- 23:48Speaker 1: Justin is and has been a student at La Canyon
- 23:51Speaker 1: High School. Now, there was a some sort of a
- 23:54Speaker 1: social studies test that they did last week a very
- 23:59Speaker 1: very famous coffee shop up there in the La Canyon
- 24:02Speaker 1: area which is called Carl's or not Carl's, Cal's Place,
- 24:05Speaker 1: And we're going to talk to Justin about exactly what happened.
- 24:08Speaker 1: Turn that music down, Bud, he can't use his hands yet. Jesus,
- 24:14Speaker 1: you really kicked the shit out of him.
- 24:15Speaker 2: Yeah, you got a problem with it.
- 24:17Speaker 1: No, I don't have a o't No. Justin, welcome to
- 24:22Speaker 1: our program. How you doing, buddy?
- 24:24Speaker 5: Oh I'm not sharing it. I'm proud to be on
- 24:26Speaker 5: your program.
- 24:27Speaker 1: And Justin, along with a classmate of yours, Sissy Wallace,
- 24:31Speaker 1: you went into Cal's Place, a breakfast place there in
- 24:36Speaker 1: the l A Canyon area of La County.
- 24:38Speaker 5: Right, it's correct.
- 24:40Speaker 2: Now, why did you select this restaurant and what did
- 24:43Speaker 2: you do when you got in there?
- 24:45Speaker 5: It's a place where mister Durgan is the owner, cal Durgan,
- 24:52Speaker 5: his full name is Calvin Duran Calvin or Calvan Calvan
- 24:57Speaker 5: because he's originally born in Germany, but he came over
- 25:01Speaker 5: here and converted to not converted, but yeah, I converted
- 25:05Speaker 5: to Americanism or became American.
- 25:08Speaker 2: Yeah, I became an American citizen, right, Oh, yeah, I
- 25:10Speaker 2: think he's.
- 25:11Speaker 5: An American citizen or he still has a green green.
- 25:14Speaker 5: I made a joke with him, I said, do you
- 25:15Speaker 5: have a green card? Or do you have like a
- 25:17Speaker 5: khaki card now? Or is it light? Is it almost
- 25:21Speaker 5: like blue? And he went, I should you know, get
- 25:23Speaker 5: out of here? And I went like, okay, that's why
- 25:27Speaker 5: we did what we did because I wasn't sure if
- 25:29Speaker 5: he was an American or not.
- 25:30Speaker 2: All right, let's tell people what you did.
- 25:34Speaker 5: Well, do you want to mister Henry? No?
- 25:36Speaker 2: You I mean you said let's us No, he means
- 25:39Speaker 2: you justin you tell?
- 25:42Speaker 5: Okay, Well here's what I here's what we did. We
- 25:47Speaker 5: went in there and my friend Sissy Wallis had a
- 25:50Speaker 5: Brica underneath her like underneath her her blouse, and I
- 25:55Speaker 5: had a turban that I had stuff that I had
- 25:57Speaker 5: stuffed into a into a bag that I had some
- 26:00Speaker 5: just like I bought a comic book, and I bought
- 26:02Speaker 5: or not a comic book, but I bought it was
- 26:04Speaker 5: more like a a I guess, an illustrated novel.
- 26:09Speaker 2: Okay, mister Henry, Yeah, okay, fine, fine, all right.
- 26:11Speaker 5: So anyway, and when we went into mister Durgan's restaurant,
- 26:17Speaker 5: he says, hey, how you doing justin I go, oh, fine,
- 26:18Speaker 5: mister Durgans, remember you said that you may still have
- 26:21Speaker 5: a green cart. He goes, yeah, he goes, what about it?
- 26:23Speaker 5: I go, remember when I said it's probably still just
- 26:26Speaker 5: taki or blue. He goes, yeah, what about that? I go,
- 26:29Speaker 5: just just I'm asking you if you just remember nothing more.
- 26:32Speaker 5: And he goes and he kind of looked at me
- 26:33Speaker 5: like I was weird. So he turned around and went
- 26:35Speaker 5: back to the kitchen and I sat down, and so
- 26:39Speaker 5: it's just now. This is on Sunday, at about eleven thirty.
- 26:42Speaker 5: Every Sunday, he comes out and makes a speech to
- 26:45Speaker 5: the people that are assembled there in the restaurant about
- 26:49Speaker 5: how wonderful it is to be an American and how
- 26:52Speaker 5: he thinks there's going to be like a terrorist attack
- 26:55Speaker 5: and you know we're you know, not protected and all
- 26:58Speaker 5: this stuff. So when we heard him do that, I thought, okay,
- 27:01Speaker 5: this would be the perfect time to do it. So
- 27:03Speaker 5: he came out and now, hold on for just a minute.
- 27:06Speaker 5: I want to be clear on what do you mean?
- 27:08Speaker 5: You went in there and asked him about do you
- 27:10Speaker 5: remember what? No? I asked him. I said, do you
- 27:12Speaker 5: remember when you said you had a green card? He goes, yeah.
- 27:15Speaker 5: I said, you probably had it so long that it's
- 27:17Speaker 5: like a blue card now, or maybe even TACKI He goes, yeah,
- 27:20Speaker 5: what about He's getting kind of pissed off. I go nothing.
- 27:22Speaker 5: So that's when he turned around.
- 27:23Speaker 2: All right, So he turns around. So you were taunting him.
- 27:26Speaker 5: I wasn't really so much taunting him as I was
- 27:28Speaker 5: just I was hold on for a minute, slow down,
- 27:33Speaker 5: justin your Yeah. I wasn't so much taunting him as
- 27:36Speaker 5: I was. I was saying to him, just do you
- 27:40Speaker 5: remember do you remember?
- 27:41Speaker 2: Okay, do you remember? Because you're getting him ready for something, well,
- 27:45Speaker 2: I mean.
- 27:45Speaker 5: It's not like I'm a little bit of him up
- 27:48Speaker 5: for it.
- 27:48Speaker 2: Oh what are you talking?
