Speaker 1: What's up everyone, and welcome to another episode of the
• 0:03
Epstein Chronicles. In this episode, we're going to pick up
• 0:06
where we left off with tovin Owell and her chat
• 0:10
with Congress Question. I'm going to reference the DOJ OIG
• 0:16
report once more. It said that the MCC security cameras
• 0:19
in the Shoe failed to record any live footage starting
• 0:22
on July twenty ninth, twenty nineteen, and that this malfunction
• 0:27
was not discovered by MCC staff until August eighth, twenty nineteen.
• 0:32
MCC staff, however, then failed to take any action to
• 0:35
fix this malfunction. Therefore, the security cameras did not record
• 0:39
anything on August ninth or August tenth, the day of
• 0:42
mister Epstein's death. It did, however, continue to broadcast live feed.
• 0:48
It also says the report that MCC staff obtained the
• 0:51
replacement hard drives necessary to repair the security camera on
• 0:55
August ninth, but did not complete the repairs to restore
• 0:59
recording functionality. I know that you mentioned this, but did
• 1:02
you know that the security cameras were not working? Answer
• 1:05
no question, And you don't know who was in charge
• 1:09
of making sure that the security camera system was repaired?
• 1:12
Answer no, question did you ever speak with anyone oh
• 1:16
about this failure on August ninth or August tenth? Answer no,
• 1:20
because I wasn't aware that it wasn't working. Question Okay,
• 1:25
do you have any reason to believe mcc staff purposefully
• 1:28
or intentionally did not repair the cameras prior to or
• 1:31
at the time of Epstein's death. Answer I don't have
• 1:35
any reason to believe, but I don't know. Question are
• 1:37
you aware that the FBI conducted interviews on August twenty
• 1:41
eighth and twenty nineteen of inmates that were present the
• 1:45
night of Epstein's death? Answer no question. Are you aware
• 1:49
of any allegations that were made by any Shoe inmates
• 1:52
around that night? Answer no question. Did you ever hear
• 1:56
that One inmate that was in the shoe here recounted
• 1:58
a series of remarks that he heard the morning of
• 2:01
mister Epstein's death. Answer no question. This inmate recalls hearing
• 2:06
the officer's shout breathe, breathe, and then he allegedly heard
• 2:10
an officer say, dude, you killed that dude. Have you
• 2:14
ever heard anything like that? Answer no question. There's also
• 2:18
a quote that he said he heard the female guard
• 2:22
reply with quote. If he's dead, we're going to cover
• 2:24
it up, and he is going to have an alibi
• 2:27
in my officers. The inmate also said that the entire
• 2:30
wing of the prison overheard these remarks, and after learning
• 2:33
that mister Epstein had died, the inmates were saying miss
• 2:36
Noel killed. Jeffrey answered, never heard any of that. Question
• 2:41
did you ever hear any inmates make any accusation about
• 2:44
mister Epstein's death? Answer? No question. What's your response? What
• 2:49
do you think of these allegations? Answer of that question? Yes, answer,
• 2:54
I mean, I'm not aware of anything like that being said,
• 2:57
but they may say anything. Question. Thank you, answer, you're welcome. Question.
• 3:03
We discussed earlier that you altered the counts and rounds
• 3:05
on the reports. Were you ever criminally charged with falsifying
• 3:09
those prison records? Answer? No, Foy altered accounts? What do
• 3:13
you mean altered? Fire brand? Fireband? Excuse me that you
• 3:18
signed off that you had completed them when in fact
• 3:21
you had not completed them. Foy Okay, Noel, yeah, no question,
• 3:26
saying that more accounts and rounds were done then were
• 3:29
actually done? Noel, no question. Were you ever I'm sorry,
• 3:34
I'm going to back up were you ever criminally charged
• 3:36
with falsifying BOP records? Answer Noel, No, mister Foy, yes
• 3:41
you were, you were criminally charged? Noel okay, Foy, right,
• 3:46
I mean question were charges brought against you? Answer? Yes?
