- 2:19be stopping by it. We're also going to spend some time talking about human
- 2:22trafficking a little bit later on in the show, but before we get to
- 2:25that, I want to welcome back to the show, Lynn Fruth and Fruth
- 2:29Pharmacy. You know, full disclosure of one of the sponsors of the Dave
- 2:32Allen Show, but not here to talk about that. She's actually here to
- 2:37talk about some legislation that was pending in the legislature of last time. She
- 2:42well, obviously legislature, that's where the legislative things go. But nonetheless,
- 2:47you were here a couple of weeks ago, Lynn, and you are as
- 2:51my old Wyoming County grandmother would say, if Matt is a web hen,
- 2:54but you seem to be a little bit in a better mood today, Well
- 3:00just a little bit, just a little bit. You got a smile on
- 3:02your face this morning, not so much last time. You're what was it
- 3:06that you were upset about and what has made it better for today? Well,
- 3:09as we reported, you know, to you and other news outlets,
- 3:15we had had been provided information that showed that PIA patients were certainly being overcharged
- 3:23on a number of drugs, and it was reported by the Capital, Ohio
- 3:27Capital Journal that there were times that the PBM, or the pharmacy Benefit manager
- 3:34for PEIA, was paying itself as much as one hundred times the cost of
- 3:38the drug in West Virginia as it would had it been filled in West Virginia.
- 3:45So this kind of just opened the door to a lot of what we
- 3:47felt was some profiteering at the expense of PIA patients in the state. So
- 3:57the bill, Senate Bill four fifty three addressed that it had its ups and
- 4:01downs, but it did finally pass. It passed unanimously in both the Senate
- 4:06and the House, and it's now sitting on the Governor's desk, and you
- 4:11know, we're just here to make sure that the teachers and public employees are
- 4:15continue to reach out and let the governor know you need to sign this bill.
- 4:20I don't understand why the governor wouldn't want to sign it if may go
- 4:25in if just as sitting on the desk, but this is a pretty groundbreaking
- 4:30bill that's going to provide a lot of transparency and maybe we'll find out that
- 4:36there's money to be saved there, considerable amounts for both the employees and the
- 4:41state. So if people weren't listening, Lynn, and I think it was
- 4:45two weeks ago when I had you on the show and you broke it all
- 4:48down and made it really easy to understand for what exactly was the issue here,
- 4:55kind of go back, reiterate again what that issue was touched on a
- 4:59little bit to begin but let's break it down specifically what was going on here
- 5:02and what does this bill that's waiting on the governor's signature, what do we
- 5:06hope will come from it now? But just take it from the top.
- 5:10Sure, So, what a patient came to us and ask, based on
- 5:15what they were seeing in their log in for Peia that different pharmacies were being
- 5:21paid significantly different amounts of money and that didn't make sense to them. We
- 5:27found out through that data that truth and most of the West Virginia independent pharmacies
- 5:30were being paid some of the lowest reimbursement generally below cost. A lot of
- 5:38the national chains were being paid much higher reimbursements, and that caused us to
- 5:46ask a lot of questions. There. It led to some other data that
- 5:51said patients were being overcharged and there were some particular drugs, generic specialty drugs
- 6:00that patients were being forced to fill at a mail order facility that's owned by
- 6:03the company that has the business there, Express Scripts, and the data showed
- 6:11that this drug was a forty dollars drug could be dispensed at Fruit Pharmacy or
- 6:15any local pharmacy for forty dollars and the patient might be being charged as much
- 6:20as two hundred and fifty dollars a month. But on top of that,
- 6:25the state was paying another five thousand dollars. So that's where that comment came
- 6:30from. The article in the Capital Journal that Express Scripts was paying itself one
- 6:34hundred times the cost of the drug. So that means two things. Number
- 6:39One, the patients the PIA members were really being ripped off and the state
- 6:46was being ripped off even more so. This bill forces transparency and a study
- 6:53to be done. And prior to this, West Virginia did not get to
- 6:58see their own data, so they didn't see what they may be. That
- 7:02may be the one thing that was the most mind numby to me that when
