Mega Edition: Ghislaine Maxwell And The Futile Attempt To Seek Relief From The Supreme Court (10/14/26) · The Epstein Chronicles

• 0:00
Speaker 1: What's up everyone and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. Ever since a jury found Ghislaine Maxwell guilty,
• 0:08
Speaker 1: she's been trying to get her conviction overturned. And she's
• 0:12
Speaker 1: tried every avenue you can possibly imagine to make that happen.
• 0:16
Speaker 1: Well now her last hope is that the Supreme Court
• 0:20
Speaker 1: will take up her case. And while it's a long
• 0:22
Speaker 1: shot to begin with, the Department of Justice has now
• 0:26
Speaker 1: filed a brief, a memo, with the Supreme Court urging
• 0:30
Speaker 1: them to ignore Ghislaine Maxwell's pleas and telling them that
• 0:34
Speaker 1: Ghislaine Maxwell is exactly where she needs to be. So
• 0:37
Speaker 1: in this episode, we're going to dive into an article
• 0:39
Speaker 1: from ABC News and we're going to talk about the
• 0:42
Speaker 1: DOJ and their decision to ask the court to not
• 0:45
Speaker 1: accept the Ghislaine Maxwell petition. Headline, DOJ urges Supreme Court
• 0:51
Speaker 1: to turn away Epstein accomplice Ghislaine Maxwell's appeal. This article
• 0:56
Speaker 1: was authored by James Hill. The Department of Justice on
• 1:00
Speaker 1: Monday urged the Supreme Court to turn away an appeal
• 1:03
Speaker 1: from Ghislaine Maxwell, the former associate of sex offender Jeffrey Epstein,
• 1:08
Speaker 1: who is currently serving a 20-year prison sentence for conspiring
• 1:12
Speaker 1: with and aiding Epstein in his sexual abuse of underage girls.
• 1:16
Speaker 1: An associate, huh? I think what you mean is a
• 1:20
Speaker 1: fellow child abuser, a bipedal serpent, and a human trafficker.
• 1:25
Speaker 1: That's what you mean, right? Maxwell, 63, had urged the
• 1:30
Speaker 1: court earlier this year to review her case, arguing that
• 1:33
  Speaker 1: an unusual co-conspirators clause in Epstein's 2007 non-prosecution agreement with
• 1:39
Speaker 1: the federal prosecutors in Florida bartered subsequent prosecution in New York.
• 1:44
Speaker 1: A district court and a federal appeals court previously rejected
• 1:48
Speaker 1: that argument, and the DOJ today urged the high court
• 1:51
Speaker 1: to do the same. And like I've said before, I
• 1:54
Speaker 1: highly doubt that the Supreme Court is even going to
• 1:57
Speaker 1: take the case up. With all the other things cooking
• 1:59
Speaker 1: right now in the country, it just doesn't seem like
• 2:01
Speaker 1: the kind of case that warrants the Supreme Court taking
• 2:05
Speaker 1: a look at it. If the Supreme Court's going to
• 2:08
Speaker 1: be taking a look at anything that has to do
• 2:10
Speaker 1: with Jeffrey Epstein, they should be looking at the NPA itself.
• 2:14
Speaker 1: Because I don't know how that's constitutional. That contention is incorrect.
• 2:21
Speaker 1: and petitioner does not show that it would succeed in
• 2:24
Speaker 1: any court of appeals, wrote U.S. Solicitor John D. Sauer.
• 2:28
Speaker 1: At the Court of Maxwell's petition for SCOTUS review is
• 2:31
Speaker 1: her contention that the language of Epstein's non-prosecution agreement specifically
• 2:36
Speaker 1: limited his protection to the Southern District of Florida, whereas
• 2:41
Speaker 1: the language of the co-conspirator clause should have been read
• 2:44
Speaker 1: to prohibit her prosecution in any federal district. And that's
• 2:48
Speaker 1: where they're wrong. It's not binding. And furthermore, DOJ guidelines
• 2:53
Speaker 1: don't allow that kind of agreement to be put into
• 2:56
Speaker 1: action by a assistant U.S. attorney. That has to be
• 3:00
Speaker 1: something that's agreed upon by other attorneys in other districts
• 3:04
Speaker 1: where this is going to be binding. And none of
• 3:07
Speaker 1: that occurred. So according to the DOJ and according to
• 3:11
Speaker 1: the appeals court and the district court that heard the
• 3:14
Speaker 1: case previously, Maxwell doesn't have a leg to stand on.
• 3:18
Speaker 1: And I haven't seen anything in Maxwell's briefings or memoranda
• 3:21
Speaker 1: that would change my mind on that. And as far
• 3:24
Speaker 1: as I'm concerned, like I said previously, Ghislaine Maxwell is
• 3:27
Speaker 1: exactly where she belongs. And that's behind bars. And it's
• 3:30
Speaker 1: because of her own crimes. Not because what Jeffrey Epstein did,
• 3:35
Speaker 1: but what she did in furtherance of Jeffrey Epstein's proclivities
• 3:39
Speaker 1: and degeneracy. And not only that, but she took part
• 3:42
Speaker 1: in the abuse herself, if you're listening to what the
• 3:45
Speaker 1: survivors have to say. So yeah, I don't want to
• 3:48
Speaker 1: hear shit about an appeal for Ghislaine Maxwell. Sorry, she
• 3:51
Speaker 1: should rot for all 20 years. The co-conspirator clause stated
• 3:56
Speaker 1: that if Epstein successfully fulfills all the terms and conditions
• 3:59
Speaker 1: of this agreement, the United States also agrees that it
• 4:03
Speaker 1: will not institute any criminal charges against any potential co-conspirators
• 4:07
Speaker 1: of Epstein, including but not limited to four of Epstein's assistants.
• 4:12
Speaker 1: Maxwell was not among the four women named. And the
• 4:16
Speaker 1: four women named were Leslie Groff, Sarah Kellan Vickers, Adriana Ross,
• 4:22
Speaker 1: and Nadia Marcinkova. And those are the women that I
• 4:25
Speaker 1: refer to as the core four. They were the women
• 4:28
Speaker 1: that made everything move in the world of Epstein. But
• 4:31
Speaker 1: they were all lieutenants to Ghislaine Maxwell. If you look
• 4:35
Speaker 1: at it as like a mafia, Ghislaine Maxwell was the underboss.
