- 0:03Speaker 1: This is a Bramble Jam podcast. This week on your
- 0:13Speaker 1: Gabble Gabble.
- 0:14Speaker 2: If your boyfriend starts a cell phone in your name,
- 0:16Speaker 2: can you sue him for the money?
- 0:18Speaker 1: Judge Mathes is here to tell you.
- 0:19Speaker 3: And if you fall off a cliff because of an
- 0:22Speaker 3: unmarked path, can you assue the hotel or are they
- 0:27Speaker 3: gonna leave you a high and dry Judge Gino tells
- 0:30Speaker 3: us real peoplecases just.
- 0:36Speaker 1: Got bad news? What got bad news? Already? Did that one?
- 0:39Speaker 1: I've never heard this case? He's walking was there? We're
- 0:43Speaker 1: gonna do it again. I've never heard it.
- 0:46Speaker 2: Uh Uh, I think it's a I don't remember if
- 0:49Speaker 2: it's a she or he.
- 0:50Speaker 1: The she is the hotel person?
- 0:52Speaker 3: Man, I I typically remember. Uh, well, I'm gonna tell
- 0:56Speaker 3: you about it.
- 0:56Speaker 1: Then we're still gonna do it twice.
- 0:59Speaker 3: Why wouldn't I? If I don't remember it, then a
- 1:01Speaker 3: lot of people probably don't.
- 1:02Speaker 2: Okay, Well, we've had the case that we've done before
- 1:04Speaker 2: and we've just stopped and not done it.
- 1:05Speaker 3: I'm going to do it. I'm going to do it.
- 1:07Speaker 3: And if you heard it then maybe you won't like it.
- 1:10Speaker 3: But some people might maybe haven't heard it, and they
- 1:12Speaker 3: haven't heard it from my point of view.
- 1:13Speaker 1: They haven't. They just tuned into this gavel. They not
- 1:15Speaker 1: listened to it. Now we've done it.
- 1:19Speaker 3: Yeah's the show before. So there you Goesh, what do
- 1:23Speaker 3: you got? I got a judge, matthis okay? You want
- 1:27Speaker 3: me to go first?
- 1:27Speaker 1: Sure? All right.
- 1:29Speaker 2: Tierra Thompson is suing Pierre Johnson for seventeen and six dollars.
- 1:35Speaker 2: Tierra and Pierre, Tierra and Pierra. Yes, Tierra and Pierre. Okay, great,
- 1:41Speaker 2: Tierra says, me and Pierre we met around the beginning
- 1:44Speaker 2: of spring at a club in downtown Chicago, and our
- 1:48Speaker 2: relationship progressed really quickly.
- 1:51Speaker 1: He portrayed himself to be this is her words, not mine.
- 1:54Speaker 1: I want to be very clear.
- 1:56Speaker 2: He portrayed himself to be this big top chef and
- 1:58Speaker 2: had all this money. In actuality, he was a little
- 2:01Speaker 2: hood booger. Never heard that one. I've not heard hood
- 2:07Speaker 2: booger before, heard it today, learned a new new word.
- 2:11Speaker 2: He was a little hood boger. He was broke, and
- 2:13Speaker 2: he was a schemer. And matthis says, oh, how long
- 2:17Speaker 2: did it take you to find out.
- 2:18Speaker 1: That this is who he really was?
- 2:20Speaker 2: And she was like I found out in July and
- 2:22Speaker 2: they met in the spring, and he was like, oh,
- 2:24Speaker 2: it took you that long. He's a chef, he said,
- 2:27Speaker 2: he was a big top chef. You didn't go to
- 2:29Speaker 2: his restaurant and realized he was a hood booger. And
- 2:32Speaker 2: she goes, well, no, we worked together. I know he
- 2:35Speaker 2: can cook. He was a chef where I worked too.
- 2:37Speaker 2: Oh so he was just like a line cook basically
- 2:39Speaker 2: at the okay, right? So uh, Pierre's like, listen, I
- 2:44Speaker 2: met Tierra.
- 2:45Speaker 1: She's really cool. Turns out she's a cheater, she's a liar,
- 2:47Speaker 1: she's insecure. Matthis says, did you catch her cheating? Tiera?
- 2:52Speaker 2: The whole time he's about to tell this story. The
- 2:55Speaker 2: whole time Pierre's about to tell the story, Tiera has
- 2:58Speaker 2: a smile on her face. Not only did she cheat,
- 3:01Speaker 2: she enjoyed herself and is reliving it. She is smiling
- 3:04Speaker 2: and just like halving the time of her life. I
- 3:07Speaker 2: don't I don't understand why you. Some people go to.
