- 0:03Speaker 1: New details about former Biden Attorney General Merrick Garland's controversial
- 0:07Speaker 1: 2021 memo and the bombshell report exposing it all. It
- 0:13Speaker 1: includes investigating a mom for owning a gun and belonging
- 0:16Speaker 1: to a right wing moms group. And it claims the
- 0:20Speaker 1: White House asked the Department of Justice to find a
- 0:22Speaker 1: way to prosecute parents simply for speaking out about their
- 0:26Speaker 1: children's education. And now a new report is revealing what
- 0:30Speaker 1: was happening behind the scenes.
- 0:32Speaker 2: Like that wasn't enough.
- 0:34Speaker 1: It includes internal warnings that the effort could be political
- 0:38Speaker 1: and unconstitutional.
- 0:40Speaker 2: You're watching Outnumbered. I'm Harris Faulkner.
- 0:43Speaker 1: With me on the couch today, for the very first time,
- 0:45Speaker 1: Melissa DeRosa, Democrat strategist and Fox News contributor. Molly Line,
- 0:50Speaker 1: Fox News correspondent. Molly Hemingway, Fox News contributor. And Paul Morrow, attorney,
- 0:56Speaker 1: retired NYPD inspector and Fox News contributor. And host of
- 1:00Speaker 1: the weekly rap sheet on Fox Nation. So it was
- 1:04Speaker 1: 2021 and parents were flooding school board meetings to protest
- 1:08Speaker 1: COVID restrictions and how race and gender were being taught
- 1:11Speaker 1: in schools. After the National School Board's Association asked for
- 1:16Speaker 1: federal help over threats against school officials, Garland issued a
- 1:20Speaker 1: memo directing the FBI and U.S. attorneys to coordinate on
- 1:25Speaker 1: those so-called threats. Internal emails suggest the DOJ itself, under Biden,
- 1:32Speaker 1: was divided over the response, with one email stating, quote,
- 1:36Speaker 1: they might as well rename the damn thing, it's a quote,
- 1:40Speaker 1: the anti-MAGA.
- 1:41Speaker 2: Task force, end of quote.
- 1:44Speaker 1: The report further reveals worries that the investigations into parents would, quote,
- 1:48Speaker 1: tarnish reputation as an apolitical law enforcer and could be
- 1:53Speaker 1: challenging from a First Amendment perspective and also be seen
- 1:57Speaker 1: as a partisan exercise aimed at those who do not
- 2:00Speaker 1: support the administration.
- 2:01Speaker 2: All those quotes coming. You see them on the screen.
- 2:04Speaker 1: The review comes from a January 2025 executive order from
- 2:07Speaker 1: President Trump targeting what his administration is calling the weaponization
- 2:12Speaker 1: of federal agencies. Then-Attorney General Pam Bondi specifically directed the
- 2:17Speaker 1: DOJ to review the Garland memo, which has led to
- 2:20Speaker 1: this report. And the new report concludes that those early
- 2:24Speaker 1: concerns were on track.
- 2:27Speaker 2: They were spot on.
- 2:29Speaker 1: The initial skepticism of Department of Justice personnel.
- 2:32Speaker 2: Proved well-funded, founded, I should say.
- 2:36Speaker 1: The Garland memorandum, though, nominally focused on the threats of violence,
- 2:40Speaker 1: attempted to interfere with parental rights, and speech, in quote,
- 2:44Speaker 1: at the very least.
- 2:45Speaker 2: Molly. Oh, my goodness. I've got a couple of Mollies,
- 2:49Speaker 2: and they're both fantastic. Molly Hemingway.
- 2:51Speaker 3: By all means. This really is a stunning report. We
- 2:54Speaker 3: had already learned a little bit about this, that teachers' unions,
- 2:57Speaker 3: which are a big Democrat Party constituency, had asked the
- 3:00Speaker 3: White House to target the parents who were critical— of
- 3:03Speaker 3: the way some things were happening in our schools. And
- 3:06Speaker 3: the White House and DOJ just said, yeah, whatever you want.
