SPEAKER_00: Hundaf Lamitas, we're gonna start three lines from the top of Lamethas Malayh, where we left off yesterday with the word Itmar.
• 0:07
SPEAKER_00: And this is a new suya, but coming off the relation, how we're we're getting into the suya right now is basically the mission we started yesterday where we saw the concept of someone who's Shoichid La Ava Diskad.
• 0:18
SPEAKER_00: He's a yedi shechting with good intentions, etc.
• 0:20
SPEAKER_00: But he had a guy that owned the animal he was shachting for, and that guy didn't have the best kavana.
• 0:25
SPEAKER_00: So we saw before, we had him we explained uh what shot in the three-way machikas we had in the Mishnah.
• 0:31
SPEAKER_00: Uh we discussed Zemhashav Ze Oyvid.
• 0:34
  SPEAKER_00: Um, could that be?
• 0:35
SPEAKER_00: Meaning, could you effectuate uh soul based on your maqshavah if you're not the one doing the avoidah you're just a bilim.
• 0:41
SPEAKER_00: And um with that, we're gonna not talk about anymore Zemhashav Zhe Uyvade, but the other prat we were really talking about, which is uh machashvin me avoid la voidah.
• 0:52
SPEAKER_00: If you have a maqshava psula by one avoid, can it transfer on about a different avaida?
• 0:56
SPEAKER_00: So while you're doing one avaida, avoida A, you have Mahshava Psula about Avoida B.
• 1:00
SPEAKER_00: Can that work or no?
• 1:01
SPEAKER_00: In order to possibly, you actually have to have the maqshava during Avaida B.
• 1:05
SPEAKER_00: During that actual Avaida that you're having it, and with that, Zokht the Yamora.
• 1:08
SPEAKER_00: It's Ma' Rashekit esa behema lizrik doma lavadaskayhavim.
• 1:12
  SPEAKER_00: Ulahatir khaballa diskhavim.
• 1:14
SPEAKER_00: So this guy, he's shafting uh animal.
• 1:16
SPEAKER_00: This is Khulin, we're not talking about Kojim, and he's a yid, and this time it's not that he's doing it for a goid, then the guy's the bad guy.
• 1:23
SPEAKER_00: No, this guy's the bad guy, he's not the best yid in the world because he's shachting the behema, and his cavana was to do the zrika on the dam for the Avadis Khavim for Abbasara.
• 1:31
SPEAKER_00: He was a yid that's having in mind he's gonna do zrika for Abbas Khavim, or to be Mahakti the fats for Ava de Zara.
• 1:37
SPEAKER_00: So in this case, what happened again?
• 1:39
SPEAKER_00: So this is obviously Machash and La Vedaveda.
• 1:41
SPEAKER_00: That's gonna be the question because he's having this maqshava and this maqshava of Avaidazara, which would obviously passle up if we consider it to effectuate what he's doing, then it's gonna be considered Takruvasaved Zara, right?
• 1:52
SPEAKER_00: If he if he uh whatever he used and he's um has had a government for Ava Desara, that would be Asurahana, actually, it would be considered tikravisaved ezar.
• 2:02
SPEAKER_00: So, do does it make a difference basically?
• 2:05
SPEAKER_00: Because he we're trying to understand, he did a good shaita.
• 2:08
SPEAKER_00: This shaitha, if you look at it physically, it was a very good shrita, and therefore maybe you should be able to eat the animal.
• 2:12
SPEAKER_00: The only problem is he had a machava psula.
• 2:13
SPEAKER_00: He had a machava specifically of the zara.
• 2:16
SPEAKER_00: But the mahshavas of desira was not about the shaita, it was about later on.
• 2:19
SPEAKER_00: I'm shafting this right now, kitikuna, very good.
• 2:21
SPEAKER_00: I'm having in mind that later on when I do this rika that dam, I'm gonna do it for Ava Dazara.
• 2:25
SPEAKER_00: Is that gonna affect you?
• 2:26
SPEAKER_00: Is that gonna passle this up or not?
• 2:27
SPEAKER_00: It's my shit, isabah is coming.
• 2:36
SPEAKER_00: It's gonna be completely meltar, no problem, you could eat it.
• 2:38
  SPEAKER_00: Why?
• 2:38
SPEAKER_00: Rabbichnapsa Rebekn says, Pasu machashun may have.
• 2:41
SPEAKER_00: First of all, you can have a maqshava by one Avaidah about a different Avaidah, and it's going to take effect.
• 2:47
  SPEAKER_00: It's gonna be halal.
• 2:48
SPEAKER_00: Therefore, so too over here.
• 2:48
SPEAKER_00: Your maqshava of Avahazara was during the shaitha about the Zrika.
• 2:53
SPEAKER_00: So or about to be uh uh the Akara Sa Halovim.
• 2:56
SPEAKER_00: So the point is that you're having the Maqshava by the Shita and it's still going to effectuate about later on, machashun Avaidah Avaidah, and therefore it's gonna be a problem.
• 3:05
SPEAKER_00: And by the way, also Rubiachlan says another thing you another prat you need over here, the Alfin of Chutzmi Phnim.
• 3:11
SPEAKER_00: We learn chutz from phnim, as we saw yesterday.
• 3:13
  SPEAKER_00: Chutz is regular chulin.
• 3:15
SPEAKER_00: Phnim is obviously all qhotchim.
• 3:17
SPEAKER_00: And this idea that we could have a maqshava paisellis, machajun me avaida la vaida, where it only works if we learn that you're gonna have this psu biklal from qhshim, because by qashim you have these types of uh maqshavas poisless the the karma.
• 3:30
SPEAKER_00: If you have the wrong maqshava, it's gonna passle it up.
• 3:32
SPEAKER_00: So, too by chulin, you're gonna have this concept of the maqshava passling up the karma.
• 3:36
SPEAKER_00: So, first of all, ma'huna avaida alavaida.
• 3:38
SPEAKER_00: Your mahshava ha paiselis doesn't have to specifically be a b during the avoida you thought about.
• 3:42
SPEAKER_00: It could be by a different one.
• 3:43
SPEAKER_00: So that's why even if you had the maqshava during the shiit, it's gonna effectuate and passelate, even though it was about the zrik or about the akhtara.
• 3:49
SPEAKER_00: And also, even though this is chulin, it's still gonna be a problem because Mal Yalfina and Chutzmipni.
• 3:53
SPEAKER_00: Rishlakish goes 180 degrees the other way.
• 3:55
  SPEAKER_00: Rishlakish Amar Muteras.
• 3:57
SPEAKER_00: It's gonna be completely mutter.
• 3:58
SPEAKER_00: Ah, you had in mind the void is Zara, you're a terrible guy.
• 4:01
SPEAKER_00: How are you gonna be able to eat this meat?
• 4:02
SPEAKER_00: You know, you know, want to know why?
• 4:03
SPEAKER_00: Because it was a kosher shita.
• 4:04
SPEAKER_00: Ah, you had a maqshava during your shritah about the zriqa.
• 4:06
SPEAKER_00: Yeah, but ain't mah mechaj me'a by the lavaida.
• 4:08
SPEAKER_00: You can't have a maqshava during the shitah that's gonna effectuate something about the zrika.
• 4:13
SPEAKER_00: Meaning you're a bad guy, but in the end of the day, it didn't hassle up what you're doing right now.
• 4:16
SPEAKER_00: It didn't hassle up the shaita.
• 4:17
SPEAKER_00: The shit is a good shait, it's kosher, you're gonna be able to eat it.
• 4:19
SPEAKER_00: And also, we don't learn chutz from phim.
• 4:22
SPEAKER_00: This is chulin that's khajam, nothing to do with each other, no problem.
• 4:25
SPEAKER_00: So we have this machik between Rabbi Akh and Rish Lakesh, and says the Gemara of the Azul the Tamar.
• 4:29
  SPEAKER_00: They actually go lishitasam.
• 4:31
SPEAKER_00: Where do we see this?
• 4:31
  SPEAKER_00: The Itmar.
• 4:32
SPEAKER_00: We said it with the following.
• 4:33
  SPEAKER_00: Shukta Lishmah.
• 4:35
SPEAKER_00: Now we're talking about Khakshim.
• 4:36
SPEAKER_00: Now we're talking about someone who shachhted a karban chatas, specifically the shmah because the karman chatas had to be the shmah.
• 4:41
SPEAKER_00: So he shachted a karman chatas lishmah, lizar ignored shlai the smah, but he added cavana during the shaitha, which he did properly, he added cavana that when I do the zrika, I'm gonna do it not lishma.
• 4:52
SPEAKER_00: So is that gonna be a problem?
• 4:53
SPEAKER_00: Is it not gonna be a problem?