• 3:51
Question that's what she's asking. Noel okay, yes. So how
• 3:56
can you believe that tovin Oel is telling the truth
• 3:59
when she can't even get the basics right? And this
• 4:02
is the same thing we've seen time and time again
• 4:04
with people that have come before Congress to talk about
• 4:07
the Knight Epstein died. So if you want to believe
• 4:10
the narrative, go for it. My goal is to provide
• 4:14
you with enough information from these official sources so that
• 4:17
you can come to your decision with as much information
• 4:20
available to you as possible. Question charges were brought against
• 4:28
you for? Answer yes? Question how many counts? Foy? We
• 4:32
don't remember? Question okay, And what was the result of
• 4:35
those charges being brought against you? Answer Noel, Foy dismissed.
• 4:41
Noel dismissed. Question how come it was dismissed? Foy asked
• 4:46
the government they're the ones who dismissed it. Noel, I
• 4:49
read in the report discussion off record Noel comes back.
• 4:54
So there was a a Noel prosecution agreement to dismiss it,
• 4:58
and as a result of that it got to dismissed. Question. So,
• 5:01
just to be clearer for the record, you were criminally
• 5:04
charged with falsifying BOP records and that case those charges
• 5:09
were dismissed. Correct answer, correct question, Thank you. I think
• 5:13
we're wrapping up one hour's worth of questions, but I
• 5:16
have just one final question for you. Is there anything
• 5:18
that we have not covered or touched on today that
• 5:21
you would like to provide the committee in the furtherance
• 5:23
of its investigation into the crimes of Epstein and Maxwell.
• 5:27
Answer no, fair bend. I think we can go off
• 5:30
the record back on question, Miss Noel, just a few
• 5:34
more questions for you and then we'll get you on
• 5:36
your way. Answer, thank you. Question. When we left off,
• 5:40
we were working through a timeline of the night of
• 5:42
the ninth the morning of the tenth. It sounds, I
• 5:46
think pretty clear, but just confirming for us when we
• 5:49
talk about counts from twelve am to three am and
• 5:52
five am counts, those did not occur. Is that right? Answer?
• 5:56
Correct question? And it sounded from the IG report like
• 6:00
maybe around the time of twelve am count or somewhere
• 6:03
in that window, there was communication with Control about adjusting
• 6:06
the numbers. You kind of mentioned this earlier seventy three
• 6:09
or seventy two. What's your recollection of that mix up? Answer?
• 6:13
To the best of my recollection, the count couldn't clear
• 6:16
because the number was off, and I think it had
• 6:18
something to do with that inmate that was not returning.
• 6:20
So Control basically told me what the number is supposed
• 6:22
to be? Question? Got it? Were you the one that
• 6:25
talked to Control? Answer? I honestly don't remember. Could have
• 6:28
been question all right, great, Noel. So there was no
• 6:33
count conducted in the shoe, but upstairs on ten South
• 6:35
I did count with Adams. Question I've got that as well,
• 6:40
and I'll get to that in the timeline. Thank you.
• 6:43
As far as rounds, maybe just between your arrival at
• 6:46
four pm and your ten pm count, did any rounds
• 6:50
occur in that period? Answer? A few of them as
• 6:53
far as I can remember. I don't know. Question any
• 6:56
recollection of around what time or around how many of
• 6:59
You're just not sure? Answer? Not sure? Question okay? And
• 7:04
then after ten or ten thirty whenever that counting occurred
• 7:08
through let's say, delivering breakfast. Were the rounds that occurred? Then?
• 7:12
Answer no question. There was a sign, a physical sign
• 7:16
described in the IG report. It sounds like it was
• 7:18
posted to the shoe officer one of these shoe officer computers,
• 7:22
and the sign said, I'll just read it. It's one
• 7:25
sentence mandatory rounds must be conducted every thirty minutes on
• 7:29
Epstein as per God. And it sounded like at least
• 7:33
a day and an evening watch officer agreed that the
• 7:35
sign was on the computer on that day and night.
• 7:38
Do you have any recollection of ever seeing that? Answer
• 7:41
I don't recall the sign. Question even if it wasn't
• 7:45
that night ever seeing that sign? Answer sign, no question.