- 27:49Speaker 4: About we're talking about a grown beat. Why do you
- 27:51Speaker 4: have to introduce something sexual like that?
- 27:53Speaker 5: What is that?
- 27:53Speaker 2: Yah?
- 27:53Speaker 6: That's very very extremely.
- 27:55Speaker 2: Wrong of you.
- 27:56Speaker 5: Well, I mean, mister Ry goes, you know, you're getting
- 27:58Speaker 5: him ready for something.
- 27:59Speaker 2: You know exactly what I meant?
- 28:01Speaker 5: All right? Well, yeah, I was sort of getting him
- 28:02Speaker 5: ready for there was going to be a surprise, not
- 28:05Speaker 5: getting him ready like you know, take three fingers of loob.
- 28:07Speaker 4: And I didn't say anything of that sort. All right,
- 28:10Speaker 4: you know you went, I didn't say that, So you
- 28:12Speaker 4: have the same problem he had.
- 28:13Speaker 5: Yeah, I'm sure you went kind of your tongue kind
- 28:16Speaker 5: of did lose loose muscular control?
- 28:19Speaker 6: It did film.
- 28:20Speaker 2: Okay, thanks a lot.
- 28:21Speaker 1: So anyway, now you've set this guy up for some
- 28:25Speaker 1: kind of thing that's about to happen.
- 28:26Speaker 5: Well, it's not really. I just said, do you remember Haunt?
- 28:28Speaker 5: Do you remember? And he goes, yeah, he looks all irritated.
- 28:32Speaker 6: Erriottd too haf to do him. Do you remember hun?
- 28:34Speaker 2: Do you remember?
- 28:34Speaker 5: Yeah?
- 28:34Speaker 2: You didn't.
- 28:35Speaker 5: Well, I mean I was just simply trying to say
- 28:37Speaker 5: to him, do you remember the time? Do you remember Hank?
- 28:39Speaker 5: Do you remember?
- 28:40Speaker 2: Okay? All right, so you said that and you got
- 28:41Speaker 2: him dutifully pissed off, right.
- 28:44Speaker 5: I got him how pissed off?
- 28:46Speaker 2: So he but in other words, he got pissed off.
- 28:48Speaker 5: Yeah, I got pissed off. So he comes back out,
- 28:51Speaker 5: and I know he's going to make the speech that
- 28:52Speaker 5: he makes every single Sunday at eleven thirty, and he'll
- 28:57Speaker 5: go like, yeah, ladies and John, and my name is
- 29:00Speaker 5: Cal Jurgen or cal Van Durgen. I'm a native of Germany,
- 29:04Speaker 5: but I am a American. And that's when I said,
- 29:09Speaker 5: are you you know? And then Sissy sort of kicked
- 29:12Speaker 5: me not to say. I was going to say, are
- 29:14Speaker 5: you sure you're American? Or do you have just a
- 29:16Speaker 5: khaki card? You know?
- 29:18Speaker 2: Why? Why did you have it in for this guy?
- 29:20Speaker 5: No, no reason, just because I wanted to experiment, you know,
- 29:25Speaker 5: experiment with all you were about to do. But we
- 29:28Speaker 5: thought we would go into his restaurant because he's the
- 29:31Speaker 5: guy that was like talking all about how you know
- 29:33Speaker 5: America is going to be attacked to him by a
- 29:35Speaker 5: tear by a tourist. Not a tourist, a tear.
- 29:39Speaker 1: A terrorist, yeah, a terrorist. And all right, so you
- 29:43Speaker 1: went in there, she's hiding a burka. You got a turbine,
- 29:46Speaker 1: Am I correct? And assuming that at some point you
- 29:48Speaker 1: put those on, Yes, sir, yes we did.
- 29:51Speaker 6: At what point?
- 29:52Speaker 5: Well, about five minutes in, at the five way mark
- 29:54Speaker 5: of his speech, which goes on for about fifteen minutes,
- 29:57Speaker 5: and he talks about America is a great country, and
- 29:59Speaker 5: he talks about how we're probably gonna get attacked again
- 30:02Speaker 5: by a tourist.
- 30:03Speaker 2: And he talks about by a not a tourist. Why
- 30:06Speaker 2: get you get that word right? What's wrong with you?
- 30:07Speaker 5: Man? What's wrong with me? Oh? My god?
- 30:10Speaker 2: Yeah, terrorist, not tourist, stranger.
- 30:13Speaker 5: I'm on the program. I'm trying to remember all all
- 30:15Speaker 5: the details.
- 30:16Speaker 3: Don't remember all the details. You remember all that stuff
- 30:18Speaker 3: you don't need a member, like how you're giving him
- 30:21Speaker 3: crap and everything. Forget about all the shit about how
- 30:23Speaker 3: you're saying to him.
- 30:24Speaker 1: Hey, mister Durgan, do you remember when I asked you
- 30:27Speaker 1: about your khaki card.
- 30:28Speaker 5: Well, I think it's pretty pivotal in that he was
- 30:31Speaker 5: getting irritated, all.
- 30:32Speaker 1: Right, So you figure it's pivotal that you got him
- 30:34Speaker 1: irritated by taunting him with the khaki card thing.
- 30:37Speaker 4: Well, I don't think it was taunting him, obviously, it
- 30:39Speaker 4: was taunting him justin because he looked irritated, as you say,
- 30:44Speaker 4: and you did that just before he was going to
- 30:46Speaker 4: come out and make this speech. Now go ahead and continue,
- 30:49Speaker 4: all right.
- 30:49Speaker 5: I mean, so he comes out, he's talking about America,
- 30:52Speaker 5: how bitching everything is, and how bitching it's all going
- 30:55Speaker 5: to be, and we're like, yeah, yeah, whatever, whatever, and
- 31:00Speaker 5: uh uh.
- 31:00Speaker 2: Were you saying that out loud?
