- 0:00Speaker 1: What's up, everyone, and welcome back to the program. When
- 0:04Speaker 1: we first heard that Brian Colberger was filing for an appeal,
- 0:08Speaker 1: it was obvious that the families were going to be affected,
- 0:12Speaker 1: especially considering that the plea deal was supposed to put
- 0:15Speaker 1: this to bed. But now it's dragged back into the
- 0:18Speaker 1: spotlight and the nightmare starts all over. And can you
- 0:22Speaker 1: imagine if this guy's successful and gets a new trial,
- 0:27Speaker 1: the burden that would place on these families is unbelievable.
- 0:31Speaker 1: But that said, if there is evidence of what Brian
- 0:35Speaker 1: Colberger is claiming, then he should get a new trial.
- 0:39Speaker 1: And look, I don't say that because I think he's innocent,
- 0:42Speaker 1: but if there's enough evidence that the process was managed,
- 0:45Speaker 1: that he was coerced, then of course he deserves a
- 0:48Speaker 1: new trial. But I don't think that that's the truth,
- 0:52Speaker 1: and I don't think that he was coerced, and I
- 0:54Speaker 1: don't think he was lied to. In fact, what I
- 0:57Speaker 1: think is happening is he's just looking for another way
- 1:00Speaker 1: to cause pain and suffering to the survivor's families and
- 1:04Speaker 1: another way to try and stay relevant. So today we
- 1:08Speaker 1: have an article from the New York Post and the
- 1:10Speaker 1: headline how sick Brian Colberger is still torturing heartbroken Idaho
- 1:14Speaker 1: victims families behind bars. This article was authored by Michael Kaplan.
- 1:20Speaker 1: Convicted quadruple murderer Ryan Colberger thrust himself back into the
- 1:24Speaker 1: spotlight this week with the sensational claim he is innocent
- 1:28Speaker 1: and demanding a trial. He did so despite pleading guilty
- 1:32Speaker 1: in June of twenty twenty five to four counts the
- 1:35Speaker 1: first degree murder and one count of burglary for his
- 1:38Speaker 1: slaying of four University of Idaho students in their Moscow
- 1:42Speaker 1: home in November of twenty twenty two. The remorseless killer
- 1:46Speaker 1: thirty one has brought untold her to the families of
- 1:50Speaker 1: each of the victims he stabbed to death, Madison Mogan,
- 1:53Speaker 1: Kaylee Gonsalves, Xana Kernodle, and Ethan Chapin, who were all
- 1:57Speaker 1: in their early twenties. A complete fucking coward bro sneaks
- 2:03Speaker 1: in in the middle of the night to murder people
- 2:05Speaker 1: talk about a straight up coward. The conditions of his
- 2:08Speaker 1: plea were that he has no right to appeal and
- 2:10Speaker 1: no possibility of parole in return for avoiding the potential
- 2:14Speaker 1: of death by firing squad. What they should have done
- 2:17Speaker 1: is they should have went through with the trial, and
- 2:19Speaker 1: after he was convicted and given the death penalty, the
- 2:22Speaker 1: state of Idaho should have made Brian Colberger and Chad
- 2:25Speaker 1: Daybell fight to the death, and then after the fight,
- 2:27Speaker 1: we throw whoever wins into a volcano. Let's just get
- 2:30Speaker 1: it all cleaned up right away, take all the trash
- 2:32Speaker 1: out at once. Sounds like a fantastic idea to me.
- 2:38Speaker 1: He's trying to control the narrative, and that's right from
- 2:40Speaker 1: his playbook. We know how manipulative he is, and to
- 2:44Speaker 1: some extent, reversing the plea puts him in the driver's
- 2:46Speaker 1: seed for the moment. Vicky Ward, co author with James
- 2:49Speaker 1: Patterson of the Idaho Four, an American tragedy, of which
- 2:54Speaker 1: a new addition with updated details on Colberger's guilty plea
- 2:57Speaker 1: has just been released, told the Post, Look, dude, there's
- 3:01Speaker 1: no doubt about it. This guy is a narcissist and
- 3:04Speaker 1: he wants to be in control of everything, and the
- 3:09Speaker 1: fact that he wasn't in the spotlight for a little
- 3:10Speaker 1: while bothered him. And I also think that he got
- 3:14Speaker 1: a little taste of prison and it is not for him. Remember,
- 3:17Speaker 1: he has OCD. He doesn't even like to use pans
- 3:21Speaker 1: that had meat cooked in them previously. Right, So how
- 3:25Speaker 1: do you think he's getting along in prison? I'm guessing
- 3:28Speaker 1: not too well. But the one thing that he can
- 3:30Speaker 1: stomach is the fact that people have stopped talking about him.
