- 0:03This is a Bramble Jam podcast. This week on your Gabble Gabble. If
- 0:14your tenant is using COVID as an excuse not to pay rent, should we
- 0:18talk about that hot bench does? And if you throw a comedy show by
- 0:23a pool and your guitar goes missing, is it a laughing matter? Judge
- 0:28Ross tells us free people cases, Thank Justice. This is your gavel Gabble
- 0:36in the stands in the air. Huh huh coffing real good. Drive the
- 0:40car, yr Gavilvo. Drive the car like you know we should. Ten
- 0:43and two. Hello, everybody, Welcome to Yo Gavel Gabble, a Bramble
- 0:51Jam plus Exclusive Jim Plus Original. We are talking about those courtroom shows that
- 0:57you know and love. I have a Judge Ross, when I got a
- 1:00COVID down or hot bench hot bit, three judges for the price of one,
- 1:06Patricia Michael, does it add anything? Here's what I here, Here's
- 1:11these That would be my question if someone came to pitch me that show,
- 1:15I would say why I love it? When they dissent in the in the
- 1:19uh deliberation, not in the dungeon he sent in the dungeon. I did
- 1:23see them go ahead. Three people died. I was so glad to get
- 1:26out of their alive never again dissent in the dungeon. They go back and
- 1:30they deliberate, and when they argue amongst themselves because they all have like actual
- 1:36law degrees, that is fun when they all are in agreement, and it's
- 1:40just they're taking turns just basically interrogating the people. And two of them are
- 1:44hard New Yorkers. It just it gets a little repetitive after a while.
- 1:48Yeah, yeah, so's it could go either way for me. The well,
- 1:49do we want to start high or start low? Let's start low and
- 1:53then it'll be all right. I like that a lot. I like that
- 1:55a rot a covid uh con artists, you say, yeah, yeah,
- 1:59that was the title of the episode. Let me introduce you to I don't
- 2:05know their first names, mister Mayan Dea and miss Yan. They are married
- 2:10and they sublease their uh these properties that they have through an app. I
- 2:15don't remember the name of the app. It's not like Airbnb or something.
- 2:21It's a rental. They rent their apartments, They sub leets their houses,
- 2:25houses and condos. They have several properties and they rent them through an app.
- 2:32They rented to mister Montoya in twenty nineteen. August of twenty nineteen.
- 2:40There is no formal document, least there is an app agreement. So this
- 2:45is this is a long term. This isn't like Airbnb where it's short that's
- 2:49right. No, No, it's a rental. It's a house, so
- 2:52like a zillo or something like. So. Uh, he starts renting with
- 2:54his girlfriend Brandy in August of twenty nineteen. How's Brandy. She's you know,
- 3:00not around anymore. Unfortunately for Montoya. You feel like he's taking it
- 3:05on the chin a lot. But we'll see, Uh, like she's dead.
- 3:08She's not dead. She just left him. They paid through December twenty
- 3:13nineteen. Uh, but then he basically said he couldn't afford the rent anymore
- 3:19and heading into twenty twenty, heading into twenty twenty, where everything went,
- 3:23you know, went to crap, right, And so he couldn't afford the
- 3:28rent, and they said, hey, look I got nowhere. He said,
- 3:30I got nowhere else to go. I can't afford the rent, but
- 3:32I'm gonna get back on my feet. My girlfriend just left me. I
- 3:36do have a job. And they basically said okay, And so they let
- 3:39him rent a different place from them, and this happened before everything's shut down,
- 3:44that's right. So he gets a new place in January. Okay,
- 3:47the girl nice of the girlfriend, You're very nice of them. The girlfriend
- 3:51has not left yet. I was wrong about that. Brandy moves out in
- 3:53March. Okay. So Montoya will tell you that this agreement was between his
- 3:59girl friend, Brandy in them, not him. And when she moved out
- 4:03in March, he was never paying the rent. He was paying her and
- 4:06she was paying the rent. And when she moved out in March and COVID
- 4:11hit, it all went downhill. So what does that mean? So was
- 4:15he splitting it with her? Yes, so he was giving her, you
- 4:17know, half correct. We get back over to Mayandaia and jan and they
- 4:26say Mayandia does most of the talking. Miss Yan talks a little bit,
- 4:29but it's mostly Mayandia. He says, that's not accurate. They both signed
- 4:33the agreement on the app both of them did, and they didn't pay any
- 4:39money in January and March. They were back due on August to December.
