- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're picking up where we left off with
- 0:05Speaker 1: the Tyler Robinson prelim hearing, day number two. And we
- 0:10Speaker 1: left off with the prosecution asking the question, on what day?
- 0:14Speaker 1: And Agent Hall responds, September 10th, 2025. And that, of course,
- 0:19Speaker 1: leads us into today's episode. Question, okay, what just happened?
- 0:24Speaker 1: Or what did we just see happen? Answer, the individual
- 0:28Speaker 1: actually kind of rolls over the railing onto the roof
- 0:30Speaker 1: of the Losey building. Question, all right, go ahead, sorry. Answer,
- 0:35Speaker 1: and again, in the top left corner, the individual is
- 0:37Speaker 1: now seen running across the rooftop of the Losey building
- 0:40Speaker 1: to what would be the southwest corner of the building,
- 0:43Speaker 1: crouching down and then crawling to the corner of the building. Question,
- 0:48Speaker 1: and what time is this at? Answer, around 1223. I
- 0:52Speaker 1: think the timestamp on the video is 1222. Question on
- 0:54Speaker 1: the 10th. Answer, on the 10th, yes, 2025. Question, we're clear,
- 1:01Speaker 1: this is the roof of the Lhotse building. Answer, correct. Question,
- 1:05Speaker 1: can you still see that individual? Answer, yeah, you can,
- 1:08Speaker 1: laying prone. Question, do you believe this to be Mr. Robinson? Answer,
- 1:13Speaker 1: I'm sorry? Question, do you believe this to be Mr. Robinson? Answer,
- 1:18Speaker 1: I do, yes. Question, and how long is he out
- 1:20Speaker 1: there on the edge of that building? Answer, Just until
- 1:24Speaker 1: the reported shot was fired at 12-23-28, the individual then
- 1:28Speaker 1: stands up and then moves across the building to the north. Question,
- 1:32Speaker 1: is that what we're seeing happening now? Answer, it is, yes.
- 1:36Speaker 1: They move behind the atrium area on the rooftop to
- 1:38Speaker 1: the northeast corner where the white triangle is. Question, do
- 1:42Speaker 1: you see Mr. Robinson now? Answer, I do, yes. He
- 1:46Speaker 1: is just arriving at the corner of the building, almost
- 1:48Speaker 1: the top of the center image. Question, what are we
- 1:51Speaker 1: seeing now? Answer, Mr. Robinson lowering and jumping off of
- 1:55Speaker 1: the roof of the low C building onto the grass
- 1:57Speaker 1: area and then moving away towards Campus Drive. And he
- 2:01Speaker 1: appears to be carrying some kind of object in his
- 2:03Speaker 1: hand at this time. Question, so he's approaching? Answer, Campus Drive. Question,
- 2:10Speaker 1: and again, broken into quadrants, where is he currently? Answer,
- 2:14Speaker 1: in the top right quadrant. Question, and the time? Answer,
- 2:17Speaker 1: it's 12-24-42 on the timestamp. Question, what do we see now? Answer,
- 2:23Speaker 1: he then crosses Campus Drive and drops down into the
- 2:26Speaker 1: wooded area on the far side of Campus Drive. Question,
- 2:29Speaker 1: and that's located in what part of the video, what quadrant? Answer,
- 2:33Speaker 1: it would have been just off center on the top
- 2:35Speaker 1: left side. Question, okay, what do we see now? Answer,
- 2:39Speaker 1: this is the intersection of Campus Drive and 800 South.
- 2:43Speaker 1: There's a vehicle attempting to turn right onto Campus Drive.
- 2:46Speaker 1: That's the vehicle that's driven by Mr. Robinson. Question, and
- 2:50Speaker 1: on the screen... Where is the vehicle that you're referring
- 2:52Speaker 1: to located, if you broke it into quadrants? Answer. It's
- 2:56Speaker 1: on the left side. On the upper side, the upper quadrant. Question. Now,
- 3:01Speaker 1: what do we see? Answer. That vehicle is now pulling
- 3:04Speaker 1: away and heading east on 800 south. Question. And why
- 3:08Speaker 1: do you believe that that vehicle was Mr. Robinson's vehicle? Answer.
- 3:12Speaker 1: When the vehicle stopped, it actually made contact with an
- 3:14Speaker 1: officer who was doing security detail. Question. And do you
- 3:18Speaker 1: know who that officer is? Answer. Officer Goforth. Question. Okay.
