- 0:01Speaker 1: Now we turn to the Mountain Eagle to read news
- 0:04from Whitesburg. Your reader today is Bill den Arsdale. We
- 0:09will begin with the edition dated May twentieth, twenty twenty six,
- 0:13which the publishers have donated to RADIOI as a reminder.
- 0:18RADIOI is a reading service intended for people who are
- 0:21blind or have other disabilities that make it difficult to
- 0:24read printed material. The first headline is Steins ordered to
- 0:31attend court hearing June fifth. A judge has ordered former
- 0:37Letcher County Sheriff Sean Mickey Steins to appear in person
- 0:41on June fifth for a status report on his murder case. Steins,
- 0:47who has been in the Leslie County jail since September nineteen,
- 0:50twenty twenty four, is charged in the murder of Leccher
- 0:54District Judge Kevin R.
- 0:55Speaker 2: Mullins.
- 0:57Speaker 1: Video showed Stein's shoot Mullins multiple time times in the
- 1:00judges chambers. He was arrested a few minutes later and
- 1:04charged with murder. Special Lectcher Circuit Judge Christopher Koran issued
- 1:10the order for a status conference last week. Stein's will
- 1:14be taken out of the Leslie County Jail and transported
- 1:17to the Leslie County District courtroom for the hearing set
- 1:20for ten am on June fifth. The judge will also
- 1:24consider all pending motions at that hearing. Steins's attorneys in
- 1:30December asked that Koran recused himself from the case the
- 1:34morning he was supposed to begin a bond hearing and
- 1:36status conference for Stein's I filed a motion with the
- 1:40Supreme Court of Kentucky, but the court ruled it was
- 1:43up to Koran to make that decision himself. Koran declined
- 1:47to accuse himself, and Stein's attorneys appealed again. Deputy Chief
- 1:53Justice Robert Connolly rejected the appeal, which was based solely
- 1:57on the fact that both Koran and Mullens were members
- 2:00of a seventy five member judicial Commission on Mental Health,
- 2:03and both attended a meeting of the commission two weeks
- 2:06before Mullins was murdered. The facts, as alleged simply do
- 2:10not support a conclusion that a reasonable person would question
- 2:14Judge Koran's impartiality, Colly wrote. He wrote that Stein's defense
- 2:20is free to appeal after a final judgment is entered.
- 2:24The hearing on June fifth will take up all motions
- 2:27that are still pending, likely including the question of bond
- 2:31and requests that the judge release a metal health report
- 2:34on Stein's. Additional motions may be filed prior to the hearing.
- 2:41The next story is Jenkins bitcoin mine at center of
- 2:46fifty one point five million dollar fight. A foreign owned
- 2:52cryptocurrency company has asked a federal judge to enforce a
- 2:56fifty one point five million dollar arbitration award against a
- 3:01bitcoin mining operation in Lectric County, according to a petition
- 3:05filed earlier this month in U. S. District Court in Louisville.
- 3:10HBT Power Limited filed a petition May eleventh in U. S.
- 3:15District Court for the Western District of Kentucky asking the
- 3:19court to confirm a final arbitration award entered April thirteenth
- 3:24against Mohawk Energy LLC, a Jenkins based crypto mining company
- 3:30owned by Kentucky State Senator Brandon Smith, Republican from Hazard.
- 3:35The dispute centers on a large scale bitcoin mining operation
- 3:40at Gateway Industrial Park in Jenkins, where Mohawk Energy announced
- 3:44in twenty twenty three that it planned to employ hundreds
- 3:48of workers in blockchain processing, electronics repair, and related technology work.
- 3:56HBT Power a bitcoin mining company tied to Hong Kong
- 4:00and British Virgin Islands Entities, claims Mohawk Energy breached a
- 4:04licensing agreement governing the mining site and wrongfully seized or
- 4:09sold mining equipment worth tens of millions of dollars. According
- 4:14to the petition filed by HBT Power, Mohawk entered into
- 4:18an operation Right License agreement in twenty twenty two under
- 4:23which HBT Power would operate bitcoin mining activities at the
- 4:27Gateway Industrial Park, located off US Highway twenty three. The
- 4:33bi lingual English Chinese agreement described a thirty megawat bitcoin
- 4:38mining operation using bitmain and miner and micro bt Witts
- 4:43miner mining machines housed in a forty one thousand square
- 4:47foot facility formerly occupied by Ferris Incorporated, a Canadian firm
- 4:52that provided liquid nitrogen used in the natural gas industry.
