- 7:01Speaker 4: my host.
- 7:02Speaker 6: To that job.
- 7:04Speaker 10: And now.
- 7:06Speaker 7: I know you guys been want to hear from mister Legate.
- 7:10Speaker 7: I haven't had missed. We haven't talked to mister Legate
- 7:14Speaker 7: in probably about two or three months, and I wanted
- 7:17Speaker 7: to just check in with him and see how he's doing. So,
- 7:22Speaker 7: mister Legate, how were you doing this evening?
- 7:26Speaker 6: Well, I'm doing great. Should I thank you so much
- 7:29Speaker 6: for having me back at the Prince to be here
- 7:31Speaker 6: with you and mister Cornell.
- 7:33Speaker 4: Thank you.
- 7:34Speaker 7: You are welcome. So I would like for you to
- 7:39Speaker 7: introduce yourself let the audience know exactly what's going on.
- 7:48Speaker 6: Okay, Well, you know my name is James Legate. I'm
- 7:52Speaker 6: in nineteen ninety nine and before the ninety for her investment.
- 7:57Speaker 6: Any doorship who is gonna duved as the Fingo King.
- 8:02Speaker 6: It was very highly uh highly influential individual. They had
- 8:08Speaker 6: times with congressman, senators, lawyers, judges. I mean he was
- 8:13Speaker 6: in everybody's a fucket, so many attentions. Out of everything
- 8:17Speaker 6: that I read, you know, at the beginning of my job,
- 8:20Speaker 6: I know anything else, not just all I knew. They
- 8:23Speaker 6: were charged before his murder, which murder I.
- 8:25Speaker 4: Did not admit.
- 8:27Speaker 6: I asked this, like my case six day one. I've
- 8:30Speaker 6: been looking into my case and looking into my cage
- 8:33Speaker 6: and and I've been glad uh with this out of
- 8:38Speaker 6: a detectives of Silver magazine who wrote an article in
- 8:42Speaker 6: the Mad Pointies uh nineteen, I mean May twenty issues.
- 8:49Speaker 6: Murder was the first uh exculpatory evidence they was held
- 8:55Speaker 6: for me. In other words, what they been ill was
- 8:57Speaker 6: the awaitness I was looking for that day actually saw
- 9:01Speaker 6: my name as a poena attendant that I didn't do it,
- 9:04Speaker 6: totally investigator there, but they hit her. And after my
- 9:08Speaker 6: conviction twenty years later, uh, they found uh the individual
- 9:16Speaker 6: he said that had me commit this crime alive, which
- 9:21Speaker 6: during trial they actually said that they had learned that
- 9:25Speaker 6: he was killed in mexicool.
- 9:27Speaker 4: But the craziest part of my case, which I didn't
- 9:30Speaker 4: under just to.
- 9:34Speaker 6: I cannot find any case like mine where he talked
- 9:38Speaker 6: to evidence of the discovered evidence to the prosecutor saying, hey,
- 9:42Speaker 6: this guy's not dead, he's alive, which could be seen
- 9:45Speaker 6: on the documentary that the Asians were metaling her team
- 9:49Speaker 6: produced for Case at twelve on YouTube, the titles of
- 9:53Speaker 6: Conviction the Big Bokid Murder. But well, it's so crazy
- 9:57Speaker 6: is that though the guy was there and they had.
- 10:00Speaker 4: Awakened school personally had firstly overheard this man telling me
- 10:07Speaker 4: that I needed to be gore and and hurt this
- 10:09Speaker 4: person talking about mister Garcia.
- 10:12Speaker 6: Well, when they discovered that mister Simona was intact alive
- 10:18Speaker 6: now the state they actually changed her tomb. They're all
- 10:22Speaker 6: kids like, oh, it's more than likely that mister Siever,
- 10:27Speaker 6: you hit it independent cooperation to bring a case a gift.
- 10:33Speaker 6: It not even the person who had personal knowledge of
- 10:37Speaker 6: this fact. And this is where I'm at right now,
- 10:40Speaker 6: This is where I can't understand, because now if you
- 10:43Speaker 6: take away the main past character was a confuser, you
- 10:47Speaker 6: take came away, then you're taking away the person who
- 10:51Speaker 6: alledly had me commit the crime.
- 10:55Speaker 4: I'm neither or nothing.
- 10:57Speaker 6: What am I here for? I don't have.
- 11:52Speaker 11: Well, y'all, I am truly truly sorry. But apparently there
- 11:56Speaker 11: we're having some technical difficulties. Sheeannette has dropped off. We're
- 12:01Speaker 11: gonna see if she comes back on. Hopefully she will
- 12:05Speaker 11: come back on. I truly truly apologize. Meanwhile, we're gonna
- 12:11Speaker 11: play a video that she wanted to share with you guys.
- 12:18Speaker 12: And concerning apparently.
- 12:21Speaker 5: There, we're having some technical difficulties.
- 12:24Speaker 4: Sett has dropped off.
- 12:26Speaker 5: We're going to see if she comes back on.
- 12:29Speaker 12: Hopefully, So yeah, just hold on just a second. Hopefully
- 12:43Speaker 12: she will get back on.
- 12:50Speaker 13: Mister Legate has always maintained that there was more to
- 12:53Speaker 13: this case than what was presented at the trial.
- 12:56Speaker 1: Do you agree? Oh?
