- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to get right back to that
- 0:05Speaker 1: Tyler Robinson transcript from the prelim hearing on day one.
- 0:10Speaker 1: And once again, prosecution is asking questions. Question, Agent Hull,
- 0:16Speaker 1: you testified that there were four visits to campus that day. Answer, correct, yes. Question,
- 0:22Speaker 1: and the first three visits, based on what you have observed,
- 0:25Speaker 1: it's your opinion that those videos were captured by UVU
- 0:28Speaker 1: surveillance video, is that correct? Answer, that is correct, yes. Question,
- 0:33Speaker 1: the fourth visit, well, the fourth visit to was captured
- 0:36Speaker 1: by UVU surveillance video, is that correct? Answer, correct. Question,
- 0:40Speaker 1: was there any other video that was collected, either on
- 0:42Speaker 1: the 10th or on the 11th, that you believe might
- 0:45Speaker 1: be important or relevant to today's hearing? Answer, there was
- 0:49Speaker 1: a large amount of video. Gets cut off. I'm going
- 0:52Speaker 1: to be a little bit more specific. Other than UVU
- 0:55Speaker 1: surveillance video, was there any other video that was collected
- 0:58Speaker 1: and subsequently gathered an 1102 statement for? Answer, yeah. We
- 1:02Speaker 1: collected ring doorbell footage from the surrounding neighborhoods. Question, okay.
- 1:07Speaker 1: Let me ask you this. Did that include video from
- 1:10Speaker 1: residences located at 860 West, 925 South Orem? Answer, yeah.
- 1:16Speaker 1: That's the horseshoe area, yeah. Question, okay. That's in Orem. Answer, correct.
- 1:21Speaker 1: Question and close to campus. Answer, yes it is. Question, okay.
- 1:25Speaker 1: And what can you tell us about that video? Answer,
- 1:28Speaker 1: it has a ring doorbell video that was provided that
- 1:30Speaker 1: showed a vehicle consistent with the one we had identified
- 1:33Speaker 1: as belonging to Mr. Robinson parking in front of the
- 1:36Speaker 1: residence across the street. Question, okay. And what can you
- 1:39Speaker 1: tell us about the timing of that parked vehicle? Answer,
- 1:43Speaker 1: if I recall, that vehicle parked approximately 038 hours on
- 1:48Speaker 1: the morning of the 11th. Question, okay, so 038 hours,
- 1:53Speaker 1: what time is that to regular people? Answer, just after midnight. Question,
- 1:57Speaker 1: at 1238? Answer, in the morning, yes. Question, okay, so
- 2:02Speaker 1: how did this video come to your attention? That you're
- 2:05Speaker 1: talking about this doorbell or whatever? Question, the footage was
- 2:08Speaker 1: obtained as part of the canvas of the area that
- 2:10Speaker 1: was conducted as part of the investigation. Question, were you
- 2:14Speaker 1: able to identify the owners of that residence? Answer, yes. Question,
- 2:19Speaker 1: Where that video was collected from? Answer, correct. Question, okay.
- 2:23Speaker 1: And do you know who it was collected from and
- 2:26Speaker 1: by whom? Answer, it was Mr. and Mrs. Noble. I
- 2:29Speaker 1: believe Agent Davis collected the video directly from them. Question, okay.
- 2:34Speaker 1: And do you know what date it was collected? Answer,
- 2:37Speaker 1: if I can refresh my notes. Answer, if referring to
- 2:40Speaker 1: your notes will refresh your memory, go ahead and take
- 2:42Speaker 1: a look at that, but don't read it out loud. Question,
- 2:45Speaker 1: or answer, excuse me. I don't have the specific date.
- 2:48Speaker 1: But I do know that myself and Agent Davis returned
- 2:51Speaker 1: to the address as we had done in the previous
- 2:53Speaker 1: videos and had the owners of the video verify that
- 2:56Speaker 1: it was from their system. And we did have them
- 3:00Speaker 1: complete an 1102 statement, which would be dated. Question, okay,
- 3:06Speaker 1: so let's talk about this. What does that video look like? Answer,
- 3:10Speaker 1: it's a nighttime view looking from the front porch of
- 3:12Speaker 1: the residence across the street. Question, okay, and what about
- 3:16Speaker 1: the video? Why was this particular video significant to you?
- 3:20Speaker 1: Why do you think that that was related to the case? Answer,
- 3:24Speaker 1: we know from the UVU footage that the person, we
- 3:27Speaker 1: believe to be Mr. Robinson, had interaction with law enforcement.
