- 0:00Speaker 1: I'm Chris Hansen right now on Crime wat Daily. From
- 0:02Speaker 1: here in New York City. A woman collapses in court
- 0:15Speaker 1: and leaves on a stretcher. It's a shocking end to
- 0:19Speaker 1: a sensational trial that rocked San Diego.
- 0:22Speaker 2: It's very bizarre, very bizarre.
- 0:24Speaker 1: Is this woman an evil fem fatale?
- 0:27Speaker 3: She was looking for someone to kill her husband.
- 0:30Speaker 1: Or a heroic mother in fear of her husband.
- 0:33Speaker 4: He had made accusations that he sexually assaulted her. Was
- 0:36Speaker 4: Melissa and the child.
- 0:37Speaker 1: Anna Garcia with a fitness trainer turned YouTube cook.
- 0:41Speaker 5: Welcome to my kitchen where I really.
- 0:43Speaker 6: Like to cook.
- 0:44Speaker 1: Accused of cooking up a recipe for murder.
- 0:47Speaker 7: My friends shot.
- 0:48Speaker 8: I felt like someone hit me in the back.
- 0:51Speaker 1: Then it was one of the biggest Ponzi schemes of
- 0:53Speaker 1: all time. And he is the slippery con man behind
- 0:57Speaker 1: one hundred million dollar crime.
- 1:00Speaker 6: Of a fancy car.
- 1:00Speaker 9: He dressed well Out's waterfront mansion and corporate jet.
- 1:04Speaker 1: Today how Drenberg's house of cards came crashing down and
- 1:08Speaker 1: after a during prison escape, he became a fugitive on
- 1:11Speaker 1: the rock.
- 1:12Speaker 6: Where darren Burg.
- 1:13Speaker 9: Is right now with anybody's cash.
- 1:15Speaker 3: Right now, let's go Jason Matower with Prime Watch Daily.
- 1:19Speaker 7: I'm as also going up from Crimewatch Cally, Yes, let's
- 1:21Speaker 7: be smart. From Crimewatch Daily.
- 1:23Speaker 10: It's Ana Garcia from Crime Watch Daily.
- 1:25Speaker 11: You got anything to say.
- 1:27Speaker 1: Us crime Watch Deally? What you don't know?
- 1:29Speaker 11: She's thirteen?
- 1:30Speaker 1: You're running away now. Welcome to Crime Watch Daily, everyone,
- 1:36Speaker 1: I'm Chris Hansen. We start today in southern California. That's
- 1:39Speaker 1: where a secretive mission in the middle of the night
- 1:41Speaker 1: ends with one man in the hospital and two unlikely
- 1:44Speaker 1: suspects in cups. Ana Garcia has the story the parting shot.
- 1:51Speaker 10: It's the kind of twisted tail the police say is
- 1:53Speaker 10: not exactly uncommon in upscale Carlsbad, California, an elite and
- 1:59Speaker 10: ideal like coastal enclave a little north of San Diego.
- 2:04Speaker 2: We don't have a lot of crime, but when we
- 2:06Speaker 2: do have crime, they are very violent and very bizarre.
- 2:11Speaker 10: This particular violent and bizarre crime beginning with a late
- 2:15Speaker 10: night nine to one one call from a secluded area
- 2:18Speaker 10: of town on one.
- 2:21Speaker 7: Yeah, I'm my friend has just shot.
- 2:25Speaker 10: It appears to be a failed assassination attempt.
- 2:29Speaker 4: Shot him.
- 2:30Speaker 7: There's a guy going down like a sniper sniper. Did
- 2:33Speaker 7: you see him at all? Briefly we saw that as
- 2:35Speaker 7: a guard and he shot time, one.
- 2:40Speaker 10: Of the bullets hitting forty six year old computer programmer
- 2:43Speaker 10: Greg Mulda Hill in the left side of his chest.
- 2:48Speaker 10: And Greg's fading fast.
- 2:50Speaker 12: My friends getting whiteheaded?
- 2:54Speaker 8: Turnround, I got bout two year Okay.
- 2:57Speaker 10: Greg is rushed to emergency surgery, where Doc learned the
- 3:00Speaker 10: bullet just missed his heart. At the same time, police
- 3:05Speaker 10: are hunting for what they fear, maybe an armed maniac
- 3:08Speaker 10: on the loose. Initially, you all thought you had an
- 3:12Speaker 10: active shooter situation, and this whole place was almost like
- 3:15Speaker 10: on a lockdown, right.
- 3:16Speaker 2: We didn't know what we had, and at the time
- 3:19Speaker 2: of the callum.
- 3:21Speaker 4: It wasn't until we got more information that it started
- 3:23Speaker 4: sounding less like a random attack and more like a
- 3:28Speaker 4: purposeful event.
- 3:30Speaker 10: But who would want Greg assassinated? The handsome computer programmer
- 3:34Speaker 10: had married his high school sweetheart, Diana loved Joy, a
- 3:39Speaker 10: pretty fitness instructor and champion triathlete, shown promoting her own
- 3:44Speaker 10: recipes for women on the go in this YouTube cooking
- 3:48Speaker 10: video and.
- 3:49Speaker 5: Diana Lovejoy and quick meals.
- 3:50Speaker 13: Are my specialty.
- 3:52Speaker 10: Greg and Diana had been married for seven years and
- 3:55Speaker 10: went through eight heartbreaking miscarriages before giving birth to their
- 3:59Speaker 10: own only child, a son. The struggles to have a
- 4:03Speaker 10: baby reportedly added stress to their relationship, and they sought
- 4:07Speaker 10: marriage counseling, but the damage was done.
- 4:10Speaker 3: They made a beautiful little boy. But once that was done,
- 4:14Speaker 3: that was once they conceived, that was the end of
- 4:17Speaker 3: their marital relationship.
- 4:20Speaker 10: But Greg told detectives that despite their animosity toward each other,
- 4:23Speaker 10: he couldn't believe Diana would ever want their three year
- 4:27Speaker 10: old son to be left without a father, and Diana
- 4:31Speaker 10: seemed more like the perfect working single mom than a
- 4:34Speaker 10: would be killer.
- 4:35Speaker 7: I really like to cook, but I'm often short on time.
- 4:39Speaker 5: The speed is the hook.
- 4:41Speaker 10: But detectives would soon come to suspect Diana may have
- 4:44Speaker 10: also been cooking up something else altogether, especially after Greg
- 4:50Speaker 10: told detectives why he went to the spot of the ambush.