• 4:38
Speaker 1: And those four women, they were like the capos. They
• 4:41
Speaker 1: reported to Glenn Maxwell and Jeffrey Epstein, except Nadia Marcinkova,
• 4:46
Speaker 1: that's a little different. And that's because she was purchased
• 4:49
Speaker 1: by Jeffrey Epstein when she was 14 and groomed for
• 4:52
Speaker 1: the role that she was inserted into. So how much
• 4:56
Speaker 1: can you hold against her, right? I think that's one
• 4:58
Speaker 1: of those touchy areas, one of those touchy subjects that
• 5:01
Speaker 1: needs more of a scalpel approach as opposed to a
• 5:04
Speaker 1: hammer because she was brought into that as a child.
• 5:07
Speaker 1: So it's a different type of deal. But Maxwell was
• 5:11
Speaker 1: never named. She was one of the unnamed co-conspirators at
• 5:14
Speaker 1: the time. And according to her, that should be enough
• 5:16
Speaker 1: for her not to be prosecuted. Unfortunately for her, all
• 5:20
Speaker 1: of the courts that she's been in previously have disagreed
• 5:23
Speaker 1: with her and agreed with the government. And unless there's
• 5:26
Speaker 1: some kind of seismic change, I don't see the Supreme
• 5:29
Speaker 1: Court doing anything different. So if I was Glenn Maxwell,
• 5:33
Speaker 1: and thank God I'm not, I would be prepared for
• 5:36
Speaker 1: a lot more pain and suffering coming down the pipe.
• 5:39
Speaker 1: Despite the existence of a non-prosecution agreement promising in plain
• 5:42
Speaker 1: language that the United States would not prosecute any co-conspirator
• 5:46
Speaker 1: of Jeffrey Epstein, the United States in fact prosecuted Ghislaine
• 5:50
Speaker 1: Maxwell as a co-conspirator of Jeffrey Epstein, her attorneys wrote
• 5:54
Speaker 1: in their petition to the SCOTUS in April. The DOJ, however,
• 5:58
Speaker 1: argues in their response that the U.S. Attorney's Office in Florida,
• 6:02
Speaker 1: then led by R. Alexander Acosta, did not intend to
• 6:06
Speaker 1: bind other federal districts And had no authority to do
• 6:09
Speaker 1: so without the approval of those districts or the criminal
• 6:12
Speaker 1: division of the DOJ. And that's what I was just saying.
• 6:16
Speaker 1: You can't make that decision for all the other districts.
• 6:19
Speaker 1: There's a whole process that it has to go through.
• 6:22
Speaker 1: And it didn't go through that process. So that's why
• 6:24
Speaker 1: Glenn Maxwell's argument has failed and is going to continue
• 6:28
Speaker 1: to fail. And there is no indication here that anyone
• 6:32
Speaker 1: involved in negotiating Epstein's NPA... obtained the necessary approval for
• 6:37
Speaker 1: binding other USAOs, or thought it was necessary, the DOJ's
• 6:42
Speaker 1: brief states. The DOJ also contends that, even if the
• 6:47
Speaker 1: co-conspirators clause could be read to apply nationwide as Maxwell claims,
• 6:51
Speaker 1: there's no evidence that the parties who negotiated the NPA
• 6:55
Speaker 1: intended for the co-conspirators clause to benefit Maxwell, who the
• 6:58
Speaker 1: government describes as at most an incidental third-party beneficiary of
• 7:03
Speaker 1: the agreement. The government was not even aware of Maxwell's
• 7:07
Speaker 1: role in Epstein's scheme at the time, Sauer wrote, and
• 7:11
Speaker 1: urged that the justices deny Maxwell's petition for certification. I
• 7:16
Speaker 1: don't really believe that that's true, though. Pretty sure the
• 7:19
Speaker 1: government knew exactly who Maxwell was. At the very least,
• 7:24
Speaker 1: they knew who she was down in Florida. So I
• 7:27
Speaker 1: don't know if that's really true, honestly. But maybe she
• 7:30
Speaker 1: wasn't a target at the time. That's possible. Maybe they
• 7:33
Speaker 1: didn't know the extent... of Maxwell's involvement, but I do
• 7:36
Speaker 1: find that hard to believe. In a statement on Monday,
• 7:39
Speaker 1: an attorney for Maxwell hinted at the swirling controversy surrounding
• 7:43
Speaker 1: the Trump administration's decision not to release any further records
• 7:47
Speaker 1: related to investigations of Epstein. I'd be surprised if President
• 7:52
Speaker 1: Trump knew his lawyers were asking the Supreme Court to
• 7:55
Speaker 1: let the government break a deal. He's the ultimate dealmaker,
• 7:59
Speaker 1: and I'm sure he'd agree that when the United States
• 8:02
Speaker 1: gives its word, it should keep it. With all the
• 8:05
Speaker 1: talk about who's being prosecuted and who isn't, it's especially
• 8:08
Speaker 1: unfair that Glenn Maxwell remains in prison based on a
• 8:11
Speaker 1: promise the government made and broke, wrote David Oscar Marcus.
• 8:17
Speaker 1: Talk about packaging a bunch of bullshit and serving it
• 8:20
Speaker 1: up as filet mignon. Buddy, nobody's buying that. Not even
• 8:24
Speaker 1: Trump's crazy ass. Can you imagine right now if the
• 8:28
Speaker 1: DOJ was to do something crazy about Glenn Maxwell? It
• 8:32
Speaker 1: would be absolute insanity. So I highly doubt that's going
• 8:36
Speaker 1: to happen. And if Glenn Maxwell is lined up for
• 8:39
Speaker 1: a pardon, I would say that that would happen later
• 8:41
Speaker 1: on down the road. That would be more likely. So
• 8:44
Speaker 1: I don't see the pardon coming either, but you never know.
• 8:47
Speaker 1: It certainly wouldn't be the first time that I was
• 8:49
Speaker 1: shocked when it comes to something Jeffrey Epstein related. Sigrid McCauley,
• 8:54
Speaker 1: an attorney who represented hundreds of alleged Epstein victims, including
• 8:59
Speaker 1: one of the trial's key witnesses against Maxwell, told ABC
• 9:02
Speaker 1: News in a statement that Maxwell... should stay behind bars.
• 9:06
Speaker 1: Understatement of the year. After two decades plus of recruiting
• 9:10
Speaker 1: and abusing young girls trapped in Jeffrey Epstein's sex trafficking enterprise,
• 9:14
Speaker 1: Ghislaine Maxwell has again attempted to escape accountability by trying
• 9:18
Speaker 1: to hide behind the non-prosecution agreement. Maxwell does not deserve
• 9:23
Speaker 1: any protection, and she should remain in prison for the
• 9:26
Speaker 1: horrific crimes that she committed, wrote McCauley, a managing partner
• 9:30
Speaker 1: at Boys, Schiller & Flexner. Maxwell, who pleaded not guilty
• 9:34
Speaker 1: to all criminal charges against her, was convicted by a
• 9:37
Speaker 1: jury in 2021 on five of six counts, including conspiracy
• 9:42
Speaker 1: sex trafficking of a minor and transporting a minor with
• 9:45
Speaker 1: intent to engage in criminal sexual activity. Sure, let's give
• 9:49
Speaker 1: her a pardon. Let's let her out. Let's argue that
• 9:52
Speaker 1: Ghislaine Maxwell doesn't belong in prison. Bunch of fucking nimrods.