- 4:44So in August he was paying, they were paying full, but towards the
- 4:47end of the year they stopped being able to pay the full amount, They
- 4:50were paying partial amounts. What happened, I don't know the answer to that
- 4:55question yet, but there's something that will happen in the future. But what
- 4:58happened in nineteen, they we stopped paying it regularly toward the end of twenty
- 5:02nineteen, and so they owed back money from twenty nineteen, even with an
- 5:06app agreement. Again, that's a that is a contract. So do we
- 5:12have like the logistics of what they signed when they agreed. We don't have
- 5:15the logistics because it is a month to month situation. It's got a full
- 5:19board month. Okay, So he said they the twenty one hundred dollars that
- 5:25they had paid in January February March, which didn't even cover one month's rent.
- 5:30The rent was supposed to be twenty one hundred bucks a month. That
- 5:32was back pay for money that they had owed in twenty nineteen. So that
- 5:40caught him. On the other hand, that's right, that caught him up
- 5:42to date. But they had paid no rent January February March, which is
- 5:46over five thousand dollars in rent, had not paid a dome of that money.
- 5:50Now, when Brandy moved out, and they heard about his situation.
- 5:56They dropped his rent for him. They said it it's supposed to be over
- 6:00two thousand dollars a month. We're dropping it to fifteen hundred dollars a month
- 6:04for you because Brandy moved out and you're in a tough spot. He said,
- 6:08thank you very much. Now in March the world shuts down. Let's
- 6:12find that Brandy left because it was month to month. That's right, so
- 6:14it' silic. She like, correct, Yeah, So here's the deal.
- 6:17Hasn't paid He says he's paid rent January through March. They say he hasn't.
- 6:21He's paid back rent for twenty nineteen. There is a contention there,
- 6:26although the paperwork would suggest he paid it in two thousand and nine for they
- 6:30that he owed money in twenty nineteen, and their papers are orderly. I
- 6:33promise you that I can ali you. So in March the whole world shuts
- 6:36down. Yes, and in that neighborhood there is a moratorium on rent.
- 6:43No one is required to pay rent, not required to pay it. You
- 6:46didn't you know? They haven't figured it out yet. Still, they haven't
- 6:50figured out how people are getting their money for rent. Tricky, So they
- 6:54say, okay, March hits, did you pay him any rent? And
- 6:57he said, I did. I lost my but whenever I got some money,
- 7:01I would pay him one hundred dollars here, one hundred dollars there.
- 7:04What I could. I couldn't afford where I was living, and I told
- 7:09them that, but they kept telling me I could afford it, and I
- 7:14kept telling him I couldn't. Does that mean when I finally moved out in
- 7:16September twin's We'll get to that in a second. So Judge Tanya, who's
- 7:19doing the interrogation, says, hey, the state says, you got to
- 7:23give the renters a break. Here were you making him pay you money?
- 7:27We understand he owes you January to March. Were you making him pay you
- 7:30rent? And Leonard is the guy's first name, Mandaea, that guy Lyonyard
- 7:34says, here's the deal, and they said, we have a text message
- 7:39that you sent saying don't worry about the rent right now. And sure enough
- 7:43there's a text message and it says don't worry about the rent right now.
- 7:46Things are crazy. There are a lot of benefits you can apply for.
- 7:48Apply for these things and that will help you get money. And then we'll
- 7:53worry about COVID rent later. It doesn't say anything about the January March,
- 7:57right, it says moving forward now January to March is very is tricky.
