- 0:00[SPEAKER_00]: The liberal globalist order is on its brink and awakening a new conservative age.
- 0:06[SPEAKER_00]: On Dr. Steve Turley, join me every day as we discover answers to today's toughest challenges and explore the re-bondalization of conservative civilization.
- 0:18[SPEAKER_00]: This is Turley Talks.
- 0:21[SPEAKER_00]: Again, it's me, Dr. Steve.
- 0:23[SPEAKER_00]: Coming to you from the beautiful Hudson Valley and upstate New York
- 0:29[SPEAKER_00]: vacation is, you know, we've been working really hard with international classical school movements throughout the world.
- 0:36[SPEAKER_00]: That's re-awakening, conservative Christian civilization.
- 0:40[SPEAKER_00]: And so now, you know, it's time for me to get a little rest and relaxation here, but I just had to comment on the, well, frankly, the one to gut punch that we all just got from.
- 0:51[SPEAKER_00]: The supposedly conservative justices Robertson Barrett on the Supreme Court, I'm sure, most of you have heard by now as of this morning.
- 1:00[SPEAKER_00]: The court has indeed struck down President Trump's executive order on birthright citizenship and that abysmal decision followed yesterday's blow to election integrity, where the same two justices joined the three liberal idiots to allow mail-in ballots to be counted days after election day.
- 1:19[SPEAKER_00]: So let's take each and turn.
- 1:21[SPEAKER_00]: So you might call President Trump on January 20th of 2025.
- 1:26[SPEAKER_00]: It's very first day back in office.
- 1:28[SPEAKER_00]: He directed federal agencies through an E.O.
- 1:31[SPEAKER_00]: Not to recognize the citizenship of Babies born in the United States if either parent was illegal.
- 1:40[SPEAKER_00]: The administration's argument was very straightforward.
- 1:42[SPEAKER_00]: The 14th Amendment says citizenship belongs to persons born or naturalized in the United States and subject to the jurisdiction thereof.
- 1:52[SPEAKER_00]: So, it's those last six words, I mean, they're not decoration, right?
- 1:57[SPEAKER_00]: All children born in the United States to parents who were not under the jurisdiction of this nation, like an ambassador or a diplomat or like a children of tribal Indians.
- 2:09[SPEAKER_00]: Their children are born in the United States are not recognized as United States citizens and neither should illegal migrants who are by definition still under the jurisdiction of their own countries of origin.
- 2:24[SPEAKER_00]: But somehow, some way, the two supposed conservative justices, both nominated by Republican
- 2:40[SPEAKER_00]: That's just infested modern jurisprudence, and they've ruled that children born to illegales inside the country are indeed automatically poof automatically U.S. citizens.
- 2:50[SPEAKER_00]: Even my name's Jake Jonathan Terley, the law professor, who's not a conservative.
- 2:56[SPEAKER_00]: He says that this constitutional interpretation is utterly insane, was exact words or it's perfectly insane.
- 3:03[SPEAKER_00]: And he thinks this is going to force us to try to ultimately pass a constitutional amendment
- 3:09[SPEAKER_00]: permanently defines the jurisdiction clause as excluding children of illegal migrants.
- 3:17[SPEAKER_00]: Now, the good news is that the border is shut because of the very policies that were instituted on that very day, January 20, 2025, the same day President Trump issued his executive order.
- 3:30[SPEAKER_00]: Since that day, there has been zero illegal border crossings.
- 3:34[SPEAKER_00]: Zero, that's not an exaggeration.
- 3:39[SPEAKER_00]: The anchor baby strategy that's tied to this birthright citizenship is officially dead.
- 3:45[SPEAKER_00]: So an illegal alien parent is absolutely still subject to deportation even if their child's a US citizen.
- 3:52[SPEAKER_00]: Courts have upheld that for 50 years.
- 3:54[SPEAKER_00]: Having a US citizen child is not the equivalent of getting a visa.
- 3:58[SPEAKER_00]: A US citizen child cannot petition for a parent's green card until the child turns 21.
- 4:10[SPEAKER_00]: doesn't legally attach, if the parent is deported before the child can petition for them a child turning 21.