- 4:53Speaker 10: When you're interviewing the victim at this point, is he
- 4:56Speaker 10: in the hospital.
- 4:57Speaker 4: Yes, in the hospital after surgery from his injury. He
- 5:01Speaker 4: had told us that he had received a phone call
- 5:03Speaker 4: at around ten thirty at night from an unknown number
- 5:07Speaker 4: to him.
- 5:08Speaker 10: That caller, identifying himself as a private investigator, saying he
- 5:13Speaker 10: had information that could help Greg in a bitter divorce
- 5:16Speaker 10: and custody battle he was waging with his now estranged
- 5:20Speaker 10: wife Diana love Joy.
- 5:22Speaker 4: He wanted to see it. He needed to come to
- 5:23Speaker 4: a location within a certain amount of time and look
- 5:27Speaker 4: at the information see if he wanted.
- 5:29Speaker 6: To buy it from him.
- 5:30Speaker 10: When he's released from the hospital, Greg would return to
- 5:33Speaker 10: the scene of the crime with detectives to show them
- 5:36Speaker 10: exactly what happened. When he arrived at the appointed meeting
- 5:40Speaker 10: place with friend Jason Kovach at his side.
- 5:44Speaker 2: Greg maulther Hill was holding a flashlight or a bike
- 5:48Speaker 2: light and his friend was holding like a mini bat
- 5:52Speaker 2: kind of like for some protection.
- 5:54Speaker 10: And police would make this video recreation of Greg's account
- 5:57Speaker 10: of the frightening events.
- 6:00Speaker 11: Is scanning the area when.
- 6:02Speaker 10: His light suddenly falls on something moving in the bushes.
- 6:06Speaker 2: When he immediately knew that that was a person laying
- 6:09Speaker 2: down that was holding a rifle aimed at him.
- 6:11Speaker 10: Greg and his buddy Jason panic, but one.
- 6:14Speaker 2: Of them yelled gun as soon as they saw that
- 6:16Speaker 2: it was a gun and they both.
- 6:17Speaker 10: Ran, Greg getting hit when the gunman fires shot after
- 6:23Speaker 10: shot at them as they flee, So they run off
- 6:27Speaker 10: this way, and the shooter runs that way.
- 6:30Speaker 11: The shooter runs that way.
- 6:32Speaker 10: It doesn't take long for detectives to figure out that
- 6:35Speaker 10: Greg had been lured into a planned death trap, and
- 6:39Speaker 10: they immediately become suspicious of Greg's estranged wife, Diana, when
- 6:44Speaker 10: they go to her house around three in the morning,
- 6:47Speaker 10: just hours after the shooting, to tell her what happened
- 6:50Speaker 10: to him. Why were the detectives so suspicious of her reaction?
- 6:56Speaker 4: Giggling just wasn't appropriate reaction to finding out the father
- 7:00Speaker 4: of your child had just been shot and was in
- 7:03Speaker 4: the hospital.
- 7:04Speaker 3: Where there's smoke, there's fire.
- 7:06Speaker 10: Next, police uncovers shocking evidence that leads them to believe
- 7:10Speaker 10: Diana recruited this hired gun to do her dirty work.
- 7:15Speaker 3: She was looking for someone to kill her husband, and
- 7:18Speaker 3: she thought that she found her man.
- 7:22Speaker 1: We return now with more of today's story, the parting shot.
- 7:25Speaker 1: For that, let's head back to Ana Garcia in southern California.
- 7:31Speaker 10: Greg Mulvahill is lucky to be alive after being lured
- 7:34Speaker 10: into what police call a death trapt.
- 7:39Speaker 3: It's not like he didn't get a life threatening injury.
- 7:42Speaker 3: We just happened to live in a time where we
- 7:43Speaker 3: have excellent medical care, and he lived.
- 7:46Speaker 10: Investigators wonder if Greg's estranged wife, Diana Lovejoy may have
- 7:51Speaker 10: had something to do with what looks like an attempt
- 7:55Speaker 10: to kill him.
- 7:56Speaker 11: So are you immediately thinking wife as a.
- 7:59Speaker 4: Susp not at that point now, not necessarily, but.
- 8:03Speaker 10: Detectives would grow more suspicious when they learned Diana and
- 8:06Speaker 10: Greg had been having problems throughout a stormy seven year marriage,
- 8:11Speaker 10: which had effectively ended when their three year old son
- 8:14Speaker 10: was conceived.
- 8:15Speaker 3: Mister Malva Hill stated that was the last time that
- 8:17Speaker 3: they were intimate with one another after she found out
- 8:19Speaker 3: she was pregnant with the little boy, and they basically
- 8:22Speaker 3: lived as strangers in the same house.
- 8:25Speaker 10: The couple eventually separated. The next two years were spent
- 8:29Speaker 10: locked in an ugly battle over alimony, child support, and
- 8:33Speaker 10: custody issues, and it would only grow more bitter when
- 8:37Speaker 10: a divorce court judge eventually ruled Diana would have to
- 8:41Speaker 10: pay Greg half the worth of the house they'd lived
- 8:44Speaker 10: in before separating.
- 8:45Speaker 11: How much money are we talking about?
- 8:47Speaker 3: She had three months to give him one hundred and
- 8:49Speaker 3: twenty thousand dollars cash.
- 8:52Speaker 10: Diana is said to have been furious and even more
- 8:55Speaker 10: angry that the judge had awarded fifty to fifty custody.
- 8:59Speaker 11: Of their child.
- 9:00Speaker 3: She wanted complete possession of that little boy.
- 9:03Speaker 10: Detectives theorize she may have been prepared to kill him
- 9:07Speaker 10: to get her way.
- 9:09Speaker 11: Did you do any interviews with Diana Lovejoy?
- 9:11Speaker 4: I did the interviews. Initially, she tried to distance herself
- 9:14Speaker 4: as much as possible.
- 9:16Speaker 10: Detectives have no evidence to link Diana to Greg's shooting
- 9:20Speaker 10: until they uncover this store security video of Diana buying
- 9:25Speaker 10: a cheap burner phone and it's a phone number detectives recognize.
- 9:32Speaker 10: Turns out it's the very same phone used by the
- 9:35Speaker 10: mystery man who called Greg, luring him to this remote
- 9:39Speaker 10: meeting spot with the ruse of selling information to help
- 9:43Speaker 10: him in his divorce battle with Diana.
