- 0:04Speaker 1: Fire Eyes Media. Justine Vanderschute had her whole life ahead
- 0:08Speaker 1: of her at just seventeen years old. She was bright
- 0:11Speaker 1: and vibrant, always the life of the party. She was
- 0:15Speaker 1: known to be quite funny, and her family described her
- 0:18Speaker 1: as being a little firecracker. Unfortunately, before she even got
- 0:22Speaker 1: the chance to make some tough decisions for herself, her
- 0:26Speaker 1: life was cut short. With that said, let's get into
- 0:29Speaker 1: Justine's story. Welcome to another episode of Truly Twisted. As always,
- 0:50Speaker 1: I'm your host, Alicia Watson, and every Thursday, I will
- 0:54Speaker 1: be bringing you a true and twisted story that is
- 0:58Speaker 1: always victim focused and fact based. Thank you so much
- 1:02Speaker 1: for being here, and remember to subscribe so that you
- 1:05Speaker 1: never miss an episode. And whether I've caught you on
- 1:09Speaker 1: your commute to work, cleaning your house, or at the gym,
- 1:13Speaker 1: I do just want to warn you that this story
- 1:15Speaker 1: is hard to hear, and I would like to give
- 1:17Speaker 1: a trigger warning for domestic abuse before we get started.
- 1:21Speaker 1: On September first, two thousand and three, Justine Vanderschute and
- 1:26Speaker 1: her family were celebrating Labor Day by having a family barbecue.
- 1:30Speaker 1: Justine would invite her boyfriend Danny over, and it was
- 1:33Speaker 1: just like any other night at the household. Danny Besmer
- 1:37Speaker 1: did not have the greatest home life himself and would
- 1:40Speaker 1: often spend time at Justine's house. They had become the
- 1:44Speaker 1: family that he never got to have. Justine and her
- 1:48Speaker 1: older sister Christine were extremely close and just eighteen months apart,
- 1:53Speaker 1: so they shared a lot of the same friends. That
- 1:56Speaker 1: is actually how Danny and Justine would meet in the
- 1:59Speaker 1: first place. Christine had become friends with Brandon Fernandez and
- 2:04Speaker 1: he invited his best friend Danny to her pool party. Originally,
- 2:08Speaker 1: he had planned to set up Christine and Danny, but
- 2:12Speaker 1: Danny hit it off with Justine. They had a lot
- 2:14Speaker 1: of common interests and for him, it was definitely love
- 2:18Speaker 1: at first sight. Of course, Christine didn't mind, but just
- 2:21Speaker 1: so you get an idea of their circle and how
- 2:24Speaker 1: they met. Danny and Justine became serious fast and often
- 2:29Speaker 1: talked about their future together and marriage. At the time,
- 2:33Speaker 1: Justine was fifteen and Danny was seventeen. Justine's father, Don
- 2:38Speaker 1: got Danny a job working with him at an auto
- 2:41Speaker 1: dealership as his first job, and he quickly became a
- 2:45Speaker 1: part of their family. Given Danny's home life, her parents
- 2:49Speaker 1: wanted to give him that support. He even got a
- 2:52Speaker 1: key to the Vanderschut's house in case he needed to
- 2:55Speaker 1: come there when they weren't home. Justine was incredibly creative
- 2:59Speaker 1: and would often design and sew her own clothing. She
- 3:03Speaker 1: was heading into her graduating year in two thousand and
- 3:06Speaker 1: three and she wanted to work in fashion when she
- 3:08Speaker 1: was done school. Honestly very cool. She was incredibly ambitious
- 3:13Speaker 1: in fact, and Danny didn't really like that. He was
- 3:17Speaker 1: obsessed with the fear of losing her. Danny was controlling
- 3:21Speaker 1: over who Justine's friends were and would make her feel
- 3:25Speaker 1: bad anytime she did anything outside of hanging out with him.
- 3:29Speaker 1: When he saw her next, he would ask her a
- 3:31Speaker 1: bunch of questions about who was there and what they did.
- 3:34Speaker 1: It was honestly starting to feel a little bit suffocating.