- 3:23Speaker 1: And do you know which department he works for? Answer.
- 3:26Speaker 1: Spanish Fork Police. Question. And did you have a conversation
- 3:29Speaker 1: with Mr. Goforth regarding this interaction at the intersection? Answer.
- 3:33Speaker 1: I did. Yes. Question. Okay. And what time was that interaction?
- 3:37Speaker 1: I'm sorry. Did I ask you that? Answer. It was
- 3:39Speaker 1: approximately 1230 AM. Question. Okay. On the 11th. Answer. On
- 3:44Speaker 1: the 11th, 2025. Question. So you talked to Officer Goforth
- 3:49Speaker 1: about the contact on the corner. I guess during the
- 3:51Speaker 1: early morning hours of the 11th? Answer, correct. Question, and
- 3:55Speaker 1: what did Officer Goforth tell you about that interaction? Answer,
- 3:59Speaker 1: it was an interaction that I guess cop intuition, but
- 4:02Speaker 1: there was something about the interaction that made him make
- 4:04Speaker 1: note of the license plate of the vehicle. And then subsequently,
- 4:08Speaker 1: when information was available that the vehicle or a vehicle
- 4:12Speaker 1: matching the description of that was involved in the incident,
- 4:15Speaker 1: he ran the information that he had obtained from the stop,
- 4:18Speaker 1: and was able to identify that it was registered to Mr. Robinson.
- 4:21Speaker 1: And he had, in fact, made contact with Mr. Robinson
- 4:24Speaker 1: on the morning of September 11th, 2025. Question the information
- 4:29Speaker 1: that he ran. When you say he ran information, the
- 4:32Speaker 1: agent jumps in, yeah, he ran a partial plate. Question, oh, okay,
- 4:36Speaker 1: a license plate? Answer, correct. Question, and based on that
- 4:40Speaker 1: partial license plate, he was able to identify the owner
- 4:42Speaker 1: of that vehicle? Answer, yes. Question, and did he tell
- 4:46Speaker 1: you who the owner of the vehicle was? Answer, he did, yes. Question, okay.
- 4:52Speaker 1: And who did he tell you that it belonged to? Answer,
- 4:55Speaker 1: that there were two registered owners of the vehicle, Tyler
- 4:58Speaker 1: Robinson and Amber Robinson. Question, did he say anything about
- 5:02Speaker 1: the person that he actually interacted with? Answer, yeah, it
- 5:06Speaker 1: was a male he believed to be Tyler Robinson. Question, okay.
- 5:10Speaker 1: Let's return again to what's been marked State Exhibit 12.1. Again,
- 5:14Speaker 1: you reviewed that video. Agent, yes. Question, okay. And the
- 5:19Speaker 1: difference between 12.1 and what's been marked as state exhibit 12.1
- 5:22Speaker 1: and 12.4, if I understand you correctly, are these enhancements
- 5:26Speaker 1: that we've been talking about. Answer, yes. Question, and specifically
- 5:30Speaker 1: be specific about the enhancements, and let's go one at
- 5:33Speaker 1: a time. Answer, okay. Question, I think there's a reference
- 5:37Speaker 1: to either red circles or red highlights. Answer, correct. Question,
- 5:41Speaker 1: that's how Mr. Olson described it, red highlights. Answer, yes. Question,
- 5:46Speaker 1: what's he referencing by the red highlights? Or what do
- 5:49Speaker 1: you believe that he's referencing? Answer, I believe he's referring
- 5:52Speaker 1: to red ovals or circles that were placed over the
- 5:55Speaker 1: image to identify specific individuals of note. Question, and these
- 6:00Speaker 1: red circles, are they permanent circles? Are they temporary? Anything different? Answer,
- 6:05Speaker 1: I would assume they're temporary. They're not very technological, but
- 6:08Speaker 1: I believe they would be overlaid of the image. Question,
- 6:12Speaker 1: this is a bad question. What I mean by that is,
- 6:14Speaker 1: do they appear and disappear quickly, or do they linger
- 6:17Speaker 1: or last for a period of time? Answer, they're there
- 6:21Speaker 1: for a notable period, but I believe they come off
- 6:23Speaker 1: the video. Question, alright, what do the circles do? Answer,
- 6:28Speaker 1: they identify an area or a person of interest within
- 6:31Speaker 1: the video. Question, and other than that, do the circles
- 6:34Speaker 1: or the highlights, do they do anything with regard to
- 6:37Speaker 1: the video itself, as far as its accuracy? Answer, not
- 6:40Speaker 1: to my knowledge, no. Question, okay, I think the next
- 6:44Speaker 1: enhancement that's been mentioned that we've talked about, is there
- 6:47Speaker 1: some blurring? Answer, yes. Question, tell us what it is.