- 8:01It's tricky because it's over five thousand dollars and it doesn't apply. Get it
- 8:05doesn't apply to the COVID situation. Correct, Yes, So he did not
- 8:11apply for any benefits. And finally Leonard's wife applies for him for the EDD
- 8:20benefits, employee benefits, unemployment benefits applies. Because he wasn't tech savvy,
- 8:26he didn't know how to operate. He's a little bit older, didn't know
- 8:28how to operate it. They did it for him. They successfully applied,
- 8:33and on August fifth, he received his unemployment card and received back pay from
- 8:39March all the way through August eleven thousand dollars in unemployment and then began to
- 8:45receive weekly unemployment checks beginning in August. Okay, so they say, hey,
- 8:52this sounds really nice. Mister Montoya, like, wasn't that nice of
- 8:56him? And he said it was nice of him, but I think they
- 8:58did it to take advantage of me. And Tanya goes, you mean to
- 9:01tell me they got you eleven thousand dollars to take advantage of you, and
- 9:05he says, well, when he was helping me, he was there for
- 9:09me. But when they weren't, they weren't, that's all he says.
- 9:11So at this point, Leonard says, we got him eleven thousand dollars plus
- 9:16weekly benefits. As soon as he gets that, I text him and call
- 9:20him to say, hey, is there any amount of this that you can
- 9:22pay for the rent? And he doesn't answer my calls. He's ghosted me
- 9:28completely. I tried texting, I tried calling, and finally he had to
- 9:31file some paperwork, a tro form or something like a tenant's not answering or
- 9:35doing what he's supposed to do. So he shows up at the door and
- 9:39informs me no longer has a parking spot out front and he needs you know,
- 9:43I don't. He didn't say he needs to move out because it's COVID,
- 9:46but you don't have a parking spot out front. You got these all
- 9:48this back pay for January through March. We know you have money, you're
- 9:50not paying us the money. At that point, we have a threat.
- 9:56Mister Montoya says, you tow my car and see what happened, and mister
- 10:01Montoya says, I felt threatened. I felt it was a terrorist threat.
- 10:05Terrorist threat for you to tell me I don't have a parking spit anymore.
- 10:09That defendant, what's his what's what's his nationality? Uh? He and his
- 10:15wife are both definitely people of color. Miss Yan is Asian, he is
- 10:20I don't know, but it is definitely in the ballpark for him to be
- 10:24Middle Eastern. And Montoya it looks like he is Latin American of some descent.
- 10:28So it's so, who's that way? Who's Montoya said it was a
- 10:31terrorist threat, right, And Tanya immediately says, telling someone that's your tenant,
- 10:37you don't have a parking spot is not a terrorist threat. Then there's
- 10:39a video. They have a video of them outside talking about it, and
- 10:43basically, mister h the filming, Uh no, no, it's a not
- 10:48Tanya. The complex that they're in has a video, a security system video.
- 10:54So uh Basically, Leonard is like, I'm tired of this, Like
- 10:58I just need you to pay some money. Why can't you pay their print?
- 11:01We got eleven thousand plus you're getting the benefits every week, and he
- 11:05says, I had other things to pay, and he says, so what
- 11:05you're telling me is the other things you had to pay are more important than
- 11:09the rent. And basically Montoya says, yes, on the security system,
- 11:15yes, this is good, good stuff. Yes, it's good stuff.
- 11:18So then Leonard says, look, he received eleven thousand dollars. We felt
- 11:24like it's time, it's time for him to start paying. But he also
- 11:30could We knew he was receiving unemployment every week. So then Patricia gets in
- 11:33and says, how much unemployment were you receiving? He says one hundred and
- 11:37sixty seven dollars a week. Child support takes forty two dollars a week.