• 9:58
Speaker 1: Prosecutors allege that Maxwell was played a key role in
• 10:01
Speaker 1: a multi-state sex trafficking scheme in which he allegedly befriended
• 10:05
Speaker 1: and later enticed and groomed multiple minor girls to engage
• 10:09
Speaker 1: in sex acts with Epstein and was also at times
• 10:12
Speaker 1: present for and involved in the abuse herself. Well, there
• 10:15
Speaker 1: you go. Exactly the problem with the whole Ghislaine Maxwell
• 10:19
Speaker 1: should be free. Why is she in prison? Well, here's
• 10:22
Speaker 1: an idea, dum-dum. Have an idea about what you're talking
• 10:24
Speaker 1: about before you open your mouth. But I guess that
• 10:27
Speaker 1: would be way too much to ask from the White
• 10:29
Speaker 1: Binder Brigade, right? Actually have an idea of the bullshit
• 10:33
Speaker 1: you're pumping? All they care about is access. And if
• 10:36
Speaker 1: that means running propaganda, so be it. What do they care?
• 10:40
Speaker 1: A unanimous jury has found Ghislaine Maxwell guilty of one
• 10:43
Speaker 1: of the worst crimes imaginable, facilitating and participating in the
• 10:47
Speaker 1: sexual abuse of children. Then U.S. Attorney Damian Williams said
• 10:51
Speaker 1: in a statement following the verdict. Alright, so in the
• 10:55
Speaker 1: next couple of episodes, we'll be taking a look at
• 10:58
Speaker 1: the memo that the DOJ sent to the Supreme Court.
• 11:02
Speaker 1: But until then, that's going to do it for this one.
• 11:04
Speaker 1: All of the information that goes with this episode can
• 11:07
Speaker 1: be found in the description box. What's up everyone and
• 11:11
Speaker 1: welcome to another episode of the Epstein Chronicles. Fresh off
• 11:15
Speaker 1: of her meeting with the DOJ, Ghislaine Maxwell has now
• 11:18
Speaker 1: filed a reply to the United States government with the
• 11:22
Speaker 1: Supreme Court in hopes of having the Supreme Court take
• 11:25
Speaker 1: up her case. So in this episode, we're going to
• 11:28
Speaker 1: take a look at that brief that was filed by
• 11:30
Speaker 1: Ghislaine Maxwell and we're going to see what she has
• 11:33
Speaker 1: to say for herself. Case number 24-1073. Ghislaine Maxwell, a.k.a.
• 11:41
Speaker 1: Sealed Defendant No. 1, Petitioner, v. United States of America.
• 11:46
Speaker 1: Reason for granting the petition. This case presents a straightforward
• 11:50
Speaker 1: and important question about the government's obligation to honor the
• 11:54
Speaker 1: promises in plea and non-prosecution agreements. The petition asks whether
• 11:59
Speaker 1: a U.S. attorney's promise made on the behalf of the
• 12:02
Speaker 1: United States binds the entire United States. The government's brief
• 12:07
Speaker 1: in opposition only underscores the importance of this question. Most significantly,
• 12:13
Speaker 1: the government concedes a circuit split on the issue, effectively
• 12:17
Speaker 1: admitting that defendants' rights hinge on the happenstance of geography.
• 12:22
Speaker 1: Such an acknowledged conflict among the circuits demands the court's intervention.
• 12:27
Speaker 1: Rather than grapple with the core principles of plea agreements,
• 12:30
Speaker 1: the government tries to distract by reciting a lurid and
• 12:34
Speaker 1: irrelevant account of Jeffrey Epstein's misconduct. But this case is
• 12:38
Speaker 1: about what the government promised, not what Epstein did. Even
• 12:43
Speaker 1: more remarkably, the government advances an interpretation of its non-prosecution
• 12:48
Speaker 1: agreement that flips its plain meaning on its head. Promising
• 12:52
Speaker 1: not to prosecute someone meant preserving the right to prosecute.
• 12:56
Speaker 1: That is not contract interpretation, it is alchemy. Plea agreements
• 13:00
Speaker 1: are supposed to be strictly construed against the government, yet
• 13:04
Speaker 1: here the government isn't even asking for the benefit of
• 13:07
Speaker 1: the doubt. It's asking for a blank check to rewrite
• 13:10
Speaker 1: its own promise after the fact. The government's only real
• 13:14
Speaker 1: argument is that the Second Circuit rule is correct on
• 13:16
Speaker 1: the merits, while the other circuits have it wrong. We
• 13:20
Speaker 1: obviously disagree, but regardless, the court should grant this writ
• 13:26
Speaker 1: so that all circuits employ the same rule. The circuit
• 13:30
Speaker 1: split presents an exceptionally important question. Plea and non-prosecution agreements
• 13:35
Speaker 1: resolve nearly every federal case. They routinely include promises that
• 13:40
Speaker 1: extend to others, co-conspirators, family members, potential witnesses. If those
• 13:45
Speaker 1: promises mean different things in different parts of the country,
• 13:48
Speaker 1: then trust in our system collapses. The court should grant
• 13:52
Speaker 1: this writ and restore consistency and credibility to the government's word. 1.
• 13:59
Speaker 1: The government concedes that the circuits are split as to
• 14:01
Speaker 1: whether a promise on behalf of the United States by
• 14:05
Speaker 1: a United States Attorney's Office in one district is binding
• 14:08
Speaker 1: upon other districts. The government, like the Second Circuit in
• 14:13
Speaker 1: the opinion below, agrees that there is a clear split
• 14:17
Speaker 1: on the precise question posed by this petition. Opposition at
• 14:22
  Speaker 1: 13 United States v. Maxwell 118 4 4 256 263 N3,
• 14:29
Speaker 1: 2nd Circuit, 2024. Recognizing that circuits have been split on
• 14:35
Speaker 1: this issue for decades, as the 2nd Circuit noted, the
• 14:38
Speaker 1: conflict is well-documented and long-standing. Indeed, the government points out
• 14:43
Speaker 1: that litigants have sought the court's clarification of this issue
• 14:48
Speaker 1: at least as far back as 2011, when the court
• 14:51
  Speaker 1: denied a writ in Prisco v. U.S. 562 U.S. 1290, 2011.