- 3:30Speaker 1: And a short period after that, the vehicle comes to
- 3:33Speaker 1: that house. And some additional evidence that was collected from
- 3:36Speaker 1: the cell phone data and things indicated that Mr. Robinson
- 3:39Speaker 1: was in the area. And we were able to locate
- 3:42Speaker 1: the footage of his vehicle on that ring doorbell camera. Question,
- 3:47Speaker 1: or at least, what you believe is this vehicle? Answer, yeah,
- 3:49Speaker 1: the vehicle that we believe to belong to Mr. Robinson. Question,
- 3:53Speaker 1: and is there something about that vehicle or that particular
- 3:56Speaker 1: video in this, I guess a vehicle, that was captured
- 3:59Speaker 1: that leads you to believe that it was Mr. Robinson's vehicle? Answer, yeah,
- 4:03Speaker 1: the vehicle has very distinct wheels. I won't say they're
- 4:06Speaker 1: wholly unique, but in terms of the video footage that
- 4:09Speaker 1: we're reviewing, the wheels on the vehicle are fairly unique
- 4:13Speaker 1: and stand out on the video footage. Question, Okay, so again,
- 4:17Speaker 1: this video that you received early on in the investigation? Answer, yes. Question, okay.
- 4:23Speaker 1: And then in preparation for the prelim hearing, you went
- 4:26Speaker 1: back out and you met with someone about this video? Answer, correct. Question,
- 4:30Speaker 1: who specifically did you meet with about the video? Answer,
- 4:34Speaker 1: I met with Ms. Noble. Question, and what did you
- 4:37Speaker 1: do with Ms. Noble? Answer, we did what we'd done before.
- 4:41Speaker 1: We had specific files that we wanted, or files that
- 4:44Speaker 1: we wanted her to verify. The footage itself is broken into,
- 4:47Speaker 1: I believe, 10 second segments. So we had specific files
- 4:51Speaker 1: that we had her view, and confirmed that they were
- 4:54Speaker 1: actually from her system. Those were written on the 1102,
- 4:58Speaker 1: as they had been before. Question, and who wrote those
- 5:01Speaker 1: file names on this particular statement? Answer, I believe it
- 5:05Speaker 1: would be my handwriting on the 1102. Question, alright, what
- 5:10Speaker 1: did you do next? Answer, we had her view the
- 5:12Speaker 1: videos and then complete a statement verifying the authenticity of
- 5:16Speaker 1: those videos on the 1102. Question, okay, was this also
- 5:21Speaker 1: prepared on a State Bureau form? Answer, I believe this
- 5:25Speaker 1: was on a State Bureau investigation form, yeah. Question, and
- 5:29Speaker 1: in this particular form on which Ms. Noble provided her statement,
- 5:33Speaker 1: does it have the advisory that it would be used
- 5:35Speaker 1: in lieu of her testimony here today? Answer, it does, yes. Question,
- 5:39Speaker 1: does it also contain a warning that if she gave
- 5:42Speaker 1: a false statement, it's punishable by a Class A misdemeanor? Answer, correct. Question, okay.
- 5:48Speaker 1: I'm going to have displayed on your monitor what's been
- 5:50Speaker 1: marked states exhibit number 13 for identification. Let me know
- 5:54Speaker 1: when you see that, would you? Answer, I can see that. Question, okay.
- 5:58Speaker 1: And I'm going to have my assistant scroll through that slowly. Okay,
- 6:02Speaker 1: do you recognize that? Answer, I do, yes. Question, what
- 6:06Speaker 1: is it? Answer, correct. The 1102 that myself and Agent
- 6:10Speaker 1: Davis collected from Ms. Noble. Question, and does it appear
- 6:14Speaker 1: to be in the same condition as when you collected it? Answer,
- 6:17Speaker 1: it does, yes. Question, this is a copy, right? Answer, yes. Question, okay.
- 6:22Speaker 1: And the personal identifying information appears to be redacted. Is
- 6:25Speaker 1: that right? Answer, it has been redacted, yes. Question, okay.
- 6:29Speaker 1: It wasn't redacted when you collected it, right? Answer, no.
