- 0:00SPEAKER_00: Welcome to the Latino Podcast, where we amplify the voices of Latino professionals, entrepreneurs, and leaders coming together to educate, inspire, and connect across one of the most dynamic binational regions in the world.
- 0:12SPEAKER_00: Bicultural, premium, powerful.
- 0:20SPEAKER_02: Hey Sean Gomez with another episode of the La Tino Podcast and our special series of podcasts here from Washington, D.C.
- 0:28SPEAKER_02: We are here at the Hispanic National Bar Association annual conference, meeting great people from all over the country, even outside the country.
- 0:38SPEAKER_02: Um, this episode, as always, is brought to you by MasterCard.
- 0:41SPEAKER_02: Nope, let me correct that.
- 0:42SPEAKER_02: It's brought, and you'll learn why I said that, uh, is brought to you by Gomez Trial Attorneys, a bi-national law firm with offices both in the United States and Mexico, a bicultural law firm delivering the very highest legal excellence to both English and Spanish, and best in class.
- 0:59SPEAKER_02: We do believe we're the best lawyers of what we do.
- 1:01SPEAKER_02: What do we do?
- 1:02SPEAKER_02: We represent consumers and personal injury, um, mass tort, employment harm, and civil rights cases.
- 1:09SPEAKER_02: And so uh we have some great uh guests that have joined us here today.
- 1:14SPEAKER_02: You'll get the reference to MasterCard in a moment.
- 1:17SPEAKER_02: But David Aragin, my co-host, uh, who started off as a guest on the podcast back in San Diego, where we're from, and then joined the firm and now runs our um border uh border corridor practice and is in charge of outreach at the law firm.
- 1:34SPEAKER_02: Uh, but David, why don't you introduce our our newest guest?
- 1:38SPEAKER_03: Thank you, John.
- 1:39SPEAKER_03: By the way, that podcast was probably a job interview, so I nailed it.
- 1:44SPEAKER_03: But uh, so one of the things that I'm loving about the HMBA, it's like open space, you're talking to people, and you know, people are actually reaching out to us and they want to participate in the podcast.
- 1:53SPEAKER_03: So I appreciate you reaching out.
- 1:55SPEAKER_03: We had a nice conversation earlier.
- 1:57SPEAKER_03: I know you were in a hurry, but now you brought like Juan as well.
- 2:00SPEAKER_01: Absolutely.
- 2:01SPEAKER_03: So happy to have you here.
- 2:02SPEAKER_03: Generally, what we ask is tell us who you are, where you're from, what you do, and then we'll get a little bit deeper into that.
- 2:09SPEAKER_00: Go ahead.
- 2:10SPEAKER_04: So, um, Juan Gonzalez, I'm uh Senior Vice President, Associate General Counsel of MasterCard.
- 2:16SPEAKER_04: I've been there for about 19 and a half years, uh, focused on intellectual property law.
- 2:20SPEAKER_04: So mainly patents, patent litigation, patent prosecution, client counseling, and the sort.
- 2:26SPEAKER_04: Um, I was an engineer before that.
- 2:28SPEAKER_04: Uh, and I went to law school at night uh while I was working at the electric utility, uh, first generation uh law school.
- 2:35SPEAKER_04: I was born in Ecuador, but raised in New York City.
- 2:39SPEAKER_04: Uh, so very proud of that.
- 2:42SPEAKER_04: My mom and dad, you know, classic immigrant story.
- 2:45SPEAKER_04: Uh, and uh, you know, that helped put me through school and put me where I am now.
- 2:49SPEAKER_04: So very happy.
- 2:50SPEAKER_04: A MasterCard, fantastic company, uh, really, really great experience there working.
- 2:55SPEAKER_04: I mean, my my whole legal career there pretty much.
- 2:58SPEAKER_04: And um, you know, their commitment to, you know, to uh helping underprivileged communities in any way and increasing representation in the legal profession has been one of their one of their hallmarks uh over the years that I've been there.
- 3:11SPEAKER_04: And our sponsorship of the HMBA over the last several years has been uh a testament to that.
- 3:17SPEAKER_04: So we believe in the mission, we believe uh in what they're trying to accomplish, um, and we're here for that purpose.