- 3:08Speaker 3: It does show how important that teachers' union constituency is
- 3:12Speaker 3: to the Democrat Party. But this really is stunning. Yes,
- 3:15Speaker 3: there were some people who said, you shouldn't go along
- 3:17Speaker 3: with this. But that did not keep DOJ from actually
- 3:20Speaker 3: moving full force ahead, opening dozens of investigations and going
- 3:24Speaker 3: after parents who were rightly concerned with the radicalism in
- 3:28Speaker 3: many of their schools.
- 3:29Speaker 1: So, Melissa, I guess I'm just curious, why would anybody
- 3:33Speaker 1: feel the need to do that?
- 3:34Speaker 2: I mean, it's free speech.
- 3:35Speaker 4: Well, and I think that two things can be true, right?
- 3:38Speaker 4: If there were legitimate claims of harassment or threats, and
- 3:42Speaker 4: we're all living in a time where political violence is rampant, right?
- 3:45Speaker 4: President Trump has endured not one but two assassination attempts.
- 3:49Speaker 4: When I was in government, I had threats on my life.
- 3:51Speaker 4: I had a security detail for a period of time,
- 3:53Speaker 4: Congress members being shot on baseball fields. So, I understand
- 3:57Speaker 4: if you're hearing that there are things like real threats
- 4:00Speaker 4: of violence and harassment, the desire to act.
- 4:03Speaker 2: But that doesn't necessarily mean you immediately deploy the FBI.
- 4:07Speaker 2: There should be an interim step.
- 4:08Speaker 4: The FBI should review what they were putting out and
- 4:12Speaker 4: seeing whether or not there was some legitimacy to it
- 4:14Speaker 4: before you just jump. And that's a critically important step
- 4:17Speaker 4: when you're talking about the Department of Justice and the
- 4:20Speaker 4: FBI and the freedom of speech and our parental rights.
- 4:23Speaker 2: Yeah, not just an interim move. That's their job, to
- 4:25Speaker 2: figure out if the threats are real.
- 4:27Speaker 5: Yeah, I would be— It's very— it' s fascinating to see the
- 4:31Speaker 5: political interest that people had as this memorandum was coming
- 4:34Speaker 5: out and how concerns were aimed at what this could
- 4:37Speaker 5: mean politically for the Republican Party somewhere down the road
- 4:40Speaker 5: when the elections drew closer that.
- 4:41Speaker 2: Would be politically bad.
- 4:43Speaker 5: But I would love to understand more about any— concerns
- 4:47Speaker 5: that were raised about this being just simply unconstitutional and
- 4:51Speaker 5: interfering with the parents' rights in schools, which is still
- 4:55Speaker 5: a huge electoral issue as we head towards these midterm elections.
- 4:58Speaker 5: Parents want to know what's going on in their schools,
- 5:01Speaker 5: what's being taught.
- 5:01Speaker 2: Especially after COVID.
- 5:03Speaker 1: Molly, you and I have talked about, as moms, we
- 5:05Speaker 1: want to know.
- 5:06Speaker 5: Yes, which is a great point, that at the point
- 5:09Speaker 5: this memorandum came out, we were just coming out of COVID,
- 5:12Speaker 5: where many parents were enlightened to find out via Zoom
- 5:15Speaker 5: calls and Zooms what their children were actually being taught
- 5:18Speaker 5: and then wanted to change the direction of what they
- 5:21Speaker 5: were learning in the course from that. And there have
- 5:24Speaker 5: been significant efforts underway for years now to find out
- 5:30Speaker 5: what exactly went on with this memorandum. I mean, it
- 5:33Speaker 5: goes back to hearings in 2021 where they were trying
- 5:37Speaker 5: to find out very alarming concerns about free speech and
- 5:41Speaker 5: if parents were being tempered and pushed back down, and
- 5:44Speaker 5: that if it was being weaponized or how concerned they
- 5:46Speaker 5: were about actual real threats when the FBI was called
- 5:49Speaker 5: in with attorneys general.