• 4:54
SPEAKER_00: Obviously, if during the zrika he had a mahava shlala shlala shma, it's a problem.
• 4:58
SPEAKER_00: But over here he had a mahsabah shlate smah about the zrika during the shaitha.
• 5:01
  SPEAKER_00: So that's machaj mehaveda.
• 5:03
SPEAKER_00: So Rabbiakna Marpsula, Rishla Kishra Maqsh.
• 5:08
SPEAKER_00: Rabbi Akna Marapsula, Mahajman Meh'avaid Alavaida.
• 5:10
SPEAKER_00: You could have a Mahshava Piselis during a different Avaida.
• 5:12
SPEAKER_00: So so too over here.
• 5:13
SPEAKER_00: You had a Mahshava Piseles during the Shita about the Zrika.
• 5:16
  SPEAKER_00: Problem.
• 5:16
SPEAKER_00: Vega me in a machine mi Mahshev's Pigle.
• 5:18
SPEAKER_00: Additionally, we learn from Mahshev's Pigle.
• 5:22
  SPEAKER_00: Zakterashi, what's Mahshev's pig?
• 5:23
  SPEAKER_00: Mi Mahakshev's pigle, the code me'avaidalavaida.
• 5:25
SPEAKER_00: The whole Mahakshev's pigle, the whole psoul of Mahshevas Pigel is Me'a Avaidala Vada.
• 5:30
SPEAKER_00: There's no pigle about what I'm doing right now, it should be piggle.
• 5:32
SPEAKER_00: That's not what pigle is.
• 5:32
SPEAKER_00: Pigle is that I'm gonna do something chutzlazmanah.
• 5:35
SPEAKER_00: I'm gonna do the zrika chutzlazmana.
• 5:37
SPEAKER_00: I'm gonna eat the basar chutzlazmana.
• 5:39
SPEAKER_00: So that is pigle in essence is a maqshava of avaidala vaida.
• 5:45
SPEAKER_00: You're having a maqshava pissels during one avoidah about something else that you're gonna do improperly.
• 5:49
SPEAKER_00: So pigle is inherently a maqshava, uh a maqshava me'avaidala vaida.
• 5:54
SPEAKER_00: So what about the maqshava shalai lishmah?
• 5:57
SPEAKER_00: Can you have that maqshava?
• 5:58
  SPEAKER_00: It's a different maqshava pizza, it's not pigle.
• 5:59
  SPEAKER_00: Pigle is something else.
• 6:00
SPEAKER_00: Pigle is uh chutzmana or something like that.
• 6:02
SPEAKER_00: So, what about there's other types of maqshavas that could passle up your car, but like like uh shalishmah that we're talking about right now.
• 6:08
SPEAKER_00: So, can will that be the same thing that you're going to be able to be ma'chaj me'avaidalava, and it's gonna passle it up even if you thought about a different Avaida, not the Avaida you're currently doing?
• 6:16
SPEAKER_00: So says R Biachanan, yeah.
• 6:18
SPEAKER_00: First of all, Machash and Navaidala voidah.
• 6:19
SPEAKER_00: And how do we know that?
• 6:21
SPEAKER_00: Gamina Mahakshava's pigle, because we learn it from Pigel, just like pigle in an essence inherently is always me'avidilava, so too, you're gonna have any maqshava pessaless about a different Avaida is gonna be a problem.
• 6:31
SPEAKER_00: And Rashman Lakish or Maxhay Rashman Lakaj says in this case it's gonna be kasher.
• 6:34
SPEAKER_00: Again, you had a maqshava during your shitah of this karman.
• 6:37
SPEAKER_00: It was a karman chatas.
• 6:38
SPEAKER_00: You had a mahshava during your shitah that the zrika, I'm gonna do shalishmah.
• 6:43
SPEAKER_00: So Rish Lakish says that's fine, no problem.
• 6:44
  SPEAKER_00: It's gonna be kosher.
• 6:45
  SPEAKER_00: Why?
• 6:46
  SPEAKER_00: Ain't Mechash Mahvaidala Vada, like I'm in a Mahshava's Pigel.
• 6:48
SPEAKER_00: Because there's no such thing as Mahajme Avaidala Badah we don't learn from Pigel.
• 6:51
  SPEAKER_00: Pigel's a kiddish, you're right, it's May'abada La Vida, that's a kidish.
• 6:54
SPEAKER_00: We don't learn from Pagel.
• 6:55
  SPEAKER_00: Ain't Machaj Mehvaid Alavada.
• 6:56
SPEAKER_00: You're Mahakshavashala Shma right now about the Shitha, you you you had uh Maqshava Lishma.
• 7:01
SPEAKER_00: You had a Mahakshava that you're gonna do the Zriqa Shalai Shmah, that's Mahaj Mahavida La Vadah, and that's not gonna passel it up according to Rash Lakesh.
• 7:07
  SPEAKER_00: So that's gonna sricha.
• 7:08
SPEAKER_00: And I need the machelikas between Rebeh and Rish Lakish, both by the case of Hulin that we started off with today, right?
• 7:14
SPEAKER_00: The case of Hulin where he had a maqshava during the shaitha that he's gonna do the zrika of Rabbit Zara.
• 7:19
SPEAKER_00: So does that passle up his his uh food?
• 7:21
SPEAKER_00: He can't eat it now.
• 7:22
SPEAKER_00: And we need this machelikas over here between Ishlokish by Karchum, the Karman Khatas, where we brought the idea that he's shachting it now, Lishmah, but he has in mind that he's gonna do the zrikashla Shmah.
• 7:31
SPEAKER_00: Why do I need the machlakas by both?
• 7:32
SPEAKER_00: It would seem to be some very similar.
• 7:33
SPEAKER_00: So it's my idea, but I only said that by the case of Hulin, the Hokkaram Arishlakesh or Shemin Men Lakesh Mishum dichutzmi pnim laofina.
• 7:40
SPEAKER_00: I would think maybe Rishlakish only says that it's gonna be mutter over there.
• 7:43
  SPEAKER_00: Why?
• 7:43
SPEAKER_00: Because it's chulin, and chutzmi pnim laofinah we don't learn chutz.
• 7:48
  SPEAKER_00: And therefore it's chulin.
• 7:48
SPEAKER_00: I don't care what you ate, what maqshava you had, not gonna be a problem.
• 7:53
SPEAKER_00: But in the second machlikas where the whole case was karchem itself, it was a karmal chatas.
• 7:58
  SPEAKER_00: It's pnim mi pnim.
• 7:59
  SPEAKER_00: What's pnim pne pnim?
• 8:01
SPEAKER_00: It's uh it's a karma chatas from uh case of pigle.
• 8:04
SPEAKER_00: We're trying to see if maqshava shalashmah by karmel chatas can be learnt from pigl by any karma.
• 8:09
  SPEAKER_00: Maqshava pigl.
• 8:10
  SPEAKER_00: That's me'avoidalava.
• 8:11
  SPEAKER_00: So too.
• 8:12
SPEAKER_00: If you have maqshava shalishma, me'avoid lava, is that gonna be a problem?
• 8:15
SPEAKER_00: So maybe p'nimi pnim, then aimajal bakhana, maybe he's gonna be majatarbiachna.
• 8:19
SPEAKER_00: Maybe he only said his allah bayhulin if you didn't tell me both.
• 8:22
SPEAKER_00: Maybe he only said his allochabi chulin.
• 8:23
SPEAKER_00: You don't learn chutzmi pnim, so I don't care about your maqshabas.
• 8:25
SPEAKER_00: Whereas by the case of the karman chatas, that's already khakshim.
• 8:28
SPEAKER_00: Khajim, we do learn pnim i pnim, and therefore your maqshava's gonna be a problem, even if it was may of it, even if it was about something else.
• 8:34
SPEAKER_00: If I only said the machist between the second case, by the case of the karmic chatas, by khajchim, the a he com Rabi'achan.
• 8:41
  SPEAKER_00: Again, now the opposite.
• 8:42
SPEAKER_00: I would think maybe only over there Rubi Akhan says it's gonna be possible.
• 8:45
  SPEAKER_00: Why?
• 8:45
SPEAKER_00: Because it's uh khajim, and we learn p'em Abu Bhaba by the case of Khulin, ain' aimed shim and minlakish.
• 8:52
SPEAKER_00: Maybe you should agree to Rishlakish that it's gonna be fine.
• 8:54
  SPEAKER_00: Why?
• 8:54
SPEAKER_00: Because the Ain Yalfin and Chutzmi Pnim, because we don't learn chutz from him.
• 8:57
SPEAKER_00: So that's why I needed to show you that they argue make katsh, they argue across the board, and there's the machelikes, rebirn and ishlakes, both by khotchim, both by both by chulin.