- 7:05I had you and the other gentlemal on the show a couple of weeks ago,
- 7:10was that west Ford, the state of West Virginia, was not allowed
- 7:12to even see the data correct. And I will tell you that several of
- 7:15the legislature members were incredibly shocked by that as well, Like, we're spending
- 7:23four hundred million dollars in this program and we don't get to see a transactional
- 7:29level breakdown of the data. That's preposterous. Sure, So this bill does
- 7:35require the PBM to provide that level of data, and when they do that,
- 7:42then the state will be able to look at that and say, why
- 7:46are we paying five thousand dollars for a prescription that could be and is being
- 7:53filled in West Virginia by Medicaid and being reimbursed reimbursed at forty dollars. There's
- 7:59an instance of a drug that is filled in West Virginia or Kentucky. It's
- 8:05being paid at the cost of the drug plus a dispensing fee for nine hundred
- 8:09dollars. That's an expensive drug. The state of West Virginia is actually paying
- 8:13close to thirteen thousand dollars for that drug. It doesn't take a lot of
- 8:20abuses like that to rack up millions of dollars that the state's being overcharged,
- 8:26and that trickles down to thousands of dollars that patients are being overcharged, and
- 8:33premiums keep going up and no one can explain why now. And what we
- 8:37do want to reiterate is I talked to you a couple of weeks ago,
- 8:39and again we're talking with lin and fruit pharmacy. Yeah, Fruit pharmacy was
- 8:41affected by this, but so was every other independent pharmacy in the state of
- 8:46West Virginia, the smaller guys, and more importantly, who's take the businesses
- 8:50out of it. Who's really been screwed in this whole deal were the workers,
- 8:54you know, those on pea in the state of West Virginia. That's
- 8:56who was really getting the raw end in this deal, not pharmacies. Yeah,
- 9:00but that's not really what this is all about. That's true. And
- 9:03the part that was so just completely unacceptable to me was and I even said
- 9:11these words to different different you know, Governor's office and other place like this
- 9:16is just wrong. How can you allow someone to charge a custodian, a
- 9:22teacher, a cook, a first responder, you know, two hundred and
- 9:26fifty dollars a month for a cancer drug or a drug for a MS or
- 9:33something that you have to treat, when this drug could be purchased at a
- 9:39fraction of the cost, and then on top of that, the state's paying
- 9:43another two to four or five thousand dollars. It's just it's just mind blowing,
- 9:50and the fact that people just wouldn't want to immediately address that and make
- 9:54it right because premiums are one thing. But even if I have a uramium
- 10:00I can afford if then when I go to pick up my medication, I'm
- 10:03looking at an amount of money that might even be greater than my premium one
- 10:09thousand dollars copay. I can't do that. As a state employee, I
- 10:13can't afford that. So that's really what I want to make sure gets fixed
- 10:18with this bill is that patients get access to their healthcare, that those working
- 10:24in the school system and the municipalities and our police officers have access to fair
- 10:31prescription coverage at a cost that is the right cost, and not this hugely
- 10:39inflated cost nine eighteen but avey Alan Chilling five eighty live rights you buught by

- 11:01Okay, So like when you were here, you were on your way
- 11:05to the capitol. I know you're on my show. You talked to Hoppy.
- 11:07I saw you on with our good friends over to over WWK. You
- 11:11made the rounds of all the television stations and whatnot, and you knocked on
- 11:15enough doors and you got it off because this was pretty much dead. I
- 11:18mean, it wasn't even it was kind of dormant, and it was taken
- 11:20up. Now you're just waiting on on the governor's signature. And one one
- 11:24of the things I like about this is you had once once the from what
- 11:28you told me, Lynn from once, the legislator's really got a handle on
- 11:33this. What happened. They were all on board with fixing this. Republicans,
- 11:37Democrats, liberals considered. They said, I mean, we got to
- 11:39fix this, and it looks like at least they have at this point.
- 11:43Now we're just waiting on the governor signature. Yes. And I want to
- 11:46say that this was kind of my first experience doing this with the media,
- 11:52and it made me realize that it's really important for people to hear the truth.