- 11:39From that, he says, so you're receiving like six hundred bucks a month,
- 11:43and Montoya goes, I don't really get into the math. She goes,
- 11:46you get in the math. It's your money. Well, you mean
- 11:50you'll get into the math, like you need to get in the math,
- 11:52like what's going on there? And he goes, yeah, I guess it
- 11:54was something like six hundred whatever she said. And you gave him them no
- 12:00money? He goes, that's not true. I gave them to two thousand
- 12:03and once one thousand another time, and They said, did he give you
- 12:05any money? They said, yes, he gave us thirty six hundred dollars
- 12:09is what he did give us when during the time from some time between March
- 12:15and August, between August and September. August and September, that's right,
- 12:16Yeah, he thirty had some money six hundred dollars, okay, and uh,
- 12:22But he said, I had all these other expenses. I spent four
- 12:26thousand dollars on my kids. They're twins, they're seventeen years old. I
- 12:28was behind. I needed to get them things that was very important to me.
- 12:33My aunt passed away. I helped with a burial. And I'm only
- 12:35getting six hundred dollars a month. At this point, Leonard says, that's
- 12:37a lie, your honor, and and and and do that's a lie that
- 12:41he's getting six hundred dollars, only getting six hundred dollars a month. He
- 12:45goes, no, I'm getting one hundred sixty seven dollars a week. I
- 12:46give forty two. And Leonard says, he's not telling you that he's also
- 12:52getting the six hundred dollars a week unemployment benefits signed by the government in the
- 12:58Cares Act, which you should remember I remember, and he was in fact
- 13:05getting six hundred dollars a week on top of his one sixty seven. Wow,
- 13:09so he's making after child support seven and change a week. He's making
- 13:13three grand a month was what he's making. Yeah, yeah, yeah,
- 13:18yeah. So they say it was this true, mister Monteli. He goes
- 13:22yeah, but they shut that down. They said, yeah, when they
- 13:24shut it down in like the fall and gave you three hundred instead of six
- 13:26hundred, we're talking about August and August, you're still getting an extra six
- 13:30hundred week. Yes, I am getting six hundred a week. So at
- 13:33this point they say, so where do you get this number five thousand?
- 13:37And they say, well, the money he owed us, we believe like
- 13:41money he owed us currently is twelve thousand, six hundred dollars. He gave
- 13:46us three thirty six hundred. That's nine thousand left the max we can sue
- 13:50at hot benches five thousand. So we're asking for five thousand. So then
- 13:54they say, can you campaus your head because the twelve thousand that's more than
- 13:58Because I was under the impression it was we were doing January to March,
- 14:01that's right. So they have included some time in COVID. They have included
- 14:03the money he owed that was under the impression it was five thousand January.
- 14:07They've included the lesser amount through May, June, July, August, and
- 14:11September. May, June, July, August and September five, and then
- 14:15they basically included like seventy five hundred from there, so because it was fifteen
- 14:18hundred dollars a month. So the breakdown is fifty one hundred for the January
- 14:26to March, and then another seven eight thousand or whatever for the for the
- 14:31time afterwards. And basically they want the money and they say, hey,
- 14:35we can't. They're like, you understand that. We cannot tell you if
- 14:39giving money to his kids is more or less important than paying the rent,
- 14:43we can't do that, Like this is not the time or place to do
- 14:46that. That's not our job to do it. And they're like yeah,
- 14:48they're like, also, you understand he didn't have to pay rent after March.
- 14:52So then they go to deliberate and that's that's where we are. What
- 14:58to me, it sounds like, so he has given them thirty six January
- 15:03to March is fifty one? Is that crack? Fifty one? Hundred.
