Tyler Robinson Will Stand Trial for Charlie Kirk’s Murder (9/2/26) · The Vault: The Epstein Files

Speaker 1: What's up everyone and welcome back to the program. Yesterday,
• 0:04
Speaker 1: Tyler Robinson appeared before Judge Graff to find out if
• 0:09
Speaker 1: he would go to trial for the alleged murder of
• 0:12
Speaker 1: Charlie Kirk. And when all was said and done, that's
• 0:16
Speaker 1: exactly what's going to happen. Because Judge Graff decided that
• 0:21
Speaker 1: there was more than enough evidence to bind Tyler Robinson
• 0:24
Speaker 1: over for trial. And not only that, he didn't get
• 0:28
Speaker 1: rid of the aggravated enhancement that could have gotten rid
• 0:32
Speaker 1: of the death penalty for Tyler Robinson. So, not only
• 0:36
Speaker 1: is Tyler Robinson facing murder charges, he's facing the death penalty.
• 0:42
Speaker 1: Today we have an article from CBS News and the headline,
• 0:46
Speaker 1: Charlie Kirk's accused killer will stand trial for aggravated murder.
• 0:49
Speaker 1: Utah judge rules. This article was authored by Carter Evans.
• 0:57
Speaker 1: Charlie Kirk's alleged killer will stand trial for aggravated murder
• 1:01
Speaker 1: in the September 10, 2025 shooting of the right-wing political
• 1:05
Speaker 1: activist in front of a crowd at Utah Valley University,
• 1:09
Speaker 1: a judge ruled on Tuesday. Judge Tony Graff decided, in
• 1:13
Speaker 1: favor of prosecutors who say they have enough evidence against
• 1:16
Speaker 1: Tyler Robinson, to put the 23-year-old on trial on a
• 1:20
Speaker 1: charge of aggravated murder, which could see him face the
• 1:23
Speaker 1: death penalty, life in prison without parole, or 25 years
• 1:27
Speaker 1: to life in prison with parole. So I highly doubt
• 1:32
Speaker 1: it'll be 25 years to life in prison with parole.
• 1:35
Speaker 1: It's either going to be the death penalty or life
• 1:38
Speaker 1: in prison. And I think that if the evidence keeps
• 1:42
Speaker 1: coming in the way it is, it's going to be
• 1:44
Speaker 1: rough for Tyler Robinson to not end up meeting the
• 1:48
Speaker 1: hangman's noose. And if he's guilty of all of this,
• 1:52
Speaker 1: I think he should. Society has to pass a message here.
• 1:56
Speaker 1: That shit like this is not okay. And I don't
• 1:59
Speaker 1: give a flying fuck what your politics are. Nobody should
• 2:03
Speaker 1: be getting killed on live TV or anywhere else because
• 2:06
Speaker 1: they have a political view that leans one way or
• 2:09
Speaker 1: the other. Before the court in Provo, Utah went to
• 2:12
Speaker 1: recess earlier Tuesday, Graff said he needed time to go
• 2:15
Speaker 1: over the 24 pages of notes that he took during
• 2:18
Speaker 1: the closing arguments of Robinson's prelim hearing. Well, I can't
• 2:23
Speaker 1: blame him. A lot going on, right? and you want
• 2:25
Speaker 1: to be thorough, especially as a judge. And so far,
• 2:29
Speaker 1: so good when it comes to Judge Graff. Prosecutors presented
• 2:34
Speaker 1: much of the evidence against Robinson during a five-day hearing
• 2:37
Speaker 1: back in July. A factor for the aggravated murder charge
• 2:41
Speaker 1: is a reasonable belief that the defendant knowingly endangered others
• 2:45
Speaker 1: in Kirk's death. The state of Utah argued Robinson targeted
• 2:48
Speaker 1: Kirk because of his political beliefs, and knowing that children
• 2:52
Speaker 1: were present and would witness the shooting. And I find
• 2:55
Speaker 1: the defense's argument here a bit laughable. The guy's sitting
• 3:00
Speaker 1: up on top of a building, allegedly, and fires a
• 3:03
Speaker 1: bullet at somebody. How can you say with a straight
• 3:07
Speaker 1: face that nobody else was in danger? Sure seems to
• 3:10
Speaker 1: me that everybody that was in the path was in danger.
• 3:16
Speaker 1: So I'm not shocked to see the judge keep the
• 3:18
Speaker 1: aggravated enhancement attached to the charges. And I think it's
• 3:22
Speaker 1: the right way to go. The judge said his decision
• 3:27
Speaker 1: was based on the documented position of several individuals in
• 3:30
Speaker 1: and around the canopy area where Kirk was speaking, among
• 3:34
Speaker 1: other factors. These circumstances support a reasonable inference that defendant
• 3:39
Speaker 1: was aware that other individuals were positioned near Mr. Kirk
• 3:43
Speaker 1: when he fired, Graff said. And I think that is legitimate.