- 3:34Speaker 1: God forbid that happens. Sadly, this is where Hugh Ego
- 3:38Speaker 1: Wilding Coberger appears to think he deserves to be. As
- 3:42Speaker 1: we write in a book, he was clearly an anti
- 3:45Speaker 1: social insel with very dark views about women. He was arrogant,
- 3:49Speaker 1: and he had a greatly inflated view of his own capabilities.
- 3:52Speaker 1: Ward added, Look, there is some truth to that, but
- 3:56Speaker 1: we have to be honest. If it wasn't for that
- 3:59Speaker 1: chief being left at the crime scene, this would have
- 4:02Speaker 1: went a whole different way. I mean, you look at
- 4:06Speaker 1: the car, how he prepared that car. There was no
- 4:09Speaker 1: DNA found in the car, no blood, nothing, So that
- 4:13Speaker 1: certainly tells us, or tells me anyway, that Brian Colberger
- 4:17Speaker 1: was prepared. He had that car locked and loaded, ready
- 4:21Speaker 1: to go, and he used all of his skills that
- 4:23Speaker 1: he learned on his way to becoming a criminologist. But
- 4:27Speaker 1: if it wasn't for that she's forget it. And I
- 4:31Speaker 1: think that he ended up leaving that sheath because he
- 4:33Speaker 1: was enraged, and he was enraged because Kayley was there.
- 4:38Speaker 1: Pennsylvania native Coburger has never had to answer in court
- 4:42Speaker 1: why he targeted his young victims and showed no remorse,
- 4:45Speaker 1: speaking only in a cold, monotone voice when confronted by
- 4:48Speaker 1: the families of his victims in court. And the judge
- 4:52Speaker 1: should have forced him to admit to each name to
- 4:56Speaker 1: what he did and his plea deal should have been
- 4:58Speaker 1: contingent on it. Oh, you don't want to give this statement.
- 5:01Speaker 1: You don't want to take full responsibility in open court
- 5:04Speaker 1: and tell us why and what you did? Okay? Cool,
- 5:07Speaker 1: see in a few weeks when the trial starts, bitch,
- 5:11Speaker 1: Because as I've said many times before, I think they
- 5:14Speaker 1: had more than enough evidence to convict Brian Colberger. Remember
- 5:19Speaker 1: it's not just one piece of evidence, right, it's all
- 5:22Speaker 1: of the evidence added up. And when you have all
- 5:24Speaker 1: of this circumstantial evidence building your foundation, and then you
- 5:28Speaker 1: build on top of that with DNA, it's very hard
- 5:32Speaker 1: for a defendant to win that case. And I think
- 5:36Speaker 1: that the evidence that was built against Coburger was staggering. Now,
- 5:40Speaker 1: of course there's no murder weapon, no motive, but there
- 5:44Speaker 1: was a lot of other information and it was all
- 5:46Speaker 1: anchored by the DNA, And when you have something anchored
- 5:49Speaker 1: by the DNA, it gives all the other evidence that
- 5:53Speaker 1: much more credibility. Right, Steve Gonsalvez, father of Kaylee, he
- 6:00Speaker 1: has responded to his attempted reversal of justice with time
- 6:03Speaker 1: warn resignation. I spoke to Steve yesterday and he told
- 6:07Speaker 1: me that he doesn't feel great to be proven. Right
- 6:10Speaker 1: Ward recounted noting how the Gonsolve this family were very
- 6:13Speaker 1: nervous all along, that Coburger would find a way to
- 6:16Speaker 1: circumvent the legal system, that he would coach want to
- 6:19Speaker 1: be killers in jail, and that he would sell his
- 6:21Speaker 1: story and enjoy a celebrity. I think that's all true,
- 6:25Speaker 1: and I think that if anybody's earned the right to speak,
- 6:29Speaker 1: it's the families of these victims. I mean, imagine being
- 6:34Speaker 1: Mystery Gonsolve. You wake up to the news that this
- 6:38Speaker 1: piece of shit is trying to get out from underneath
- 6:42Speaker 1: the deal that he made with the state. Then on
- 6:46Speaker 1: the flip side of that, I'd almost welcome it to
- 6:49Speaker 1: tell you the truth because again, I think Brian Colberger
- 6:52Speaker 1: is guilty, and I think there's enough evidence to prove that. Now.