- 15:07They don't ever split it up. They just say he owes over five thousand
- 15:13dollars from January to March twelve six was the total he paid thirty six hundred
- 15:16down to nine thousand. I would say he owes the rest fourteen hundred,
- 15:22fourteen hundred, fifteen hundred, whatever it would be to get to January to
- 15:26March. Can enforce make him pay for March onward. So they Tanya says,
- 15:31I'm really uncomfortable with this. They all agree we can't determine what's most
- 15:35important. However, they're basically the paperwork that was turned in. They believe
- 15:41the court believes he still owes a full five thousand dollars from January to March,
- 15:46and that even though he paid some money along the way, the money
- 15:50he owes from January through March is over five thousand dollars, and so they're
- 15:54going to award them the full amount on that money, which is five thousand
- 15:58dollars. That is what they determine. It's a weird one. I don't
- 16:00know how they get there. I don't either, but we don't. We
- 16:03never get the excit, I mean unless the you know what, did they
- 16:07confirm that August to December was settled or did the thirty six hundred go towards
- 16:12that they determined that the twenty nineteen was paid in full. They did determine
- 16:18that. So the only thing I can figure is is that from January to
- 16:21March the rent on that place was way higher. Like it was like the
- 16:25thirty six hundred still left them with over five thousand do in from January to
- 16:30March. That's the only thing I can figure. But it was a mess,
- 16:33and there was a lot there. And at the point, didn't you
- 16:36say that it was supposed to be two thousand dollars they dropped it to fifteen
- 16:40hundred dollars. There was a yes there, So, but that's not the
- 16:42first house. The twenty nineteen house was more. I don't know how I'm
- 16:47talking about the second place. I thought you said the second place was supposed
- 16:49to be two thousand. When she dropped out, they moved. They moved
- 16:52to fifteen hundred, which wasn't until COVID, which wasn't until COVID. That's
- 16:56right, But they weren't paying. They weren't paying, so yeah, it
- 17:00could be six thousands, yes, could be, it could be sick still
- 17:03at that point, it's still less than three, Like it's still five.
- 17:07Gives them the full five? Okay, whatever, you we really dug deep.
- 17:11It is really you know that the whole COVID apartment thing, it's super
- 17:17tricky for for everybody because there are people that legitimately cannot pay rent. There's
- 17:22other people that can't and won't, and then landlords, some who are good
- 17:27people who want to do the right thing, are stuck in really difficulty.
- 17:33Said the original house that they were in, that he got rid of that
- 17:37that he left because it was too expensive. They had to get rid of
- 17:38that property. They had to sell the property because they couldn't. I can
- 17:41see that rent is Uh that's still happening, is the rent? I think
- 17:45there's still a rent moratorym in some places. Yeah, I don't know how
- 17:48they're going it in South Carolina, I don't know. I think it did.
- 17:52I'm not sure. Yeah, who's you want to go over to Judge
- 17:56Raw I would love to go to Judge A. Cross. I want to
- 18:00introduce you to Todd Carter. Todd Carter is suing a J Mercer for two
- 18:07thousand dollars, which is the amount of a stolen guitar. Fair enough,
- 18:14So Dylan, sorry, his name is Dylan. I don't know why I
- 18:18wrote Todd, Tod, Todd and Dylan. I mean, you know,
- 18:22oh, I know what happened. I was watching on YouTube the very first
- 18:26part. It doesn't say his name. I didn't get Dylan the name Dylan
- 18:30until later. It was just mister Carter. And so I wrote Todd as
- 18:33a fill, as a filler, yeah, just so I was your reference.
- 18:36I was gonna go with Todd the whole time. I don't understand why
- 18:37you would write a filler. You just write Carter. You need a first
- 18:41name to move on? Is that what you need? I could have gone
- 18:44with Carter, So Todd Dylan Carter basically was approached by his friend okay,
- 18:52who's also his roommate, who's also as lord. So this person's say that
- 19:03this person's name is Kelly. Don't know if it's a guy or girl whatever,
- 19:07she's not she or she or he's not. Kelly's not here. But
- 19:11Kelly owns the house and is you know, subleasing it to to to Todd
- 19:18Dylan. Okay, done and done. So Kelly tells Dylan, Hey,
- 19:23I have a buddy who throughout this idea of having a comedy show in the
- 19:29backyard by the pool. Yeah, it's a classic comedy it's a comedy comedy
- 19:33show. Pool time. Now, Dylan. The house, it's a nice
- 19:37house, has a really nice pool in the back. And when AJ caught
- 19:41wind of this nice pool, his wheels started attorning because AJ is a freelance
- 19:48photographer who likes to take pictures of comedy shows. Interesting. So yeah,
- 19:55so AJ had this idea, like, how cool would it be to take
- 19:59pictures of this exclusive comedy show by a pool. That would be awesome.