• 3:46
Speaker 1: Are we going to pretend that nobody else could have
• 3:48
Speaker 1: been injured? Like, for real? Remember, it's not that somebody
• 3:53
Speaker 1: was injured. It's the risk of people being injured. And
• 3:57
Speaker 1: that's why the judge decided to go with the prosecution
• 4:00
Speaker 1: when it comes to that enhancement. And I thought that
• 4:04
Speaker 1: would be the case. I think the prosecution has done
• 4:07
Speaker 1: a good job making the argument. Now, does that mean
• 4:10
Speaker 1: they have all the evidence they're going to need to
• 4:12
Speaker 1: get this over the finish line? I don't know. I
• 4:15
Speaker 1: haven't seen all the evidence yet. But as of now,
• 4:18
Speaker 1: certainly enough to go to trial. And there's certainly an
• 4:20
Speaker 1: overwhelming amount of evidence to get it over That hump.
• 4:25
Speaker 1: Not that there's an overwhelming amount of evidence that's been
• 4:28
Speaker 1: produced that makes Tyler Robinson guilty at this point, but
• 4:32
Speaker 1: certainly enough evidence to have it go to trial. And
• 4:36
Speaker 1: that's what this whole prelim hearing was about. It wasn't
• 4:39
Speaker 1: the real argument. It was the appetizer. Today's decision, which
• 4:43
Speaker 1: comes nearly a year since Charlie was taken from us,
• 4:46
Speaker 1: marks an important step in our family's pursuit of justice
• 4:50
Speaker 1: for him. Kirk's family said in a Tuesday, In an
• 4:53
Speaker 1: emailed statement, every step in the process carries the weight
• 4:56
Speaker 1: of all that Charlie's murder has taken from his family,
• 4:59
Speaker 1: especially his children, who will grow up without their father.
• 5:03
Speaker 1: We're grateful to all those who continue to pray for us,
• 5:06
Speaker 1: support us, and stand with us through a year of
• 5:10
Speaker 1: unimaginable grief. And the fact that people like pile on
• 5:14
Speaker 1: this woman is bizarre to me. Like, I don't care
• 5:17
Speaker 1: about Erica Kirk one way or the other, and I
• 5:19
Speaker 1: wasn't a big fan of Charlie Kirk. I didn't dislike them.
• 5:22
Speaker 1: I just didn't care one way or the other. But
• 5:25
Speaker 1: I think it's reprehensible, honestly, the way some people have
• 5:28
Speaker 1: carried on. And the fact that they're profiting from it
• 5:31
Speaker 1: is crazy. And you know the sad truth? A lot
• 5:35
Speaker 1: of the people out here that have all of a
• 5:37
Speaker 1: sudden inserted themselves in the conversation, inserted themselves in the debate,
• 5:42
Speaker 1: weren't even fans of Charlie Kirk. And I have a
• 5:44
Speaker 1: suspicion that a lot of these people are chaos agents.
• 5:48
Speaker 1: They're not looking for justice. They don't care what really happened.
• 5:52
Speaker 1: They want to cause as much chaos and sow as
• 5:55
Speaker 1: many seeds of pain as possible. And there's always going
• 5:58
Speaker 1: to be an audience for that kind of shit. Always.
• 6:00
Speaker 1: Because the truth is, when it comes to the media,
• 6:03
Speaker 1: you're not selling papers on happy stories, right? If it bleeds,
• 6:08
Speaker 1: it leads. As the next phase of the judicial process begins,
• 6:14
Speaker 1: our family remains united in our love for Charlie, our
• 6:17
Speaker 1: commitment to the pursuit of justice, and our prayer for
• 6:20
Speaker 1: a transparent and timely process, the statement said. On Tuesday,
• 6:25
Speaker 1: prosecutors said Robinson shot and killed Charlie Kirk because he
• 6:28
Speaker 1: disagreed with him, and he did it by firing a
• 6:31
Speaker 1: high-powered rifle into a crowd of thousands. They added that
• 6:35
Speaker 1: there is a mountain of evidence against Robinson, and it's overwhelming. Look,
• 6:39
Speaker 1: I agree. So far, not looking good. And if you
• 6:43
Speaker 1: go and look at my track record talking about these
• 6:45
Speaker 1: kinds of cases, I've pretty much called them all spot on.
