Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to get right back to that
- 0:05Speaker 1: Chad Daybell trial and we're going to see what went
- 0:08Speaker 1: down on day number nine. To do that, once again,
- 0:12Speaker 1: we're using eastidahonews.com and this time the author of this
- 0:17Speaker 1: article is Kalama Hines. Headline, day number nine of the
- 0:22Speaker 1: Chad Daybell trial. Fremont deputy describes graphic images of Tammy's body.
- 0:26Speaker 2: 8.31 a.m.
- 0:30Speaker 1: Court is now in session. Chad is wearing a gray
- 0:32Speaker 1: shirt and a yellow tie.
- 0:35Speaker 2: 8.33 a.m.
- 0:36Speaker 1: David Warwick, Melanie Gibbs' husband, is on the stand. His
- 0:39Speaker 1: testimony began yesterday. 8.36 a.m. Pryor will continue the cross. 8.36 a.m.
- 0:48Speaker 1: Pryor asking Warwick about his previous testimony and communications with
- 0:52Speaker 1: prosecuting attorneys. 8.38 a.m. Warwick says he does not recall...
- 0:57Speaker 1: Looking at an affidavit, but did review a written document.
- 1:01Speaker 1: He doesn't know what it was called. 8.39 a.m. Warwick
- 1:05Speaker 1: calls Chad meek, humble, and deeply religious. And hella moronic,
- 1:09Speaker 1: if I can add a little something something to it. 8.41 a.m.
- 1:14Speaker 1: Warwick momentarily forgets his wedding date. Voice seems a bit nervous,
- 1:18Speaker 1: but I've never spoken with him. Well, that's to be expected.
- 1:21Speaker 1: You're on the stand, right? Nobody wants to be up there.
- 1:25Speaker 1: Talking to the jury, talking to the judge... Especially considering
- 1:29Speaker 1: the circumstances that we're discussing here. Who the hell wants
- 1:32Speaker 1: to be called up on the stand when it's something
- 1:35Speaker 1: like this?
- 1:36Speaker 2: 8.42am.
- 1:37Speaker 1: Warwick and Gibb lived together for only several months before
- 1:40Speaker 1: taking up residence in separate states. He says they were
- 1:43Speaker 1: not married in order to avoid testifying against each other.
- 1:47Speaker 1: And I've said from the beginning, the whole entire lot
- 1:50Speaker 1: of these people were questionable to me. And I have
- 1:53Speaker 1: a very hard time believing that they weren't discussing all
- 1:56Speaker 1: this crazy wild stuff with Lori and Chad. Lori and
- 2:00Speaker 1: Chad weren't, you know, private about their thoughts. They were
- 2:03Speaker 1: trying to gather the 144,000. So all these people that
- 2:07Speaker 1: were hanging out with them, they knew what they were
- 2:09Speaker 1: talking about. They knew what they were up to. Now,
- 2:12Speaker 1: I won't go as far as to say they were
- 2:14Speaker 1: involved in any of the murders or anything like that.
- 2:17Speaker 1: I haven't seen that kind of evidence unless we're talking
- 2:19Speaker 1: about Alex Cox. But there's no doubt. That all of
- 2:23Speaker 1: these people that were hanging out, that were going to
- 2:26Speaker 1: the podcast, that were hanging out at the conferences, they're
- 2:29Speaker 1: all questionable human beings in my opinion. 8.46 a.m. Pryor
- 2:34Speaker 1: and Warwick ironing out the recollection of events on a
- 2:37Speaker 1: Saturday evening when he recorded a podcast episode with Lori. 8.47 a.m.
- 2:43Speaker 1: Warwick saw Chad late morning Sunday the following day. JJ
- 2:47Speaker 1: was not there. Pryor did not ask about Tylee.
- 2:49Speaker 2: 8.49 a.m.
- 2:51Speaker 1: Chad was wearing his church clothes when they met. Warwick
- 2:54Speaker 1: says Chad did not get there until the afternoon. His
- 2:57Speaker 1: church clothes, huh? So what, usually he wears his mom
- 3:01Speaker 1: jeans and his New Balance? But when he's wearing his
- 3:03Speaker 1: church clothes, he throws on his goofball dockers? It's like
- 3:06Speaker 1: my cousin Veet. He has a couple tracksuits, right? He
- 3:10Speaker 1: has one for going out during the day, and then
- 3:13Speaker 1: at night, he has that special tracksuit that he puts on,
- 3:16Speaker 1: you know, for the special occasions.
- 3:17Speaker 2: 8.50 a.m.
- 3:19Speaker 1: Pryor does not understand how Chad would have been at
- 3:22Speaker 1: this meeting if he was at church. Warwick says they
- 3:25Speaker 1: were attending their calling, not a church service. 8.51 a.m.
- 3:30Speaker 1: Warwick did not see Chad on Saturday. He did see
- 3:33Speaker 1: him on Sunday. Pryor says those were the only interactions
- 3:37Speaker 1: Warwick had with Chad that weekend. 8.53 a.m. On redirect,
- 3:42Speaker 1: Warwick says he does not recall meeting with the prosecution
- 3:45Speaker 1: yesterday or Sunday. 8.55 a.m. Warwick, still on redirect, says
- 3:50Speaker 1: he told law enforcement he liked Chad. Warwick does not
- 3:53Speaker 1: recall more descriptive language he used when discussing Chad. He
- 3:57Speaker 1: will review a report from Detective Hermosillo for reference. 9 a.m.
- 4:02Speaker 1: Having now reviewed the report, Warwick says he was angry
- 4:05Speaker 1: Chad told Gibb not to speak with police. When someone
- 4:08Speaker 1: makes a call like that, something's wrong. Yeah, no doubt
- 4:12Speaker 1: about it. The second somebody starts asking you some bullshit
- 4:15Speaker 1: like that, that's the second to get the police involved.
- 4:19Speaker 1: And I'm not somebody who's into calling the police or
- 4:22Speaker 1: being involved with the police at all. But if there's
- 4:24Speaker 1: a kid that's been kidnapped or a kid that might
- 4:27Speaker 1: be hurt, that's the time, right? We're not talking about
- 4:31Speaker 1: somebody coming over and asking you to hang on to
- 4:33Speaker 1: an ounce of, you know, marijuana or something. These are
- 4:38Speaker 1: children that are missing and they're calling you and asking
- 4:40Speaker 1: you to be part of the bullshit. Yeah, something's wrong. 9.02 a.m.
- 4:44Speaker 1: Warwick says Chad was manipulative. Describes Chad as a con man,
- 4:49Speaker 1: developing people's confidence in him to his favor. Dude's definitely
- 4:53Speaker 1: a con man extraordinaire. Anyone who could get people believing
- 4:56Speaker 1: into this apocalypse bullshit the way Chad Daybell had people believing?
- 5:00Speaker 1: Dude's definitely a con man.
- 5:03Speaker 2: 9.02am.
- 5:04Speaker 1: He says he saw a different Chad. He describes an
- 5:07Speaker 1: authoritative voice.
- 5:09Speaker 2: 9.03am.
- 5:09Speaker 1: Warwick says he married Gibb because she is a wonderful
- 5:12Speaker 1: woman who is great with his children, especially his son
- 5:16Speaker 1: with Down Syndrome. 9.05 a.m. One of the attorneys requests
- 5:20Speaker 1: a sidebar. Could not tell which. 9.08 a.m. Following the
- 5:24Speaker 1: sidebar wicks him. Diving into the weekend to which Pryor referred,
- 5:28Speaker 1: Warwick says Chad told him Tammy was healthy. Chad told
- 5:32Speaker 1: Warwick he had a dream Tammy would die. 9.09 a.m.
- 5:36Speaker 1: Warwick says he does not have visions of himself having
- 5:39Speaker 1: superpowers or mystical foresight. Well, that's reassuring, huh? Dude's over
- 5:44Speaker 1: here thinking he's what, Professor X? 9.10 a.m. Pryor will recross. 9.10 a.m.
- 5:51Speaker 1: Back into the timeline of the weekend, Saturday, when Chad
- 5:54Speaker 1: told Warwick that Tammy would die sometime in the near future. 9.12 a.m.
- 5:59Speaker 1: Warwick steps down. State releases him from the subpoena. Defense
- 6:03Speaker 1: asks for the subpoena to be upheld. The state calls
- 6:06Speaker 1: Brandon Boudreaux. Melanie Polowski's ex-husband. Melanie is Lori Vallow Daybell's niece.
- 6:12Speaker 2: 9.15 a.m.
- 6:14Speaker 1: Brandon and Melanie were married for about 10 years from 2008.
- 6:18Speaker 1: Brandon met her family, including Janice, Barry, Adam, and Alex Cox.
- 6:24Speaker 2: 9.17 a.m.
- 6:26Speaker 1: Brandon saw the Coxes about once a month. They would
- 6:29Speaker 1: spend a lot of time with Lori and Charles Vallow.
- 6:31Speaker 1: He got to know them very well. 9.20 a.m. Brandon
- 6:35Speaker 1: says everyone could tell JJ had autism early on. He
- 6:39Speaker 1: was nonverbal. 9.20 a.m. Brandon now describes Tylee As a
- 6:44Speaker 1: good girl, says there were times when she kept to
- 6:47Speaker 1: herself and watched too much Netflix, but other times when
- 6:50Speaker 1: she was sweet. Says she had good motherly instincts. 9.22 a.m.
- 6:56Speaker 1: Brandon now asked about the relationship between Melanie and Lori. 9.22 a.m.
- 7:02Speaker 1: He says Melanie's mother died when Melanie was young, so
- 7:05Speaker 1: she looked up to Lori as a mother figure. Brandon
- 7:08Speaker 1: says he and Charles Vallow had a good relationship. 9.27 a.m.
- 7:14Speaker 1: Brandon says that things began to distance between Lori and
- 7:17Speaker 1: Charles around Christmas. He thought it was strange to have
- 7:20Speaker 1: someone he did not know, Melanie Gibb, there during Christmas. 9.27 a.m.
- 7:26Speaker 1: Brandon spoke with his wife during that visit, says she
- 7:29Speaker 1: seemed to find everything normal. Well, yeah, crazy recognizes crazy, right?
- 7:34Speaker 1: And there's no doubt that all of these people are
- 7:36Speaker 1: a whole ass brand of crazy.
- 7:38Speaker 2: 9.29 a.m.
- 7:38Speaker 1: In all of 2018, Melanie Boudreaux's approach to church changed.
- 7:44Speaker 1: He says early on, she was not fully committed to church.
- 7:47Speaker 1: Beginning fall 2018, she decided to start going to the
- 7:51Speaker 1: temple daily. 9.30 a.m. He thinks attending the temple is
- 7:56Speaker 1: a great thing, but believes some moderation is necessary. 9.31 a.m.
- 8:02Speaker 1: Going to temple is something someone does for themselves to
- 8:05Speaker 1: make promises to God. Sees it as a once a
- 8:08Speaker 1: month sort of thing. Daily visit is something someone would
- 8:11Speaker 1: do when they're retired and have nothing else to do. 9.32 a.m.
