- 1:47Speaker 5: Thursday edition of the show. Another lovely drive in this
- 1:49Speaker 5: morning with the rain and whatnot not. As I mean,
- 1:53Speaker 5: to my knowledge, it's not as many accidents reported this
- 1:55Speaker 5: morning as there were yesterday. There were a few here
- 1:57Speaker 5: and there, though, as as you make expack it'll get
- 2:00Speaker 5: better those we head toward the weekend, of course. The
- 2:02Speaker 5: announcement was made on Tuesday that Canawa County would move
- 2:05Speaker 5: their Trick or Treating festivities from tonight's, which is when
- 2:08Speaker 5: it was originally scheduled, to now Tomorrow night and Halloween Night.
- 2:11Speaker 5: I had County Commission President of Ben Selango on the
- 2:13Speaker 5: show yesterday talking about the reasons why. And you know, you,
- 2:16Speaker 5: as we said yesterday, you're never going to make everyone happy,
- 2:20Speaker 5: but yes, Trick or Treating is tomorrow night, Halloween Night
- 2:23Speaker 5: in Canawha County, Halloween Night in Putnam County as well.
- 2:25Speaker 5: That was the original night over there, all right. Coming
- 2:28Speaker 5: up a little bit later on, going to introduce you
- 2:30Speaker 5: to someone named Terra Martinez. She's running for the House
- 2:33Speaker 5: of Delegates out of Canawha County District fifty four and
- 2:37Speaker 5: she is an independent. We're going to introduce you to
- 2:39Speaker 5: her attorney. Rusty web is going to be by the
- 2:42Speaker 5: program as well, to talk about this opioid settlement. Well,
- 2:46Speaker 5: you know, I don't want to call it really a settlement,
- 2:49Speaker 5: but the news that came out of Cabull County, it
- 2:52Speaker 5: can be quite confusing.
- 2:53Speaker 4: Where does it go next?
- 2:54Speaker 5: Rusty to somebody who's been involved in this for some time,
- 2:57Speaker 5: keeping an eye on this and so he's going to
- 2:59Speaker 5: join us to wait and on that, plus, your calls
- 3:01Speaker 5: and text are welcome to and again I promise it.
- 3:04Speaker 5: On social media, I will get into the hottest thing
- 3:06Speaker 5: going on social media in the area now and that
- 3:09Speaker 5: is the swing club controversy in Charleston. I'll get into
- 3:12Speaker 5: that coming up a little bit later on as well,
- 3:14Speaker 5: But right now I want to welcome into show the
- 3:16Speaker 5: chief of staff for Charles Mary Amy Shooter.
- 3:18Speaker 4: Good one, Matt Sutton, Good morning, sir, Welcome to the show.
- 3:21Speaker 4: How are you doing by it? I am doing fine.
- 3:23Speaker 5: First of all, Trick or Treating has been moved Knawa County,
- 3:27Speaker 5: as we said, from tonight to tomorrow night because of
- 3:30Speaker 5: the weather.
- 3:30Speaker 6: Your thoughts, yeah, I mean it's it's the right call.
- 3:32Speaker 6: It's all about safety for kids, and that is the
- 3:35Speaker 6: number one priority in any event that you put on,
- 3:38Speaker 6: whether it's trick or treat, whether it's the Regatto, whether
- 3:41Speaker 6: it's just you know, a night in the park. It's
- 3:44Speaker 6: all about safety, especially as relates to our little ones.
- 3:46Speaker 6: And we don't want want kids out not only in
- 3:49Speaker 6: the cold and the rain, but you know, as you mentioned,
- 3:51Speaker 6: we have a lot of accidents that go on trig
- 3:53Speaker 6: or treats a hard night throughout the entire county for
- 3:56Speaker 6: law enforcement ems to try to make sure that people stay.
- 4:00Speaker 6: It's about safety. It's the right decision. And by the way,
- 4:02Speaker 6: it's not the first time this has happened. I mean
- 4:03Speaker 6: in that I've been with Mary Goodwin now for seven
- 4:05Speaker 6: years and we had to do this before.
- 4:07Speaker 4: And it's the right decision.
- 4:09Speaker 5: Was it a couple of years ago we had some
- 4:11Speaker 5: some pretty uh nasty weather that was more like storm
- 4:14Speaker 5: or as opposed to just rain there it was like
- 4:15Speaker 5: some lightning and all that kind of stuff. I think
- 4:18Speaker 5: what you know, Matt, I think what some people were
- 4:20Speaker 5: bothered by was that it was going. Now it's going
- 4:23Speaker 5: to go head to head with high school football, but
- 4:25Speaker 5: it's going to go head to head in a lot
- 4:26Speaker 5: of places. And I mean, I like what Selango said.
- 4:29Speaker 5: YESTERD Commissioner Selango said yesterday, maybe we should just say
- 4:32Speaker 5: it's October thirty first, no matter what, and just leave
- 4:34Speaker 5: it there.
- 4:35Speaker 4: Yeah.
- 4:35Speaker 6: I mean, I think, you know, we've talked about that,
- 4:36Speaker 6: and I think that that makes a lot of sense.
- 4:38Speaker 6: And but again, when it you want people want to
- 4:41Speaker 6: participate in Halloween. My my neighborhood is all kinds of
- 4:44Speaker 6: decorated and so, and the kids get excited and they
- 4:46Speaker 6: want to be able to participate.
- 4:48Speaker 4: So make it a nice night.
- 4:49Speaker 6: We've already all bought our candy, kids have already got
- 4:51Speaker 6: their costumes. And make sure the kids can participate and
- 4:54Speaker 6: most importantly that people can stay safe. I get it
- 4:57Speaker 6: goes against high school football. There's really not a lot
- 4:59Speaker 6: you can do about that because we're not going to
- 5:01Speaker 6: move it into next week.