- 31:01Speaker 5: No? But I mean I was gonna say, hey, what
- 31:04Speaker 5: about your Kaki card? But that's when Sissy, you know't
- 31:06Speaker 5: pinch me, and you know, pinch me pretty hard. And
- 31:09Speaker 5: I did go uh like that. I did try to
- 31:11Speaker 5: stifle it, but I think he then he looked over
- 31:13Speaker 5: at me again and he got even more irritated. You know.
- 31:17Speaker 2: All right, now hold on for a minute.
- 31:19Speaker 5: You already know this guy's getting irritated because you asked
- 31:21Speaker 5: him about his Khaki card and this sissy pinched your
- 31:24Speaker 5: real hard. Yeah she did, she did. All right, go ahead,
- 31:28Speaker 5: go on, okay, So he goes, yeah, an American, we're
- 31:31Speaker 5: gonna be attacked again. And that's when I elbowed Sissy
- 31:35Speaker 5: and I said, okay, uh five seconds, four seconds, because
- 31:39Speaker 5: I did like a countdown general, you know, how they
- 31:42Speaker 5: do in the army. Well, we don't do countdowns in
- 31:44Speaker 5: the army that way, but is just go ahead with
- 31:46Speaker 5: your don't look at kid, don't try to tie this
- 31:47Speaker 5: in tending military operation. Well that's what I did. I went, okay,
- 31:51Speaker 5: fine for and I'm doing it really light, you know, fine,
- 31:55Speaker 5: four three two one, salaam is. It was the keyword.
- 32:01Speaker 5: She slipped the burka on.
- 32:03Speaker 2: So you guys are doing some countdown. Did he hear that?
- 32:05Speaker 5: Oh yeah he did. He looked over and he got
- 32:07Speaker 5: even really pissed off. He was looking all yeah, like
- 32:11Speaker 5: his face was scrunched up, you know.
- 32:12Speaker 2: All right, So first you ask him if he's got
- 32:14Speaker 2: a Khaki card. He looks pissed. Then he asked this guy.
- 32:17Speaker 1: Then you get pinched and you go oh, and he
- 32:19Speaker 1: looks really pissed, And then you went salaam.
- 32:22Speaker 5: Well, I think he heard the countdown too.
- 32:24Speaker 2: You didn't give this guy a chance to give this
- 32:26Speaker 2: speech at all, did you.
- 32:27Speaker 5: Yeah, he's giving it. He's five minutes in it. The
- 32:29Speaker 5: five way mark. You know, we mean the five way mark,
- 32:32Speaker 5: I mean at the five second mark.
- 32:34Speaker 2: All right, So you went salaam on when her burka
- 32:37Speaker 2: on went your turbine.
- 32:38Speaker 5: Yeah, and that's when he turned and he looked at me,
- 32:40Speaker 5: and I had on the turbin and she had on
- 32:43Speaker 5: the burka, and that's when we both together we went
- 32:45Speaker 5: no no, no, now no, no, no, now no no
- 32:50Speaker 5: do doo doom doo doo doom doo doo doo doo
- 32:52Speaker 5: like that.
- 32:53Speaker 2: And so you did that fake Arab song that they
- 32:56Speaker 2: do in the cartoons.
- 32:57Speaker 5: Well, mister Enery, I'm not familiar with how fake it is.
- 33:00Speaker 2: Now, mister Henry's absolutely right. It's that goofy cartoon song. Yes,
- 33:05Speaker 2: we all know. It's like the snake charmer song. What
- 33:08Speaker 2: the snake charmer song?
- 33:09Speaker 5: Yeah?
- 33:09Speaker 7: Tell me guys, you got a charm of snake out
- 33:11Speaker 7: of a basket?
- 33:13Speaker 5: Yeah? Okay, man, do you want to talk about charman
- 33:15Speaker 5: a snake? Shit?
- 33:16Speaker 6: No, nothing, don't even talking about it.
- 33:18Speaker 2: Snake charming India, You have.
- 33:19Speaker 5: A dickmens all like you ever tell you your charm
- 33:21Speaker 5: your snake? Hey man, speak for yourself on that.
- 33:24Speaker 1: All right, look at Jason before I hang up on you,
- 33:27Speaker 1: I want this to take an decidedly adult turn.
- 33:30Speaker 2: Okay, now you've been tauting this.
- 33:31Speaker 5: Guy, Streenery. I'm just telling you what we did for
- 33:33Speaker 5: school project.
- 33:34Speaker 6: You did this for a school project.
- 33:36Speaker 2: You pissed this guy off for a school project.
- 33:38Speaker 1: Just what you did, no, sir, No, sir, Yes, you
- 33:41Speaker 1: did your school project pissing off some guy who's an
- 33:44Speaker 1: immigrant who may or may not be a citizen because
- 33:47Speaker 1: he happens to love this country.
- 33:49Speaker 5: Well, a guy's been here for, like, you know, twenty years.
- 33:52Speaker 2: How can you be here for twenty years and and
- 33:54Speaker 2: only have a green card?
- 33:55Speaker 5: Is that?
- 33:55Speaker 2: Is that possible? I don't know. Possibly, I'm telling you, mister.
- 33:59Speaker 5: And he's got a khanky.
- 34:00Speaker 2: But you don't even know if the guys a citizen
- 34:01Speaker 2: or not? Do yet?
- 34:02Speaker 5: Well? I asked the guy. He didn't tell me. He
- 34:04Speaker 5: just goes, what what you know that? So?
- 34:07Speaker 2: So you did that?
- 34:09Speaker 7: So you did the cartoon song?
- 34:11Speaker 5: Well no, so he goes. So he goes, hey, what
- 34:14Speaker 5: are you kids doing? And we go. I go five
- 34:17Speaker 5: four three two one. She puts on the book. I
- 34:19Speaker 5: put on it on a turbine and I go, you know,
- 34:21Speaker 5: do do do do do do do do do do
- 34:24Speaker 5: do And he stopped and he's looking at it. He's going,
- 34:26Speaker 5: shut up, shut up, do do do do do do
- 34:29Speaker 5: do do do do Like that okay, and why what
- 34:33Speaker 5: did he do? He threw us out, He grabbed us
- 34:34Speaker 5: and pushed us out. He goes, get out of here,
- 34:36Speaker 5: Get out of here, get out of here. And I go,
- 34:38Speaker 5: I got a constitutional right. He goes, no, you don't.