- 8:16Speaker 1: Around the same time, Melanie began attending what she referred
- 8:19Speaker 1: to as firesides. He did not acknowledge them as firesides,
- 8:23Speaker 1: which he viewed as an uplifting gathering under the direction
- 8:26Speaker 1: of the church. Firesides. All this stuff wrapped up in
- 8:31Speaker 1: the shield of it being a religion, when in reality
- 8:34Speaker 1: what they were doing was nothing more than a perverse cult.
- 8:38Speaker 1: Being led by Chad Daybell and Lori Vallow. 9.34 a.m.
- 8:42Speaker 1: Brandon was concerned when Melanie returned from one of these
- 8:45Speaker 1: firesides wanting to build a massive food storage. 9.35 a.m.
- 8:50Speaker 1: He suggested that these meetings were not focused on the
- 8:53Speaker 1: core of their faith and says for the second time
- 8:55Speaker 1: he did not attend any of the firesides. He tried
- 8:58Speaker 1: but was informed he was not welcome. Well, he was
- 9:01Speaker 1: a dark spirit, remember? Brandon Boudreaux was one of the darks.
- 9:05Speaker 1: that Lori Vallow and Chad Daybell had to get rid of,
- 9:08Speaker 1: so of course he's not going to be welcomed into
- 9:10Speaker 1: the inner sanctum, right? 9.37 a.m. January 2019, Lori sent
- 9:16Speaker 1: messages to family that Charles was cheating. Said she began
- 9:21Speaker 1: taking things from him, calls it irrational. Found out later
- 9:25Speaker 1: Charles' number was blocked on his phone. He believes Melanie
- 9:28Speaker 1: blocked it.
- 9:29Speaker 2: 9.40 a.m.
- 9:30Speaker 1: Says Lori left without JJ, adds that caring for JJ
- 9:34Speaker 1: was a full-time thing. All plans had to be made
- 9:37Speaker 1: around his needs. Melanie took Lori's side in the divorce.
- 9:41Speaker 1: He encouraged they did not pick sides and loved Lori, Charles, JJ,
- 9:45Speaker 1: and Tylee equally. 9.42 a.m. Brandon holding back tears, reminiscing
- 9:51Speaker 1: JJ coming to his house with Charles to play with
- 9:54Speaker 1: his kids. Describes the planning involved in hosting JJ. Brandon's
- 9:58Speaker 1: son would help keep an eye on JJ while Charles
- 10:01Speaker 1: and Brandon chatted it's just all sad man when you
- 10:04Speaker 1: think about it right and you look at the big
- 10:07Speaker 1: picture here and what went down my disdain for all
- 10:10Speaker 1: of them grows by the second and all these people
- 10:13Speaker 1: that were hanging out with Lori Vallow and Chad Daybell
- 10:16Speaker 1: Melanie Polowski and the rest of them They're lucky that
- 10:19Speaker 1: I'm not the investigator here, because I would have found
- 10:22Speaker 1: some charges to slap them all with. It's too bad
- 10:25Speaker 1: stupidity isn't a criminal offense, because if it was, all
- 10:29Speaker 1: of them would be doing a life sentence. 9.44 a.m.
- 10:33Speaker 1: Late June 2018, Brandon and Melanie visited her family. He
- 10:37Speaker 1: says a few things happened during that visit, including the
- 10:40Speaker 1: unexpected death of his grandfather of a heart attack. 9.46 a.m.
- 10:46Speaker 1: When Brandon learned the date of the funeral... He told
- 10:49Speaker 1: Melanie he wanted the entire family to attend. Says Melanie refused.
- 10:53Speaker 1: That led to an argument. Imagine your grandpa dies and
- 10:56Speaker 1: your chick's like, nah, your kids can't go. We're not
- 10:59Speaker 1: going to go to the funeral. Yeah, you're not, huh? Well,
- 11:02Speaker 1: you can stay home. My kids, they're coming.
- 11:06Speaker 2: 9.48 a.m.
- 11:06Speaker 1: During the argument, Melanie accused Brandon of hacking into Lori's computer.
- 11:10Speaker 1: Seems Wood is leading to something defense doesn't want presented.
- 11:14Speaker 1: Several objections to the line of questioning. 9.50 a.m. Brandon
- 11:19Speaker 1: says Melanie never provided any evidence of his hacking Lori's computer,
- 11:23Speaker 1: says it was just a wild accusation. 9.53 a.m. The
- 11:28Speaker 1: two argued from the afternoon through midnight. Melanie went to
- 11:31Speaker 1: bed and Brandon stayed up troubled all night. He texted
- 11:34Speaker 1: Lori and Charles, telling them if his family was ruined,
- 11:38Speaker 1: it was on them. 9.54 a.m. Lori ignored the message.
- 11:43Speaker 1: Charles responded the following evening. He and Charles spoke. He
- 11:46Speaker 1: apologized to Charles for not being there for him. He
- 11:49Speaker 1: says he felt like he believes Charles felt going through
- 11:52Speaker 1: a separation and divorce. Yeah, look, man, not easy, right?
- 11:58Speaker 1: Losing your wife, losing your family can't be an easy thing. 9.55 a.m.
- 12:03Speaker 1: Brandon says he no longer had any contact with Lori, JJ,
- 12:06Speaker 1: and Tylee. He and Melanie were divorced. The process began
- 12:10Speaker 1: immediately after Brandon's grandfather's funeral.
- 12:13Speaker 2: 9.58 a.m.
- 12:15Speaker 1: Following the divorce, Melanie became cold to Brandon. He did
- 12:19Speaker 1: not know what happened with Lori, Tylee, and JJ. Then
- 12:22Speaker 1: on October 2nd, 2019, someone shot at him in front
- 12:25Speaker 1: of his home. Imagine you're hanging out in front of
- 12:28Speaker 1: your house and someone just starts popping off shots at
- 12:31Speaker 1: you and you're just some regular old Mormon dude. Not
- 12:34Speaker 1: like you're out here living in the, you know, Central Valley,
- 12:38Speaker 1: selling all kinds of drugs and shit. Just a random
- 12:40Speaker 1: ass guy living his life. But because he got caught
- 12:43Speaker 1: up with Lori Vallow and her murder cult, They tried
- 12:46Speaker 1: to clip him, too. 10 a.m. Brandon described his morning.
- 12:51Speaker 1: Says he got his kids ready for school, dropped them
- 12:53Speaker 1: off at school, and went to the gym. When he
- 12:56Speaker 1: returned from the gym, he saw a Jeep parked in
- 12:58Speaker 1: the corner near his home, and he thought that was
- 13:00Speaker 1: awkward and out of place. 10.02 a.m. He saw the
- 13:04Speaker 1: window of the Jeep open. Then he saw a gun
- 13:07Speaker 1: with a silencer, and his window was shot out. Rather
- 13:11Speaker 1: than turning into his driveway, he floored it to the
- 13:13Speaker 1: end of his street and parked near a community pool,
- 13:16Speaker 1: where he called police. 10.03 a.m. He followed the Jeep
- 13:20Speaker 1: when it left. I don't know what I was doing.
- 13:22Speaker 1: Police told him to return to his home, so he did.
- 13:25Speaker 1: Brandon says very few people knew he lived at the house,
- 13:29Speaker 1: where he had only been living for a few days. 10.06 a.m.
- 13:33Speaker 1: Brandon reported the incident to police, including providing a description
- 13:37Speaker 1: of the Jeep. He later determined the Jeep was purchased
- 13:41Speaker 1: by Charles for Tylee. 10.07 a.m. Because he was an
- 13:46Speaker 1: insurance agent at the time, he had information for the Jeep,
- 13:49Speaker 1: including the VIN, which he provided to police. 10.08 a.m.
- 13:54Speaker 1: We will now take a morning recess, back at 10.30.
- 13:57Speaker 1: All right, so like usual, this is where we're going
- 13:59Speaker 1: to take our break as well, and we'll be back
- 14:02Speaker 1: in the next episode picking up where we left off.
- 14:05Speaker 1: All of the information that goes with this episode can
- 14:08Speaker 1: be found... in the description box. What's up, everyone, and
- 14:12Speaker 1: welcome back to the program. In this episode, we're getting
- 14:15Speaker 1: right back to the Chad Daybell court proceedings for day
- 14:19Speaker 1: number nine. Once again, the author of this article is
- 14:22Speaker 1: Kalama Hines, and it was published by eastidahonews.com. 10.45 a.m.
- 14:30Speaker 1: Jerry being brought back in. Brandon Boudreaux still on the
- 14:33Speaker 1: witness stand.
- 14:33Speaker 2: 10.48 a.m.
- 14:37Speaker 1: Would publish photos of Tylee's Jeep to the jury. Brandon
- 14:40Speaker 1: confirms that is the Jeep he saw the morning of
- 14:43Speaker 1: October 2nd, 2019. 10.50 a.m. Brandon says the entire situation
- 14:49Speaker 1: was traumatic. He knew a resolution wouldn't come quickly, so
- 14:52Speaker 1: he decided to help police in any way possible, including
- 14:55Speaker 1: hiring a private investigator. He also provided police with emails
- 14:59Speaker 1: he received from Charles. 10.51 a.m. Those emails voiced concerns
- 15:04Speaker 1: Charles had about Lori's mental health 10.52 a.m. Brandon believed
- 15:10Speaker 1: a better understanding of the beliefs Lori and Melanie had
- 15:13Speaker 1: taken on would help his situation. That was how he
- 15:16Speaker 1: learned about the belief of light and dark spirits and
- 15:19Speaker 1: that he was a dark spirit. 10.53 a.m. Brandon wanted
- 15:23Speaker 1: to learn more about the person responsible for these teachings,
- 15:27Speaker 1: so he googled Chad Daybell's name. He found an obituary
- 15:30Speaker 1: for Tammy Daybell and he was shocked.
- 15:32Speaker 2: 10.55 a.m.
- 15:35Speaker 1: This was around the time that he learned that J.J.
- 15:37Speaker 1: and Tylee were missing. 10.55 a.m. He got a call
- 15:41Speaker 1: on June 9, 2020, informing him of the discovery of
- 15:44Speaker 1: their bodies. 10.56 a.m. He got married the following day.
- 15:49Speaker 1: Shortly after that, he felt the need to go to Rexburg.
- 15:52Speaker 1: He drove from Arizona to Idaho. He was asked to
- 15:55Speaker 1: ID J.J. 10.57 a.m. He identified J.J. using photos of
- 16:01Speaker 1: his deceased body on June 11th. Brandon crying on the stand. 10.58 a.m.
- 16:08Speaker 1: That concludes direct examination. Pryor will now cross. 11 a.m.
- 16:13Speaker 1: Pryor asks how close Alex Cox and Lori were. Says
- 16:17Speaker 1: Alex often moved from state to state, city to city
- 16:20Speaker 1: with Lori. 11.02 a.m. Brandon agrees with Pryor that Tylee
- 16:25Speaker 1: often was like a second mother to JJ. Pryor asks
- 16:28Speaker 1: if JJ relied on Tylee for things Lori did not provide.