- 4:58The agreement called for Ohawk to provide the site, electrical
- 5:02infrastructure and staffing of eleven employees at forty thousand dollars
- 5:07a month, while HBT Power would supply specialized computers called ASICs,
- 5:14Application specific integrated circuits used to mine bitcoin and pay
- 5:20rent of fifty thousand dollars a month, energy costs and
- 5:24a ten percent share of mining revenue. The contract references
- 5:29who will be a major Chinese cryptocurrency company in describing
- 5:34HBT powers, ownership, structure, and operations. Bitcoin is a digital
- 5:40currency or a virtual form of cash that allows users
- 5:45to make anonymous payments online. Bitcoin mining refers to the
- 5:50data processing operations that solve the complicated mathematical equations that
- 5:56verify cryptocurrency transactions worldwide. Companies earned rewards in the form
- 6:02of new bitcoins in exchange for completing blocks of data
- 6:07that are transmitted over peer to peer computer networks or
- 6:10block chains around the world. One bitcoin is now worth
- 6:16about seventy eight thousand dollars in U S dollars, down
- 6:20from its all time high of one hundred twenty six thousand,
- 6:23one hundred ninety eight dollars in October two thousand, twenty five.
- 6:28The federal petition says the dispute went to arbitration in
- 6:32late twenty twenty three and was heard over five days
- 6:36in May twenty twenty five before a judicial Arbitration and
- 6:41Mediation Services arbitrator who issued an interim award in December
- 6:46two thousand twenty five and ordered further briefing on attorney sees, costs,
- 6:51prejudgment interest, punitive damages, and the scope of injunctive relief.
- 6:58After considering other motions filed by both HBT Power and Mohawk,
- 7:03in March twenty twenty six, the arbitrator found that Mohawk
- 7:07breached the operating agreement and unlawfully retained or sold mining
- 7:12equipment belonging to HBT Power. The petition states the arbitrator
- 7:17found Mohawk sold two thousand, fifty nine micro bt wets
- 7:22Minor M thirty M thirty one series ASIC miners to
- 7:26third parties without authorization after ousting HBT Power from the
- 7:31Jenkins facility, and kept two thousand, two hundred seventy bit
- 7:36main and Minor S nineteen series ASIC miners for its
- 7:40own use.
- 7:43Speaker 2: The arbitrator's final.
- 7:44Speaker 1: Ruling awarded HBT Power a total of fifty one point
- 7:48five million dollars forty six point seven million dollars for
- 7:52breach of contract, six hundred thousand dollars for conversion, one
- 7:57hundred twenty eight thousand, one hundred twenty five dollars in
- 8:00prejudgment interest, three point five to three million dollars in
- 8:04attorney fees and five hundred fifty nine thousand eight dollars
- 8:08in costs. The petition also asks the court to permanently
- 8:14bar Mohawk from selling, using, or transferring mining equipment and
- 8:19electrical infrastructure at the site, and to order the return
- 8:23of remaining equipment, including two thousand, two hundred seventy S
- 8:27nineteen series mining machines, a substation said to have cost
- 8:31eight million dollars, fourteen transformers, and fourteen low voltage cabinets.
- 8:38HBT Power claims Mohawk has not paid any portion of
- 8:41the arbitration award since the April ruling. The filings are
- 8:47the latest development in a long running dispute surrounding the
- 8:50Jenkins operation. Mohawk Energy held a grand opening in September
- 8:56twenty twenty three, touting plans for blockchain computing, electronics repair,
- 9:02and aviation related training. At the time, Smith said the
- 9:06company would pay workers between twenty five and sixty five
- 9:09dollars an hour and eventually employ as many as two
- 9:12hundred fifty people, but within months the operation became embroiled
- 9:18in litigation. Earlier reporting described disputes between Smith and representatives
- 9:24of the Chinese crypto company over payments and control of
- 9:28the mining operation. The Gateway Industrial Park site itself has
- 9:33a long history of failed industrial projects. The former Firous
- 9:38nitrogen plant at the center of the dispute previously sat
- 9:41vacant after the collapse of earlier oil and gas related
- 9:45industrial projects in eastern Kentucky. The petition asks the federal
- 9:51court to convert the arbitration award into an enforceable judgment
- 9:55under the Federal Arbitration Act. While the bill his coin
- 10:00mining facility is in Jenkins, which is in the U.