- 34:40Speaker 5: I have the right to refuse service. I go yeah,
- 34:44Speaker 5: to a dude's that that's wearing to a dude's what's
- 34:47Speaker 5: that are that are wearing burkas?
- 34:49Speaker 2: You know, to a dude or dudes?
- 34:52Speaker 5: He said, I have the right to refuse service. And
- 34:54Speaker 5: I go yeah to a.
- 34:55Speaker 2: Dude's two dudes?
- 34:57Speaker 5: You mean no, I said, to a dude's that are
- 35:00Speaker 5: both wearing burkas?
- 35:01Speaker 2: To a dudes that are both wearing burkas?
- 35:04Speaker 5: All right, well, GOVI sarn your nitpicking. Nat. The point
- 35:06Speaker 5: is I had on a I didn't have a burke on.
- 35:09Speaker 5: I had on a turban. Well, what did you do
- 35:11Speaker 5: it for?
- 35:11Speaker 2: What was the point of it?
- 35:13Speaker 5: It was a social It was a social studies experiment
- 35:17Speaker 5: that we did for mister Blondell's class to show how
- 35:20Speaker 5: you know the limits of free of free speech in America.
- 35:24Speaker 5: And we showed that there is done.
- 35:26Speaker 1: Not really all right, You don't seem to understand the
- 35:29Speaker 1: whole idea of a business license owner who enjoys the
- 35:34Speaker 1: freedom to remove from his business anyone that is upsetting
- 35:37Speaker 1: the clientele or anyone that is disturbing the business.
- 35:41Speaker 5: Well, but mister Henry, I thought you said the last
- 35:43Speaker 5: time we talked that if you have a license to
- 35:46Speaker 5: do business with the public, then you're supposed to let
- 35:49Speaker 5: people be in there.
- 35:50Speaker 1: I was talking about the discrimination against people based upon race, color,
- 35:54Speaker 1: creed in the Public Accommodations Act of the Civil Rights Act.
- 35:58Speaker 1: You cannot discriminate against people in those grounds. You have
- 36:01Speaker 1: to serve them if you have a license to do
- 36:04Speaker 1: business with a public, a public business license.
- 36:06Speaker 2: That's different from.
- 36:07Speaker 1: Having to put up with two clowns that are trying
- 36:10Speaker 1: to disrupt his business.
- 36:11Speaker 2: Which is what you were doing now, Jason.
- 36:14Speaker 4: I am very sympathetic to the liberal cause, and I'm
- 36:17Speaker 4: very sympathetic to the plight of our Arab friends.
- 36:20Speaker 2: And I'm certainly not very.
- 36:22Speaker 4: Sympathetic to some old crone who's living over here may
- 36:27Speaker 4: not be a citizen.
- 36:28Speaker 2: I don't know. Cal Van Durgan, that's very very suspect. Now,
- 36:32Speaker 2: Nevanish German. So the name is going to be roused differently.
- 36:35Speaker 2: Uh huh, but I will not what do you mean,
- 36:38Speaker 2: uh huh that get sidetracked.
- 36:41Speaker 4: But I will not abide two young people such as yourselves,
- 36:45Speaker 4: mocking that man's speech that he gives to his clientele
- 36:48Speaker 4: about America wearing a burka and a turban.
- 36:51Speaker 2: And by the way, what do you mean a turban?
- 36:54Speaker 5: Well, I mean it was a turban from I got
- 36:56Speaker 5: from the Magic store.
- 36:58Speaker 1: I realized that the first of all those turbans that
- 37:01Speaker 1: don't wear in the Middle East, those are like Indian turbans.
- 37:04Speaker 5: Well, I got it from the magic store.
- 37:06Speaker 2: I don't know where did you get the burka?
- 37:08Speaker 5: Sissy made it. She just took some sheets, we died
- 37:10Speaker 5: them black and then stitched them together and put a
- 37:12Speaker 5: hole in the middle of it. And he's all like, hey,
- 37:15Speaker 5: cut it out, cut it out, your kids, And we're like,
- 37:17Speaker 5: doo do do do do do do do? And we
- 37:22Speaker 5: were trying to do the free speech and he wouldn't
- 37:24Speaker 5: let us.
- 37:24Speaker 6: You guys are idiots.
- 37:25Speaker 7: Man had that free speech.
- 37:27Speaker 2: That's not free speech.
- 37:29Speaker 1: Well how do you figure that, man, because, like Phil said, oh,
- 37:32Speaker 1: a general general this because, as I said, you cannot
- 37:36Speaker 1: go into someone's business and disrupt it. That is not
- 37:39Speaker 1: part of your constitutional That is not part of your
- 37:42Speaker 1: right as a citizen who is entering a place that
- 37:45Speaker 1: is doing business with the public.
- 37:46Speaker 2: If a business says we're doing business with.
- 37:48Speaker 1: The public, they are legally bound to serve that public
- 37:54Speaker 1: legally bound, or they can lose their business license.
- 37:57Speaker 2: As it turns out, Uh, you overstep that.
- 38:00Speaker 1: You went in there, and you weren't just being a
- 38:02Speaker 1: citizen who was partaking of this service that they were providing.
- 38:07Speaker 1: You were mocking, you are disrupting, you were causing the problem.
- 38:10Speaker 1: You were interrupting the guy's speech, and to that end,
- 38:14Speaker 1: you were violating the law yourself.
- 38:17Speaker 5: But mister Henry was still it was civil disobedience and everything,
- 38:20Speaker 5: all right, So that's civil disobedience.
- 38:21Speaker 1: Then you admit you're breaking the law. What do you
- 38:24Speaker 1: mean you admit you're breaking the law If it's civil disobedience.
- 38:27Speaker 7: Don't you understand too? Good?