- 12:57Speaker 2: Absolutely. One of the sound invites that the prosecutors gave
- 13:02Speaker 2: us was that this wasn't an open and shut case,
- 13:03Speaker 2: that this was one of the easiest murder cases that
- 13:06Speaker 2: they've ever tried, and there was a lot more to this,
- 13:10Speaker 2: just the fact that Zamora is out there in existence
- 13:14Speaker 2: when they all but gave up in ever finding him.
- 13:17Speaker 2: And you know, one of the things that the prosecutor
- 13:19Speaker 2: said was, well, we couldn't bring a case against him,
- 13:21Speaker 2: you know, an im paphrasing here, But the pursuit of
- 13:25Speaker 2: justice to me means more than just are you able
- 13:27Speaker 2: to get a case against him, but are you able
- 13:29Speaker 2: to question him and even determine whether or not he
- 13:34Speaker 2: had anything to do with it? And so, you know,
- 13:38Speaker 2: there were a lot of lingering questions that I think
- 13:41Speaker 2: we helped to answer in this process. So, yes, I
- 13:45Speaker 2: agree that there was much more to this story.
- 13:47Speaker 9: Did you contact additional people who weren't in this documentary
- 13:51Speaker 9: for any additional sources? Just additional information?
- 13:55Speaker 10: I explored a lot of I don't know if conspiracy
- 13:58Speaker 10: theories is the right phrase for it, but went down
- 14:01Speaker 10: a lot of rabbit holes that were mentioned either in
- 14:04Speaker 10: the trial or in some of the appeal paperwork that
- 14:07Speaker 10: came after the conviction of Legate, and you know, spend
- 14:12Speaker 10: an extensive amount of time just making sure that those
- 14:15Speaker 10: weren't factual leaders.
- 14:20Speaker 13: Mister Legate has always maintained that there was more to
- 14:22Speaker 13: this case than what was presented at the trial.
- 14:25Speaker 1: Do you agree? Oh?
- 14:26Speaker 2: Absolutely. One of the sound bites that the prosecutors gave
- 14:31Speaker 2: us was that this wasn't an open and shut case,
- 14:33Speaker 2: that this was one of the easiest murder cases that
- 14:35Speaker 2: they've ever tried. And there was a lot more to this,
- 14:39Speaker 2: just the fact that Zamora is out there in existence
- 14:43Speaker 2: when they all but gave up in ever finding him.
- 14:46Speaker 2: And you know, one of the things that the prosecutor
- 14:48Speaker 2: said was, well, we couldn't bring a case against him,
- 14:51Speaker 2: you know, inn in paraphrasing here, But the pursuit of
- 14:54Speaker 2: justice to me means more than just are you able
- 14:56Speaker 2: to get a case against him, but are you able
- 14:58Speaker 2: to question to him and even determine whether or not
- 15:03Speaker 2: he had anything to do with it? And so you know,
- 15:07Speaker 2: there were a lot of lingering questions that I think
- 15:10Speaker 2: we helped to answer in this process. So yes, I
- 15:14Speaker 2: agree that there was much more to this story.
- 15:16Speaker 9: Did you contact additional people who weren't in this documentary
- 15:20Speaker 9: for any additional sources just additional information?
- 15:24Speaker 10: I explored a lot of I don't know if conspiracy
- 15:27Speaker 10: theories is the right phrase for it, but went down
- 15:30Speaker 10: a lot of rabbit holes that were mentioned either in
- 15:33Speaker 10: the trial or in some of the appeal paperwork that
- 15:36Speaker 10: came after the conviction of Legate. And you know, spend
- 15:41Speaker 10: an extensive amount of time just making sure that those
- 15:44Speaker 10: weren't factual leads. So a lot of you know, the
- 15:47Speaker 10: behind the scenes work that we did never even made
- 15:50Speaker 10: it into the six episodes.
- 15:53Speaker 9: What happens next?
- 15:54Speaker 1: Where there being more to follow?
- 15:55Speaker 9: In the case of James Leggate, that's a good question.
- 16:00Speaker 2: All depends I know now revealed and so it's unknown
- 16:08Speaker 2: what happened.
- 16:08Speaker 7: I don't know if you guys heard mister Legate speak
- 16:11Speaker 7: before we got the connection went down on us. But
- 16:17Speaker 7: I have a question for you right quick, mister Legate,
- 16:22Speaker 7: how do you feel?
- 16:25Speaker 5: How?
- 16:26Speaker 7: How did the justice system fail you? We know that well,
- 16:31Speaker 7: I know that by looking at the documentary that they
- 16:39Speaker 7: found the man that a cute that supposedly paid you
- 16:45Speaker 7: to do this hit. They found him alive after someone
- 16:49Speaker 7: stated that he was stabbed in Mexico. The investigative team
- 16:54Speaker 7: found him over in Mexico.
- 16:56Speaker 1: So we know.
- 16:57Speaker 7: I know that much, but I want to hear it
- 17:01Speaker 7: coming from you.
- 17:05Speaker 6: Well, yes, uh, you see, this is what I was
- 17:09Speaker 6: talking about earlier and what I've been saying, which is
- 17:11Speaker 6: really kind of crazy to me, because you know, the
- 17:15Speaker 6: argument of the state, their whole theory for this was
- 17:18Speaker 6: a hired hit. You know that even though the word
- 17:21Speaker 6: hired hit wasn't there established that has team and he
- 17:28Speaker 6: had problems with some kind of Albogado, which is an attorney,
- 17:31Speaker 6: although mister Garcia was not an attorney. He said, look
- 17:34Speaker 6: he's starting to he's having the problems. He needed protection
- 17:37Speaker 6: and he needed that man hurts well. Uh, this is
- 17:42Speaker 6: according to Jesse Hernandez, who would be Goo's real name
- 17:46Speaker 6: is one a thought of Hernan.