- 9:47Speaker 11: And what was her reaction to that?
- 9:49Speaker 4: She tried to come up with a new version of
- 9:53Speaker 4: events that had happened.
- 9:54Speaker 10: Diana now tells detectives she bought the phone for a
- 9:58Speaker 10: man she hired to scare her her husband into giving
- 10:01Speaker 10: up his child custody rights before their divorce became final.
- 10:06Speaker 10: My Love Diana would identify the man as Weldon McDavid Junior,
- 10:12Speaker 10: a local gun instructor. She says had been giving her
- 10:18Speaker 10: shooting lessons so she could defend herself against Greg, whom
- 10:22Speaker 10: she claims was abusing her and their little boy.
- 10:26Speaker 4: She had made accusations that he sexually assaulted her, was
- 10:29Speaker 4: molesting the child, was a drug abuser.
- 10:33Speaker 10: Diana told detectives she'd seen a report on NBC's Dateline
- 10:37Speaker 10: in twenty thirteen when McDavid was hailed as a hero
- 10:42Speaker 10: for helping another woman, Crystal Harris. He claimed he was
- 10:46Speaker 10: helping Harris protect herself from an allegedly abusive husband.
- 10:50Speaker 13: I asked her, are you prepared to kill him? Because
- 10:54Speaker 13: that is a very real possibility.
- 10:57Speaker 10: McDavid says in the report that he'd given Crystal shooting
- 11:01Speaker 10: lessons too, and after.
- 11:03Speaker 6: A few moments she said, yes.
- 11:05Speaker 11: If I have to, but Crystal didn't have to.
- 11:10Speaker 10: Diana tells detectives it was never her intention to have
- 11:14Speaker 10: McDavid kill or hurt Greg unless it became necessary.
- 11:19Speaker 4: She also lets us know that there was eventually a
- 11:23Speaker 4: plan to either have well McDavid scare her husband or
- 11:28Speaker 4: murder her husband and called law enforcement.
- 11:30Speaker 10: Detectives say Diana used all her charm to talk McDavid
- 11:34Speaker 10: into helping her. Did you talk to either of them
- 11:37Speaker 10: about whether they were having a sexual relationship.
- 11:40Speaker 4: They had had sex one time, and she felt it
- 11:43Speaker 4: was a mistake because he was married and had a
- 11:46Speaker 4: brand new couple of month old baby.
- 11:48Speaker 10: And she says McDavid finally agreed to help her.
- 11:52Speaker 4: She told us that she'd given him a thousand dollars
- 11:54Speaker 4: to scare her husband.
- 11:56Speaker 10: But when McDavid is brought in for questioning, he denies
- 11:59Speaker 10: knowing and having any knowledge of Greg mulba Hill's shooting.
- 12:04Speaker 14: I'm asking you where you were at last where he
- 12:06Speaker 14: gets shot.
- 12:08Speaker 6: Why do you want to be telling you that?
- 12:10Speaker 10: McDavid insists he was at home at the time of
- 12:12Speaker 10: the shooting, and detectives give him an opportunity to prove it.
- 12:16Speaker 4: Can you give me access to your phone to show.
- 12:19Speaker 12: That you're home by because yeah, that's fine.
- 12:23Speaker 6: So listen, you.
- 12:26Speaker 14: Guys are trying to accuse me because no, no, no,
- 12:28Speaker 14: or not too well?
- 12:28Speaker 6: Yes you are well.
- 12:29Speaker 12: I'm trying to find out your version of events, and
- 12:34Speaker 12: you're telling me I don't know, and I'm not giving
- 12:36Speaker 12: you access.
- 12:36Speaker 6: To the only thing that you possess. You possess that.
- 12:42Speaker 10: Shows where you're at but detectives tell McDavid they already
- 12:46Speaker 10: have DNA evidence placing him at the scene of the crime.
- 12:50Speaker 1: Any reason why you.
- 12:51Speaker 6: Would have any DNA in that?
- 12:52Speaker 13: And DNA is something that doesn't just fly off and
- 12:55Speaker 13: blow down the street.
- 12:56Speaker 6: You have to go there to put it there? Would
- 12:59Speaker 6: you have been there?
- 13:01Speaker 15: He might have been there, right.
- 13:02Speaker 6: Why would you be here?
- 13:04Speaker 9: I don't know, I don't.
- 13:06Speaker 16: Know what's there.
- 13:08Speaker 10: Then McDavid suddenly remembers going jogging there.
- 13:12Speaker 1: You went for a run back here?
- 13:16Speaker 10: Yeah, And now he realizes he was tripped up by
- 13:20Speaker 10: a sudden call of nature.
- 13:23Speaker 6: I know what you're talking about, you do?
- 13:26Speaker 7: Yeah, okay, okay, explain.
- 13:31Speaker 1: I was on.
- 13:33Speaker 13: Der road, just running along, and then I.
- 13:41Speaker 6: Did have to.
- 13:44Speaker 10: Explaining, well, not quite.
- 13:47Speaker 12: How much of a coincidence do you think it would be?
- 13:50Speaker 16: Knowing that the area that he took is the area
- 13:53Speaker 16: that Greg was.
- 13:54Speaker 10: Shire detectives tell McDavid he left his DNA on one
- 13:59Speaker 10: of two two towels found at the crime scene.
- 14:02Speaker 6: Did you wipe yourself?
- 14:03Speaker 4: Did you use a tonnel or anything?
- 14:06Speaker 8: Yeah?
- 14:06Speaker 6: Where'd you get the towel?
- 14:08Speaker 13: He was there?
- 14:10Speaker 6: Really?
- 14:11Speaker 7: Yeah?
- 14:12Speaker 1: Are you sure you didn't get from anywhere else?
- 14:16Speaker 13: I didn't get it from anywhere else. I saw the
- 14:20Speaker 13: towels there.
- 14:22Speaker 10: But detectives had already discovered. Those towels at the crime
- 14:26Speaker 10: scene matched a set they'd found in Diana loved Joy's home,
- 14:32Speaker 10: and they would also find the assault rifle used to
- 14:35Speaker 10: shoot Diana's a strange husband among a huge cache of
- 14:39Speaker 10: weapons at McDavid's home.
- 14:41Speaker 2: This rifle was found in the garage, up in some rafters,
- 14:45Speaker 2: and it was hidden.