• 14:58
Speaker 1: The government seeks to minimize the split as of limited
• 15:05
Speaker 1: importance because the scope of a plea or similar agreement
• 15:08
Speaker 1: is under the control of the parties to that agreement.
• 15:11
Speaker 1: Opposition at 14. This turns a blind eye to the problem.
• 15:16
Speaker 1: The very premise of Petitioner's argument is that the parties
• 15:19
Speaker 1: to the MPA did not seek to control the scope
• 15:23
Speaker 1: of the relevant clauses. by narrowing the scope of immunity
• 15:26
Speaker 1: for Epstein through the use of narrow language, specifying enforceability
• 15:31
Speaker 1: only in the Southern District of Florida, and then expanding
• 15:34
Speaker 1: the scope of it as co-conspirators by using the broad
• 15:38
Speaker 1: term United States. While doing so, Epstein's lawyers were no
• 15:42
Speaker 1: doubt informed by how that language was interpreted in the
• 15:46
Speaker 1: jurisdiction in which they were practicing. Yet by definition, the
• 15:51
Speaker 1: issue presented in this case, and every other like it,
• 15:54
Speaker 1: only arises when the language in question is being interpreted
• 15:58
Speaker 1: by a different jurisdiction than the one where the agreement
• 16:01
Speaker 1: was negotiated. Accordingly, uniformity in interpretation of such a provision
• 16:07
Speaker 1: is unusually and particularly compelling. The very nature of a
• 16:12
Speaker 1: clause of this nature, unlike most other clauses in an
• 16:16
Speaker 1: agreement which are not cross-jurisdictional in nature, cries out for
• 16:20
Speaker 1: nationwide symmetry. The government also contends, rather bizarrely, that this
• 16:27
Speaker 1: is not itself a case that turns on any default rule.
• 16:31
Speaker 1: Opposition at 14. To the contrary, it is precisely the
• 16:36
Speaker 1: Second Circuit's default rule, adopted in the United States v. Anabi,
• 16:40
  Speaker 1: 771 F. 2D 670 Second Circuit, 1985, that doomed petitioner to
• 16:47
Speaker 1: stand trial on a case that would have been dismissed
• 16:50
Speaker 1: outright in at least half the country. The primary reason
• 16:54
Speaker 1: this court should grant the writ is to create one
• 16:57
Speaker 1: single default rule across the country as to what parties
• 17:01
Speaker 1: mean when they use the term United States without further qualification.
• 17:07
Speaker 1: The Second Circuit's decision below is wrong and violates the
• 17:10
Speaker 1: principles set forth in this court's opinions. In attempting to
• 17:15
Speaker 1: defend the Second Circuit's outcome, the government advances a series
• 17:20
Speaker 1: of contentions about the Epstein-NPA scope. the U.S. Attorney's Authority,
• 17:25
Speaker 1: contract law doctrines, and canons of construction. Each lacks merit.
• 17:31
Speaker 1: As the government acknowledges opposition at eight, the starting point
• 17:35
Speaker 1: in any contract is the text. Here, the text could
• 17:39
Speaker 1: not be more clear. In exchange for Epstein's guilty plea
• 17:42
Speaker 1: and other penalties and concessions, the United States and also
• 17:46
Speaker 1: agrees that it will not institute any criminal charges against
• 17:50
Speaker 1: any potential co-conspirator of Epstein, including but not limited to
• 17:55
Speaker 1: four names. This promise is unqualified. It's not geographically limited
• 18:00
Speaker 1: to the Southern District of Florida. It's not conditioned on
• 18:04
Speaker 1: the co-conspirators being known by the government at the time.
• 18:07
Speaker 1: It does not depend on what any particular government attorney
• 18:10
Speaker 1: may have had in his or her head about who
• 18:14
Speaker 1: might be a co-conspirator. and it contains no other caveat
• 18:18
Speaker 1: or exception. This should be the end of the discussion.

• 18:28
Speaker 1: When a plea rests in any significant degree on a
• 18:31
Speaker 1: promise or agreement of the prosecutor so that it can
• 18:34
Speaker 1: be said to be part of the inducement or consideration,
• 18:38
Speaker 1: such promise must be fulfilled, ignored by the government in
• 18:42
Speaker 1: its opposition. The government seeks to evade this straightforward language
• 18:47
Speaker 1: by focusing on other clauses in the MPA and on
• 18:50
Speaker 1: extrinsic context, but its efforts only underscore that the plain
• 18:55
Speaker 1: meaning favors petitioner. First, the government notes, as did the
• 18:59
Speaker 1: Second Circuit, that the MPA explicitly limited Epstein's own immunity
• 19:04
Speaker 1: to the Southern District of Florida, pointing to a clause
• 19:07
Speaker 1: stating that after Epstein fulfilled the agreement, no prosecution for
• 19:11
Speaker 1: the offenses set out in pages 1 or 2 of
• 19:13
Speaker 1: this agreement will be instituted in this district. The government
• 19:18
Speaker 1: then urges the court to follow it through the looking glass,
• 19:21
Speaker 1: offering inexplicable suggestion that the absence of a similar in
• 19:26
Speaker 1: this district qualifier in the co-conspirator clause should be ignored
• 19:30
Speaker 1: as immaterial. Opposition at 9. Of course, basic interpretive canons
• 19:36
Speaker 1: point in exactly the opposite direction. When parties include an
• 19:39
Speaker 1: express territorial limitation in one clause of a contract and
• 19:44
Speaker 1: omit it in another, the omission must be presumed intentional.

Speaker 1: Idea 170 Here the drafters knew how to confine the
• 20:07
Speaker 1: promise to a single district to they did so for
• 20:10
Speaker 1: Epstein personal non-prosecution assurance. Yet, when it comes to Epstein's
• 20:14
Speaker 1: potential co-conspirators, the drafters chose broad, unqualified language. In fact,
• 20:21
Speaker 1: not only did the parties use an unrestricted jurisdictional clause
• 20:25
Speaker 1: for the co-conspirators, they amended the document from the previous
• 20:28
Speaker 1: draft in which the co-conspirator immunity was limited to the
• 20:32
Speaker 1: Southern District of Florida, changing it to refer more broadly
• 20:36
Speaker 1: to the United States. The government's interpretation cannot be correct
• 20:42
Speaker 1: if the United States means just the Southern District of Florida.
• 20:46
Speaker 1: Why specify the district for Epstein? The only logical inference
• 20:50
Speaker 1: is that the co-conspirator promise was meant to reach, more broadly,
• 20:54
Speaker 1: in line with its different phrasing. At the very least,
• 20:57
Speaker 1: there is a textual ambiguity and under Santabello and the
• 21:01
Speaker 1: contract interpretation principle, such ambiguity must be construed against the
• 21:07
Speaker 1: government and as the drafter and promisor, CEG United States v.

