- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:12Speaker 2: This week on your gabble gabble. If your dog almost
- 0:15Speaker 2: gets bit by another dog that bites.
- 0:16Speaker 3: You instead, can the chiropractor not charge you because you're
- 0:20Speaker 3: suing the dog owner?
- 0:21Speaker 2: Judge Faith trust to straighten that all out. Wolf Wolf.
- 0:23Speaker 4: And if you swerve out of the way of a
- 0:25Speaker 4: car and hit a tree, can you get money for it?
- 0:29Speaker 1: Are you lost? Strained in the woods? Judge Jerry tells
- 0:32Speaker 1: its real people cases.
- 0:33Speaker 2: Thank Justice. This is your go get up?
- 0:40Speaker 1: What up?
- 0:40Speaker 3: What up?
- 0:42Speaker 1: Gavel in the house?
- 0:43Speaker 2: Ring down? All right, there's a ringtone happening thing here.
- 0:47Speaker 1: Do you usually do that?
- 0:49Speaker 4: No?
- 0:49Speaker 3: My ringtone is up for a very specific reason. It
- 0:52Speaker 3: is about travel. It's a long story I've not told
- 0:54Speaker 3: you yet and it really has no bearing on the
- 0:57Speaker 3: GAPO A.
- 0:57Speaker 1: You're not going to Boston.
- 0:58Speaker 3: I am going to Boston, but many Kay paid for
- 1:00Speaker 3: my son, me and my wife. I had to book
- 1:02Speaker 3: my other kids separately. You can't book a child's ticket online.
- 1:06Speaker 3: We got to call them, so I was waiting on
- 1:08Speaker 3: a call back.
- 1:09Speaker 2: That's what happened.
- 1:10Speaker 1: Oh I'm sorry that no, No, that that callback already happened.
- 1:13Speaker 2: Never turned it down. So we're all good. Here avelin.
- 1:18Speaker 2: That's the fullest.
- 1:19Speaker 4: Now we have a judge j and a judge Faith
- 1:21Speaker 4: and Dan. We don't talk about our cases beforehand, but
- 1:23Speaker 4: we both looked at each other. But right before President
- 1:25Speaker 4: Recording said and I said my case is a snoozer,
- 1:28Speaker 4: and he said my cases snooze or too.
- 1:30Speaker 1: So we're sorry in advance. The thing about the.
- 1:32Speaker 3: Gabbl is is it's a tricky mistress because you it's
- 1:36Speaker 3: luck of the draw. Typically we were up against the
- 1:38Speaker 3: clock when we do this, and so if we both
- 1:40Speaker 3: have bad cases, we both have bad cases. Now mine's
- 1:42Speaker 3: got some fun names in it. Brand Okay, great, you
- 1:45Speaker 3: want me to start off with the fun name.
- 1:46Speaker 2: I would love to.
- 1:47Speaker 1: And I love Judge Faith.
- 1:48Speaker 3: She's wonderful. She really is doctor Phil. Okay, not not
- 1:54Speaker 3: that doctor Phil.
- 1:55Speaker 1: He's listen.
- 1:57Speaker 3: He's a doctor and his name is doctor Phil Pinto Pento.
- 2:01Speaker 3: I'm gonna call him doctor Phil.
- 2:03Speaker 2: Is he bald? Yes? Does he have a mustache? Yes?
- 2:05Speaker 2: Is he doctor Phil from Texas? No? He is not.
- 2:08Speaker 2: He's a chiropractor.
- 2:10Speaker 3: Doctor Phil is suing Jim Moorecroft for two thousand, three
- 2:15Speaker 3: hundred and thirty dollars for unpaid chiropractor bills. Jim Morecroft
- 2:22Speaker 3: is countersuing doctor Phil for the same amount of money,
- 2:27Speaker 3: exact same amount.
- 2:28Speaker 1: Of Wow, okay, great now.