- 11:56And I appreciate the fact that the West Virginia media was thinking about the
- 12:03employees and the state and got this story out because I do think it really
- 12:07impacted where it had just come to a stall. It brought enough attention to
- 12:11it that we couldn't just shoven under a run. And I think sometimes in
- 12:16government we would rather continue to do something that's probably not the best then maybe
- 12:22admit we've not been doing something very well. But there's literally millions of dollars
- 12:28at stake. So it did force people to really look at it and say,
- 12:33I'm going to have to defend why I don't support this, and I
- 12:37really don't have a good reason to do that. So you know, now
- 12:41we're just asking the teachers and other public employees and general citizens. As a
- 12:46citizen paying taxes. I don't want to pay sure, you know, ten
- 12:48thousand dollars. I don't want the state to pay ten thousand dollars for a
- 12:52drug that costs nine hundreds sh effects everybody. And again, this story,
- 12:56we've got to wrap it up. This story is going nationwide. Matter of
- 12:58fact, somebody sent me information out of out of the Stay of New York,
- 13:03out of Illinois. I mean, you are now in demand because people
- 13:07are contacting you and going, hey, this is going on in our states
- 13:11as well. How do we do how do we do the same thing?
- 13:13So this is not just a West Virginia thing. No, I really think
- 13:16West Virginia is leading the way in this and we've been contacted by at least
- 13:20fifteen states legislators, pharmacies, teachers, representatives, public employees. This is
- 13:28really going to be a very groundbreaking bill, which is why I'm urging Governor
- 13:33Justice not to just let it pass. Sitting on his deck on the desk,
- 13:37make a statement, make a statement and sign this bill. Support the
- 13:41public employees, sign the bill, and then let West Virginia lead the way
- 13:46again in some of this reform. Because we're starting to pick up some notoriety
- 13:50as being the state that is addressing some of these issues in healthcare in a
- 13:54very positive, proactive way. We have a chance to be a leader.
- 13:58Let's do that, all right. We'll leave it there, A good way
- 14:01to end it, lending Fruit and Fruit Pharmacy at nine to twenty one.

- 18:07West Virginia Faith and Freedom Coldition. He joins us now via the big Lely
- 18:11piggly wiggly hopline Max good morning, welcome to the show. Good morning,
- 18:15Thanks for having me and appreciate it. Now. Maxis has to do with
- 18:18House Bill forty six sixty six. What was the bill? What would it
- 18:23have done and what happened to him? Yeah, So this was our big
- 18:27one. Four six sixty six was sponsored by Steel and Westball, and the
- 18:33bill was to increase and establish penalties for human trafficking and related crimes. So
- 18:40the proposed legislation defines human trafficking for both adultson and the science respective penalties including
- 18:47imprisonment, fines or both. The bill also elucidates distinct penalties concerning forced labor,
- 18:53debt, bondage, sexual servitude, and patronizing a victim of special servitude.
- 19:00The important thing is that it does offer immunity for minor victims of sex
- 19:04trafficking and specific circumstances, with provisions for their treatment of abused children. So
- 19:11this passed the House unanimously, right, and we expected a lot of support
- 19:21for this in the Senate, and there was, I mean when I talked
- 19:22to certain centers, especially Grady and Woodrum and Stewart, there's wide support for
- 19:30this generally speaking in the whole Senate. The issue was that it went to
- 19:34Senate Judiciary Committee and it went to Charlie Trump, and Trump never introduced the
- 19:40bill to be read. And this is now for the second year in a
- 19:41row. He timed this bill out. I tried to get meetings with him
- 19:47through his front office. That never happened. As I understand it, Delegate
- 19:52feel talked to him personally and Charlie Trump told him that he would introduce it,
- 19:57but he didn't. I know that there were other House Delicate members who
- 20:03went and talked to him privately as well, and essentially the feeling was he
- 20:07just didn't want to deal with it as he was, you know, as
- 20:11he's currently running for Supreme Court Justice of West Virginia, so you know,
- 20:19personally, my biggest problem with it is that he never questioned the language.
- 20:22He didn't form any challenges, he had no suggestions and had he done that,
- 20:29that to me is a completely respectable thing that is part of the process.