- 6:53Speaker 1: What blurring do you see? What's been marked as state
- 6:55Speaker 1: exhibit 12.1 that you now don't see in 12.4? Answer,
- 7:00Speaker 1: if I recall, there were some individuals in the parking
- 7:02Speaker 1: garage footage and their faces were blurred. Question, anything other
- 7:06Speaker 1: than faces being blurred? Answer, not that I recall, no. Question,
- 7:11Speaker 1: And how often do you see the blurring throughout the video? Answer.
- 7:14Speaker 1: I believe it's just in the original sequence in the
- 7:17Speaker 1: parking garage. Question. Well, the blurring, other than obviously blur
- 7:21Speaker 1: out part of the image, does it change or impact
- 7:24Speaker 1: the accuracy in your mind of that part of the
- 7:27Speaker 1: compilation video? Answer. Not to my knowledge, no. Question. And
- 7:32Speaker 1: then the last thing is, I believe there's some zooming
- 7:35Speaker 1: in and zooming out. That's 12.1. That has been removed.
- 7:39Speaker 1: And 12.4. Answer, yes. Question, what can you tell us
- 7:44Speaker 1: about the zooming in and zooming out? Answer, predominantly it's
- 7:48Speaker 1: in the area that was referred to as viewing the
- 7:50Speaker 1: Losey Building rooftop. I believe it focuses on the area
- 7:54Speaker 1: where Mr. Robinson comes up the stairs and onto the rooftop.
- 7:58Speaker 1: Those portions of that particular footage were zoomed in for clarity. Question, okay,
- 8:04Speaker 1: other than zooming in and zooming out, at least that
- 8:07Speaker 1: enhancement to the video, does it change the content of
- 8:10Speaker 1: the video? Answer, no. Question, the accuracy of the video.
- 8:14Speaker 1: In your mind? Answer, no. Question, okay. Are there enhancements
- 8:18Speaker 1: in State Exhibit? Well, it's been marked as State Exhibit 12.1.
- 8:22Speaker 1: Are they helpful in any way? Or what did they
- 8:25Speaker 1: add or take away from that video? Answer, I think
- 8:29Speaker 1: for people who are not familiar with the area and
- 8:31Speaker 1: what's trying to be shown. They are now an opportunity
- 8:34Speaker 1: for people to look at an individual, who we believe
- 8:37Speaker 1: to be Tyler Robinson, and also specific movements with more
- 8:41Speaker 1: clarity than the original focal point gives. Question, so let's
- 8:45Speaker 1: talk about the zooming in and the zooming out. It
- 8:48Speaker 1: sounds like it's specific to the low-sea rooftop, if I
- 8:51Speaker 1: understand you correctly. Answer, yes. Question, okay. And I think
- 8:55Speaker 1: we've all watched that exhibit before. Answer, correct. Question, and
- 9:00Speaker 1: although you can see Mr. Robinson and his movements... Is
- 9:02Speaker 1: it fair to say that it's difficult to really see
- 9:04Speaker 1: what's going on? Answer, that would be fair, yes. Question, okay.
- 9:09Speaker 1: And the version that's 12.1, does it facilitate, at least
- 9:12Speaker 1: that part of the video, seeing Mr. Robinson and tracking,
- 9:15Speaker 1: I guess, his steps? Answer, I believe so, yes. Question, okay, judge.
