- 0:00Speaker 1: What's up, everyone, and welcome to another episode of the
- 0:02Epstein Chronicles. In this episode, we're going to pick up
- 0:06where we left off with a tovin Owell interview with Congress. Question, Okay,
- 0:12some of these other inmates coming and going. At three
- 0:14point fifteen, inmate Fernandez left the shoe for a dry
- 0:17cell NRA. That's forty five minutes before you arrived. Did
- 0:22anybody mention that to you at the time? Answer? No question.
- 0:26And then during your shift there were a few more departures.
- 0:29So somebody named Hemingway departs at six thirty four pm,
- 0:33and then a few minutes later an inmate named Red
- 0:35also leaves. Those are both in your first two to
- 0:39three hours of work. Do you recall anybody mentioning or
- 0:42I guess would you have seen Hemingway or read leave
- 0:46the shoe? Answer? To be honest, I don't recall these
- 0:49two inmates leaving. Question got it? Would that likely be?
- 0:53Would you physically be in the shoe essentially during your
- 0:55entire shift? Answer? I would be in the shoe my
- 0:58entire shift, and I went to the bathroom on ten south.
- 1:02Question understand, and so I guess is it? The likeliest
- 1:07scenario is these guys leave, but you don't necessarily recall
- 1:11sitting here today that happening. Answer correct question, okay. And
- 1:15then at eight twenty one pm, Felix and Williams leave
- 1:19for suicide watch, and you just describe before what suicide
- 1:22watch was. Do you recall those two inmates leaving? Answer?
- 1:26I don't question okay. And around eight thirty am, an
- 1:30inmate named Garcia Penya moved into the shoe. That's the
- 1:34only inmate we're aware of coming into the shoe that day.
- 1:37Do you have any recollection of mister Garcia Pena arriving? Answer,
- 1:41no question, okay. So it ends up being I think
- 1:44a total of six inmates leaving, one arriving that day,
- 1:48you don't really have any recollection gets cut off by
- 1:51noel of any of that. No question, okay. Is it
- 1:55right that as far as you remember, mister Epstein was
- 1:58out of the shoe most of the day with the lawyers.
- 2:00Answer correct question. Okay. So you started your first shift
- 2:05at four pm, and right away it would have been
- 2:07time for the four pm count. Is that right? Answer?
- 2:11Correct question? That count slip I think was signed by
- 2:17yourself and the evening watch officer in charge there was
- 2:20some question about whether or not that count happened. Sitting
- 2:23here today, to the best of your recollection, did you
- 2:26or your colleagues conduct the four pm count? Answer? I
- 2:30didn't conduct the four pm count. Question since there was
- 2:33a total of three of you, do you know whether
- 2:36the other two guards conducted the four pm count? Answer?
- 2:39I don't recall. Question okay, I think your signature was
- 2:43on the four pm count slip though, Is that correct
- 2:46as far as you know? Answer? I think so. Question
- 2:50with respect to mister Epstein's phone call, which we understand
- 2:53to be sometime around seven pm, mister Epstein, this is
- 2:56our best understanding, and then I'll ask you answer okay,
- 3:01question our understanding. Mister Epstein was escorted to the shoe
- 3:04shower area, so that gets cut off by Noel. Correct question,
- 3:11so that he can make a phone call. The phone
- 3:12call was not monitored or recorded, and mister Epstein was
- 3:16left alone for the conversation. Do you have any knowledge
- 3:19of that personally? Answer yes? Question okay, what's your recollection
- 3:25of that? Answer? Mister Epstein came into the shoe with Bullock.
- 3:30Bullock placed him in the shower, plugged in the phone,
- 3:33and gave it to him. He didn't say anything to
- 3:35any of us, and he left. After a long while,
- 3:38he called. I answered the phone, and he said, take
- 3:41the phone from Epstein because his time is up. I
- 3:44went to the shower cell and I told him that
- 3:46his time was up, and I took the phone from
- 3:48mister Epstein. Question and the he is Bullock? Answer Bullock correct, redacted. Okay.
- 3:57Did you would you have been able to overhear any
- 4:00of the conversations from wherever you were sitting at the time?
- 4:04Answer no question. Did you overhear any conversation when you
- 4:09came in to take the phone from Epstein? Answer no question?
- 4:13Did Epstein? Well, let's do this. What did you say
- 4:16to mister Epstein when he entered the shower area. Answer
- 4:20that Bullock told me to take the phone from him
- 4:22because their time was up. And he told me okay,
- 4:25And he told the person by question and that's it
- 4:28as far as you remember. Answer correct. Question. It sounds
- 4:32like Epstein was on a line that's supposed to be
- 4:34for calls with lawyers, which this was not. Were you
- 4:38familiar at the time with how inmate phone calls were
- 4:41normally supposed to work at the MCC Answer not in
- 4:45the shoe, I'm not familiar. Question if you remember, did
- 4:50you have a sense at the time that this was
- 4:52an unusual setup for an inmate's phone call? Answer no question.