- 5:02Speaker 4: That doesn't make any sense.
- 5:03Speaker 6: So you know, people can participate, you know tonight, I
- 5:07Speaker 6: know there's some big uh. I think it's high school
- 5:10Speaker 6: volleyball games that go on because of the state high
- 5:11Speaker 6: school volleyball tournament. There people getting there's always always.
- 5:14Speaker 5: There's always a high school football game on a Thursday
- 5:16Speaker 5: night somewhere to Marshall's playing tonight, you know. For my
- 5:19Speaker 5: Thundering Herd, they have a game at Coastal Carolina tonight.
- 5:22Speaker 5: And the municipality is the Selango Commissioner. Silango explain to us,
- 5:26Speaker 5: you know, the municipalities can pretty much do what they want.
- 5:30Speaker 5: They didn't have to necessarily go along with what the
- 5:32Speaker 5: county said. However, it makes it easier for everybody. And
- 5:35Speaker 5: I'm pretty sure unless somebody tells me otherwise, that the
- 5:38Speaker 5: municipalities in Kanawa County are all going along with the
- 5:40Speaker 5: county recommendations and having their trick or treating tomorrow night.
- 5:43Speaker 5: But look, I mean there's communities having it on Saturday night,
- 5:46Speaker 5: and there's people that don't like that because they say, well,
- 5:48Speaker 5: Saturday nights the night that people go out and party
- 5:51Speaker 5: and go to bars, and we don't want the kids
- 5:53Speaker 5: out then, So you know, it's you're never gonna make
- 5:56Speaker 5: and there is no as I said yesterday, Matt, there
- 5:58Speaker 5: is no trick or treat police. You could go out
- 6:00Speaker 5: trick or treating in in January if you want to,
- 6:03Speaker 5: I mean, and you may not get any candy, but
- 6:05Speaker 5: you can do I mean you.
- 6:06Speaker 6: Yeah, whatever you want. The cities can, but we we coordinate.
- 6:09Speaker 6: I know, I can only speak for the City of Charleston,
- 6:11Speaker 6: and we coordinated close with the county on this because
- 6:12Speaker 6: it does make sense, because it's a bad you know,
- 6:14Speaker 6: it's hard to you know, for you all in the
- 6:17Speaker 6: news media, it would be hard for you to stand
- 6:18Speaker 6: up here and say and trick or treat tonight is
- 6:20Speaker 6: in Saint Albans and nitro and then tomorrow night.
- 6:23Speaker 4: It's interesting.
- 6:24Speaker 6: I mean, it would just be confusing for people. Most importantly, again,
- 6:28Speaker 6: I know it can be I know it can be frustrating.
- 6:31Speaker 6: I understand that it can. That people have plans, But
- 6:33Speaker 6: when we make these decisions every single time, and I
- 6:37Speaker 6: know Commissioner Silango talk with Mary a good one every
- 6:40Speaker 6: single time, the number one priority of safety of kids,
- 6:42Speaker 6: and that that's it. That's that's the goal. And if
- 6:44Speaker 6: you want to be upset about that, I understand. I
- 6:47Speaker 6: guess I get it. But we're always going to put
- 6:49Speaker 6: the safety of kids first and that that's what this
- 6:51Speaker 6: is about. And so hopefully everybody can have a great
- 6:54Speaker 6: time tomorrow night, and when we can, we can move
- 6:57Speaker 6: on to the Christmas parade after that, right, I.
- 6:59Speaker 4: Mean Thanksgivings in the middle.
- 7:01Speaker 6: But I mean, I don't know like the people you know,
- 7:03Speaker 6: we just I was in the stores the other day
- 7:05Speaker 6: and it's all Christmas again.
- 7:06Speaker 5: So I got news for you. I was in a
- 7:07Speaker 5: store that there was Valentine's Day stuff out of me
- 7:11Speaker 5: store before we get to the Christmas bread. And that's
- 7:13Speaker 5: why you're really here today. I did want to say
- 7:16Speaker 5: this and allow you to talk about this. W CCHS
- 7:18Speaker 5: Television no relation by the way out with the story
- 7:20Speaker 5: late Tuesday about a public hearing that was held Tuesday
- 7:23Speaker 5: night to discuss the presence of an adult's only establishment
- 7:27Speaker 5: on Greenbriar Street in Charleston. It said to be a
- 7:29Speaker 5: swingers club. Just wanted to clarify with you and i'm'll
- 7:32Speaker 5: talk about this a little bit later on. There was
- 7:35Speaker 5: a cease and desist that was sent out to them,
- 7:38Speaker 5: and according to the w CHS story was sent by
- 7:40Speaker 5: the county, not by the city.
- 7:42Speaker 4: It is not in city limits.
- 7:43Speaker 6: It's not in the city limits. Greenbrierce Street can get
- 7:45Speaker 6: a little bit weird going up and down Greenbrice Streek.
- 7:47Speaker 4: Es especially now boundary weird. Boundary weird.
- 7:52Speaker 6: Sorry, and as ken south Ridge. But you know, I
- 7:55Speaker 6: was actually literally on the phone with our Director of
- 7:57Speaker 6: Development Service, Dan Rent and when I first when I
- 7:59Speaker 6: saw the article, and I said.
- 8:01Speaker 4: Damn, that did I miss a meeting like what happened here?
- 8:03Speaker 6: And he didn't know anything about it, and I said,
- 8:05Speaker 6: and then I dug into the article and I said, oh, okay,
- 8:07Speaker 6: I understand what the county is doing. They do have
- 8:09Speaker 6: a Charleston address, but it's not in the city of Charleston,
- 8:12Speaker 6: so it is a county decision for them to make.
