- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:04In this episode, we're picking up where we left off
- 0:06with the John DeJong memorandum in support of his motion
- 0:10to dismiss the lawsuit filed against him by the Epstein Survivors.

- 1:15Eight requires at a minimum that the FAC give each
- 1:19defendant fair notice of what the plaintiff's claim is and
- 1:22the grounds upon which it rests. The FAC fails to
- 1:26give fair notice because it lumps all defendants together in
- 1:29each claim and provides no factual basis to distinguish their conduct.

- 3:13claims depend on continuing conspiracy to be timely. They would
- 3:17otherwise be barred by the statute of limitations. The FAC
- 3:21fails to plead a CoA four conspiracy in New York,
- 3:24but it additionally fails to plead a conspiracy for the
- 3:27purpose of establishing continuing conduct liability for mister DeJong. Each
- 3:33defendant is entitled to know how he is alleged to
- 3:35have conspired with whom and for what purpose. Mirror generalizations

- 4:52in the USVII, not New York. The plaintiffs filed in
- 4:56New York for the Adult Survivors Act CPLR Section two

- 5:28claims would otherwise be time barred in the USVII, which
- 5:32is not enacted any one year revival period for sexual assault.
- 5:36That's almost certainly why the plaintiffs forum shopped and filed
- 5:39this case in New York instead of the USVII. They
- 5:42wanted to forum shop for the New York ASA. New
- 5:46York law should not apply. Though four first second third
- 5:49coas FAC alleges conduct before TVPR a private right of
- 5:54action existed. The first, second and third coas are premised
- 5:59on conduct that arose from two thousand and one. Alleged
- 6:02conduct from two thousand and one to two thousand and
- 6:04three predates the private rights of action under the tv PRA.
- 6:09The FAC largely does not identify which conduct occurred when
- 6:13plaintiffs have no private right of action for allegations occurring
- 6:17before two thousand and three, and the FAC fails to
- 6:20distinguish dates for the vast majority of alleged conduct. Congress
- 6:24enacted the TVPR in two thousand, first, creating criminal offenses
- 6:28for sex trafficking, but no private right of action. Congress
- 6:33did not add a civil right of action for victims
- 6:35to sue their traffickers until twenty thirteen. A TVPRA private
- 6:41CoA not retroactive. The TVPRA does not apply retroactively to
- 6:46conduct that predated the creation of the private right of action.

- 8:18theory for the retroactive application of Section fifteen ninety five
- 8:22FAC At five and six However, federal courts have also
- 8:26rejected the continuing violation theory to overcome the presumption against
- 8:30retroactive application of Section fifteen ninety five. For the two

- 9:03Five First second third coas failure to allege knowledge of venture.
- 9:08The first, second and third causes of action coas are
- 9:12premised upon Section fifteen ninety five A. The FAC's vague
- 9:15pleading fails to satisfy the knowledge element as to the
- 9:19particular sex trafficking venture SJ versus Choice Hotels. The statutory
- 9:25text speaks in singular terms participation and a venture which
- 9:28that person should have known has engaged in enact in
- 9:31violation of this chapter. Therefore, knowledge or wilful blindness of
- 9:36a general sex trafficking problem does not satisfy the men's
- 9:39rea requirements of the TVPR. Once again, the FAC's group
- 9:44pleading is fatal. Here the FAC does not allege that
- 9:47mister DeJong had the requisite knowledge of a specific sex
- 9:50trafficking venture. Accordingly, coas one to two fail to allege
- 9:55the knowledge element as to particular venture under the TVPR,
- 9:59and therefore it must be dismissed. In Noble versus Weinstein,
- 10:02three thirty five f Dot supp three D fiveh four
- 10:06five twenty five SDN Y twenty eighteen, a TVPR a case,
- 10:11this court held that guilt or in this case, liability,
- 10:15cannot be established by association alone. Plaintiff must allege specific
- 10:19conduct that furthered the sex trafficking venture. Such conduct must
- 10:23have been undertaken with a knowledge or in reckless disregard
- 10:27of the fact that it was furthering the alleged sex
- 10:29trafficking venture. In other words, some participation in the sex
- 10:32trafficking act itself must be shown. Defendants mere membership in
- 10:36the venture is insufficient if he's ignorant of the ventures,
- 10:39sex trafficking activities and the means and methods thereof. As
- 10:43in noble factual allegations implicating mister DeJong as a participant
- 10:47in Epstein's conduct toward each plaintiff is required. The FAC
- 10:52fails to meet this standard. All right, we're going to
- 10:55wrap up this episode here and in the next episode
- 10:57we're going to pick up with six second coas no
- 11:00aiding and abetting liability under Section fifteen ninety five. All
- 11:04of the information that goes with this episode can be
- 11:07found in the description box.