- 3:38Speaker 1: Justine would confide in Brandon's girlfriend, Lindsey Morris about their troubles,
- 3:43Speaker 1: and was even quoted as saying she was worried if
- 3:46Speaker 1: she ever broke up with him that he wouldn't ever
- 3:48Speaker 1: really let her go. Justine believed that part of the
- 3:52Speaker 1: issues in her relationship was Danny's friendship with Brandon. She
- 3:57Speaker 1: knew that he had cheated on his own girlfriend and
- 3:59Speaker 1: didn't feel like he was a very good person or
- 4:02Speaker 1: a good influence on that matter. Danny and Brandon would
- 4:06Speaker 1: lose touch for about a year as a result, but
- 4:09Speaker 1: in two thousand and two the boys would reconnect and
- 4:12Speaker 1: actually ended up moving in together. Danny had graduated and
- 4:16Speaker 1: he needed to get his own place, and because of
- 4:19Speaker 1: the trouble with Justine, he couldn't always rely on being
- 4:22Speaker 1: at her house. The tensions became quite high between Justine, Danny,
- 4:27Speaker 1: and Brandon. Brandon openly hated Justine, calling her a whore.
- 4:32Speaker 1: He thought of her as a thorn in his friendship
- 4:35Speaker 1: with Danny. By April of two thousand and three, things
- 4:39Speaker 1: had reached ahead during a spring break trip to Florida
- 4:42Speaker 1: and April, Justine had met someone she really liked. He
- 4:46Speaker 1: was a Navy seal in Pensacola, and if anything, the
- 4:49Speaker 1: meeting opened her eyes even more to the problems that
- 4:52Speaker 1: she was facing with Danny. Nothing happened between the two
- 4:55Speaker 1: of them, but she was very unhappy in her relationship.
- 4:59Speaker 1: Justine would tell her friends about the Navy seal guy,
- 5:02Speaker 1: how she thought he was cute and that she would
- 5:04Speaker 1: like to spend more time with him, but again, leaving
- 5:07Speaker 1: a relationship that is controlling is hard and not to
- 5:11Speaker 1: mention statistically dangerous. Rumors began to spread and Danny became
- 5:16Speaker 1: obsessed with the fact that Justine must be cheating on him.
- 5:21Speaker 1: While at a party at Danny and Brandon's house, Justine
- 5:24Speaker 1: and Lindsey had a major heart to heart on the
- 5:26Speaker 1: front porch. They both felt like they deserved better in
- 5:30Speaker 1: their relationships and that they had had enough. They made
- 5:33Speaker 1: a pack to break up with the boys, which brings
- 5:36Speaker 1: us back to the start of our story. The next morning,
- 5:40Speaker 1: September two, when Justine's mother went into her room to
- 5:43Speaker 1: say goodbye before she left for work, she found that
- 5:46Speaker 1: she wasn't in her bed. In fact, the front door
- 5:49Speaker 1: was unlocked and Justine's truck was gone. Many searches would
- 5:54Speaker 1: be held for Justine in the community. Missing person's flyers
- 5:57Speaker 1: with a pink ribbon were hung up all over town
- 6:00Speaker 1: because pink was her favorite color, and Justine's family had
- 6:04Speaker 1: shirts and distributed them amongst everyone. They were incredibly worried
- 6:09Speaker 1: as this was not like their daughter. Danny was also
- 6:13Speaker 1: very involved with the searches and appeared to be incredibly distraught.
- 6:17Speaker 1: Investigators got their first break in the search when Justine's
- 6:21Speaker 1: truck was located at a park and ride. The doors
- 6:24Speaker 1: were locked and it appeared that she had left it
- 6:27Speaker 1: there intentionally. This was also along a very busy interstate,
- 6:32Speaker 1: so she could have gone anywhere. Did she possibly go
- 6:36Speaker 1: and meet up with this Navy seal guy? Did she
- 6:39Speaker 1: run away on her own accord, or did something horrible
- 6:42Speaker 1: happen to her. Investigators were able to track down the
- 6:45Speaker 1: Navy seal guy pretty much right away, but it became
- 6:48Speaker 1: clear quickly that he knew nothing about Justine's disappearance and
- 6:53Speaker 1: was cleared as a suspect. Police continued to search the
- 6:56Speaker 1: immediate area around the park and ride, and that is
- 6:59Speaker 1: what am named Matt Scribner came forward. He said that
- 7:03Speaker 1: a few weeks prior, while riding the trails in the
- 7:06Speaker 1: area training one of his horses, that he had come
- 7:09Speaker 1: across a freshly dug hole. He thought it was strange,
- 7:13Speaker 1: but at the time he didn't think anything of it.