- 8:15Speaker 6: And and with anything, holding holding public hearings is always
- 8:18Speaker 6: a good idea. And so we were quite caught off
- 8:20Speaker 6: guard about it, and we kept seeing the articles and
- 8:22Speaker 6: the mayor was texting me. She was like, you said
- 8:24Speaker 6: the same thing, like did we miss something? You know,
- 8:26Speaker 6: this is this is the county. But uh yeah, So
- 8:29Speaker 6: for for everybody having fun with it or not having
- 8:31Speaker 6: fun with it however you want to do, you know,
- 8:34Speaker 6: it is a county decision. And and just like the
- 8:37Speaker 6: City of Charleston, the county has zoning loss and the
- 8:39Speaker 6: city has zoning loss. And that's how it works. And uh,
- 8:42Speaker 6: you know a lot of times, the the opinion of
- 8:45Speaker 6: what you should do, you have. You have the laws
- 8:48Speaker 6: and you have to follow them where things get out
- 8:49Speaker 6: of hand. And I don't know enough about this situation,
- 8:52Speaker 6: but I just know that zoning laws are important in
- 8:56Speaker 6: both in all in all areas, and so you know,
- 9:00Speaker 6: it is what it is. And if you think otherwise,
- 9:03Speaker 6: the argument is to talk about zoning loss and look
- 9:06Speaker 6: to look at those.
- 9:07Speaker 4: And you can have that.
- 9:07Speaker 5: They can have that discussion at another point. But but
- 9:09Speaker 5: I agree with you. All right, let's move on to
- 9:11Speaker 5: the Christmas Parade announcement coming out yesterday that I guess
- 9:14Speaker 5: applications are out there now, you asking for people sign up,
- 9:16Speaker 5: talk about it.
- 9:17Speaker 6: Yeah, So we open the applications for the Christmas Parade yesterday.
- 9:21Speaker 6: Those applications we already got twenty one as of eight
- 9:25Speaker 6: o'clock this morning, so that probably numbers up to probably
- 9:27Speaker 6: twenty five or thirty already, and so that'll stay open
- 9:30Speaker 6: through the basically through the end of November or till
- 9:32Speaker 6: we get to about one hundred and twenty five participants.
- 9:34Speaker 6: That's about the deal number. Yeah, I would call it
- 9:38Speaker 6: the max number. It's the number in which we can
- 9:40Speaker 6: handle through the parade. You know, we could sneak in
- 9:43Speaker 6: a few here and there, but one hundred and twenty
- 9:45Speaker 6: five is when we try to get to. We usually
- 9:46Speaker 6: don't make it through the whole time, praying for the
- 9:49Speaker 6: application to be open till we get to one hundred and
- 9:51Speaker 6: twenty five. So make sure you get your application in
- 9:54Speaker 6: as soon as you possibly can. The Christmas Parade itself
- 9:57Speaker 6: December eleventh on at seven pm always, I don't think
- 10:02Speaker 6: any after mind, anybody that tries to move the Christmas
- 10:04Speaker 6: Parade to the evening time, and it has been in
- 10:08Speaker 6: the evening time, you know since Marygodwe was in is
- 10:10Speaker 6: one of the best events in town. So December eleventh
- 10:13Speaker 6: at seven pm, you're definitely gonna want to be there.
- 10:16Speaker 6: But if you want to participate in the parade, i'd
- 10:18Speaker 6: sign up today theme for.
- 10:20Speaker 4: Because this just went live. I guess yesterday at least
- 10:22Speaker 4: that's when I got the pressure. He saw it.
- 10:24Speaker 5: And so if you've already had that many people that
- 10:26Speaker 5: have signed up in a less than twenty four hour period,
- 10:29Speaker 5: you're going to have a lot of people sign up.
- 10:30Speaker 6: Yeah, we usually get tow one hundred and twenty five
- 10:32Speaker 6: in about in a week or two. We have people
- 10:35Speaker 6: calling about the Christas Parade in September. I mean, people
- 10:37Speaker 6: love their parades, and I know that they also schedule
- 10:40Speaker 6: it out right because there are a lot of Christmas
- 10:41Speaker 6: brades going out throughout the entire county and in the
- 10:44Speaker 6: Putnam County and all that areas. So people try to
- 10:46Speaker 6: plan these out. We try to work to make sure
- 10:48Speaker 6: that we have you know, we don't want to duplicate nights.
- 10:51Speaker 6: So it is a great night. I mean this year's
- 10:53Speaker 6: theme is Tenseltown, so everybody can sparkle up, you know
- 10:57Speaker 6: you can, you know your nod to your favorite sort
- 11:00Speaker 6: of classic Christmas movies and and how you interpret the
- 11:04Speaker 6: theme of Tensiltown. But man, it's a really fun event
- 11:07Speaker 6: and I will I will forever remember the meeting I
- 11:10Speaker 6: was in with the mayor even before she took office,
- 11:13Speaker 6: where she said she was going to move the parade
- 11:16Speaker 6: to the night time. And I was I wasn't a
- 11:19Speaker 6: big parade person. I just not nothing. My family did,
- 11:22Speaker 6: we weren't. We weren't big parade people. So I was
- 11:23Speaker 6: just okay and didn't realize actually how impactful it would be,
- 11:32Speaker 6: not only from a community perspective, from a business perspective,
- 11:34Speaker 6: from restaurants. Because it was in you know, it was
- 11:36Speaker 6: on a Saturday morning. It was nice and people attended.