• 9:08
  SPEAKER_00: Says gumar must reshish.
• 9:10
SPEAKER_00: So I'll ask you the following.
• 9:11
  SPEAKER_00: Says Rishish.
• 9:12
  SPEAKER_00: Amrbi I see.
• 9:13
SPEAKER_00: Going back to the Mishnah.
• 9:14
SPEAKER_00: So we had three sheetas in the Mishnah, and the case, and again the case in the Mishnah was you were shafting uh Oyvid Kohavim's animal for Hulin, not for Karban, obviously, and you were shafting his animal for Kulin, but he had in mind, he had in mind uh that it should be for Ava Dazar.
• 9:28
SPEAKER_00: You didn't, you're uh Tweemazdi Kayin and you shafted it properly.
• 9:31
  SPEAKER_00: Can you eat it?
• 9:31
  SPEAKER_00: Can you not?
• 9:34
  SPEAKER_00: We saw that yesterday.
• 9:35
SPEAKER_00: But either way, Rabyisi said a kabuchimer.
• 9:37
  SPEAKER_00: Kabuchimer the M.
• 9:38
SPEAKER_00: Um'abi makem shemach shabba pe selec be mukdashim, ein ha kolho lech el akara iveid.
• 9:42
SPEAKER_00: Rbyoisi was trying to prove that it's not gonna be a problem.
• 9:44
SPEAKER_00: Why is it not gonna be a problem?
• 9:46
SPEAKER_00: Because I don't care about what the Ayyvid Khachovim is thinking.
• 9:48
SPEAKER_00: You're the one doing the shita, all I care about is what you're thinking.
• 9:51
SPEAKER_00: What's the words that he used to say that?
• 9:53
  SPEAKER_00: It's a kabochimer.
• 9:54
SPEAKER_00: Ma'ab machem shemshava pesas be mukdashin, eyakalekh el akara ived, ma'akh we see in a place where a maqshovah can effectuate a pso.
• 10:02
SPEAKER_00: When in a place where a maqshabh where you have a maqshovah pesales, where by khacim, that eyakalh ella akara ived, that's the only person we care about is the iveid, the coin doing the avoidah, and I don't care what the baylam is thinking.
• 10:14
SPEAKER_00: So maqumsh, in maqshava pesales, b'chulin.
• 10:17
SPEAKER_00: So in a case where maqshoba doesn't make a difference, a maqshovah there's no concept of a maqshovah passling, which is what?
• 10:21
  SPEAKER_00: Baikulin.
• 10:22
SPEAKER_00: There's no problem with maqshovah being passling.
• 10:24
SPEAKER_00: So in adventure, haqal hoyleh ella akra shaykhit.
• 10:27
SPEAKER_00: So for sure everything should go after the guy doing it, the shaykhit, the guy doing the shit.
• 10:30
SPEAKER_00: And I for sure shouldn't care about what the guy is thinking, what the Avet Muchham.
• 10:33
SPEAKER_00: If I look in a place where you have a maqshovah that could passle, by Kojin, still we only care about the guy doing the Avedah So for sure where by Hulin, where Maqshaba doesn't passle, important words, where Maqshaba doesn't passle by chulin, so for sure over there we should only care about the guy doing the shahita, and I don't care about Ayyat Kham.
• 10:49
SPEAKER_00: Say Gemara, what do we mean?
• 10:50
SPEAKER_00: What did R BIC mean?
• 10:51
  SPEAKER_00: My ain maqshabbs bekhulin.
• 10:53
SPEAKER_00: What did he mean when he said that there's no maqshabbah that passes on chulin?
• 10:56
SPEAKER_00: That by chulin, there's no such thing as maqshabah passling.
• 10:59
  SPEAKER_00: Ely madullah pasl klaw.
• 11:00
SPEAKER_00: If you're gonna tell me that's meant to be taken literally, that by chulin, I don't care about your maqshabas.
• 11:04
SPEAKER_00: Your maqshabas aren't gonna pass it.
• 11:08
  SPEAKER_00: Really?
• 11:08
SPEAKER_00: By chulin, there's no maqshava that could passle your uh animal right here?
• 11:12
  SPEAKER_00: Really?
• 11:13
  SPEAKER_00: What about Avayajovim?
• 11:14
SPEAKER_00: How do you find by shafting an animal for Ava Dazara, that obviously is Ashar?
• 11:19
  SPEAKER_00: It's considered Takravis of a Dzara.
• 11:20
SPEAKER_00: So if you shaft an animal for Ava Dazara, no matter who does it, it's a problem.
• 11:23
  SPEAKER_00: It's considered Takarbis of a Dazara.
• 11:25
SPEAKER_00: So if you're gonna tell me though that your we don't care about your maqshovah bikla by chulin, the heikhmish, so where do you find the case that it's gonna be asher because it's above a dhazara?
• 11:33
SPEAKER_00: It was only in your head.
• 11:34
SPEAKER_00: We don't care what you think.
• 11:34
SPEAKER_00: Aye, you shachti it for Abad Azar, yeah, but there's no maqshaba by chulin.
• 11:37
SPEAKER_00: Of course there's maqshab by chulin.
• 11:39
SPEAKER_00: You had a machabah to do this Aba Dzar, it's Ava Dzara.
• 11:41
  SPEAKER_00: You shachtified, it's 100% of a d'shar.
• 11:43
SPEAKER_00: So obviously we don't mean to take it literally that there's no maqshabah pay selec baichulin.
• 11:48
SPEAKER_00: Because obviously the whole concept of the karvas of a desar is mahshava paysales by chulin.
• 11:51
SPEAKER_00: It's gonna passle it up.
• 11:52
SPEAKER_00: So Allah, so must be what do we have to say there?
• 11:54
SPEAKER_00: Because he meant El Pshito Ma'a Vada La Vaidah.
• 11:57
SPEAKER_00: What did he mean when he said that there's no maqshabah pay selects in a place where the maqshabah won't passle by chulin?
• 12:04
  SPEAKER_00: What did he mean?
• 12:05
SPEAKER_00: He meant specifically, may Avoidala Avaidah it's not gonna pass by Hulin.
• 12:09
SPEAKER_00: Your Maqshaba by one Avaidah about a different available by chulin is not gonna passle.
• 12:13
SPEAKER_00: And that was his whole Kabukhaimer.
• 12:14
SPEAKER_00: This is that you read the Kabukimer.
• 12:16
SPEAKER_00: Umsabah Paisal, Mukdash, Ma'avaidla Avoidah, In Haqal Ayleh Akara Aivid.
• 12:22
SPEAKER_00: Marach we see in a place that mm your maqshabbah is gonna passle by khajin, even may avoid la avaida, even from one available to the next.
• 12:30
SPEAKER_00: And still we only care about the one doing the available himself.
• 12:36
SPEAKER_00: So in a place like Khulin, where your maqshabbah won't passle if it's not in the same Avaida.
• 12:41
SPEAKER_00: Not that it won't passle at all.
• 12:42
SPEAKER_00: Obviously, you have Ava de Zara, you have to carry this Avedazara.
• 12:44
SPEAKER_00: But in a place by Chulin where it won't passle, may Avaidallah Avaidah if you add your Mahshava by one Avaida by the shittah, to have in mind something about the Zrikah, that's not gonna passle by Chulin.
• 12:55
SPEAKER_00: Allah besa avaida, where do you find the soul of Maqshaba?
• 12:58
SPEAKER_00: Where do you find the maqshabah by says?
• 13:00
SPEAKER_00: Only if you add a maqshava during that abaidah.
• 13:02
SPEAKER_00: I'm doing the shrita now for Avaidazara.
• 13:03
SPEAKER_00: And you do the shaitha, that would be, yeah.
• 13:05
  SPEAKER_00: But may Avaidala not.
• 13:07
SPEAKER_00: So in adin, shalai, hey, a khala, alacha.
• 13:10
SPEAKER_00: Shaykhita, for sure, the only person we should care about as thoughts is gonna be the one that's doing the shaitha.
• 13:14
  SPEAKER_00: That's the Kawakimer.
• 13:15
SPEAKER_00: But what do we see over here?
• 13:16
  SPEAKER_00: It's a double question.
• 13:17
SPEAKER_00: It says the Gemar of Shaishis is bringing out Muslim Ribbshesh.
• 13:20
SPEAKER_00: This is a question, Sayaniban, Sayan or Bshlakish.
• 13:22
SPEAKER_00: Where do we see this?
• 13:22
SPEAKER_00: Phnim, Kashulbsham Lakeshut, Kashir Bechunan.
• 13:26
SPEAKER_00: First of all, what we saw about Phnim is gonna be Kash on Rish Lakesh, because what do we see?