- 7:17Speaker 1: It's not until he saw investigators in the area searching
- 7:20Speaker 1: for Justine that something clicked for him and that the
- 7:23Speaker 1: two things could possibly be involved. But when he had
- 7:27Speaker 1: ridden back to the area, a week later where he
- 7:29Speaker 1: saw the hole. It didn't appear to be there anymore,
- 7:32Speaker 1: and he couldn't find where it was, but at least
- 7:36Speaker 1: this gave them an area to search and some people
- 7:40Speaker 1: to talk to. At just eighteen years old, Danny had
- 7:44Speaker 1: a history of run ins with the law, having been
- 7:46Speaker 1: arrested for theft and possession of stolen property. Brandon Fernandez,
- 7:51Speaker 1: at twenty one, was not much better. He was known
- 7:54Speaker 1: for his intelligence and cunning nature, and he seemed to
- 7:57Speaker 1: have a fascination with violence, often discussed harming others. He
- 8:02Speaker 1: even went as far as creating a website ranking levels
- 8:06Speaker 1: of violence, complete with images of crime scenes and dead bodies.
- 8:11Speaker 1: Truly disturbed. Like I said earlier, Danny didn't have a
- 8:15Speaker 1: great upbringing and looked up to Brandon in a way. This,
- 8:19Speaker 1: along with Brandon's hatred of Justine and Danny's controlling nature,
- 8:24Speaker 1: is likely what led to Justine's tragic murder. Danny and
- 8:28Speaker 1: Brandon were both interviewed in the early days of the investigation,
- 8:32Speaker 1: having been close with Justine, but claimed to have been
- 8:35Speaker 1: home together the evening of September first. According to Danny,
- 8:40Speaker 1: he went home after dinner at the Bandershoots and hung
- 8:43Speaker 1: out with Brandon. Police were definitely suspicious of the two
- 8:47Speaker 1: of them from the beginning because of their past experiences
- 8:50Speaker 1: with the law. Justine's friends coming forward with concerns over
- 8:54Speaker 1: Danny and reports of how controlling he tended to be
- 8:58Speaker 1: also solidified their suspicions. Brandon's girlfriend, Lindsay even reported that
- 9:04Speaker 1: he had told her if he ever wanted to kill
- 9:06Speaker 1: her that no one would find her, and while he
- 9:10Speaker 1: played this off as a joke, it was incredibly disturbing
- 9:15Speaker 1: and given that Auburn, California, where this story takes place,
- 9:19Speaker 1: is incredibly wooded and vast, that would scare me. Investigators
- 9:24Speaker 1: continued to follow up with Danny and Brandon and enlisted
- 9:28Speaker 1: the help of the FBI to do further interviews with them.
- 9:31Speaker 1: Brandon's phone had two miss calls to Justine on the
- 9:35Speaker 1: evening of September. First, he said that he had been
- 9:38Speaker 1: jet skiing with friends while Danny was at the Vanderschoots
- 9:41Speaker 1: and headed home because he wasn't feeling very well. He
- 9:44Speaker 1: said that the reason that he'd called Justine twice was
- 9:48Speaker 1: because he had gotten pulled over for running a stop
- 9:50Speaker 1: sign on the way home and meant to call his
- 9:53Speaker 1: girlfriend Lindsey and that their names are side by side
- 9:56Speaker 1: in his phone. Okay, but the boys would be caught
- 10:00Speaker 1: in their first lie. Brandon's cousin, Clayton Cole, and a
- 10:04Speaker 1: friend had actually spent the night at Danny and Brandon's
- 10:07Speaker 1: the night that Justine went missing, so they weren't home
- 10:11Speaker 1: alone hanging out together as they had previously said. Clayton
- 10:15Speaker 1: told detectives that he had seen Brandon and Danny leave
- 10:19Speaker 1: the house and that they did not come back until
- 10:21Speaker 1: much later. During their second interview with Brandon, the FBI
- 10:26Speaker 1: had some new proof up their sleeves as a result.