- 11:38Speaker 6: But this has turned into an entire two month event
- 11:43Speaker 6: basically after the parade, Yeah, I mean it, so what
- 11:46Speaker 6: the evening time Christmas Parade was the catalyst for things
- 11:49Speaker 6: like Holly Jolly Browley and like the Night because we
- 11:51Speaker 6: started to create this vibe in this atmosphere and Charleston
- 11:54Speaker 6: around the holidays, and man, it's just such a it's
- 11:56Speaker 6: such a great night. And you know we keep that
- 11:59Speaker 6: to about one hundred and twenty five because we've gotten
- 12:02Speaker 6: bigger before and it can last a long time and
- 12:04Speaker 6: you know when you kids need to get home and
- 12:05Speaker 6: get to bed. But it is really a fun event
- 12:09Speaker 6: and really one in which I know, you know Holly
- 12:12Speaker 6: Jolly Brawley and L like the night start first. But it
- 12:14Speaker 6: really is the one that kind of kicked off everything
- 12:18Speaker 6: for the holidays in Charleston and what what we have
- 12:20Speaker 6: become over the last couple of years. And so I
- 12:23Speaker 6: would make sure to get your your entry. And my
- 12:25Speaker 6: guess is is when I get back to the office
- 12:26Speaker 6: here in a few minutes, we'll be up to about
- 12:28Speaker 6: thirty or thirty five entries. We want as many youth
- 12:32Speaker 6: organizations as we can get. We love bands, we love kids,
- 12:36Speaker 6: youth sports clubs, kids' activities, and but you know adults
- 12:41Speaker 6: are welcome to but as many people as we can get.
- 12:44Speaker 6: We want that out there and then have a fun
- 12:46Speaker 6: evening in Charleston. That's the big that's the biggest part
- 12:48Speaker 6: about this.
- 12:49Speaker 5: You grab some dinner, go to Holliday Jolly Brawley, swing
- 12:52Speaker 5: by light to night you know, all these things and
- 12:55Speaker 5: again you know, talking to the merchants downtown, they love it.
- 12:58Speaker 5: They love it because as you said, it was on
- 13:00Speaker 5: Saturday morning for and and it was very well attended.
- 13:03Speaker 3: Uh.
- 13:03Speaker 5: But this has taken it to another another level because
- 13:06Speaker 5: it's not just about the parade, it's about everything around
- 13:09Speaker 5: the parade.
- 13:09Speaker 7: Yeah.
- 13:09Speaker 6: I mean when you get that, you know now that
- 13:11Speaker 6: we've got the we've got all the trees up, and
- 13:13Speaker 6: you've got the I think the Charles Snary Alliance is
- 13:15Speaker 6: doing their window decorating contest again this year. And so
- 13:19Speaker 6: those type of things really add to that environment. And
- 13:21Speaker 6: to have the have the Christmas Parade uh, kind of
- 13:24Speaker 6: as the culmination of a lot of it. Then you
- 13:26Speaker 6: head into the holidays. It is just it is a
- 13:29Speaker 6: it is a really special night interest and and all
- 13:32Speaker 6: the bars are packed, all the restaurants are packed, retail
- 13:34Speaker 6: establishments are great, and it is a huge night. I mean,
- 13:36Speaker 6: we've had we have people when we ask and we
- 13:39Speaker 6: go out and ask sort of the you know, the
- 13:40Speaker 6: establishments downtown, like what are your biggest draw what are
- 13:43Speaker 6: your biggest revenue nights? What are your biggest draw nights?
- 13:45Speaker 6: Christmas Parade is always in the top three or four,
- 13:47Speaker 6: and and it just because it is such a well
- 13:49Speaker 6: attended event, and you know you want to you want
- 13:53Speaker 6: some hot chocolates from Allen's ice Cream. You better get
- 13:56Speaker 6: there early to get you to get your hot chocolate
- 13:58Speaker 6: and just come out and have a good time. And again,
- 14:01Speaker 6: I think the other thing to not to not to
- 14:04Speaker 6: go back and be a dead horse.
- 14:06Speaker 4: With the moving of Halloween.
- 14:07Speaker 6: We had to move the Christmas Bread one year because
- 14:09Speaker 6: of weather and so stuff happens. But book December eleventh
- 14:12Speaker 6: at seven pm.
- 14:13Speaker 5: Speaking of which somebody asked, as there been a rain
- 14:15Speaker 5: date set, I guess we'd have to wait till we
- 14:17Speaker 5: got a little bit closer to do extended forecast and
- 14:19Speaker 5: things of that nature.
- 14:20Speaker 6: Yes, I mean when we look at the rain dates,
- 14:22Speaker 6: we look at a lot of different things. A is
- 14:24Speaker 6: how long is it going to rain, what's the what
- 14:25Speaker 6: is the time frame? And so, But we want to
- 14:29Speaker 6: get it in kind of early in December, so we
- 14:31Speaker 6: have a little bit of time to move into that
- 14:33Speaker 6: next week if we need to. And a lot of
- 14:35Speaker 6: that has to do honestly, because when we did have
- 14:38Speaker 6: to move it two years ago, I think it was
- 14:41Speaker 6: our first caller to our bands that participate, the local
- 14:44Speaker 6: school bands that participate in the youth group, to say, what.
- 14:46Speaker 4: Else last year?
- 14:47Speaker 6: What it may have been last Yeah, know what what
- 14:49Speaker 6: do you have going on? What do you have going on?
- 14:51Speaker 6: What can you when can you participate? Because having those
- 14:54Speaker 6: bands is such a critical part of it, we always
- 14:57Speaker 6: co coordinate with them before we set a rain date.
- 14:59Speaker 5: Somebody also said food trucks would be nice if you
- 15:01Speaker 5: could have them down there. The only thing I would
- 15:03Speaker 5: worry about would be spacing space. Spacing space is hard.
