- 0:15Kirk Stangy.
- 0:18Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:21The topic is prenuptial agreement pitfalls and this episode today
- 0:26is based on an article on our blog, Tulsa Divorce
- 0:29lawyersblog dot com dated July three, twenty twenty four, and
- 0:35the title of that article is red Flags and a
- 0:38prenuptial Agreement. So, as a follow up to the episode today,
- 0:42going over to that blog and read this article for
- 0:45more information on this topic. Obviously, more and more individuals
- 0:49are interested in prenuptial agreements in this day and age.
- 0:53Some folks even come in and they are already married
- 0:56and they want a post optial agreement. And the idea
- 0:59behind these agreements is that in the instance of a divorce,
- 1:03they'll be protection, the divorce will be easier, it'll be simplified, hopefully,
- 1:08it'll take less time, cost less money and attorney fees.
- 1:13And individuals coming in to let's say a second marriage
- 1:16or a third marriage, something like this a prenuptial agreement
- 1:20can be a great thing because it can protect the
- 1:22assets that they brought into the marriage itself and then
- 1:26maybe deal prospectively with some of the issues that might
- 1:30be out there if a divorce were to occur, you know.
- 1:33The flip end. There are obviously lots of individuals who
- 1:36are still not, you know, really excited about the idea
- 1:40of a prenuptial agreement. That can seem a little bit
- 1:42unromantic to some. Some might feel like this is a
- 1:45forecast that the marriage isn't going to work, and if
- 1:48we're going to be in this and being it together,
- 1:50why do we need a prenuptial agreement. But that said,
- 1:53lots of individuals want these. They're becoming more and more popular.
- 1:58But there are some pitfall. There are some red flags
- 2:01that people have to know if they're interested in getting
- 2:05a prenuptial agreement. And this is what we want to
- 2:08talk about today in this episode. So the listeners can
- 2:12hopefully get legal counsel who's competent and to practice law
- 2:17in their jurisdiction, experienced in drafting prenupsial agreements, and then
- 2:21the hope is that these kinds of issues can be avoided. Okay,
- 2:26problem number one one of the most biggest, one of
- 2:28the most common problems with prenuptial agreements or the rush
- 2:31or the last man in agreements. So individuals decide to
- 2:34get married and then maybe they come to lawyers to
- 2:40get a print up, but it's a short time before
- 2:42the marriage itself. That's troublesome sometimes individuals. Again, it could
- 2:48be a deal where the engagement isn't very long, so
- 2:50they don't have a lot of time out of the gates.
- 2:52But in some instances, individuals might have been engaged a
- 2:56long time and they just kind of sat on this.
- 2:59They didn't understand the urgency to get this done and
- 3:03make it happen. So listeners need to understand that there
- 3:07can be reasons prenuptial agreements can be set aside or
- 3:11not enforced by a court. And some of these reasons
- 3:14are duress, which is one party is under a tremendous
- 3:18amount of pressure to sign this coercion which kind of
- 3:21goes with duress, but it's one party is putting a
- 3:24whole lot of pressure on the other person, and so
- 3:27duress and coercion can be proven at times through a
- 3:32rushed process where a party says to the other, look,
- 3:36I know we're not to get married, and you'd say two, three,
- 3:39four weeks, but you got to sign this print up
- 3:41and we're not getting married. This kind of thing. And
- 3:45of course coercion of duress could take place in other ways.
- 3:48But the closer you get to a wedding date where
- 3:52parties begin the process of trying to get a prenuptial
- 3:54agreement put together, the worse this is. And you know,
- 3:59lots of prent optial agreements will be set aside for
- 4:01the coersion in the duress principles, but the timing can
- 4:06be a big key in a judge determining whether either
- 4:09of those two things have taken place, all right, So
- 4:12better to do a prenuptial agreement as far away from
- 4:15the wedding date as possible, So you can't you know,
- 4:17nobody can give you any definitive time frames like X
- 4:21number of days is okay, but is a general rule
- 4:24further away from the wedding date the better. Obviously, individuals
- 4:28might hear this and they're like, wow, well I don't
- 4:30have a whole lot of time. Now, we can't push
- 4:32back the wedding, So they still do the prent up
- 4:36and go forward with the wedding. But they just have
- 4:38to understand the legal risks that are there. If it's
- 4:42you know, that print up assigned very close to the
- 4:44wedding date, all right, issue too is no legal representation.
- 4:48In order for prenuptial agreement to be enforced, both parties
- 4:51should really have independent legal counsel, right, so they each
- 4:55need their own lawyer. The lawyers cannot work in the
- 4:57same firm and be independent. And both parties need to
- 5:02be advised thoroughly about the provisions and the print up,
- 5:05the clauses, the pros, the cons these kinds of things.