- 38:29Speaker 5: Yeah, I bet you couldn't even under explain it or
- 38:33Speaker 5: whatever you want to say.
- 38:34Speaker 3: Yeah, if you do civil disabassin, explain it. If you
- 38:36Speaker 3: do civil disobedience, you're disobedient to it.
- 38:40Speaker 2: Well, does that mean disobedience to it?
- 38:41Speaker 5: Man?
- 38:42Speaker 1: I mean that when you're civilly disobedient. You know you're
- 38:46Speaker 1: breaking the law, and you do it anyway for a
- 38:49Speaker 1: higher moral purpose.
- 38:51Speaker 5: Yeah, that's what we were doing.
- 38:52Speaker 1: Okay, then you should have been prepared to be arrested,
- 38:55Speaker 1: not sit there and claim that you get free speech.
- 38:58Speaker 5: What about the lady in in.
- 39:01Speaker 2: In Kentucky?
- 39:03Speaker 5: Is that what it's called?
- 39:04Speaker 2: Yeah, it's a state. Ever heard of it?
- 39:06Speaker 5: Yeah, I'm sorry. What about that lady?
- 39:08Speaker 2: What about her?
- 39:09Speaker 5: Well, she's trying to get out of jail and everything.
- 39:12Speaker 5: That lady.
- 39:12Speaker 1: If she's practicing civil disobedience, then she should accept her
- 39:16Speaker 1: jail term. Now her lawyer is trying to get her
- 39:18Speaker 1: sprung based upon some legal grounds. However, I'm not I
- 39:23Speaker 1: don't see that she's admitting that she didn't break that
- 39:26Speaker 1: she's breaking that she didn't break the law.
- 39:28Speaker 2: See that again, Yeah, that was very confusing, feel that
- 39:30Speaker 2: she did.
- 39:31Speaker 1: I don't know that she's actually saying, no, I didn't
- 39:33Speaker 1: break the law. I'm not guilty. I think she knows
- 39:35Speaker 1: she's guilty. I think her lawyer's trying to spring her
- 39:37Speaker 1: on unless you know something else, general.
- 39:39Speaker 6: I don't.
- 39:39Speaker 1: No, I don't know anything else, but we certainly can
- 39:41Speaker 1: get to Harvey Werman back.
- 39:43Speaker 6: On here and yeah, Marvey wer Mclaw.
- 39:46Speaker 1: Call up Harvey. We just had him on the line here.
- 39:48Speaker 1: He was talking with us about the about what was
- 39:52Speaker 1: that he was talking with us about. Oh yeah, Malaysian
- 39:55Speaker 1: Air three seventy and that they're still looking for that
- 39:57Speaker 1: Harvey on the line.
- 39:58Speaker 2: Hey, Harvey, it's Phil Henry here. How are you.
- 40:00Speaker 5: I'm fine, what's going on?
- 40:02Speaker 1: I'm sorry to get you, you know, back on the program.
- 40:04Speaker 1: We've got with us here. Justin McElroy, who's a young student. Hey,
- 40:08Speaker 1: got thrown out of a restaurant on Sunday for making
- 40:10Speaker 1: fun of a guy's speech.
- 40:12Speaker 5: Uh there you I've been listening. If you're a kid,
- 40:15Speaker 5: put the you put on a burka, and you put
- 40:17Speaker 5: a turb put put the turbulet on. Well, yes, sir,
- 40:20Speaker 5: I mean I didn't put on a turblet. I put
- 40:22Speaker 5: on a I put the turbine on. You did, indeed
- 40:25Speaker 5: put it on? Now, oh yes, sir? All right, Well
- 40:27Speaker 5: that that right there. If you uh make too, if
- 40:31Speaker 5: you make to put on a turbine, then you've already
- 40:35Speaker 5: violated the law insofar as disturbing or upsetting the service
- 40:41Speaker 5: of breakfast in the establishment to your space. Now, you
- 40:45Speaker 5: say the guy was giving a speech. Well, yes, sir,
- 40:48Speaker 5: he was giving a speech about America and how much
- 40:50Speaker 5: he loved it and how and about the terrorisms. And
- 40:54Speaker 5: I go and and that's when Sissy and I go, okay,
- 40:57Speaker 5: four five three four or five? I mean, I mean,
- 41:02Speaker 5: I mean, I mean, I mean five four three two?
- 41:05Speaker 5: What salam?
- 41:06Speaker 2: Do?
- 41:06Speaker 5: Do? Do? Do? Do you know? And yeah, no, I
- 41:09Speaker 5: hear you. So you went salaam and you put your
- 41:11Speaker 5: helmet on, you put your turbine on? Right, Well, yeah
- 41:13Speaker 5: it was. It wasn't a helmet. No, I know, you
- 41:15Speaker 5: put a turbinon. And what did she put on? She
- 41:18Speaker 5: put on a burka and she put on the burger.
- 41:20Speaker 5: Now this guy is giving a speech. Now. You said
- 41:22Speaker 5: earlier that you had been mocking him. Well, I mean
- 41:26Speaker 5: I said, hey, hey, old man Durgan. Did you call
- 41:28Speaker 5: him old man Durgen? Very important? I don't know. I
- 41:31Speaker 5: might have said, hey, cal Van, all right, go ahead.
- 41:35Speaker 5: I said, uh, you're green cards so old it's probably blue.
- 41:38Speaker 5: And he goes, what did he say? Exactly? You just
- 41:42Speaker 5: went what? Let mean write that down? What what you? Uh?
- 41:46Speaker 5: Thank you? I got my who paralegal is here? Uh?
- 41:49Speaker 5: Right down and then what well then and then he
- 41:52Speaker 5: goes what And then he came out and he started
- 41:54Speaker 5: to do his speech. Now, had you put your turbinon? No, sir,
- 41:58Speaker 5: I hadn't. All right, the team out started to do
- 42:00Speaker 5: a speech and he's all, America will be attacked by
- 42:03Speaker 5: a terrorism. And what do you mean by a terror?