- 16:32Speaker 1: Brandon is noncommittal in his response. 11.03 a.m. Pryor says
- 16:38Speaker 1: Charles and Lori discussed Charles naming Lori as the beneficiary
- 16:43Speaker 1: on his life insurance policy. Brandon cannot testify to that,
- 16:46Speaker 1: says he and Charles did not discuss that. 11.05 a.m.
- 16:50Speaker 1: Pryor now asking about the relationship between Lori and Melanie Gibb. 11.05 a.m.
- 16:56Speaker 1: Pryor suggests Gibb plan the firesides. Brandon does not know
- 17:00Speaker 1: if that is correct. 11.06 a.m. Prior shifts gears to
- 17:05Speaker 1: the temple visits. Brandon tries to explain some of the
- 17:08Speaker 1: events that occur at the temple. Prior cuts him off
- 17:12Speaker 1: to direct him towards the sealing ceremonies. 11.09 a.m. Prior
- 17:16Speaker 1: and Brandon now discussing the firesides. 11.11 a.m. Prior asks
- 17:22Speaker 1: Brandon if he is aware of people who claim to
- 17:24Speaker 1: have visions about the future. Brandon says he has never
- 17:27Speaker 1: had such visions and does not personally know of anyone
- 17:31Speaker 1: who has. 11.12 a.m. Brandon says that he is not
- 17:35Speaker 1: personally aware of Latter-day Saint teachings regarding light and dark spirits. 11.13 a.m.
- 17:42Speaker 1: Brandon steps down and is released from all subpoenas. Attorneys
- 17:46Speaker 1: and judge in a sidebar. 11.15 a.m. State calls Ryan Pillar. 11.17 a.m.
- 17:54Speaker 1: Pillar is an officer with the Gilbert, Arizona Police Department. 11.19 a.m.
- 17:59Speaker 1: Deputy Idaho State Attorney General Ingrid Beatty is on direct examination. 11.20 a.m.
- 18:06Speaker 1: Pilar was among the officers who responded to reports of
- 18:09Speaker 1: the Brandon Boudreaux shooting incident. 11.21 a.m. Pilar says there
- 18:14Speaker 1: was evidence that Brandon's vehicle has sustained damage from a
- 18:18Speaker 1: projectile and that there was a Jeep idling leading up
- 18:21Speaker 1: to the shooting. 11.22 a.m. Descriptions of suspect vehicle match
- 18:26Speaker 1: that of Tylee's Jeep A dark gray Jeep displaying a
- 18:29Speaker 1: Texas license plate without a spare tire attached to the
- 18:32Speaker 1: rear hatch. 11.24 a.m. Pilar learned of a recent homicide
- 18:37Speaker 1: in Chandler, Charles Vallow, involving family members of Brandon's ex-wife,
- 18:42Speaker 1: Melanie Boudreau. So he reached out to Chandler PD for info.
- 18:46Speaker 1: Learned a dark gray Jeep registered to the deceased was
- 18:50Speaker 1: at the scene. 11.26 a.m. Gilbert PD designated Alex Cox
- 18:55Speaker 1: as a person of interest involved in the Boudreaux shooting.
- 18:59Speaker 1: Alex Cox was an absolute piece of garbage. And while
- 19:03Speaker 1: the world is certainly a better place without his bitch
- 19:06Speaker 1: ass in it, he should have had to face justice
- 19:08Speaker 1: for what he did. Instead, he took the coward's way out. Oh,
- 19:12Speaker 1: I know the official narrative says that he died of
- 19:14Speaker 1: a heart attack, but I don't believe it. The walls
- 19:17Speaker 1: were closing in and old boy decided to have an
- 19:19Speaker 1: opioid cocktail.
- 19:20Speaker 2: 1126 a.m.
- 19:23Speaker 1: Pilar found in investigating the Jeep that it had traveled
- 19:26Speaker 1: to and from Rexburg. Pilar called Rexburg PD and Fremont
- 19:31Speaker 1: County Sheriff's Office to serve a search warrant on the Jeep. 11.27 a.m.
- 19:36Speaker 1: While searching the Jeep, Pilar and other officers collected physical evidence,
- 19:41Speaker 1: including DNA swabs and gunshot residue evidence. 11.29 a.m. Attention
- 19:48Speaker 1: shifted from Boudreaux shooting to the missing children in late
- 19:51Speaker 1: November after the Jeep was processed by evidence texts. And
- 19:55Speaker 1: then keep in mind, all of a sudden, all this
- 19:57Speaker 1: other stuff goes on and Alex Cox ends up dying. Boy,
- 20:01Speaker 1: that's convenient for him, huh?
- 20:02Speaker 2: 11.30 a.m.
- 20:05Speaker 1: Pilar says his department found no evidence either child was
- 20:08Speaker 1: in Arizona in 2019. 11.31 a.m. Pilar stopped surveilling Cox
- 20:15Speaker 1: on December 12, 2019, when Cox died. Officers executed a
- 20:20Speaker 1: search warrant of Cox's home. They found guns, clothing, literature,
- 20:25Speaker 1: authored by Chad Daybell. Inside his Cox truck, they found
- 20:28Speaker 1: gun paraphernalia.
- 20:29Speaker 2: 11.33 a.m.
- 20:32Speaker 1: That concludes direct examination. Judge requests sidebar before cross. 11.35 a.m.
- 20:38Speaker 1: Boyce excuses the jury momentarily so he and the attorneys
- 20:41Speaker 1: can discuss the next witness on the record outside the
- 20:44Speaker 1: presence of the jurors.
- 20:47Speaker 2: 11.36 a.m.
- 20:49Speaker 1: Boyce says he is concerned about the witness directing comments
- 20:52Speaker 1: at the jury following testimony. State and defense both acknowledge
- 20:56Speaker 1: the concern. 11.38 a.m. Prior on cross. 11.39 a.m. Pryor
- 21:02Speaker 1: says common denominator of instances is Lori Vallow and Alex Cox.
- 21:07Speaker 1: Pilar agrees. 11.40 a.m. That concludes Cross. No redirect. Pilar
- 21:13Speaker 1: steps down and is released from the subpoenas. So, again,
- 21:18Speaker 1: Pryor is trying to make it out that it was
- 21:21Speaker 1: Alex Cox and Lori Vallow who were steering this ship. And,
- 21:26Speaker 1: according to Pryor, Chad Daybell was just, you know, a
- 21:29Speaker 1: passenger along for the ride. Now, good luck convincing the
- 21:32Speaker 1: jury of that, but make no mistake, that's what he's
- 21:35Speaker 1: attempting to do. 11.42 a.m. State calls Deputy Coulter Cannon. 11.43 a.m.
- 21:43Speaker 1: Cannon is with the Fremont County Sheriff's Office. He is
- 21:46Speaker 1: a school resource officer and a patrol deputy. 11.46 a.m.
- 21:52Speaker 1: On October 9th, 2019, Cannon was on patrol when he
- 21:55Speaker 1: received a call reporting a suspicious circumstance involving Tammy Daybell.
- 22:00Speaker 1: Someone pointed a paintball gun at her in her driveway. 11.49 a.m.
- 22:05Speaker 1: Court listening to the 911 call reporting the brandishing of
- 22:09Speaker 1: what was believed to be a paintball gun at the
- 22:11Speaker 1: Daybell home. 11.52 a.m. Court now listening to Tammy's 911
- 22:16Speaker 1: call reporting the gun incident. 11.52 a.m. Tammy says she
- 22:22Speaker 1: was removing stuff from the backseat of her car and
- 22:25Speaker 1: found a man wearing a mask pointing a paintball gun
- 22:27Speaker 1: at her. She yelled for Chad, and the man took
- 22:30Speaker 1: off around her house.
- 22:33Speaker 2: 11.53 a.m.
- 22:34Speaker 1: Tammy says the man holding the gun, like a rifle,
- 22:37Speaker 1: and shot at her, but nothing came out. Can you imagine?
- 22:41Speaker 1: Certainly wasn't a paintball gun. This gross-ass, disgusting, beaver-faced son
- 22:46Speaker 1: of a bitch, Alex Cox is over here, playing the
- 22:49Speaker 1: part of some two-bit-ass hitman. 11.54 a.m. Cannon says he
- 22:53Speaker 1: responded to the call's, Around 9 p.m., the sun was
- 22:57Speaker 1: going down. It was dusk, he says. 11.56 a.m. Upon arrival,
- 23:03Speaker 1: Cannon drove around the property searching for the assailant. Wixom
- 23:07Speaker 1: asked for a lunch break. We will be back at
- 23:09Speaker 1: 1 p.m. So we're not going to take a break here.
- 23:11Speaker 1: We're just going to roll through and we're going to
- 23:12Speaker 1: finish it out. 1.06 p.m. We are back and the
- 23:16Speaker 1: jury is being seated. 1.10 p.m. Fremont County Deputy Coulter
- 23:21Speaker 1: Cannon is still on the stand. Trial will conclude early today.
- 23:24Speaker 1: so there will not be an afternoon recess.
- 23:28Speaker 2: 1.10 p.m.
- 23:29Speaker 1: Cannon again says he searched the area around the Daybell home,
- 23:32Speaker 1: looking for the person who aimed the gun at Tammy
- 23:35Speaker 1: on October 9, 2019. 1.10 p.m. After searches were unsuccessful,
- 23:42Speaker 1: Cannon spoke with Tammy, who described the incident. She apparently
- 23:45Speaker 1: confronted the gunman, who did not say anything. Tammy described
- 23:49Speaker 1: hearing two pops, but nothing was discharged from the gun.
- 23:52Speaker 2: 1.11 p.m.
- 23:54Speaker 1: Chad did not say anything to the officer. Cannon said
- 23:57Speaker 1: Chad would have heard the entire conversation. Cannon found it
- 24:01Speaker 1: odd that Chad never seemed to take any protective actions,
- 24:04Speaker 1: hearing what happened to his wife. Imagine someone fires off
- 24:07Speaker 1: some shots, or almost fires off shots at your wife.
- 24:11Speaker 1: You don't put up security cameras. You don't do anything
- 24:14Speaker 1: to make sure that your people are safe. 1.12 p.m.
- 24:17Speaker 1: Cannon searched the area for paintballs or shell casings, but
- 24:21Speaker 1: found nothing. 1.13 p.m. Cannon and other officers returned to
- 24:25Speaker 1: the Daybell home to search and investigate a second time. Again,
- 24:29Speaker 1: nothing of evidentiary value was found. Direct done. Pryor will cross. 1.15 p.m.
- 24:36Speaker 1: Pryor asked about the two separate police reports filed by
- 24:39Speaker 1: Cannon regarding the incident. The first, he says, was short.