- 4:20[SPEAKER_00]: If the parents deported, they have two choices.
- 4:22[SPEAKER_00]: They could leave the child here with US-based relatives, or they can take the child with them.
- 4:26[SPEAKER_00]: Technically speaking, the child is not being deported.
- 4:29[SPEAKER_00]: The parent simply chooses to bring them in their deportation.
- 4:33[SPEAKER_00]: And under Trump's current enforcement posture,
- 4:36[SPEAKER_00]: The prosecutorial discretion as it's been called, that's where ICE would previously deprioritize parents of citizen children like they did under the Biden administration.
- 4:46[SPEAKER_00]: That's dead.
- 4:47[SPEAKER_00]: That's gone.
- 4:47[SPEAKER_00]: And it will be gone for the next few years.
- 4:51[SPEAKER_00]: But all of that said, this decision this morning, as well as the blow to election integrity yesterday, are two very painful reminders that Roberts and Barrett are not
- 5:04[SPEAKER_00]: Conservatives, they are not constitutional originalists like Thomas and Alito and Gorsuch and Cavalinal, Cavalinal's got much more originalists actually as time's going on.
- 5:14[SPEAKER_00]: Roberts and Barrett are not originalists.
- 5:18[SPEAKER_00]: They are institutionalists.
- 5:19[SPEAKER_00]: That's a very important distinction to get.
- 5:21[SPEAKER_00]: They are not originalists.
- 5:22[SPEAKER_00]: They are institutionalists.
- 5:24[SPEAKER_00]: They care more about the court's reputation than they do about fidelity to the constitution.
- 5:29[SPEAKER_00]: They care more about avoiding political controversy.
- 5:33[SPEAKER_00]: than deciding in favor of our constitutional republic.
- 5:38[SPEAKER_00]: So when you've got the other justices in default cases running home to their judicial philosophy, either on the left or the right, Robertson Barrett run home to stability.
- 5:49[SPEAKER_00]: And that's not textualism, that's judicial, timidity, dressed up in constitutional robes.
- 5:55[SPEAKER_00]: And that's exactly what we're going to have to fight against when a republican president
- 6:01[SPEAKER_00]: the next Supreme Court justice.
- 6:03[SPEAKER_00]: The smell test is no longer constitutional originalism.
- 6:07[SPEAKER_00]: The smell test is whether they're institutionalists, whether they're going to allow their devotion to the court's reputation overrule.
- 6:16[SPEAKER_00]: They're supposed to commitment to constitutional originalism.
- 6:20[SPEAKER_00]: And we saw, we frankly saw the same thing yesterday with their blow to election integrity.
- 6:26[SPEAKER_00]: And all of that forces us to ask, what do we do?
- 6:29[SPEAKER_00]: What decisive actions can we take to finally resolve this judicial insanity?
- 6:35[SPEAKER_00]: And that is exactly what we're about to find out.
- 6:39[SPEAKER_00]: I know you keep telling yourself at some point in the future you're going to buy and store away a few dozen gallons of water just in case an emergency hits your family and the water shuts off.
- 6:49[SPEAKER_00]: We've all experienced it, you know, the storm hits, the faucet stops working and we're left wondering how long it's going to be before we have drinking water again.
- 6:59[SPEAKER_00]: Every time it happens, we kick ourselves for not being more prepared.
- 7:03[SPEAKER_00]: Well, here is an easy step that you can take the cost less than a dinner out.
- 7:08[SPEAKER_00]: It's called the Pure Water Strawl, and it can clean an entire year of water for you.
- 7:14[SPEAKER_00]: It's absolutely amazing.
- 7:15[SPEAKER_00]: It's the perfect emergency tool.
- 7:17[SPEAKER_00]: for making sure your family always has clean water through a disaster.
- 7:22[SPEAKER_00]: So I got a little bit of some dirty water here as it were.
- 7:27[SPEAKER_00]: And what you do is you just take it out and you take the top off.
- 7:33[SPEAKER_00]: And then what you can do is you can drink from any water source no matter how dirty check this out.