• 13:30
SPEAKER_00: Raishlakish said across the board, Ain Machashman Mehavida Lava.
• 13:33
  SPEAKER_00: Right?
• 13:33
SPEAKER_00: But clearly in the Hajjmin we just saw over here, what was the whole Kabalchimer that we rebuilt?
• 13:37
SPEAKER_00: Ma'ab ifnim in a clay case of Totchim that you do have a maqshavaid la voidah, that it's gonna possibly.
• 13:48
SPEAKER_00: We don't learn it from Pingo, said Raishlakish.
• 13:50
SPEAKER_00: Even by Karban Khath Shalhish Mah, you're not gonna be able to do it from one evidence to the next.
• 13:53
  SPEAKER_00: It's not gonna possibly.
• 13:54
SPEAKER_00: So it says the Gabar, Phnim Kashla Bishim Lakesh, Chutz Kashala Rabihnun.
• 13:58
SPEAKER_00: And chutz, what we built off this Kabukimer is gonna be a Kashir Biachman, because Rabbi had said across the board, you're going to be machashiv, may avoid a la voida.
• 14:06
SPEAKER_00: But what do we see over here in the Kabukheimer?
• 14:08
SPEAKER_00: The second part of the Kabukimer was Maklaim that a maqshabh won't pass.
• 14:13
SPEAKER_00: So that was a clear anakh we just made that by chulin, your maqshab may avoid la voida is not gonna pass it.
• 14:18
  SPEAKER_00: Rabihna wouldn't agree.
• 14:19
SPEAKER_00: Rabihana holds across the board that it will pass it.
• 14:21
SPEAKER_00: May avoid the la voida.
• 14:24
SPEAKER_00: Okay, let's try to answer this up.
• 14:26
SPEAKER_00: First of all, Rish Lakesh.
• 14:30
SPEAKER_00: I'll explain to you how it's not a Kashman Rish Lakesh.
• 14:32
  SPEAKER_00: Why?
• 14:32
  SPEAKER_00: Very balabatish.
• 14:33
  SPEAKER_00: Becauseham Ribekanan.
• 14:38
SPEAKER_00: Because Ribbshim bin Lakish, that Sheetah that you heard, that Rabbi Shiman Min Lakesh said that Bifnim Ing Mikhashimada, even Bifnim, that's before he heard this Mishnah we just quoted.
• 14:48
SPEAKER_00: That's before he heard this back and forth from Rabbi'echan.
• 14:50
SPEAKER_00: Why from Rabbi Echmann Rashis says he's Rebbe?
• 14:52
SPEAKER_00: And it's the dark of the Rebbe to teach his Talmud uh to teach his Talmud uh Mishnah and Brahisis.
• 14:58
SPEAKER_00: And therefore, before he heard it from his Rebbe, who is a Tamil Khavar of Rabbi Echanan, as we know, he argues all the time.
• 15:03
SPEAKER_00: But the point is, before he heard this from Rabbi'aichanan, and Rabihan, that's what he holds, right?
• 15:07
SPEAKER_00: So Rabi Echnan told him this Mishnah.
• 15:09
SPEAKER_00: Hey, this is my Shita.
• 15:10
SPEAKER_00: Okay, then I agree with you.
• 15:11
SPEAKER_00: His whole argument on Rabbi Echalan was before Rabbi Echanan told him this Mishnah.
• 15:16
SPEAKER_00: But afterwards, he 100% agreed with him.
• 15:18
SPEAKER_00: So P'nim the Rish Lakesh is not a Kasha.
• 15:20
SPEAKER_00: Ah, you have a Mishnah that you just uh you know rebuilt that sounds like it's a Kash on him.
• 15:25
SPEAKER_00: Yeah, but his Shita was before he changed his mind, before he heard this Mishnah from Rabbichan.
• 15:29
SPEAKER_00: But in that day he's mask him 100%, pneum, there's for sure an idea of Mechashwun Avaid Alavedah as we just saw.
• 15:33
SPEAKER_00: So how makam de shamurabichan, Allah the Sham Rabihan, and the chutz kashra beachan.
• 15:38
SPEAKER_00: So what are you gonna do with the second part of the question?
• 15:40
SPEAKER_00: That chutz is cash labehun.
• 15:41
SPEAKER_00: Because Rabihan said across the board that Mechajwin may avoid a lavaida.
• 15:44
SPEAKER_00: And we saw in the Kaabukhramra, we just said in the Mishnah, the way we explained it, that Chutz is we were taking it for granted that Bahut by regular chulin obviously in Mechajan may've alavaida.
• 15:56
SPEAKER_00: Rabihan holds across the board, even by chulin, yeah, mechajman avoid the lavaida.
• 15:59
SPEAKER_00: So it says the Gemara, who Mysul, who Matharakla Ribshai asked this question, and Ribsheshis also is the one to answer the question that the Arab Avoidois the Hokhikamer, that you understood the Kabukhamir wrong.
• 16:10
SPEAKER_00: Really, we're talking about what?
• 16:12
SPEAKER_00: Being Mechash Meh Avaida La Voidah by all four Avaidas.
• 16:15
SPEAKER_00: There were four main avaidas by Khacin, which was the Shita, the Kabbalah, the Eloha, and the Zrika, as we know.
• 16:20
SPEAKER_00: Those four Ikra Avaidas, that's specifically what we're talking about in the Kabukimer.
• 16:25
SPEAKER_00: That's how you have to read the Kabukimer.
• 16:27
SPEAKER_00: Uma b machem shimshava pay sales be mugdashin, bear ba avoidah.
• 16:31
SPEAKER_00: So what did we just swap out?
• 16:33
SPEAKER_00: We swapped out me'avoida la voida.
• 16:34
SPEAKER_00: So the point of comparing and contrasting in the Kabu Khaimer, Hulin to Kharchim, is not anymore that one of them, you're machash of la voida, voidah, the other one you're not machaj of la voida la voida.
• 16:43
  SPEAKER_00: What do we mean?
• 16:44
SPEAKER_00: We mean you could have a machava about all four as it relates to uh as opposed to hulin where your maqshava doesn't effectuate all four, because you don't have four avoidas by chulin, as we're about to see.
• 16:53
SPEAKER_00: So we're basically substituting that in, not a kasha anymore across the board, not even on a Rish Lakesh anymore.
• 16:57
SPEAKER_00: And also Rabbichnan, because again, the whole Kasha was about what they held about Mehajan Meh'void a la voida.
• 17:03
SPEAKER_00: But if we say that that's not the Kabukhima wasn't Bakhla referencing Me'a Avoid a la voida, but rather what's it referencing having a maqshava by all four, it's just talking about something else in Gans.
• 17:11
SPEAKER_00: And then therefore, says the Gemar like this.
• 17:21
SPEAKER_00: We see in a place that your Maqshaba passes by Qhajim by all four Avaidas, right?
• 17:25
SPEAKER_00: If you have a Maqshaba Passals by any of the four Avaidas, by Khajim it's gonna pass it.
• 17:29
SPEAKER_00: And still Aina Kalakhela Kharaidas.
• 17:31
SPEAKER_00: And still the only person's thoughts that we care about is gonna be the one actually doing the available.
• 17:35
SPEAKER_00: So macham shah, ey maqshabah passals bakulin.
• 17:38
SPEAKER_00: So in a place that maqshabb is not poisa by chulum.
• 17:40
SPEAKER_00: What do you mean a maqshabb is not poison by chulum?
• 17:42
SPEAKER_00: It's not poison alabish avaidas, it's not passal by all four.
• 17:46
SPEAKER_00: It's only your maqshabah only makes a difference by two avaidas by chulin.
• 17:49
SPEAKER_00: Because by chulen, you don't have four availas, you only have two.
• 17:51
SPEAKER_00: What do you mean you have avaidas?
• 17:52
  SPEAKER_00: It's not avaida that you're doing, you're doing a shahita's a path, how about me?
• 17:54
SPEAKER_00: So what do we mean?
• 17:55
SPEAKER_00: We mean that your voidah could be considered an avaidah for avaidazara.
• 17:59
SPEAKER_00: That's what we mean over here.
• 18:00
SPEAKER_00: That word we see rashi brings which two?
• 18:02
SPEAKER_00: You have the shaita and the zrika, not the kabbalah and the alahu.
• 18:04
SPEAKER_00: We see him, rashi brings that the shaitha and the zrika, that's going to be considered avaida for a vaid-zara in terms of avaidazara purposes.
• 18:11
SPEAKER_00: But that's the mah that that's the kabuchimer over here.
• 18:15
SPEAKER_00: So maqim sha'in machabah's bhul in elabesh tea by this.
• 18:18
SPEAKER_00: So in a place where your maqshabah is much more limited to Pasulat.
• 18:21
  SPEAKER_00: Why?