- 10:29Speaker 1: After this tip, Clayton was asked to call Brandon and
- 10:32Speaker 1: wear a wire, and they played that recorded call back
- 10:36Speaker 1: to Brandon. In the call, basically, it says that Clayton
- 10:40Speaker 1: is feeling guilty and that he needs to go to
- 10:42Speaker 1: the police about Justine. Brandon tells his cousin that he
- 10:46Speaker 1: can't do that because it would basically fuck up their plan.
- 10:50Speaker 1: Brandon was completely rattled by this phone call, and FBI
- 10:54Speaker 1: asked him if he had ever seen anyone die. Brandon
- 10:58Speaker 1: went completely white and hung his head, telling agents how
- 11:01Speaker 1: afraid he was of Danny and that he needed protection
- 11:05Speaker 1: before he told them anything else. He said that Danny
- 11:09Speaker 1: strangled Justine in the back of his car, and that
- 11:11Speaker 1: he had no idea Danny was going to do that.
- 11:14Speaker 1: He said that the three of them were planning on
- 11:16Speaker 1: sneaking out and stealing some marijuana from a local farm.
- 11:20Speaker 1: Apparently Danny had tapped Justine's phone and was trying to
- 11:24Speaker 1: catch her cheating, and he was planning on hurting her,
- 11:27Speaker 1: but he had no idea what it would be. That night,
- 11:30Speaker 1: he said that he had met Danny and Justine at
- 11:33Speaker 1: the park and ride around midnight, and they drove his car.
- 11:36Speaker 1: Danny was giving him directions on where to go and
- 11:39Speaker 1: when they parked, he said that Danny told him he
- 11:42Speaker 1: wanted to be alone with Justine to talk privately, so
- 11:45Speaker 1: he got out of the car and walked aways away
- 11:48Speaker 1: to give them some privacy. Brandon then said that he
- 11:52Speaker 1: heard a car horn followed by a scream and hurried
- 11:55Speaker 1: back to find Danny had strangled Justine. Brandon's statements became
- 12:00Speaker 1: more inconsistent. On the one hand, he said that he
- 12:03Speaker 1: didn't know that Danny was going to do that, but
- 12:06Speaker 1: on the other hand, he said that he was worried
- 12:08Speaker 1: about Justine and that the two missed calls on her
- 12:11Speaker 1: phone were him trying to get a hold of Danny
- 12:14Speaker 1: to stop him. But you also walked away and left
- 12:17Speaker 1: him alone with him. Nothing is adding up here. Brandon
- 12:21Speaker 1: claimed that all he had done was help Danny bury
- 12:25Speaker 1: the body. He blamed everything on Danny in fact, but
- 12:29Speaker 1: he would lead investigators to where she was buried. Truly twisted.
- 12:33Speaker 1: We'll be right back after this quick ad break, and
- 12:36Speaker 1: on September eighteenth, two thousand and three, over two weeks
- 12:40Speaker 1: after Justine had gone missing, her remains would be found,
- 12:44Speaker 1: and the grave was covered in debris to cover the
- 12:47Speaker 1: disturbed dirt, which is why Matt wasn't able to find
- 12:50Speaker 1: it again when he went back. Danny had removed Justine's
- 12:55Speaker 1: clothes before putting her in the grave and then dumped
- 12:58Speaker 1: chemicals all over her to beat up decomposition. Brandon's interview
- 13:03Speaker 1: gives even more inconsistencies to her time of death as well.
- 13:08Speaker 1: In one account that he gave, she was lifeless when
- 13:10Speaker 1: he came back to the car, and in another she
- 13:13Speaker 1: was still breathing slightly after they placed her in the grave,
- 13:17Speaker 1: and he began crying and praying for her to just
- 13:21Speaker 1: go so that it would all be over. Allegedly, Danny
- 13:25Speaker 1: told Brandon that if he told anyone, he would kill him, Lindsey,
- 13:29Speaker 1: and himself. Brandon said that he was scared and that's
- 13:33Speaker 1: why he didn't intervene. So there's just inconsistencies all over
- 13:38Speaker 1: the map. But the interview was four and a half
- 13:41Speaker 1: hours before he led investigators to where Justine was buried.