- 20:33But he decided not to bring it up at all, and that was
- 20:38very disappointing for us, to say the least. And we don't exactly understand
- 20:45why. But those are the facts. So again we're talking to Max Fisher,
- 20:52who is with the Western Dean Faith and Freedom Coalition about this bill's House
- 20:55Bill forty sixty six. And again, Max, for what I'm hearing from
- 20:59you is again you you are you feel or you really don't know how you
- 21:04feel because other than being upset, because you really don't know why that that
- 21:10it wasn't taken up. As you said, it started in the House,
- 21:11and this is I'm basing this on on your words. It started in the
- 21:15House, went to the Senate. There was some support there. You mentioned
- 21:17a couple of senators Grading and Stewart and others. Uh, but it just
- 21:21didn't It just didn't get there. And what you're saying is, is you
- 21:25you think that in your organization thinks that that perhaps it had to do something
- 21:30with the with mister Trump and his running for Supreme Court. I can only
- 21:34go on the facts, okay, and so that that is my opinion based
- 21:40on evidence. But that is an opinion of mine. I cannot get inside
- 21:42his head inside the park, right, I have no idea is that the
- 21:48House is closest to the people of West Virginia. So when something passes ninety
- 21:52seven to zero, at the very least, at the very least, the
- 21:56Senate should introduce it to discuss it. That seems to be to be the
- 22:02work of the people and also the will of the people. And again,
- 22:06I want to be very clear, had he brought it up and had they
- 22:08come up with different language or different concerns. I think that's absolutely part of
- 22:12the American process. Yeah, but he didn't, and he timed it out.
- 22:17And he also again as far as I understand it, promised Delegate Steel
- 22:21that he would bring it up. So if that is in fact true,
- 22:25and this is you know, this is here sam by part but you know
- 22:27he lied to Delegate Steel. And this is the guy who is running unopposed,
- 22:34you know, as a as a Supreme Court jodesh West, Virginia.
- 22:37And I will and let me just jump in here and say that if Senator
- 22:41Trump wants an opportunity to talk about this on the show, he's more than
- 22:45welcome to come on to tell his side. I just don't want to present
- 22:48one side, but I would be more than willing to have that conversation with
- 22:51him, as it sounds like you would be willing to more than have that
- 22:52conversation with him. Absolutely, and and also to show you know, a
- 22:57bit more pattern of behavior. Or I also have to talk about build four
- 23:00three one three, which is establishing the parents' Bill of Rights. That was
- 23:06delicate. John Contenson and there were others from right now are escaping my mind.
- 23:11The purpose is to establish protections for West Virginia parents fundamental right to direct
- 23:15the upbringing, education, and healthcare of their children in accordance with their family
- 23:21values. This passed the House and it died in the Senate Judiciary again because
- 23:27it was not brought up. And you know, there are already parents in
- 23:33West Virginia whose rights, from my perspective as parental rights, have been already
- 23:37been violated. And besides that, parental rights throughout the country is pulling unbelievably
- 23:45high right now among independence as well as conservatives. Seems to be a top
- 23:49issue for them, and we have already seen secret social transitions in conservative states
- 23:56done without the knowledge of the parents. This bill also wouldn't change any kind
- 24:03of status quo about current abuse cases, and unless the parents are proven unfit,
- 24:11you know, we generally believe that the parents know what is best for
- 24:15their minor children. So this was another one that was not introduced. And
- 24:22again I am sound like a broken record, but it's the same thing.
- 24:26Had he introduced it and discussed it, that's fine. But I respect,
- 24:32I respect any kind of debate about any issue. But when you refuse debate
- 24:37and you have the power not to debate. And you also have a Senate
- 24:41President, Craig Blair, who I did speak with, and you know,
- 24:45in a sense my experience was, you know, factually talked out of both
- 24:51sides of his mouth. One is that he's not a micromanager, okay,
- 24:56you are Senate President, and the other side is that you know, he
- 24:59would talk to Charlie. So I'm not sure if he did lush help there
- 25:03either. And I think that there are a lot of social conservative issues that
- 25:07this last session you know, proved to be disappointing from the standpoint of Faith
- 25:12and Freedom Coalition. I also just want to I also just want to clarify
- 25:18one thing. I'm not a lobbyist for them. I'm an advocate. I'm
- 25:22an ambassador and also special advisor on Israel for Faith and Freedom as well.
- 25:26And there was also another Israel bill that I think a lot of people were
- 25:30behind. It just didn't catch enough same early on, and I did have
- 25:37the event to speak to the House of Delegates about the commands Israel war.