• 18:21
SPEAKER_00: Because Mahulan it only has two.
• 18:23
SPEAKER_00: Not that it doesn't have it all, not that it's not may'a void alavaida.
• 18:26
SPEAKER_00: No, that it doesn't have four, it has two.
• 18:28
SPEAKER_00: It only has two, so it's much more limiting.
• 18:30
SPEAKER_00: So in a dish, so for sure.
• 18:34
SPEAKER_00: That it should all go according to the shaykhid.
• 18:35
SPEAKER_00: And we shouldn't care what the Galoch is thinking in his head.
• 18:37
  SPEAKER_00: Says the Gemara.
• 18:39
SPEAKER_00: So it's not anything about Mechajwin, meh avoid a la voidah, not any more of kasha on rishlockish, not a kasha on rebay'n.
• 18:45
  SPEAKER_00: Says the gem.
• 18:47
SPEAKER_00: I'll bring you a rayah from a bra, I'll bring a braisa that supports she.
• 18:52
SPEAKER_00: That again, mechajvin may avoid la vada across the board.
• 18:58
SPEAKER_00: To do the zrika trabed azara.
• 19:00
SPEAKER_00: Ulahakter Khalba is kahavim Hare ilu zivchimasim.
• 19:04
SPEAKER_00: It's considered zivchimasim, meaning this could this is considered the covers of a desira that you now, this is the proper zivchimesim for all intents and purposes that you sacrifice the Frab de Zara.
• 19:13
  SPEAKER_00: Shaqtabaakah.
• 19:15
SPEAKER_00: What about if you did the shikitah?
• 19:16
SPEAKER_00: And after you finished the shaitha, you had a maqshava, and we saw you have a maqshava, you said it out loud.
• 19:22
SPEAKER_00: Now I'm gonna do the zrika uh for Ava de Zara.
• 19:25
SPEAKER_00: But you didn't say it, and we didn't realize that you said it whatever it was uh during the shaitha itself.
• 19:29
SPEAKER_00: It was only after the actual shita that you decided, or you said out loud now that you're gonna do the zrika, you're gonna continue doing the Vadobi here for Avedzara.
• 19:36
SPEAKER_00: Zalya Maya this is actually a Maisa Bisari in Kisaria, Veloy Amru Bala Isrelah.
• 19:42
SPEAKER_00: Then the Rabban, they didn't paskin that it's Usr, they didn't paskin that it's Mutr.
• 19:45
SPEAKER_00: It was kind of neutral ground.
• 19:46
  SPEAKER_00: Why?
• 19:46
SPEAKER_00: Because Amr-Kh, said Loi Amrbah isr mishimkwah and the rabbanan.
• 19:50
SPEAKER_00: They didn't say it's 100% usar because of the cover of the Rabbanan.
• 19:54
  SPEAKER_00: Who's the Rabbanan, Zakrashi?
• 19:56
SPEAKER_00: That Amri Loy Amrinan Stam Mahshabis Kam Lab is Kam.
• 19:59
  SPEAKER_00: This was yesterday's daft.
• 20:00
SPEAKER_00: That the Rabbanan said, we don't say that the stam Mach Shabbat of Abadiscom is Labad is Khaman.
• 20:05
SPEAKER_00: And by the way, would mean a mummer as well.
• 20:07
SPEAKER_00: Even if he's a yid, as soon as you see he's saying I'm doing Abadazara, he's considered, for all intents and purposes, an Abbat's Kham, uh Abid Khham.
• 20:14
SPEAKER_00: And therefore, says the Rabanan yesterday, that we don't say stamasabatiscom, labad is command.
• 20:19
SPEAKER_00: And therefore, unless he was mefarish that I was doing this for Abadazara, we don't assume that automatically he was doing for Abadazara.
• 20:24
SPEAKER_00: And therefore, and therefore what?
• 20:25
SPEAKER_00: This guy, this Yisoah that's doing it.
• 20:27
SPEAKER_00: The high nami Afghan got the Igloy Milsa the Mummer, who, even though we realize now that he says he's gonna do the rest for Abbott Azara, it was Igloi Milsah that he's a Mummer, 100%, so he has the dinabah to hum him.
• 20:40
SPEAKER_00: We're not gonna say that when he did the shrita, he also meant it for Abadazara.
• 20:44
SPEAKER_00: Even though then now we see he's a mummer, again, what was the case?
• 20:46
SPEAKER_00: Obviously, if he did the shrita for Abedazara, zivchimesin, no problem.
• 20:49
SPEAKER_00: Even if he did the shark and he said, I'm gonna do the, I'm gonna do the hachtara, I'm gonna do the zrikah for Abedazara later on.
• 20:55
SPEAKER_00: He showed us he's a mummer at the beginning, it's gonna be zivchimasin.
• 20:59
SPEAKER_00: But if he did the shark without saying anything, and after he did the shit, that's the case we're talking about, then he said, I'm gonna go and do the zrikah for Ravedazara.
• 21:07
SPEAKER_00: So now he has the din of a mummer.
• 21:09
SPEAKER_00: But we don't say stam mahsheves mummer la vad is kham, stamaksheavis of him, and therefore, right now he said it.
• 21:15
SPEAKER_00: So right now he's a mummer, but before we don't assume that it was the Gloy Milsala Mafraya that also is Shita had these maqshavas, and therefore kosher.
• 21:23
SPEAKER_00: It's gonna be kosher because again, we don't say that stam Mahshavas Avad is Kam Labath Khachavim.
• 21:29
SPEAKER_00: So they didn't say it's Asar, why Mishim Kwaydidra Rabban?
• 21:32
SPEAKER_00: Because the covet of the Rabbana that was that would hold, as we just said.
• 21:35
SPEAKER_00: And they also didn't say it's mutter, loyheter Mishum Kwaidar Lezir.
• 21:39
SPEAKER_00: They also say it's not, they also didn't say it's 100% mutter because of the covet of Belezr.
• 21:42
SPEAKER_00: But lezar we learned yesterday in the Bishra Belezar who said that stampshabed as Khavim is Lava Des Kavam.
• 21:46
SPEAKER_00: And therefore, if this guy showed us that he's a mobr, because after the Shita, now he said he's gonna go do the Srika for Abedazara, so he's a mobur.
• 21:53
SPEAKER_00: And therefore, I you didn't you weren't mefarish to us while you were doing the shita, you didn't say it out loud.
• 21:57
  SPEAKER_00: I don't care.
• 21:58
  SPEAKER_00: Cezar Belezha, stamma comes.
• 22:00
  SPEAKER_00: You showed us you're a mummer now, so you're 100% a mummer.
• 22:02
SPEAKER_00: You were a mummer even before, and you're stammachabas law just khabim.
• 22:05
SPEAKER_00: And therefore, when you did the shaita, it was probably also a problem.
• 22:08
SPEAKER_00: Sure balazar would say it's usr.
• 22:09
SPEAKER_00: So says the Gemara, this was a mice in Kisaria that he Dafka made it clear his intentions after the Shita, and they didn't say Asr, they didn't say Mutr, they didn't say Muttr Mishum Kwaidadrabath, they didn't say Asr, Mishum Kwahd Dharabatan, they didn't say mutter, Mishum Kwaidarbalazar.
• 22:22
  SPEAKER_00: Says the Gemar Mima.
• 22:24
SPEAKER_00: How do you know to say that that's the same Makhlik is that it's totally in this machelik?
• 22:30
SPEAKER_00: Maybe there are a bottom only said over there that that uh maybe the Rabbanan only said that it's going to be mutter in the Mishnah, the loy shamanid khashiv.
• 22:40
SPEAKER_00: Meaning that that their abundance said in the Mishnah that we don't say, that's what we explained it yesterday, that we don't say stammaqshavis of it is command law to them.
• 22:47
SPEAKER_00: And therefore, unless you heard it, it's gonna it's not gonna be a problem.
• 22:49
SPEAKER_00: So maybe the abundant only said it over there because we didn't hear anything.
• 22:53
SPEAKER_00: We didn't hear him have any maqshabah, he didn't say anything.
• 22:55
SPEAKER_00: It's just a question of do you have to assume that he meant that by the czar or not?
• 22:58
  SPEAKER_00: Ab al-Hachadish.
• 22:59
SPEAKER_00: But over here that we did hear him say it, he clearly made his intentions clear after he already did the shaithah, but at he said something, so maybe we should say al-y.
• 23:08
SPEAKER_00: Over here he did make his intentions clear that he's a mummer.
• 23:11
SPEAKER_00: And therefore, maybe we should say over here that a khiya safai al-Khilasay, that the saf, meaning once he made it clear, that should be Makhiach Al Thilasay in the beginning that even when he did the shaithah, he was doing it lava dezara.