- 14:47Speaker 10: Now detectives had all the evidence they needed to charge
- 14:51Speaker 10: Diana Lovejoy and Weldon McDavid with attempted murder.
- 14:55Speaker 4: We rested both that same day.
- 14:59Speaker 10: Next a shackle, Diana comes face to face with Greg
- 15:03Speaker 10: for the first time since his shooting.
- 15:06Speaker 8: About the time I realized what I was looking at,
- 15:08Speaker 8: it felt like I had been hitten back.
- 15:15Speaker 1: Diana Lovejoy is charged with attempted murder in the attack
- 15:18Speaker 1: of her strange husband. She didn't pull the trigger. Prosecutors
- 15:21Speaker 1: say she found someone else to do her dirty work,
- 15:24Speaker 1: and the trials and verdicts would make headlines around the world.
- 15:28Speaker 6: Once again.
- 15:29Speaker 1: Here's Anna Garcia.
- 15:31Speaker 10: A somber and humble Diana Lovejoy is led into court
- 15:35Speaker 10: in shackles. Doesn't that's the less, the real housewife of Carlsbad, California,
- 15:43Speaker 10: charged with plotting to murder her estranged husband Greg Mulbahill
- 15:50Speaker 10: and hiring shooting instructor and former marine Weldon McDavid as
- 15:54Speaker 10: her hit man.
- 15:55Speaker 3: Why did you try them together because it is so
- 15:58Speaker 3: clear that this is a conspiracy case where they did
- 16:01Speaker 3: this together.
- 16:03Speaker 10: Now, lucky to be alive, Greg would come face to
- 16:06Speaker 10: face with Diana for the first time since the shooting,
- 16:11Speaker 10: as well as the trigger man. Diana allegedly paid a
- 16:14Speaker 10: mere thousand bucks to kill him in a late night ambush.
- 16:18Speaker 3: The gunman, lying in the sniper position shoots six to
- 16:21Speaker 3: seven more rounds.
- 16:24Speaker 10: Greg takes the stand to tell how he'd caught a
- 16:27Speaker 10: quick glimpse of McDavid hiding behind him brush with a
- 16:30Speaker 10: rifle aimed directly at him.
- 16:32Speaker 8: About the time I realized what I was looking at,
- 16:36Speaker 8: it felt like I had been hitting the back. The
- 16:41Speaker 8: next thing I remember was starting to run.
- 16:45Speaker 10: As McDavid continues shooting until he and friend Jason Kovach
- 16:49Speaker 10: are out of range and.
- 16:51Speaker 12: We ran the other direction away from the gunfire.
- 16:55Speaker 10: Diana shows no emotion as Greg testifies, and her attorneys
- 16:59Speaker 10: continue you to deny she had any intention of harming Greg,
- 17:04Speaker 10: claiming McDavid was only supposed to scare Greg into staying
- 17:08Speaker 10: away from Diana and their little boy after accusing him
- 17:11Speaker 10: of sexually abusing both of them.
- 17:14Speaker 3: Miss Lovejoy had gone to the Carlsbad Police Department and
- 17:16Speaker 3: made a complaint stating that mister Mulvahill had sexually assaulted
- 17:20Speaker 3: her in her sleep. She said that she suspected that
- 17:24Speaker 3: mister Malverhill was molesting her boy.
- 17:27Speaker 10: But the court would hear that a Child Protective Services
- 17:29Speaker 10: investigation had found no evidence to support Diana's shocking allegations
- 17:34Speaker 10: against Greg.
- 17:36Speaker 3: He had to go through numerous psychological evaluations. He had
- 17:39Speaker 3: to see psychiatrists, psychologists, sex therapist. The unanimous conclusion was
- 17:45Speaker 3: that this was made up, that he had not molested
- 17:47Speaker 3: his little boy, and they ended up determining that actually
- 17:50Speaker 3: he was the better parent of the two.
- 17:53Speaker 11: So you don't believe her.
- 17:54Speaker 7: Absolutely not.
- 17:56Speaker 10: Assistant Prosecutor Jody Breton would tell the court Diana simply
- 18:00Speaker 10: didn't want to pay Greg his one hundred and twenty
- 18:03Speaker 10: thousand dollars share of a house they owned, nor give
- 18:07Speaker 10: him shared custody of their son as ordered by a
- 18:10Speaker 10: divorce court judge. Instead, the prosecution tells the court Diana
- 18:15Speaker 10: chose to kill two birds with one stone by paying
- 18:19Speaker 10: Weldon McDavid to kill her child's father.
- 18:22Speaker 3: Diana Lovejoyce sets about looking for someone, and she finds
- 18:24Speaker 3: that someone when she finds mister McDavid.
- 18:27Speaker 10: But McDavid would testify that, like Diana, he had no
- 18:31Speaker 10: intention of harming greg Or the friend that was with
- 18:34Speaker 10: him the night of the shooting.
- 18:36Speaker 13: I fired six shots in the air, and once they
- 18:40Speaker 13: started running, I ceased fire.
- 18:43Speaker 10: It's about the strangest defense you will hear for an
- 18:46Speaker 10: attempted murder charge. The shooter insists he's such a good
- 18:50Speaker 10: shot that if he wanted the ex husband dead, he'd
- 18:53Speaker 10: be dead.
- 18:53Speaker 13: Now, Marines are taught if they wanted to kill someone,
- 18:57Speaker 13: two to the center, madness, one to the head.
- 19:01Speaker 10: Briton doesn't buy it, telling the court how McDavid had
- 19:04Speaker 10: deliberately lured Gregg into a death trap with the false
- 19:08Speaker 10: promise of selling him information that would help him in
- 19:11Speaker 10: his divorce from Diana.
- 19:15Speaker 3: And you can discharge a firearm and there'd be no
- 19:17Speaker 3: reason for you to call the police and tell them.
- 19:18Speaker 15: Mathworns.
- 19:20Speaker 13: I didn't call them because I knew that they would
- 19:24Speaker 13: view that as me discharging a firearm, but I was
- 19:28Speaker 13: actually defending my life from a flashlight.
- 19:33Speaker 10: Briton alleges McDavid had his rifle cocked and ready to
- 19:37Speaker 10: fire before Greg and his friend spotted him, and Briton
- 19:41Speaker 10: tells the jury there is only one decision they can make.
- 19:45Speaker 3: He's still guilty attempted murder because he took that one shot.