- 25:41I was there in early May as part of a solidarity trip and that was
- 25:45facilitated by Delegate Longen Acre. And also currently right now there is an initiative
- 25:52that's been sent over to Jim Justice to see if he would like to spearhead
- 25:56taking surplus equipment of the West Virginia National Guards state Beliefe Sheriff's Department sending it
- 26:03over there, you know, during the war effort. So that's another thing
- 26:06that we're working on as well. How last thing back to you know,
- 26:11back to sort of you know, socially conservative issues. In this last session,
- 26:17Build four eight sixty seven require pornography websites to utilize age verification methods to
- 26:22prevent minors from accessing content. This was sponsored by Delegate share Rally and uh,
- 26:32this one did pass the House, and it's a tough one. And
- 26:36I understand why it's a tough one because a lot of people had very legitimate
- 26:41concerns when they said, well, wait a second week, we we maybe
- 26:44behid the intent of this, but behind the overreach of government to do something
- 26:48of this sort. And there was a lot of conversation back and forth in
- 26:52the House, and you know, after educating them and showing them data and
- 26:56showing them what I consider to be some of the unintended consequences of this bill,
- 27:03which basically is that there's a lot of pornography websites that just choose them
- 27:07not to do business in that state. And what that also sends a message
- 27:11to them is that the things that they do that are on the fringes,
- 27:15that have to do with human trafficking, that have to do with underage you
- 27:19know, filming, they they feel that another state is watching and that makes
- 27:25them very nervous about the way that they conduct business. That did get to
- 27:29the Senate. The Senate had a they wanted to amend the title of the
- 27:37bill. I don't know why, to be frank with you, it got
- 27:40sent back to the House, but again it just got introduced. The amendment
- 27:44was just it was too late, I would I would say that it was
- 27:48in a way where really there was virtually no time for the House to take
- 27:52a look at it and see what it is that they wanted to do.
- 27:55So that again is another is another thing that it did not happen that I
- 28:00think that, uh, while they're completely legitimate concerns about the overreach of government
- 28:07storing data without going into a longer conversation, the bill has provisions and and
- 28:15and suggestions and and explanations for that how that would not be But the but
- 28:21the the real intent would be to take a shot at human trafficking. No,
- 28:26and with the open border that we have right now, you know I
- 28:30can show you data that this is a bigger problem than ever. Let me
- 28:36before we let you go, and Max, I want to ask you overall
- 28:40now, you brought up a couple actually two three different things here that you
- 28:44felt were left undone by the legislature. Overall. Uh and this has been
- 28:48kind of a recurring theme of various people have that on the show. As
- 28:51somebody who keeps a close eye as an advocate for the group that you are,
- 28:55how would you rate this session? I would say I would rate it
- 29:03probably about a C or a C plus, you know, something of that
- 29:07nature. I think that I may be able to answer your question in a
- 29:12better way by reframing your questions. I'm not I've been in West Virginia for
- 29:19about two years now, and I can tell you that outside of West Virginia,
- 29:25a lot of people think that this is the reddest, most conservative state
- 29:27in the country. And what in fact is is a one party state.
- 29:33And you had the Democrats and now you have the Republicans, and it's very
- 29:37chaotic in a way. Because a lot of the the Republican tent is very
- 29:42very wide in West Virginia, and we all know that there are some people
- 29:45here who run with an R next to their name and not a D because
- 29:49they know that it's very difficult to win an elect And so that is that,
- 29:57to me, is an issue that it's gonna take real leadership by whoever
- 30:03becomes governor in twenty twenty four, twenty twenty five actually, and whoever is
- 30:07going to be to send a president to gather everybody together and say this is
- 30:14the Overton window for conservatism Republicanism. And again I'm all for. I mean,
- 30:21I'm from the Northeast corridor man, like I. You know, we
- 30:23have all sorts of different republishers there too. I get it. But there's
- 30:27got to be leadership to say this is the Overton window. Visa the parameters.
- 30:33Let's get in line and do the bidding of the people of West Virginia.