- 17:48Speaker 1: Uh.
- 17:49Speaker 6: What happened there is is during my trial the three
- 17:52Speaker 6: computers came up and me and said, hey, we just
- 17:55Speaker 6: learned to Uh mister Garcia wasn't actually killed him actually, Okay,
- 18:01Speaker 6: So that just says that you'res the judge, everybody and
- 18:04Speaker 6: the auden, everybody, even me with with just being believed
- 18:08Speaker 6: in what the state was president at that copen Jesse's
- 18:12Speaker 6: Jessie Hernand's personal testimony that he overheard this that's saying
- 18:17Speaker 6: that actually go ahead and hurt this man. He also
- 18:20Speaker 6: said that there were two other individuals at is so
- 18:23Speaker 6: called a meeting that I wasn't supposed to have been
- 18:25Speaker 6: in which poison of Robert most Pubert lawyers. But those
- 18:29Speaker 6: two A division boards never at my tunal. They never
- 18:32Speaker 6: testified for me, against me or anything. In other words,
- 18:35Speaker 6: I don't understand why and for those people operating testimony
- 18:39Speaker 6: that it could and helped Jesse's uh uh testimonies. So
- 18:44Speaker 6: what happens now is that when he's soever her team,
- 18:50Speaker 6: they you know, put a lot of the work into
- 18:53Speaker 6: this investigation of my case, and all they said, well,
- 18:56Speaker 6: they're trying to find the truth to unanswered questions so
- 19:00Speaker 6: dated and they certain they found that Timona was actually alive.
- 19:03Speaker 6: And so when they hired a team to go out
- 19:06Speaker 6: there and interview mister Simona, he even admitted, Hey, look,
- 19:11Speaker 6: I don't know nothing about this case. I was at
- 19:14Speaker 6: the man's funeral. He was my friend. We were never
- 19:16Speaker 6: business partners, which was the state's argument that business bumpers said,
- 19:21Speaker 6: we're not business bumpers or nothing.
- 19:24Speaker 4: Uh, I don't have him doing his murder. I'm looking
- 19:27Speaker 4: at him as sure.
- 19:28Speaker 6: Uh that ah. But now that the state learned that
- 19:34Speaker 6: he was alive, the whole tune changed. There was there's
- 19:38Speaker 6: no evidence to bring against a case again, uh, mister Simona,
- 19:43Speaker 6: not even not even Bessie Hernandez or they would even
- 19:47Speaker 6: want to get Robert montes Dy and give me an
- 19:51Speaker 6: evidentary hearing so that we could depote the records, some
- 19:54Speaker 6: of them, the records with the facts. I don't have
- 19:57Speaker 6: nothing to hide.
- 19:58Speaker 7: You know, I was, I was looking at episode five
- 20:04Speaker 7: and well, you know, you guys, when you have the time,
- 20:09Speaker 7: please go look at episode five. That's when everything the
- 20:17Speaker 7: supposedly evidence and stuff is supposed to be shown. But
- 20:24Speaker 7: you will also know mister Legate said Jesse Hernandez was
- 20:32Speaker 7: his brother name. So the little brother used the big
- 20:37Speaker 7: brother name and wants the investigation team. You know what,
- 20:42Speaker 7: go watch it. You know you will see. I want
- 20:45Speaker 7: you guys to see exactly what I've seen and look
- 20:49Speaker 7: at the face of the prosecution of look.
- 20:53Speaker 14: At one when the sound way.
- 21:28Speaker 1: But but but the.
- 21:31Speaker 2: Mean the amazing.
- 21:37Speaker 1: And you know we can culture and.
- 21:50Speaker 8: Yeah, yeah yeast.
- 22:03Speaker 1: Us after.
- 22:18Speaker 10: An instance bat and then for they never really never
- 22:26Speaker 10: made it.
- 22:29Speaker 1: What happened.
- 22:38Speaker 8: Now now now.
- 22:43Speaker 1: It was.
- 22:45Speaker 8: I really sat to talk.
- 23:00Speaker 7: Don't at.
- 23:10Speaker 8: All yet.
- 23:31Speaker 14: When when when you know, yeah, but.
- 23:41Speaker 8: But but but the start.
- 23:53Speaker 5: Anything, you know, you know a lot.
- 23:57Speaker 2: Of anything we help, we hope help.
- 24:02Speaker 4: Yeah, you come from.
- 24:13Speaker 1: A lot of period your life, Kay, have.
- 24:30Speaker 10: Dis make big don't want to back a lot, a
- 24:35Speaker 10: lot a lot of my language never never never.
- 24:42Speaker 8: Happens that yours now now now now.
- 24:56Speaker 15: Now I think they Indian when years old age share
- 25:06Speaker 15: your share.
- 25:08Speaker 2: You know your time as you don't even know how to.
- 25:17Speaker 5: Joke at something.
- 25:29Speaker 14: One of the one of the when when when they
- 25:45Speaker 14: all they are they.
- 25:46Speaker 8: I don't know how yeah yeah, but.
- 25:53Speaker 11: But but.
- 25:56Speaker 2: Joy when you.
- 26:05Speaker 4: Have anything?
- 26:08Speaker 1: You know, a.
- 26:26Speaker 16: Lot of people were happy, you know, making scuse Its
- 26:45Speaker 16: still like that, a lot of a lot of but I.
- 26:51Speaker 1: Never never never did anybody.