- 24:43Speaker 1: Cannon agrees. Cannon also says his body cam was not
- 24:46Speaker 1: active because it was broken. 1.19 p.m. Pryor asked to
- 24:51Speaker 1: publish a photo of the report. Following discussion, the reports
- 24:54Speaker 1: will be admitted and published. 1.20 p.m. Pryor asks Cannon
- 24:59Speaker 1: to read the first sentence of the report. Pryor asks
- 25:02Speaker 1: why Cannon made it a point to include the word
- 25:05Speaker 1: gun after paintball. Cannon? Well, it's a paintball gun, so... 1.21 p.m.
- 25:12Speaker 1: Pryor asks to play the 911 calls from Tammy and
- 25:14Speaker 1: her son-in-law Joseph Murray again. 1.22 p.m. A couple months later,
- 25:20Speaker 1: Cannon's second report is longer, Pryor says. Cannon says he
- 25:23Speaker 1: was told by a supervisor to add further details to
- 25:26Speaker 1: his report. 1.23 p.m. Pryor asked if it was really
- 25:30Speaker 1: important to add more details or if Cannon's supervisors were
- 25:33Speaker 1: trying to put a gun at the scene. 1.25 p.m.
- 25:37Speaker 1: Pryor asked why Cannon, why his second more detailed report
- 25:42Speaker 1: contained that Tammy described there being a gun believed to
- 25:45Speaker 1: be a paintball gun. 1.28 p.m. Original report said suspect
- 25:50Speaker 1: was around 5.10 p.m. 190 pounds. Second report listed six feet,
- 25:55Speaker 1: 200 pounds. Prior suggests it was changed to better fit
- 25:58Speaker 1: Alex Cox description. OK, nice try. But is there really
- 26:02Speaker 1: that big of a difference if somebody is standing out
- 26:05Speaker 1: in their yard and someone pulls a gun on them
- 26:08Speaker 1: and they say, oh, he was 5'10, 190 as opposed
- 26:11Speaker 1: to six feet, 200 pounds. You're really going to be
- 26:13Speaker 1: able to tell the discrepancy.
- 26:15Speaker 2: Stop it. 128 p.m.
- 26:17Speaker 1: Cannon says to his knowledge his supervisors were not intentionally
- 26:21Speaker 1: trying to link Cox to the incident. 1.30 p.m. Joseph
- 26:25Speaker 1: Murray did not report hearing a gunshot. Cannon did not
- 26:28Speaker 1: ask him. Pryor asked why it was so important to
- 26:31Speaker 1: include the word gun but not important enough to talk
- 26:33Speaker 1: to the witness and ask if he heard a gunshot. 1.30 p.m.
- 26:38Speaker 1: Pryor asked what info Cannon received to lead him toward
- 26:41Speaker 1: a gun involved and rather than a paintball gun. Cannon
- 26:45Speaker 1: says it was info he received from Tammy. 1.32 p.m.
- 26:49Speaker 1: Tammy's 911 call is being played for a second time. 1.33 p.m.
- 26:54Speaker 1: Tammy's first mention of gun without proceeding with paintball is
- 26:58Speaker 1: when she says the man holds it like a rifle.
- 27:01Speaker 1: Pryor asks when that was said. Cannon says later in
- 27:04Speaker 1: the recording. Pryor says he never heard that. He heard
- 27:07Speaker 1: the recording stop. Cannon says that's because Pryor stopped it. 1.36 p.m.
- 27:13Speaker 1: Despite several prompts from Pryor, Cannon will not concede. that
- 27:17Speaker 1: the incident was certainly a paintball gun incident.
- 27:20Speaker 2: 1.38 p.m.
- 27:21Speaker 1: Wood on Reed Direct asked about Fremont County Police regarding
- 27:25Speaker 1: body cams. Cannon says the Sheriff's Office does not require
- 27:28Speaker 1: the use of body cams. Police reports, he continues, are
- 27:32Speaker 1: how deputies document incidents and their responses. 1.39 a.m. Regarding
- 27:38Speaker 1: the time differential, Cannon says he used a timestamp from
- 27:41Speaker 1: his being dispatched. You'll remember that Joseph Murray called before Tammy. 1.40 p.m.
- 27:48Speaker 1: Cannon says there was nothing he discovered that rules out
- 27:51Speaker 1: that incident could have involved a real gun. 1.41 p.m.
- 27:56Speaker 1: Cannon did not think to ask Murray about hearing a
- 27:58Speaker 1: gunshot and believes that would be a detail he would
- 28:01Speaker 1: have brought up without prompting. 1.42 p.m. Cannon is dismissed
- 28:06Speaker 1: and released from his subpoenas. State will call Elisa Greenhall. 1.43 p.m.
- 28:12Speaker 1: Greenhall is a Fremont County Sheriff's Deputy.
- 28:14Speaker 2: 1.45 p.m.
- 28:16Speaker 1: Greenhall responded to reports of an unattended death, Tammy Daybell. 1.48 p.m.
- 28:22Speaker 1: Court listening to audio from 911 call received a reporting
- 28:25Speaker 1: Tammy's death. 1.50 p.m. I'm Chad, the husband. She's clearly dead.
- 28:31Speaker 1: He begins to cry. Oh, what a good actor Chad
- 28:33Speaker 1: Daybell is. Crying in tears of joy, probably. 1.51 p.m.
- 28:39Speaker 1: Greenhall says the call came in around 6 a.m. 1.51 p.m.
- 28:44Speaker 1: Garth Daybell, Tammy and Chad's son. Let Greenhalgh into the home.
- 28:48Speaker 1: Chad was there. Later, more family arrived. 1.53 p.m. Greenhalgh
- 28:53Speaker 1: says Chad was definitely more emotional than Garth. 1.55 p.m.
- 28:58Speaker 1: Chad told Greenhalgh Tammy woke up in the middle of
- 29:00Speaker 1: the night in a coughing fit and had to vomit.
- 29:03Speaker 1: He said he woke to find her unresponsive and had
- 29:06Speaker 1: fallen partially off the bed. 1.56 p.m. With Garth's help,
- 29:11Speaker 1: Chad moved Tammy's body back onto the bed, the covers
- 29:14Speaker 1: were pulled back, up to cover Tammy's shoulders. 1.58 p.m.
- 29:18Speaker 1: Greenhall checked Tammy's body and says she was colder than
- 29:22Speaker 1: the room and rigid. 1.58 p.m. Chad said Tammy had
- 29:27Speaker 1: been suffering from a pretty bad cold, but did not
- 29:30Speaker 1: like visiting the doctor. He says she recently fallen and
- 29:33Speaker 1: visited the doctor. Well, that's convenient, huh? Doesn't like the
- 29:36Speaker 1: doctor when she's sick, but she falls and she'll go.
- 29:39Speaker 1: Makes a lot of sense, Chad Daybell. Also that she
- 29:42Speaker 1: was going through menopause and suffered from feigning spells. 1.59 p.m.
- 29:48Speaker 1: Greenhall requested for assistance from detectives in investigating the death.
- 29:52Speaker 1: The detectives told her to take photos and allow the
- 29:55Speaker 1: coroner to decide whether an autopsy was needed.
- 29:57Speaker 2: 2.01 p.m.
- 29:59Speaker 1: Greenhalgh says she found nothing suspicious about the scene based
- 30:02Speaker 1: on the info provided by Chad. No one else provided
- 30:06Speaker 1: any info on Tammy or about her death.
- 30:08Speaker 2: 2.02 p.m.
- 30:10Speaker 1: Garth never said anything. He was present for the conversation
- 30:14Speaker 1: and never interjected. 2.03 p.m. Wixom asks for the admittance
- 30:18Speaker 1: of evidence exhibits but requests a sidebar prior to publishing. 2.03 p.m.
- 30:24Speaker 1: The evidence, I believe, is photos of Tammy's body taken
- 30:27Speaker 1: by Greenlaw. 2.04 p.m. Look like Larry Woodcock used his
- 30:32Speaker 1: brief break to stretch his legs. He's sitting in the
- 30:34Speaker 1: back row with a woman who looks like Kay. For
- 30:37Speaker 1: those watching the video, you will know that the picture
- 30:39Speaker 1: is not perfect. 2.08 p.m. Attorneys and judge still in sidebar. 2.10 p.m.
- 30:46Speaker 1: Following the sidebar, judge informs the court that the upcoming
- 30:50Speaker 1: exhibits will be graphic. They will be published. 2.13 p.m.
- 30:55Speaker 1: The exhibits will be published to the jury, but not
- 30:57Speaker 1: broadcast publicly.
- 31:00Speaker 2: 2.15pm.
- 31:01Speaker 1: Greenlaw describes the first photo of Tammy's body as she
- 31:04Speaker 1: was in bed when the officers arrived. 2.15pm. A second
- 31:08Speaker 1: photo was taken to show the pinkish foam running down
- 31:11Speaker 1: Tammy's cheek. I like to document any body fluids that
- 31:15Speaker 1: are present.
- 31:16Speaker 2: 2.16pm.
- 31:17Speaker 1: A third photo shows Tammy's arms were positioned uncovered by
- 31:21Speaker 1: the blanket. 2.17pm. A fourth photo with a coroner present
- 31:25Speaker 1: showing Tammy's body position with the mattress shifted a few
- 31:29Speaker 1: inches from the box spring below it. She says this
- 31:32Speaker 1: corroborates Chad's telling of him and Garth moving Tammy's body. 2.19 p.m.
- 31:37Speaker 1: A fifth photo to document discoloration in Tammy's right ear. 2.20 p.m.
- 31:43Speaker 1: A sixth photo is a close-up of Tammy's face showing
- 31:46Speaker 1: blood around her nose and mouth and facial discoloration. The
- 31:50Speaker 1: foam from her mouth flowed down the left side of
- 31:52Speaker 1: Tammy's face consistent with Chad's telling of the events. 2.21 p.m.
- 31:58Speaker 1: A seventh photo showed blood and foam from Tammy's mouth.
- 32:01Speaker 1: Greenlaw says she had never seen an unattended death where
- 32:05Speaker 1: the deceased had blood and foam coming from the mouth,
- 32:08Speaker 1: so she found it important to document. 2.22 p.m. An
- 32:12Speaker 1: eighth photo shows Tammy's face after the coroner wiped some
- 32:15Speaker 1: of the foam and blood away. 2.23 p.m. A ninth
- 32:19Speaker 1: photo taken after the passage of some time shows bruising
- 32:23Speaker 1: on Tammy's head and face. The pink foam was not
- 32:26Speaker 1: present in the photos. Greenhall says she did not personally
- 32:30Speaker 1: remove it. 2.25 p.m. Greenhall says there was lividity, bruising
- 32:36Speaker 1: from blood pooling following Tammy's death, in Tammy's lower back
- 32:40Speaker 1: and the back of her thighs. Greenhall says it shows
- 32:43Speaker 1: Tammy was on her back for some time after she died. 2.26 p.m.
- 32:48Speaker 1: Greenhall never discussed the possibility of an autopsy with Chad
- 32:52Speaker 1: and never heard anyone else do so. 2.27 p.m. Greenhalgh
- 32:57Speaker 1: was told Tammy took meds for depression. Greenhalgh found no
- 33:00Speaker 1: evidence that Tammy may have overdosed on any of these meds.