- 7:47[SPEAKER_00]: I can't, I can't do not, it tastes just like water, this is, this is coffee, obviously.
- 7:57[SPEAKER_00]: I don't taste the coffee, it's just water, I mean, this is, this is amazing.
- 8:05[SPEAKER_00]: The pure water straw allows you to drink from literally any water source, from the pond.
- 8:12[SPEAKER_00]: from the mud puddle, the bucket that caught the rainwater, even I kid you not, even the toilet.
- 8:21[SPEAKER_00]: The pure water straw instantly cleans out bacteria, pathogens, and debris, and purifies the water.
- 8:27[SPEAKER_00]: So you can drink clean water from any source without worrying about you can your guts out.
- 8:33[SPEAKER_00]: We have these in our home.
- 8:35[SPEAKER_00]: We got him in our cars, we've got him in our go bags or emergency responders actually recommend having one of these on hand for every member of your household.
- 8:45[SPEAKER_00]: They store well in their sealed bag.
- 8:47[SPEAKER_00]: It's a tool your family will be able to count on for years to come now.
- 8:51[SPEAKER_00]: If it take out meal is more important than a year of clean water for your family, well then obviously the pure water straw isn't for you, but if you know how important clean water is and understand how quickly a disaster can change everything, then getting a few of these pure water straws is a no brainer.
- 9:11[SPEAKER_00]: It's the most logical next step, both for your
- 9:13[SPEAKER_00]: piece of mine, but also from an investment price standpoint, because normally these are $45 each, but today the makers Sierra Madre need to make some space in their Wisconsin warehouse.
- 9:26[SPEAKER_00]: So they're marking these guys down over 60% with free shipping to boot.
- 9:32[SPEAKER_00]: Click the link in the description below and grab yours today so your family's ready for the next crisis or disaster.
- 9:39[SPEAKER_00]: You won't regret it.
- 9:39[SPEAKER_00]: Click on that link below right now.
- 9:43[SPEAKER_00]: So yesterday in a five to four decision, Justice Barrett joined by Roberts and the three liberal justices upheld.
- 9:51[SPEAKER_00]: A Mississippi Law, allowing mailing ballots postmarked by election day to be received and counted up to five days later, 14 states all blue states have similar laws.
- 10:03[SPEAKER_00]: And Barrett wrote that federal law specifies that a vote must be cast, but not when a ballot must be received.
- 10:11[SPEAKER_00]: So, therefore, states can set up their own receipt deadlines.
- 10:15[SPEAKER_00]: Now, Justice Alito, who's joined by Thomas, of course, a concommodal.
- 10:18[SPEAKER_00]: They wrote a scorching descent, pointing out that election day is a specified date, not a span of multiple dates.
- 10:27[SPEAKER_00]: the election day statutes require that federal elections occur on that date, but if the collection of ballots continue for days on and afterward, like they did in Mississippi here, the elections not held until the end of that period.
- 10:42[SPEAKER_00]: So there was not an election day.
- 10:45[SPEAKER_00]: There were defector election days, which contradicts the statute designating a single day for the election.
- 10:51[SPEAKER_00]: That's not spin.
- 10:52[SPEAKER_00]: That's the plain reading of the statute.
- 10:55[SPEAKER_00]: federal law designates the first Tuesday of November as election day, not election week, not election month, right?
- 11:03[SPEAKER_00]: Congress sets the date one day, and now this five to four decision allows states to shred that deadline by simply calling the extended counting period something other than the election.
- 11:16[SPEAKER_00]: And if it's California, you could literally be counting for months on and after the federally mandated date.
- 11:25[SPEAKER_00]: Now, Robertson Barrett are effectively saying that the federal government could set the date, but there's nothing that constitutionally mandate how state legislatures have to honor it.
- 11:39[SPEAKER_00]: And the irony here is beyond oblivious, I guess, to them.
- 11:43[SPEAKER_00]: When it came to birthright citizenship, a question of the executive power over immigration that the federal government gives to the president,
- 11:51[SPEAKER_00]: They were willing to override the president by refusing to read the text as originally intended by the framers.