- 15:05Speaker 6: I mean we you know, when you think about the
- 15:07Speaker 6: Chris Brad you don't have a lot of space on
- 15:09Speaker 6: any space left down down So we've got we've got
- 15:12Speaker 6: plenty of places downtown to eat.
- 15:13Speaker 5: Go to the restaurants. Yeah yah, I mean food trucks
- 15:15Speaker 5: are nice. I love a good food truck, don't get
- 15:17Speaker 5: me wrong, but I think you're better served by going
- 15:18Speaker 5: to the restaurants. Matt Sutton, Chief of Staffer, Mayor Goodwin.

- 18:19Speaker 5: good morning and welcome to the show.
- 18:21Speaker 9: Good morning, Dave, Thanks so much for having me.
- 18:23Speaker 5: Thank you for being here. Give us your bia. Who
- 18:26Speaker 5: is tera to just run.
- 18:27Speaker 4: It down for us?
- 18:28Speaker 9: Yeah, my mom said that you were going to ask that, so.
- 18:31Speaker 4: I pretty much asked us of every candidate. I try
- 18:34Speaker 4: to be fair.
- 18:35Speaker 9: So I am a public servant. I started serving the
- 18:39Speaker 9: state of West Virginia when I was nineteen years old
- 18:42Speaker 9: with the Public Service Commission. I've worked for the Department
- 18:45Speaker 9: of Agriculture. I've worked for the Department of Health and
- 18:49Speaker 9: Human Resources at the time as the director of the
- 18:51Speaker 9: Women's Commission. I have given a lot of my free
- 18:55Speaker 9: time to do work as a volunteer for the I
- 19:01Speaker 9: was the chair and vice chair of the Advisory Committee
- 19:05Speaker 9: to the US Commission on Civil Rights for West Virginia.
- 19:08Speaker 9: I am a public servant by heart, and I'm a mom,
- 19:12Speaker 9: I'm a wife, a daughter, and I am a constituent
- 19:16Speaker 9: of currently a constituent and a candidate for the District
- 19:19Speaker 9: of fifty four.
- 19:21Speaker 4: So why did you decide to run?
- 19:25Speaker 9: Being on the other side and unders have a unique
- 19:29Speaker 9: perspective of being on the other side of the legislation
- 19:33Speaker 9: that has passed at the House, in the Senate and
- 19:37Speaker 9: signed by the governor and working in state government. All
- 19:41Speaker 9: of my life, I have really dug into what the
- 19:46Speaker 9: needs are, working on surveys, working with individuals and having
- 19:54Speaker 9: their worst day of their life. As a director of
- 19:57Speaker 9: a soup kitchen here in Charleston. I got to the
- 20:01Speaker 9: point last session I had taken my daughter's softball team
- 20:07Speaker 9: to listen and to be recognized, and that they were
- 20:12Speaker 9: having a pretty controversial bill on the floor, and the
- 20:16Speaker 9: girls afterwards, after they were recognized, said, why aren't they
- 20:21Speaker 9: Why don't they ask the kids what we want and
- 20:23Speaker 9: what we need, and why aren't you down there being
- 20:27Speaker 9: our voice? And you know, for a bunch of thirteen
- 20:31Speaker 9: fourteen year olds to ask you to be their voice,
- 20:33Speaker 9: it's pretty significant. And that was kind of the catalyst
- 20:36Speaker 9: for me.
- 20:37Speaker 4: So, what do you see as the biggest needs of
- 20:39Speaker 4: the district?
- 20:42Speaker 9: Workforce? Opportunities, affordable housing, childcare for folks that want to work,
- 20:50Speaker 9: and maybe accessible and affordable childcare has been a huge
- 20:55Speaker 9: topic as long as when I was at the Women's Commission.
- 20:59Speaker 9: That was something statewide and I had the good fortune
- 21:03Speaker 9: of when I was working briefly as a consultant for
- 21:09Speaker 9: Governors of Justice's Office to help with getting a program
- 21:15Speaker 9: called triest Share a grant to do a pilot program
- 21:20Speaker 9: in eight counties in West Virginia and giving individuals that
- 21:26Speaker 9: support that they need to be able to get back
- 21:30Speaker 9: to work or to have with the opportunity to go
- 21:34Speaker 9: to work so that they're not worried about who's keeping
- 21:37Speaker 9: their children and who's taking care of their most precious asset.
- 21:42Speaker 5: Talking to Cherry Martinez again, who is a candidate for
- 21:45Speaker 5: a House of Delegates. So Dave Alan Show and five
- 21:47Speaker 5: eighty Live is brought to you in part by your
- 21:49Speaker 5: hometown baseball team, the Charleston Dirty Birds, the Selango Law
- 21:52Speaker 5: Light the Night returning to gilmart Ballpark twenty first of
- 21:54Speaker 5: November to run through the first of the year. But
- 21:56Speaker 5: you please get your tickets in advanced by visiting Dblightthnight
- 21:59Speaker 5: dot com. All right, so your running as an independent?
- 22:02Speaker 4: Okay?
- 22:03Speaker 5: Not?
- 22:03Speaker 4: Why not as a Republican or Democrat.
- 22:06Speaker 9: I don't belong to either party. Non affiliate has been
- 22:10Speaker 9: something that I have just I always said everyone has
- 22:14Speaker 9: to work for my vote, and I want to work
- 22:17Speaker 9: for everyone to get their vote.
- 22:19Speaker 5: And you do realize, I mean, I'm sure you do that.
- 22:22Speaker 5: It's kind of no matter what office you're running for it.