- 19:50Speaker 10: But attorneys for Weldon McDavid and Diana Lovejoy continue to
- 19:53Speaker 10: insist they both were only trying to protect her innocent child.
- 19:58Speaker 12: People simply trying to help stop molestation of a three
- 20:02Speaker 12: year old.
- 20:04Speaker 10: Next, this suddenly happens when the jury returns to deliver
- 20:09Speaker 10: its verdict.
- 20:10Speaker 3: Her family is screaming, help her, help her.
- 20:18Speaker 1: Now to the conclusion of today's story, the parting shot.
- 20:21Speaker 1: Once again, here's Anna Garcia.
- 20:25Speaker 10: The fate of Diana Lovejoy is being left in the
- 20:28Speaker 10: hands of the jury, who must decide if she is
- 20:32Speaker 10: a ruthless, villainous who plotted to kill her husband, Greg
- 20:36Speaker 10: mulvahill for her own personal gain.
- 20:39Speaker 5: I know that you don't have all day and we've got.
- 20:41Speaker 10: Malice to feed, or if this happy homemaker is actually
- 20:46Speaker 10: a concerned mother who claims she was just trying to
- 20:49Speaker 10: stop Greg from allegedly sexually abusing their three year old son. Now,
- 20:56Speaker 10: as the jury is about to deliver its verdict, an
- 20:59Speaker 10: anxiously Diana sits in court alongside Weldon McDavid, the former
- 21:04Speaker 10: marine she had allegedly hired to shoot Greg and a
- 21:08Speaker 10: failed attempt. He miraculously survived, and Diana appears to be
- 21:13Speaker 10: physically ill, waiting to hear the words that will either
- 21:17Speaker 10: set her free or possibly send her to prison for
- 21:20Speaker 10: the rest of her life.
- 21:22Speaker 15: Be the jury in the abovant title cause, find the defendant,
- 21:26Speaker 15: Diana Jane Lovejoy guilty of the crime of conspiracy to
- 21:29Speaker 15: commit murder in violation of penal quote section onety two
- 21:33Speaker 15: for an.
- 21:33Speaker 3: Eight you could see this Lovejoy look over at her
- 21:38Speaker 3: defense attorney in like what happened? Like just shock disbelief.
- 21:44Speaker 10: Now it's time for her accomplice to hear his fate,
- 21:47Speaker 10: and Diana Lovejoy just can't take it anymore.
- 21:50Speaker 15: Leave the jury in the above actual cause, find the
- 21:53Speaker 15: defendant Weldon K. McDavid as to commit murder.
- 22:02Speaker 10: Diana has suddenly passed out, her body slumped back in
- 22:06Speaker 10: her chair as family members cry and scream in horror.
- 22:11Speaker 3: You can kind of see her head go back and
- 22:13Speaker 3: her eyes go in the back of her head, and
- 22:15Speaker 3: she just slumps over, and it was a pretty loud,
- 22:19Speaker 3: audible clunk when she hit her head on the table,
- 22:22Speaker 3: and then she kind of spills over onto the floor.
- 22:27Speaker 10: Diana still appears to be unconscious as medics carry her
- 22:30Speaker 10: from the courtroom on a stretcher.
- 22:33Speaker 3: So it's quite a bit of chaos.
- 22:35Speaker 10: Doctors would find that Diana had only faint, but Jody
- 22:40Speaker 10: Bruton suspects Diana might have even faked that.
- 22:44Speaker 11: You sound very skeptical.
- 22:47Speaker 3: I am skeptical because I just again, she's somebody who
- 22:50Speaker 3: will hire a person to kill her ex husband. She's
- 22:52Speaker 3: someone who will accuse her ex husband of molesting and
- 22:56Speaker 3: sexual assault, So I would not put it all past her.
- 23:00Speaker 10: Breton isn't sure Diana's tears are real either, when she
- 23:04Speaker 10: returns to court to make a plea for mercy, still
- 23:07Speaker 10: denying guilt and still making the same shocking allegations against Greg.
- 23:13Speaker 5: And what sexually abused And I did my son be
- 23:17Speaker 5: molested once? And I did take all the steps I
- 23:23Speaker 5: possibly could to obmiterate that situation.
- 23:27Speaker 10: Briton is disgusted that Diana continues to falsely accuse Greg
- 23:31Speaker 10: of such an atrocity, especially after a full investigation had
- 23:35Speaker 10: found it simply wasn't true, and even praised Greg as
- 23:39Speaker 10: the better parent.
- 23:40Speaker 3: And he genuinely is a nice man.
- 23:44Speaker 10: Diana insists she never wanted her son to be without
- 23:48Speaker 10: a father.
- 23:49Speaker 6: I would. It's so big. Who have people?
- 24:01Speaker 5: Some people in this world seem to think that I
- 24:03Speaker 5: would have it iffy to do this.
- 24:07Speaker 10: Her partner in crime, Weldon McDavid, also turns on the tap.
- 24:11Speaker 12: I thought of my son growing up without a father.
- 24:17Speaker 12: My father was killed. My father was killed when I
- 24:23Speaker 12: was twenty four, and I still haven't gotten over that
- 24:28Speaker 12: I would not take a father from a child.
- 24:33Speaker 10: But the judge appears to be unmoved by anything the
- 24:36Speaker 10: two have to say for themselves, as he gives them
- 24:38Speaker 10: both the max for a conspiracy to commit murder and
- 24:42Speaker 10: attempted murder, sentencing Weldon McDavid, the triggerman, to fifty years
- 24:48Speaker 10: to life, and Diana Lovejoy, who hatched the plot, twenty
- 24:53Speaker 10: six years to life, leaving just about everyone except the
- 24:58Speaker 10: two co conspirators and their defense attorneys in full agreement
- 25:02Speaker 10: with the judge and jury.
- 25:05Speaker 11: What did the jury say afterwards?
- 25:06Speaker 3: They didn't believe mister McDavid at all, that they thought
- 25:10Speaker 3: he was narcissistic and was his story was just absolutely incredulous.
- 25:16Speaker 3: There there's just nothing, no truth to it, and.
- 25:20Speaker 10: That Diana was perhaps the worst villain of the diabolical duo.
- 25:26Speaker 3: I believe Lovejoy was the manipulator. And then you know
- 25:29Speaker 3: the master behind all of it. That mister and McDavid
- 25:32Speaker 3: would have had no reason to come up with this
- 25:34Speaker 3: plot or engage in any of this on.