- 42:06Speaker 5: What did he say? That's what he said, America is
- 42:09Speaker 5: going to be attacked by a terrorism or don't want
- 42:11Speaker 5: I mean a terrorist? Yeah, because you can't get attacked
- 42:13Speaker 5: by goodhead. I got to get another pen hold on
- 42:18Speaker 5: my paralegal. Yeah, it's Dwayne. How you doing, Dwyane. I'm
- 42:24Speaker 5: just dated to get a pencil. I don't want a pencil.
- 42:26Speaker 5: I want a pen You have to You've got to
- 42:28Speaker 5: do it in pen Okay, wait a minute, and don't
- 42:31Speaker 5: grab the phone for me.
- 42:32Speaker 2: Say hi to him for us.
- 42:33Speaker 5: Okay, Bell Andrey says, hello, Dwayne him mister herey, I
- 42:37Speaker 5: do him, buddy, Okay, I have one now, all right,
- 42:41Speaker 5: take this down. Justin McElroy, Ah, heldy, justin. I'm seventeen.
- 42:47Speaker 5: Justin mclroy seventeen Injury Establishment, private restaurant to perform a
- 42:52Speaker 5: demonstration against the anti terrorist philosophy. It wasn't really against
- 42:58Speaker 5: anti terrorism, which him to make fun of the American way,
- 43:02Speaker 5: of the American way that he was, to make fun
- 43:04Speaker 5: of the American way that he was. He started singing
- 43:08Speaker 5: the fake Arab cartoon song do Do Do Do Do
- 43:12Speaker 5: of the snake Charmer. Yes, that's it, the snake Charmer.
- 43:15Speaker 5: At which time then what happened? Then? Then mister Durgan goes, Okay,
- 43:21Speaker 5: that's it, that's it. Get your hind ends out of here,
- 43:24Speaker 5: and don't ever let me see don't ever let me
- 43:26Speaker 5: see the light of day again. And he and he
- 43:28Speaker 5: kicked us out. This is very important. Did he say
- 43:31Speaker 5: don't ever let me see the light of day again? Yes, sir,
- 43:35Speaker 5: he did. He said, that's it, that's it.
- 43:37Speaker 2: Wait wait wait wait wait wait wait are you sure
- 43:39Speaker 2: you're not mishearing this?
- 43:40Speaker 5: He hey, Henry, let me interrogate my witness in my
- 43:43Speaker 5: own way.
- 43:44Speaker 4: What the hell do you think this is, because that's
- 43:46Speaker 4: very much a non secretary of you said, that's it,
- 43:49Speaker 4: that's it, Get out, and don't ever let me see
- 43:51Speaker 4: the light of day again.
- 43:52Speaker 2: I think the kids miss hearing it.
- 43:53Speaker 5: Again. Boy, you sure don't talk too good. No, mister Henry.
- 43:58Speaker 2: I meant to say the word again, mister Dary.
- 44:01Speaker 5: He said, that's it, that's it.
- 44:03Speaker 2: Let me call off sissy, Okay, don't We don't have
- 44:06Speaker 2: time for you to call her up? What did what
- 44:07Speaker 2: was said?
- 44:08Speaker 5: He said, that's it, that's it. You kids get out
- 44:12Speaker 5: of here and don't ever let me see the light
- 44:14Speaker 5: of day again. All right? So that guy said, you
- 44:16Speaker 5: kids get out of here and don't let me see
- 44:20Speaker 5: the light of day again. You got a stand, phil,
- 44:21Speaker 5: So what he was saying was something contradictory. Are they
- 44:24Speaker 5: supposed to leave? Are they supposed to turn around and
- 44:26Speaker 5: somehow abduct or otherwise impinge upon the free actions of
- 44:32Speaker 5: mister Durgan by not letting him see the light of day?
- 44:35Speaker 2: Well, this is absolute hope.
- 44:37Speaker 5: Do you know so?
- 44:38Speaker 4: Well the young man is mishearing it? Most likely was
- 44:40Speaker 4: that he said, and I don't want to see you
- 44:42Speaker 4: around here again.
- 44:43Speaker 2: Wasn't that it? Justin?
- 44:44Speaker 5: No, ma'am, No, ma'am, no, it wasn't.
- 44:47Speaker 2: Are you sure justin? Because it just doesn't make any
- 44:49Speaker 2: sense for a guy to say that.
- 44:50Speaker 5: I understand that. And I even said to him, oh, yeah,
- 44:53Speaker 5: you don't want me to blitch you see the light
- 44:55Speaker 5: of day, and he goes, what like that? All right,
- 44:59Speaker 5: don't unny words this guy? For the third time. The
- 45:02Speaker 5: third time, he goes, what like that? Yes, sir, he did, Yes, sir,
- 45:06Speaker 5: he did you get that? Dwain? Uh yeah, for the
- 45:09Speaker 5: third time. Oh, I broke my pencil. The pencils I said,
- 45:14Speaker 5: get a pen Okay, hold on, we got to get
- 45:17Speaker 5: a pen there's probably one of my briefcase. Uh hey,
- 45:22Speaker 5: mister ware mc, can I ask a question. We're on
- 45:24Speaker 5: the air right now. Okay, Well, if they call it
- 45:26Speaker 5: a briefcase, do you carry briefs like underwear? I had
- 45:30Speaker 5: to slap you, okay for three times. The guy goes there, so.
- 45:36Speaker 1: All right, so justin obviously, when you said to him,
- 45:40Speaker 1: so does that mean you want us to keep you
- 45:42Speaker 1: from seeing the light of day?
- 45:44Speaker 2: He didn't quite understand you.
- 45:45Speaker 5: Well, but he'd been doing that the whole time. He'd
- 45:47Speaker 5: been going what what what? All that shit or excuse
- 45:50Speaker 5: me all that?
- 45:51Speaker 2: Would you watch your language? Please? You're a seventeen year
- 45:53Speaker 2: old punk kid.
- 45:55Speaker 1: God man, Yeah, I agree, watch your language. So what
- 46:01Speaker 1: did you feel that he said that he understood what
- 46:04Speaker 1: you said.