- 5:51Speaker 1: So, Paul, I guess my question comes back to something
- 5:53Speaker 1: that Melissa said. Two things can be true. We don't
- 5:55Speaker 1: know if the threats were true. I mean, that's what
- 5:58Speaker 1: I want to know. I want to know what they
- 5:59Speaker 1: knew then. I think we can make that public now
- 6:01Speaker 1: if we're going to go forward with everything else and
- 6:03Speaker 1: why the DOJ and the world, why would they put
- 6:06Speaker 1: the Constitution in its crosshairs?
- 6:08Speaker 6: Well, let's recognize one of the terms that was imported
- 6:11Speaker 6: into this thing that they used. Domestic terrorists is one
- 6:14Speaker 6: of the terms that they— are you kidding me? First of all,
- 6:17Speaker 6: America doesn't have a domestic terrorist statute, okay?
- 6:20Speaker 7: We don't have that thing.
- 6:22Speaker 6: It's really hard to do that as a domestic terrorism case.
- 6:25Speaker 6: In order to do that, you essentially need— if you don't
- 6:28Speaker 6: have a connection to a foreign power, you need an
- 6:31Speaker 6: ambition to do something like use a weapon of mass destruction.
- 6:35Speaker 1: So, in other words, not those parents.
- 6:37Speaker 7: Exactly.
- 6:38Speaker 6: So, they're calling these people— remember what they said about traditional
- 6:40Speaker 6: Catholics as well.
- 6:41Speaker 7: And look at the distinction.
- 6:42Speaker 6: When Donald Trump in this administration talks about domestic terrorists,
- 6:46Speaker 6: they're talking about narco-traffickers who are killing our kids. This
- 6:49Speaker 6: is in regard to parents. And let's enlarge the playing field.
- 6:53Speaker 6: What's really going on here, as we all know— I' ve said
- 6:55Speaker 6: it on.
- 6:55Speaker 7: The show previously, Harris. You and I have talked about this.
- 6:59Speaker 6: As the Jesuits used to say in the old days,
- 7:01Speaker 6: give me the child till seven, I have the child
- 7:04Speaker 6: for life.
- 7:04Speaker 5: Right?
- 7:05Speaker 7: And that's what's really going on here.
- 7:07Speaker 6: This government wanted to, the Biden administration, wants to raise
- 7:10Speaker 6: your kids.
- 7:11Speaker 7: That's it.
- 7:12Speaker 6: All right? And that's why the teachers' union is all,
- 7:14Speaker 6: are all involved and embedded in this. Because if they
- 7:17Speaker 6: know they could get the kid at that stage, that early,
- 7:20Speaker 6: that's why universal daycare is such a hyper-popular thing in
- 7:24Speaker 6: the blue cities. They get the kids. There's nothing wrong
- 7:26Speaker 6: with daycare. Mother has to go to work. Father has
- 7:28Speaker 6: to go to work.
- 7:28Speaker 7: We get that.
- 7:29Speaker 6: Okay.
- 7:29Speaker 7: But you better understand what you're getting into.
- 7:31Speaker 6: The government's going to raise your kid Up until 7,
- 7:34Speaker 6: 8 years old, you can imprint those values. Then they
- 7:37Speaker 6: go into the public schools where all that stuff is
- 7:39Speaker 6: only exacerbated and strengthened. And then you come out the
- 7:42Speaker 6: other way, and you end up with a teacher's union
- 7:45Speaker 6: raising your kid as opposed to you.
- 7:47Speaker 7: And if you want.