- 13:46Speaker 1: Danny and Brandon were immediately arrested for Justine's murder. The
- 13:51Speaker 1: search for her was finally over, but justice would continue
- 13:55Speaker 1: to be a fight. Danny would be interviewed again and
- 13:59Speaker 1: told detectives that he started to strangle Justine, but she
- 14:02Speaker 1: said in a fight for her life, Danny, I love you,
- 14:06Speaker 1: and that Brandon encouraged him to keep going, saying that
- 14:09Speaker 1: it was too late now and that it would already
- 14:11Speaker 1: be attempted murder. After she was placed in the grave,
- 14:16Speaker 1: they poured drain cleaner over her and Brandon poured some
- 14:19Speaker 1: down her throat. Justine's official cause of death was homicidal violence,
- 14:26Speaker 1: but her autopsy showed dirt deep with in her lungs,
- 14:29Speaker 1: indicating that she was still alive when she was buried
- 14:33Speaker 1: and had ingested some of the dirt. The Vanderschoots wanted
- 14:37Speaker 1: to avoid a lengthy and painful trial, so instead, prosecutors
- 14:41Speaker 1: offered Danny a plea deal for full information of Brandon's
- 14:45Speaker 1: involvement in exchange for a sentence of twenty five years
- 14:49Speaker 1: to life for first degree murder. This would mean that
- 14:52Speaker 1: there was a possibility of Danny being released when he
- 14:55Speaker 1: was forty five years old. Brandon Fernandez pled guilty to
- 15:00Speaker 1: second degree murder and was charged with fifteen years to life,
- 15:05Speaker 1: even though Matt Scribner's testimony indicated that there was premeditation
- 15:09Speaker 1: in Justine's murder and the grave being dug in advance. Unfortunately,
- 15:14Speaker 1: there was no way at this point to prove that
- 15:17Speaker 1: Brandon had helped Danny digget. Justine's parents, Don and Lynnette
- 15:21Speaker 1: planted many of the flowers that were given to them
- 15:23Speaker 1: through condolences outside of their daughter's bedroom window. They put
- 15:28Speaker 1: a footprint impression of her as well from when she
- 15:31Speaker 1: was small, and her favorite trees. They affectionately call it
- 15:36Speaker 1: Justine's Garden. Even though it's been almost twenty two years,
- 15:41Speaker 1: it still feels fresh for her family. A large part
- 15:45Speaker 1: of this is that they do not get to rest.
- 15:48Speaker 1: Danny and Brandon continue to apply for pearl and try
- 15:51Speaker 1: and get released early from prison. The family has been
- 15:55Speaker 1: in courts seven times to give statements since Justine's murder
- 15:59Speaker 1: to keep her killers behind bars. Her sister, Christine says
- 16:03Speaker 1: that she misses her best friend every day and feels
- 16:07Speaker 1: lost without Justine. She understands that she needs to continue
- 16:11Speaker 1: to be her sister's voice and fight for her so
- 16:13Speaker 1: that she can rest easy. Brandon was up for his
- 16:17Speaker 1: first parole in twenty seventeen, but was denied given the
- 16:21Speaker 1: victim statements of the Vanderschoots. But in twenty eighteen, California
- 16:27Speaker 1: changed their murder laws and in twenty twenty Brandon Fernandez
- 16:31Speaker 1: would file a petition to be retried as an accessory
- 16:35Speaker 1: to murder. Given this new law, this meant that anyone
- 16:38Speaker 1: who did not actually commit the crime could not be
- 16:42Speaker 1: given a life sentence, and I can only imagine the
- 16:45Speaker 1: devastation in this for Justine's family, as it's clear that
- 16:49Speaker 1: Brandon has not taken any responsibility nor does he feel
- 16:53Speaker 1: any remorse. Despite the judge denying Brandon's motion for a retrial,
- 16:59Speaker 1: that was overturned given this new law, and a trial
- 17:03Speaker 1: would need to be held proving his involvement beyond a
- 17:06Speaker 1: reasonable doubt. In May of twenty twenty four, prosecutors would
- 17:11Speaker 1: use Danny as their star witness in proving Brandon's guilt,
- 17:16Speaker 1: and it's very clear that the two played off each