• 23:22
SPEAKER_00: Inami, another uh also on the also on the other end, that's what Lazar maybe only said over there that we always say stambah, deskab, even if he didn't say anything, we assume his maqshabh was for Abbasara.
• 23:35
SPEAKER_00: Maybe he only said that in the case of the Mishnah, which was an actual bona fide oyvid kachovin.
• 23:40
  SPEAKER_00: Al-Gabe O'vit Kachovin.
• 23:41
SPEAKER_00: This stamsabas ovid kachovin lava diskhahavan.
• 23:44
SPEAKER_00: Obvious so, but what's our case?
• 23:45
SPEAKER_00: Our case was a yid.
• 23:46
SPEAKER_00: We realized after Ahmad al-San is a mummer.
• 23:48
SPEAKER_00: But a yyid, uh shaf al-khilasa, maybe by a yid we're not gonna say, even though he showed us he's a mummer now, we're not gonna say that lamafreah he probably was also a mummer.
• 23:59
SPEAKER_00: That by the shaitha also we have to assume now he was a mummer as well.
• 24:02
  SPEAKER_00: Why?
• 24:02
  SPEAKER_00: Zakrashi?
• 24:03
SPEAKER_00: Because since he had a chhez cashrois, the Dumma achha shahitah nichmas by Yetzah, behimer daita, we assume that he had a chzqis kashhras until the latest possible time.
• 24:11
SPEAKER_00: And therefore, maybe after he did the shait, and now he became a mummer.
• 24:14
SPEAKER_00: Maybe the yetzehar happened already after the shahitah you don't assume he was always a mummer, he's a yid.
• 24:18
SPEAKER_00: And therefore he has a chesed kashhris.
• 24:20
SPEAKER_00: We only assume that when once he made his intentions clear, then now he's a mummer.
• 24:23
SPEAKER_00: But we don't say a bat khilas, and even Rabalazar maybe would be mounted to that.
• 24:27
SPEAKER_00: Rabalazar maybe only said his Allah laqha by Avid Khalim, not by a yid.
• 24:30
SPEAKER_00: So says the Gemara, who said that's the Machlekas?
• 24:31
SPEAKER_00: I could show you whether why the Rabbanan would say it might be different in this case, and why Rabbi Lezir would also say it might be different in this case.
• 24:36
SPEAKER_00: So says the Gemara, so again, back to the question.
• 24:38
SPEAKER_00: Zehoya Misa Bi Kisari, and they didn't say it's mutter, they didn't say it's a Mishum Kwawidar Rabazar, Kwaidadir Abbanan.
• 24:44
  SPEAKER_00: What do you mean?
• 24:45
SPEAKER_00: There's nothing to do with that machikas, as we just said.
• 24:47
SPEAKER_00: Says the Gemara, El Amr of Shizwi.
• 24:49
  SPEAKER_00: You're right.
• 24:49
  SPEAKER_00: Let's explain that story.
• 24:54
SPEAKER_00: They didn't say it's mutter in that case because the covet of Rab Shimon Mangamlio.
• 24:57
SPEAKER_00: And Ram Shim and Mangamlio would hold its usur.
• 25:00
  SPEAKER_00: So that's why they didn't say it's mutter.
• 25:03
SPEAKER_00: Because they wanted to show covet to the sheet of Rab Shim and Mangamlio.
• 25:06
SPEAKER_00: Says the Gamar, hi Ramanshim and Mangamlio.
• 25:08
SPEAKER_00: Which Raman Shimang Mangamlio we're talking about.
• 25:10
  SPEAKER_00: Elaima Rashbagdi Gitin.
• 25:12
SPEAKER_00: If you're gonna tell me it's a sheet of Rabash Mag and Gitin, which is what?
• 25:15
SPEAKER_00: It's not we have a Mishnah, famous Mishnah.
• 25:17
SPEAKER_00: Habari Shaamar Kisfu get the ishti.
• 25:18
SPEAKER_00: A bari, a healthy person that said, write a get for my wife.
• 25:21
SPEAKER_00: The magic word is that he didn't say is that tnu.
• 25:24
SPEAKER_00: Don't give he didn't say kisfu utnu get l isti.
• 25:27
SPEAKER_00: He just said kissfucat l ishti, just write it for my wife.
• 25:29
  SPEAKER_00: Now, what's the context?
• 25:30
SPEAKER_00: The context is that a shimira, if a guy's about to die and he says kisfu get l isti, although generally someone has to say kisfu get la ishti u tnu or kisfu tnu get l ishti that write it and give it to my wife.
• 25:41
SPEAKER_00: So he's giving instructions to aid him to both write it and to give it, then you give it.
• 25:45
SPEAKER_00: But if he didn't say give it, then it's not gonna be considered anything.
• 25:47
SPEAKER_00: Islam wants to write it, he didn't say to give it, and therefore if you give it, you're not doing Alpia Shlikus, and it's not gonna be considered a get.
• 25:52
SPEAKER_00: But a shhmirah, we assume that the guy's about to die.
• 25:55
SPEAKER_00: He doesn't have his dash 100%, and therefore we take whatever he says very seriously.
• 25:58
SPEAKER_00: And if he says kiss who get the ishti, even if he didn't say tnu, since he's in this very compromised situation, he's a shhimira, he's about to die.
• 26:05
SPEAKER_00: We assume it says that we treat it as if he said tnu.
• 26:07
SPEAKER_00: We treat it as if he says tnu, and even if he just said kiss who, we go and give the get to the wife.
• 26:12
SPEAKER_00: So it says, if you're gonna tell me it's this sheet of rash bag, the get then it's not how bari.
• 26:15
  SPEAKER_00: If he's a bari, it's not a shimmer, he's completely healthy.
• 26:18
SPEAKER_00: Shama, he said, kiss who get the ishti, and he didn't say tnu.
• 26:21
  SPEAKER_00: So that's the sahik.
• 26:22
SPEAKER_00: But how do we treat this?
• 26:23
SPEAKER_00: We treat it as if he stam wanted to mess with her.
• 26:25
  SPEAKER_00: It's not a nice game he's playing.
• 26:26
SPEAKER_00: But he is who get the ishti is trying to mess with his wife, but because he didn't say t'nu, and that's it.
• 26:30
SPEAKER_00: Umai Sibibari, and there's a story with a healthy person.
• 26:33
SPEAKER_00: Shamar kiss who get the ishti, he didn't say t'nu.
• 26:35
SPEAKER_00: The other gag, and he went to the roof and alpha, um, and he fell off the roof and died.
• 26:38
  SPEAKER_00: So I'm Shumil.
• 26:39
SPEAKER_00: In the Atmanafa, if he jumped off the roof and committed suicide, then I is a get.
• 26:44
SPEAKER_00: It's gonna be considered a get because you see clearly this guy wasn't in a matzov of joking around.
• 26:48
SPEAKER_00: He was more in the matzav of a shimmer about to die.
• 26:50
SPEAKER_00: He knew he was about to commit suicide, and he said kiss who get the ishti, so you probably take him seriously over there.
• 26:54
  SPEAKER_00: It's a very similar uh case.
• 26:57
SPEAKER_00: But if he happened to go up to the roof and the and stom the wind pushed him off, and that's why he died, then ain't a get.
• 27:02
SPEAKER_00: It's not gonna be considered a get.
• 27:03
  SPEAKER_00: Valvinabon.
• 27:04
SPEAKER_00: We asked on the back and forth in the Mishnah we just brought.
• 27:06
  SPEAKER_00: My solicitor?
• 27:07
SPEAKER_00: We're bringing a story to contradict what we just said.
• 27:09
SPEAKER_00: What did we just say?
• 27:09
SPEAKER_00: A body that said, Kiss who get the ishti, ratsless sahik, but it doesn't mean anything.
• 27:13
SPEAKER_00: And then we brought a story showing you how sometimes it could mean something if you went to the roof and jumped off.
• 27:17
SPEAKER_00: So is the Gamar, my solicitor?
• 27:18
SPEAKER_00: Says the right, you're right.
• 27:20
SPEAKER_00: It's really missing a few words of this day.
• 27:21
SPEAKER_00: You have to read it.
• 27:23
SPEAKER_00: That in my khiya seb at killasay, harizaghet.
• 27:26
SPEAKER_00: That a bari that says kiss who get the ishti, it's not gonna be considered anything, because he didn't say it's new.
• 27:30
SPEAKER_00: But if it was my khiya saf al-hilase, then this guy was probably serious, then hariz a get.
• 27:35
SPEAKER_00: It's gonna be considered a get, um my senami, bibari.
• 27:37
SPEAKER_00: And we had a story like this, Bibari Shama Kizuka the ishti, but the gagmanafa, lumei some Rashim Gamel, I mean atmanafariza get we're maruat the chase and a gat.