- 9:21Speaker 1: At this point, I think in combination with yesterday, the
- 9:24Speaker 1: foundation that was laid yesterday, including the written statement from Mr. Olson,
- 9:28Speaker 1: which has been admitted into evidence and is, well, it's
- 9:32Speaker 1: already been admitted into evidence. We believe there's enough foundation
- 9:36Speaker 1: that at this point, we'd also ask the court to
- 9:38Speaker 1: admit what's been marked State Exhibit 12.1. I think it
- 9:42Speaker 1: would be beneficial for Your Honor to view it. Judge Graff, Ms. Nestor,
- 9:47Speaker 1: Kathy Nestor, thank you, Your Honor. We renew our authenticity
- 9:51Speaker 1: objection and we also object for admission purposes. And then
- 9:55Speaker 1: we also object to the publication for the same reason,
- 9:58Speaker 1: the fair trial issues that we raised, with the unaltered
- 10:01Speaker 1: version that was just submitted. Prosecution jumps back in. And judge, sorry,
- 10:06Speaker 1: I neglected to mention the other two. Again, judge, we
- 10:09Speaker 1: believe that the presumption is that this is a public record,
- 10:12Speaker 1: that it should not only be admitted, but it should
- 10:15Speaker 1: be published here in the courtroom and and it should
- 10:17Speaker 1: be published in such a way that the media can
- 10:20Speaker 1: have access to it. Judge Graff, all right, I do
- 10:23Speaker 1: have a question. And just directing your attention to the
- 10:26Speaker 1: Utah Rule of Evidence 403 to the last phrase, the
- 10:29Speaker 1: last four words in that, do you wish to address that? Prosecution, Judge,
- 10:34Speaker 1: I'm going to have to look at 403 specifically for
- 10:37Speaker 1: those last four words, unless you want to share it
- 10:39Speaker 1: with me. Judge, I can read that. Needlessly presenting cumulative evidence,
- 10:45Speaker 1: let me just read the whole rule for completeness. The
- 10:48Speaker 1: court may exclude relevant evidence if its probative value is
- 10:51Speaker 1: substantially outweighed by a danger of one or more of
- 10:54Speaker 1: the following. Unfair prejudice, confusing the issue, misleading the jury,
- 10:59Speaker 1: undue delay, wasting time, or needlessly presenting cumulative evidence. I'm
- 11:04Speaker 1: not looking at anything else other than that last portion.
- 11:07Speaker 1: I recognize there is no jury. I am the magistrate.
- 11:11Speaker 1: I'm the fact finder. But just addressing that last point
- 11:14Speaker 1: of rule 403. Prosecution, right, judge? I don't believe that
- 11:18Speaker 1: the evidence is cumulative. I think that each of the
- 11:21Speaker 1: two videos, although they portray basically the same footage, there's
- 11:25Speaker 1: characteristics of the one that has been enhanced that I
- 11:29Speaker 1: think makes it easier for your honor to truly see
- 11:31Speaker 1: what's going on and for the public to see what's
- 11:34Speaker 1: going on. I mean, we've displayed 12.4 on the video
- 11:38Speaker 1: and unless you have a very, very, very good vision
- 11:41Speaker 1: or you've zoomed in on the monitor, you really can't
- 11:43Speaker 1: see what Agent Hull has just described, the character of 12.1
- 11:48Speaker 1: is it simply enhances that at least important parts of
- 11:51Speaker 1: that exhibit, and it just makes it easier to see,
- 11:54Speaker 1: not only by your honor, but also by the public. We,
- 11:58Speaker 1: not only by your honor, but also by the public,
- 12:01Speaker 1: and specifically as it relates to the zoning, in or
- 12:04Speaker 1: zooming in and zooming out. Judge Graff, okay, anything further
- 12:09Speaker 1: from the parties as it relates to 12.1? All right, well,
- 12:13Speaker 1: I will admit 12.1 into evidence, but as it relates
- 12:16Speaker 1: to playing in the courtroom... or on television for the media,
- 12:19Speaker 1: I find that it is, well, as a fact finder,
- 12:22Speaker 1: I will look at the evidence and weigh it as
- 12:24Speaker 1: a magistrate is required to do. But I do not
- 12:27Speaker 1: find it, I don't find it necessary to replay the video,
- 12:30Speaker 1: given the representation, that's the exact same video, the difference
- 12:34Speaker 1: being enhancements made. If it was different in any way,
- 12:37Speaker 1: or if it added to or subtracted from, that would
- 12:40Speaker 1: be one factor. But because it's simply the same video,
- 12:43Speaker 1: simply zooming in with circles or notations, The court does
- 12:47Speaker 1: not find that the interest of justice requires it being
- 12:50Speaker 1: played again, but it's received into evidence and will be
- 12:53Speaker 1: reviewed by myself in determining a probable cause determination. Prosecution,
- 12:59Speaker 1: and I appreciate that, Judge, and just so we're clear,
- 13:02Speaker 1: State Exhibit 12.1 has been admitted. Judge, it's received into evidence, yes. Prosecution,
- 13:09Speaker 1: and your intent is to review it in its entirety,
- 13:11Speaker 1: but not here in the courtroom? Judge, yes. Prosecution, can
- 13:15Speaker 1: I make one suggestion? Or maybe one run request? I
- 13:20Speaker 1: believe that the most important part, the most helpful part
- 13:22Speaker 1: of the video, is the zooming in and the zooming out.