- 6:57Speaker 1: With that said, I'm certainly willing to look at whatever
- 6:59Speaker 1: evidence he provides, if he has any that points to
- 7:03Speaker 1: somebody else or that he didn't do it. But up
- 7:06Speaker 1: until this point, he hasn't provided that. And listen, remember
- 7:10Speaker 1: we used to go through every court document that was
- 7:12Speaker 1: released as we were leading up to trial. We went
- 7:15Speaker 1: through all the court documents, everything, motions about cameras, you
- 7:19Speaker 1: name it. And never once did Brian Colberger or his
- 7:23Speaker 1: defense make an argument that really hit that would make
- 7:27Speaker 1: me say to myself, hull, hold up a minute here,
- 7:29Speaker 1: there might be somebody else involved, or it's not Coburger,
- 7:34Speaker 1: because I assure you all the evidence that we were
- 7:37Speaker 1: provided points in one direction. Former criminology student Brian Colberger
- 7:47Speaker 1: claimed that he had been duped into agreeing to a
- 7:49Speaker 1: guilty plea due to false promises and blatant disinformation, and
- 7:53Speaker 1: filed a petition challenging his conviction, insisting on an absolute
- 7:58Speaker 1: claim of innocence. He told report orders on Monday. Legal
- 8:01Speaker 1: analysts say he has little chance of succeeding. Yeah, I
- 8:04Speaker 1: don't think he's going to be successful either. But the
- 8:07Speaker 1: point is this little prick is doing this to try
- 8:10Speaker 1: and you know, bring some more pain to these families.
- 8:15Speaker 1: That's my opinion. I think that's what his motivation is.
- 8:19Speaker 1: Olivia Gonzalvez, sister of Kaylee, is not surprised by Kolberger's brazenness,
- 8:24Speaker 1: claiming she can read The Killer like a cheap novel.
- 8:27Speaker 1: After going through his new filing, Olivia told Vanity Fair,
- 8:31Speaker 1: I genuinely wanted to laugh. He's arguing in effective counsel,
- 8:35Speaker 1: which could not be further from the truth. The last
- 8:37Speaker 1: ice roll always appears to be the most dramatic, even
- 8:40Speaker 1: though it's no different from any of the others. And
- 8:43Speaker 1: that's true too. I don't know how anyone who followed
- 8:47Speaker 1: the trial could look at the representation that was given
- 8:51Speaker 1: to him by Anne Taylor and be like, oh, well,
- 8:54Speaker 1: he wasn't represented correctly, because I'm telling you right now,
- 8:58Speaker 1: Ann Taylor went all the way for Brian Colberger. I mean,
- 9:02Speaker 1: she got the venue changed, she got a lot of concessions, Okay,
- 9:06Speaker 1: concessions that in my opinion shouldn't have been given, but
- 9:10Speaker 1: they were. And then when you get to Aida County
- 9:13Speaker 1: Judge Hipler bent over backwards to make sure that Brian
- 9:17Speaker 1: Colberger got a fair shake. And even though he got
- 9:21Speaker 1: a fair shake, even though he got all the concessions
- 9:23Speaker 1: he wanted, his bitch ass pled guilty. Now he has
- 9:29Speaker 1: Buyer's remorse, he wants to show up talking about, Oh,
- 9:32Speaker 1: I'm not guilty, Let's change the plea. No, let's not.
- 9:38Speaker 1: She also expressed outrage over what his bid to recount
- 9:41Speaker 1: his admission at guilt is doing to family members. It
- 9:44Speaker 1: sucks that the justice system allows a perpetrator to continue
- 9:48Speaker 1: to revictimize their victims. Coburger should never ever ever have
- 9:52Speaker 1: that power again. Agreed put them underneath the jail. As
- 9:58Speaker 1: far as the other family reactions to co change of mind,
- 10:01Speaker 1: Ward added, Steve told me that some parents have spoken
- 10:04Speaker 1: to him and been in tears. I suspect that those
- 10:08Speaker 1: are the laramies, referring to Mogan's mother Karen and her
- 10:11Speaker 1: stepfather Scott. Ward explains that Colberger's attempt to shake things
- 10:15Speaker 1: up is particularly gut wrenching in light of the fact
- 10:19Speaker 1: that some of the brief parents rationalize the plea deal
- 10:22Speaker 1: as they anticipated never having to hear about Colburger again.
- 10:26Speaker 1: That's what I was just saying that was the whole point,
- 10:28Speaker 1: and that's why people went along with the plea deal.
- 10:31Speaker 1: But no, of course not, Let's give Brian Colberger's bitch
- 10:35Speaker 1: ass another chance. Meanwhile, the victims, the real victims here
- 10:39Speaker 1: are the families. They get to suffer all over again,
- 10:42Speaker 1: and then on top of that, the taxpayer has to
- 10:45Speaker 1: be on the hook for another lawyer. The Laramies were
- 10:50Speaker 1: okay with it because lead prosecutor Bill Thompson assured them
- 10:54Speaker 1: that there was absolutely no way that Colburger would ever
- 10:57Speaker 1: see the light of day outside of prison. She said, Now,
- 11:00Speaker 1: if Coburger were to get his wish and is granted
- 11:03Speaker 1: a new trial, there would be a chance he could
- 11:05Speaker 1: overturn his conviction. While there's a mountain of evidence against them.