- 3:24SPEAKER_04: So thank you for your sponsorship.
- 3:26SPEAKER_04: Yep.
- 3:27SPEAKER_04: You're welcome.
- 3:28SPEAKER_01: It is definitely a great space uh to represent our community and give the opportunity to the group of uh Latino lawyers uh or legal practitioners in MasterCard to participate.
- 3:40SPEAKER_01: Whether you are as senior as Mr.
- 3:43SPEAKER_01: here next to me, or as junior as somebody that is just you know joining the company at an interlevel, it's open, right?
- 3:51SPEAKER_01: The exposure is there, uh, the brand is there.
- 3:54SPEAKER_01: So that identification of MasterCard as supporting the HMBA, you know, as encouraging everybody to be a part of the mission, their vision, their passions.
- 4:08SPEAKER_01: Um, that's what we're here for.
- 4:09SPEAKER_01: And we have done it, I don't know, for how many years now?
- 4:12SPEAKER_04: Uh at least, oh it goes back in before my time, but it it's been pretty consistent for the last seven or eight years.
- 4:18SPEAKER_04: Um, and then I might have some breaks in between, usually when there's a change of senior Latino leaders, which aren't that many, uh, it changes hands and then we, you know, we lose it for a year and then we come back.
- 4:30SPEAKER_04: So I've been helping doing this for the last five or six years.
- 4:33SPEAKER_04: Uh, before that, it was someone else that that was at the company that left.
- 4:37SPEAKER_04: So we've been supporters for for quite some time.
- 4:39SPEAKER_03: So, what what one of the things that I see, like we go to conferences uh a lot, uh, but generally I don't hear like that passion about the conference and the group.
- 4:48SPEAKER_03: Like a lot of the people that we're talking here today, the guests that we have, they all speak so passionately about HMDA.
- 4:54SPEAKER_03: Like, what do you think that is?
- 4:56SPEAKER_01: Well, the way you see it here at the conference, at least, right?
- 5:00SPEAKER_01: It's a space where you can pay it forward.
- 5:05SPEAKER_01: You're here, you participate, we you know, we moderate, we do panels.
- 5:10SPEAKER_01: We have the opportunity to share that knowledge, to actually complete each other throughout different experiences, whether it is as an in-house council, as a compliance lead myself, outside council, you know, somebody that is uh in government doing some kind of you know function.
- 5:29SPEAKER_01: Every single point of view within our community represents the effort of a family that migrated into the US, whether first generation, second, third, or fourth, we made it.
- 5:45SPEAKER_01: We made it through the corporate ladder, we made it through the you know public service career path, we made it, you know, within the law firm.
- 5:55SPEAKER_01: And that's that's really critical for young generations to see and actually have somebody to look up to.
- 6:04SPEAKER_02: Well, thank you for your leadership, thank you for being an example to others.
- 6:07unknown: Of course.
- 6:08SPEAKER_02: And so um I have a I have a uh a it's kind of a little bit of a funny question, but I don't know if so.
- 6:16SPEAKER_02: I used to work um when I was in college, I was um a representative for a beer distributor.
- 6:23SPEAKER_02: And our main beer was uh Miller.
- 6:26SPEAKER_02: And so we would uh compete with Budweiser, and so you know, our people were very, very, very loyal to Miller.
- 6:34SPEAKER_02: And like if you were to be caught, think of it as Pepsi and Coke, you know, uh Miller and Budweiser.
- 6:41SPEAKER_02: Uh, what if you showed up to the MasterCard dinner and you put down a visa to pay?
- 6:46SPEAKER_02: Or what would that be?
- 6:50SPEAKER_04: That's like that's like the equivalent of going to the Coca-Cola headquarters on top of the Pepsi.
- 6:55SPEAKER_04: I wondered, I wondered.
- 6:56SPEAKER_04: Uh I mean it's happened.
- 6:58SPEAKER_04: It's happened.
- 6:59SPEAKER_04: I I've been to many dinners and events with our outside council, right?
- 7:02SPEAKER_04: Who represents this.
- 7:04SPEAKER_04: And, you know, the theory.
- 7:07SPEAKER_04: And they pull out a visa.