Speaker 1: Carmichael 216, Second Circuit 2000. We can strew plea agreements
• 21:18
Speaker 1: strictly against the government, internal citation, OPR report, at 80
• 21:23
Speaker 1: and 166, confirming that AUSA wrote the specific language in question.
• 21:30
Speaker 1: Under any normal reading of this contract, then no federal
• 21:33
Speaker 1: charges can be brought against any co-conspirator in any district
• 21:37
Speaker 1: of the United States. Reading the MPA as a whole
• 21:42
Speaker 1: means giving effect to the deliberate difference in phrasing between
• 21:45
Speaker 1: the Epstein Focus Clause and the Co-Conspirator Clause. It means
• 21:50
Speaker 1: recognizing that when the parties intended to mean only in
• 21:53
Speaker 1: the Southern District of Florida, they said so explicitly, and
• 21:57
Speaker 1: that their use of the all-encompassing term the United States
• 22:00
Speaker 1: is in the co-conspirator clause was purposeful. The government's evocation
• 22:05
Speaker 1: of context and the purported purpose of the MPA is
• 22:09
Speaker 1: no more persuasive. The government suggests that a broad grant
• 22:13
Speaker 1: of immunity cannot be made because there was no consultation
• 22:18
Speaker 1: with the Southern District of New York. The record does
• 22:21
Speaker 1: not permit such a conclusion as the district court denied
• 22:24
Speaker 1: a hearing and the petitioner was not granted any discovery,
• 22:28
Speaker 1: so there is no way to confirm who was consulted.
• 22:31
Speaker 1: But the record is clear in any event that the
• 22:34
Speaker 1: MPA was signed on behalf of the United States Attorney
• 22:37
Speaker 1: for the Southern District of Florida, who was heavily involved
• 22:40
Speaker 1: in the negotiation and approval process. Notice how he says involved?
• 22:45
Speaker 1: And heavily involved, but not the one who did it?
• 22:48
Speaker 1: Keep that in mind. Oscar David Marcus might be a
• 22:51
Speaker 1: smarmy motherfucker, but he knows what he's doing. And he
• 22:54
Speaker 1: knows exactly what he's saying. But the record is clear
• 22:57
Speaker 1: in any event that the MPA was signed on behalf
• 23:00
Speaker 1: of of the United States Attorneys for the Southern District
• 23:03
Speaker 1: of Florida. In addition, representatives of the Department of Justice
• 23:07
Speaker 1: were also actively involved in the drafting and approval process,
• 23:11
Speaker 1: including the Chief of the Child Exploitation and Obscenity Section
• 23:16
Speaker 1: and the Principal Deputy Assistant Attorney General for the Department's
• 23:20
Speaker 1: Criminal Division, OPR 272884. If these officials felt to do
• 23:26
Speaker 1: what their internal policy suggested was appropriate, it is irrelevant.
• 23:30
Speaker 1: The provision in the U.S. Attorney's Manual advising U.S. attorneys
• 23:35
Speaker 1: not to bind other districts was relevant in OPR's review
• 23:38
Speaker 1: of the government attorney's actions in the case. It does
• 23:41
Speaker 1: not inform the outcome here. However, despite the government's heavy
• 23:46
Speaker 1: reliance on it throughout the brief, what a prosecutor should
• 23:50
Speaker 1: have done is not relevant. Whether or not the Southern
• 23:53
Speaker 1: District of Florida should have prohibited the Southern District of
• 23:56
Speaker 1: New York from prosecuting Ghislaine Maxwell, it clearly did so.
• 24:00
Speaker 1: Nor can the government's appeal to context exclude petitioner from
• 24:04
Speaker 1: the clear including but not limited to language, which unmistakably
• 24:08
Speaker 1: signaled an intent to cover all potential co-conspirators, not just
• 24:12
Speaker 1: those who were specifically named. Indeed, the broad including but
• 24:17
Speaker 1: not limited to clause shows the parties contemplated both known
• 24:21
Speaker 1: and unknown accomplices, and it was the government who drafted,
• 24:25
Speaker 1: in the final broad language, intentionally declining to further enumerate individuals.
• 24:31
Speaker 1: The purpose was to assure Epstein that pleading guilty would
• 24:34
Speaker 1: protect all his associates from federal prosecution, effectively closing the
• 24:39
Speaker 1: federal case completely. That purpose is perfectly consistent with the
• 24:43
  Speaker 1: plain text. It's the government's after-the-fact spin that's inconsistent, attempting
• 24:48
Speaker 1: to import unwritten limits that the dealmakers did not include.
• 24:53
Speaker 1: The government's argument across the board is essentially an appeal
• 24:57
Speaker 1: to what wishes the agreement had said. rather than what
• 25:01
Speaker 1: it actually says. Of course, if wishful thinking were the standard,
• 25:05
Speaker 1: the whole MPA would have been thrown out long ago.
• 25:08
Speaker 1: The government has spent years lamenting that agreement and initiated
• 25:12
Speaker 1: a massive OPR investigation into its execution, which resulted in
• 25:16
Speaker 1: OPR's conclusion that the attorneys who negotiated it on behalf
• 25:20
Speaker 1: of the government did many things contrary to internal government
• 25:24
Speaker 1: policy and typical practices. The entire co-conspirator provision itself, putting
• 25:30
Speaker 1: aside the issue of jurisdiction, in which it is enforceable,
• 25:34
Speaker 1: was according to OPR unusual for such an agreement. But
• 25:38
Speaker 1: as the amicus notes, the fact that the deal was
• 25:41
Speaker 1: unconventional does not license the government or the courts to
• 25:45
Speaker 1: rewrite it to conform to ordinary preferred governmental practice, amicus
• 25:49
Speaker 1: brief at five. To the contrary, it underscores that Epstein's
• 25:53
Speaker 1: negotiators sought and obtained an expansive guarantee. The government also
• 25:58
Speaker 1: suggests that Petitioner is not entitled to enforce the MPA
• 26:02
Speaker 1: because she was not a party to it and was
• 26:05
Speaker 1: not named in it. Opposition at 15. But as the
• 26:09
Speaker 1: court below recognized, and as Hornbook contract law dictates, Maxwell
• 26:13
Speaker 1: has standing to enforce the agreement as a third-party beneficiary.