- 20:04It would be awesome cool. So AJ meets up with Dylan, pitches in
- 20:11the idea and uh, Aj is you know it? Says it sounds okay
- 20:18now, AJ says, Dylan, Dylan is on board. But until this
- 20:22point, AJ says Dylan was Dylan was on board for the party, and
- 20:26Dylan says, no, I was not on board for a party. Okay,
- 20:32okay, Dylan says, I want to make this very clear. I
- 20:36was pitched a comedy event. What happens was it turned into a full fledged
- 20:42rager, a full fledged run with people walking in and out of my house,
- 20:47which was not agreed to, and he rents the house. He rents
- 20:49the house with Kelly. Kelly's there, Oh, Kelly's there, Okay,
- 20:52Kelly's at the house, Okay, at the at the event event, the
- 20:56comedy event. And uh, Judge Ross is like, what's the difference event
- 21:00between an event and a party? And Dylan says, well, what happened
- 21:06was there was a DJ there that played music. And Dylan says, I
- 21:11was told that once the comedy was done, everyone would leave. And that's
- 21:17not what happened. I don't understand. He wanted to do a Dylan Dylan
- 21:22wanted to have a very professional comedy events by the pool, by the pool,
- 21:30hard out with alcohol. He did agree to the alcohol. Comedy's done,
- 21:33stop drinking, go home. Yes, don't stick around and drink more
- 21:37alcohol by the pool. That was the plan. Don't swim. Now.
- 21:40The good news is is this event, this nice, classy event that wanted
- 21:45to have, was only five dollars to get into. Okay, so you
- 21:51know how all the classy comedy lovers love to go those five dollars. Comedy
- 21:55events, not parties. It was the drinks weren't included on drinks were included,
- 22:00Dan, Oh my gosh, aj wanted to make sure that this was
- 22:04awesome, so he paid for the drinks. He just he we will get
- 22:10to the money here, and we'll get to the money in just so,
- 22:15man, where are the where are the pool? Comedy event? Open bars?
- 22:21They come. So around two hundred people show up to the party.
- 22:26Okay, not bad, not bad, not bad. Start going out of
- 22:30his house. You didn't like that, and Dylan claims that something happened that
- 22:37either a allowed people to enter the event without paying or b a J took
- 22:44more money. So it was supposed to it was supposed to be a split.
- 22:48That's not what happened. But remember Dan, this is not about the
- 22:52money guitar. This is about the guitar. And we will get there,
- 22:56I promise. So AJ says, listen, I paid for all the drinks.
- 23:02You know, I tried to, you know, get my money back
- 23:06for the drinks. Dylan's like, that's not what we agreed on. But
- 23:10again, not why we're here. So the day before the event, AJ
- 23:19says, hey, I have to drop off DJ equipment. Okay, and
- 23:26Kelly, you know Kelly, Kelly gave him a key, said no problem,
- 23:29here's the key, going there, leaving and it's good. Good to
- 23:30go. The day after the party, the event, Dylan and Kelly are
- 23:40out back cleaning everything up, working hard, and he's thinking to himself,
- 23:44man, where's Aj. Why isn't AJ here helping us clean up? AJ
- 23:48rolls up with his swim trunks on with more beer, ready to keep the
- 23:52event going, and Dylan says, I don't want to see your face here
- 23:57ever again. Since him off, I'm going to clean all this up myself.