- 10:03S District Court's Eastern District of Kentucky, the lawsuit was
- 10:07filed in the Western District of Columbia because Louisville was
- 10:10designated as the arbitration location in the contracts between HBT
- 10:15Power and Mohawk Energy. HBT Power is represented by the
- 10:20Lexington law firm of Stahl keenan Ogden, PLLC. Mohawk Energy
- 10:26is represented by Frankfurt attorney Anna Stuart Whites. Meanwhile, Brandon
- 10:32Smith and Mohawk Energy are named in a separate lawsuit
- 10:36that remains pending in Lector Circuit Court. The lawsuit concerns
- 10:40the same Gateway industrial park property now at the center
- 10:44of the case in which HBT Power is seeking to
- 10:46enforce the fifty one and a half million dollar arbitration
- 10:49award against Mohawk Energy.
- 10:53Speaker 2: According to a.
- 10:54Speaker 1: Complaint by Ricky Dale Cole of Danville, Kentucky, Smith approached
- 10:58him in April two thousand, two twenty two about leasing
- 11:02and eventually purchasing the Old Fears Building in Jenkins. Cole
- 11:07says Mohawk initially agreed to lease the property for fifty
- 11:11thousand dollars a month under a three year agreement, before
- 11:15later negotiating to purchase.
- 11:17Speaker 2: The building outright.
- 11:19Speaker 1: The complaint says Coal agreed to accept two point five
- 11:22million dollars less than the property's asking price in exchange
- 11:26for a twenty percent ownership interest in Mohawk Energy.
- 11:31Speaker 2: Coal claims Smith.
- 11:32Speaker 1: Told him the deal represented an opportunity to invest in
- 11:36Mohawk Energy at a very low cost and that the
- 11:39company had a strong financial outlook that would produce substantial profits.
- 11:45The lawsuit alleges those representations were false and that Coal
- 11:49has received nothing additional by way of monetary value since
- 11:53the property transfer was completed. Coal further alleges Mohawk failed
- 12:00to provide him access to company financial records and information
- 12:04regarding ownership interests, transactions, and company assets, despite a formal
- 12:09demand made in December twenty twenty four. The suit asks
- 12:14the court to order Mohawk to produce company records and
- 12:18seeks compensatory damages, punitive damages, attorney fees, and recision of
- 12:23the transaction. Mohawk Energy denied the allegations. In its answer.
- 12:30Mohawk denied Coal ever acquired a valid ownership interest in
- 12:34the company, and claimed he had intentionally and voluntarily relinquished
- 12:38any interest he may have had. Mohawk also alleged Coal
- 12:43repeatedly told local residents and members of the Jenkins community
- 12:47that he had nothing whatsoever to do with Mohawk. The
- 12:51company further accused Cole of undermining Mohawk's operations and interfering
- 12:57with a major third party contract tied to the Gateway
- 13:00Industrial Park project. According to Mohawk's counterclaim, Cole continually undermined, damaged,
- 13:08and disrupted the company's business operations, and intentionally interfered with
- 13:13a contract that would have generated substantial income for Mohawk.
- 13:19Although the filing does not identify the third party by name,
- 13:23the allegations appeared to correspond to Mohawk's cryptocurrency mining agreement
- 13:28with HBT Power and related Chinese crypto entities that later
- 13:33became the subject of arbitration in federal court.
- 13:37Speaker 2: Mohawk has asked the court to dismiss.