- 2:30Speaker 3: Judge Faith immediately says, mister Morecroft, you're suing him for
- 2:33Speaker 3: the exact same amount.
- 2:34Speaker 2: Is that a coincidence?
- 2:36Speaker 3: Mister Morecroft, I'm not sure if he's all there, because
- 2:38Speaker 3: he's like, well, your honor, that's how much he's suing
- 2:40Speaker 3: me for.
- 2:41Speaker 2: So I figured it was a good number.
- 2:43Speaker 3: So you can tell the case is going well for Jim.
- 2:46Speaker 3: So let's talk to doctor Phil first. Not that doctor Phil,
- 2:49Speaker 3: not that, not that Joe Rogan. So Phil says in
- 2:53Speaker 3: twenty eleven. This case is taking place in twenty seventeen,
- 2:56Speaker 3: so this is six years ago. Jim Morecroft was referred
- 3:01Speaker 3: to me from an orthopedist for a dog bite. His
- 3:04Speaker 3: finger was kind of frozen in place and in a
- 3:07Speaker 3: lot of pain. I did ultrasound on him, evaluated. I
- 3:11Speaker 3: took the case on lean, which means if there was
- 3:14Speaker 3: a judgment that was waiting to happen in a suit
- 3:17Speaker 3: over when it's gonna be paid, that's what it means.
- 3:20Speaker 3: It means he doesn't get the money up front. So
- 3:23Speaker 3: I did an ultrasound, evaluated it, and we I worked
- 3:29Speaker 3: with him, and then when it's time to pay, I
- 3:31Speaker 3: never heard from him. Jim's like, that's not true. You're
- 3:33Speaker 3: on like just out of nowhere, just old white guy.
- 3:36Speaker 3: I'm always right. Just jumps up, that's not true, your honor.
- 3:39Speaker 3: And the bailiff comes in hot, oh yeah. It's like, hey,
- 3:42Speaker 3: you'll get your turn.
- 3:44Speaker 1: Wow.
- 3:44Speaker 3: And he's like and Judge Faith is like, sir, it's
- 3:47Speaker 3: not your turn to talk. It's a whole big thing.
- 3:49Speaker 3: I think they did it because this case is an
- 3:51Speaker 3: interesting aside from that. So Phil says, I saw him
- 3:54Speaker 3: twenty nine times. Wow, from March to September. Twenty nine times.
- 3:59Speaker 3: And that's normal for me. I'm known for working with
- 4:02Speaker 3: extremities like orthopedist. Once they heal it with surgery, they
- 4:07Speaker 3: send it to me. If the function's not fully better.
- 4:10Speaker 1: Sure.
- 4:10Speaker 3: So they're like, all right, mister Morcroft, did you go
- 4:14Speaker 3: see him twenty nine times? He's like, yes, but you
- 4:16Speaker 3: need to hear some backstory. We don't need to hear
- 4:18Speaker 3: some backstory, but we're gonna okay.
- 4:21Speaker 2: He says, uh, let me give you a little history
- 4:23Speaker 2: on the situation.
- 4:24Speaker 3: I'm walking my dog one day and my neighbor's dog
- 4:28Speaker 3: sticks his head out from under the fence and grabs
- 4:31Speaker 3: my dog's leash, pulls him over and is about to
- 4:34Speaker 3: grab him. And in the process of freeing my dog
- 4:37Speaker 3: from that dog, he bit me on both hands and
- 4:40Speaker 3: across my right knuckles, and it was a mess.
- 4:43Speaker 2: I had nine stitches.
- 4:45Speaker 3: I had to go see an orthopedist and they and
- 4:47Speaker 3: then they sent me to doctoring the dog's owner. We're
- 4:50Speaker 3: getting there because he is, oh, this is his whole
- 4:53Speaker 3: claim is he's suing the dog's owner, and because that
- 4:56Speaker 3: judgment hasn't been rendered, he doesn't owe them money because
- 4:59Speaker 3: of the lean. That's the whole bit. So they sent
- 5:03Speaker 3: me to doctor Pinto to get the functionality my handbag.