- 11:57[SPEAKER_00]: But when it comes to an election integrity in a clear federal statute, well, suddenly, you know, it's all about supposedly what the constitution originally mandate and it was never the actual outwork.
- 12:09[SPEAKER_00]: So you can't have it both ways.
- 12:10[SPEAKER_00]: Either the court reads texts, honestly, and applies them, or it differs.
- 12:15[SPEAKER_00]: Robert and Barrett chose deferral when it inconveniences conservatives and activism when it inconveniences the left.
- 12:23[SPEAKER_00]: That's not judicial philosophy.
- 12:25[SPEAKER_00]: That's a pattern.
- 12:27[SPEAKER_00]: they're institutionalists and they see as their job the responsibility of supposedly balancing the court so that the right doesn't get too much of it wants and the left doesn't get too much of what it wants.
- 12:40[SPEAKER_00]: So they're actively obstructing constitutional originalism at least when it comes to decisions like this.
- 12:47[SPEAKER_00]: So bottom line moving forward.
- 12:50[SPEAKER_00]: We now know exactly what we need to prevent in the next Supreme Court appointments.
- 12:55[SPEAKER_00]: We're slowly getting rid of the Senate rhinos, and the national trajectory is clearly moving in the conservative direction.
- 13:03[SPEAKER_00]: So enough of these institutionalists across the board, we need faithful, unapologetic, originalists.
- 13:11[SPEAKER_00]: So that's number one.
- 13:13[SPEAKER_00]: Secondly, the more red the country gets, the more red states accumulate, the easier it's gonna be for us to pass constitutional amendments.
- 13:23[SPEAKER_00]: And that's in the end, really what we're gonna have to do to push back against the court.
- 13:27[SPEAKER_00]: The left could talk about stacking them, packing the court all they want.
- 13:31[SPEAKER_00]: They're losing political geography.
- 13:35[SPEAKER_00]: To ratify constitutional amendment, 38 out of the 50 states have to approve it.
- 13:39[SPEAKER_00]: That's three-force.
- 13:41[SPEAKER_00]: And you actually only need 34 states to hold an article five constitutional convention that bypasses Congress in the proposal of constitutional amendment.
- 13:50[SPEAKER_00]: And the simple fact is Republicans quickly controlling more and more and more state legislature.
- 13:55[SPEAKER_00]: We're getting very close right now we're at 28 state legislatures that we're controlling.
- 14:01[SPEAKER_00]: And to only go into continued to grow.
- 14:03[SPEAKER_00]: with the voter registration crisis, the Democrats are facing.
- 14:07[SPEAKER_00]: So we're just four or five states away from being able to actually call an Article 5 constitutional convention and rectify this nonsense.
- 14:15[SPEAKER_00]: So I think in the end what all of this means is that today's scotus ruling on birthright citizenship is really actually a clarion call for the Article 5 movement.
- 14:26[SPEAKER_00]: If the court won't read the Constitution honestly, then we, the people, can rewrite the relevant clauses.
- 14:33[SPEAKER_00]: And Republicans are closer to having the state level power to do that than at any other point in modern history.
- 14:40[SPEAKER_00]: And then in the meantime, yeah, we got to push the Senate to pass the save act, which would require proof of citizenship, it would restrict mail-in ballots, it would do the job the courts telling the legislature to do.
- 14:53[SPEAKER_00]: The court just told us they're not going to rewrite this statute.
- 14:58[SPEAKER_00]: You have to do that and so we should say fine.
- 15:00[SPEAKER_00]: We will rewrite it in such a way that guarantees election integrity for this way forward.
- 15:06[SPEAKER_00]: But bottom line, the court failed the country, bottom line.
- 15:10[SPEAKER_00]: They put their own institutionalism in front of what's best for the nation and what's most faithful to the Constitution So it's our job to keep going to keep fighting and yes, ultimately we most certainly and then we'll inevitably win So what are you guys think I want to hear it in the comments below?
- 15:30[SPEAKER_00]: I know we tend to try to be as optimistic as possible by hanging you know we got to call the shots and we got