- 22:25Speaker 5: It's kind of an uphill client, for instance, because you
- 22:28Speaker 5: don't have backing of the executive committees and things of
- 22:31Speaker 5: that nature.
- 22:32Speaker 9: I mean, it's true, but I have been having kitchen
- 22:39Speaker 9: table conversations. Any of the Dems are doing that right now,
- 22:42Speaker 9: but for about a year and a half, I've been
- 22:44Speaker 9: having these conversations with individuals in the district, people that
- 22:48Speaker 9: I love and trust and friends, family, colleagues, and they
- 22:53Speaker 9: love the concept. And if you look at voting records,
- 22:57Speaker 9: folks have changed parties either from leaving Republican leaving Democrat
- 23:02Speaker 9: to be independent.
- 23:03Speaker 5: Well, I mean unaffiliated. Independent is the fastest growing party
- 23:07Speaker 5: in West Virginia for one reason or another. And you
- 23:09Speaker 5: can you can feel in your own you know as
- 23:11Speaker 5: to why that is, but it is, I mean it
- 23:13Speaker 5: is more and more young people are registered as independent
- 23:16Speaker 5: as well. But it does make it a little difficult
- 23:17Speaker 5: on those you know, sure.
- 23:19Speaker 9: Camp and I and I've understood that. And I've had
- 23:22Speaker 9: lots of folks who have been entrenched in politics say,
- 23:26Speaker 9: you know, this is this is going to be hard,
- 23:29Speaker 9: and that's okay. Hard work is what I've always done
- 23:33Speaker 9: and I look forward to being a pragmatic voice for
- 23:38Speaker 9: our district and just being there to listen and really
- 23:43Speaker 9: focus on the issues that people are telling me that
- 23:45Speaker 9: they need.
- 23:46Speaker 5: If you are elected now as an independent, how how
- 23:49Speaker 5: would that work? Would you caucus with one side or
- 23:52Speaker 5: I mean how does that?
- 23:53Speaker 9: It depends on who invites me. I mean I have
- 23:55Speaker 9: to wait to see who would invite me to caucus
- 23:57Speaker 9: with them?
- 23:58Speaker 5: Okay, yeah, so that's I mean I really don't know
- 24:01Speaker 5: so that you it's you got to be invited, I guess, right,
- 24:03Speaker 5: and it's are you open to one side or the other?
- 24:07Speaker 9: I think right now, I just want to make sure
- 24:09Speaker 9: that I'm listening to everyone. I have good relationships. I mean,
- 24:16Speaker 9: my committee is made up of Republicans, Democrats, independents, a large.
- 24:23Speaker 4: What a novel concept.
- 24:24Speaker 9: Yeah, so we can listen to everyone, and I even
- 24:28Speaker 9: have I think one person who's a libertarian that is
- 24:30Speaker 9: supporting me, just to I I grew up. I went
- 24:36Speaker 9: to school at Marshall goheard, go ahead and listening and
- 24:41Speaker 9: then coming up with what is best for the greater
- 24:44Speaker 9: common good? Is really what this is about.
- 24:48Speaker 4: What your campaign strategy look like? I mean, are you
- 24:52Speaker 4: going to go door to door?
- 24:53Speaker 9: You go it's a door strong ground game. You know.
- 24:56Speaker 9: If I learned anything from Mayor Goodwin was a strong
- 25:00Speaker 9: ground game will get you a lot of places.
- 25:03Speaker 5: Are you open if there are meet the candidate type
- 25:07Speaker 5: forums or a debate.
- 25:10Speaker 4: Or anything like, Are you open to them?
- 25:11Speaker 9: Yes?
- 25:12Speaker 5: Of course, what I know, we don't want to give
- 25:14Speaker 5: away too much if those things do happen. But if
- 25:17Speaker 5: you're speaking to a group of people right now, what
- 25:19Speaker 5: would you say to them about why they should elect you.
- 25:24Speaker 9: I have over twenty years of experience of understanding state government,
- 25:30Speaker 9: working in the nonprofit sector and listening and acting on
- 25:35Speaker 9: behalf of individuals that may not have a voice, and
- 25:38Speaker 9: even teaching folks how to go to the capital and
- 25:42Speaker 9: advocate for themselves. I'm here to listen and to not
- 25:49Speaker 9: just listen, but actually take action. Not I've been able
- 25:54Speaker 9: to accomplish a lot in the work that I do
- 25:59Speaker 9: without how passing legislation, But just think what I could
- 26:02Speaker 9: do to help the district being in office and getting
- 26:07Speaker 9: some real actionable plans in place for folks.
- 26:09Speaker 4: Yeah, the website or social media or anything.
- 26:12Speaker 9: Facebook and Instagram. Right now, I'm Tara Martinez for the fifty.
- 26:15Speaker 5: Fourth Okay, all right, you know, one of the things
- 26:19Speaker 5: that's been said about the legislative session over the last
- 26:21Speaker 5: couple of years, and you can agree or disagree or whatever,
- 26:26Speaker 5: is that the legislature has been too focused on social
- 26:32Speaker 5: issues maybe not enough on economic issues. That's been one
- 26:35Speaker 5: of the criticisms and it's really, quite frankly, come from
- 26:37Speaker 5: both sides. Some Republicans have said, hey, we are too
- 26:41Speaker 5: focused on these things, and some Democrats have said, we're
- 26:43Speaker 5: two hookused.
- 26:44Speaker 4: Where are you on all that?
