- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to pick up where we left
- 0:05Speaker 1: off with the Tyler Robinson transcript from day number four
- 0:09Speaker 1: of the prelim hearing. Question. All right. After processing the
- 0:14Speaker 1: scenes there at Utah Valley University in Orem, did you
- 0:17Speaker 1: go to St. George? Answer. Yes, I did. Question. And
- 0:21Speaker 1: what was your role in St. George? Answer. My role
- 0:24Speaker 1: was overseeing the execution of the search warrant at both Mr.
- 0:27Speaker 1: Robinson's residence as well as his parents' residence. Question, we've
- 0:32Speaker 1: had testimony that Mr. Robinson was arrested there. Was he
- 0:35Speaker 1: fingerprinted and his DNA taken? Answer, they were actually taken
- 0:39Speaker 1: at the Utah County Sheriff's Office, the jail. Question, after
- 0:43Speaker 1: he was transported to Utah County? Answer, yes. Question, okay,
- 0:46Speaker 1: you said that there was, oh, and were items of
- 0:49Speaker 1: evidence collected from him after he was arrested? Answer, yes,
- 0:53Speaker 1: there was. Question, from his person, what were those things? Answer,
- 0:57Speaker 1: they were his clothing. What he was wearing at the
- 0:59Speaker 1: time of his arrest to include shirt, pants, underwear, as
- 1:03Speaker 1: well as shoes and anything that were in his pockets. Question.
- 1:07Speaker 1: Do you remember what top he had on? Answer. I
- 1:09Speaker 1: believe it was a maroon top. Question. And was there
- 1:12Speaker 1: any other top layer that was collected that you recall? Answer.
- 1:16Speaker 1: I don't recall. Question. Okay, let's go to. You said
- 1:19Speaker 1: that there were a couple of homes that were searched there.
- 1:22Speaker 1: Is that right? Answer. Yes. Question. Whose home was that? Answer,
- 1:28Speaker 1: one of them was Mr. Robinson's and Mr. Twiggs, where
- 1:30Speaker 1: they resided, and the other was Robinson's parents' residence. Question,
- 1:35Speaker 1: I want to ask you about the defendant's home. Will
- 1:38Speaker 1: you describe some of the items that were collected from
- 1:40Speaker 1: that home? Answer, some items collected in that home were
- 1:44Speaker 1: a Dremel tool and its bits container, as well as
- 1:47Speaker 1: two Remington boxes of. 30- 06 ammunition, as well as. 30- 06
- 1:52Speaker 1: cartridge cases, and a handful of long guns or rifles
- 1:55Speaker 1: or revolver. as well as a burned paper. Question, all right,
- 2:00Speaker 1: I want to ask you about the clothing as well.
- 2:02Speaker 1: Was any clothing collected from the townhome? Answer, yes, there was. Question,
- 2:06Speaker 1: how about shoes? Answer, yes. Question, what kind of shoes? Answer,
- 2:12Speaker 1: two shoes were collected from the home. One was a
- 2:15Speaker 1: Converse shoe, gray in color with white laces, I believe
- 2:18Speaker 1: size 10 and a half. Then the other Converse shoe
- 2:21Speaker 1: were also gray, but they had gray laces instead. But
- 2:24Speaker 1: there were of different size that I can't remember. Question,
- 2:28Speaker 1: I think you said that you collected boxes of ammunition.
- 2:30Speaker 1: Do you remember what caliber that ammunition was? Answer, yes, sir.
- 2:34Speaker 1: A handful, but the one that I recall was. 30- 06. Question,
- 2:39Speaker 1: and you also said you found some cartridge cases. Do
- 2:41Speaker 1: you remember what caliber those cartridge cases were? Answer, yes.
- 2:46Speaker 1: Those were also. 30- 06. Question, if we can display just
- 2:50Speaker 1: to the witness Exhibit 23, do you recognize plaintiff Exhibit 23? Answer, yes,
- 2:54Speaker 1: I do. Question. And is this an accurate photograph of
- 2:59Speaker 1: the cartridge casings and some of the bullets that you found? Answer. Yes. Question.
- 3:04Speaker 1: I would move the admission of plaintiff's exhibit 23. Judge Graff. Defense. Defense.