- 3:09Speaker 1: The club have fun, some people go to court. Yeah.
- 3:13Speaker 2: Pierre's like, yeah, I did. I caught her cheating. And
- 3:16Speaker 2: she started blaming me for everything. And I was like,
- 3:19Speaker 2: if she's blaming me for everything that she probably trying
- 3:21Speaker 2: to hide something, And so we had a conversation where
- 3:25Speaker 2: I was like, we both need to just be honest
- 3:26Speaker 2: with everybody with each other, and we were like yeah,
- 3:28Speaker 2: and I asked her to be honest with me.
- 3:30Speaker 1: Have you ever cheated? And she said technically no?
- 3:33Speaker 2: Oh and uh, he was like technically no, what does
- 3:38Speaker 2: that mean? She said, well, we really weren't together. And
- 3:41Speaker 2: then she said, yeah, I did cheat with my friend,
- 3:43Speaker 2: but it only happened one time, and I promise.
- 3:45Speaker 1: I won't do it again.
- 3:46Speaker 3: Oh, and everybody knows it's once one time past.
- 3:51Speaker 2: And she then you pan over to tear She's just
- 3:54Speaker 2: smiling like hear her full teeth grin like and and
- 3:58Speaker 2: basically Pierre's like, I couldn't get and so I ended
- 4:01Speaker 2: up breaking up with her, and that's why she was here.
- 4:04Speaker 2: On top of that, this is my favorite part of
- 4:06Speaker 2: this case and why it is an old timer.
- 4:09Speaker 1: On top of that, she was pretty muchly pregnant. What
- 4:15Speaker 1: pretty much?
- 4:16Speaker 2: Le Pierre says, pretty muchly pregnant, and matthis did exactly
- 4:22Speaker 2: what you did? He goes, what pretty much?
- 4:26Speaker 3: Lee?
- 4:27Speaker 2: And and she go he goes, shoot, yeah, He goes,
- 4:30Speaker 2: how can you be pretty much pregnant. And he goes, well,
- 4:34Speaker 2: I guess she was. She was pregnant, okay, And matthis
- 4:38Speaker 2: is like when you met her, she was pregnant. He's like, no, no, no,
- 4:41Speaker 2: she said it was mine, but I didn't believe her.
- 4:43Speaker 2: And he said and Mathis goes, well, did you do
- 4:46Speaker 2: a DNA test? And he said no, I didn't do
- 4:49Speaker 2: a DNA test because she terminated the pregnancy. And she
- 4:52Speaker 2: didn't tell me she terminated the pregnancy. I found out
- 4:55Speaker 2: through my co workers. She didn't even tell me herself.
- 4:58Speaker 2: She was never going to tell me. So Tierra says,
- 5:01Speaker 2: first off, you're honor. He has three kids with three
- 5:03Speaker 2: baby mamas and three child supports.
- 5:05Speaker 1: What would you do?
- 5:07Speaker 2: Matthis goes well, I wouldn't put myself in that circumstance.
- 5:10Speaker 2: I cannot answer what you would do in that situation
- 5:13Speaker 2: because I would not be in that situation.
- 5:17Speaker 1: Sierra then goes yeah, always sympathetic. Yeah, He's like yeah.
- 5:20Speaker 2: He's like, hey, I gotta let me get to this.
- 5:22Speaker 2: What's this money about? And she's like, in July, I
- 5:24Speaker 2: received a letter from a collection agency that I owed
- 5:28Speaker 2: at and T and seventy eight dollars and fifty two
- 5:31Speaker 2: cents for a cell phone billow, and I knew it
- 5:34Speaker 2: wasn't mine because I had not had a cell phone
- 5:36Speaker 2: in eight months. I owed money to Sprint, couldn't afford
- 5:38Speaker 2: a cell phone, so I didn't get a cell phone.
- 5:41Speaker 2: So I got this pill and I called him and
- 5:42Speaker 2: they were like, no, this phone line's in your name.
- 5:45Speaker 2: Here's the number, and so I the number of the
- 5:47Speaker 2: phone was Pierre's cell phone.
- 5:49Speaker 1: Wow. So I called Pierre.
- 5:51Speaker 2: And I was like, she must have called him on
- 5:53Speaker 2: her landline and uh and asking afford and he just
- 5:57Speaker 2: denied it. He's like, no, She's like, I called him
- 6:00Speaker 2: a liar, and he said it wasn't wasn't me.
- 6:02Speaker 1: Come here on my cell phone. Wasn't me?
- 6:04Speaker 4: Uh?
- 6:05Speaker 2: And then he said I'll fix this, but I won't
- 6:07Speaker 2: pay anything. He was like, I'll fix it, but I
- 6:09Speaker 2: won't pay anything.