- 5:05Speaker 3: That the hand is back, My functionality's back. I sued
- 5:10Speaker 3: the owner of the dog, and the judge ruled that
- 5:13Speaker 3: there was no strict liability, which meant that the dog
- 5:16Speaker 3: and the other dog's owner was not at fault. And
- 5:20Speaker 3: she goes, oh, so the judge didn't rule in your favor,
- 5:22Speaker 3: and he says, yes, but we're in appeal right now.
- 5:25Speaker 3: We're in appeal right now, and so that means the
- 5:27Speaker 3: case isn't over, and so I don't dispute the fact
- 5:31Speaker 3: that doctor Pinto.
- 5:32Speaker 2: Saw me twenty nine times. I dispute the fact that
- 5:34Speaker 2: I owe him any.
- 5:35Speaker 3: Money because the lean that we signed is dependent upon
- 5:39Speaker 3: that case being rendered, and when I get the money
- 5:42Speaker 3: from that case, then he gets his money. Not only
- 5:45Speaker 3: do I have that verbally from him, but I have
- 5:47Speaker 3: that in a written agreement. Faith says, show me the
- 5:50Speaker 3: written agreement. He brings her something and she says, this
- 5:54Speaker 3: doesn't say that at all. Oh, And he's like, yes,
- 5:57Speaker 3: it does, and she says, no, this is a statement
- 6:01Speaker 3: that there is a lean against this payment, and it
- 6:03Speaker 3: is the court case in which you had with the
- 6:06Speaker 3: dog's owner that has been adjudicated. And he says, but
- 6:10Speaker 3: I'm in appeal of that court case. Even though they
- 6:13Speaker 3: ruled against me. I'm appealing it, which means I don't
- 6:16Speaker 3: have to pay you just yet. At this point, doctor
- 6:19Speaker 3: Phil's wife stands up. Her name is Marcia Pinto, and
- 6:23Speaker 3: she says, hey, I do the paperwork. I've never met
- 6:26Speaker 3: mister Morecroft, but I deal with this all the time.
- 6:28Speaker 3: In any personal injury case, we always have a lean.
- 6:31Speaker 3: We don't take the money until their case is settled.
- 6:34Speaker 3: And I have the paperwork that says not only did
- 6:36Speaker 3: he sign this, but he also signed that we were
- 6:39Speaker 3: doing the money regardless of.
- 6:40Speaker 2: The outcome of the case. Oh and even if it's.
- 6:43Speaker 3: An appeal, we're do the money.
- 6:45Speaker 1: Wow.
- 6:45Speaker 3: Doctor Pinto says, here are two documents. One he filled
- 6:48Speaker 3: out himself, the other he signed. And Jim Morecroft is like, one,
- 6:51Speaker 3: I don't remember filling on any document myself. And two,
- 6:54Speaker 3: I've never met that woman in my life. I want
- 6:56Speaker 3: that on the record. I've never met that woman in
- 6:57Speaker 3: my life. And Faith is like, mister Moore, she said
- 7:01Speaker 3: she'd never met you. We've got it, and he's like, no,
- 7:04Speaker 3: I want it on the record. So they put it
- 7:06Speaker 3: on the record. And then Faith said, look, she's never
- 7:09Speaker 3: seen you.
- 7:10Speaker 2: I don't know what the big deal is.
- 7:11Speaker 3: And he says, look, Judge Faith, once this court case
- 7:14Speaker 3: is handled, I'm gonna pay him, but I'm not gonna
- 7:17Speaker 3: do it until the court case is done. I'm an
- 7:19Speaker 3: appeal that's what.
- 7:21Speaker 1: A leen means.
- 7:22Speaker 3: I'm an appeal lean mean dog Biden machine, that's what
- 7:26Speaker 3: it means. Uh.