- 3:11Speaker 1: No further objections, Your Honor. Judge Graff. All right. I'll
- 3:14Speaker 1: note the standing objections by the defense. Overrule those objections
- 3:18Speaker 1: and admit into evidence state exhibit 23. As to the publication, Mr. McBride. Answer,
- 3:25Speaker 1: I would move to publish at all three levels. Judge Graff,
- 3:28Speaker 1: all right. It's published to the courtroom. As well, it
- 3:31Speaker 1: may be broadcast via the camera. Question, as that's coming up,
- 3:36Speaker 1: where did you find these? Answer, I found these in
- 3:38Speaker 1: what we would consider the spare bedroom right next to
- 3:41Speaker 1: Tyler's bedroom on top of the safe. Question, how do
- 3:44Speaker 1: you know which bedroom was Tyler's bedroom? Answer, we determined
- 3:48Speaker 1: that based off of such documents we found in what
- 3:50Speaker 1: we believe was Tyler's bedroom, such as mail, that was
- 3:54Speaker 1: addressed to him, as well as some school documents as well. Question,
- 3:58Speaker 1: and again, will you describe the layout of the house
- 4:00Speaker 1: in that area? Answer, yeah. So this was on the
- 4:04Speaker 1: second floor as you're coming up the stairs. If you
- 4:07Speaker 1: turn left up the stairs, you're going to run into
- 4:09Speaker 1: two bedrooms, and that is on the south end of
- 4:12Speaker 1: the residence. The southeast bedroom would be Tyler's, and then
- 4:15Speaker 1: the southwest would be the spare bedroom. Again, if you
- 4:19Speaker 1: go back to the stairs and you make a right-hand turn,
- 4:22Speaker 1: That's where you're now on the north end of the residence,
- 4:25Speaker 1: and that's now Twig's bedroom. Question, and where were these
- 4:28Speaker 1: items found? Answer, these were found on the southwest, or
- 4:33Speaker 1: in the southwest bedroom, the one right next to Tyler's bedroom. Question,
- 4:37Speaker 1: and you said on top of the safe? Answer, yes. Question, okay,
- 4:41Speaker 1: all right. Will you describe what we're looking at in
- 4:44Speaker 1: Exhibit 23? Answer, Exhibit 23 are the five cartridge casings
- 4:49Speaker 1: we found on top of the safe. All were. 30- 06
- 4:52Speaker 1: Springfield caliber, and one of them had an engraving that
- 4:55Speaker 1: said test shot on it. Question, you've talked about Springfield, Remington, those. 30- 06.
- 5:02Speaker 1: Are they the same type around as was found in
- 5:04Speaker 1: the gun? Answer, yes. Question, all right. Did you find any.
- 5:08Speaker 1: 30- 06 weapons in that house? Answer, no, I did not. Question,
- 5:13Speaker 1: all right. Did you search the closet on the first floor? Answer, yes,
- 5:16Speaker 1: I did. Question, what did you find in the closet? Answer,
- 5:20Speaker 1: in the closet, we found on the ground some shooting
- 5:22Speaker 1: targets with perforations in it. As well as on the shelf,
- 5:26Speaker 1: we found a Dremel tool with a bits container. Question, alright,
- 5:30Speaker 1: a Dremel tool with bits. What's a Dremel tool? Answer,
- 5:34Speaker 1: it's basically like a handheld device where you can make
- 5:37Speaker 1: etchings or engravings on things. Question, what are bits? Answer,
- 5:42Speaker 1: bits would be, I guess, like a sharp edge or
- 5:44Speaker 1: something that would actually cause the etchings that you would
- 5:46Speaker 1: put into the tool. Question. Is this kind of like
- 5:49Speaker 1: a drill bit? Answer. Yes. Question. Okay. And what did
- 5:53Speaker 1: you do with the Dremel and the bits? Answer. We
- 5:56Speaker 1: photographed them in place, took additional pictures, packaged them, then
- 6:00Speaker 1: sent them for testing to the ATF. Question. All right.
- 6:03Speaker 1: You also mentioned targets. Were those targets photographed? Answer. Yes,
- 6:06Speaker 1: they were. Question. I want to show you on your end.
- 6:10Speaker 1: Have you reviewed plaintiff's exhibit 25 before? Answer. Yes. Question.
- 6:15Speaker 1: And is that an accurate photograph of those targets that
- 6:18Speaker 1: you found? Answer, yes. Question. I move to admission of
- 6:23Speaker 1: State Exhibit 25. Judge Graff, defense. Defense, no further objections.