- 33:04Speaker 1: She never found anything suspicious at the time. 2.30 p.m.
- 33:08Speaker 1: Prior on Cross says it was determined an autopsy would
- 33:12Speaker 1: only be performed if the Daybell family requested one. Greenhalgh confirms. 2.31 p.m.
- 33:18Speaker 1: Greenhalgh confirms the meds Tammy was taking. She was experimenting
- 33:22Speaker 1: with essential oils. Chad told Greenhalgh, There was also cough
- 33:26Speaker 1: medicine next to the bed. 2.33 p.m. Among the meds
- 33:30Speaker 1: found was also a respiratory blend and something to treat bruising. 2.34 p.m.
- 33:36Speaker 1: Greenhall agrees that Chad was more shook up and despondent
- 33:39Speaker 1: than anyone else in the house. 2.35 p.m. Pryor suggests
- 33:44Speaker 1: Tammy was dealing with unexplained falls, then confirms Greenhall was
- 33:48Speaker 1: not using a body cam or recorder while present for
- 33:51Speaker 1: the investigation into the unattended death. 2.36 p.m. Pryor suggests
- 33:57Speaker 1: the pink foaming was from anemia. Greenhall cannot confirm. She
- 34:01Speaker 1: does confirm, however, that there were no signs of a
- 34:03Speaker 1: struggle in the home. 2.37 p.m. Tammy's daughter, Emma, told
- 34:08Speaker 1: officers that Tammy had slowed down recently. 2.38 p.m. Pryor
- 34:13Speaker 1: reads from a report about something Greenhall says she does
- 34:17Speaker 1: not remember. Greenhall informs him he is reading the coroner's report.
- 34:21Speaker 1: That concludes Cross. Wood, back for redirect.
- 34:25Speaker 2: 239.
- 34:26Speaker 1: Wood focused on the non-prescription treatments found at the home.
- 34:30Speaker 1: Greenhalgh had no information, outside of what was provided by Chad,
- 34:34Speaker 1: about who was taking the meds and for how long.
- 34:36Speaker 1: 240 p.m. Wood asks about Tammy's seizures. Greenhalgh does not
- 34:42Speaker 1: recall that, confirms it's possible Chad told her one thing
- 34:45Speaker 1: and the coroner another. 241 p.m. Greenhalgh dismissed and released
- 34:50Speaker 1: from all subpoenas. Boyce requests Sidebar to discuss whether the
- 34:54Speaker 1: next witness will be called now or tomorrow morning. 2.43pm.
- 34:59Speaker 1: Boyce calling it for the day. Alright folks, so obviously
- 35:03Speaker 1: that's the end for us as well. And with the
- 35:05Speaker 1: way things are going, it looks like the end is
- 35:07Speaker 1: near for Chad Daybell as well. All of the information
- 35:11Speaker 1: that goes with this episode can be found in the
- 35:14Speaker 1: description box. What's up everyone and welcome back to the program.
- 35:18Speaker 1: In this episode, we're getting right back to it with
- 35:20Speaker 1: the Chad Daybell trial as we recap what went down
- 35:24Speaker 1: during day 10 of testimony. Once again, we'll be using EastIdahoNews.com
- 35:31Speaker 1: and the author this time around is Andrea Olson. 8.38 a.m.
- 35:36Speaker 1: Court is now in session and the jury is being
- 35:38Speaker 1: brought in. 8.39 a.m. Chad Daybell is wearing a white
- 35:43Speaker 1: shirt and a tie.
- 35:44Speaker 2: 8.40 a.m.
- 35:46Speaker 1: The state will be calling Brenda Dye, who is a
- 35:48Speaker 1: Fremont County coroner. 8.43 a.m. Fremont County Deputy Prosecutor Rocky
- 35:54Speaker 1: Wixom is questioning Dye. Dye has been the coroner since
- 35:58Speaker 1: January 2019, and they are discussing what kind of training
- 36:02Speaker 1: that she has. 8.44 a.m. We respond to unattended deaths.
- 36:07Speaker 1: Determine cause of death. I sign off on the death certificate,
- 36:10Speaker 1: Dye says.
- 36:11Speaker 2: 8.45 a.m.
- 36:13Speaker 1: We look for weapons, we look for medications, we look
- 36:16Speaker 1: for health history. Dye is talking about responding to an
- 36:19Speaker 1: unattended death, which death is not directly under a doctor's care.
- 36:25Speaker 2: 8.50am.
- 36:26Speaker 1: How do you know what lividity means? Wixom is asking. Dye,
- 36:30Speaker 1: it's the lowest point of the body of the blood
- 36:32Speaker 1: pools when somebody is no longer living. It looks like
- 36:35Speaker 1: a bruise. It helps Dye know how the body was
- 36:38Speaker 1: found and the position the body was in at the
- 36:41Speaker 1: time of the death. It's important to know if the
- 36:44Speaker 1: body was moved. That's the most important, Dye said. Rigor
- 36:48Speaker 1: mortis is stiffening of the body and occurs two to
- 36:51Speaker 1: six hours after death. Releases after eight hours of death.
- 36:55Speaker 1: This is important to determine the time of death, Dye says.
- 37:00Speaker 1: And whenever you are trying to put together what happened,
- 37:03Speaker 1: finding out the time of death is very important, right?
- 37:06Speaker 1: So the coroner The medical examiner, they have a process
- 37:10Speaker 1: that they follow so that they can determine when the
- 37:13Speaker 1: death occurred and then go from there as far as investigation. 8.51 a.m.
- 37:20Speaker 1: Di is being asked if she knew any of the
- 37:21Speaker 1: day bells and she says no. She received a call
- 37:24Speaker 1: from dispatch that there was an unattended death that she
- 37:28Speaker 1: needed to respond to. She received the call early morning.
- 37:31Speaker 1: This is back in 2019. 8.52 a.m. Di called her
- 37:37Speaker 1: deputy coroner to come. It took Di 45 minutes to
- 37:40Speaker 1: get to the scene of the Daybell's home. The deceased
- 37:43Speaker 1: husband was very distraught and crying, Di says. I observed Chad,
- 37:47Speaker 1: the husband, very upset and distraught. Garth, Chad's son, was
- 37:51Speaker 1: emotionless to me, Di says. This is when Tammy Daybell died,
- 37:55Speaker 1: and Di responded. Note, Tammy Daybell died October 19th, 2019. 8.54 a.m.
- 38:04Speaker 1: After I looked at the body, I questioned Chad about
- 38:06Speaker 1: Tammy's past health history, Di says. 8.56 a.m. I am
- 38:12Speaker 1: holding a picture of Tammy deceased on the bed, Di says.
- 38:15Speaker 1: She was handed an exhibit. 8.57 a.m. I observed the
- 38:20Speaker 1: blood coming from her mouth, kind of a pink foam.
- 38:23Speaker 1: She was wrapped in a blanket. I asked if that
- 38:25Speaker 1: was the position she was found, and Chad said no,
- 38:28Speaker 1: Di said. She was hanging off the bed, Chad told her.
- 38:32Speaker 1: When he discovered that she was dead, they called Garth
- 38:35Speaker 1: and picked her up off the floor. A 58 AM.
- 38:38Speaker 1: Di looks to see if there was signs of any struggle.
- 38:41Speaker 1: She saw rigor mortis and lividity. Di said Tammy was
- 38:45Speaker 1: cold to the touch, and Di learned Tammy died on
- 38:48Speaker 1: her back. 9 AM. Chad said to Di that he
- 38:51Speaker 1: felt her body roll off the bed, and that's what
- 38:54Speaker 1: woke him up. I asked him how it was possible
- 38:57Speaker 1: because she was really cold. Di says he thinks it
- 38:59Speaker 1: was because... He pulled on the sheets and Tammy was
- 39:03Speaker 1: going through menopause and she liked to sleep with her
- 39:05Speaker 1: feet out of the bed. This clown had an answer
- 39:08Speaker 1: for everything, right? The only problem is these answers are
- 39:11Speaker 1: all ridiculous. And I'm sure the jury is feeling the
- 39:14Speaker 1: same exact way as we all are. 9.02am. Chad said
- 39:18Speaker 1: Tammy had been feeling really off for the past few months.
- 39:21Speaker 1: Ty says she felt outside of her body, not normal.
- 39:25Speaker 1: And she had been having fainting spells and one occasion
- 39:29Speaker 1: they were at the office at the temple, and Tammy fainted.
- 39:32Speaker 1: She had low blood pressure, but didn't seek medical attention,
- 39:35Speaker 1: and she didn't like going to the doctor, and she
- 39:38Speaker 1: treated everything naturally. There was a natural remedy book in
- 39:42Speaker 1: the side table in her bedroom. 9.03 a.m. At about 12.30 a.m.,
- 39:48Speaker 1: Tammy was having a coughing fit. This is talking about
- 39:52Speaker 1: the previous night, Dye said. Tammy reportedly threw up. 9.08 a.m.
- 39:57Speaker 1: Dye determined Tammy's death was pulmonary edema, the backup of
- 40:01Speaker 1: fluid in the lungs, a cardiac event.
- 40:05Speaker 2: 9.11 a.m.
- 40:06Speaker 1: She has made amendments to Tammy's death certificate, like homicide.
- 40:10Speaker 1: Tammy's body was exhumed. There was an autopsy done. And remember,
- 40:14Speaker 1: in the initial stages, there was no autopsy. Chad Daybell
- 40:18Speaker 1: and the family didn't want there to be one. So
- 40:21Speaker 1: the coroner and medical examiner, they just rolled with it.
- 40:25Speaker 1: But after all was said and done, and more investigation
- 40:29Speaker 1: was engaged in, they found out that things might not
- 40:32Speaker 1: have been what Chad Daybell was saying. And now we
- 40:35Speaker 1: know that not just might not have been, sure looks
- 40:38Speaker 1: likely that everything the government is saying about Chad Daybell
- 40:43Speaker 1: is true. And there hasn't been anything presented at this
- 40:45Speaker 1: trial that has changed my mind so far about Chad
- 40:49Speaker 1: Daybell's guilt or innocence. 9.12am. Di is talking about Tammy's autopsy.
- 40:56Speaker 1: As they were dissecting the bruise, there was a very
- 40:58Speaker 1: deep bruise on her arm. It didn't make sense she
- 41:01Speaker 1: had thrown up the night before because she had a
- 41:03Speaker 1: stomach full of contents. Her stomach was full of food.
- 41:07Speaker 1: If she threw up, there wouldn't be food in the
- 41:09Speaker 1: stomach during the autopsy, Di says. I am the one
- 41:12Speaker 1: who signed the death certificate. That makes that determination. All
- 41:16Speaker 1: of her organs were healthy. The only organ that was
- 41:19Speaker 1: not healthy was her lungs. There was a lot of
- 41:21Speaker 1: foam in her lungs. 9.15 a.m. I received a call
- 41:25Speaker 1: from Arizona police. They wanted my records. Chad's name was
- 41:28Speaker 1: brought up. Lori Vallow, Alex Cox, Chad Daybell's names were
- 41:32Speaker 1: brought up. 9.16 a.m. Wixom asks if Di had any regrets.
