- 0:00Speaker 1: What's up everyone and welcome to another episode of the
- 0:02Speaker 1: Epstein Chronicles. In this episode, we're going to pick up
- 0:06Speaker 1: where we left off with the survivor lawsuit filed against
- 0:09Speaker 1: the United States government. H. The FBI's failure to investigate
- 0:14Speaker 1: caused plaintiffs harm. By failing to investigate credible allegations of CSAM,
- 0:19Speaker 1: human trafficking, and sexual abuse, the FBI violated its own
- 0:24Speaker 1: protocol and acted negligently. The FBI's inaction and negligence allowed
- 0:29Speaker 1: this abuse and trafficking, including to plaintiffs, to continue for
- 0:33Speaker 1: over 20 years. Had the FBI followed mandatory protocol and
- 0:37Speaker 1: appropriately responded to that evidence, plaintiffs would not have been raped, molested, trafficked,
- 0:43Speaker 1: and abused. Epstein could not and would not have sexually trafficked, abused, assaulted,
- 0:48Speaker 1: and battered plaintiffs in New York, Florida, New Mexico, the U.S.
- 0:51Speaker 1: Virgin Islands, and elsewhere but for the FBI's negligence, cause
- 0:56Speaker 1: of action, Count number one. Negligence under the voluntary undertaking doctrine.
- 1:02Speaker 1: Plaintiffs incorporate by reference the allegations contained in all preceding paragraphs. Duty.
- 1:08Speaker 1: Under the voluntary undertaking doctrine, one who undertakes gratuitously or
- 1:12Speaker 1: for consideration to render services to another which he should
- 1:16Speaker 1: recognize is necessary for the protection of the third person
- 1:19Speaker 1: or his things is subject to liability to the third
- 1:22Speaker 1: person for physical harm resulting from his failure to exercise
- 1:26Speaker 1: Reasonable care to protect his undertaking if A. His failure
- 1:31Speaker 1: to exercise reasonable care increases the risk of such harm
- 1:35Speaker 1: or B. He's undertaken to perform a duty owed by
- 1:38Speaker 1: the other to the third person or C. The harm
- 1:42Speaker 1: is suffered because of reliance on the other or the
- 1:45Speaker 1: third person upon the undertaking. This duty applies to agents, servants,
- 1:50Speaker 1: and or employees of the FBI and the Department of Justice.
- 1:55Speaker 1: Breach The FBI and the Department of Justice rendered law
- 1:58Speaker 1: enforcement services to American citizens and failed to exercise reasonable care. A.
- 2:04Speaker 1: In complying with mandatory investigative procedure that the FBI had
- 2:09Speaker 1: adopted as the standard of conduct for handling information. B.
- 2:13Speaker 1: In complying with non-discretionary duties not to falsely assure people
- 2:17Speaker 1: possessing credible information and evidence about ongoing sex trafficking. C.
- 2:23Speaker 1: In performing the task of investigating complaints and other information
- 2:26Speaker 1: regarding Epstein's abuse of women and minors. And D. In
- 2:30Speaker 1: the way it handled information regarding Epstein's abuse of women
- 2:34Speaker 1: and minors. The FBI failed to exercise reasonable care in
- 2:38Speaker 1: the following ways, among other negligent acts and omissions already
- 2:42Speaker 1: known and to be revealed in discovery. Failing to properly
- 2:46Speaker 1: investigate or follow up on a report received from Maria
- 2:49Speaker 1: Farmer in 1996 of sexual abuse, trafficking, and CSAM possession. B.
- 2:55Speaker 1: Failing to properly respond to tips and reports regarding sex
- 2:58Speaker 1: trafficking of minors and sexual abuse of minors from 1996
- 3:02Speaker 1: to 2005. C. Failing to investigate or follow up on Ms.
- 3:07Speaker 1: Christensen's allegations of sexual abuse and trafficking in 2005. D.