- 6:33Speaker 1: The original form was not redacted. question so other than
- 6:37Speaker 1: the redactions it appears to be in the same condition
- 6:40Speaker 1: as it was when you collected it answer that is
- 6:42Speaker 1: correct question the state would move to admit exhibit 13
- 6:46Speaker 1: judge graph miss nester now kathy nester objects once again
- 6:50Speaker 1: your honor we renew our concern about unconstitutional hearsay being
- 6:55Speaker 1: admitted we have the same concern about the fact that
- 6:58Speaker 1: agent hull amended this himself and there's no foundation as
- 7:01Speaker 1: to when he filled that in if it was before
- 7:04Speaker 1: or after she signed it And due to all those reasons,
- 7:07Speaker 1: we object to its admission and object to its publication
- 7:10Speaker 1: as well. Judge Graff, prosecution. Now the prosecution, they're a butt. Judge, again,
- 7:17Speaker 1: it was collected in compliance with Rule 1102 of the
- 7:20Speaker 1: Utah Rules of Evidence, specifically subsection B8. It's in writing.
- 7:27Speaker 1: It's on a form. It includes both the advisory and
- 7:30Speaker 1: the warning, and it was collected by Agent Hull. It's
- 7:33Speaker 1: also collected in compliance and being introduced as reliable hearsay,
- 7:37Speaker 1: which is lawful to do here in Utah under the
- 7:40Speaker 1: state constitution. Article 1, Section 12. Judge Graff, do you
- 7:44Speaker 1: wish to lay more foundation about when the statement was written,
- 7:47Speaker 1: whether it was before it was signed or not? Answer,
- 7:51Speaker 1: I can do that, Judge. I appreciate that. Yes, Agent Hall,
- 7:54Speaker 1: do you recall when you collected this written statement from Ms. Noble? Answer, yeah,
- 7:59Speaker 1: it was in April. Question, in April, do you know
- 8:01Speaker 1: what day? Answer, April 6th, I believe. Question, okay, and
- 8:05Speaker 1: you collected it. Did you go to her home? I think,
- 8:08Speaker 1: is that what you said? Answer, yeah, myself and Agent
- 8:11Speaker 1: Davis went to the residence. Question, okay, and did you
- 8:14Speaker 1: sit there while she prepared it? Answer, I did, yes. Question,
- 8:19Speaker 1: and did you witness her sign it? I did, yes. Question, okay,
- 8:23Speaker 1: at this point, I'd move to admit Exhibit 13. Judge Graff,
- 8:27Speaker 1: all right, and to the state representative, could you scroll down? Okay,
- 8:31Speaker 1: all right. Pursuant to the Utah Rule of Evidence 1102
- 8:35Speaker 1: and Article 1, Section 28, I'm sorry, Article 1, Section 12,
- 8:39Speaker 1: which allows for a reliable hearsay, I'm going to move
- 8:42Speaker 1: it into, it's going to be admitted, into evidence over
- 8:44Speaker 1: the objection of the defense. I note in particular that
- 8:48Speaker 1: it states that I confirm that the above files were
- 8:51Speaker 1: taken from our Nest Doorbell videos and are accurate. And
- 8:55Speaker 1: right before that statement is the notation that were allegedly
- 8:59Speaker 1: made by Agent Holt. and so for the reasons the
- 9:02Speaker 1: court finds proper foundation has been laid, and that this
- 9:05Speaker 1: exhibit in its entirety is admitted into evidence. As it
- 9:09Speaker 1: relates to publication, I will authorize publication in the courtroom
- 9:13Speaker 1: and by the media if they so wish to capture
- 9:15Speaker 1: it in that form. Again, following the same format, I
- 9:19Speaker 1: have it on the first portion of the screen for
- 9:22Speaker 1: about 10 seconds, and then scroll down to the written
- 9:24Speaker 1: portion for about 15, and then scroll to the very
- 9:27Speaker 1: bottom to ensure that the full exhibit has been displayed.