- 11:09Speaker 1: The prosecution had DNA, but they didn't have a murder weapon,
- 11:13Speaker 1: and they didn't have a motive. Ward pointed out first
- 11:16Speaker 1: Stacy and Jim Chapin, parents of Ethan Colberger's, hustle for
- 11:20Speaker 1: a trial, might likely be something that is best ignored.
- 11:24Speaker 1: My sense of the Chapins is that this speculation, even
- 11:28Speaker 1: though I know them very well, is that they'll ignore this,
- 11:31Speaker 1: roll their eyes and get on with their lives, said Ward.
- 11:34Speaker 1: And that's been my experience with the Chapins as well.
- 11:37Speaker 1: They're not really interested in any of this, and they
- 11:40Speaker 1: just wanted to have this plea deal be the end
- 11:43Speaker 1: of it. But of course Brian Colberger has other ideas.
- 11:47Speaker 1: Ethan is a triplet, and I think Stacey's view is
- 11:50Speaker 1: that she can't bring Ethan back, but she'll do everything
- 11:53Speaker 1: in her power to help the other two Hunter and
- 11:56Speaker 1: Mazie to rebuild their lives. Similarly, said Ward, the Colonel
- 12:00Speaker 1: family just want the judge to quash this. As with
- 12:03Speaker 1: most people who have followed the case, their confident Colberger
- 12:07Speaker 1: is the murderer and he acted alone. And look that's
- 12:10Speaker 1: where I'm at. And as you know, if I felt differently,
- 12:13Speaker 1: I tell you right, if I thought something was a miss,
- 12:16Speaker 1: believe me, I tell you. And that's one of the
- 12:18Speaker 1: reasons that I follow these cases. I want to make
- 12:21Speaker 1: sure that everybody's getting a fair shake. So if the
- 12:25Speaker 1: government is acting stupid, you better believe I'm gonna talk
- 12:29Speaker 1: about it. I mean, remember Lori Valo. As much as
- 12:32Speaker 1: I hated that woman, as much as I still hate her,
- 12:36Speaker 1: I think the prosecution deserved to be punished for their
- 12:39Speaker 1: discovery missteps, and they were. The death penalty was taken
- 12:43Speaker 1: off the table, and I supported it at the time,
- 12:45Speaker 1: even though I think Loris Valo should be thrown in
- 12:48Speaker 1: a volcano. The process must be followed, and the state
- 12:52Speaker 1: has so much power that they can't be skipping steps.
- 12:56Speaker 1: They have to follow the law to the letter of it,
- 12:59Speaker 1: and if they don't do that, there are consequences. But
- 13:02Speaker 1: I don't see that in this case. I don't see
- 13:05Speaker 1: any Jillio Brady violations and I certainly don't see anything
- 13:09Speaker 1: that is constitutional. There's no doubt in my mind, having
- 13:15Speaker 1: spent a lot of time talking to the police chief,
- 13:18Speaker 1: that they got the right guy said Ward, see, I
- 13:20Speaker 1: don't need to talk to the chief. I read the
- 13:22Speaker 1: court documents, the actual factual documents. Those are what matter,
- 13:27Speaker 1: not what the chief says. With all respect due to
- 13:29Speaker 1: the chief, but in a way, I was not that
- 13:33Speaker 1: shocked that he would do this. Coburger is a very
- 13:36Speaker 1: antisocial sort of misfit, not somebody who does well around
- 13:39Speaker 1: other people. I'm sure he doesn't like being locked up
- 13:42Speaker 1: in prison. If the judge were to allow him to
- 13:45Speaker 1: go back on his plea Ward acknowledges the best case
- 13:47Speaker 1: scenario at trial could see Coburger answer questions about his
- 13:51Speaker 1: motives and detail what exactly went down in the home
- 13:55Speaker 1: that became a bloody house of horrors. However, War doubts
- 13:59Speaker 1: that would actually happen, adding, he's not going to say
- 14:02Speaker 1: he did it. He's a pathological liar and a sociopath.
- 14:06Speaker 1: It's like what we say in the new ending of
- 14:08Speaker 1: the book, it's unlikely that the families will ever have
- 14:11Speaker 1: quote unquote closure. And that's true. The closure that they
- 14:16Speaker 1: were promised is gone now as well, because it's back
- 14:21Speaker 1: up in the news, right. They got to relive it,
- 14:23Speaker 1: they got to think about it again. And this is
- 14:26Speaker 1: why people like Brian Kohlberger, with a mountain of evidence
- 14:29Speaker 1: against them, should be taken all the way to trial.
- 14:33Speaker 1: But since that didn't happen here, we are so like usual,
- 14:37Speaker 1: we'll keep an eye on it and when we have
- 14:39Speaker 1: some more information, we'll definitely get it added to the catalog.
- 14:43Speaker 1: All the information that goes with this episode can be
- 14:46Speaker 1: found in the description box.