- 13:39Speaker 1: Cole's lawsuit, ruled that he is not a member of
- 13:42the company, or alternatively expel him from the LLC. The
- 13:47company is also seeking compensatory and punitive damages for alleged
- 13:51interference with its business relationships. Cole has denied Mohawk's counterclaims
- 13:58and denied interfering within it the Mohawk contracts. The case
- 14:03remains pending in Leiser Circuit Court. In the next story,
- 14:09man pleads guilty to lesser charge in girlfriend's death. A
- 14:16cram Creek man charged with murdering his girlfriend on November one,
- 14:20twenty twenty four, has pleaded guilty to a lesser charge
- 14:24of manslaughter. Vincent Fleming, twenty six, admitted to killing twenty
- 14:30three year old Renata Don Bailey at flemings home at
- 14:34three sixty six Box Rock Road. May King. Bailey, twenty three,
- 14:40of Elk Creek at Blackie was found dead inside Fleming's
- 14:44home by an ambulance crew after Fleming called nine one
- 14:47one and requested an ambulance. Emergency Medical Service personnel notified
- 14:53nine one one and requested police shortly after eleven o'clock
- 14:56that night, reporting a dead body. Police said there were
- 15:00signs of a struggle and there were bruises on her body.
- 15:06Bailey had apparently been involved in an all terrain vehicle
- 15:09accident two weeks earlier, sources said, but there was also
- 15:13fresh bruising on her body. Sources said windows had been
- 15:18broken out of the car parked outside, and Bailey's cellular
- 15:21telephone was lying in the yard. Police first said that
- 15:26she could have been killed when a dresser fell on her,
- 15:29but other sources said she had severe bruising all over
- 15:32her body and head trauma. Fleming was in the district
- 15:36courtroom on the first floor of the courthouse to answer
- 15:39numerous traffic violations when the murder indictment was returned. Nearly
- 15:43a month later, Fleming pleaded guilty May thirteenth to an
- 15:49amended charge of first degree manslaughter in exchange for a
- 15:52recommended nineteen year sentence. The charge carries a minimum of
- 15:57ten years and a maximum of twenty Formal sentencing is
- 16:02set for June third in Lector Circuit Court. In the
- 16:08next story, yet another dream appears to fade at Gateway.
- 16:15At a grand opening in September twenty twenty three, Mohawk
- 16:19Energy owner and state Senator Brandon Smith told visitors touring
- 16:24the former Furious Nitrogen plant at the Gateway Industrial Park
- 16:28that workers there could earn up to forty six dollars
- 16:30an hour repairing high tech electronics, while even the company's
- 16:35lowest paid workers would make twenty five dollars an hour.
- 16:39The sprawling operation, built around cryptocurrency mining and electronics repair,
- 16:44featured rows of powerful computer servers, an eight million dollar
- 16:49electrical substation, and plans for aviation repair training. Smith of
- 16:54Hazard said the operation was not dependent on public incentives
- 16:58and would instead create a self sustaining technology hub in
- 17:01the mountains. Less than three years later, the parking lot
- 17:06is empty, the doors are locked, and Mohawk Energy now
- 17:10faces a court fight over an arbitration award totaling more
- 17:14than fifty one point five million dollars. The latest filing
- 17:21in US District Court in Louisville asks a federal judge
- 17:24to confirm the award in favor of HBT Power Limited,
- 17:28a foreign owned cryptocurrency mining company that partnered with Mohawk
- 17:32to operate a bitcoin mining facility in Jenkins. According to
- 17:37the filing, an arbitrator found that Mohawk breached its operating
- 17:40agreement with HBT Power, wrongfully retained computerized equipment to mine bitcoin,
- 17:46and sold more than two thousand of the mining machines
- 17:49without authorization. The arbitrator awarded forty six point seven million
- 17:55dollars for breach of contract, six hundred thousand dollars for
- 17:59conversion of proper three point five three million dollars in
- 18:02attorney fees, and additional interest and costs, for a total
- 18:06of fifty one million, five hundred eighteen thousand, four hundred
- 18:10fifty three dollars and thirty cents. HBT Power is also
- 18:14asking the court to permanently prohibit Mohawk from selling or
- 18:19using mining equipment and to order the return of thousands
- 18:22of mining machines and electrical components located at the Jenkins site.