- 9:31Speaker 1: All right, that concludes the publication of State Exhibit 13. Question,
- 9:36Speaker 1: thank you, Judge. The video that you took with you
- 9:38Speaker 1: that day when you visited with Ms. Noble, or Ms. Noble,
- 9:42Speaker 1: had you previously, well, you've stated that the videos that
- 9:45Speaker 1: you showed the Nobles were actually more than one video. Answer, correct. Question, okay,
- 9:50Speaker 1: and I believe you said they were like 10-second clips. Answer,
- 9:54Speaker 1: if I recall correctly, yes. Question, short clips, and you
- 9:57Speaker 1: showed Ms. Noble all those videos that I in that statement? Answer,
- 10:02Speaker 1: the one shown on the statement was shown to Ms. Noble, yes. Question,
- 10:06Speaker 1: have you had the chance to review what's been marked
- 10:09Speaker 1: state exhibit number 12.2? Answer, yes. Question, and when did
- 10:14Speaker 1: you have a chance to review that exhibit? Answer, I
- 10:16Speaker 1: believe that was reviewed last week, I believe, with yourself. Question,
- 10:21Speaker 1: and does that video, is it a single video that
- 10:23Speaker 1: you watched? Answer, no, I believe it's four separate short videos. Question,
- 10:28Speaker 1: and I understand that, but as far as the 12.2
- 10:30Speaker 1: is concerned, what does that exhibit consist of? Answer, it
- 10:35Speaker 1: shows the vehicle believed to be driven by Mr. Robinson
- 10:37Speaker 1: arriving in front of the residence, an individual exiting the
- 10:40Speaker 1: vehicle and moving away from it, followed by an individual
- 10:44Speaker 1: returning to the vehicle and unlocking it. And then it
- 10:47Speaker 1: shows the vehicle, a short time later, starting... and leaving
- 10:50Speaker 1: the area. Question. And those are videos that you showed, Ms. Noble? Answer. Yes.
- 10:57Speaker 1: Question 12. What I have displayed on your monitor? What's
- 11:00Speaker 1: been marked states exhibit 12.2 for identification. Let me know
- 11:04Speaker 1: as soon as you see. Should still be an image. Answer.
- 11:06Speaker 1: It's there. Question. Do you recognize what's depicted there? Answer. Yeah.
- 11:11Speaker 1: This is the view looking what would essentially be west
- 11:14Speaker 1: across the street from the Noble's residence. Question, okay, at 12.38 a.m.,
- 11:19Speaker 1: I guess. Answer, yes. Question, okay, and what's depicted in this?
- 11:24Speaker 1: I think you've already described that. So, Judge, I would
- 11:27Speaker 1: move to admit Exhibit 12.2. Judge Graff, Ms. Nestor. Now
- 11:33Speaker 1: she has another objection, Your Honor. We renew our objection
- 11:37Speaker 1: to allowing the evidence without the sponsoring witness. I do
- 11:40Speaker 1: have some concerns because I'm not totally sure if this
- 11:43Speaker 1: is a compilation or this is just one of the two, three, four, five,
- 11:48Speaker 1: six videos they took from the nobles. So if we
- 11:52Speaker 1: could just have that clarification, I think that's what concerns
- 11:55Speaker 1: me about the authenticity that I don't understand if this
- 11:58Speaker 1: is just a portion or if this is the whole
- 12:00Speaker 1: thing or if this is all of them or none
- 12:02Speaker 1: of them. And for those reasons, we object to the
- 12:05Speaker 1: admission and to the publication. Prosecution, Judge Graff asks. Now
- 12:12Speaker 1: they answer. That's a good point. And I'll ask additional
- 12:15Speaker 1: questions before I re-seek to admit it. Agent Hall, this
- 12:18Speaker 1: particular video you described taking several videos to Ms. Noble
- 12:21Speaker 1: and having her review them? Answer, yes. Question, okay, this
- 12:25Speaker 1: particular exhibit, 12.2, have you watched it in its entirety? Answer, yes. Question,
- 12:30Speaker 1: does it consist of either some or all of those
- 12:33Speaker 1: videos that you showed Ms. Noble? Answer, it does, yes. Question, okay.
- 12:38Speaker 1: And is it a single video? Is it a compilation,
- 12:40Speaker 1: that is to say? Or is it four different videos?
- 12:44Speaker 1: Or a number of different videos? Answer, it'll be a
- 12:48Speaker 1: number of short videos sequenced. Question, okay, a number of
- 12:51Speaker 1: short videos in sequence? Answer, I believe that's how this
- 12:53Speaker 1: one plays, yes. Prosecution, okay, judge again, I seek to
- 12:58Speaker 1: admit it. Judge Graff, anything further from the parties? No
- 13:03Speaker 1: objection this time. So Judge Graff continues. All right, given
- 13:07Speaker 1: my previous rulings on exhibits, I apply the same analysis
- 13:10Speaker 1: and find that state exhibit 12.2, I believe, is admitted
- 13:14Speaker 1: over the objection and may be published in the courtroom
- 13:17Speaker 1: and by the media, if so chosen. All right, folks,
- 13:20Speaker 1: we're going to wrap up right here. And in the
- 13:22Speaker 1: next episode, we're going to pick up with prosecution asking, OK,
- 13:26Speaker 1: so before we play the video. All the information that
- 13:30Speaker 1: goes with this episode can be found in the description box.