- 36:38you good morning? How are you doing? I'm doing fine. Thanks for
- 36:42being here. I ask you to be on the show this morning because Commissioner,
- 36:44there's a public event happening this evening starts at five at the courthouse to
- 36:49discuss the usage of the opioid settlement funds. How's this whole thing work?
- 36:52Where to come from? What's going on? Well, I know you and
- 36:54your listeners probably understand. We've talked about this for months now, but one
- 37:00the West Virginia won a settlement with the opioid manufacturers and distributors up to a
- 37:04billion dollars. And why that's important is because that is actually the largest settlement
- 37:08win for per capita in the nation regarding the opoids settlements that we've seen nationwide,
- 37:15and a lot of that is due to the counties coming together with the
- 37:16state Attorney General Patrick Morrissey and his team did an absolute wonderful job and we
- 37:22wouldn't be in this position today if it wasn't for him and his team,
- 37:24and so I think the kudos need to go out to them. But this
- 37:28is important because now that we have this billion dollars, what do we do
- 37:30with it? And we've got this money for abatement due to the openoid epidemic
- 37:35that US homegrown West Virginians have seen for the last decades, and so can
- 37:39all kind of commission was awarded seven million dollars of that one billion, five
- 37:44hundred million going to a foundation created by the States that we have a representative
- 37:50on with there, but seven million is directly ours and so we need to
- 37:53distribute this, but we need to do it smart. I think we all
- 37:55realize that this money can help, but it only can help if we do
- 38:00it the right way. And the Kenawllan County Commission, with Commissioner of carp
- 38:02Purcelango myself, we believe the best way to do that is being transparent,
- 38:06and so tonight we're going to have our public hall where we're going to have
- 38:09during our commission meeting, a public meeting on a public agenda with the record.
- 38:14We're going to make sure that we're discussing how we're going to spend this
- 38:16money, what's the best approach to do that? And I think we're going
- 38:19to have some good transparency from this, and I think the people of Kenwall
- 38:22County will be happy to know that they'll have some type of input on the
- 38:25best way to do this. So this is going to be part of the
- 38:28County Commission meeting this evening right, Yes, it starts at five o'clock.
- 38:30Now, if folks want to come in wigh in, do they need to
- 38:34sign in? Did you show up? You call it on people in the
- 38:37crowd. How's the whole thing going to work? Now? So, we've
- 38:40never had time limits, we never had sign in chets for public comments.
- 38:44If you want to come and talk, you're invited to do so. Once
- 38:46we get to this section of the agenda, which we'll do early, we'll
- 38:50make sure that we ask for public comments and you can talk again. We
- 38:52don't ask people to stop talking. We don't give them a red light green
- 38:55light. What we do do is we ask them to be considered of the
- 38:59time if they're sure. Fellow citizens and even our employees who are staying after
- 39:02five o'clock for count of commission meeting so that way we can all go home
- 39:07at a reasonable time. But we want to hear from everyone. We want
- 39:08that input. I know this is something that Commissioner Slango has been very important
- 39:13in making sure that we spread, is that we want to hear from the
- 39:15people of Kennall County because we don't want to just be the last deciding factors
- 39:21on this. We want to make sure that we hear from people boots on
- 39:23the ground that this affecting the most, that they have their ideas of what
- 39:28they believe this money can help with solution. Now, a commissioner, I'm
- 39:30sure you being outed about as you are in the county and doing things,
- 39:35you probably had people that have either reached out to you already, you know,
- 39:37you ran into somebody at an event, or somebody called or emailed you
- 39:42or whatever. What have you heard out there so far from people? Well,
- 39:44once the announcement hit that we were going to be receiving seven million dollars,
- 39:47my phone was blowing up. And of course it's people eager to help
- 39:52and they have projects they've been working on or they want to start. And
- 39:55that's why we're going to decide to do this the best way possible is just
- 39:59like we did with the or ARP funding, We're going to have this as
- 40:01an application process, and so we're going to have on our website starting April
- 40:05first, an application that you can fill out for any request for this opioid
- 40:08settlement money. And I think that's the fairest way to do this. Those
- 40:12applications will be viewable by anybody on our website. So if you submit an
- 40:15application for a request for the opioid settlement money, that will be viewable.