- 3:13Speaker 1: Failing to follow up on the investigative reports and tips
- 3:16Speaker 1: of suspicious banking activity from financial institutions, including payments, to
- 3:21Speaker 1: minor girls. E. Failing to properly investigate evidence provided by
- 3:26Speaker 1: the Florida Palm Beach Police Department. F. Negligently investigating reports
- 3:31Speaker 1: of a 14-year-old being sexually abused in Epstein's Palm Beach Mansion. G.
- 3:38Speaker 1: Negligently failing to investigate child sexual abuse material during the
- 3:42Speaker 1: 2005 raid of Epstein's Palm Beach Mansion. H. Negligently failing
- 3:47Speaker 1: to interview and assist the victim's whose names were on
- 3:51Speaker 1: the important message from 2001 to 2005. J. Negligently permitting
- 3:57Speaker 1: Epstein to be a judge at a beauty pageant in
- 3:59Speaker 1: the U.S. Virgin Islands in 2007, despite impending charges of
- 4:03Speaker 1: sex trafficking of minors and sex abuse. J. Negligently permitting,
- 4:08Speaker 1: via the clearing of background checks for passengers on Epstein's
- 4:12Speaker 1: private jet, Epstein to traffic minors and young women. K.
- 4:16Speaker 1: Ignoring reports of violence and threats to victims if they
- 4:19Speaker 1: cooperated with authorities. L. Ignoring reports of child sex trafficking. M.
- 4:26Speaker 1: Ignoring evidence of minors procuring other minors for sex abuse. N.
- 4:31Speaker 1: Prematurely closing an FBI file in the face of evidence
- 4:34Speaker 1: of sex trafficking and minor sexual abuse. O. Ignoring reports
- 4:40Speaker 1: of suspicious banking in SARS. P. Ignoring child sexual abuse material.
- 4:45Speaker 1: And C. Porn. and Q. Failing to follow up on
- 4:49Speaker 1: improper issuing of passports and federal passport fraud. The FBI
- 4:54Speaker 1: and the Department of Justice failure to exercise reasonable care
- 4:57Speaker 1: increased the risk of such harm. Indeed, if the FBI
- 5:01Speaker 1: and the Department of Justice had exercised reasonable care, plaintiff
- 5:05Speaker 1: would not have been trafficked or abused. Plaintiff suffered harm
- 5:08Speaker 1: because of the reliance on others, on the FBI and
- 5:11Speaker 1: the Department of Justice and its failure to properly act
- 5:15Speaker 1: including but not limited to Maria Farmer, Audra Christensen, Annie Farmer, J.P. Morgan,
- 5:20Speaker 1: and the Florida Palm Beach Police Department. Causation As a
- 5:25Speaker 1: direct and proximate cause of the FBI and Department of
- 5:27Speaker 1: Justice negligence, plaintiffs would not have been and or would
- 5:31Speaker 1: not have continued to be sex trafficked, abused, raped, tortured,
- 5:35Speaker 1: and threatened. The FBI and the Department of Justice failure
- 5:38Speaker 1: to investigate the tips and information it had received, and
- 5:42Speaker 1: failing to follow its mandatory established protocol, was a direct
- 5:45Speaker 1: and substantial cause of the plaintiff's damages. If the FBI
- 5:50Speaker 1: and Department of Justice had complied with its mandatory obligations
- 5:53Speaker 1: to investigate and intervene based on the information it was receiving,
- 5:58Speaker 1: Epstein would not have been able to continue to commit
- 6:00Speaker 1: the heinous crimes he did against plaintiff. The FBI's repeated
- 6:05Speaker 1: and continued failures, delays, and inaction allowed Epstein and others
- 6:09Speaker 1: to continue their sex trafficking conspiracy for almost 25 years.