- 41:38Speaker 1: Di says she has regrets from her original decision. Had
- 41:42Speaker 1: I known that information, I would have ordered an autopsy.
- 41:45Speaker 1: At that time, with my limited training and being new,
- 41:48Speaker 1: I did the best I could with the training I
- 41:50Speaker 1: had at the time. 9.18 a.m. John Pryor, Chad's attorney,
- 41:55Speaker 1: is now at the stand for a cross-examination of Dye.
- 41:58Speaker 1: Wixom is done asking Dye questions. 9.21 a.m. Chad is
- 42:03Speaker 1: watching the questioning intently. He has his arms crossed on
- 42:06Speaker 1: the table and is leaning forward. 9.25 a.m. Pryor is
- 42:11Speaker 1: questioning Di on legal statutes right now. 9.29 a.m. He
- 42:15Speaker 1: is asking Di questions about Tammy's bruises. Di used the
- 42:19Speaker 1: word old bruises in her report. Di answers yes. 9.31 a.m.
- 42:24Speaker 1: Pryor asks Di about responding to the scene of Tammy
- 42:27Speaker 1: Daybell when she was found dead. 9.34 a.m. Emma Daybell
- 42:32Speaker 1: stated she didn't want an autopsy done because she didn't
- 42:34Speaker 1: want her mother to be treated that way. Pryor asks
- 42:37Speaker 1: and Di says yes.
- 42:38Speaker 2: 9.38 a.m.
- 42:42Speaker 1: Brenda Dye is reviewing a police report that was from
- 42:45Speaker 1: the day they responded to the Daybell home when Tammy
- 42:47Speaker 1: was found dead. Prior asked Judge Boyce for a sidebar.
- 42:51Speaker 1: Boyce asked to wait. 9.39 a.m. Sidebar taking place right
- 42:56Speaker 1: now with Judge Boyce and the attorneys. 9.45 a.m. The
- 43:00Speaker 1: sidebar is taking place. Chad Daybell appears to be reading
- 43:03Speaker 1: through some notes at the table that he's sitting at. 9.46 a.m.
- 43:09Speaker 1: After the sidebar, Judge Boyce says... We need to get
- 43:12Speaker 1: an exhibit prepared. We will take a mid-morning recess. We
- 43:15Speaker 1: will take a 30-minute break. Come back at 10.15. We're
- 43:19Speaker 1: just going to keep it rolling. 10.21 a.m. Court is
- 43:22Speaker 1: back in session.
- 43:24Speaker 2: 10.22 a.m.
- 43:25Speaker 1: Pryor continues questioning Fremont County Coroner Brenda Dye, asking her
- 43:30Speaker 1: what she did at the scene when she responded to
- 43:32Speaker 1: Tammy Daybell's body back in October 2019. 10.28 a.m. Pryor
- 43:38Speaker 1: is putting up a body chart on the projector screen
- 43:41Speaker 1: so everyone can see it. It's a little difficult to
- 43:43Speaker 1: see on my end. 1028 AM. Levitity was found on
- 43:48Speaker 1: Tammy's entire body according to the body chart. Pryor asks
- 43:52Speaker 1: and Di says yes. 1030 AM. Blood-tinged foam is also
- 43:57Speaker 1: written on the body chart for Tammy Daybell. Old bruising
- 44:00Speaker 1: was also written Pryor. You didn't put new bruising, did you?
- 44:04Speaker 2: Di, no.
- 44:05Speaker 1: So he's trying to say that there was no bruising
- 44:07Speaker 1: here and all of this is just because Tammy was
- 44:11Speaker 1: ill and she just happened to die in her sleep. 10.34 a.m.
- 44:16Speaker 1: Photo of Tammy's right arm showing some discoloration is being
- 44:19Speaker 1: admitted for an exhibit. Judge Boyce will not publish to
- 44:23Speaker 1: the public due to its graphic nature. 10.35 a.m. Prior
- 44:28Speaker 1: is asking Di about old bruises in the picture of
- 44:31Speaker 1: Tammy Daybell's arm. and asking if those are it in
- 44:34Speaker 1: the picture, and Di is responding and saying yes. 10.37 a.m.
- 44:39Speaker 1: Pryor is asking Di about the old bruises and foam
- 44:42Speaker 1: coming from Tammy's mouth. He is also asking about how
- 44:46Speaker 1: Di issued her death certificate.
- 44:50Speaker 2: 10.38 a.m.
- 44:51Speaker 1: Pryor, did you talk to Garth about how he brought her, Tammy,
- 44:54Speaker 1: a quarter pounder, and french fries? Di, no. I did
- 44:58Speaker 1: not identify what was in her stomach. There were contents
- 45:00Speaker 1: in her stomach. Pryor, We don't know if Tammy threw
- 45:03Speaker 1: up or not before she died, right? Other than what
- 45:06Speaker 1: Chad told you? Di says yes. 10.41 a.m. Pryor is
- 45:11Speaker 1: listing the different medications that Tammy Daybell took and confirming
- 45:15Speaker 1: them with Di. 10.44 a.m. Pryor, you were told that
- 45:19Speaker 1: Tammy would have minor fits consistent with seizures, correct? Di
- 45:23Speaker 1: says yes. 10.47 a.m. Pryor says Emma talked about how
- 45:28Speaker 1: her mother Tammy was taking clogging classes. but couldn't keep up.
- 45:33Speaker 1: Pryor brings up the temple and that Tammy fainted. There
- 45:37Speaker 1: were other instances listed in a report. Pryor, you made
- 45:40Speaker 1: the determination that there was a medical reason as to
- 45:43Speaker 1: how she passed away, but it all changed, right?
- 45:46Speaker 2: Die?
- 45:47Speaker 1: Says yes. So what he's saying is that somebody got
- 45:50Speaker 1: to her and made her change her story? That's basically
- 45:53Speaker 1: what he's inferring. He won't come out and say that, obviously, right?
- 45:57Speaker 1: But that's what he means.
- 45:58Speaker 2: 10.48 a.m.
- 46:01Speaker 1: Pryor's talking about how the FBI was involved with an
- 46:04Speaker 1: order to remove Tammy's body from the ground after she
- 46:07Speaker 1: was buried. 10.49 a.m. Pryor at the time of digging
- 46:12Speaker 1: her up. Were you looking for something? Die? Suspicious activity
- 46:16Speaker 1: and anything that resulted in homicide? This was after talking
- 46:20Speaker 1: to the police. 10.54 a.m. Pryor off the stand. Wixom
- 46:25Speaker 1: is back on the stand to question Die. 10.56 a.m.
- 46:29Speaker 1: Dye recalls looking for medical history and medications and looked
- 46:33Speaker 1: in the bedroom and the nightstand drawers for anything suspicious
- 46:36Speaker 1: in the Daybell home. Dye was there with deputy coroner
- 46:40Speaker 1: and an officer. 10.57 a.m. Dye mostly talked to Chad
- 46:44Speaker 1: and Emma on the scene, did not talk with Garth
- 46:46Speaker 1: very much. Garth would mainly nod to questions. 10.58 a.m.
- 46:50Speaker 1: Dye amended Tammy's death certificate later due to the results
- 46:55Speaker 1: of the autopsy and learning two dead children were at
- 46:58Speaker 1: the same home. JJ and Tylee. 11.03 a.m. Wixom talking
- 47:03Speaker 1: about the scene again when Tammy Daybell was found dead. 11.05 a.m.
- 47:08Speaker 1: Wixom sits down, prior, back on the stand asking questions
- 47:12Speaker 1: to Dye. 11.06 a.m. Boyce says that concludes the testimony
- 47:16Speaker 1: of Dye. 11.07 a.m. Kelsey Harris has been called as
- 47:20Speaker 1: the next witness. 11.08 a.m. Wixom questions Harris, asking her
- 47:26Speaker 1: about Tammy Daybell. She said Daybell was a clogging student
- 47:29Speaker 1: of hers in Sugar City and worked as a librarian.
- 47:32Speaker 1: She would see her all the time. We were friends,
- 47:34Speaker 1: Harris said. We would have conversations more than hello. 11.10 a.m.
- 47:40Speaker 1: Harris said Daybell came to her class in early August
- 47:42Speaker 1: and September 2019. Every week, a 60-minute class once a week. 11.11 a.m.
- 47:50Speaker 1: Harris doesn't recall any issues with Tammy getting tired or
- 47:53Speaker 1: falling behind in clogging classes that she taught. So what's
- 47:57Speaker 1: her daughter even talking about over here? Trying to make
- 47:59Speaker 1: up an excuse for her dad? The more I think
- 48:02Speaker 1: about it, and the more I hear from Chad Daybell's kids,
- 48:05Speaker 1: the more I feel like they're just in denial. How
- 48:09Speaker 1: could you sit here and try and cover for your
- 48:11Speaker 1: dad when there's all this evidence? 11.14 a.m. Harris went
- 48:15Speaker 1: to a high fitness class in St. Anthony. She stood
- 48:18Speaker 1: by Tammy in the class. It's a high intensity class,
- 48:21Speaker 1: burpees and explosive movements. That class was held two times
- 48:25Speaker 1: a week for 60 minutes. Tammy went in late September 2019.
- 48:30Speaker 1: Harris said she observed Tammy keeping up in class and
- 48:33Speaker 1: was doing the high-intensity moves.
- 48:36Speaker 2: 11.14 a.m.
- 48:37Speaker 1: Harris talked to her regularly in these classes. Wixom done questioning.
- 48:41Speaker 1: Harris and Pryor now asking his questions. 11.16 a.m. There
- 48:46Speaker 1: were at least five classes that Tammy attended for clogging
- 48:49Speaker 1: before she died. 11.16 a.m. Harris, I would say, she
- 48:53Speaker 1: was a very fit woman, talking about Tammy. 11.17 a.m.
- 48:58Speaker 1: Harris saw Emma Daybell in the high-intensity class with Tammy. M.O.
- 49:02Speaker 1: was also in the clogging class that Harris taught.
- 49:06Speaker 2: 11.19 a.m.
- 49:07Speaker 1: Wixom now back to asking questions. 11.20 a.m. Harris is
- 49:12Speaker 1: done testifying. She will be released from subpoena. 11.21 a.m.
- 49:17Speaker 1: Shanna Miller is now being called to the stand. 11.22 a.m.
- 49:22Speaker 1: Wixom asking questions to Miller. She was a school teacher
- 49:25Speaker 1: at Central Elementary in Sugar City for over 30 years.
- 49:28Speaker 1: She worked with Tammy Daybell. Miller was on the committee
- 49:31Speaker 1: to interview Tammy for a position in the school. She
- 49:34Speaker 1: also attended a high fitness class with Tammy.
- 49:36Speaker 2: 11.24 a.m.