- 46:05Speaker 5: I yes, I do, Yes, I do. When I go.
- 46:09Speaker 5: When he said, don't get out of here. Okay, okay,
- 46:12Speaker 5: get out of here, and don't ever let me see
- 46:13Speaker 5: the light of day again. I'm going to you. So
- 46:16Speaker 5: you don't want us to do so, you don't want
- 46:18Speaker 5: us to have you see the light of day. And
- 46:20Speaker 5: he goes, what like that, that's the third time he
- 46:23Speaker 5: done it.
- 46:24Speaker 1: Well, as long as that guy looked as bifuddled as
- 46:26Speaker 1: he did, maybe they've got a case.
- 46:28Speaker 5: Yeah, I'll say you got a case. You got a
- 46:29Speaker 5: very good case, kid. I look, I want to get
- 46:32Speaker 5: your phone number on call Phil later. I don't want
- 46:35Speaker 5: you to give me your phone number now. Whatever you're
- 46:36Speaker 5: do and I'll do it over the air.
- 46:37Speaker 2: Yeah, don't do it over the air.
- 46:38Speaker 5: Okay, it's five five five.
- 46:40Speaker 2: Don't do it over the air man.
- 46:42Speaker 5: Oh jesus. So I'll get your number later and we'll
- 46:47Speaker 5: see what we can do about this situation now where
- 46:50Speaker 5: you arrested. Yeah, I was arrested by the by the
- 46:54Speaker 5: uh Pa Junga police.
- 46:57Speaker 2: Okay, the Tahunga police.
- 46:59Speaker 5: Yeah, the police. And the guy goes disturbing, and you
- 47:03Speaker 5: were disturbing. It was probably causing a disturbance.
- 47:06Speaker 2: I would think that sounds about right, Harvey.
- 47:10Speaker 5: Yeah, I know, Margaret, thank you. I know you're married
- 47:12Speaker 5: to a lawyer, but that doesn't make you one.
- 47:14Speaker 2: I beg your part.
- 47:15Speaker 4: I'm not trying to be a lawyer, and there's no
- 47:16Speaker 4: point in insulting me and embarrassing me like that.
- 47:18Speaker 5: I'm sorry, Margaret, but I'm in the middle of consulting
- 47:21Speaker 5: with a client here. All right, very good, kid, And
- 47:25Speaker 5: I understand that your father is a dentist and is
- 47:30Speaker 5: distantly related to Bobby Dooley. Oh yeah, my father is
- 47:34Speaker 5: her brother in law.
- 47:35Speaker 2: I got Okay, what does that got to do with anything?
- 47:38Speaker 5: What has it got to do it? Because they got
- 47:40Speaker 5: working in this pro bono? Yeah, my dad has money.
- 47:44Speaker 2: Okay, great, are you guys take care of it then?
- 47:47Speaker 5: Okay, yeah, all right, Phil, we'll take care of it.
- 47:50Speaker 2: There it is.
- 47:51Speaker 1: Well, you know, there's a lot that's wrong with that
- 47:53Speaker 1: whole thing. First of all, this kid Tonning a private
- 47:56Speaker 1: business owner that bothers the hell out of me. Secondly,
- 47:59Speaker 1: this tech the County of get out of here and
- 48:02Speaker 1: don't ever let me see the light of day again.
- 48:04Speaker 2: Chares Devilla. The van was very confused. Now, what about
- 48:07Speaker 2: Ben Moistenter. The guy's confused and he doesn't know what
- 48:09Speaker 2: he's hearing.
- 48:10Speaker 3: Mister Henry's not a lawyer, will you you're not sure something?
- 48:13Speaker 3: Jeff SA's opinion? But I can give an opinion. But okay, yeah,
- 48:17Speaker 3: what about my opinion? In my opinion, no one's asking
- 48:20Speaker 3: you for your opinion? What about your opinion? Thank you
- 48:23Speaker 3: very much, Robert, you're welcome. Wait a minute, I was
- 48:27Speaker 3: asked first. Can I come next?
- 48:28Speaker 2: Okay?
- 48:29Speaker 6: Actually I should come next.
- 48:31Speaker 5: Up.
- 48:31Speaker 3: Just wait now I forgot what the question was. Glad, Yeah,
- 48:36Speaker 3: I believe that what should happen here, I forget.
- 48:40Speaker 4: No, I believe that what should happen here is that
- 48:42Speaker 4: this young man is defended. But I think at some
- 48:46Speaker 4: point the judge is going to say, no, you misheard it.
- 48:48Speaker 4: It's a nonsensical phrase. It could not possibly be construed
- 48:51Speaker 4: to mean get out of here and don't ever let
- 48:54Speaker 4: me see the light of day again, given their actions.
- 48:57Speaker 2: Now that makes sense, that makes sense. You're not a lawyer.
- 49:01Speaker 4: I don't give a sweet hot holy shit, he'll excuse
- 49:05Speaker 4: my language.
- 49:05Speaker 2: Whether I'm a lawyer or not.
- 49:07Speaker 6: It would be, it would it cannot be. You can't
- 49:10Speaker 6: could cou coo?
- 49:11Speaker 7: You said cool?
- 49:12Speaker 2: Construed is what I said.
- 49:14Speaker 7: Construed, uh, construed.
- 49:18Speaker 2: Okay, he has to fork backed off. Oh yeah, I can't.
- 49:23Speaker 1: I said, I can't defend you, bud. You bet it
- 49:26Speaker 1: did stings, don't it. You cannot construe it to mean anything.
- 49:33Speaker 4: Given the fact that these young people were causing this
- 49:36Speaker 4: disturbance put on the burka were very up, could be
- 49:39Speaker 4: heard saying five four three two one salaam uh. Then
- 49:43Speaker 4: we're singing that little made up cartoon song where you've
- 49:46Speaker 4: charmed the stank and so forth, and so I think
- 49:48Speaker 4: the judge would say it's very clear what their intent is.