• 27:44
SPEAKER_00: So what do we see from here?
• 27:44
SPEAKER_00: We see that Rabashim Gamel holds that we say this inion of Ishiach Saife Al-Khilasa, and therefore, in our story as well, what happened?
• 27:53
SPEAKER_00: The guy did the shit.
• 27:54
SPEAKER_00: After he did the shit, he didn't say anything, he didn't have any machabah, or he did, but we don't know about it, he didn't make his intentions clear because he did, and he did a shita.
• 28:00
SPEAKER_00: After the shita, he said that I'm gonna go do and now the zrika for a dezara.
• 28:04
SPEAKER_00: So now we see he's a mummer.
• 28:05
SPEAKER_00: Are we gonna say a khiach soif al-Khilasai?
• 28:07
SPEAKER_00: Then now we see as a mummer, so it's gonna be ma'chiah that he did even the shaita like this as well, so it's gonna be a problem, or not, says the Gemara, their abundant didn't know what to do.
• 28:14
SPEAKER_00: They didn't say because uh Mishum Khvaidai, uh they didn't say it's mutter, they didn't say it's associated.
• 28:18
SPEAKER_00: So says the Gemara, maybe this is what we meant.
• 28:20
  SPEAKER_00: That they didn't say it's mutter.
• 28:22
SPEAKER_00: Why Mishum Kvaidid or Rashimliya?
• 28:24
SPEAKER_00: We see that Rab Shimlio holds that we still say this concept, Hikhiach safilas, like we just don't get it.
• 28:29
  SPEAKER_00: So too over here.
• 28:30
SPEAKER_00: We're gonna say al-So what would Rajbag say in this case?
• 28:33
SPEAKER_00: He would tell you that you see now the guy's a Mummer even after the Shreita, Hojihirh Sai Featchilase, that probably the Shita was bad as well.
• 28:40
SPEAKER_00: And therefore he would tell you it's Hasr.
• 28:41
SPEAKER_00: So they didn't say it's mutter, Mishum Khai to Ramash Mangamlio.
• 28:44
SPEAKER_00: Says a gumara, how could you say that though?
• 28:46
SPEAKER_00: Vidul Mashani Hasam, the Kamara Kisw, maybe it's different over there.
• 28:49
SPEAKER_00: Maybe Rimashum Leo only says Hhoi Khir Sef Al-Khilase because he actually said something in the beginning.
• 28:54
  SPEAKER_00: What did he say?
• 28:55
  SPEAKER_00: He said Khisfu.
• 28:56
SPEAKER_00: So Kizvu is already something.
• 28:57
SPEAKER_00: I understand we until now we thought it was nothing.
• 28:59
  SPEAKER_00: Obviously, it means something.
• 29:00
SPEAKER_00: It's like write a get from my wife.
• 29:01
SPEAKER_00: The question is, is he joking around?
• 29:02
SPEAKER_00: If not, so he actually appointed them to write a get.
• 29:05
SPEAKER_00: If they're it's gonna be considered a kasher get the smah, everything if they go and write it, maybe not a give it.
• 29:10
SPEAKER_00: But the point is there is something that he said.
• 29:12
SPEAKER_00: Over here, did the guy say anything?
• 29:14
SPEAKER_00: No, he just shached it.
• 29:15
SPEAKER_00: He didn't say anything, and we're trying to s and we're trying to come afterwards without any previous information to say alkilase.
• 29:21
SPEAKER_00: Over there, there were there was previous information.
• 29:23
SPEAKER_00: He said kisru gatla isti.
• 29:25
  SPEAKER_00: There's we're working off something.
• 29:26
SPEAKER_00: So maybe the Rajbag only says where you're working off something, the Kamar Kiswu.
• 29:31
SPEAKER_00: But in this case, the parallel to that would be by the shita, by the shiita he didn't say anything, and therefore not necessarily Remshun Gamhiya.
• 29:39
SPEAKER_00: You're right, it's a different shietah of Ramsah Gamyod.
• 29:45
SPEAKER_00: Someone who writes over all his nachasim to someone else.
• 29:47
SPEAKER_00: He's dying or whatever it is, and he writes all my nachasim are gonna go to plaini.
• 29:51
SPEAKER_00: And in his nachosim, he owned Avadim.
• 29:53
SPEAKER_00: The umrhallah and the maqabal, the person that was maqabal the matana, he said, Iashiban, I'm very nice, thank you very much, but I don't want your avadim.
• 30:00
SPEAKER_00: I'm accepting everything else, I'm being coin to everything else, but not the avadim.
• 30:03
SPEAKER_00: So ima your rabbi sheni koyen, if the rabbi sheni, meaning the second master, meaning the macable of the matana over here, if the guy was a Kayan, the mission's bring the brass just bring out a point that he was 100% coin to everything, even the Avadim, even though he tried to say I don't want the Avadim, to the point that if he was a Kain, Arayu eich machum.
• 30:19
SPEAKER_00: We know that Kinan cosplay, the Avadim of a Kayan can eat Shumah.
• 30:22
SPEAKER_00: If the second guy was a kayun, they're so always Avadim that they can even eat Shumma.
• 30:26
  SPEAKER_00: That's the point.
• 30:26
SPEAKER_00: I don't care that he was screaming, he doesn't want it.
• 30:28
SPEAKER_00: The Gemara's about to explain.
• 30:29
SPEAKER_00: Rem al Aimer came and shama hallo.
• 30:31
SPEAKER_00: Yeshiva and Fries Achmann Yarsh and Ramsa Mamila argues and says no.
• 30:34
SPEAKER_00: As soon as he says, I don't want them, so he was never kind to them, he was kind to everything else, and therefore, who was kinda?
• 30:38
SPEAKER_00: So if the first guy died, the Yarshim are gonna be kind at uh right away.
• 30:41
SPEAKER_00: The Yarshim now of the first guy were kinda, and this guy wasn't kinda.
• 30:45
  SPEAKER_00: Says the Gemara.
• 30:46
  SPEAKER_00: Maviruma.
• 30:47
SPEAKER_00: And we asked, what's going on over here in the bride in the Brahsa?
• 30:50
SPEAKER_00: The Tanakhama, according to Tanakhama, he's gonna tell you that this guy was kind of the Avadim.
• 30:55
SPEAKER_00: I mean, the second guy was kind to the Avadim, even if he's standing and screaming that I don't want to be kind to them, what do you mean?
• 31:00
SPEAKER_00: You're gonna force him to be kind to them?
• 31:01
SPEAKER_00: You know, he's standing and screaming on the onset that he's not being kind to them.
• 31:04
SPEAKER_00: So he never made a kinyon.
• 31:05
SPEAKER_00: Why are we telling you that he's for sure gonna be kind to them?
• 31:07
SPEAKER_00: So Marabah Rabba explains, he explains like this.
• 31:11
SPEAKER_00: If the guy was screaming the whole time, Mammish in the beginning of the kinyon, that I'm being kind to everything else besides for these Avonim, I don't want them, then Kula Amalai Pliggy, the lay kinda.
• 31:19
SPEAKER_00: Everyone's gonna agree that you're right, he was not kind of them, and they're gonna go to the rab, and uh they're gonna go to the Yarshim of the Rabbi Rush.
• 31:26
SPEAKER_00: If he was quiet on the onset during the Kenyon, and then later on, a week later, he started making a fuss.
• 31:31
SPEAKER_00: I don't want to be kind of the abandon.
• 31:32
SPEAKER_00: Then the kula amalai pliggy dekana.
• 31:34
SPEAKER_00: Everyone agrees that he already was kinda.
• 31:35
SPEAKER_00: There's nothing you could do right now besides you could free them, whatever it is.
• 31:38
SPEAKER_00: But but as relates to the original opinion, you were 100% kind of them, they could go and eat shroom.
• 31:42
SPEAKER_00: Keep pliggy, where's the machlikes?
• 31:43
SPEAKER_00: Shazikhle alideach, where he was mizakh, his nichosim to this second guy, al Yede someone else.
• 31:50
SPEAKER_00: He was Mizza Al Yede someone else.
• 31:53
SPEAKER_00: And during the transaction, he was quiet, meaning the who the intermediary, while it was going through him, he was quiet.
• 32:00
SPEAKER_00: And afterwards, once it got to him, then he started screaming that I don't want these, uh I don't want these abandon.
• 32:04
SPEAKER_00: Tanakama Savar mideshah se kananu.
• 32:06
SPEAKER_00: Tanakama holds that from the fact that he was quiet on the onset during the transfer, so he was 100% kind of everything.