- 6:10Speaker 1: You're lying. I'll fix it. Got a bill from Verizon,
- 6:13Speaker 1: wasn't me? Got a bill from Mobile? Wasn't me. Even
- 6:16Speaker 1: having add makes it tough. You kind of gotta go
- 6:23Speaker 1: with just att.
- 6:26Speaker 2: Pierre's like, listen, when she asked me about this phone bill,
- 6:29Speaker 2: I asked to see it. I just need a proof.
- 6:31Speaker 2: She never brought me proof. She everything she did was
- 6:33Speaker 2: about draming money. I said. She said she had a bill,
- 6:36Speaker 2: and I out her twelve hundred dollars. I said, show me.
- 6:38Speaker 2: She refused to show me. She was supposed to bring
- 6:41Speaker 2: me this bill to workhouse, never shows. Does she have
- 6:44Speaker 2: the bill in court?
- 6:45Speaker 1: Do you have the bill in court, ma'am? Tierra goes, yes,
- 6:48Speaker 1: I do.
- 6:49Speaker 2: Okay, I didn't expect it either. I expect it. And
- 6:53Speaker 2: he goes, well, it's here now, you can see it now.
- 6:55Speaker 2: Piers like, she never brought it to me to see it.
- 6:56Speaker 2: I would have paid her if she never brought it.
- 6:59Speaker 2: Don't say that I've never seen it. Mathis goes, well,
- 7:01Speaker 2: we got it here, we got it right here, and
- 7:04Speaker 2: and then he goes. Pier says, well, she got the phone.
- 7:08Speaker 2: She knew about this phone. She got this phone for me,
- 7:11Speaker 2: she knew it. It's under her name, not my name.
- 7:14Speaker 2: She got it, she knew about it, you know. Tierra's like,
- 7:18Speaker 2: I don't know anything about this.
- 7:19Speaker 1: This is not true. I don't know anything about it.
- 7:21Speaker 3: So his story is yea that he didn't open it up.
- 7:25Speaker 2: She opened it up, and Maths is like, all right,
- 7:27Speaker 2: that's twelve hundred whatever you're suing for seventeen oh six,
- 7:29Speaker 2: and Tierra said, well, I also was living with Pierre
- 7:32Speaker 2: for a month and I was in school. I had
- 7:34Speaker 2: my laptop. We broke up. I went back to my place.
- 7:37Speaker 2: I left my laptop there. I kept asking for it back.
- 7:40Speaker 2: He said he wasn't going to give it back. I've
- 7:42Speaker 2: got text messages that say he won't give me the
- 7:44Speaker 2: laptop back.
- 7:45Speaker 1: Pierre's like, you're on her, that's not true.
- 7:47Speaker 2: Anytime she asked me for the computer, I told her,
- 7:49Speaker 2: come get the computer. Well, she never got it, and
- 7:52Speaker 2: when I moved, it got thrown away. So I don't
- 7:55Speaker 2: have the computers. Something I can do about it. Math's
- 7:57Speaker 2: ready to rule.
- 7:57Speaker 3: Well, I think the fun thing is cutting in my opinion,
- 8:01Speaker 3: that he's gonna have to owe that money. The way
- 8:04Speaker 3: that he handled that with mathis is just not how
- 8:07Speaker 3: you do it. He started by saying she never showed
- 8:10Speaker 3: me the bill. If I saw the bill, I would
- 8:12Speaker 3: have paid it, and then changed his story too. Well,
- 8:14Speaker 3: she opened the account, she knew about it.
- 8:16Speaker 1: I didn't do it. That makes it seem to me
- 8:19Speaker 1: that he did.
- 8:20Speaker 3: Like whatever, however it happened, he knew that he was
- 8:26Speaker 3: supposed to pay it. That's how I take that. All
- 8:28Speaker 3: that information, So I think is gonna pay it? No laptop,
- 8:31Speaker 3: I'm gonna say no, I'm just gonna just pay for
- 8:33Speaker 3: the Pune.
- 8:33Speaker 2: Matthis reads a text that he sent her about the
- 8:37Speaker 2: laptop that was like, I ain't giving you nothing. Ever,
- 8:40Speaker 2: that was enough for Mathis he gives it all?
- 8:42Speaker 3: Is it all? Yeah? That's fair, that's fair, Dan Stobby,
- 8:45Speaker 3: you've heard this one though, But we're going to personal
- 8:47Speaker 3: herd record. Doctor Eric Howard is suing for uh do
- 8:52Speaker 3: you remember how much?