- 24:03A week later, Oh boy, Dylan gets a text from AJ saying,
- 24:08Hey, I still have the key? Can I swing by and get
- 24:12my DJ equipment? Oh? Who's still there? Yeah? He's like,
- 24:15sure, I'm not here. I'm He's a He apparently works at a recording
- 24:21studio, so he's like, I'm in the studio, go by, I
- 24:22get it, and then never talk to me again. So he goes,
- 24:27gets the stuff, leaves the key on the kitchen counter. Dylan gets in
- 24:33from a long day's work in the studio, sees the key, is like,
- 24:36thank god, this is over, goes to bed, wakes up the
- 24:38next morning for band practice, and he goes down into his uh what does
- 24:45he call this room? The jam room? The jam room? Ahead this
- 24:51is a mansion. Apparently the jam room goes on a jam room, and
- 24:56he goes and he turns on the lights and and he reaches for his guitar,
- 25:00which is hanging by the light switch, and his guitar is nowhere to
- 25:04be found. Oh boy. Now here's a couple of things that we know
- 25:08about the guitar. One, it was seen at the party because Dylan's band
- 25:15played. Now Ross doesn't say I thought this was a comedy event. But
- 25:19my first thought was, Dylan, you're contributing to the problem. That's right.
- 25:23Comedy event, not comedy event, not a rager. If you wanted
- 25:27to be in a comedy event, you don't have your band play a quick
- 25:30fifteen minute set. So his guitar was seen at the party, and he
- 25:36remembers Aja. After the set he gets off stage and eight is like,
- 25:40man, that's a nice guitar. I played too, great guitar. Comment
- 25:42on the guitar. The week following, Dylan had been working on some new
- 25:48songs, so he was playing his guitar, so he had seen it since
- 25:52the party. The last person in the house was Aj. Aj mentioned like
- 26:00the guitar. It must have been Aj. Now you might say that's not
- 26:03enough, not enough. Well, what if I told you that there's a
- 26:07picture that appears on the internet a couple of days later of AJ playing at
- 26:12a gig with a guitar that looks very similar to Dylan's guitar. Now we
- 26:19see two pictures here. The first pictures of Dylan's guitar. The second is
- 26:25of AJ playing the gig. Now, this is what I will say about
- 26:30the guitar guy. This is what I will say about this. So this
- 26:33is not a straight straight ahead shot. He's kind of at an angle and
- 26:37there are stage lights, different colors. Is it the same guitar? It
- 26:42looks similar, it's close, but could it be the same. It could
- 26:48absolutely be the same guitar. Is it a pretty pretty generic guitar though,
- 26:51No, it's it's a nice, like a nice it's got like a nice
- 26:56sunburst to its It's a unique and you can kind of see the sunburst.
- 27:02But again, he's kind of at an angle. You can't exactly tell.
- 27:04It looks like a similar build, but you can't tell. And Judge Ross
- 27:11is ready to make his judgement. They're a police report filed. No police
- 27:17report here, no police report. Not that we are a claimed he didn't
- 27:21take it. AJ claims that he did not take the guitar and that he
- 27:26you can get that guitar anywhere. You can get it at any guitar shop.
- 27:30I have lots of guitars, no big deal, and this is tough
- 27:34I And AJ doesn't say that it's not the same style either. He just
- 27:41hit His defense is you could get that guitar and say I have a guitar
- 27:44just like it. He doesn't say that, but but when, but when
- 27:48Judge Ross is like, did you take the guitar, he says, no,
- 27:51you could get that guitar, pointing at the picture of Dylan's at any
- 27:55guitar shop. But you know, he never says I have one just he
- 27:56never says that he has one just like it, And he never said is
- 28:00that. You know, he just makes a point. There's just not enough
- 28:03evidence. There's not enough proof here to the burden of proof is on the
- 28:07planeiff and it did not it was not met. No money for Dylan.
- 28:11Judge Ross agrees with you to do anything, you have to have at least
- 28:17fifty one percent of you know, the overwhelming evidence that there's that it's on
- 28:22that it's on AJ and he says, if I would go off my gut,
- 28:26I think Aj is a liar and he and he stole it. Yeah,
- 28:29but I but you know I can't go off my gut in the court
- 28:33room. Kate dismissed. Kate dismissed. Kate, get it out, Kate.
- 28:37You're not welcome here anymore, Kate, Kate enough. I love the
- 28:41Google. No, Kate, come on, the episode's over. You're not