• 32:13
SPEAKER_00: And that that he's uh complaining later on he doesn't want the abadim, he's being khaizer, and you can't you're not meaning you can't undo the original transaction, and that's why it's not gonna work over here.
• 32:27
SPEAKER_00: That in the beginning he didn't even want these abadim either.
• 32:32
SPEAKER_00: Okay, so you're gonna ask me why didn't he scream in the beginning?
• 32:33
SPEAKER_00: It doesn't sound so normal, right?
• 32:35
SPEAKER_00: You wake up a week later and all of a sudden you don't want the abadim, even though you meant it the whole time.
• 32:38
SPEAKER_00: So why weren't you uh complaining in the beginning that you don't want them?
• 32:41
  SPEAKER_00: Savar khiloy asiliyadimatzvah.
• 32:44
SPEAKER_00: He just felt himself, it's not even in my hands yet.
• 32:46
SPEAKER_00: I have nothing to complain about.
• 32:47
SPEAKER_00: I'm gonna save my uh energy for for when I actually they try to bring me this abadim, then I'm gonna uh make a fit.
• 32:52
  SPEAKER_00: But right now, no.
• 32:53
SPEAKER_00: But either way, he never had a mind to be kind to them, and therefore, we say over here, a khich sab alkilasa, what's the point?
• 32:59
SPEAKER_00: That this is the rashback.
• 33:00
SPEAKER_00: This is where we see Rashimliyah holds.
• 33:11
SPEAKER_00: That said after the Shitah he made his intentions clear, he would say now khilaso.
• 33:16
SPEAKER_00: And by the way, we're not gonna knock this one off because we tried with the last one we were able to say shan't, it was different over there.
• 33:20
SPEAKER_00: But we hear here there's no shahani aaslam.
• 33:22
SPEAKER_00: This is the khvaida, Mishum Kwaidar Mishum Gamlia.
• 33:24
  SPEAKER_00: That's why the Rabbana didn't say it's Mutr.
• 33:26
SPEAKER_00: And we said Mishum Khvaida Rabba Lazar, they didn't say it's usar.
• 33:30
  SPEAKER_00: Or Kwaida.
• 33:33
  SPEAKER_00: They didn't say it's mutter, they didn't say it's usually.
• 33:35
SPEAKER_00: So let's try to work out the other side.
• 33:36
SPEAKER_00: So it says I'm sorry, the other side was what?
• 33:39
  SPEAKER_00: I'm a rabbit.
• 33:43
SPEAKER_00: Who is the other sheetah?
• 33:47
  SPEAKER_00: Yeah, it was Rabalazer.
• 33:51
SPEAKER_00: No, we're substituting Rebelazer for some now.
• 33:53
  SPEAKER_00: So sorry.
• 33:53
SPEAKER_00: There are Banan who hold with that.
• 33:55
SPEAKER_00: We don't say, we deal with that before.
• 33:58
SPEAKER_00: But either way, says Amar.
• 33:59
SPEAKER_00: So some the Sab, I'm rebuilding Mashmour.
• 34:01
SPEAKER_00: Rebuita's in the name of Ms.
• 34:02
  SPEAKER_00: Halah Krebysi.
• 34:04
SPEAKER_00: In the Mishnah that said what?
• 34:05
SPEAKER_00: That we only care about what the maqshava of the Shoichit, meaning back to yesterday's daff, right?
• 34:09
SPEAKER_00: Do we care about what the Galah is thinking if he's not the one doing Abueda?
• 34:12
SPEAKER_00: Sad Byasi, a whole Kalvahimer.
• 34:14
SPEAKER_00: We went through the Kalvahimer, a few different versions of it today, to show you that the only person's Maqshava we care about is the guy actually doing Abuida, the guy actually doing the Shita.
• 34:22
  SPEAKER_00: Halloh Kurbyysi.
• 34:23
SPEAKER_00: And says around that note.
• 34:24
  SPEAKER_00: Hanutay, the Asulit Zikunya.
• 34:27
SPEAKER_00: There was these Arabs that came to Tsikunya.
• 34:29
SPEAKER_00: Yoy V Dikhid Tabhai Israel and they gave these animals to Jewish Shaykhtim and Amr Lahu.
• 34:35
SPEAKER_00: They told them, uh Damavitarbaladidan, the blood and the fats or whatever, are gonna go to us.
• 34:43
SPEAKER_00: They wanted to use it for Avadazara.
• 34:45
  SPEAKER_00: And Mishro Bisr Lidhu.
• 34:46
SPEAKER_00: So I want you guys to shachte it, just do the Shitta.
• 34:49
SPEAKER_00: Because if they held, Rash explains that these tayim, even if for their Avadazar, they held you had to do a shrita.
• 34:53
SPEAKER_00: So they wanted the Israel to do the Shita, and you're gonna give us the blood and the fats and the things we're gonna be maker to the Avadazara, and you keep the Basar and uh you keep the Basar and the hides for yourself.
• 35:04
SPEAKER_00: By the way, you have these Arabs over here.
• 35:06
SPEAKER_00: I don't think if you have to uh Tao Taya is usually an Arab, it's usually an Arab merchant.
• 35:09
SPEAKER_00: But over here we see we see that they're Avday Vazar.
• 35:12
SPEAKER_00: It doesn't know whether the Rambam says that Ishmaelim are not Avada Zahra.
• 35:15
SPEAKER_00: But it's important to remember that was like uh hundreds of years later.
• 35:17
SPEAKER_00: We're in the times of the Amaron.
• 35:19
SPEAKER_00: Muhammad only came around like in 600, like uh 500 years later than this, or 300.
• 35:24
SPEAKER_00: But the point is that it's very well that Taya could be Avidavatazar over here, and it's not uh it's not gonna be a steer to anything else that you heard about the Ishmaelim nowadays not being.
• 35:31
SPEAKER_00: But says the Gemara that um that what?
• 35:35
SPEAKER_00: So he they tried to say that you guys keep the meat, keep whatever you want, you do the shark, and we'll just take that other the other stuff for the Abadhazar.
• 35:43
SPEAKER_00: So you're gonna have a problem here or not?
• 35:44
SPEAKER_00: Again, like Yid's doing a shahita, it's a kasha sharkita, he wants to eat the meat, but uhid kachavim now had in mind about the blood and other parts that are gonna go for Abadazar.
• 35:53
SPEAKER_00: So yo, so what happened?
• 35:55
SPEAKER_00: So Shalcha Ravtuvi Barrav Maslakamid Rabbiasiv is send the shah to Rabbi Yasiv.
• 36:00
SPEAKER_00: What's gonna be the Allah in this case?
• 36:01
SPEAKER_00: So Shah, he answered him back.
• 36:08
SPEAKER_00: Or the one that's doing the shakita, we only care about what he thinks, and therefore the Tayyah, the the Arab over here is thinking something else.
• 36:14
  SPEAKER_00: I don't care what he thinks.
• 36:15
SPEAKER_00: No problem, you're gonna be able to eat it.
• 36:16
SPEAKER_00: Umla Rabahab Abialabashi, Rabalazar, quantas, who holds that you can toss it off based off the galax mahshava, someone else's maqshava.
• 36:24
  SPEAKER_00: So Ya'lai Zuzil Tabak.
• 36:26
SPEAKER_00: What about a case where the guy didn't give him the animal, like the case in the Mishnah?
• 36:31
SPEAKER_00: It wasn't that the animal didn't belong to the guy that he gave to the Jew and said, Shechtah for me, and I'm having in mind Abadazar.
• 36:36
  SPEAKER_00: That's not what happened.
• 36:36
SPEAKER_00: But rather, if the animal belonged to the Jew, and the guy, the Abbot Kahadim, gave him money.
• 36:41
SPEAKER_00: He gave a zuz to a Jewish shafit, and he told him, Give me a piece of meat, and his he had in mind for Abad Azar.
• 36:47
SPEAKER_00: So my what's gonna be the law in that case?
• 36:48
SPEAKER_00: So Amr Lay told him, Khazino.
• 36:50
SPEAKER_00: We check out the situation, meaning it's totally on the situation.
• 36:53
SPEAKER_00: Inish Alma Alamahu Al Mahu Delay Matsi Madhilay.
• 36:57
SPEAKER_00: If the guy was an Inish Alma, meaning he was a very strong person, he wasn't the type of guy you wanted to mess with, and therefore, if he came with this request, you're gonna have to do it.
• 37:04
SPEAKER_00: You can't just back out of it, says Rash.
• 37:05
SPEAKER_00: You can't just undo it, take your zuz and go jump in the lake.
• 37:07
SPEAKER_00: You're not gonna be able to say that.
• 37:08
SPEAKER_00: So, awesome, it's gonna be awesome because you're 100% bound to this, and it's gonna be a problem according to Riblazer.