• 6:50
Speaker 1: And that's because I read the court documents, right? And
• 6:52
Speaker 1: if you're seeing the arguments develop in the background on
• 6:55
Speaker 1: the docket, you know what to expect. And when it
• 6:58
Speaker 1: comes to Tyler Robinson, the circumstantial evidence is as high
• 7:03
Speaker 1: as Mount Everest. Now, again, just to be clear, that
• 7:06
Speaker 1: doesn't mean that they're going to have enough when all
• 7:08
Speaker 1: is said and done. And when Robinson's team begins challenging
• 7:12
Speaker 1: what they've shown us, because at this stage, this has
• 7:15
Speaker 1: mainly been one-way traffic, right? And what I mean by
• 7:17
Speaker 1: that is we've only really heard from the prosecution. And
• 7:22
Speaker 1: that's because that's how this process works. But now that
• 7:26
Speaker 1: he's been binded over, I expect his team to start
• 7:29
Speaker 1: challenging this shit section by section, evidence by evidence, and
• 7:34
Speaker 1: we'll see what they come up with. But as of now,
• 7:37
Speaker 1: not looking good for Mr. Furry. The defense's closing argument
• 7:43
Speaker 1: mainly focused on the enhancements to the charges that would
• 7:45
Speaker 1: allow the prosecution to seek the death penalty against Robinson.
• 7:49
Speaker 1: The attorneys argued that the aggravating factor needed for a
• 7:53
Speaker 1: capital case in which other lives were knowingly put at
• 7:56
Speaker 1: great risk hasn't been proven because the shooter had a
• 7:59
Speaker 1: clear shot and only fired once over the crowd. Well,
• 8:03
Speaker 1: I think the law states that if other people are
• 8:06
Speaker 1: in danger of being harmed, then that aggravator certainly kicks in.
• 8:11
  Speaker 1: And I don't think there's any debate here. If you're
• 8:13
Speaker 1: firing over a group of people, thousands of them, shit
• 8:17
Speaker 1: can go south real quick. To counter that argument, prosecutors
• 8:20
Speaker 1: said you can't shoot a rifle into a crowd of 3,000
• 8:24
Speaker 1: people and not know that you're posing a significant risk
• 8:27
Speaker 1: of death. And I think that's very logical, right? I mean,
• 8:32
Speaker 1: when you look at it from a neutral perspective, and
• 8:34
  Speaker 1: that's certainly what I'm doing, I don't have any problem
• 8:38
Speaker 1: with the aggravator. Robinson had no visible reaction to the arguments.
• 8:44
Speaker 1: His mother Amber Robinson watched from the courtroom gallery as
• 8:47
Speaker 1: his father Matt listened with his head bowed. Kirk's parents,
• 8:51
Speaker 1: Robert and Catherine Kirk, entered the heavily secured facility arm-in-arm
• 8:55
Speaker 1: before the hearing at the 4th Judicial District Courthouse in Provo.
• 8:59
Speaker 1: Erica Kirk was seated beside them. The family stepped out
• 9:03
Speaker 1: during part of the prosecutor's argument that described the shooting. Yo,
• 9:07
Speaker 1: I don't blame them. Imagine living with that shit every day,
• 9:11
Speaker 1: seeing it all the time. All these people talking out
• 9:14
Speaker 1: of the side of their neck. Has to be horrible.
• 9:17
Speaker 1: Think about how you feel when somebody passes away, even
• 9:20
Speaker 1: when it's from natural causes. Imagine if some fucking Yahoo
• 9:24
Speaker 1: on the internet started popping off about your mom or
• 9:26
Speaker 1: your dad or your husband. Shit's monstrous. And the people
• 9:30
Speaker 1: engaging in it, they should check themselves. But they won't.
• 9:35
Speaker 1: Because it's all about the engagement, right? It's all about
• 9:39
Speaker 1: being part of the team. Robinson is also accused of
• 9:44
Speaker 1: obstruction of justice, which carries a penalty of up to
• 9:47
Speaker 1: 15 years in jail, and felony discharge of a firearm,
• 9:50
Speaker 1: causing serious bodily injury, which carries a penalty of five
• 9:53
Speaker 1: years to life in prison, according to the Utah County
• 9:56
Speaker 1: Attorney's Office. Graff ordered Robinson to stand trial on all
• 10:01
Speaker 1: seven counts. So look, this battle has just begun, and
• 10:05
Speaker 1: it's going to be a very, very long process. How
• 10:08
Speaker 1: long it takes, I'm not sure. That's going to depend
• 10:10
Speaker 1: on how much discovery has to come in and how
• 10:13
Speaker 1: much time it's going to require to go through all
• 10:15
Speaker 1: of it. So buckle up. Unless Tyler Robinson decides to
• 10:20
Speaker 1: plead guilty at some point and gets a plan to deal,
• 10:24
Speaker 1: this is going to be a long ride. And when
• 10:26
  Speaker 1: I say a long ride, I don't mean months. I'm
• 10:29
Speaker 1: talking years. So we're going to do our best to
• 10:32
Speaker 1: swim through all the muck and get to the clarity
• 10:35
Speaker 1: whenever we can. And when we have some more information,
• 10:37
Speaker 1: we'll get that added to the catalog. All the information
• 10:41
Speaker 1: that goes with this episode can be found in the
• 10:44
  Speaker 1: description box.