- 25:36Speaker 9: His own, coming up waterfront mansion, corporate jet, he.
- 25:42Speaker 1: Had a taste for the finer things, in a bad
- 25:45Speaker 1: habit of taking other people's money. Now the frat boy
- 25:49Speaker 1: turned khan man is playing catch me if you can
- 25:52Speaker 1: with the facts.
- 25:52Speaker 9: Where deren Burg is right now with anybody's guests.
- 25:55Speaker 1: That's next, Welcome back to crime much Daily. Up next.
- 26:01Speaker 1: He made millions of dollars appear then disappear. But darren
- 26:05Speaker 1: Berg was no magic man. Instead the Fed saying he
- 26:07Speaker 1: was a con man. And now the man who has
- 26:10Speaker 1: been dubbed Mini Madeoff has managed to make something else
- 26:13Speaker 1: vanish himself Melissa McCarty is in northern California with today's story,
- 26:18Speaker 1: the Money Mirange.
- 26:20Speaker 7: He's the mastermind of one of the biggest Ponzi schemes ever.
- 26:24Speaker 6: There's no magic here.
- 26:26Speaker 10: He might think it's magic, but it's actually rooting eating
- 26:28Speaker 10: potato stuff.
- 26:30Speaker 7: The slick scam artist ripped off more than one hundred
- 26:33Speaker 7: million dollars one hundred mili defunt, his lavish lifestyle.
- 26:39Speaker 9: Drove a fancy car, he dressed well, waterfront mansion, corporate jets.
- 26:45Speaker 7: Now this wolf of Washington is playing catch me if
- 26:48Speaker 7: you can with the Feds. But this guy is no
- 26:51Speaker 7: Leonardo DiCaprio.
- 26:53Speaker 14: He vanished within seven days, and nobody knew very well.
- 26:57Speaker 7: Where the crafty con man is hiding is a mystery.
- 27:01Speaker 9: Where Darren Burg is right now is anybody's guests. Canada, Mexico,
- 27:05Speaker 9: Central America.
- 27:09Speaker 7: Darren Berg started his white collar, black tie life of
- 27:12Speaker 7: crime in college as a front boy at the Pi
- 27:15Speaker 7: Kappa Alpha House also known as Pikes at the University
- 27:18Speaker 7: of Oregon.
- 27:19Speaker 14: First showed up in Eugene and joined the fraternity in
- 27:23Speaker 14: the fall, and they immediately elected him treasurer.
- 27:28Speaker 7: Michael Stone, a former alumni advisor to the fraternity remembers
- 27:32Speaker 7: the smooth talking Berg dazzled his fraternity brothers with his
- 27:37Speaker 7: charisma and business savvy.
- 27:38Speaker 6: We viewed him as the boy Wonder.
- 27:42Speaker 7: Because at just twenty years old, the ambitious entrepreneur already
- 27:47Speaker 7: owned his own business, a charter bus company touting his
- 27:50Speaker 7: own name, Darren Berg Tours, and so they gave him
- 27:54Speaker 7: two titles because of that.
- 27:55Speaker 14: Yes, the rest of the undergraduate chapter elected him president
- 27:59Speaker 14: of the fraternity at the same time that he continued
- 28:01Speaker 14: to be treasurer of the fraternity.
- 28:04Speaker 7: But while his fraternity brothers were guzzling beer, Berg was
- 28:08Speaker 7: busy funneling Pike House money into his own bank account.
- 28:13Speaker 7: So you get this call one day from someone in
- 28:15Speaker 7: the house panicking.
- 28:16Speaker 14: Yeah, I got a call from the assistant treasurer who
- 28:22Speaker 14: called to say that all of their checks were bouncing
- 28:24Speaker 14: and that there was no money in the bank account
- 28:26Speaker 14: and they didn't understand how that could be because everybody
- 28:29Speaker 14: had just paid a full quarter of room, and board.
- 28:34Speaker 7: Stone was concerned. So we stopped buy the Pike House
- 28:37Speaker 7: to inspect the bank records that Berg kept tucked away
- 28:40Speaker 7: in his room, and sure enough, the balance was zero.
- 28:46Speaker 14: He came home at the time that I was looking
- 28:51Speaker 14: at the financial records in his.
- 28:52Speaker 6: Room, and he kind of went ballistic, and I.
- 28:56Speaker 14: Said, I'm here to try to find out where all
- 28:58Speaker 14: the money went, sinceverybody says they paid their house bills,
- 29:01Speaker 14: but there's no money in the bank account and it's
- 29:03Speaker 14: bouncing checks.
- 29:04Speaker 7: Turns out Berg was taking checks written to the fraternity,
- 29:08Speaker 7: endorsing them with his tour company stamp, and depositing them
- 29:12Speaker 7: straight into his charter bus account. How much money are
- 29:16Speaker 7: we talking that he stole?
- 29:18Speaker 6: About twenty one thousand at the time.
- 29:20Speaker 7: I mean, these are college kids. That's a lot of
- 29:22Speaker 7: money to a lot of those kids.
- 29:24Speaker 14: It was we ultimately got it all back. His bank,
- 29:27Speaker 14: First Interstate Bank took the hit for having dealt with
- 29:31Speaker 14: a fraudulent depositor.
- 29:33Speaker 7: Stone called the cops and the DA about what he
- 29:36Speaker 7: considered straight up embezzlement, but Eugene police never pressed charges.
- 29:41Speaker 7: And you won't believe why.
- 29:43Speaker 6: Darren's defense was that he had spent all of this.
- 29:46Speaker 14: Money on behalf of the fraternity and he was merely
- 29:50Speaker 14: reimbursing himself.
- 29:52Speaker 6: Lane County District Attorney in the Eugene.
- 29:54Speaker 14: Police Department felt that that was a good enough defense
- 29:56Speaker 14: that they didn't need to investigate.
- 29:58Speaker 7: Berg escaped an indictment, and then, just like the rep
- 30:02Speaker 7: money he stole, he simply disappeared. Well, he's living in
- 30:07Speaker 7: this house and everyone's looking at him, like, where's our money?
- 30:11Speaker 7: Did he leave?
- 30:11Speaker 14: He was gone and out of town within seven days.
- 30:17Speaker 6: Nobody knew where he went.