- 6:12Speaker 1: Damages As a direct and proximate cause of defendant's negligence,
- 6:18Speaker 1: plaintiffs were sexually abused, raped, assaulted, tormented, violated, harassed, intimidated,
- 6:23Speaker 1: and suffered permanent injuries, including but not limited to severe
- 6:27Speaker 1: emotional and physical pain and suffering, post-traumatic stress disorder, insomnia, anxiety, shock, fear, nightmare, shame, embarrassment,
- 6:36Speaker 1: lost earnings, flashbacks, need for future medical and psychiatric expenses,
- 6:41Speaker 1: and other severe injuries. Count number two Negligence under the
- 6:46Speaker 1: zone of risk doctrine. Plaintiff incorporates by reference all the
- 6:50Speaker 1: allegations contained in all preceding paragraphs. Duty. Under the zone
- 6:55Speaker 1: of risk doctrine, when a person's conduct creates a foreseeable
- 6:58Speaker 1: zone of risk, the law generally will recognize a duty
- 7:01Speaker 1: upon the person to act reasonably in protecting others from harm.
- 7:06Speaker 1: This duty applies to agents, servants, and or employees of
- 7:09Speaker 1: the FBI and the Department of Justice. Breach. The FBI
- 7:14Speaker 1: and Department of Justice fell to exercise reasonable, which created
- 7:18Speaker 1: a foreseeable zone of risk to future Epstein, victims including plaintiffs.
- 7:24Speaker 1: The FBI and Department of Justice fell to exercise reasonable
- 7:27Speaker 1: care in complying with mandatory investigative procedure and the FBI
- 7:32Speaker 1: and the Department of Justice had adopted as the standard
- 7:35Speaker 1: of conduct for handling information, both in the MIOG and elsewhere. B,
- 7:40Speaker 1: in complying with non-discretionary duties, not to falsely assure people,
- 7:45Speaker 1: possessing credible information and evidence about ongoing sex trafficking. C.
- 7:50Speaker 1: In performing the task of investigating complaints and other information
- 7:54Speaker 1: regarding Epstein's abuse of women and minors. And D. In
- 7:58Speaker 1: the way it handled information regarding Epstein's abuse of women
- 8:01Speaker 1: and minors. The FBI and Department of Justice failed to
- 8:05Speaker 1: exercise reasonable care in the following ways, among other negligent
- 8:09Speaker 1: acts and omissions already known, and to be revealed in discovery. A.
- 8:14Speaker 1: Failing to properly investigate or follow up on a report
- 8:17Speaker 1: received from Maria Farmer in 1996 of sexual abuse, trafficking,
- 8:22Speaker 1: and CSAM possession. B. Failing to properly respond to tips
- 8:25Speaker 1: and reports regarding sex trafficking of minors and sexual abuse
- 8:29Speaker 1: of minors from 1996 until 2005. C. Failing to investigate
- 8:33Speaker 1: or follow up on Ms. Christensen's allegations of sexual abuse
- 8:37Speaker 1: and trafficking in 2005. failing to follow up and investigate
- 8:42Speaker 1: reports and tips of suspicious banking activity from financial institutions,
- 8:46Speaker 1: including payments to minor girls, failing to properly investigate evidence
- 8:51Speaker 1: provided by the Florida Palm Beach Police Department, negligently investigating
- 8:55Speaker 1: reports of a 14-year-old being sexually abused in Epstein's Palm
- 8:59Speaker 1: Beach mansion, negligently failing to investigate child sexual abuse material
- 9:04Speaker 1: during the 2005 raid of Epstein's Palm Beach mansion, Negligently
- 9:08Speaker 1: failing to interview and assist the victims whose names were
- 9:12Speaker 1: on the important messages from 2001 to 2005. Negligently permitting
- 9:17Speaker 1: Epstein to be a judge at a beauty pageant in
- 9:19Speaker 1: the U.S. Virgin Islands in 2007, despite impending charges of
- 9:23Speaker 1: sex trafficking of minors and sex abuse. Negligently permitting, via
- 9:28Speaker 1: the clearing of background checks for passengers on Epstein's private jet,
- 9:33Speaker 1: Epstein to sex traffic minors and young women. Ignoring reports
- 9:37Speaker 1: of violence and threats to victims if they cooperated with authorities.