- 49:39Speaker 1: Miller is talking about how Tammy and her daughter attended
- 49:42Speaker 1: the fitness class. 11.26 a.m. Miller said at first Tammy
- 49:47Speaker 1: and her daughter could not complete the workouts correctly but
- 49:49Speaker 1: over time did well. 11.26 a.m. Miller would see Tammy
- 49:54Speaker 1: every day at work. 11.27 a.m. I would say that
- 49:59Speaker 1: the time she started the fitness class, her overall image
- 50:02Speaker 1: of herself had improved. It looked like she was in
- 50:05Speaker 1: great health to me, Miller said. She was in complete
- 50:08Speaker 1: shock learning about Tammy's death. Hours before that, she had
- 50:11Speaker 1: seen her at work, and Tammy was happy, healthy, and
- 50:15Speaker 1: conversing with kids at work. She seemed perfectly healthy to me,
- 50:18Speaker 1: Miller said. Now look, there's no doubt that you can
- 50:21Speaker 1: just drop dead. Shit happens, right? But what's the likeliest
- 50:26Speaker 1: scenario here? With everything else we know, with all the
- 50:29Speaker 1: evidence that we've seen, do you really think that Tammy
- 50:32Speaker 1: Daybell just dropped dead 11.29 a.m.? Miller believes Tammy Daybell
- 50:36Speaker 1: started working at the school in Sugar City in 2018. 11.31 a.m.
- 50:42Speaker 1: Miller said Daybell was attending the high-intensity classes for at
- 50:45Speaker 1: least a year and a half. 11.33 a.m. Miller says
- 50:49Speaker 1: Tammy had the stamina to complete the workouts. Prior is done.
- 50:53Speaker 1: Miller is released from subpoena. 11.36 a.m. Jennifer Geisler called
- 50:58Speaker 1: to the stand. Wixom questioning. She works at Central Elementary School.
- 51:03Speaker 1: First grade teacher. She has worked there for 26 years.
- 51:06Speaker 1: She worked with Tammy Daybell in 2019 and says Tammy
- 51:10Speaker 1: was a librarian. She would see Tammy every day. 11.39 a.m.
- 51:15Speaker 1: We were good friends, Geisler said of Tammy. Always bubbly
- 51:19Speaker 1: and happy. She was a person that you wanted to
- 51:21Speaker 1: be around. Geisler invited Tammy and Emma to a high
- 51:24Speaker 1: fitness class. 11.39 a.m. Geisler was in the front row
- 51:30Speaker 1: and Tammy and Emma were in the back row. They
- 51:32Speaker 1: were always giggling together. and adding their own moves. Tammy
- 51:36Speaker 1: loved the class, Geisler said. She said that Tammy kept
- 51:39Speaker 1: up with the class. She does not recall Tammy ever
- 51:42Speaker 1: taking breaks. And this testimony runs right into the face
- 51:47Speaker 1: of what Chad Daybell is telling us. And it continues
- 51:50Speaker 1: to build that foundation of the case that the prosecution
- 51:54Speaker 1: is attempting to make. 11.41 a.m. The Friday before she died,
- 51:58Speaker 1: she ate lunch with Tammy. She was healthy, happy, talkative.
- 52:01Speaker 1: She was sitting by her son, Seth. It was just
- 52:03Speaker 1: a normal day, Geisler said. She was super surprised that
- 52:07Speaker 1: Tammy passed away due to her being super healthy. 11.42 a.m.
- 52:12Speaker 1: Wixom done asking questions. Pryor takes a stand. 11.43 a.m.
- 52:18Speaker 1: Geisler said her and Tammy were good friends. She never
- 52:21Speaker 1: went to Tammy's home. 11.45 a.m. Pryor's done asking questions.
- 52:26Speaker 1: Wixom back on. There is a clarification between a HiFit
- 52:30Speaker 1: class and Zumba class. HiFit is more intense. Zumba is
- 52:34Speaker 1: a little more dancey. 11.46 a.m. Geisler made a comment
- 52:39Speaker 1: to Tammy during lunch, saying that she wished she had
- 52:41Speaker 1: as healthy as her. 11.47 a.m. Pryor asked for clarification.
- 52:47Speaker 1: Tammy and her daughter did the high-fit class. It was
- 52:49Speaker 1: not Zumba. Geisler released from her subpoena. 11.48 a.m. There
- 52:56Speaker 1: is going to be a break. The next witness will
- 52:58Speaker 1: be lengthy, so the break is happening earlier. We will
- 53:00Speaker 1: be back at 1 p.m. All right, so like usual,
- 53:04Speaker 1: this is where we're going to break as well. And
- 53:06Speaker 1: in the next episode, we'll pick up where we left off.
- 53:10Speaker 1: All of the information that goes with this episode can
- 53:13Speaker 1: be found in the description box. 1.06 p.m. Court is
- 53:18Speaker 1: back in session after the lunch break. The jury is
- 53:20Speaker 1: being brought back in. 1.08 p.m. Chad Daybell and his attorney,
- 53:25Speaker 1: John Pryor, appear to be chatting, whispering to each other
- 53:28Speaker 1: a lot today. 1.08 p.m. The state is calling a
- 53:31Speaker 1: new witness. Detective Bruce Mattingly with the Fremont County Sheriff's Office. 1.11 p.m.
- 53:38Speaker 1: Fremont County Prosecuting Attorney Lindsay Blake is questioning Mattingly on
- 53:42Speaker 1: his background. She's asking him about an unattended death call
- 53:46Speaker 1: on October 19th, 2019. This is in reference to Tammy Daybell. 1.12 p.m.
- 53:53Speaker 1: He had learned that Tammy Daybell was the unattended death.
- 53:57Speaker 1: He's describing talking to an officer about what the scene
- 53:59Speaker 1: looked like. He was talking on the phone to Deputy Greenlaw.
- 54:03Speaker 1: He also said law enforcement is not the one who
- 54:06Speaker 1: determines whether to have an autopsy. The coroner makes that decision. 1.15 p.m.
- 54:12Speaker 1: There was not an investigation during the time of Tammy's
- 54:15Speaker 1: death until later in 2019.
- 54:16Speaker 2: 1.17 p.m.
- 54:21Speaker 1: He learned that the Rexburg Police Department and FBI were
- 54:24Speaker 1: looking for J.J. and Tylee, and in Arizona, they were
- 54:27Speaker 1: investigating the shooting of Boudreau and the Charles Valot incident.
- 54:31Speaker 2: 119 p.m.
- 54:34Speaker 1: Blake asks Mattingly about Tammy Daybell's medical records. She is
- 54:38Speaker 1: asking if there was any indication of health issues. Mattingly
- 54:42Speaker 1: says there were general health issues. She had been prescribed
- 54:45Speaker 1: medication for wrist pain and medication for managing depression. 121 p.m.
- 54:51Speaker 1: Tammy was reported by Chad to faint and slow down
- 54:55Speaker 1: and being dizzy. 1.22 p.m. Mattingly is being asked about
- 54:59Speaker 1: reviewing reports from Tammy Daybell the day that she died.
- 55:02Speaker 1: Emma Daybell said her mom had been slowing down, according
- 55:06Speaker 1: to reports. Emma was unwilling to speak to Mattingly, he says.
- 55:10Speaker 1: Mattingly made attempts to talk to her. And the whole
- 55:13Speaker 1: entire Hills Have Eyes vibe from the Daybell clan continues
- 55:17Speaker 1: to resonate with me. Like who doesn't want to talk
- 55:20Speaker 1: to the police after their mother dies? Unless you think
- 55:24Speaker 1: your dad did it and you're trying to cover for him.
- 55:27Speaker 1: There's no good excuse in my mind for you not
- 55:29Speaker 1: talking to the police. And furthermore, if my mom was
- 55:33Speaker 1: to God forbid pass away under unexpected circumstances, you don't
- 55:38Speaker 1: want to have an autopsy to find out what went on?
- 55:40Speaker 1: What if there's some sort of generational health issue? Never
- 55:44Speaker 1: mind being suspicious of a crime, but what about finding
- 55:48Speaker 1: out what killed your mother? 1.24 p.m. I learned that
- 55:51Speaker 1: Tammy had two life insurance policies, Mattingly says. 1.27 p.m.
- 55:56Speaker 1: There was an exhibit up on the screen. It had
- 55:58Speaker 1: been taken down. Now there is a sidebar. 1.28 p.m.
- 56:02Speaker 1: Sidebar's over. The exhibit is on the projector screen. It
- 56:05Speaker 1: appears to be a life insurance policy. This is very
- 56:08Speaker 1: hard to see on the live feed. 1.30 p.m. A
- 56:12Speaker 1: monitor is not working in the jury pool. None of
- 56:14Speaker 1: the jury can see what's happening on their screens. The
- 56:17Speaker 1: court is going to try and fix it. 1.31 p.m.
- 56:21Speaker 1: Chad Daybell filled out this form. He wrote October 18th, 2019,
- 56:24Speaker 1: the day before Tammy died. Chad said her health started
- 56:29Speaker 1: to have changes. Oh, I'm sure, very convenient, that all
- 56:33Speaker 1: of a sudden her health started to have changes. But
- 56:35Speaker 1: nobody in her clog class saw any kind of issue?
- 56:39Speaker 1: According to Chad Daybell and his daughter Emma, she was
- 56:41Speaker 1: slowing down. But nobody... that is an independent source, can
- 56:46Speaker 1: confirm that. In fact, we're hearing the opposite. 1.32 p.m.
- 56:50Speaker 1: A Fitbit was on Tammy's side of the bed, and
- 56:53Speaker 1: Mattingly said they requested a search warrant from Fitbit to
- 56:56Speaker 1: look into her health.
- 56:58Speaker 2: 1.35 p.m.
- 56:59Speaker 1: We were looking for a heart rate, sleep patterns, and
- 57:02Speaker 1: their activity, Mattingly says of the search warrant to Fitbit. 1.37 p.m.
- 57:07Speaker 1: There will be a quick break as court figures out
- 57:09Speaker 1: the monitor situation for the jurors since another exhibit will
- 57:13Speaker 1: have to be shown on the screen. 1.55 p.m. Court
- 57:17Speaker 1: is still in break. Appears there are still issues with
- 57:20Speaker 1: the monitors for the jury. 2.02 p.m. Court's back in session. 2.03 p.m.
- 57:26Speaker 1: Blake is on the podium. She is putting an exhibit
- 57:29Speaker 1: on the screen in regards to Fitbit information. Mattingly is
- 57:33Speaker 1: discussing the Fitbit account for Tammy Daybell. And it's pretty
- 57:37Speaker 1: amazing how far technology has come. You can wear a
- 57:40Speaker 1: watch or a Fitbit or whatever, and it's going to
- 57:42Speaker 1: give you your heart rate. It's going to give you
- 57:44Speaker 1: sleep patterns. And there's a lot of good that can
- 57:48Speaker 1: come from knowing all of that, right? And if you
- 57:51Speaker 1: end up passing away, there's a lot that the investigators
- 57:55Speaker 1: can get from those records.
- 57:57Speaker 2: 2.06 p.m.