- 17:18Speaker 1: other planning Justine's murder. Brandon purchased the drain cleaner that
- 17:24Speaker 1: they used to dump over her body and borrowed a
- 17:27Speaker 1: pickaxe from his parents' house to dig the grave. The
- 17:31Speaker 1: two dug the grave over several days leading up to
- 17:34Speaker 1: September first, matching the testimony of Matt Scribner having seen
- 17:37Speaker 1: the freshly dug dirt. There was additional evidence found at
- 17:42Speaker 1: Brandon's work as well, indicating his knowledge of the plan,
- 17:45Speaker 1: including the wiring device that Danny used to tap Justine's
- 17:49Speaker 1: phone and a shredded receipt for a new set of
- 17:52Speaker 1: tires from the day after her murder. Brandon's defense claimed
- 17:57Speaker 1: that Danny being the only witness was problematic because of
- 18:01Speaker 1: course he would say or do anything to increase his
- 18:04Speaker 1: chances of pearl himself one day. They claim that Danny
- 18:08Speaker 1: is the real monster, and in my opinion, They're both
- 18:11Speaker 1: absolutely heartless monsters, and my heart just aches for Justine
- 18:17Speaker 1: and her family. Justine's father, Dawn, was quoted as saying
- 18:21Speaker 1: that he fears that he may never get the full
- 18:24Speaker 1: story of what happened to his daughter from either of
- 18:27Speaker 1: her killers. Over the years, their family has heard at
- 18:30Speaker 1: least five different versions of the event. On August first,
- 18:34Speaker 1: twenty twenty four, after all evidence and testimony had been
- 18:38Speaker 1: gathered against Brandon Fernandez, he would stand trial. If his
- 18:43Speaker 1: case won, he would be able to walk free, but thankfully,
- 18:47Speaker 1: his motion was denied and the judge upheld his sentence.
- 18:52Speaker 1: In the judge's statement, he himself said that the legal
- 18:55Speaker 1: system can be very unfair to the victim's families and
- 18:58Speaker 1: survivors of crime. We see this all the time, but
- 19:02Speaker 1: I'm just really glad that somebody of this caliber is
- 19:04Speaker 1: the person to say it. Justine's family will have two
- 19:08Speaker 1: more hearings for Brandon and Danny in the next two years,
- 19:11Speaker 1: in twenty twenty seven and twenty twenty eight. They said
- 19:16Speaker 1: that they will never stop fighting for her. Their lives
- 19:20Speaker 1: just keep getting put on pause. They're never really able
- 19:23Speaker 1: to fully move forward. If there is a possibility that
- 19:26Speaker 1: either of them can get out. In the meantime, though,
- 19:30Speaker 1: they have done something very beautiful to honor Justine's memory.
- 19:35Speaker 1: In twenty twenty three, Justine's Law was passed to develop
- 19:38Speaker 1: a statewide teen dating violence prevention resource to support participating
- 19:44Speaker 1: school districts. Justine's family will tell you that there were signs,
- 19:49Speaker 1: but they thought at the time it was just a
- 19:51Speaker 1: young teenage boy acting bigger than he truly felt. It
- 19:55Speaker 1: seems harmless until after the fact, but they're hope in
- 19:59Speaker 1: creating Justine's Law is to prevent any more stories from
- 20:03Speaker 1: ending this way. Justine's mom says that her daughter visits
- 20:07Speaker 1: her as a hummingbird in her garden, coming right up
- 20:10Speaker 1: to her face, and she talks to them as a
- 20:13Speaker 1: way of bringing her comfort. And you could help Justine's
- 20:17Speaker 1: family by signing the petition to stop the release of
- 20:21Speaker 1: Danny and Brandon on their next paroles, and I will
- 20:24Speaker 1: link that for you in the show notes. And in
- 20:27Speaker 1: the meantime, I do hope that Justine's family is able
- 20:31Speaker 1: to find their piece one day and that her killers
- 20:34Speaker 1: remain behind bars. Remember that you are loved, you are wanted,
- 20:40Speaker 1: and you deserve to be here. And I will see
- 20:43Speaker 1: you next week. Truly Twisted is a proud production of
- 20:47Speaker 1: Fire Eyes Media, a woman owned and operated network. This