• 26:18
Speaker 1: Petitioner falls squarely within the class of persons, any potential
• 26:22
Speaker 1: co-conspirator of Epstein that the MPA expressly protected. She is
• 26:26
Speaker 1: therefore an intended beneficiary of the agreement and she has
• 26:30
Speaker 1: standing to enforce it. Petitioners allege status as Epstein's co-conspirator
• 26:36
Speaker 1: was the entire basis of her prosecution. The NPA's language
• 26:40
Speaker 1: demonstrates that the parties anticipated that there were additional co-conspirators
• 26:45
Speaker 1: beyond those that were already known. By using, including but
• 26:49
Speaker 1: not limited to, before naming some individuals, the government knowingly
• 26:53
Speaker 1: extended the benefit of bargained to other unnamed individuals who
• 26:57
Speaker 1: participated in Epstein's offenses. Whether the government attorneys personally knew
• 27:02
Speaker 1: the identities of every such person is beside the point.
• 27:06
Speaker 1: They certainly knew there could be others, hence the language.
• 27:09
Speaker 1: Ghislaine Maxwell's name was well known to Epstein's circle and
• 27:13
Speaker 1: was referenced in public reporting at the time of the NPA.
• 27:17
Speaker 1: But even if she had been entirely unknown, the broad
• 27:20
Speaker 1: language of the NPA evidences an intent to cover whoever
• 27:25
Speaker 1: might later be deemed a co-conspirator. Accordingly, Petitioner can rely
• 27:30
Speaker 1: on the immunity clause in the NPA. The government's suggestion
• 27:36
Speaker 1: that it would have drafted the agreement differently, had it
• 27:39
Speaker 1: specifically had Petitioner in mind, is both unprovable and irrelevant.
• 27:44
Speaker 1: If anything, the inclusion of specific names alongside a general
• 27:47
Speaker 1: category shows the parties knew some of the players and
• 27:51
Speaker 1: also wanted to cover others to prevent any federal prosecution
• 27:55
Speaker 1: of Epstein's circle. Whether or not this was wise, it
• 27:58
Speaker 1: was the deal, and petitioner is entitled to enforce it.
• 28:02
Speaker 1: This case is an ideal vehicle for resolving the split
• 28:06
Speaker 1: over this important and recurring question. It's hard to imagine
• 28:09
Speaker 1: a more compelling scenario for this court's review. For decades now,
• 28:13
Speaker 1: the same federal promises yielded opposite results in different jurisdictions,
• 28:18
Speaker 1: undermining the uniformity of federal law and the integrity of
• 28:22
Speaker 1: plea bargains nationwide. This court's review is warranted. Conclusion. For
• 28:27
Speaker 1: the foregoing reasons, this court should grant the petition. Respectfully
• 28:33
Speaker 1: submitted by David Oscar Marcus. And this document was dated
• 28:37
Speaker 1: July 28th, 2025. All of the information that goes with
• 28:42
Speaker 1: this episode can be found in the description box. What's
• 28:46
Speaker 1: up everyone and welcome to another episode of the Epstein Chronicles.
• 28:50
Speaker 1: In the previous episode, we were talking about the broader
• 28:53
Speaker 1: impact of the Supreme Court deciding not to hear Ghislaine
• 28:57
Speaker 1: Maxwell's appeal. So in this episode, we're going to build
• 28:59
Speaker 1: on that a little bit, and we're going to talk
• 29:01
Speaker 1: about how that might affect prosecuting some of Jeffrey Epstein's
• 29:05
Speaker 1: other co-conspirators that we know for a fact were co-conspirators.
• 29:10
Speaker 1: And that, of course, means the four women named as
• 29:13
Speaker 1: co-conspirators as part of that NPA. So let's dive in.
• 29:20
Speaker 1: The Supreme Court's refusal to hear Ghislaine Maxwell's appeal has
• 29:23
Speaker 1: done more than end her legal fight. It's quietly shaken
• 29:27
Speaker 1: the very foundation of protection that's long insulated Jeffrey Epstein's
• 29:31
Speaker 1: inner circle. The decision signals that the 2007 non-prosecution agreement
• 29:36
Speaker 1: out of the Southern District of Florida, once wielded like
• 29:39
Speaker 1: a magic shield by his alleged co-conspirators, might finally be
• 29:43
Speaker 1: losing its power. For years, that deal served as an
• 29:46
Speaker 1: invisible barrier between accountability and the four women most often
• 29:51
Speaker 1: named as Epstein's lieutenants. Sarah Kellan, also known as Sarah Vickers,
• 29:55
Speaker 1: Leslie Groff, Adriana Ross, and Nadia Marcinkova. Each of them
• 30:01
Speaker 1: was explicitly identified in federal filings as an unindicted co-conspirator,
• 30:05
Speaker 1: and each has lived in the shadow of a deal
• 30:08
Speaker 1: they never personally signed but benefited from immensely. With the
• 30:12
Speaker 1: Supreme Court's silence, that protection now looks paper thin, especially
• 30:16
Speaker 1: outside of Florida. Sarah Kellan, perhaps the most publicly recognizable
• 30:21
Speaker 1: of the four, served as Epstein's personal scheduler, recruiter, and gatekeeper.
• 30:27
Speaker 1: Survivors described her as the one who called, arranged, and
• 30:30
Speaker 1: coordinated their encounters, sometimes preparing massage tables, handing out oils,
• 30:34
Speaker 1: and instructing girls on what to do before Epstein arrived.
• 30:38
Speaker 1: During Maxwell's 2021 trial, Judge Allison Nathan even referred to
• 30:43
Speaker 1: Kellen as a knowing participant in Epstein's criminal conspiracy. Yet,
• 30:47
Speaker 1: she's never faced charges. For years, federal prosecutors avoided touching her,
• 30:52
Speaker 1: citing the lingering shadow of the Florida MPA. But that
• 30:56
Speaker 1: unspoken hesitation was built on the assumption that the deal's
• 31:00
Speaker 1: co-conspirator immunity might stand. The Supreme Court's decision to leave
• 31:04
Speaker 1: Maxwell's appeal untouched effectively kills that presumption. There is no
• 31:09
Speaker 1: longer any controlling authority suggesting that Kellen, or anyone else,
• 31:13
Speaker 1: can hide behind Epstein's Florida deal outside of that jurisdiction.
• 31:17
Speaker 1: And that matters enormously, because so much of Epstein's trafficking
• 31:20
Speaker 1: network wasn't confined to Palm Beach. It extended through Manhattan,
• 31:25
Speaker 1: the U.S. Virgin Islands, New Mexico, and beyond. If Kellan
• 31:29
Speaker 1: arranged flights scheduled victims across state lines or coordinated appointments
• 31:33
Speaker 1: in New York, that's all conduct outside southern Florida and
• 31:37
Speaker 1: thus well outside the reach of the Florida MPA. Federal
• 31:41
Speaker 1: prosecutors in Manhattan or the Virgin Islands now have a
• 31:44
Speaker 1: much freer hand to pursue those acts without worrying about
• 31:47
Speaker 1: triggering a co-conspirator immunity defense. What once looked like a
• 31:51
Speaker 1: bureaucratic technicality has become a doorway, one that investigators, if
• 31:56
Speaker 1: they have the courage to, may soon walk through. Leslie Groff,
• 32:01
Speaker 1: Epstein's long-serving executive assistant, has also lived under the same umbrella.