- 30:19Speaker 7: Stone never saw the frat frodster again, but he did
- 30:22Speaker 7: finally get a richly defensive earfull. How many weeks or
- 30:27Speaker 7: months after until you receive that very condescending letter from.
- 30:31Speaker 6: Him, Oh, that was the same week.
- 30:34Speaker 7: In his scathing letter, Berg writes, I have, at no
- 30:37Speaker 7: time ever embezzled any funds from the Pi Kappa Alpha fraternity.
- 30:42Speaker 7: What an erroneous assumption. Unfortunately, I will be unable to
- 30:46Speaker 7: participate in your Perry Mason game. If for some reason, however,
- 30:50Speaker 7: you should have any questions, I suggest you direct them
- 30:54Speaker 7: to my attorney. He's paid good money to answer stupid questions.
- 31:00Speaker 14: I wrote him a letter back saying I called your attorney,
- 31:02Speaker 14: and your attorney says he's never heard of you, So
- 31:05Speaker 14: I'm still waiting. That was classic Darren puffing, up coming
- 31:10Speaker 14: up with with you know, this grandiose response and rebuttal
- 31:14Speaker 14: that if you just peel back the veneer, there's nothing there.
- 31:20Speaker 7: Where did Darren Burg go? Nobody knew for sure until
- 31:26Speaker 7: he resurfaced in Portland, Oregon, and started up an advertising business,
- 31:31Speaker 7: even bringing some of his former fraternity brothers on board.
- 31:35Speaker 7: Wait a minute, his same fraternity brothers who he stole
- 31:39Speaker 7: money from a couple.
- 31:40Speaker 6: Yeah, there was two members who worked for him.
- 31:43Speaker 7: He was able to convince them it wasn't his fault.
- 31:45Speaker 6: Yeah.
- 31:46Speaker 7: But Berg's new business venture ended up much like the
- 31:49Speaker 7: old one, a scam. This time, the US Attorney indicted
- 31:54Speaker 7: him on bank fraud charges, accusing Berg of stealing nineteen
- 31:58Speaker 7: thousand dollars from a s Portland bank in a check
- 32:01Speaker 7: kiding scheme where an individual writes a bad check on
- 32:04Speaker 7: one account and then covers it by writing a second
- 32:07Speaker 7: bad check from another account. Berg pleaded guilty, but ultimately
- 32:13Speaker 7: dodged a bullet. The slick talking Berg cooperated with cops,
- 32:17Speaker 7: gave the money back, and convinced authorities to let him
- 32:21Speaker 7: off the hook.
- 32:22Speaker 14: He ended up making some arrangements where he paid restitution
- 32:26Speaker 14: and left town. But as far as I know, his
- 32:28Speaker 14: returney brothers lost the money that they had loaned him
- 32:32Speaker 14: in that business.
- 32:33Speaker 7: From there, Berg takes his sketchy show on the road again,
- 32:37Speaker 7: heading to Seattle, where in this gleaming glass tower he
- 32:41Speaker 7: launches yet another new business venture.
- 32:43Speaker 9: Darren Berg's mortgage company, Meridian Funds, was set up to
- 32:48Speaker 9: collect money from investors and invest that money into mortgages.
- 32:52Speaker 7: But wait for it, instead.
- 32:55Speaker 9: Of using the money to buy mortgages and invest he
- 32:58Speaker 9: was living lavishly off the money, and he was placating
- 33:02Speaker 9: his investors who were getting monthly dividend payments by attracting
- 33:06Speaker 9: new investors.
- 33:08Speaker 7: That is the textbook definition of a Ponzi scheme. Darren
- 33:13Speaker 7: Berg became a master at the game of attraction. Watch
- 33:18Speaker 7: as he gives a slick sales pitch to hook prospective clients.
- 33:22Speaker 14: Key for us is to get in front of people
- 33:24Speaker 14: and get them to know who we are.
- 33:25Speaker 6: You need to know how we run our business.
- 33:27Speaker 9: Darren Berg was very convincing. And darren Berg also always
- 33:31Speaker 9: thought he was the smartest guy in the room.
- 33:34Speaker 7: But is he smart enough to outsmart the Feds?
- 33:37Speaker 9: He always thought he could stay one step ahead of everybody.
- 33:39Speaker 7: The answer is yes, and you won't believe how.
- 33:43Speaker 1: He did it. We return now to today's story the
- 33:48Speaker 1: money mirage once again. Here's Melissa McCarty.
- 33:51Speaker 7: Chris darren Berg owned two private jets several multi million
- 33:55Speaker 7: dollar homes, but the Fed say Berg and his life
- 33:58Speaker 7: were the same thing, one big fraud. Darren Burg offers
- 34:03Speaker 7: his clients big returns on real estate investments, but he's
- 34:07Speaker 7: actually running a multi million dollar scam.
- 34:11Speaker 9: He really used the trappings of wealth as a big
- 34:15Speaker 9: sales pitch to his investors.
- 34:18Speaker 7: In addition to using his client's cash to fund the
- 34:20Speaker 7: high life, he also used it to launch a lifelong obsession.
- 34:24Speaker 7: Dating back to his college days at the University of Oregon.
- 34:28Speaker 9: Darren Berg was fascinated with buses. His grandfather had been
- 34:31Speaker 9: a bus driver and he heard stories about, you know,
- 34:33Speaker 9: his grandfather driving a bus and traveling around, and that
- 34:35Speaker 9: really appealed to him, and it's stuck with him as
- 34:38Speaker 9: an adult.
- 34:39Speaker 7: So Berg cooked up the idea to launch a luxury
- 34:43Speaker 7: motor coach company with a fleet of buses catering to
- 34:47Speaker 7: high end clientele.
- 34:48Speaker 9: They were leased out to sports teams, to politicians. The
- 34:54Speaker 9: governor of Washington was running for reelection and she chartered
- 34:57Speaker 9: one of his buses for his campaign.
- 35:00Speaker 7: Like always, Berg was able to get away with his
- 35:03Speaker 7: high flying business schemes because his sleek salesmanship lured fresh
- 35:08Speaker 7: blood into his web of lies. But also, like always,
- 35:12Speaker 7: the golden boy ran off with the goal when his
- 35:15Speaker 7: bus company went south.
- 35:17Speaker 9: The key to the Pondee scheme was always having fresh investors,
- 35:21Speaker 9: you know, bringing in new cash. Early on, some of
- 35:24Speaker 9: this ones were actually legitimate, but as the years went on,
- 35:27Speaker 9: the Ponzi scheme became more prevalent, and he became deeper
- 35:31Speaker 9: and deeper in debt.