- 7:09SPEAKER_04: And then, you know, my home manager, I was more kind about it.
- 7:13SPEAKER_04: I pretended to my home manager used to say, you know, you're breaking my heart here.
- 7:16SPEAKER_04: What are you saying?
- 7:17SPEAKER_04: What are you doing?
- 7:17SPEAKER_04: And then their response is, well, that's a corporate card, that's what the company gave us.
- 7:20SPEAKER_04: You know, I have no control over it.
- 7:22SPEAKER_04: I didn't pick it.
- 7:22SPEAKER_04: It's just what the company does.
- 7:24SPEAKER_04: But but that but that has happened.
- 7:26SPEAKER_04: And you know, we're competitors with Visa, right?
- 7:28SPEAKER_04: Just like Pepsi and Coke and Miller and Bud.
- 7:32SPEAKER_04: So we know that they're out there.
- 7:33SPEAKER_04: And you know, we're we're number two in terms of size, in terms of number of cards and transaction volume, but we're leading in other areas as well, many of the technology technology areas.
- 7:42SPEAKER_04: We're out front in a lot of things that Visa's trying to catch up on.
- 7:45SPEAKER_04: So, you know, it's nice to be number one in terms of overall volume and stuff, but um, but you know, we know our competitors are out there, and you know, we we we compete out there like any other company and staying out in front with our with our products and services, our people, um, and um managing risk, you know, which what we do every day is the lawyers.
- 8:06SPEAKER_04: Um, and yeah, we we're we're happy to be out there.
- 8:09SPEAKER_04: And uh, you know, we know what happens with a visa comes out, like, oh I just wondered.
- 8:14SPEAKER_04: I was curious, you know, because that was my experience.
- 8:16SPEAKER_04: Well, well, uh, I'm sorry, a quick story that I'll tell you after the story.
- 8:19SPEAKER_04: See, he's a good idea.
- 8:20SPEAKER_04: My manager was really he retired.
- 8:22SPEAKER_04: He he banked with Chase, uh Chase, Chase, JP Morning Chase.
- 8:26SPEAKER_04: And they don't issue uh they issue visa debit cards.
- 8:29SPEAKER_04: You have a checking account to give you debit cards.
- 8:30SPEAKER_04: Yeah, you only issue visa and not MasterCard.
- 8:34SPEAKER_04: And uh and he said, give me an unbranded debit card.
- 8:37SPEAKER_04: I don't want the Visa brand on it.
- 8:39SPEAKER_04: I just just he doesn't want anything visa in his wallet.
- 8:41SPEAKER_04: Right.
- 8:41SPEAKER_04: So so he asked Chase for it, you have to make a special request.
- 8:43SPEAKER_04: Because if you don't say anything, they give you the visa, everybody.
- 8:46SPEAKER_04: So he was so passionate about not carrying a visa that he said, just give me an unbranded generic debit card with my name on it for my to access my account.
- 8:54SPEAKER_04: Yeah, so he couldn't use it to pay for things, you could only use it to go to the ATM and get cash and do transactions, but he couldn't use it because he didn't want to have ever pull out a visa out of his wallet.
- 9:03SPEAKER_04: I was like, Well, that's hardcore.
- 9:04SPEAKER_04: I mean, I I get it.
- 9:06SPEAKER_02: It would have been more hardcore to change banks.
- 9:07SPEAKER_02: Yeah, I know.
- 9:08SPEAKER_02: But he said he didn't gotta do that.
- 9:09SPEAKER_04: No, but that's the easier thing to do.
- 9:11SPEAKER_04: I think it's easy to change banks.
- 9:12SPEAKER_04: But to ask the bank, can you give me a special card?
- 9:15SPEAKER_04: Yeah, you know, I mean, um like a black one.
- 9:18SPEAKER_04: That's no brand, yeah, just blank one, yeah.
- 9:21SPEAKER_01: Blank canvas.
- 9:22SPEAKER_01: I I kind of sleep at night.
- 9:24SPEAKER_01: I can tell.
- 9:25SPEAKER_01: You take my wallet, you know what's gonna be there.
- 9:28SPEAKER_02: Yeah, yeah.
- 9:29SPEAKER_02: The little ambiguity.