- 27:03Speaker 2: Now I think I think every.
- 27:24Speaker 17: Seem okay out along.
- 27:40Speaker 8: Absolutely having account.
- 27:45Speaker 4: Because when when they all.
- 28:00Speaker 2: Yeahs, but but but then.
- 28:18Speaker 1: Anything so you know you.
- 28:23Speaker 2: Help, we don't help and intend.
- 28:27Speaker 13: Yeah yeah yeah, could you want to watch the locals.
- 28:38Speaker 1: Boring just a lot of I don't know you but
- 28:43Speaker 1: we got we mentioned minute after. It makes.
- 29:00Speaker 4: A lot of work.
- 29:02Speaker 1: You never never never did.
- 29:06Speaker 13: What happened about happen the walls.
- 29:11Speaker 12: That's a good question.
- 29:15Speaker 8: They're new and now we've now now now were.
- 29:23Speaker 1: I I got what you're sharing for?
- 29:31Speaker 8: Share share share and.
- 29:34Speaker 1: Get the.
- 29:36Speaker 2: Seemingly you know you.
- 29:46Speaker 1: Are.
- 29:47Speaker 17: They work on that one a while, I would.
- 30:50Speaker 3: Garcia was shot in cold blood in the office of
- 30:53Speaker 3: his home healthcare business, and shortly after Garcia was killed,
- 30:58Speaker 3: thirty seven year old James Legate to the scene fleeing
- 31:01Speaker 3: the scene was arrested for the murder.
- 31:10Speaker 7: Okay, and we're back. I have Cornell, and I have
- 31:16Speaker 7: Cornell and mister Legate on and we were just talking
- 31:22Speaker 7: about the me and mister Gate was just talking about
- 31:25Speaker 7: the gun. Because that's kind of strange that if your
- 31:31Speaker 7: case you're still you said your this is an ongoing investigation,
- 31:36Speaker 7: and I know you still have the right to appeal
- 31:38Speaker 7: your your case right, And from what I seen on
- 31:46Speaker 7: the documentary episode five, I truly believe if I heard
- 31:52Speaker 7: it right, that the gun is no longer in.
- 31:57Speaker 5: Existence. All they had was a picture.
- 32:00Speaker 6: You're up there, Well, I do know what they If
- 32:05Speaker 6: they just destroyed it and they give me an opportunity
- 32:07Speaker 6: for a new trial, I'm gonna have to I have
- 32:11Speaker 6: that opportunity to have it tested again. No, uh, you know,
- 32:17Speaker 6: according to like I said, according to the attention closed
- 32:19Speaker 6: the criminal procedure, I have to come there someone. I
- 32:22Speaker 6: think it's thirty four seventeen or nineteen something like that.
- 32:26Speaker 6: It clearly shows the preservation of evidence, and if the
- 32:29Speaker 6: preservation of evidence they show that if for it, then
- 32:33Speaker 6: there is no more ongoing investigations.
- 32:37Speaker 4: Or they could do it that they can't.
- 33:00Speaker 6: H at the time it goes Donas County for an
- 33:42Speaker 6: aggravate for an assault charge. But I also learned that
- 33:46Speaker 6: that same case under I had to putice for the
- 33:49Speaker 6: phone number that it's still to this day on his
- 33:53Speaker 6: brother's record because he was using his brother's name. Remember,
- 33:57Speaker 6: And what the great is that the crit that through
- 34:00Speaker 6: trials she all the investigation I have right now, right
- 34:04Speaker 6: I have what they call it the prosecution guys report.
- 34:07Speaker 6: That prosecution guys report, I think all all investigating officers
- 34:12Speaker 6: in every county, every state they do this, and they
- 34:14Speaker 6: had this one their complete of their investigation to the
- 34:19Speaker 6: prosecutors so that they can build their case. All the
- 34:23Speaker 6: evidence that the prosecutors somebody that already accumulated. So throughout
- 34:30Speaker 6: all the Siboard guy I have, you know, I pounced
- 34:34Speaker 6: it and he was given to his charge all this stuff.
- 34:37Speaker 6: But during the trial he ca I mean, I'll want her.
- 34:44Speaker 6: But from the beginning of the investigation of this her
- 34:47Speaker 6: investigation he used just yourn I got every paperwork and
- 34:51Speaker 6: everybody who even testified that they said, well, missus John
- 34:57Speaker 6: and Hernanda, but he said, don't want this in her
- 35:00Speaker 6: that even his girlfriend shooting over the wheels, Well he
- 35:05Speaker 6: got the peanut. Under genesee, hernanis to go to the
- 35:09Speaker 6: grand jurors. So even in the grand jury, he died
- 35:12Speaker 6: about his whole identity. So if we think about this man,
- 35:15Speaker 6: what he did, we think or when he was to trial,
- 35:19Speaker 6: he didn't give it no name. But when he asked him,
- 35:22Speaker 6: did they promised you anything or did you get any
- 35:24Speaker 6: deals or nothing?
- 35:25Speaker 4: He said no.
- 35:26Speaker 6: Well technically, but when you go back to the original
- 35:34Speaker 6: name that he use, you're going to find that police
- 35:38Speaker 6: case that he was incited and charged for possession of compain.
- 35:44Speaker 6: Now they didn't dismiss that case for his testiment. So
- 35:48Speaker 6: that's another another area that that was just what the traditional.
- 35:53Speaker 4: System health me.
- 35:55Speaker 6: They telled me because they didn't care about justice. Him
- 36:00Speaker 6: was a conviction which they got and twenty six plus
- 36:03Speaker 6: years later, here I am playing to fight. But the
- 36:07Speaker 6: jail was that when they found it, the motive was alive.