• 32:06
Speaker 1: She was more than an employee, she was the administrative
• 32:08
Speaker 1: heart of the entire operation. Groff handled Epstein's schedules, arranged travel,
• 32:14
Speaker 1: managed the household staff, and kept the paper trail clean.
• 32:17
Speaker 1: For years, she was shielded from prosecution because her name
• 32:21
Speaker 1: appeared in the NPA's list of potential co-conspirators. In practical terms,
• 32:26
Speaker 1: that meant prosecutors were wary of touching her. But the
• 32:30
Speaker 1: Maxwell ruling, by refusing to extend that immunity to Ghislaine herself,
• 32:34
Speaker 1: effectively tells every US attorney in the country that the
• 32:38
Speaker 1: NPA's reach ends at the borders of Florida. Groff's daily communications,
• 32:43
Speaker 1: her New York City travel coordination, her logistical work for
• 32:47
Speaker 1: Epstein's Manhattan townhouses, all of it could be fair game now.
• 32:51
Speaker 1: What makes Groff's case particularly precarious is that the evidence
• 32:54
Speaker 1: against her overlaps with Maxwell's. Many of the same emails,
• 32:58
Speaker 1: calendar entries, and staff directives that implicated Maxwell also trace
• 33:02
Speaker 1: back to Groff. In any future indictment, prosecutors could simply
• 33:06
Speaker 1: reframe the conspiracy as one of interstate coordination. where the
• 33:11
Speaker 1: key overt acts occurred not in Florida, but in New
• 33:14
Speaker 1: York or the Virgin Islands. By structuring charges around non-Florida conduct,
• 33:19
Speaker 1: prosecutors can sidestep the MPA completely. Groff's defense would likely
• 33:24
Speaker 1: still try to invoke it, but after Maxwell's failed appeal,
• 33:28
Speaker 1: the argument would carry little weight outside of Palm Beach. Now,
• 33:32
Speaker 1: Adriana Ross's situation is equally precarious, but for different reasons.
• 33:37
Speaker 1: Once a model, and later a personal assistant to Epstein...
• 33:40
Speaker 1: Ross was allegedly involved in concealing evidence. She's been accused
• 33:44
Speaker 1: of removing computers from Epstein's Florida mansion when law enforcement
• 33:47
Speaker 1: began closing in, and of helping Maxwell manage sensitive records.
• 33:52
Speaker 1: Those actions were precisely the kind of obstruction that helped
• 33:55
Speaker 1: sustain Epstein's criminal enterprise. And while those acts began in Florida,
• 33:59
Speaker 1: investigators have long suspected that Ross's digital cleanup extended across jurisdictions,
• 34:05
Speaker 1: especially when it came to transferring files to New York
• 34:08
Speaker 1: or offshore servers. In that light, Chi Tu could be
• 34:13
Speaker 1: vulnerable to fresh charges in other federal districts. The beauty
• 34:18
Speaker 1: and the danger of the current legal landscape is in
• 34:21
Speaker 1: its nuance. Prosecutors don't have to claim that the NPA
• 34:24
Speaker 1: was void, they simply have to assert that its geographic
• 34:27
Speaker 1: scope was limited. They can carve out fresh indictments and
• 34:31
Speaker 1: focus on interstate travel, financial transfers, or communications that originated
• 34:36
Speaker 1: outside Florida. For Ross and That could mean facing a
• 34:39
Speaker 1: conspiracy charge based on her alleged role in helping move
• 34:43
Speaker 1: or hide digital evidence beyond state lines. For Groff, it
• 34:47
Speaker 1: could mean federal wire fraud, transportation charges tied to Epstein's
• 34:50
Speaker 1: Manhattan base. For Kellen, the recruitment and grooming of victims
• 34:54
Speaker 1: across multiple states. Each woman's exposure grows with every email,
• 34:59
Speaker 1: flight manifest, or transaction that crossed jurisdictional boundaries. And then
• 35:05
Speaker 1: there's Nadia Marcinkova. perhaps the most enigmatic figure of them all.
• 35:10
Speaker 1: A licensed pilot, she was frequently described as both Epstein's
• 35:13
Speaker 1: protege and participant and victim. Some victims testified that she
• 35:18
Speaker 1: took part in encounters. Others said that she was there
• 35:22
Speaker 1: to normalize or assist them. She also flew on Epstein's
• 35:26
Speaker 1: private jets, log-in flights that crisscrossed the United States and
• 35:30
Speaker 1: the Caribbean. The aviation role alone puts her directly in
• 35:34
Speaker 1: the crosshairs of a federal jurisdiction. Every leg of every
• 35:37
Speaker 1: flight that carried an underage victim across state or international
• 35:40
Speaker 1: lines could constitute a separate Mann Act violation, and none
• 35:44
Speaker 1: of that would be protected by the Florida deal. For Marcinkova,
• 35:48
Speaker 1: the denial of Maxwell's appeal is potentially devastating. If the
• 35:52
Speaker 1: Florida MPA doesn't apply outside its home district, then any trafficking, transportation,
• 35:57
Speaker 1: or facilitation acts tied to other states or... Countries are
• 36:01
Speaker 1: now wide open. Prosecutors in New York, New Jersey, or
• 36:05
Speaker 1: even the U.S. Virgin Islands could argue that our flight
• 36:07
Speaker 1: activity constitutes independent crimes under federal law. And because aviation
• 36:13
Speaker 1: records are meticulously maintained, or should be, they wouldn't have
• 36:16
Speaker 1: to rely on hearsay or decades-old witness statements. The proof
• 36:20
Speaker 1: would already exist in black and white. FAA logs, tail numbers,
• 36:25
Speaker 1: passenger lists, and customer declarations. The Maxwell decision just cleared
• 36:30
Speaker 1: the last legal fog blocking those potential charges. Now, each
• 36:34
Speaker 1: of these women has maintained relative obscurity since Epstein's death,
• 36:38
Speaker 1: living quietly and staying out of public view. That low
• 36:41
Speaker 1: profile may have worked when prosecutors were wary of reigniting
• 36:45
Speaker 1: the legal minefield around the NPA. But now, with that
• 36:48
Speaker 1: chill weakened, obscurity may not save them. And now there's
• 36:52
Speaker 1: a growing sense in the legal community that this could
• 36:55
Speaker 1: be the moment where prosecutors re-examine every previously off-limits co-conspirator,
• 37:00
Speaker 1: deciding whether the Supreme Court's silence is, in fact, permission
• 37:04
Speaker 1: to act. The Maxwell appeal denial didn't just close her case,
• 37:08
Speaker 1: it could have cracked everyone else's wide open. Now to
• 37:12
Speaker 1: understand why, consider how prosecutors think. They're risk-adverse. They don't
• 37:17
Speaker 1: like wasting time on cases that might collapse under procedural defenses.