- 13:26Speaker 1: And that is the portion that, if you want, we
- 13:28Speaker 1: could isolate that and only play that portion of the
- 13:31Speaker 1: video if you'd be willing to publish that portion of
- 13:33Speaker 1: the video. And that's really the thrust of why we're
- 13:36Speaker 1: trying to introduce that exhibit. Because we believe that it's
- 13:39Speaker 1: helpful to see it up close. And unfortunately, because of
- 13:42Speaker 1: the way it's formatted and the way it's been recorded,
- 13:45Speaker 1: There's no way for us to zoom in and out
- 13:48Speaker 1: on this video to get a better look at what's
- 13:50Speaker 1: going on. And that's the reason why we did what
- 13:53Speaker 1: we did. But we had to memorialize it and save
- 13:56Speaker 1: it and then present it in the way rather than
- 13:58Speaker 1: just present it in its raw form and then have
- 14:00Speaker 1: the ability to zoom in and out if that helps.
- 14:03Speaker 1: Your Honor understands why we're doing what we're doing. Judge,
- 14:06Speaker 1: all right, Ms. Nestor. To the second request of not
- 14:09Speaker 1: playing the whole video in its entirety, but simply the
- 14:12Speaker 1: portion with the zooming in, How long is this video, prosecution? Prosecution?
- 14:18Speaker 1: I think it's a couple of minutes. All right, Ms. Nestor.
- 14:22Speaker 1: Kathy Nestor, we object to the prejudice of that, Your Honor,
- 14:25Speaker 1: and ask the court to stand by your previous ruling
- 14:27Speaker 1: on that. Judge Graff, all right. Thank you. I appreciate
- 14:31Speaker 1: both parties. What I'll do is review the video in court,
- 14:34Speaker 1: and it'll be displayed to the monitor council table and
- 14:37Speaker 1: to the court's monitor to any portion that you wish
- 14:39Speaker 1: to play for me to look at so all parties
- 14:42Speaker 1: can see clearly what the court's reviewing in court, but
- 14:45Speaker 1: I do not find that it necessary for its publication
- 14:48Speaker 1: because this is the exact same video. We recognize it's
- 14:51Speaker 1: zooming in, but balancing constitutional rights, there's nothing on the
- 14:55Speaker 1: video from what's been represented to the public that hasn't
- 14:58Speaker 1: already been seen. It's simply zooming in, and I don't
- 15:01Speaker 1: find that that is necessary. So I'm balancing with constitutional
- 15:05Speaker 1: rights of all parties. I'll view it on the monitor.
- 15:08Speaker 1: Counsel's free to view it with me as I'm looking
- 15:11Speaker 1: at it, but it will not be broadcast in the courtroom.
- 15:14Speaker 1: or by the video camera. Prosecution, I appreciate that, Judge.
- 15:18Speaker 1: I respect that. I think there's a natural break where
- 15:20Speaker 1: we can start. And that's what I'm going to ask
- 15:22Speaker 1: is just simply play the most. You will have this
- 15:25Speaker 1: entire exhibit in evidence, though, is that right? Judge Graff,
- 15:29Speaker 1: thank you. Yes, I will. All right, whenever you're ready. Counsel,
- 15:32Speaker 1: as it relates to your monitors, just as a caution,
- 15:34Speaker 1: if you don't want to be wished to be picked up,
- 15:36Speaker 1: and I'm not saying it will, I know there are
- 15:38Speaker 1: camera operators being diligent in ensuring they're complying with the rules.
- 15:43Speaker 1: But in an abundance of caution, this is just your
- 15:46Speaker 1: moment to take care of your screens if you feel
- 15:48Speaker 1: you need to do so. All right, folks, we're going
- 15:50Speaker 1: to wrap up right here. And in the next episode,
- 15:52Speaker 1: we're going to pick up where we left off. All
- 15:54Speaker 1: the information that goes with this episode can be found
- 15:58Speaker 1: in the description box.