- 40:20You can open anyone can open that up. We will then if we decide
- 40:23to move forward with staff's recommendations, we'll have that on a public agenda,
- 40:27you know, four days before we meet on Monday, and then when we
- 40:30go in you'll come to us. You'll present recorded at a public event.
- 40:36You're going to be telling us why you think this is the best way,
- 40:37and Commissioner Carp Purslanga myself will vote at a public meeting. We will not
- 40:43spend any of this, not a dime of this money outside of the public's
- 40:45view, and I think that's important for the transparency. It worked with the
- 40:50ARP application process, we actually received a lot of good, good remarks from
- 40:55the state and even the federal government on how we did that, and so
- 40:59we're going to it's not broke, don't fix it. Let's do that with
- 41:01the opioid settlement money. But I think the fairest way instead of just getting
- 41:05text messages to the commissioners and that's how you get this money. We need
- 41:08to do this fair because out the tont of everybody, at the end of
- 41:10the day, this is the people's money, and we've made that clear even
- 41:15with the foundation that was set up by the legislature. Is making sure they
- 41:19understand that this is open this money, this is the people's money, and
- 41:21they need to know how this money is going to be spent because at the
- 41:23end of the day, this is one time money. Once this is spent,
- 41:27it's gone. So we need to make sure that we do this in
- 41:29the most effective way possible in looking at the abatement of the opioid epidemic that
- 41:34we've seen. But Dave Vland showing five ay the lie of bright to a

- 41:54right, so are there things that the money commissioner can't be used for?
- 41:59I mean, I mean the cause there's got to be some kind of restrictions.
- 42:00I mean, you're not going to go put in I don't know,
- 42:04fill in name here. I mean, you've got to have some sort of
- 42:07rules because everybody's going to want something out of this. What are some from
- 42:09the I know it's a very very vague question, but from the top,
- 42:13from the top of you, what are some of the things that the money
- 42:15can or cannot be used for? Well, Dave, that's a great question
- 42:19actually, and what first off, the common sense would tell you that this
- 42:22money needs to be used for anything that has revolved around the opoid epidemic.
- 42:27We did sign an MLU with the state that has certain guidelines of how we
- 42:30can spend this money. Some of those guidelines are prevention of opoid use.
- 42:36Some of them are for treatment, so treatment facilities. Anyone who's trying to
- 42:39work in the treatment of somebody who is an active addiction. And also we
- 42:43have reimbursements and we know I think it's no surprise to anyone that the amount
- 42:49of resources for first responders in the last twenty years has been outenormous and we've
- 42:53seen ambulances run on calls for overdoses. We've seen police officers having to go
- 43:00on the scenes due to this opioid crisis. So we can look at how
- 43:05can we take the taxpayer money that was spent in the last twenty years for
- 43:08these events and services and reimburse those because that money was spent on those resources
- 43:15when it could have been spent on something else that the community needs with our
- 43:17first response. So what I'm hearing you say in your Commissioner is that it
- 43:20has to be spent on something related to the opioid crisis to begin with.
- 43:24You can't use this to fix potholes with no, you cannot, and we
- 43:29would never built stadiums or anything like that. It has to be something to
- 43:31do with opioids in some way, whether it's education, whether it's prevention,
- 43:37more resource officers, or something to that effect exactly, and we would never
- 43:40spend this money for any of those type of resources. We got this money
- 43:45because of the opioid academic This money needs to go directly back. That's a
- 43:47very important point because I don't want people showing up the night saying, hey,
- 43:51we can get well, I can get my holler paved or something like
- 43:54that. That's not going to happen. They're more than welcome to come and
- 43:58tell you that, but they're going to be told no, because this money
- 44:00is strictly for the open okay, and you got a lot of it.
- 44:02We have there. We know that seven million is that seven million dollars right
- 44:07now? We've received our first check. This is going to be over ten
- 44:09years. That's how these settlements work. The first check that we received is
- 44:13three million dollars. That's what we're working with now. I'm told that there's
- 44:15possibility of another check coming later down the road, but I believe it's front
- 44:20loaded, so we're just going to see lower increments down the couple of years.