- 18:29The lawsuit is only the latest chapter in a business
- 18:32saga that has left Gateway Industrial Park once again searching
- 18:36for stable industry after years of highly publicised projects that
- 18:42collapsed under economic pressure, disputes, or changing markets from promise
- 18:49to lawsuits. Mohawk Energy first emerged publicly in twenty twenty
- 18:54three as a replacement for an earlier bitcoin mining proposal
- 18:58that never materialized. An August twenty twenty three article in
- 19:03The Mountain Eagle described Mohawk as part of a multi
- 19:07pronged approach to reviving Jenkins through industry, tourism and housing.
- 19:13At the time, company officials said Mohawk planned not only
- 19:17blockchain processing operations, but also electronics repair and aviation related
- 19:22training programs. The company leased the former fires facility at
- 19:28Gateway Industrial Park and installed the large transformers needed to
- 19:32power cryptocurrency mining operations. By the following month, Smith was
- 19:38hosting reporters and invited guests inside the facility, touting custom
- 19:43built cooling systems, in house fabrication work by former coal miners,
- 19:48and plans to expand electrical capacity from thirty to fifty megawatts.
- 19:55Smith and Mohawk Vice president Dustin Rodgers repeatedly emphasized worker
- 20:00training and long term opportunity. We don't say we'll give
- 20:04you a job, we give a degree, Smith said during
- 20:07the twenty twenty three grand opening event, but According to
- 20:12a June twenty twenty five Mountain Eagle report, problems surfaced
- 20:17almost immediately. Just two months after the grand opening, police
- 20:22were called to the site during a dispute between Smith
- 20:26and representatives of Huobi, the Chinese lenk company that owned
- 20:30the mining servers, over a camper being used by one
- 20:33of the company representatives. Huobi, identified in court records as
- 20:38HBT Power Limited, later sued Mohawk for breach of contract,
- 20:43while Smith counter sued, claiming the company owed Mohawk more
- 20:47than seven hundred thousand dollars. That dispute eventually moved into
- 20:52private arbitration, which largely remained hidden from public view until
- 20:57the recent federal filing seeking confirmation of the arbitration award. Meanwhile,
- 21:03Mohawk became embroiled in additional litigation involving the ownership of
- 21:08the former Fist building itself. For longtime observers of Gateway
- 21:14Industrial Park, the collapse of Mohawk Energy feels painfully familiar.
- 21:20The industrial park has seen a succession of heavily promoted
- 21:23projects arrived with promises of economic revival, only to close
- 21:27a few years later. A twenty seventeen Mountain Eagles story
- 21:33traced the cycle through earlier ventures at the same site.
- 21:37Before Mohawk occupied the former Fires building, the site housed
- 21:42two oil and gas related companies, Ferris Corporation, which shut
- 21:46down in twenty fifteen after the collapse of Energy Markets
- 21:50and Drillers LLC. At the time, local officials were already
- 21:55searching for a new economic direction after repeated setbacks to
- 22:00to coal, oil and gas markets. Economic development leaders promoted aerospace,
- 22:07automotive manufacturing, and advanced technology as possible futures for the region.
- 22:14Mohawk appeared to fit that vision as a technology centered
- 22:18employer promising high wages, technical training, and an industrial reuse
- 22:23of an otherwise vacant building. Instead, the latest filings suggest
- 22:29the project devolved into an international dispute over cryptocurrency mining, equipment,
- 22:35electrical infrastructure, and millions of dollars in alleged damages. No
- 22:41ruling has yet been issued by the Federal court on
- 22:44the request to confirm the arbitration award.
- 22:48Speaker 2: When it comes to success.
- 22:50Speaker 1: Stories at Gateway Industrial Park, one of them has been
- 22:54locally owned Tailor Metal roofing and siding.
- 23:02Speaker 2: The next story is.
- 23:04Speaker 1: Man held after holding his girlfriend hostage. A man accused
- 23:10of holding his girlfriend at gunpoint in a standoff with police.
- 23:14Is being held in the Letter County Jail in lieu
- 23:17of a fifty thousand dollars cash bond. Dusty Allen Schell,
- 23:22thirty six, whose address is listed as Emmelina in Nott County,
- 23:27was taken into custody about one pm May thirteenth, after
- 23:31he was accused of taking his girlfriend and a man
- 23:34in a wheelchair hostage. Jennifer Cantrell's sister called police about
- 23:40fourteen am, reporting that Cantrell had been the victim of
- 23:43domestic abuse. Police arrived on Buck Creek sometime after six am,
- 23:50after first attempting to find the nine to one one
- 23:53caller in nearby Love's Branch. They didn't positively find the
- 23:58correct house until after six am, and then learned everyone
- 24:02in the house had crossed the road to a neighbor's home.