• 37:21
Speaker 1: For years, the NPA's vague language about potential co-conspirators scared
• 37:25
Speaker 1: them off. No one wants to be the test case
• 37:28
Speaker 1: that a defense lawyer could drag into appellate limbo. But
• 37:31
Speaker 1: now that Maxwell herself, a named co-conspirator and Epstein's closest confidant,
• 37:36
Speaker 1: failed to convince any federal judge, much less the Supreme Court,
• 37:40
Speaker 1: that the NPA shielded her, that hesitation begins to fade.
• 37:43
Speaker 1: Or should. The legal precedent, or rather, Lack of one
• 37:47
Speaker 1: now favors action. If even Ghislaine Maxwell, with world-class lawyers
• 37:52
Speaker 1: and unlimited resources, couldn't convince the courts that the NPA
• 37:55
Speaker 1: protected her, it's hard to imagine a judge in Manhattan
• 37:59
Speaker 1: or D.C. entertaining that argument from a lesser-known assistant. The
• 38:03
Speaker 1: judicial signal is unmistakable. The NPA was local, narrow, and
• 38:08
Speaker 1: not a get-out-of-jail-free card for the entire network. Any prosecutor
• 38:13
Speaker 1: who wants to bring charges against Kellen, Groff, Ross, or
• 38:16
Speaker 1: Marcinkova can now do so with reasonable chance of surviving
• 38:20
Speaker 1: early dismissal. This change also has political resonance. The Epstein
• 38:26
Speaker 1: scandal remains one of the most notorious failures of federal
• 38:29
Speaker 1: justice in modern history. Each of these women has come
• 38:33
Speaker 1: to symbolize a system that allowed enablers to walk free
• 38:36
Speaker 1: while survivors endured decades of silence. The Supreme Court's move,
• 38:42
Speaker 1: even if procedural, could be interpreted as an invitation to
• 38:46
Speaker 1: fix that imbalance. It's a rare opportunity for prosecutors to
• 38:50
Speaker 1: rewrite the legacy of the case, to show that the
• 38:52
Speaker 1: law can reach beyond the convenient boundaries of the Florida
• 38:55
Speaker 1: plea deal struck in secret almost 20 years ago. Now,
• 39:00
Speaker 1: for survivors and their advocates, this development means hope. Hope
• 39:04
Speaker 1: that accountability might finally extend beyond Maxwell. They've long argued
• 39:08
Speaker 1: that the NPA was a betrayal, a backroom deal that
• 39:11
Speaker 1: immunized the guilty without consent from those harmed. The denial
• 39:15
Speaker 1: of Maxwell's appeal does not undo that injustice, but it
• 39:19
Speaker 1: may finally strip the NPA of its untouchable status. It
• 39:22
Speaker 1: reframes the conversation from, they can't be charged, to, should
• 39:27
Speaker 1: they be charged? A subtle but monumental shift. Yet the
• 39:32
Speaker 1: road ahead won't be so simple. Prosecutors must still overcome
• 39:36
Speaker 1: evidentiary decay, expired memories, and logistical hurdles of decades-old crimes,
• 39:42
Speaker 1: but those challenges are tactical, not legal. The strategic barrier,
• 39:46
Speaker 1: the fear that a court would toss the case because
• 39:49
Speaker 1: of the NPA, is fading fast. In the world of
• 39:53
Speaker 1: federal prosecution, that's often enough to change everything. When the
• 39:56
Speaker 1: perceived risk drops, the appetite for justice grows. Look, it's
• 40:01
Speaker 1: also worth noting that any new charges would likely focus
• 40:04
Speaker 1: on interstate or international acts, not local recruitment in Palm Beach.
• 40:08
Speaker 1: That's by design. By anchoring cases in non-Florida jurisdictions, prosecutors
• 40:14
Speaker 1: can avoid any entanglement with the NPA's original framework. The
• 40:18
Speaker 1: Maxwell decision makes this strategy not just possible, but appealing.
• 40:23
Speaker 1: In legal circles, it's called venue insulation, crafting indictments so
• 40:28
Speaker 1: they live outside the reach of prior immunities. For the
• 40:31
Speaker 1: Epstein Network, it's the most viable path toward renewed accountability. Now,
• 40:36
Speaker 1: some legal analysts that I've talked to have even predicted
• 40:39
Speaker 1: that a domino effect would follow. If one co-conspirator is
• 40:43
Speaker 1: indicted successfully, say Kellen in New York, the others could
• 40:46
Speaker 1: soon follow, either through cooperation deals or parallel prosecutions. Once
• 40:52
Speaker 1: a single district court upholds the idea that the Florida
• 40:55
Speaker 1: MPA doesn't protect them, the precedent could ripple across the country.
• 41:00
Speaker 1: Prosecutors love momentum, and in cases like this, momentum is everything.
• 41:05
Speaker 1: for the women who once thought that Epstein's death ended
• 41:08
Speaker 1: their exposure, the Supreme Court's quiet decision might be the opposite.
• 41:12
Speaker 1: It breathes new life into their legal jeopardy. It means
• 41:16
Speaker 1: that the Florida deal was never a blanket pardon. It
• 41:19
Speaker 1: was a temporary loophole now closing. And in its wake,
• 41:23
Speaker 1: a generation's worth of deferred justice may finally find its footing. Look,
• 41:27
Speaker 1: in the end, the story of the MPA is becoming
• 41:30
Speaker 1: the story of its collapse. For nearly two decades, that
• 41:33
Speaker 1: agreement kept some of the key architects of Epstein's trafficking
• 41:36
Speaker 1: ring insulated from accountability. But the Supreme Court's refusal to
• 41:41
Speaker 1: extend its protection to Maxwell shifts the balance of power.
• 41:45
Speaker 1: It moves the conversation from we can't to we can
• 41:48
Speaker 1: if we choose to. Whether prosecutors act on that new
• 41:52
Speaker 1: freedom remains to be seen. But the legal door, once
• 41:56
Speaker 1: bolted shut, now stands wide open. All of the information
• 42:01
Speaker 1: that goes with this episode can be found in the