- 6:28Speaker 1: Judge Graff, all right. I note the standing objection, and
- 6:30Speaker 1: those objections are overruled. Did you want to, what did
- 6:34Speaker 1: you want to do in regards to publication? Prosecution. Yes,
- 6:39Speaker 1: I'm so used to admission before publishing, I move to
- 6:41Speaker 1: publish those at all three levels. Judge Graff, all right.
- 6:44Speaker 1: Any further comment from defense? Defense, no further objections. Judge Graff,
- 6:49Speaker 1: all right. Noting the standing objections, those are overruled. State
- 6:53Speaker 1: Exhibit 25 is admitted into evidence and may be published
- 6:57Speaker 1: in the courtroom, as well as captured by the media camera. Question,
- 7:02Speaker 1: will you describe what we're looking at here? Answer, yes.
- 7:05Speaker 1: So these were shooting targets we found in the closet,
- 7:08Speaker 1: and each of them have perforations in them. Question, when
- 7:11Speaker 1: you say perforations, what do you mean? Answer, holes in them. Question,
- 7:16Speaker 1: those holes consistent. Now we have an objection by the defense. Objection,
- 7:22Speaker 1: foundation on this opinion. Judge Graff, prosecution, do you want
- 7:26Speaker 1: to weigh in upon that objection? Prosecution, no, I'll submit it.
- 7:31Speaker 1: I'll lay the foundation if the objection's sustained. Judge Graff,
- 7:35Speaker 1: I'll sustain the objection. Prosecution, all right, holes. Have you
- 7:39Speaker 1: ever shot a gun before? Answer, yes, I have. Question,
- 7:42Speaker 1: when you hit a target, what happens to the target
- 7:45Speaker 1: when it's hit with a bullet? Answer, hit with a bullet.
- 7:47Speaker 1: There's holes in there. We call those perforations because there's
- 7:51Speaker 1: an entrance as well as an exit. Question, looking at
- 7:54Speaker 1: state exhibit 25. I'm going to ask some questions that
- 7:58Speaker 1: was objected to. You said there's perforations in those. Are
- 8:01Speaker 1: those consistent with bullet holes? Answer, yes. Question, and I
- 8:05Speaker 1: would ask you to describe where those perforations are. There's
- 8:09Speaker 1: three targets here, right? Answer, yes. Question, let's look at
- 8:13Speaker 1: the far right target first. Where are the perforations in
- 8:16Speaker 1: relation to the bullseye? Answer, they're all probably within 7, 6,
- 8:19Speaker 1: and 8 ring. Question, is there a perforation up at
- 8:23Speaker 1: the upper left-hand corner of that rightmost target? Answer, yes
- 8:27Speaker 1: there is. Question, do any of those hit the bullseye? Answer, no. Question, okay.
- 8:33Speaker 1: Looking at the center target, will you describe where the
- 8:35Speaker 1: perforations are in relation to the bullseye there? Answer, it's closer,
- 8:40Speaker 1: but still not. Most of them are to the left
- 8:42Speaker 1: of the bullseye rings. I would say nine and eight. Question,
- 8:46Speaker 1: all right, and then the leftmost target, will you describe
- 8:49Speaker 1: where the perforations are there? Answer, yeah, the perforations are
- 8:52Speaker 1: actually closer to the bullseye as well, actually one being
- 8:56Speaker 1: in it. Question, okay, all right. You described also collecting
- 9:01Speaker 1: a burnt note. We can take down 25, thank you.
- 9:04Speaker 1: Will you describe where that note was found and what
- 9:07Speaker 1: it looked like to you? Answer, yeah, the burnt note
- 9:10Speaker 1: was found in the trash located in the kitchen. The
- 9:13Speaker 1: way it looked to me, it looked like, say, you're
- 9:15Speaker 1: at a campfire and someone burns paper. Question, what was
- 9:19Speaker 1: done with that? Answer, that was also collected and that
- 9:22Speaker 1: was sent to the FBI for analysis. Question, was it photographed? Answer, yes,
- 9:26Speaker 1: it was. Question, and have you reviewed State Exhibit 24? Answer, yes. Question,
- 9:33Speaker 1: is that a photograph of the note? Answer, yes. Question,
- 9:36Speaker 1: I moved the admission of Plaintiff Exhibit 24. Judge Graff,
- 9:42Speaker 1: any objections? Defense, no further objections. Judge Graff, all right,
- 9:46Speaker 1: in publication. Prosecution, I move to publish at all three levels.