- 36:12Speaker 6: Now they did know what to city. Oh, we can't
- 36:14Speaker 6: bring it back because we really don't have to live
- 36:17Speaker 6: the kist. We don't use it because he was he
- 36:21Speaker 6: was killed.
- 36:22Speaker 4: That's what we learned.
- 36:23Speaker 6: So we went with this kid, what do they have it?
- 36:26Speaker 4: And you President, and you.
- 36:28Speaker 7: Know, I want to jump in because you I mean,
- 36:32Speaker 7: everything that you're saying, it's in the documentary. Everything that
- 36:39Speaker 7: you're saying, I mean just by looking at the documentary
- 36:42Speaker 7: five one today so I can get caught back up
- 36:45Speaker 7: and seeing that it was two brothers but one of
- 36:50Speaker 7: the brothers didn't know that the other brother was using
- 36:53Speaker 7: his name. If the police department would.
- 36:57Speaker 5: Have did the.
- 37:00Speaker 2: More the trial, do you.
- 37:03Speaker 5: Agree it's no as should be.
- 37:06Speaker 2: One of the sound by the prosecutors say was that
- 37:09Speaker 2: this wasn't an opening case, that this is one of
- 37:11Speaker 2: the easiest cases that they've ever tried. And there was
- 37:15Speaker 2: a bage to this, just the fact that when they
- 37:22Speaker 2: all but gave up, you know, never findings and you know,
- 37:25Speaker 2: one of the things, can the case against the more
- 37:29Speaker 2: in paraphrasing, but.
- 37:30Speaker 7: He's supposed to be there to say, justice.
- 37:33Speaker 2: Means more than just are you able to do a
- 37:35Speaker 2: case against you? A question and even determine whether you
- 37:41Speaker 2: had anything to do with that. And so you know,
- 37:45Speaker 2: there were a lot of we helped imp in this process. Yes,
- 37:52Speaker 2: I agree that there was much more.
- 37:54Speaker 9: Now I know you want to contact additional people who
- 37:56Speaker 9: want the most documentary for any additional source is just
- 38:00Speaker 9: additional information.
- 38:02Speaker 10: I explored a lot of I don't know if conspiracy
- 38:05Speaker 10: theories is the right phrase for it, but went down
- 38:08Speaker 10: a lot of rabbit holes that were mentioned either in
- 38:11Speaker 10: the trial or in some of the appeal paperwork that
- 38:14Speaker 10: came after the conviction of the Gate and you know,
- 38:19Speaker 10: spend an extensive amount of time just making sure that
- 38:22Speaker 10: those weren't a lot of you know, the behind the
- 38:26Speaker 10: scenes work that we did never even made it the.
- 38:32Speaker 1: More to follow.
- 38:33Speaker 13: In the case of James Leggade.
- 38:36Speaker 8: That's a good question.
- 38:37Speaker 2: I think it all depends. I know that we've now
- 38:40Speaker 2: revealed our findings to.
- 38:42Speaker 8: All the parties involved.
- 38:43Speaker 2: We've revealed our findings, and so it's unknown what happens next.
- 38:47Speaker 2: I think there are different opinions on what avenues are available,
- 38:52Speaker 2: mister Legate now that we have found what we found
- 38:55Speaker 2: of sharing it with the public, and so that'll be
- 38:58Speaker 2: not to be determined what happens in this seemingly non
- 39:02Speaker 2: stop saga.
- 39:10Speaker 13: Most of the game has always maintained that there was
- 39:12Speaker 13: more of this case than one was presented at the trial.
- 39:16Speaker 2: Oh absolutely, from one of the sound bites that the
- 39:20Speaker 2: prosecutors gave us was that this wasn't an open and
- 39:23Speaker 2: shut case, that this was one of the easiest murder
- 39:25Speaker 2: cases that they've ever tried. And there was a lot
- 39:29Speaker 2: to this, just the fact that Zamora is out there
- 39:32Speaker 2: in existence when they all but gave up in ever
- 39:36Speaker 2: finding it. And you know, one of the things that
- 39:38Speaker 2: the prosecutor said was, well, we couldn't bring a case
- 39:40Speaker 2: against in paraphrasing him, but the pursuit of justice to
- 39:45Speaker 2: me means more than just are you able to a
- 39:47Speaker 2: case against him, but are you able to question and
- 39:51Speaker 2: even determine whether or not he had anything to do
- 39:54Speaker 2: with it? And so you know, there were a lot
- 39:58Speaker 2: of lingering questions that we helped to answer in this process. So, yes,
- 40:05Speaker 2: I agreed that there was much.
- 40:06Speaker 1: More to this story.
- 40:07Speaker 9: Did you contact additional people who wanted in this documentary
- 40:11Speaker 9: for any additional sources just additional information?
- 40:14Speaker 10: I explored a lot of I don't know if conspiracy
- 40:17Speaker 10: theories is the right phrase for it, but UH went
- 40:20Speaker 10: down a lot of rabbit holes that were mentioned either
- 40:24Speaker 10: in the trial or in some of the appeal paperwork
- 40:27Speaker 10: that came after the conviction of the Gate, and you know,
- 40:31Speaker 10: spend an extensive amount of time just making sure that
- 40:34Speaker 10: those weren't faction. There's a lot of you know, the
- 40:38Speaker 10: behind the scenes work that we did never even made
- 40:40Speaker 10: it into the destroy.