- 58:00Speaker 1: I cannot see the exhibit on the screen in the
- 58:01Speaker 1: live stream. It's very difficult to see the details, but
- 58:05Speaker 1: essentially Fitbit information is being discussed.
- 58:08Speaker 2: 2.08 p.m.
- 58:10Speaker 1: Mattingly says they were not able to get heart rate
- 58:12Speaker 1: information from Tammy's Fitbit. The sleep data was very sparse,
- 58:16Speaker 1: Mattingly said. 2.09 p.m. They were provided step counts from
- 58:21Speaker 1: day to day and year to year, Mattingly says in
- 58:23Speaker 1: regards to Tammy Daybell's Fitbit. 2.11 p.m. Out of all
- 58:28Speaker 1: the months, Tammy was generally above average or she was
- 58:31Speaker 1: close when it came to her step count on her Fitbit.
- 58:34Speaker 1: Mattingly did not see anything where she was slowing down.
- 58:38Speaker 1: Mattingly researched that 10,000 steps is normal to have per day.
- 58:43Speaker 2: 2.13 p.m.
- 58:45Speaker 1: I found that she was very active and a go-getter,
- 58:48Speaker 1: Mattingly says of Tammy Daybell. He didn't get any indication
- 58:51Speaker 1: that she was slowing down. 2.16 p.m. Blake hands Detective
- 58:55Speaker 1: Mattingly an exhibit. He's looking through the pages. Meanwhile, Chad
- 58:59Speaker 1: Daybell is talking with his attorney, John Pryor, and they
- 59:02Speaker 1: appear to be looking at his screen. 2.18 p.m. Total
- 59:06Speaker 1: life insurance. On the Primerica, there was... $ 300, 000, and LifeMap
- 59:11Speaker 1: was $ 130, 000. Mattingly learned that both had been paid out
- 59:15Speaker 1: to Chad Daybell. Blake's done questioning. Pryor's now at the podium. 2.20 p.m.
- 59:21Speaker 1: Pryor is asking Mattingly about how he mentioned talking about
- 59:25Speaker 1: Emma Daybell and how Mattingly tried to talk to her.
- 59:28Speaker 1: He is asking dates and times. 2.21 p.m. I have
- 59:32Speaker 1: referenced Emma a few times as Emma Daybell. She is
- 59:35Speaker 1: Emma Murray, but she is Chad and Tammy's daughter. 2.33 p.m.
- 59:39Speaker 1: Joe or Joseph Murray refused to talk to Mattingly too,
- 59:43Speaker 1: Mattingly said. Joe Murray is married to Emma. 2.28 p.m.
- 59:47Speaker 1: Pryor is talking about Tammy Daybell's health history, like her anemia.
- 59:52Speaker 1: Now why wouldn't this lady, her daughter, want to talk
- 59:55Speaker 1: to the investigator? What are you hiding? Why are you
- 59:58Speaker 1: clamming up? And why aren't you helping out? And we're
- 1:00:02Speaker 1: not even talking about like a stranger here where your
- 1:00:04Speaker 1: dad might have, you know, gotten to an altercation or whatever.
- 1:00:07Speaker 1: We're talking about your mother. So it tells me everything
- 1:00:10Speaker 1: I need to know about the Daybell clan by the
- 1:00:13Speaker 1: way they conduct themselves. None of them are interested in
- 1:00:15Speaker 1: finding out the real story about what happened to their mother.
- 1:00:18Speaker 1: All they really care about is making sure Ulf Stunat
- 1:00:21Speaker 1: over here doesn't get the death penalty. 2.37pm. There was
- 1:00:25Speaker 1: a Fitbit competition that Tammy Daybell was a part of.
- 1:00:28Speaker 1: Mattingly learned that Tammy was a competitive person. 2.39pm. Pryor
- 1:00:34Speaker 1: is done. Blake back on the podium. 2.40pm. Blake is
- 1:00:38Speaker 1: asking if any of Chad's children voluntarily came forward with information. Mattingly,
- 1:00:43Speaker 1: not one. Emma was not willing to speak to Mattingly
- 1:00:46Speaker 1: and did not provide any information on her mother's health,
- 1:00:48Speaker 1: he says. Well, that's not a big red flag, right?
- 1:00:51Speaker 1: All these kids and not one of them want to
- 1:00:53Speaker 1: talk to the authorities about what happened to their mother?
- 1:00:56Speaker 1: None of them are curious, huh? 2.45 p.m. Blake is done.
- 1:01:00Speaker 1: Mattingly might be recalled to the stand, but for now,
- 1:01:03Speaker 1: he is finished and remains subpoenaed. 2.45 p.m. Detective Vince
- 1:01:08Speaker 1: Kayakamanu has been called to the stand. He was a
- 1:01:11Speaker 1: detective at the time of the case. He was with
- 1:01:14Speaker 1: Fremont County Sheriff's Office. He is currently with the Madison
- 1:01:17Speaker 1: County Sheriff's Office. 2.48 p.m. Kaya Kamanu had talked with
- 1:01:22Speaker 1: Officer Greenhall on an unattended death. He could not go
- 1:01:26Speaker 1: to the call in 2019 because he was helping Idaho
- 1:01:29Speaker 1: Falls Police Department with an officer-involved shooting. 2.51 p.m. During
- 1:01:34Speaker 1: that time, he did not learn of anything suspicious from
- 1:01:37Speaker 1: the unattended death, which was Tammy Daybell.
- 1:01:39Speaker 2: 2.54 p.m.
- 1:01:42Speaker 1: My main focus was Tammy, Kaya Kamanu says, about when
- 1:01:45Speaker 1: he was involved in the investigation. He did assist with
- 1:01:49Speaker 1: locating and helping JJ and Tylee too. Blake asked him
- 1:01:53Speaker 1: about October 9th, 2019. The nature of the call had
- 1:01:57Speaker 1: to do with a suspicious event. It involved a gun
- 1:02:00Speaker 1: or a paintball gun being pointed at someone. 3 p.m.
- 1:02:04Speaker 1: Another 911 call is being listened to. This one from
- 1:02:07Speaker 1: the Tammy Daybell from October 9th, 2019. Tammy describes that someone,
- 1:02:12Speaker 1: dressed in black, had a mask, and she said he
- 1:02:15Speaker 1: had a paintball gun. She yelled for her husband, Chad. 3.05pm,
- 1:02:19Speaker 1: Blake asking Kaya Kamanu about Alex Cox now. Pryor and
- 1:02:23Speaker 1: Daybell are chatting on the side. 3.06pm, Blake is asking
- 1:02:28Speaker 1: about a firearm that was seized. It could have been
- 1:02:30Speaker 1: what was used during the paintball incident. 3.08pm, Blake is
- 1:02:35Speaker 1: asking Kaya Kamanu about paintball guns and what he knows
- 1:02:38Speaker 1: about them. 3.13pm, Blake is now asking about Alex Cox again. 3.18pm,
- 1:02:45Speaker 1: Blake would like to show an exhibit but it's not working.
- 1:02:48Speaker 1: Boyce is concluding evidence for the day. 3.18 p.m. Boyce
- 1:02:52Speaker 1: said there are some motions he is a part of tomorrow.
- 1:02:55Speaker 1: He wants to start court at 9 a.m. tomorrow. Next week,
- 1:02:58Speaker 1: court won't happen. On Tuesday, April 30th. 3.20 p.m. Court's
- 1:03:03Speaker 1: finished for the day, and the jury has been excused.
- 1:03:06Speaker 1: Detective Kayakamanu was not finished on the stand and should
- 1:03:09Speaker 1: be back tomorrow. Boyce is talking about motions that will
- 1:03:13Speaker 1: be discussed in regard to designating victims in the case.
- 1:03:17Speaker 1: He wants to take a break and come back in
- 1:03:19Speaker 1: 20 minutes. The motions will be streamed live for the public,
- 1:03:22Speaker 1: he says. 3.42 p.m. Boyce came back after a 20-minute break.
- 1:03:28Speaker 1: Motions are going to be discussed. Two motions from the state.
- 1:03:32Speaker 1: One is a notice from the court about designation of victims. 3.44 p.m.
- 1:03:37Speaker 1: Prosecutor Wood addressing the court. He is asking Kay Woodcock, J.J.
- 1:03:41Speaker 1: Vallow's grandmother, and Charles Vallow's sister, who has designated a
- 1:03:45Speaker 1: victim in this case, and can give an impact statement,
- 1:03:48Speaker 1: to be able to stand in for Charles Vallow during
- 1:03:50Speaker 1: the trial. Annie Cushing would be in place for Tylee Ryan,
- 1:03:54Speaker 1: Cushing is her aunt. No objections.
- 1:03:57Speaker 2: 3.51pm.
- 1:03:58Speaker 1: There is a motion in Lamine that relates to a
- 1:04:00Speaker 1: proposed statement made by Janice Olsen regarding Tammy Daybell's life insurance.
- 1:04:05Speaker 1: Another motion in Lamine is in regards to Janet Anderson
- 1:04:09Speaker 1: that alleged statements about Tammy Daybell as a zombie. 4.04 p.m.
- 1:04:15Speaker 1: Pryor and Wood discussing back and forth about life insurance.
- 1:04:19Speaker 1: Lots of hearsay issues.
- 1:04:20Speaker 2: 4.11 p.m.
- 1:04:23Speaker 1: Lots of legal talk right now. 4.13 p.m. Boyce will
- 1:04:27Speaker 1: get an oral ruling on the motion at 8.30 a.m. tomorrow. 4.15 p.m.
- 1:04:32Speaker 1: Other motion in Lamine being discussed in regards to witness
- 1:04:35Speaker 1: Janet Anderson that alleged statements about Tammy Daybell as a zombie.
- 1:04:39Speaker 1: Wixom tells the court that these motions are all about
- 1:04:43Speaker 1: two witnesses with two statements and they are trying to
- 1:04:45Speaker 1: enter testimony in court. Wixom wants it to be admitted
- 1:04:49Speaker 1: into trial. 4.19 p.m. Pryor said it's hearsay and the
- 1:04:54Speaker 1: timing of it all is suspect. 4.21 p.m. Boyce will
- 1:04:58Speaker 1: rule on the motions tomorrow morning at 8.30 a.m. Jurors
- 1:05:02Speaker 1: will be brought in at 9 a.m. Court is done
- 1:05:04Speaker 1: for the day. So again, no surprises one way or
- 1:05:07Speaker 1: the other. Things are moving along exactly as expected. And
- 1:05:11Speaker 1: unless there's some sort of miracle for Chad Daybell, it
- 1:05:14Speaker 1: looks like he's going to be sharing the same fate
- 1:05:16Speaker 1: as Lori Vallow very, very soon. Either way, we're going
- 1:05:19Speaker 1: to be here the whole entire way, following along and
- 1:05:23Speaker 1: recapping what goes down every day inside of the courtroom
- 1:05:27Speaker 1: as the state of Idaho looks to drop the hammer
- 1:05:29Speaker 1: on Chad Daybell. All of the information that goes with
- 1:05:33Speaker 1: this episode can be found in the description box.
