public participation and only once. what it does not do is stop enforcement. Section 162, brackets three of the Planning Act says no enforcement action shall be stayed or withdrawn by reason of application for permission of retention. Filing is not a shield and it puts your unauthorised use on a public register. And the government does not agree with itself on this on the deadline. The department says the register opens on the 1st of December and every host must be on it by the 31st of December. The National Tourism Authority which will run it says the registration is not open yet and it will open once necessary legislation has been passed but that bill has not been published. So I think there are two reliefs that are worth knowing about. Towns of 20,000 or fewer get two years to reach planning compliance and there is a presumption in favour of permission where a dwelling has been used continuously for short-term rent. renting within the last seven years with no enforcement action. So the threshold has moved in March and the deadline is still not lost. So make sure you check the number before you're kind of planning around that date. And if you are over 20,000 and under seven years, take this advice this week. Thank you for watching and I'll see you tomorrow.