- 44:22All Right, I got a text here for you, something totally unrelated
- 44:25to what we're talking about here. That's okay, soys can you check with
- 44:28Commission Wheeler about the status of the chemical spill at Paint Creak Commissioner Selango said
- 44:31on your show recently that it was unsafe to eat fish there. Yet the
- 44:36state has been stocking trout there since the fall, and a lot of folks
- 44:37are eating them that don't know any better. Yeah, So since that comment,
- 44:42I'm sure we've worked with our legal team and the abatement of the chemical
- 44:46spill has moved forward. We won that lawsuit, and it was if it
- 44:49wasn't for the Kenaw County Commission, that lawsuit never went went forward. You
- 44:52know, we saw the chemical spill go into the river, kill the fish,
- 44:57and even contaminate the soil in the m embankment. We said that the
- 45:00chemicals were still there. We were told they weren't. We demanded testing of
- 45:05the soil and the testing came back to show that it was positive for that
- 45:08chemical and that spill from that driver who was over three times over the legal
- 45:13limit intoxicated driving. We sued the company. We won that and the abatement
- 45:16has moved forward. We won about I believe it's one hundred thousand dollars at
- 45:21end of day on our end, and we've made sure that that money is
- 45:23going to go right back in that area in Paint Creek. We actually just
- 45:27recently received a request from the Paint Creek Watershed where they're going to have a
- 45:31fishing with Kids day and they asked us, they asked us for some money
- 45:35to help with that, and we use that money to help them with it.
- 45:37And so we're going to continue to work on that. But at this
- 45:39point, I believe the abatements has completed and the testing has shown that the
- 45:45soil is not contamind anymore. But if we never got involved, that would
- 45:49not have been the case. So we're going to continue to keep our eyes
- 45:52on it and make sure that everything looks clean. But at this point,
- 45:53we're told things are healthy and the fish are coming back. All right,
- 45:58got to wrap it up. But I do have one quick question before you'll
- 46:00give you about thirty second stance or this. Can the county use the money
- 46:04to pay the jail bill? No, So here's what I don't know who.
- 46:07The text isn't what they were getting at, but I was thinking,
- 46:09okay, well, a lot of the people that are in jail are there
- 46:12because of opioids, you know, in one way or the other. But
- 46:15I'll be quick because that's a long winded question by the way, but I'll
- 46:17be quick. The reason with that I've heard this policy is coming out with
- 46:22people running for office that oh, we can't you know you're gonna use it
- 46:23to pay a jail bill. No, the part of that reimbursement is that
- 46:27we can use the jail bill as a evidence that we did see a significant
- 46:31increase because of the opido epidemic, and so we can reimburse ourselves and use
- 46:36that money for whatever we want, which I believe we can use that money
- 46:38to go back to our first responders. Meeting starts at five o'clock, and
- 46:40again the public is invited to attend. You don't need to sign up,
- 46:45just show up and be respectful of other people's time. You get seven million
- 46:47dollars or so to spend, but it needs to be spent. This is
- 46:50the opioid money. It's got to be spent in some way related to the
- 46:53opioid crisis. Be it as I said, as you said, first responders,
- 46:57or whatever the case may be. Five o'clock at the courthouse this afternoon.

- 50:37Chef Jenkins has story posted at metronews dot com. The Board of Education
- 50:40is working under budget. And when they when I say that, why do
- 50:44I get a mental image of the superintendent of the board members doing math problems
- 50:47on an old school backboard blackboard. But that's just me. The county has
- 50:52lost more than five hundred students and in turn are losing staff members, and
- 50:58there is a proposal to cut approximately fifty five professional positions to make the math
- 51:05pardon the pun work. Superintendent Tom Williams says that cutting the cutting into fifty
- 51:10five jobs could possibly have been more had they not voted to close some elementary
- 51:16schools at the end of the school year. Now, there's going to be
- 51:21a public meeting held in the month of May, and I hate to give
- 51:23you the day now because you may forget about it between now and then,
- 51:27but I will say it's going to be the thirteenth of May. The final
- 51:30vote will be taken by the board on May fifteenth. Again, Jeff as
- 51:32a story post about all of this at wv metronews dot com, And I
- 51:38was on the phone earlier this morning with the folks at the board's office.
- 51:40I've got to Superintendent Williams on the show next Monday to discuss that end of
- 51:45tail closing. Have to say a big shout out to everyone who came out