- 49:51Speaker 4: And Claire is still with the intent of the restaurant
- 49:53Speaker 4: owner was in throwing that all right, come on, come on,
- 49:56Speaker 4: get out of here, and don't ever let me see
- 49:58Speaker 4: the light of day again. I think the judge is
- 50:02Speaker 4: going to say that probably what that man meant to
- 50:05Speaker 4: say was don't ever let me see you in here again. Well,
- 50:08Speaker 4: if that's what, if he even takes that into consideration.
- 50:12Speaker 2: Well I don't know.
- 50:14Speaker 1: We're gonna be back here on the world Famous Phil

- 51:09Speaker 1: in a moment now, as far as I can tell,
- 51:11Speaker 1: and they're in't a whole lot that I know of in.
- 51:14Speaker 2: This world, that is absolutely for sure.
- 51:16Speaker 1: But as far as I can tell, Dean has I
- 51:19Speaker 1: think what he's done is he's reworked go with it,
- 51:21Speaker 1: and I think he's got Amirelda singing this thing in
- 51:26Speaker 1: the clubs and they are about to embark on a
- 51:28Speaker 1: tour of the Northern California clubs and bars and well
- 51:35Speaker 1: you don't have to put it that way, sorry, nightclubs
- 51:37Speaker 1: and cabarets and really bitching places like that. Okay, So
- 51:42Speaker 1: let's get on the line here, Dean Wheeler from the
- 51:44Speaker 1: Northern California Holistic Center. Dean is again a longtime member
- 51:48Speaker 1: of our you know, of our news panel. He's been
- 51:51Speaker 1: on the program many times giving us his read, giving
- 51:54Speaker 1: us his his take on things.
- 51:56Speaker 2: But this is the very first time in a.
- 51:58Speaker 1: Long time that we've had him on to talk about
- 52:01Speaker 1: his wife, Emeralda and what she's been up to and
- 52:04Speaker 1: her musical career. Dean, as you know, it took over
- 52:07Speaker 1: the hell is that?
- 52:08Speaker 7: Man?
- 52:09Speaker 2: Hey, Dina you there? Dean? You there?
- 52:12Speaker 5: Oh? Hi? Phil? Yeah, we are here, Emarelda at I
- 52:15Speaker 5: and we're here at the hold on Rely Yeah right now, Phil,
- 52:23Speaker 5: we're rehearsing for tonight's first show at Slatterley's here in
- 52:28Speaker 5: San Francisco, where there should be a very good crowd.
- 52:31Speaker 5: We've really kicked in the promotion for this. We've been
- 52:35Speaker 5: handing out flyers all day long. Emarelda did an interview
- 52:39Speaker 5: on k CLAC kk L a K that's kk l
- 52:44Speaker 5: a k k K clack is.
- 52:46Speaker 3: What it is?
- 52:47Speaker 2: Kk l a k that's one too many call letters.
- 52:50Speaker 5: No, not, this is the digital age, Phil, what is it?
- 52:53Speaker 2: Was a digital radio session?
- 52:55Speaker 5: I'm sorry, I can't hear you very last did? Don't
- 52:59Speaker 5: let the clown still. So what we're doing right now
- 53:02Speaker 5: is simply uh, listening as very carefully as we can. Yeah, guys,
- 53:09Speaker 5: I have a little patience. Now, Wes Hurlford will be
- 53:14Speaker 5: here in a moment.
- 53:15Speaker 2: Now, that's what I understand that Wes is going to be. Uh,
- 53:20Speaker 2: Wes is going to be performing the song with Emeralda.
- 53:22Speaker 5: That's exactly right. What we wanted to do is get
- 53:24Speaker 5: Wes to perform this song with Emrelda and have it
- 53:28Speaker 5: be a I guess you could say a hybrid, you know,
- 53:32Speaker 5: a step up, you know, in many ways, the new man,
- 53:36Speaker 5: the new song, the new the new the new brew
- 53:40Speaker 5: of music in and around America. And here's Wes now, Ben,
- 53:45Speaker 5: who is it's Bill Henry. I'm mister Henry.
- 53:49Speaker 2: Hey, Wes, how are you?
- 53:50Speaker 5: I'm good?

- 53:53Speaker 5: That's right. Uh, only it's not called go, it's called Midget.
- 53:57Speaker 5: There's a midget. No, that's not what we agree Well,
- 53:59Speaker 5: that's what I'm a greet to. Well what we agree to?
- 54:03Speaker 5: You want me to back your wife singing a song,
- 54:04Speaker 5: don't you? Yes, I do. It's going to be cool.
- 54:07Speaker 5: There's a midget, and I'll give her instruction on the lyrics.
- 54:11Speaker 5: And oh my god, oh my god, are you changing
- 54:14Speaker 5: the lyrics if we're singing there's a midget? Yeah, what
- 54:17Speaker 5: the hell do you think? I'm gonna go with it?
- 54:19Speaker 5: Don't let it betray you, Wheeler. You got a long
- 54:22Speaker 5: way to go before you understand West Hurlford and he
- 54:25Speaker 5: what he's all about? What I stand for? Oh yeah,
- 54:29Speaker 5: what's that supposed to mean? Nothing?
- 54:31Speaker 2: So all right, So you guys got this together, don't
- 54:34Speaker 2: you look?
- 54:34Speaker 6: West?
- 54:35Speaker 2: It sounds like there's some contention going on there.
- 54:37Speaker 5: No, there's no contention. We're gonna do just fine. We're
- 54:40Speaker 5: gonna do just fine. Now. I've also got the band
- 54:44Speaker 5: warming up just to do. Oh you know, little warm
- 54:47Speaker 5: ups for for instance, if people want to hear the
- 54:50Speaker 5: traditional there's a midget, I don't know if they will
- 54:52Speaker 5: or not. I don't know if they will or not.
- 54:54Speaker 5: It's I got to tell you. It's been very very
- 54:56Speaker 5: tough going with that song. Dean was supposed to break
- 54:59Speaker 5: it through for me. Got your airplay on K k