- 26:45Speaker 9: I completely agree with that. I think that we need
- 26:48Speaker 9: to really take into consideration what are the needs of
- 26:56Speaker 9: our constituents will be. I know, as a constitutant now,
- 27:01Speaker 9: I want to know how we're helping the folks during
- 27:05Speaker 9: this shutdown. I want to know what's happening. Like Shawn
- 27:10Speaker 9: Hornbuckle says, the kitchen table conversations, you know, Speaker Handshaw
- 27:17Speaker 9: yesterday during his or I don't think it was yesterday,
- 27:21Speaker 9: but Tuesday, Tuesday, talking about how inefficiencies at the federal
- 27:25Speaker 9: level are causing great heartache and we need to as
- 27:29Speaker 9: a state step up. And I think everyone agrees on that.
- 27:33Speaker 5: All right, I do this with every candidate that I
- 27:35Speaker 5: have on I give you the final thirty seconds. It's
- 27:37Speaker 5: not timed. I just say, give me, give me, give
- 27:39Speaker 5: me your kitchen table speech or your stump speech or whatever.
- 27:42Speaker 5: Why should somebody vote for Tiera Martinez.
- 27:45Speaker 9: I have lived in this district for over thirty years.
- 27:51Speaker 9: I grew up in Rowne County, West Virginia, moved to Charleston,
- 27:54Speaker 9: started working for the state of West Virginia. West Virginia
- 27:57Speaker 9: has a huge part of my heart. I have worked
- 28:02Speaker 9: with some of our most vulnerable populations. I'm a mom,
- 28:07Speaker 9: and I want to see West Virginia citizens stay here
- 28:13Speaker 9: or come back home and help us grow our state
- 28:17Speaker 9: to be better. We can be better together.
- 28:21Speaker 5: Jer Martinez, Independent candidate for House in District fifty four.

- 31:55Speaker 7: literally July fourth, twenty twenty two. After a ten week
- 32:00Speaker 7: trial in twenty twenty one, in the summer twenty twenty one,
- 32:05Speaker 7: Federal District Judge Faber issued I think a sixty two
- 32:09Speaker 7: page opinion that said that Huntington and Cable County did
- 32:14Speaker 7: not have a case. That West Virginia law, nuisance law
- 32:17Speaker 7: did not allow for this kind of look at drugs
- 32:21Speaker 7: and explosion of drugs and distribution of drugs, and that
- 32:26Speaker 7: didn't fall within the parameters of the law. And so
- 32:30Speaker 7: Cable Huntington filed an appeal to the Fourth Circuit Court
- 32:35Speaker 7: of Appeals in Richmond, which is our you know, it's
- 32:39Speaker 7: court of sort of the Atlantic Coast Conference of Yeah,
- 32:43Speaker 7: it's like Maryland, Virginia, West Virginia, North Carolina. Maybe I'm
- 32:49Speaker 7: not sure, but anyway, so they at some point they
- 32:53Speaker 7: asked the West Virginia Supreme Court, would you clarify that,
- 32:57Speaker 7: would you clarify your law for us? In the West
- 32:59Speaker 7: rgin Ginia Supreme Court basically said, no, we don't believe
- 33:03Speaker 7: it's factually developed enough for us to give you an
- 33:06Speaker 7: opinion on what our law is. So four Circuit said, okay,
- 33:10Speaker 7: so we'll do it. We'll do it on our own.
- 33:12Speaker 7: This was a panel, and that's going to become important
- 33:15Speaker 7: here in a second. So this, this panel just ruled that,
- 33:21Speaker 7: in fact, West Virginia law does incorporate the type of
- 33:25Speaker 7: legal theories that Cable Huntington has asserted and the entire
- 33:30Speaker 7: state of West Virginia has asserted as it relates to
- 33:35Speaker 7: nuisance law and you know, kind of violating the DEA
- 33:40Speaker 7: rules as it relates to distribution. In other words, should
- 33:43Speaker 7: have reported spikes, should have reported trends, didn't report either,
- 33:47Speaker 7: And as a result, they were supposed to stay within
- 33:50Speaker 7: these guardrails. They went outside the guardrails. They didn't report
- 33:53Speaker 7: that they went outside the guardrails. And our position, in
- 33:57Speaker 7: Hunt and Cavill's position, I should say, has been that
- 34:03Speaker 7: that resulted in this huge, huge opioid epidemic for which
- 34:07Speaker 7: these distributors should pay to abate, abate to clean up
- 34:13Speaker 7: the mess, to clean up the mess. So that's where
- 34:15Speaker 7: we are well.
- 34:17Speaker 5: And I found it very interesting that you were talking
- 34:19Speaker 5: about the reporting of spikes and things like that. I
- 34:22Speaker 5: mean that that seems to be like that should be
- 34:25Speaker 5: when there's you know, major major trends maybe in one
- 34:27Speaker 5: area of the county or one area of town or whatever,
- 34:30Speaker 5: that should be something they should just jump all over.
- 34:31Speaker 4: One would think that.
- 34:33Speaker 7: That's exactly what the DEEA rules and regulations say, is
- 34:38Speaker 7: that you know, report to US spikes and trends as
- 34:42Speaker 7: it relates to the distribution appeals from your distributorship. And
- 34:47Speaker 7: they didn't. I mean they didn't. I mean, that's that's
- 34:50Speaker 7: the case we made, or you know, when we went
- 34:52Speaker 7: to trial, they didn't do that. And and you know,
- 34:55Speaker 7: I've often called it a conspiracy of thieves. Everybody's making
- 34:59Speaker 7: money up and down the uh, you know, the manufacturers,
- 35:02Speaker 7: the distributors, the pharmaceuticals, everybody's making money. Nobody's want to
- 35:07Speaker 7: report anything because then the jig is up, you know,
- 35:10Speaker 7: then the DEA comes in and says, wait a minute,
- 35:12Speaker 7: what's well, what's going on here? But anyway, I you know,
- 35:15Speaker 7: I'm I tend to get a little animated about these things.