- 8:53Speaker 1: I don't. It's an astounding amount of money. So there's
- 8:56Speaker 1: a lot of money.
- 8:56Speaker 3: One million in past medical eight million in pain and
- 8:59Speaker 3: suffering ten million for lost wages for a total of
- 9:02Speaker 3: nineteen million dollars. He is issuing the Oakmont North Hotel,
- 9:09Speaker 3: represented here in court by Sheila rays So. Eric Howard
- 9:14Speaker 3: and his ex wife they would go to the oak
- 9:17Speaker 3: Mont Hotel every year.
- 9:20Speaker 1: They loved it and they would bring their kids there.
- 9:22Speaker 3: They'd go hiking, they'd go rock climbing, they'd have picnics.
- 9:26Speaker 3: It was the best place. He has lots of fond
- 9:28Speaker 3: memories there. After his wife and him got a divorce.
- 9:34Speaker 3: He wanted to go there because it's his happy, happy
- 9:37Speaker 3: place and also spend some time kind of reminiscing during
- 9:40Speaker 3: this tough time.
- 9:42Speaker 1: Sheila says that the hotel.
- 9:45Speaker 3: Is in the midst of the mountainous train, there's beautiful scenery.
- 9:50Speaker 1: They are everywhere.
- 9:51Speaker 3: They are known for their hiking trails, and she says
- 9:54Speaker 3: that she knew the Howards they would come every year
- 9:57Speaker 3: and notice that this was the first time that he
- 10:00Speaker 3: had ever come without missus Howard, so knew something must
- 10:03Speaker 3: be up. Eric shows up and does bring a friend
- 10:08Speaker 3: kind of make it a bro's trip, but it wasn't
- 10:12Speaker 3: as helpful as he would hope because once they start
- 10:15Speaker 3: talking about the divorce, his buddy is basically like, hey, man,
- 10:19Speaker 3: maybe it's your fault, and that's not what anybody wants to.
- 10:21Speaker 1: Hear in the midst of a messy divorce.
- 10:24Speaker 3: Even if it is your fault, everybody knows you bring
- 10:28Speaker 3: your bro, and your bro has to read the room
- 10:31Speaker 3: and figure out, hey, does my bro here want some hard.
- 10:34Speaker 1: Truth or that does he just want somebody to listen
- 10:37Speaker 1: to him?
- 10:38Speaker 3: And this guy apparently did not read that room correctly.
- 10:42Speaker 3: It's not what he wanted and so he decides that
- 10:44Speaker 3: he's going to go for a walk by himself, clear
- 10:47Speaker 3: his mind, doesn't need his buddy around, and he only goes.
- 10:53Speaker 3: He goes a little ways down, and suddenly, as he's
- 10:57Speaker 3: walking along this trail, he finds himself falling fifteen to
- 11:02Speaker 3: twenty feet down to the ground.
- 11:05Speaker 1: He tumbles down.
- 11:07Speaker 3: The mountain and he feels his leg snap in half,
- 11:12Speaker 3: feels his arm break, and feels his head hit a rock.
- 11:17Speaker 1: Belt his wallet at nineteen dollars. He is going in
- 11:22Speaker 1: and out.
- 11:22Speaker 3: Of consciousness and he thinks that he's gonna die. Judge
- 11:27Speaker 3: Gina looks at him. He's like, you're lucky to be alive.
- 11:29Speaker 3: Right next right, and the crowd judge shout out. Sheila says,
- 11:34Speaker 3: we want people to enjoy the property at this hotel,
- 11:38Speaker 3: and we have marked the trails very clearly, the trails
- 11:41Speaker 3: that people are allowed to walk on, and we make
- 11:43Speaker 3: sure that they know about this ahead of time. So
- 11:46Speaker 3: they have yellow lines that show you where to go,
- 11:50Speaker 3: and it's like painted onto the the trails.
- 11:55Speaker 1: If you see the lines, that means this is a
- 11:57Speaker 1: good trip.
- 11:58Speaker 3: Mister Howard knew this and shows to walk on a
- 12:01Speaker 3: trail that clearly does not have the line, is doesn't
- 12:04Speaker 3: have to yellow line, doesn't have the markings that say
- 12:07Speaker 3: this is a walking trail. She shows a video of
- 12:11Speaker 3: this trail that he was on. It is clearly not marked,
- 12:14Speaker 3: and it also is clearly a cliff that has like
- 12:19Speaker 3: you know, it's a it's a nice amount that you
- 12:23Speaker 3: could walk on, but it is at the end of
- 12:26Speaker 3: the day, it is a cliff. It's not like these
- 12:28Speaker 3: other trails that we see are like in the woods
- 12:31Speaker 3: and stuff.