- 4:56It didn't look out of the ordinary to you. Answer no,
- 5:00because the jacks don't work, so you have to put
- 5:02them where the jack is working. But I learned that
- 5:05after it was unmonitored. As far as what's monitored and
- 5:09what's not monitored, I don't know. Question do you recalling
- 5:12your time in the shoe seeing Bullock or anybody at
- 5:15Bullock's level, I guess anybody from mcc staff putting an
- 5:19inmate in that shower area for a phone call? Answer yes,
- 5:23question okay. Can you estimate, maybe roughly how many times?
- 5:27Answer I can't. Maybe two question And if you can recall,
- 5:31would that have occurred with an inmate other than Epstein?
- 5:34Answer yes, question okay, So it did not strike you
- 5:38as something unprecedented that you had never seen before. Answer
- 5:42no question. You also mentioned to the IG that you've
- 5:46fed Epstein dinner sometime after his phone call, after he
- 5:49went back to his cell. Is that right? Answer correct?
- 5:53Question Do you recall roughly what a time that would
- 5:55have been answer, I don't have a time. Question would
- 5:58it have been before or after the ten pm count? Answer?
- 6:01It would have been before question okay? And roughly what
- 6:05time would he have gone back to his cell from
- 6:07the phone call? I guess seven fifteen or seven thirty?
- 6:11Answer or about eight after eight? Question? Got it? Okay?
- 6:16Answer because after the phone was taken from him, he
- 6:18wasn't moved right away. He was left in the in
- 6:22there in the shower because you can't move an inmate
- 6:24when order leads are out, because they can't cross each other.
- 6:27So he wasn't moved right away. He was left in there,
- 6:30and then I went to the bathroom, and when I
- 6:32came back, he was moved. He was in his cell.
- 6:35Question could you estimate, to the best of your recollection,
- 6:38how long you would have been left in the shower
- 6:39area after the phone was taken from him? Answer about
- 6:43ten minutes. Question And it sounds like there were order
- 6:46leads out and about doing work at the time. Answer correct.
- 6:50Question Was this normal that the order leads sort of
- 6:54every night in the shoe would be out doing work
- 6:56or did that change from day to day? Answer? It
- 6:59would change? Question okay, just on the particular day they
- 7:03were out. Answer correct question. Okay. With respect to feeding
- 7:07mister Epstein, dinner, was that at the same time that
- 7:10you've fed everybody in the Shoe? Answer no question, okay,
- 7:14it was specifically mister Epstein. Answer correct. Question Was that
- 7:18just because that's when he got back from the phone call?
- 7:21Answer because feeding would have been at four when I
- 7:24come onto my shift. Where everybody eats from downstairs, Epstein
- 7:28doesn't eat from downstairs. He eats what we called common
- 7:32fare because he's kosher. Question got it? So he's getting
- 7:36food from a different source because of a kosher restriction. Answer? Yeah,
- 7:40So the inmates get like like prepared cook food, he's
- 7:43like a prepackaged like you warm it in the microwave
- 7:46and you give it to him. Question and would he
- 7:49typically have his dinner? What time does everybody else have dinner?
- 7:53Answer at four after four? Question okay, and his would
- 7:57typically be later because he's not getting back from the
- 7:59conference room. Answer correct question. Can you recall other inmates
- 8:04that got their meals from a similar kind of prepackaged arrangement,
- 8:08whether it's kosher or some other restriction? Was that common
- 8:12or uncommon? Answer? In the Shoe nobody else had that
- 8:15only Epstein that I can recall. And what can you
- 8:19recall about your interaction if there was one with Epstein
- 8:22when you brought him as dinner, did he say anything
- 8:25to you? Answer? No, there's a food slot in the door.
- 8:28So Davis put the food in the microwave. And then
- 8:31Davis had the grill key. So he opened the grill
- 8:34and I like, open the food slot, and I gave
- 8:36it to him and he took it and he said
- 8:39thank you, and I closed the food slot back. Question?
- 8:42Got it? So two people traveled to bring a meal
- 8:45to a cell? Answer? Right? Because every time it's always
- 8:48going to be two in the shoe because somebody has
- 8:51to open the grill. Question. So is it right that
- 8:54anytime a guard goes into a tear in the shoe
- 8:57there have to be two guards? Answer supposed to question
- 9:01supposed to be answer? Correct question? Okay, all right, I
- 9:05know I mentioned the one inmate that arrived into the shoe.