- 7:28Speaker 2: And she I'm gonna go ahead and say she's ready
- 7:30Speaker 2: to rule.
- 7:31Speaker 4: Wow, do we have any proof that he is an
- 7:35Speaker 4: appeal Nope, Okay, I don't really know how the appeal
- 7:40Speaker 4: process works and how that affects Aleen.
- 7:42Speaker 1: To be honest with you, I don't know.
- 7:46Speaker 2: You know.
- 7:46Speaker 4: My My guess is, since the what appears to be
- 7:51Speaker 4: the court has informed doctor Phil and his wife that
- 7:56Speaker 4: uh it was the court did not rule in Jim's favor.
- 8:00Speaker 4: Since they got that's notice, that's the only thing that
- 8:03Speaker 4: they have to work with right now. And because of that,
- 8:06Speaker 4: their judge faith is going to rule and their favor.
- 8:10Speaker 3: Well, you're right, except you're just way kinder than Faith is.
- 8:13Speaker 3: Faith is like, that's not what this says at all.
- 8:15Speaker 3: And he says, yes it is, and she says nope,
- 8:18Speaker 3: and then she reads, I understand that such payment to
- 8:20Speaker 3: doctor Pinto is not contingent upon any settlement or judgment.
- 8:24Speaker 3: His payment is not contingent upon the case. After it
- 8:28Speaker 3: is adjudicated, the judge ruled not in your favor. You
- 8:32Speaker 3: can appeal it all you want, maybe you win, maybe
- 8:34Speaker 3: you lose. Doctor Pinto gets his money. It is we
- 8:38Speaker 3: are not waiting on that any longer. That is not
- 8:40Speaker 3: what this says. This says that doctor Pino gets paid.
- 8:42Speaker 3: It's not if you get your money does he get paid?
- 8:44Speaker 3: He gets paid period. Your countersuit is ridiculous. I'm throwing
- 8:47Speaker 3: it out. Here's two and three hundred thirty dollars and
- 8:50Speaker 3: my big question is two three hundred and thirty dollars
- 8:53Speaker 3: for twenty nine.
- 8:54Speaker 2: Visits is a steal? Right? That's under one hundred dollars
- 8:58Speaker 2: a visit? Nothing that's impressive.
- 9:02Speaker 1: Actually, maybe he has good.
- 9:04Speaker 2: Entrance for a chiropractor. Yeah, California, Man, they're wild there. Wow,
- 9:08Speaker 2: that's just like they want people to be healthy. It's
- 9:10Speaker 2: easy out there. I so worse. What do you got?
- 9:13Speaker 4: I want to go to Judge Jerry rest in peace,
- 9:16Speaker 4: not Jerry himself, but the show. I want to introduce
- 9:19Speaker 4: you to Erstin Hair. Urstin Hair. He is suing for
- 9:25Speaker 4: three thousand, four hundred and seventy five dollars for car damage.
- 9:30Speaker 4: Uh and uh he is suing Sean Nance. Now Sean
- 9:35Speaker 4: is not who he is suing Urstin Sorry, Sean is
- 9:41Speaker 4: the CEO.
- 9:42Speaker 1: Of the company in which he is so.
- 9:44Speaker 2: Ersten suing the company? Yes, for how much?
- 9:46Speaker 4: Three thousand and seven, three hundred and four hundred, three
- 9:50Speaker 4: thousand three thousand, three hundred, four hundred.
- 9:52Speaker 3: You called out three numbers, three thousand and seven hundred,
- 9:56Speaker 3: three hundred four three thousand, four.
- 9:57Speaker 4: Hundred and seventy five dollars there it is so. Erstin
- 10:01Speaker 4: says that he was involved in a really weird crash,
- 10:06Speaker 4: and he wants to say, first of all, I love jeeps.
- 10:11Speaker 4: Want that on the record.