- 5:09And if both parties have a lawyer, that makes these
- 5:13agreements a heck of a lot more enforceable. But if
- 5:17both parties don't have a lawyer, that's not good. If
- 5:19one party doesn't have a lawyer, that's not good either.
- 5:23Both parties really need to get legal counsel and a lawyer.
- 5:27And even if it's a situation where somebody hires a
- 5:29lawyer and that lawyer takes you know, a short period
- 5:32of time to read it and go through the pros
- 5:35and the cons with the individual, that can suffice. But
- 5:39either party not having a lawyer is not good, all right.
- 5:42Vague provisions can be a problem. There's lots of forms
- 5:46out there, form prenupsal agreements, these kinds of things. People
- 5:49want to pull them and use them, and there could
- 5:52be some geneer clauses in there. Individuals just need to
- 5:55be careful. The provisions in a print up need to
- 5:59be clear on its face. They need to be carefully drafted.
- 6:04There shouldn't be ambiguities in there. There shouldn't be stuff
- 6:07that's up to a lot of judicial interpretation. And so
- 6:11having a lawyer draft a prent up in a way
- 6:15that's specific, that's clear, that's detailed, is a good thing.
- 6:20In Vague provisions, on the other hand, are definitely red
- 6:24flags or pitfalls and things obviously to avoid, all right.
- 6:29Problem for is impossible or immoral provisions. So sometimes in
- 6:35prenuptial agreements, you know, unusual clauses might be put in there,
- 6:41clauses that try to dictate too much day to day life.
- 6:45There could be provisions in there that are deemed to
- 6:47be unconscionable or may be illegal. These kinds of things
- 6:53can all be problematic. So you know, in short, you know,
- 6:56sometimes individuals can overreach, and these prenuptial agreements put clauses
- 7:01in that are moral that really try to govern day
- 7:06to day life in a marriage, which isn't a good thing.
- 7:09And maybe some of the clauses might even be impossible.
- 7:14And you know, the more stuff that's like this at
- 7:17a prenuptial agreement, the greater the chance that can be
- 7:20set aside. So this is something to be very careful
- 7:24with and make sure lawyers aren't overreaching in terms of
- 7:28the clauses in a prenuptial agreement. All right, Problem five
- 7:31is more protection for one spouse, So prenuptial agreements really
- 7:35need to be balanced. In other words, both parties need
- 7:39to gain something from the prenuptial agreement in some way.
- 7:43So if the prenuptial agreements written in a way, well,
- 7:46once one spouse would be walking away with you know,
- 7:51a great deal, maybe almost all the assets, and the
- 7:54other spouse isn't getting much. Anything that can be that
- 7:58could be really problematic and could result in a prenuptial
- 8:01agreement to be found to be unconscionable. And if it's unconscionable,
- 8:06then a court might not enforce it. So it's important
- 8:10that there'll be a give and take, that the prenuptial
- 8:13agreement result in some way of both individuals benefiting through
- 8:19the agreement itself, and that it not be too one
- 8:21sided where a judge thinks, wow, one person really really
- 8:26came away great and the other party to this marriage
- 8:29is coming away with nothing significant, nothing tangible. That's a problem, okay,
- 8:35And so these prenuptial agreements need to be balanced and
- 8:38people need to be a little bit more generous than
- 8:40maybe they were thinking out of the gates to make
- 8:42sure that when a judges reviewing the prenuptial agreement, they
- 8:45see that both parties are gaining in some way. All right,
- 8:50So other questions out there. What is considered unconscionable in
- 8:54a prenuptial agreement. This is tough because this is really
- 8:58in the eyes of a judge, and a judge would
- 9:00have to make this determination. So if there's a prenup
- 9:03and the divorce is filed, that prent up has got
- 9:05to be filed with the court and then the judge
- 9:08is going to review it. And again, if there's outrageous
- 9:13clauses in terms of morality, or there's clauses that have
- 9:19impossible clauses for people to meet, or more protections are
- 9:25there for one spouse and the other. In other words,
- 9:27one spouse again is walking away with a great deal
- 9:31and the other spouse has a terrible deal. I mean,
- 9:33the more that's out there, the more likely it could
- 9:36be deemed unconscionable. So it's not a deal where anybody
- 9:39can give you cut and dry rules. It's kind of
- 9:42a judge saying I know it when I see it,
- 9:44and this prene up doesn't look fair. Okay, so unconsionable fair,
- 9:50you know. I mean all these terms can make lawyers
- 9:53a little bit uncomfortable because it's you know, it's a
- 9:56balancing test, if you will. But it's important that these
- 10:00prenups be written in a way that's two sided, that
- 10:03both parties gain in some way. All right, what constitutes
- 10:07duress in a prenupsial agreement? Well I covered this a
- 10:10little bit a little bit more before, but again, closer
- 10:16to the wedding date, the more likely a court could
- 10:20think that there's duress. I mean if one party saying
- 10:22things like, well you need to sign this or we're
- 10:24not going to get married, and this is kind of
- 10:27throwing on another person at the last second. That kind
- 10:30of thing, I mean that could definitely be definitely be
- 10:33a bad, bad thing that could result in duress. I
- 10:37mean duress. You're thinking pressure, You're thinking one person's really
- 10:40leaning on the other person, and that the one party
- 10:43doesn't even really want to sign this, doesn't want to
- 10:45do this, but they're getting pressured. Right, there's duress, There's threats,
- 10:49these kinds of things. I mean, the more facts out
- 10:51there like that, the more likely a prenup could be
- 10:56set aside for duress. All right. In terms of what
- 10:59cannot be in looted in a prenuptial agreement, this is
- 11:02question lots of individuals have. The big one is you
- 11:07can't have any clauses in a prenuptial agreement that deal
- 11:10with child custody, child support, or any of these kinds
- 11:13of issues. I mean, when you think about it, I mean,
- 11:16you can't deal with custy of kids that haven't been
- 11:18born yet, child support for kids that aren't born yet.