- 7:49Speaker 6: A woman like we saw in Chicago going like this
- 7:51Speaker 6: after Charlie Kirk at that demonstration. You want that woman
- 7:54Speaker 6: raising your kids? You better understand what's going on. It's
- 7:57Speaker 6: not domestic terrorism. It's raising your kids as opposed to
- 8:00Speaker 6: the government imprinting your kids.
- 8:03Speaker 3: Parental concern was a really big political issue at the
- 8:07Speaker 3: time this memo came out. You might remember, in Virginia,
- 8:10Speaker 3: they elected a Republican governor, lieutenant governor and attorney general,
- 8:14Speaker 3: all based on concern with how schools had embraced radical
- 8:17Speaker 3: gender ideology, horrific COVID policies and other extremism. But this
- 8:22Speaker 3: is also part of a pattern with the FBI and
- 8:24Speaker 3: Department of Justice, a heavily partisan, weaponized system. Department. This
- 8:29Speaker 3: is the group that ran the Russia collusion lie against
- 8:33Speaker 3: President Trump. They also ran a broad investigation into anyone
- 8:37Speaker 3: who was right of center. Last week, we learned that
- 8:39Speaker 3: Jack Smith had picked up journalist communications, including my own,
- 8:43Speaker 3: as part of that effort. And it's not just this story.
- 8:46Speaker 3: It's going after the Catholics. It's going after pro-lifers. It's
- 8:49Speaker 3: going after parents and going after anyone else they deemed
- 8:52Speaker 3: a political enemy.
- 8:52Speaker 2: Yeah.
- 8:53Speaker 1: So, you know, it's interesting you talk about that. You've
- 8:55Speaker 1: heard certain people call it deep state and so on
- 8:57Speaker 1: and so forth. I haven't heard of, like, mass people
- 9:01Speaker 1: leaving from the FBI. So where did the political heads
- 9:04Speaker 1: in the FBI go during the next president?
- 9:08Speaker 7: Look, the FBI.
- 9:09Speaker 2: And by and.
- 9:10Speaker 1: Large, the rank and file, amazing. We're not talking about
- 9:13Speaker 1: a large group of people.
- 9:14Speaker 7: The politicization happens in D.C. The FBI said, did I
- 9:18Speaker 7: love all of them? No, they didn't love me either, OK?
- 9:20Speaker 6: I had a lot of fights about cases and everything else.
- 9:23Speaker 7: That's just law enforcement.
- 9:24Speaker 6: But that said, I never got the sense that any
- 9:26Speaker 6: of them... We're looking to do something hyperpolitical on the
- 9:30Speaker 6: basis of pure politics. Generally, at least in the world
- 9:34Speaker 6: that I was in, which was the kind of terrorism world,
- 9:36Speaker 6: they were trying to keep something from going boom. The
- 9:38Speaker 6: politicization happens inside the beltway.
- 9:41Speaker 7: We all know that. And it's coming right from the top.
- 9:44Speaker 6: Or in Biden's case, who knows who gave the order,
- 9:45Speaker 6: because I don't think he was really at the steering wheel.
- 9:48Speaker 6: So you've got to look at people like Jill. the
- 9:51Speaker 6: chief of staff, Jill's chief of staff, these were all
- 9:54Speaker 6: the politboros, they called themselves, who were steering the country
- 9:57Speaker 6: there for a while, and they were giving edicts to create.
- 10:00Speaker 6: a nation that they wanted and that they know in
- 10:02Speaker 6: a nation of laws, the DOJ is who has the lever.
- 10:05Speaker 6: And it's one of these things that will go into Congress.
- 10:07Speaker 6: There'll be a million hearings. Nothing will ever happen. The
- 10:10Speaker 6: best thing that can happen is the sunlight. People need
- 10:12Speaker 6: to be aware of it so it doesn't happen again.
- 10:14Speaker 1: Yeah, that's why I'm glad we know at least what
- 10:16Speaker 1: was going on with the parents.
- 10:18Speaker 2: Okay.