- 10:12Speaker 1: I'm a part of some really neat jeep clubs. I
- 10:16Speaker 1: know jeeps.
- 10:17Speaker 2: I don't know if there is such a thing as
- 10:19Speaker 2: a neat jeep. Well, that may make some people upset.
- 10:21Speaker 1: You're not a jeep guy, not a jeep. God, she's
- 10:23Speaker 1: so neat, she's so neat.
- 10:25Speaker 2: She jeep.
- 10:26Speaker 1: You get a little, you get the jeep, the jeepnh
- 10:28Speaker 1: the jeep none the wave, jeep wave, jeep wave.
- 10:30Speaker 2: I think that's just a normal wave.
- 10:31Speaker 3: No, I don't understand in South Carolina how you just
- 10:33Speaker 3: don't have any like doors.
- 10:35Speaker 1: Doors, like you've lost your every you have a jeep. Well, okay,
- 10:40Speaker 1: maybe you do whatever you want.
- 10:41Speaker 2: No good luck and gods.
- 10:43Speaker 4: Ummmm. So anyway, he was on his way with his
- 10:46Speaker 4: wife to bring some groceries to his brother who is
- 10:50Speaker 4: older than him, and Erston is sixty nine and looking old.
- 10:54Speaker 4: So his brother is older and I apparently can't get
- 10:57Speaker 4: out of the house.
- 10:58Speaker 1: So he's bringing UH to him some groceries.
- 11:01Speaker 4: Now we're on our way, he says, and I notice
- 11:05Speaker 4: we're coming up on a street that my brother mentioned
- 11:09Speaker 4: has a house that he's interested in.
- 11:11Speaker 1: Okay, okay, And he says, why don't we go take
- 11:14Speaker 1: a drug by?
- 11:15Speaker 2: Why shay that quick?
- 11:17Speaker 4: And that's what his wife pipes up and says, I
- 11:21Speaker 4: suggested we don't do that right now, we just go
- 11:23Speaker 4: deliver the groceries. I didn't want to do a drive by.
- 11:27Speaker 4: You don't want to just to groceries? No drive by today? Yeah,
- 11:30Speaker 4: So he says, I approached the I was approaching the intersection,
- 11:34Speaker 4: and so he says all this that I'm about to
- 11:39Speaker 4: tell you, But then he also shows a map later,
- 11:42Speaker 4: So I'm going to tell you. I'm going to try
- 11:44Speaker 4: to shape up the map.
- 11:46Speaker 2: Shape up that map.
- 11:46Speaker 3: Okay, three two lanes lanes coming up to an intersection.
- 11:53Speaker 2: Okay.
- 11:53Speaker 4: In the left lane, which is a left, straight or turn,
- 11:58Speaker 4: it's you know, both of these lanes are you can
- 12:00Speaker 4: go straight or you can turn right or left.
- 12:01Speaker 1: You know what I'm saying two lanes.
- 12:02Speaker 4: So there's a truck stopped at the intersection trying to
- 12:07Speaker 4: go left. Okay, okay, our guy, Ersten's in the right lane,
- 12:11Speaker 4: got it.
- 12:11Speaker 1: Okay? He decided, you know what, I'm not going.
- 12:14Speaker 4: To go to check out the drive by house because
- 12:17Speaker 4: my wife didn't want to.
- 12:19Speaker 1: He's approaching the intersection. He now has to turn right. Okay.
- 12:22Speaker 4: So he's in the right lane and he's getting ready.
- 12:24Speaker 4: He's approaching it and he's getting ready to turn right
- 12:27Speaker 4: in front of him. Hey, no one's in front of him,
- 12:28Speaker 4: got it. He gets, you know, a little bit of ways.
- 12:32Speaker 4: But he's approaching, he's approaching the intersection, and before he
- 12:36Speaker 4: can turn, the truck decides not to turn left, but
- 12:41Speaker 4: to turn right. So the truck, which is a company
- 12:45Speaker 4: truck for some company, yeah, pulls out in front of Erstin.