- 9:07Garcia Penya. I think you said it, but you have
- 9:11no recollection or knowledge of him as an inmate or
- 9:13as a rival. Is that correct? Answer? Correct question? Okay?
- 9:19And we found a document somewhere that suggested is transfer
- 9:22into the shoe had to do with a tobacco related infraction.
- 9:25Would that be something that you had seen before, the
- 9:28type of thing that would land an inmate in the shoe?
- 9:31Answer correct question. This is to be the best of
- 9:36your memory. Were any of the cells in the shoe?
- 9:38How about just an Eltier if you can recall empty
- 9:41that night or in the whole shoe? Did every cell
- 9:44have at least one inmate in it? Answer to the
- 9:46best of my recollection, I think everybody had one except Epstein. Question.
- 9:51Can you say that one more time for me? Answer
- 9:54to the best of my recollection, I think everybody had
- 9:56one except Epstein question, meaning every buddy had a cell
- 10:01mate Answer correct question. So the best of your recollection,
- 10:05Epstein was the only person alone in his cell in
- 10:08the entire shoe that night. Answer to the best of
- 10:11my recollection. Yes, question, And you have no recollection of
- 10:15any of your colleagues or yourself having any kind of conversation,
- 10:19because that would look even more out of the ordinary,
- 10:22that there's only one inmate alone and it's Epstein. There
- 10:25was no conversation about that. Answer No, If it wasn't
- 10:29Epstein and it was another inmate alone, it's not uncommon though,
- 10:32if they're alone, because people leave all the time to
- 10:34go to general pop or if people get released, so
- 10:38the one inmate is not like suspicious, Like if I
- 10:40saw one person in a cell and it just happened
- 10:43to be him, but it wouldn't have raised suspicion. Just
- 10:46to be clear and question, and I'm just thinking out loud,
- 10:50but if six people left the shoe that day, is
- 10:52it possible that not every cell had because you would
- 10:54never have a cell with three inmates in the shoe? Right, answer, right, question,
- 10:59So it is a pop that there may have been
- 11:01some other cells somewhere in the shoe gets cut off
- 11:05by Tovin Noel. Probably they didn't have one, but I
- 11:09can't recall who or if at this present time. Question
- 11:12I understand with respect to the ten PM count, there's
- 11:16some question in the IG report about the extent to
- 11:19which you or your colleagues conducted that count. We know
- 11:22that there were movements around the time, and some debate
- 11:25about whether that is officially part of the count or not. Answer,
- 11:29uh huh. Question from your point of view sitting here today,
- 11:33did you conduct that ten pm count? Answer from my
- 11:36point of view sitting here today, I conducted the ten
- 11:39pm count improperly because it was done by myself. Question
- 11:43what do you recall? Can you describe your recollection of
- 11:46conducting that ten pm count for us? What do you
- 11:49remember about what you did and around when you did it? Answer?
- 11:53I entered every tier and counted the inmates. Epstein doesn't
- 11:57sleep on his bed. He sleeps on the floor. He
- 12:00puts the mattress on the floor. So when you're conducting account,
- 12:04you look in the window of each tier and you count.
- 12:06And I went up and down every tier, and I
- 12:08counted by myself. Question and did you fill out account slip? Answer? Yeah, question,
- 12:14and there was some mention in the IG report that
- 12:17all may have occurred, you know, around ten thirty, after
- 12:20the official account had been cleared the ten pm count
- 12:23by control. Is that possible from your point of view?
- 12:26Answer about the count slip question, Yeah, that your counting
- 12:30may have occurred maybe around ten thirty when the control
- 12:33Central Control had already cleared the paperwork. Answer, oh, that,
- 12:37I don't know. Noelle. Just to clarify, the starting count
- 12:41time is ten, but you're not. It's an institutional count.
- 12:45So on the other units, they're waiting for internal to
- 12:48come and count with them, So the count would never
- 12:50be cleared like directly at ten, because you're going through
- 12:53the whole building, going to each unit for everybody to count,
- 12:57and you're waiting on them. So the count the count
- 13:00time is that ten, but you're not necessarily so you're
- 13:02in the vicinity of after ten counting. It could be
- 13:06ten to fifteen, it could be ten thirty, and then
- 13:09after the whole building has counted, then they would have
- 13:11to clear the count. I don't know anything about them
- 13:14clearing the count before I counted. All right, folks, we're
- 13:17gonna wrap up this episode right here, and in the
- 13:19next episode dealing with the topic, we're gonna pick up
- 13:21where we left off. All the information that goes with
- 13:24this episode can be found in the description box.