- 40:43Speaker 13: What happens next?
- 40:44Speaker 9: Will there be more to follow in the case of
- 40:47Speaker 9: James the Gate.
- 40:48Speaker 2: That's a good question. I think it all depends. I
- 40:51Speaker 2: know that we've now revealed our find needs to all
- 40:54Speaker 2: the parties involved. We've revealed ours date, and so it's
- 40:58Speaker 2: unknown what happens. I think they're differing opinions on what
- 41:03Speaker 2: avenues are available. It's the Gate now that we have
- 41:06Speaker 2: found what we found and whatever, sharing it with the public,
- 41:09Speaker 2: and so that'll be you have to be determined what
- 41:12Speaker 2: happens in seemingly NonStop saga.
- 41:20Speaker 1: To do that.
- 41:21Speaker 13: But the Gate has always maintained that there was more
- 41:25Speaker 13: of this case than where was presented at the trial.
- 41:28Speaker 1: Agree.
- 41:29Speaker 2: Oh absolutely. One of the sound bites that the prosecutors
- 41:34Speaker 2: gave us was that this wasn't an open and shot base,
- 41:36Speaker 2: that this was one of the easiest order of cases
- 41:38Speaker 2: that they don't tried, and there was a lot more
- 41:41Speaker 2: to this just the fact that somewhata is out there
- 41:44Speaker 2: in existence when they all but gave up in never
- 41:48Speaker 2: finding of them. And you know, one of the things
- 41:51Speaker 2: that the prosecutor said was, well, we could bring a
- 41:53Speaker 2: case against town, you know.
- 42:00Speaker 4: So then you go to the Bear County Chief depart
- 42:02Speaker 4: and asked him to give you an item, a list
- 42:04Speaker 4: of all the weapons that was destroyed by him during
- 42:07Speaker 4: the timeframe that the weapon was destored. And I guarantee
- 42:10Speaker 4: you they did not have that document.
- 42:12Speaker 5: So with that being said, this.
- 42:14Speaker 4: Is a whole newly discovery evidence showing that she was
- 42:17Speaker 4: literally framed by the San Antonio Police Department, the Beer
- 42:20Speaker 4: count of Medical m Office, and the state of that's
- 42:23Speaker 4: your case, lookame the thaw because.
- 42:27Speaker 10: I see it.
- 42:29Speaker 4: I see that. And the only woman, the only.
- 42:32Speaker 6: Evidence that the testimony they had regarding the gun was
- 42:35Speaker 6: Jamie Becker. She was a fire arm expert who tenestified
- 42:38Speaker 6: that she was the one who actually uh uh bought
- 42:42Speaker 6: her the weapon to make sure if they matched the
- 42:44Speaker 6: uh the shelves that were inside the gun that they found,
- 42:48Speaker 6: and she said it was and then the medical examiner
- 42:53Speaker 6: said that the bullet shelf they didn't match, uh or
- 42:57Speaker 6: she said it's the bullet that they just got a
- 43:00Speaker 6: mits Garcia they found did match pay the uh the
- 43:04Speaker 6: gun there was that they actually counted. So you know
- 43:07Speaker 6: the things that I had to go on to that
- 43:09Speaker 6: made me say, okay, well they're saying that the gun
- 43:11Speaker 6: that shot bet the Garcia. Now you know it's been
- 43:15Speaker 6: the prosecution guide report, the merchand I was talking about
- 43:20Speaker 6: uh oh, he said something earlier, and my brain just
- 43:24Speaker 6: went fly right now because I was talking about the gun.
- 43:27Speaker 6: Uh oh.
- 43:31Speaker 4: Throughout the investigation reports. Oh like on mister Hernandez, right
- 43:36Speaker 4: where they said that he was. He said to Mexico, well,
- 43:39Speaker 4: I understand this, and this is why.
- 43:41Speaker 6: I different questioned by his death. Was is because the
- 43:47Speaker 6: investigator that detected King Albright, he was the lead investigator
- 43:53Speaker 6: in this case, was a notation in there that he
- 43:57Speaker 6: contacted the Mexico or Attorney General trying to put out
- 44:02Speaker 6: a KPIs for mister Simon to see they can locate
- 44:05Speaker 6: in which the attorney General that the agent at the
- 44:08Speaker 6: head I think it name was that he said, yes,
- 44:11Speaker 6: he was gonna go ahead and do that and try
- 44:13Speaker 6: to see if you can look mister Simota. But then
- 44:16Speaker 6: like during Charlotte, Like they said that.
- 44:18Speaker 4: They learned that he was killed there. Well, it pops
- 44:21Speaker 4: in my head and question, well, if that's the case,
- 44:25Speaker 4: why did or did they not contact.
- 44:28Speaker 6: The attorney general up in to make sure that he
- 44:30Speaker 6: was actually killed? You see what I'm saying. So I
- 44:34Speaker 6: didn't know, And that's another question that talk in my
- 44:38Speaker 6: head because from the man that put to Mexico and
- 44:42Speaker 6: you contact the attorney general, but then you find out
- 44:45Speaker 6: that you wouldn't be feasible to actually trying to find
- 44:51Speaker 6: out if he was actually killed.
- 44:53Speaker 7: But you're not. I want to jump in right here.
- 44:58Speaker 7: Watching the documentary, the investigated team that was that.
- 45:05Speaker 6: Was in.
- 45:07Speaker 7: Mexico that actually went into the went into Zamora's house,
- 45:14Speaker 7: reported back to the investigating team over in Texas that
- 45:19Speaker 7: he said that he was kidnapped. It wasn't never that
- 45:24Speaker 7: he was killed or anything. He said he was kidnapped
- 45:28Speaker 7: and he finally escaped and then the uh, the prosecution.