- 12:50Speaker 4: Try to turn right. Now, what Erstin does is Ersten
- 12:54Speaker 4: loves his wife and and his jeep, and he is
- 12:58Speaker 4: going to do everything and everything he can't to protect
- 13:01Speaker 4: the things that he loves. So instead of when he
- 13:03Speaker 4: sees the truck's going, he's not gonna turn go straight
- 13:06Speaker 4: and collide with the truck. What he decides to do
- 13:09Speaker 4: is go do a little off roading. So he so
- 13:12Speaker 4: he turns and he ends up hitting a curb, going
- 13:15Speaker 4: up on the curb and connecting with a tree. So
- 13:19Speaker 4: he never hits the truck itself. The truck was coming
- 13:22Speaker 4: and to say.
- 13:23Speaker 2: Sue in the truck company for their reckless drive.
- 13:26Speaker 4: That's exactly right, okay, So to try to not hit
- 13:28Speaker 4: make contact with the truck. Because he loves his uh
- 13:31Speaker 4: loves his jeep and he loves his wife, he decides
- 13:34Speaker 4: to hit and unfortunately when he hit the curb there
- 13:38Speaker 4: was a tree right there as well, ended up hitting
- 13:40Speaker 4: the tree.
- 13:41Speaker 1: So we finally hear from Sean.
- 13:44Speaker 4: Sean is uh the not the person who was in
- 13:47Speaker 4: the car says, uh, my employee did not hit their car,
- 13:51Speaker 4: so it's not our fault. And as you can see,
- 13:54Speaker 4: there was an insurance claim that was made basically like
- 14:00Speaker 4: saying what the situation was, and the insurance was denied.
- 14:04Speaker 1: Because it was not our faults. So the insurance company
- 14:07Speaker 1: came out, came.
- 14:08Speaker 4: Out and said it wasn't their fault, said it wasn't
- 14:10Speaker 4: their faults.
- 14:11Speaker 3: Well you're up the creek, buddy, so and that's it.
- 14:14Speaker 3: Judge Jerry's you're the worst, and yeah, he's not getting
- 14:18Speaker 3: any money. I hate it for Erstin and his love
- 14:20Speaker 3: of jeeps and his wife.
- 14:21Speaker 2: But if the.
- 14:22Speaker 3: Insurance company came out and says that it was his fault,
- 14:25Speaker 3: it was his.
- 14:26Speaker 4: Fault, and say it was his fault, it's just said,
- 14:28Speaker 4: it's not the trucks, and that's all that matters is
- 14:30Speaker 4: it's not the truck's fault.
- 14:30Speaker 2: Becau, he's sue in the truck company. So yeah, sorry, So.
- 14:35Speaker 4: Judge Jerry says, I think it's pretty clear here whose
- 14:38Speaker 4: fault it was. Erstin is gonna get all the money.
- 14:41Speaker 4: He's asking for three four and seventy five dollars. Dan,
- 14:44Speaker 4: you could not be more wrong. Urstin gets all of
- 14:47Speaker 4: his mouth. How Judge Jerry says, it's pretty clear whose
- 14:50Speaker 4: fault it is.
- 14:51Speaker 1: He's gonna go there. That's pretty clear.
- 14:53Speaker 2: It's pretty clear. The driver wasn't he The truck driver.
- 14:56Speaker 1: Wasn't even We saw a diagram though.
- 14:58Speaker 2: That's the dumbest thing I've ever heard.
- 15:00Speaker 1: That's why you got can't So Jerry gives him all
- 15:04Speaker 1: the money. Well, okay, well there you go.
- 15:06Speaker 2: We did everybody. Congratulations.
- 15:08Speaker 4: We're gonna be back next week and with another one
- 15:10Speaker 4: until then, maybe the first to wish you at all Rise.
- 15:17Speaker 2: Yo.