- 9:51Speaker 1: Judge Graff, okay, I'm going to note the standing objection
- 9:54Speaker 1: by defense, overrule those objections, and state exhibit 24 is
- 9:58Speaker 1: admitted into evidence. and may be published in the courtroom
- 10:02Speaker 1: and may be captured by the media camera. Question by
- 10:05Speaker 1: the prosecution, do you see here on the screen Plaintiff
- 10:08Speaker 1: Exhibit 24? Answer, yes, I do. Question, it looks like
- 10:12Speaker 1: as to the evidence tag, it's actually upside down. Is
- 10:15Speaker 1: that right? Answer, yes. Question, Does it look like there's
- 10:18Speaker 1: any writing on that note, on that burnt paper? Answer, yes. Question,
- 10:23Speaker 1: will you point out for the judge where the writing is? Answer, yeah. Question,
- 10:27Speaker 1: and describe what you're pointing at, kind of the general
- 10:29Speaker 1: location on the image. Answer, so the part I'm pointing
- 10:33Speaker 1: out is the paper that you can still see the
- 10:35Speaker 1: lines in them and some handwriting as well to the
- 10:38Speaker 1: left edge of that piece of paper. Question, all right.
- 10:41Speaker 1: Have you also observed the image of a note that
- 10:43Speaker 1: was recovered from Lance Twigg's phone? Answer, yes. Question, I'd
- 10:48Speaker 1: like to show you side-by-side Exhibit 24. And there on
- 10:51Speaker 1: the left, you see Exhibit. See Exhibit 24, do you see? Answer, yes,
- 10:56Speaker 1: I do. Question, and on the right, you see, excuse me,
- 10:59Speaker 1: on the right, it's 24. On the left, it's 16.
- 11:02Speaker 1: Judge Graff, let me stop you, Prosecution. I'm not sure.
- 11:05Speaker 1: Is this being broadcast? Prosecution, let's take that down. Judge Graff,
- 11:11Speaker 1: all right. Prosecution, Exhibit 24. Thank you, Your Honor. Excuse me,
- 11:16Speaker 1: Exhibit 16.3. I would move to publish Exhibit 16-3 and
- 11:20Speaker 1: 24 side-by-side. I think they're currently on the council monitors.
- 11:25Speaker 1: Judge Graff, so 16.3 has already been admitted. Defense, without electronic. Prosecution,
- 11:33Speaker 1: and I don't remember the court's order. If this was
- 11:35Speaker 1: to be captured by electronic media or not. Judge Graff,
- 11:39Speaker 1: it was not. Prosecution, okay. Judge Graff, does that comport
- 11:42Speaker 1: with the defense's memory? Defense, it does. Judge Graff, all right,
- 11:46Speaker 1: so 16.3 was published to the courtroom, but not captured
- 11:49Speaker 1: by the media. Prosecution, very well. Judge Graff, and what's
- 11:56Speaker 1: your request? Prosecution, to comply with the court's order. Judge Graff,
- 12:00Speaker 1: all right, so 16.3 and Exhibit 24 may be published
- 12:05Speaker 1: only side-by-side to the courtroom itself, but not to be
- 12:07Speaker 1: captured by the camera. Also acknowledging that the magistrate can
- 12:12Speaker 1: weigh the evidence is not weighing in on his evidence.
- 12:15Speaker 1: solely admitting it. Well, it's already been admitted, but as
- 12:18Speaker 1: it relates to the testimony, the court is going to
- 12:21Speaker 1: overrule the objection and allow the testimony to be given. Again,
- 12:24Speaker 1: whether the court accepts or doesn't accept that will be
- 12:27Speaker 1: a determination made when determining probable cause. Question. By the prosecution,
- 12:34Speaker 1: do you see any consistencies that you're able? Inaudible. Did
- 12:38Speaker 1: you also collect the defendant's car? Answer. Yes. Question. Where
- 12:42Speaker 1: did you collect that from? Answer. No. That was collected
- 12:45Speaker 1: from Robinson's parents' home. Question, and will you describe that vehicle? Answer, yeah.
- 12:49Speaker 1: The vehicle is, say, a gray-colored Dodge Challenger. All right, folks,
- 12:54Speaker 1: we're going to wrap up right here. And in the
- 12:55Speaker 1: next episode dealing with the topic, we're going to pick
- 12:57Speaker 1: up where we left off. All the information that goes
- 13:01Speaker 1: with this episode can be found in the description box.