- 45:34Speaker 7: The lady she said, well, wouldn't you be afraid you
- 45:38Speaker 7: walking around looking over your shoulders. And I'm saying to myself, like,
- 45:45Speaker 7: this is the this is the guy that supposedly set
- 45:50Speaker 7: everything in motion, that was supposed to have paid for
- 45:56Speaker 7: a hit and you feeling sympathy for him him because
- 46:00Speaker 7: he quote unquote said he was kidnapped.
- 46:03Speaker 5: The man ran away.
- 46:04Speaker 7: What would another woman divorced? His wife left his business?
- 46:10Speaker 7: You know what, you guys, go watch episode five. I mean,
- 46:14Speaker 7: it's a documentary. And when I talk about when I
- 46:20Speaker 7: see the injustice, and that's why I'm so passionate. You know,
- 46:27Speaker 7: go watch the whole documentary from one all the way
- 46:31Speaker 7: to six. You will see what I see. You know,
- 46:35Speaker 7: no gunshot residue on his clothes, on his hand, no
- 46:40Speaker 7: blood splatter on him. It's a taco a tacos thing.
- 46:46Speaker 7: They say that he was sitting in the bar case
- 46:50Speaker 7: in the place. He's repollman. What do bring people that
- 46:55Speaker 7: repossessed cards?
- 46:57Speaker 6: Do?
- 46:57Speaker 7: They sit and they watch and they take down life
- 47:00Speaker 7: and plates number. They know they know where you work
- 47:03Speaker 7: at because you don't put the addresses down on the
- 47:07Speaker 7: paper on your finance papers.
- 47:09Speaker 5: They know where you stay at.
- 47:11Speaker 7: He's a repoman.
- 47:12Speaker 17: And then.
- 47:15Speaker 7: What if what if you hire hitmen? What hit man
- 47:21Speaker 7: is going to leave his car at the scene of
- 47:24Speaker 7: a crime.
- 47:27Speaker 17: And leave his and leave his.
- 47:30Speaker 7: Identification, leave everything in his car? You know, it's articles
- 47:37Speaker 7: I sent mister Legate articles of what was you know,
- 47:42Speaker 7: what was saying about him in these articles. I wish
- 47:47Speaker 7: you guys can read these articles because if you see
- 47:52Speaker 7: the names that's associated with mister Legate's case, it's no
- 48:02Speaker 7: way he should be sitting in there. He was just
- 48:06Speaker 7: an escape goat. That's all they used him. They use him.
- 48:18Speaker 7: Please go go watch the documentary they have a it's
- 48:22Speaker 7: a he's an innocent man. He done gave. Like I'm
- 48:26Speaker 7: gonna keep saying this the state of Texas, twenty six years.
- 48:30Speaker 1: Of his life.
- 48:33Speaker 7: For nothing. Okay, let me let my co hosts jump in,
- 48:40Speaker 7: because I feel my blood pressure kind of rising.
- 48:43Speaker 4: Yes, ma'am, Yes, ma'am, Well, thank you, Ma'am's gate, sir.
- 48:48Speaker 4: I'm going to the other side. And when I get
- 48:51Speaker 4: to the other side, the first thing I'm going to
- 48:53Speaker 4: do it go to the city Hall to speak to
- 48:55Speaker 4: the sitting there, the city councilor the county commissioners, the county,
- 49:00Speaker 4: the chief of police, the FBI and everybody, and I
- 49:03Speaker 4: am going to go have them to put up all
- 49:05Speaker 4: of the documents about this weapon. Why because this gun
- 49:09Speaker 4: is puzzled in me and I know it can't be
- 49:11Speaker 4: the murder. The wespons, sir, you have been delivered the
- 49:14Speaker 4: same fire, the police department, the medical time of office,
- 49:17Speaker 4: and the state of tests. They do this every day.
- 49:20Speaker 4: So my point to you, sir, is that as of
- 49:23Speaker 4: right answer, you are chasing what they know you'll never catch.
- 49:27Speaker 7: So what you have to do you have to go.
- 49:30Speaker 4: Back and disprove everything they say they did to you.
- 49:34Speaker 4: Iron out about that murder weapon, because the murder weapon
- 49:37Speaker 4: is what's lincoln you to the crime. Despite the fact
- 49:39Speaker 4: that this guy says that he sells you or he
- 49:42Speaker 4: told you to do this and you saw you get
- 49:44Speaker 4: a gun. Word, the murder weapon is the worst pieces
- 49:46Speaker 4: of it there. The churyself links you to the crime.