- 9:30SPEAKER_01: The little two circles joining together.
- 9:33SPEAKER_01: And that's that's the point, right?
- 9:34SPEAKER_01: No matter if you're um red or yellow, you know, is is the space where you come together.
- 9:40SPEAKER_01: As a community, the space where you come together.
- 9:43SPEAKER_01: Um, when you identify the needs, the causes, you support, you endorse, and uh at the end is the benefit of the end user, you know, it's our carholders.
- 9:53SPEAKER_01: Now, not only with uh our core business, but also, you know, in the fraud space, cybersecurity, all of that is is the goal.
- 10:00SPEAKER_01: Trust is our north art.
- 10:04SPEAKER_01: So that's what we do.
- 10:05SPEAKER_01: And that's what we do in different areas, you know, law and compliance is no different.
- 10:10SPEAKER_01: And um we represent that voice.
- 10:13SPEAKER_02: And so, you know, if if you were, you know, listening to this, and um you're a young Latino or Hispanic lawyer or you know, aspiring lawyer, maybe a law student, you know, what does a career at a company like yours look like for them?
- 10:30SPEAKER_02: And what would the advantages be of maybe having different backgrounds uh like you have?
- 10:35SPEAKER_03: And I'll add a little bit like how do you even start like a something like that.
- 10:41SPEAKER_04: Yeah, I mean it's it's the company's grown a lot, so there's been a lot more opportunities for young, uh diverse lawyers, Latino lawyers to come into the company.
- 10:48SPEAKER_04: When I started, there were much fewer lawyers, uh, and it was harder.
- 10:51SPEAKER_04: It's harder.
- 10:52SPEAKER_04: You had to have several years of uh uh law firm experience and then go through an interview, a long interview process to come in.
- 10:59SPEAKER_04: You know, in-house shops are always very hard to get uh no matter what what the color your skin is.
- 11:04SPEAKER_04: But especially in in a company like MasterCard in the New York area where I was, there weren't that many Latino lawyers.
- 11:10SPEAKER_04: I wasn't the first one, but I was probably one of the first in the office.
- 11:13SPEAKER_04: Um and so and and now we have a Miami office where there are much more bigger Cuban community and Latinos, so there's more lawyers there.
- 11:20SPEAKER_04: But um now it's it's a very diverse company.
- 11:23SPEAKER_04: It's uh I think having different perspectives uh from different countries and different cultures always adds uh value to whatever advice you you're giving or whatever you're how you're trying to help your clients.
- 11:34SPEAKER_04: And I think a young lawyer would have a really great experience uh at a company like like MasterCard, where diversity is cherished and where we really try to take in all different perspectives.
- 11:45SPEAKER_04: Um it's just hard to get in sometimes.
- 11:47SPEAKER_04: It's hard because there's a lot of competition always.
- 11:50SPEAKER_02: Right.
- 11:50SPEAKER_04: But uh I I think the company the company hires on merit, but but you know, we like to see a different palette of opinions and backgrounds when we when we hire it.
- 12:00SPEAKER_03: You gotta get the different perspectives, right?
- 12:02SPEAKER_03: Like basically the consumer is your client.
- 12:04SPEAKER_03: Yeah.
- 12:05SPEAKER_04: So yeah, we're we're a global company, you know.
- 12:08SPEAKER_04: We we have um customer relationships in all in like 220 countries around the world.
- 12:13SPEAKER_04: So we don't know Oh really?
- 12:14SPEAKER_04: Yeah, we're not uh our our customers are with the banks.
- 12:16SPEAKER_04: So every bank in the world pretty much Yeah, MasterCard in Ecuador?
- 12:19SPEAKER_02: Yeah, yeah.
- 12:20SPEAKER_04: Oh wow, there's a sales office in every country, except some like not North Korea, yeah, yeah, other places, but um every country has us at least a small mascard office, and we we have we have business there.
- 12:31SPEAKER_04: We conduct business.
- 12:32SPEAKER_04: That's what makes interoperability possible.
- 12:35SPEAKER_04: That's why you can use a card anywhere in the world that has a logo, the mascard logo.
- 12:40SPEAKER_04: You can anywhere is accepted.