• 7:50
It would be tough to answer. But do you have
• 7:52
any sense on what the as per God could be
• 7:55
referenced to? Answer no question. You talked earlier about the
• 8:00
MCC way, could I just ask your opinion? It sounds
• 8:03
like a lot of the issues we described today were widespread,
• 8:06
lack of training, understaffed over time. What's your perspective? Do
• 8:11
you think that the MCC was well run from a
• 8:14
management point of view? Answer no question. What's your perspective
• 8:19
on the extent to which it was either facing challenges
• 8:21
or was poorly run or needed to be fixed in
• 8:24
certain ways. Answer. I later learned a lot of things
• 8:28
that wasn't working, like, for example, the camera system that
• 8:31
would have been like an upper management thing. But as
• 8:34
far as the shortages, it kind of makes it hard
• 8:36
because sometimes management have less to work with, and when
• 8:39
you have less to work with, you're doing things that's
• 8:42
not supposed to be done because sometimes you have one
• 8:44
staff member work in two units. You can't be in
• 8:47
two places at one time, but there's just no manpower.
• 8:51
And as far as what I learned also is this
• 8:54
has been an ongoing issue and the union has asked
• 8:56
for help or asked for more staff, but they don't
• 8:59
get it. So I don't know that it was poorly
• 9:01
I ran because they just didn't have the people that
• 9:05
to do the job. Question Thank you. I think you
• 9:08
said in your statement with the IG, and I think
• 9:11
a moment ago that you went up to ten South
• 9:13
to help the guard do his or her account. Question
• 9:16
counts maybe both three and five? Is that correct? Answer?
• 9:20
Correct question? Was that ordinary in your experience? Answer? Yes? Question?
• 9:26
And why would that be? Answer? Because shortages? Again, there's
• 9:29
one officer up there. So usually because there is two
• 9:32
in the shoe, somebody will cross count with the ten
• 9:35
South officer. Question would it have been normal for there
• 9:39
to be one officer up in ten South or was
• 9:42
that an understaffing problem as well? Was that supposed to
• 9:45
be two officers in ten South? Answer? I know it's
• 9:48
supposed to be too intense South question, but it was
• 9:52
one that night. Answer it was one all the time?
• 9:55
Question got it? Did that officer in ten South come
• 9:58
ask you for help doing his or her I don't
• 10:00
know counts? Answer? No question? How did you end up
• 10:04
doing it that you were helping the officer do the counts? Question?
• 10:07
Because that's just I know that somebody from nine South
• 10:10
goes up to ten South to count. Question presumably ordinarily
• 10:15
somebody in the shoe is also that midnight count and
• 10:18
these other officers around the same time? Answer correct question?
• 10:23
What ended up being the difference as to why one
• 10:26
was happening and why the other was not? Answer so clearly,
• 10:29
I wanted to count because I went to ten South,
• 10:31
but Thomas was sleeping, so I didn't count nine South,
• 10:35
but I went to ten South to count his unit
• 10:37
because he wanted to count. He was, so I counted
• 10:40
up there and I came back down to my unit. Question,
• 10:43
got it? He was awake as far as you could tell.
• 10:45
Answer exactly. Question a lieutenant visited the shoe around four
• 10:51
am to perform around or what do you call it
• 10:54
when a lieutenant? Is that account or around? Answer? To
• 10:58
be honest, I don't know. I just know she comes
• 11:00
around and supposed to do a walk through, But I
• 11:03
don't know as far as for the lieutenant what they
• 11:06
classify it as. Question do you recall was that around
• 11:10
four am? Answer? Around that time? Question? And is it
• 11:14
right that the lieutenant went up and did a count
• 11:16
or around in ten south but not actually in the shoe?
• 11:19
Is that correct? Answer? To be honest, I know she
• 11:22
didn't do it in the shoe, but I can't recall
• 11:24
if she did ten self. All right, folks, we're gonna
• 11:27
wrap up right here, and in the next episode, we're
• 11:29
gonna pick up where we left off. All the information
• 11:32
that goes with this episode can be found in the
• 11:35
  description box.