- 35:33Speaker 7: And right when the king of investor scams, Bernie Madoff,
- 35:36Speaker 7: fell from his fraudulent throne, so did darren Berg. His
- 35:40Speaker 7: elaborate house of cards came crashing down.
- 35:44Speaker 9: That just was the beginning of the end for Darren.
- 35:47Speaker 7: He was arrested for embezzling and stashing millions of dollars
- 35:51Speaker 7: in exotic offshore accounts.
- 35:53Speaker 9: When people started hearing about ponde schemes and a worry
- 35:57Speaker 9: about a crumbling housing market, coached him about getting their
- 36:01Speaker 9: investments back, and Darren didn't have the money to pave
- 36:04Speaker 9: him back, and so that set off a mad scramble
- 36:07Speaker 9: for Darren.
- 36:09Speaker 7: For years, darren Berg had lived this sweet life. Now
- 36:12Speaker 7: the fifty one year old was about to get his
- 36:15Speaker 7: just desserts.
- 36:16Speaker 9: Then they started suing him in court, and they filed
- 36:20Speaker 9: lawsuits against him, started seizing his property.
- 36:23Speaker 7: So what did Darren do? He filed for bankruptcy and
- 36:26Speaker 7: broke her to deal. To help the bankers unravel his crimes,
- 36:30Speaker 7: or so they thought.
- 36:33Speaker 9: The authorities allowed Darren Berg to participate with investigators. The
- 36:38Speaker 9: rationale was that it was a very complicated scheme, lots
- 36:43Speaker 9: of accounts, lots of paperwork, and who better than Darren
- 36:47Speaker 9: Burg to help them decipher it.
- 36:50Speaker 7: But it was all smoke and mirrors.
- 36:53Speaker 9: Darren presented himself as someone who would cooperate, so he
- 36:57Speaker 9: was allowed to move from sat to take a consulting
- 37:01Speaker 9: job in California.
- 37:04Speaker 7: It wasn't long before the Feds discovered, like so many
- 37:07Speaker 7: other people in Berg's life, they too were being played.
- 37:11Speaker 7: Darren was plotting his great escape by stashing money in
- 37:16Speaker 7: secret bank accounts in Belize.
- 37:18Speaker 9: He always thought he could stay one step ahead of everybody,
- 37:20Speaker 9: ahead of his investors, ahead of the bankruptcy court, ahead
- 37:25Speaker 9: of the FBI. He just had this confidence that he
- 37:30Speaker 9: could beat it, basically beat the rat.
- 37:35Speaker 7: But finally Berg's time had run out.
- 37:38Speaker 9: Darren Berg was charged with orchestrating Washington State's largest pontie scheme.
- 37:45Speaker 7: Berg pleaded guilty and was sentenced to eighteen years in
- 37:48Speaker 7: the federal pen for fleecing over eight hundred investors, many
- 37:52Speaker 7: of them elderly, out of one hundred and forty million
- 37:55Speaker 7: dollars in a con he ran over a decade.
- 37:59Speaker 9: He did stand before the federal judge and say that
- 38:01Speaker 9: he did these crimes intentionally. He didn't apologize. Darrenburg was
- 38:07Speaker 9: not a person to apologize.
- 38:10Speaker 7: Berg spent the next six years doing time at various
- 38:13Speaker 7: minimum security federal prisons in California.
- 38:16Speaker 16: He's not considered dangerous.
- 38:19Speaker 7: He may not be dangerous, but he is cunning. It
- 38:22Speaker 7: was at the Atwater Satellite work camp where he performed
- 38:25Speaker 7: his ultimate magic trick. He disappeared. Darrenburg was only housed
- 38:31Speaker 7: at the Atwater Penitentiary minimum security facility for about a year,
- 38:35Speaker 7: but it was enough time for him to realize the
- 38:37Speaker 7: only obstacle standing between him and freedom was a fence
- 38:41Speaker 7: similar to this, and just beyond the fence in airport
- 38:46Speaker 7: where US marshalls say it's likely Berg hopped a private
- 38:50Speaker 7: jet and began his new life as an international fugitive.
- 38:54Speaker 16: The penitentiary, it's in an open field, so there's different
- 38:57Speaker 16: means of how he could have escaped, but works on
- 39:00Speaker 16: in all leeds.
- 39:02Speaker 7: So how is it possible that Berg could simply stroll
- 39:05Speaker 7: out of a federal prison.
- 39:06Speaker 16: It's definitely difficult to escape.
- 39:10Speaker 6: You know, they do the counts.
- 39:11Speaker 16: You know everybody is washed over, but it's still possible.
- 39:16Speaker 7: Obviously, when you showed up, were you looking in all
- 39:19Speaker 7: these farmlands in the airport? Were you searching for him
- 39:22Speaker 7: literally on foot?
- 39:23Speaker 16: When the team showed up to do their initial investigation,
- 39:27Speaker 16: the investigators at the facility, they had already done their
- 39:30Speaker 16: own search, and obviously we picked up where they left off.
- 39:35Speaker 7: For now, Darren Berg's whereabouts are anybody's guests? Do you
- 39:39Speaker 7: think he's in this country? Where do you think he went?
- 39:41Speaker 14: I have little doubt that he probably is someplace where
- 39:46Speaker 14: it's warm and doesn't have an extradition treaty to the
- 39:48Speaker 14: United States. There's a number of those places in the Caribbean.
- 39:52Speaker 14: They only exists to hide money.
- 39:54Speaker 9: Where Darren Burg is right now is anybody's guess. I
- 39:57Speaker 9: wouldn't be surprised if he was in Anada, Mexico, Central America.
- 40:03Speaker 9: Nothing about where he is right now. What surprised me.
- 40:06Speaker 7: Darren Berg is now fifty five. His mug is plastered
- 40:10Speaker 7: on wanted posters all over. Tips have poured in from
- 40:14Speaker 7: around the country, but as of now, the master manipulator
- 40:18Speaker 7: is still on the lamb. Obviously one of his best schemes.
- 40:22Speaker 16: Yet he's intelligent and cunning to create a Ponzi scheme
- 40:28Speaker 16: and take millions of dollars from hundreds of people. There's
- 40:31Speaker 16: no stocking to what he's capable of.