- 12:41SPEAKER_04: And the merchants, of course.
- 12:42SPEAKER_04: The merchants on the one end and the banks on the other that issue the cards.
- 12:46SPEAKER_04: Um then maybe fight stereotypes that people blame us for like high interest rates and for predatory credit practices, which is not us.
- 12:53SPEAKER_01: That's not us.
- 12:54SPEAKER_01: That's not us, not us, guys.
- 12:55SPEAKER_01: Not us.
- 12:57SPEAKER_04: The credit card companies, they they're trying to rip you off.
- 12:59SPEAKER_04: The credit card companies are hidden fees.
- 13:01SPEAKER_04: It's not us, it's the banks.
- 13:04SPEAKER_01: It's just not us, it's not us.
- 13:06SPEAKER_04: Not the Hispanic National Bar Association member banks.
- 13:10SPEAKER_04: The banks are regulated, and on the law, they have to disclose now.
- 13:13SPEAKER_04: They have to disclose uh the the late fees, they have to disclose uh the annual fees.
- 13:17SPEAKER_04: The disclosures are now very prominent.
- 13:19SPEAKER_04: They put it in big letters now.
- 13:20SPEAKER_04: That's that's by law, because they want to prevent people from getting fooled and tricked.
- 13:23SPEAKER_04: And and it's good practice.
- 13:24SPEAKER_04: And I think not to be facetious, but banks compliant and most banks are very, you know, uh credible and very uh ethical in that respect.
- 13:32SPEAKER_04: They're following the law.
- 13:33SPEAKER_04: But when a customer's unhappy with their interest rate or they they they think whatever, they they say, NASACard, visa, you know, they're they're it's not us.
- 13:41SPEAKER_03: I'm like, come on, consumer, pay your credit card, you know, you gotta pay it.
- 13:43SPEAKER_02: Yeah, I feel like doesn't the interest rate kind of float depending on on your credit profile and stuff like that?
- 13:49SPEAKER_02: We we don't know.
- 13:49SPEAKER_02: That's not us.
- 13:50SPEAKER_02: Oh, it's not yours.
- 13:51SPEAKER_02: It's not a fancy.
- 13:54SPEAKER_04: It varies by different things.
- 13:55SPEAKER_04: Yeah, yeah.
- 13:55SPEAKER_04: Your risk profile and the market and whatever else, but you know, they're they're they're they're pretty high.
- 14:00SPEAKER_04: Um so so yeah, so so we know we we we have relationships with all the banks, and we we work with them to make the whole system work so that your card can be used, can be used anywhere.
- 14:13SPEAKER_02: That's super amazing.
- 14:14SPEAKER_02: Like it's seamless.
- 14:15SPEAKER_02: I hadn't even thought about it, but you guys have actual physical presence in like almost every country in the world.
- 14:22SPEAKER_02: Yeah, you have no idea.
- 14:23SPEAKER_01: Digital payments, that's what it is.
- 14:25SPEAKER_04: And no idea how what the technology that goes on just to tap that card or your phone and make that payment, get approved, and come back in the matter of what three seconds, seconds.
- 14:34SPEAKER_04: So much happens in that time you have no idea how that message gets traveled, goes through computers, gets approved by the bank, goes back, and then boom.
- 14:41SPEAKER_04: Just by boom.
- 14:42SPEAKER_02: Just just in that so you do you understand like as an engineer, were you an engineer?
- 14:46SPEAKER_02: Is that what you said?
- 14:47SPEAKER_02: Yes.
- 14:48SPEAKER_02: Do you understand like how that works?
- 14:49SPEAKER_04: I mean, I have a better understanding.
- 14:51SPEAKER_04: I don't claim to be in the weeds, uh, but but I understand how how the the systems are interconnected and what our role is in making that transaction work and making sure that that we're being protected.
- 15:02SPEAKER_04: There's a lot of fraud, making sure that we protect our our client customers.
- 15:05SPEAKER_04: We we we help the banks a lot.
- 15:07SPEAKER_02: What is what is uh what's the biggest threat, like security threat?
- 15:11SPEAKER_02: Is it uh like how can they hack in and do bad things?
- 15:17SPEAKER_01: Cyber attacks?