- 11:22Parties financial states could be very different the years, you know,
- 11:26many years down the road after marriage, So you can't
- 11:29put anything in about child custy or child support. That's
- 11:33stuff that cannot be put in a prenuptial agreement, the
- 11:38alimony or spousal maintenance issues and other big issue. Look
- 11:42in some circumstances, and I'd say a lot of circumstances,
- 11:45parties can put clauses in that where both parties are
- 11:49waiving maintenance or one party's waving maintenance or something like that.
- 11:53But look, in some states it could be problematic, and
- 11:55it could be problematic theoretically based on other provisions of
- 12:00the prenupsial agreement itself. So look, these clauses can be
- 12:04common in prenupsial agreements, and oftentimes they are enforceable, and
- 12:09in some jurisdictions they're enforceable way more often, but there
- 12:13are some jurisdictions where it's just not one hundred percent
- 12:15a right. So individuals need to know that that, you know,
- 12:21there's some ambiguity there in some states in terms of
- 12:24the enforceability of these kinds of clauses. All right, other
- 12:27things that would be you know, problematic at a prenuptial agreement,
- 12:34and let me give you a few more, would be
- 12:36non financial personal preferences that a spouse must adhere to. Right,
- 12:41So these kind of morality clauses. Again, the clauses that
- 12:44govern the day to day living of a married couple,
- 12:47like these kinds of clauses. You know, you hear some
- 12:50weird stories about celebrities putting these clauses and prenupsial agreements
- 12:54in these kinds of things. And again, some states or
- 12:57judges might have more willingness tend force these clauses, but
- 13:00as a whole, these are pitfalls or red flags, and
- 13:05in most instances the kind of stuff to avoid, all right,
- 13:09any kind of clause that requires a spouse to agree
- 13:11to or allow a legal behavior that shouldn't be in
- 13:14a prenuptial agreement, and any kind of clause that encourages divorce.
- 13:18So if there's clauses in there that really encourage divorce
- 13:20that shouldn't be in there, and that you know would
- 13:24be would be troublesome if it was all right, all right.
- 13:31You know, Typically, again what you're trying to deal with
- 13:33in a prenuptial agreement is the financial matters and the
- 13:35financial disposition in terms of the marital property and debt,
- 13:40and that kind of stuff is okay, but when you
- 13:43start delving too far out of that, it can be problematic,
- 13:46all right. So the final question is our prent ups enforceable. Again,
- 13:50prent ups are generally enforceable if they follow contract and
- 13:55marital agreement guidelines, and so it's important that it abides
- 13:59by case law and in your jurisdiction and do some
- 14:04uniform premertal agreement acts. And I mean they generally need
- 14:07to be drafted in conformity with those acts. And again,
- 14:13farther away from the wedding date, both parties have a lawyer,
- 14:17no duress, no cores. And another big key is parties
- 14:20have to fully disclose their financial affairs, so full disclosure
- 14:26of finances and debts. You know, if all this stuff
- 14:29is taking place in the prentup doesn't overreach or a
- 14:33post up doesn't overreach, I mean, it's generally going to
- 14:36be enforceable. But it's these pitfalls, these red flags, they
- 14:40create problems, and these are the kinds of things it's
- 14:42important to know about if you're going to be seeing
- 14:45a lawyer to have a prenuptial agreement or post optial
- 14:47agreement drafted. Avoiding these pitfalls or red flags are going
- 14:51to increase the chances of enforceability. All right, Well, definitely
- 14:54an interesting topic. Again is a follow up to the
- 14:56episode today, going over to Tulsa Divorced Layers dot com