- 12:31Speaker 1: This is up against this is a cliffs.
- 12:35Speaker 3: She uh shows one of the safe trails, clear yellow line,
- 12:39Speaker 3: clearly safe. And also we have signs that say steep cliffs,
- 12:47Speaker 3: stay on.
- 12:47Speaker 2: Trails, pretty cut and drive the steep cliffs trails.
- 12:51Speaker 1: Yeah. Doctor Howard says that trail did not have a sign.
- 12:55Speaker 3: But you know, it was getting dark when I went
- 12:58Speaker 3: out there, so I just assumed there was a line.
- 13:00Speaker 1: It was kind of dark. I couldn't really see him.
- 13:02Speaker 1: She listens.
- 13:02Speaker 3: Doctor Howard just wasn't paying attention. Cut, cut and dry. Uh,
- 13:06Speaker 3: he says, Uh, don't insult, don't insult my intelligence. I'm
- 13:10Speaker 3: a surgeon. I know a sign when I see a sign.
- 13:12Speaker 3: He knows he's a surgeon. Only surgeons does signs when
- 13:15Speaker 3: they see signs. Doctor Howard Uh points out that this
- 13:21Speaker 3: injury has forced him to not be able to work.
- 13:25Speaker 3: He you know, he's a surgeon, he knows signs, but
- 13:28Speaker 3: also he can no longer do his job. And it
- 13:32Speaker 3: is due to the negligence of the hotel Uh in
- 13:36Speaker 3: making the trail even possible to get to in the
- 13:39Speaker 3: first place. The fact that I could easily get to
- 13:42Speaker 3: this trail makes it seem like this is an okay
- 13:46Speaker 3: trail to go on even if there wasn't markings.
- 13:51Speaker 1: And Judge Gino asks.
- 13:53Speaker 3: Why they haven't why they didn't put up a gate
- 13:56Speaker 3: to make sure that people didn't go.
- 13:57Speaker 1: On the trail.
- 13:57Speaker 3: Doctor Howie says, well, I have a picture that shows
- 13:59Speaker 3: that after my accidents, they did put up a gate,
- 14:03Speaker 3: which I feel like shows that they agree that they
- 14:07Speaker 3: should have done more afterward.
- 14:10Speaker 1: Yes, that would lead you to believe they're admitting that
- 14:12Speaker 1: they're wrong. That's exactly right, that's exactly what they're saying.
- 14:15Speaker 3: He says, my life is never going to be the
- 14:18Speaker 3: same because of the negligence of the hotel. She says, no,
- 14:23Speaker 3: it is because of you, and Judge Gina's ready to rule.
- 14:29Speaker 1: Do you remember what happens?
- 14:31Speaker 2: I think he gets some of this money. I don't
- 14:33Speaker 2: think he should get any. I remember thinking he shouldn't
- 14:35Speaker 2: get any. But I remember I think that he gets some,
- 14:39Speaker 2: but not all, so like maybe fifty one percent.
- 14:43Speaker 1: Uh. Judge Gino, says doctor Howard.
- 14:46Speaker 3: I'm all huh, I think. And this is why it's
- 14:49Speaker 3: fun to do it again. Is it because you're entirely wrong? Wrong?
- 14:54Speaker 3: Doctor Howard has uh to prove that the hotel was wrong,
- 14:58Speaker 3: that they're wrong caused the injury. Doctor Howard provided the
- 15:02Speaker 3: picture of the gate that they put up after this
- 15:05Speaker 3: accident happened.
- 15:07Speaker 1: Legally, though, them putting.
- 15:09Speaker 3: It up after your accident doesn't count against them. They're
- 15:15Speaker 3: just doing a thing that you can legally do. It
- 15:18Speaker 3: doesn't prove that they think that they were in the wrong. Also, legally,
- 15:23Speaker 3: when there is a hazard such as a cliff or
- 15:27Speaker 3: an ocean or a swimming pool that is open, if
- 15:31Speaker 3: it's open and obvious, you don't have to do anything
- 15:35Speaker 3: that's right. It is nature's way of saying, hey, don't
- 15:40Speaker 3: The cliff was open and obvious. Therefore they don't have
- 15:43Speaker 3: to have any more warnings.
- 15:46Speaker 1: Or gates or anything like that legally, so.
- 15:49Speaker 3: No money at all, ask for nineteen million, walked out
- 15:54Speaker 3: with nothing, and that is tough.
- 15:57Speaker 1: We do.
- 15:57Speaker 3: We make Congratulations. We're gonna be back next time with
- 16:01Speaker 3: some more gavel. Until then, All Rise.