- 15:18SPEAKER_02: Yeah, well, I don't know, cyber attacks are it?
- 15:20SPEAKER_01: Oh yeah, yes, for banks and for us and for everybody in general.
- 15:23SPEAKER_03: Yeah, how about like as in the cyberspace is like I worked at the district attorney's office and financial crimes, and we were seeing a lot of the credit cards being stolen on on RAP, basically from the originator to the client because they're they're going to the mailboxes.
- 15:37SPEAKER_03: Like, do you guys is that like a real threat or is that like a minor threat?
- 15:41SPEAKER_01: I think I think technology calls the shots.
- 15:44SPEAKER_01: At the beginning, you will see that the physic, the actual physical card getting stolen, or the the bar, you know, the band, then the chip.
- 15:53SPEAKER_01: And then and now it's just you know, it's just digits, right?
- 15:59SPEAKER_01: And uh and it and but I think that the flip side of it is how much we as a company contribute to uh security and and fraud protection or fraud prevention, right?
- 16:12SPEAKER_01: So that uh in the digital space, there is a lot that is taking place with tokenization and uh and cybersecurity, and that's that's also an area where we are a very strong player and uh and our portfolio has diversified considerably.
- 16:30SPEAKER_02: And so uh thank you guys, thanks for your sponsorship.
- 16:33SPEAKER_02: Thank you for being here, thank you for teaching us a little because there's so many pathways that our listeners uh or future lawyers or lawyers can take in law.
- 16:43SPEAKER_02: Here's another one, you know, that values diversity, that has uh a diverse uh legal team that sponsors the Hispanic National Bar Association conference.
- 16:54SPEAKER_02: And so um so far, you've been here for I guess maybe your second day um of the conference.
- 17:00SPEAKER_02: You know, how how has the conference been for you guys?
- 17:02SPEAKER_02: What have you enjoyed?
- 17:04SPEAKER_04: I mean, I've been coming for several years.
- 17:05SPEAKER_04: I I enjoy just meeting people, meeting colleagues in the Latino community.
- 17:09SPEAKER_04: Sometimes when you feel isolated in the workplace, because there's not many people like you, yeah.
- 17:13SPEAKER_04: You come here and you see people like you, similar stories, similar backgrounds, even junior people, more senior people, uh sharing war stories, sharing experiences, the panels.
- 17:23SPEAKER_04: I mean, it's just an enrichment of uh the culture coming together in the legal profession, right?
- 17:28SPEAKER_04: And that's that's a nice mix of the Latinos and law together.
- 17:31SPEAKER_04: So it celebrates it.
- 17:36SPEAKER_04: So you celebrate I like the way you did that.
- 17:38SPEAKER_04: You celebrate the birth, I know.
- 17:39SPEAKER_04: That's why that's why he's C yeah, that's how he is.
- 17:41SPEAKER_03: Well, the Latino, you know, he's the Latino on Border Latino, Border Latino.
- 17:45SPEAKER_04: And then the Latino, yeah, so yeah, so that that's what it is.
- 17:48SPEAKER_04: I I like meeting people, I like hearing stories, I like like the substantive panels, yeah.
- 17:52SPEAKER_04: Everything is just great.
- 17:53SPEAKER_04: Awesome.
- 17:54SPEAKER_01: It's just a sign of openness, guys.
- 17:56SPEAKER_01: You're here.
- 17:56SPEAKER_01: This is your first year, as I heard.
- 17:58SPEAKER_01: And we already have your podcast.
- 18:00SPEAKER_01: Yeah, and you you're catching, you know, the interest in the crowd.
- 18:03SPEAKER_01: It's just a good space.
- 18:05SPEAKER_01: And it feels easy, you know, it feels it feels natural.
- 18:09SPEAKER_01: It's there is no protocol, there is no for the good for the good reason, right?
- 18:13SPEAKER_01: Yes, so that's that's what this space for right is an oasis.
- 18:17SPEAKER_03: The connections like I keep seeing, there's one guy that I keep seeing that passes, stops by a little bit.
- 18:22SPEAKER_03: He's like a little shy.
- 18:23SPEAKER_03: I think he he wants to go on.