- 24:06When troopers knocked on the door there, they said a
- 24:09man answered and told them Cantrell had left. Police continued
- 24:14searching the neighborhood until after six thirty am, after the
- 24:17original caller told them they had been at the right
- 24:20home and the man who answered the door was lying.
- 24:24She also said the man was armed troopers knocked on
- 24:27the door again, but no one answered. Shortly afterward, the
- 24:32caller told dispatchers that her sister had both hands on
- 24:35a window and that Shell was holding her at gunpoint.
- 24:40The neighbor, who is in a wheelchair, was also held
- 24:43in the house, Police said. Police called in the Kentucky
- 24:48State Police Special Response Team when the alleged abuser refused
- 24:52to come out. Cantrell was allowed to come out later
- 24:56in the day. The others eventually left the house, and
- 25:00police arrested Shell on a parole warrant. He was also
- 25:05charged with second degree assault, domestic violence, and second degree
- 25:09terroristic threatening. Shell has a long criminal history stretching back
- 25:14eighteen years. Police also arrested Amy L. Griffith, forty five,
- 25:20of Hinman, on a fugitive warrant from Cincinnati, Ohio, and
- 25:25lodged her in the Letcher County jail. Griffith also remained
- 25:29in jail this week awaiting extradition to Ohio. The next
- 25:35story is Letcher County's jobless rate is five point three
- 25:40percent higher than state and national rates. Letcher County recorded
- 25:46a five point three percent unemployment rate in March twenty
- 25:50twenty six, above both the US rate of four point
- 25:54three percent and Kentucky's statewide rate of four point six percent,
- 25:59according to the Kentucky Center for Statistics. Among the eight
- 26:04counties in the Kentucky River Area Development District, Letcher County
- 26:08tied with Leslie County for the fourth highest unemployment rate.
- 26:14Wolfe County posted the district's highest rate at eight point
- 26:17three percent, followed by Breathett County at six point zero percent,
- 26:22and Nott County at five point nine percent. Perry County
- 26:25and Lee County each recorded four point seven percent, while
- 26:29Owsley County posted four point eight percent. According to statistics
- 26:35released May fifteenth, Letcher County had a certified labor force
- 26:39of seven thy three hundred three, with nine hundred eighteen
- 26:43of those people holding jobs, while the statistics show that
- 26:49three hundred eighty five people are drawing unemployment benefits. Scores
- 26:53of others are jobless but no longer searching for work.
- 26:58Unemployment rates fell in all one hundred twenty counties between
- 27:02March twenty twenty five and March twenty twenty six, according
- 27:06to the Kentucky Center for Statistics, an agency within the
- 27:09Kentucky Education.
- 27:10Speaker 2: And Labor Cabinet.
- 27:13Speaker 1: Hartland County's jobless rate for March stood at six point
- 27:16one percent, while Pike County's rate was six point four percent.
- 27:22Woodford County recorded the lowest jobless rate in the Commonwealth
- 27:25at three point five percent. It was followed by Todd
- 27:29County three point six percent, Fayette and Scott Counties three
- 27:33point seven percent each, Campbell, Franklin, Jessmine, and Oldham Counties
- 27:38three point eight percent each, and Boom, Caldwell, Carroll, Graves
- 27:42and Kenton Counties three point nine percent each. Lewis County
- 27:48recorded the state's highest unemployment rate at eight point four percent.
- 27:53It was followed by Wolf County, Magoffin and Martin Counties
- 27:57seven point eight percent each, Elliott County seven point one percent,
- 28:02Menefee County seven percent, Jackson County six point nine percent,
- 28:06Lawrence County six point seven percent, Carter County six point
- 28:10six percent, and Wayne County six point five percent. This
- 28:17concludes the reading of the Mountain Eagle. Your reader has
- 28:21been Bill den Arsdale. Now please stay tuned for continued
