- Hey, welcome to VoraPrep Audio. Glad you could tune in. Alright, let's talk about a moment you will absolutely have. It could be on the exam, or in your first year on the job. Your client imports some specialized lab equipment. It's a fancy analytical instrument. It comes with standard accessories. And it's all packed in a really nice, durable, fitted case. The kind meant to last forever. You start trying to classify it. You go through the first few General Rules of Interpretation… GRI 1, GRI 2, GRI 3… and you’re still stuck. It doesn't neatly fit anywhere. It's ambiguous. This is a common sticking point. It's the moment you need to know the back half of the playbook: GRI.s 4, 5, and 6. And on top of that, the Additional U.S. Rules. This isn't just trivia. Getting this wrong can lead to the wrong duty rates. It can cause compliance violations and a very unhappy client. All of this is covered under Title 19 of the Code of Federal Regulations, section 152. So let's make sure that doesn't happen. Think of the GRI.s like a hierarchy of decision-making. GRI.s 1, 2, and 3 solve almost everything. They’re the main highway. But sometimes, you need the special exit ramps and detailed local maps. That's what we're covering today. So, what happens when GRI.s 1 through 3 just don't get you to a clear answer? You've tried, but nothing fits. Your next stop, very cautiously, is GRI 4. This is what's called a residual rule. It's your last resort. GRI 4 says that goods you can't classify otherwise should be classified. They go under the heading for the goods to which they are "most akin." Most akin. It just means… what is this thing like? You classify it with articles that are similar in character, nature, or use. It’s a judgment call. You’re looking for its closest relative in the tariff schedule. Now, a huge word of caution here, and this is an exam trap. GRI 4 is almost never the right answer on its own. It’s very rarely used because the first three rules are so comprehensive. If you find yourself reaching for GRI 4, I want you to pause. Go back. Double-check if you really, truly exhausted GRI 3. Pay special attention to the part about "essential character." Chances are, the answer is hiding back there. Okay, let's move on to a much more common scenario. GRI 5. This one is all about the packaging. The boxes, the cases, the containers. It's split into two simple parts, 'a' and 'b'. GRI 5(a) is for the fancy cases. Think about a violin that comes in its custom-fitted, hard wooden case. Or a high-end camera in a specially shaped bag. The rule covers cases with a few specific traits. They're specifically shaped for an article. They're meant for long-term use. They're imported with the article. And they're normally sold with it. Cases like that get classified right along with the article inside. The violin case is classified as a violin. Easy. But there’s a catch. This only works if the case doesn't give the whole thing its essential character. If the case is some jewel-encrusted, ultra-luxury box that's way more valuable than the simple necklace inside, well, then you have a different situation. But for a normal violin in a normal violin case? They travel together in the HTS.U.S. Then you have GRI 5(b). This is for all the other, more boring packaging. The cardboard box around a bottle of wine. The plastic wrap on a pallet. The rule here is that this kind of normal, disposable packing material is also classified with the goods inside. You don't have to find a separate classification for the cardboard box. The key distinction for 5(b) is whether the packing is suitable for "repetitive use." That cardboard box for the wine? Not for repetitive use. You recycle it. So, it's classified with the wine. But what if that wine came in a sturdy, branded tote bag? One designed to be used over and over for groceries? That tote bag is suitable for repetitive use. And in that case, the rule says you would have to classify it separately from the wine. So, 5(a) is for the custom, long-term case. 5(b) is for the disposable, everyday packaging. Alright, so you've used GRI.s 1 through 5. You've found the correct four-digit heading. You’re in the right neighborhood. But you’re not done. You still need the street address—the six, eight, and ten-digit subheading. This is where GRI 6 comes in. GRI 6 is the rule for subheadings. And it's actually pretty simple. It says that to classify at the subheading level, you basically start over. You apply GRI.s 1 through 5 all over again. But you do it within that four-digit heading you already found. The rule uses a Latin phrase, 'mutatis mutandis'. It just means 'with the necessary changes made.' In other words, the same logic applies, just on a smaller scale. The most important part of GRI 6 is the idea of comparing "subheadings at the same level." This just means you can only compare two one-dash subheadings against each other, or two two-dash subheadings against each other. You can't compare a one-dash subheading to a two-dash subheading. It’s like comparing a state to a city—they're different levels of geography. GRI 6 keeps your comparison logical and consistent as you drill down to the final ten-digit code. And as you're doing this, GRI 6 reminds you to look at the relative Section, Chapter, and even Subheading notes. Which brings me to a really crucial point. The notes. The Section and Chapter Notes you see at the beginning of different parts of the tariff schedule are not suggestions. They are not helpful hints. They are legally binding. They are part of GRI 1. You have to read them. They can define terms, telling you exactly what "plastic" means in this chapter. They can exclude goods, saying "This chapter does not cover X," forcing you to go classify it somewhere else. Or they can include goods, explicitly pulling something into a heading. Always, always check the notes before you settle on any classification. Finally, after you've worked through the six GRI.s, there's one more layer: the Additional U.S. Rules of Interpretation. These are specific rules for us here in the United States. They come right after the six GRI.s in the HTS.U.S. They can provide specific guidance that might even supersede the GRI.s. This is especially true for things like textiles. For instance, classifying a shirt made of a cotton-poly blend. Or for classifying parts of an article. Always give them a quick review before finalizing your number. Okay, let's walk through an example to see how this layers together. A client imports a luxury fountain pen set. It’s got the pen, a bottle of ink, and some special paper. It all comes in a beautiful, custom-fitted, velvet-lined wooden box. How do we classify that box? First, you'd look at the set itself. The pen, the ink, and the paper. GRI 3(b) tells you to find the essential character of the set. That's clearly the fountain pen from Chapter 96. So the whole set is classified as a fountain pen. Now, what about the box? We look to GRI 5. Is it a disposable cardboard box? No. It's a custom-fitted, long-term use, velvet-lined wooden box. That’s a textbook GRI 5(a) scenario. The box is entered with the pen set. It’s normally sold with it. And it doesn’t provide the essential character... the pen does. So, the wooden box is classified right along with the pen set. It all gets one classification under Chapter 96. See how that works? Here's one more. A chemical company imports a blend that's 70% Chemical A and 30% Chemical B. You figure out the four-digit heading for the mixture, maybe based on essential character. Now what? Now you apply GRI 6. You look inside that four-digit heading. You apply the rules again. You look at the subheadings at the same level. Is there one that specifically describes this blend? If not, you might have to apply the essential character rule again, at the subheading level, to find the right path. You're just repeating the process on a more granular scale. The big takeaways for exam day are this: GRI 4, the 'most akin' rule, is a last resort. Don't jump to it. For GRI 5, remember the difference. 5(a) is the custom, long-term case that gets classified with the item. 5(b) is the disposable box that also gets classified with the item, unless it's reusable. And GRI 6 is just about applying all those same rules again to find the right subheading. This stuff can feel complex, but it’s just a logical process. Always read the Section and Chapter notes—they are law. Use GRI 6 to drill down into your subheadings by re-applying the earlier rules. And know when to use GRI 5 for packaging. Get these down, and you'll be able to handle those tricky classifications that leave everyone else guessing. You've got this. Keep up the great work.