- 49:50Speaker 4: Why because the balistic expert testify to it, and the
- 49:53Speaker 4: medical examiners testified that that was to pull it from
- 49:55Speaker 4: the from the gun that was used. So mind yourself
- 49:59Speaker 4: and min okase. The domestic expert never tested the gun,
- 50:03Speaker 4: but he tests the fire. To my trub the homicide
- 50:06Speaker 4: detective buying them say that he tested the gun. Guess what,
- 50:09Speaker 4: he never tends the gun to be test fired. So
- 50:11Speaker 4: you have been deliberately framed by nothing belized by the
- 50:14Speaker 4: barat County, distant Tourney's office, the police department, and the
- 50:17Speaker 4: medical examiners officer. So for me to you some I
- 50:21Speaker 4: know your police and I am going to do what
- 50:24Speaker 4: I can to try to get you to help. And
- 50:26Speaker 4: if for anybody's listening to this podcast tonight, we would
- 50:29Speaker 4: like to actually for you to join mister Lagate and
- 50:31Speaker 4: his fight to seek justice. How why us action for
- 50:35Speaker 4: y'all to sign on some petition to the distric Attorney's office,
- 50:38Speaker 4: the chief of police, the city mayor and anybody to
- 50:41Speaker 4: have them to pull up all the documents related to
- 50:44Speaker 4: the weight bouts of the gun, How was test fired,
- 50:47Speaker 4: went on, test fired, will test fire and how? And
- 50:50Speaker 4: I guarantee you that that stuffing is going to come
- 50:52Speaker 4: back proven that it's not the murder work and that
- 50:55Speaker 4: it was never removed from a property room, because you've
- 50:57Speaker 4: got to have property tax showing that it was removed
- 51:00Speaker 4: and that property tag has to be signed by a
- 51:02Speaker 4: division commander. If that never happened, mister Legate's case is
- 51:07Speaker 4: no good and they would have to give us the
- 51:09Speaker 4: legate of loot our that just proved stay whole case
- 51:12Speaker 4: right that. Yeah, mister Lagate, I'm sorry to start that
- 51:15Speaker 4: just happened to you like this, for I would do
- 51:18Speaker 4: what I can. I actually the audience whatever that's supporting this,
- 51:21Speaker 4: to support this Legate and see if we can get
- 51:23Speaker 4: enough to legated lout by accidents of damn to give
- 51:27Speaker 4: us the information about the girl probably tag yes.
- 51:33Speaker 5: And all we got.
- 51:35Speaker 7: We got nine minutes left. So mister Legate, I'm gonna
- 51:39Speaker 7: give you the I'm gonna give you a chance to
- 51:45Speaker 7: to say you're a party your uh speech. My my
- 51:49Speaker 7: pressure done went up a sky high, cause you know
- 51:51Speaker 7: how I give about you, mister Legate. So I'm gonna
- 51:59Speaker 7: give you six oh and remarks and then we're gonna
- 52:02Speaker 7: shoot back to my cohorts and then I may say
- 52:07Speaker 7: a word too. I'm just over here just trying to
- 52:09Speaker 7: calm down. You know, I'm just so passionate about this,
- 52:13Speaker 7: and I don't like what the justice system is doing.
- 52:18Speaker 7: Two our men, our brothers. You know, it's unbelievable. It's unbelievable,
- 52:28Speaker 7: mister Legate.
- 52:32Speaker 4: Oh thank you, Angela.
- 52:34Speaker 6: And let your court know for everything that uh, your
- 52:37Speaker 6: your your your suggestions, you're inputing everything, everything that you're doing.
- 52:40Speaker 6: I appreciate it. But like I I continue to shave
- 52:44Speaker 6: you off. I know, the outside audience. If you have
- 52:48Speaker 6: a curiosity, look at the documentary. You don't have to
- 52:51Speaker 6: believe in what I say.
- 52:53Speaker 4: Look at the evidence for yourself.
- 52:54Speaker 17: See what you to see.
- 52:56Speaker 6: I mean, if you like like mysteries or mother Streets
- 53:00Speaker 6: and get anything to that fashion, look at it. I mean,
- 53:04Speaker 6: I've done anything and everything possible I could do. You
- 53:07Speaker 6: could just coople my navy people have everything up about
- 53:10Speaker 6: my case. You's gonna have the documentary, You're gonna have
- 53:13Speaker 6: the stories written.
- 53:14Speaker 4: You're gonna you're gonna learned about everything about my case.
- 53:17Speaker 4: Formulating the opinion.
- 53:19Speaker 7: How you see it?
- 53:21Speaker 6: How do you see justice? How do you see the
- 53:23Speaker 6: judicial system? Are they write, how they correct them, how
- 53:27Speaker 6: they they plagued their head and this you know, I mean,
- 53:31Speaker 6: just think about it, even in and I'm gonna use it.
- 53:34Speaker 6: My Robert Robertson's case where they gave him a thirty
- 53:37Speaker 6: p state. Oh he was trying to be executed from
- 53:40Speaker 6: the murder of his daughter. Well, it has already depumped
- 53:44Speaker 6: the shaking baby sit them she got he was not
- 53:48Speaker 6: post that she died of a pneumonia or some kind
- 53:51Speaker 6: of other illness. The judicial system, how I'm gonna applying
- 53:55Speaker 6: this because even our own building in the state of Texas,
- 53:58Speaker 6: I still want to man convict no matter what the
- 54:01Speaker 6: evidence shows. So can you imagine in my case there
- 54:05Speaker 6: is no evidence now that can support They have to
- 54:10Speaker 6: say it both. I mean to do the because there's
- 54:12Speaker 6: no evidence. The main wisness they used.
- 54:16Speaker 4: To convict me.
- 54:18Speaker 6: His credibility is out the window. Now he's already been
- 54:21Speaker 6: giving community. He's giving the cup charge to dismiss or
- 54:25Speaker 6: testifying the kids be they presented false testimony and they
- 54:30Speaker 6: furst evident everything. So think about it. It's just system works.
- 54:37Speaker 6: We're supposed to be able to have a better impartial trial.
- 54:40Speaker 6: But I don't say it, and that's how I feel,
- 54:43Speaker 6: and I'm praying and maybe one day I can least
- 54:45Speaker 6: be able to walk out this door.
- 54:47Speaker 4: Proven that track, and thank.