- 9:41Speaker 1: Ignoring reports of child sex trafficking. Ignoring evidence of minors
- 9:46Speaker 1: procuring other minors for sex abuse. Prematurely closing an FBI
- 9:51Speaker 1: file in the face of evidence of sex trafficking and
- 9:54Speaker 1: minor sexual abuse. Ignoring reports of suspicious banking and SARS.
- 9:59Speaker 1: Ignoring child sexual abuse material and child pornography, and failing
- 10:04Speaker 1: to follow up on improper issuing of passports and federal
- 10:07Speaker 1: passport fraud. The FBI and Department of Justice knew or
- 10:12Speaker 1: should have known that its negligence, as described above, would
- 10:15Speaker 1: create a foreseeable zone of risk to future victims of Epstein.
- 10:20Speaker 1: and the FBI and Department of Justice negligence did create
- 10:23Speaker 1: a foreseeable risk to future victims. Causation As a direct
- 10:28Speaker 1: and proximate cause of the FBI and Department of Justice negligence,
- 10:32Speaker 1: plaintiffs would not have been or would have not continued
- 10:35Speaker 1: to be sex trafficked, abused, raped, tortured, and threatened. The
- 10:39Speaker 1: FBI and Department of Justice failure to investigate the tips
- 10:42Speaker 1: and information it received and failing to follow its mandatory
- 10:46Speaker 1: established protocol was a direct and substantial cause of the
- 10:49Speaker 1: plaintiff's damages. If the FBI and Department of Justice had
- 10:53Speaker 1: complied with its mandatory obligation to investigate and intervene based
- 10:58Speaker 1: on the information it was receiving, Epstein would not have
- 11:01Speaker 1: been able to continue to commit the heinous crimes he
- 11:03Speaker 1: did against plaintiffs. The FBI and Department of Justice repeated
- 11:08Speaker 1: and continued failures, delays, and inaction allowed Epstein and others
- 11:12Speaker 1: to continue their sex trafficking conspiracy for almost 25 years.
- 11:15Speaker 1: Damages As a direct and proximate case of defendant's negligence,
- 11:22Speaker 1: plaintiffs were sexually abused, raped, assaulted, tormented, violated, harassed, intimidated,
- 11:28Speaker 1: and suffered permanent injuries, including but not limited to severe
- 11:32Speaker 1: emotional and physical pain and suffering, post-traumatic stress disorder, insomnia, anxiety, shock, fear, nightmares, shame, embarrassment,
- 11:41Speaker 1: lost earnings, flashbacks, and a need for future medical and
- 11:45Speaker 1: psychiatric expenses, and other severe injuries. Request for relief. Plaintiff
- 11:51Speaker 1: respectfully requests the court to enter judgment in their favor
- 11:55Speaker 1: and against the United States as follows. A. That the
- 11:58Speaker 1: court award plaintiff compensatory, consequential, general, and nominal damages, as
- 12:03Speaker 1: well as all other available damages against defendant in an
- 12:06Speaker 1: amount to be determined at trial. B. That the court
- 12:10Speaker 1: award the plaintiff the cost and disbursement of the action,
- 12:14Speaker 1: along with reasonable attorney fees, costs, and expenses. C. That
- 12:18Speaker 1: the court awards pre- and post-judgment interest at a maximum
- 12:21Speaker 1: legal rate. D. The court grant all such and other
- 12:25Speaker 1: further relief as it deems just and proper. Wherefore, plaintiffs
- 12:30Speaker 1: pray that the court, for a judgment against defendant for
- 12:33Speaker 1: an amount in excess of $ 320 million, for compensatory damages
- 12:38Speaker 1: together with cost of the suit, legal interest, reasonable attorney fees,
- 12:42Speaker 1: and other relief as the court may deem just and proper,
- 12:46Speaker 1: under the circumstances. This document was signed by Jordan K.