- 35:19Speaker 5: But you're you know, you do, but ay Valance showing five,
- 35:24Speaker 5: I know, I do. Hey, look I'm wearing my Marshall
- 35:25Speaker 5: gear today. You should be happy herd place tonight.
- 35:27Speaker 7: So I got them always I'm always happy when the herd.

- 35:52Speaker 4: Your career starts here.
- 35:53Speaker 5: And Rusty, I can tell you this is a case
- 35:55Speaker 5: that it got nationwide and in some cases worldwide attention
- 35:59Speaker 5: because when this came out on Tuesday, after I was home,
- 36:01Speaker 5: I flipped the TV on CNBC, you know, catch a
- 36:05Speaker 5: little business news, and they were talking about this.
- 36:09Speaker 7: Yeah, well, if you're again. When it was tried, you know,
- 36:14Speaker 7: it was the first trial in federal court in the
- 36:17Speaker 7: United States, the one before Cable Huntington was in was Cleveland,
- 36:22Speaker 7: Kyoga County in Ohio. It settled, you know, the day
- 36:26Speaker 7: before trial. And the other irony about this case is
- 36:30Speaker 7: that over the July fourth weekend before Judge Faber issued
- 36:36Speaker 7: his decision, all the cities and counties in West Virginia
- 36:42Speaker 7: negotiated the settlement of four hundred million dollars with these distributors.
- 36:47Speaker 7: I mean, like, you can't make this up, the coincidences.
- 36:50Speaker 7: You can't make up this coincidence. It literally happened the
- 36:55Speaker 7: weekend before the decision came out. They agreed to pay
- 36:58Speaker 7: four hundred million without you without you know, saying that
- 37:02Speaker 7: they were responsible for That's the way settlement's go. You know,
- 37:05Speaker 7: they doesn't say they did anything wrong. They're just going
- 37:08Speaker 7: to do it strategically. So they settled for fore under me.
- 37:12Speaker 7: So that's you know, that's that's a West Virginia. And
- 37:14Speaker 7: then the state had previously settled. The state of West
- 37:19Speaker 7: Virginia had previously settled with the distributors. Uh, I want
- 37:26Speaker 7: to say about a year before that. So everybody everybody
- 37:29Speaker 7: had when when Huntington Cable went to trial, well, I'm sorry,
- 37:35Speaker 7: when the decision came out, every everybody had settled in
- 37:39Speaker 7: the state of West Virginia except Cable Huntington. So when
- 37:42Speaker 7: the so when the opioid moneys were distributed, Cable Huntington
- 37:47Speaker 7: didn't get any of the distributors money because they opted
- 37:54Speaker 7: to try their own case. Now again, you know, too
- 38:00Speaker 7: point five billion was put on the board. You know,
- 38:02Speaker 7: that's what we put on the board. So when it
- 38:05Speaker 7: comes back to trial and hopefully that'll happen and then
- 38:09Speaker 7: that you know, in the first of the year, you know,
- 38:12Speaker 7: that's that's kind of a starting point for I think
- 38:15Speaker 7: that they'll use it's two point five billion.
- 38:17Speaker 4: All right, So where does it go now, Rusty, before
- 38:19Speaker 4: we let you go, what does it go?
- 38:20Speaker 7: Now? Well, the reason I said about the panel is
- 38:23Speaker 7: that there's the distributors can there's a couple of procedural
- 38:26Speaker 7: things they can do. One is which they can ask
- 38:28Speaker 7: the entire the entire en banc E n B, A,
- 38:32Speaker 7: n C. Which means the whole panel, the whole Fourth Circuit,
- 38:36Speaker 7: which is fifteen judges, say hey, you look at this,
- 38:38Speaker 7: and you tell us if you think this is correct.
- 38:41Speaker 7: I don't think that'll work. Then you could theoretically go
- 38:44Speaker 7: to the US Supreme Court, because that's the next court
- 38:46Speaker 7: up in federal court. You have district court, Federal Appeals Court,
- 38:50Speaker 7: then you have the US Supreme Court. I don't personally
- 38:53Speaker 7: think there's a constitutional issue there or interpreting West Virginia law.
- 38:58Speaker 7: It's going to get them to the US Supreme Court.
- 39:01Speaker 7: So but that's a decision they have to make. But
- 39:03Speaker 7: ultimately it will it will come back to Judge Favor
- 39:06Speaker 7: for a retrial, a retrial based on now based on
- 39:10Speaker 7: the four Circuit Court of Appeals law and not what
- 39:15Speaker 7: Judge Favor had originally ruled. That's that's that's the law. Now,
- 39:19Speaker 7: that's the law of the land.
- 39:20Speaker 5: All right, Rusty. I know, I know, as I said,
- 39:23Speaker 5: I can hear it your voice a little tired. I
- 39:25Speaker 5: appreciate you, but I know I appreciate you taking time

- 48:05Speaker 4: MORNING i was on the phone.
- 48:06Speaker 5: With if it's a violation of zoning, laws then in my,
- 48:10Speaker 5: opinion the county has every right to shut it. Down
- 48:12Speaker 5: and As Matt sutton said in giving his, opinion again
- 48:15Speaker 5: this is not in city. Limits but he was, saying,
- 48:17Speaker 5: look if it's a violation of zoning, laws then work
- 48:20Speaker 5: to get the zoning laws, change if that's what you
- 48:21Speaker 5: want to. DO i, MEAN i get. That but if
- 48:23Speaker 5: it's a violation of zoning, laws you, know case.

- 48:29Speaker 5: You know where does it stand right? NOW i presume
- 48:33Speaker 5: it's shut down and The Canal board Of appeals has
