- 0:18Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:21The topic is dating during divorce. Now, this episode today
- 0:25is based on an article on our blog Famallawheadquarters dot
- 0:29com dated January twenty eight, twenty twenty five, and the
- 0:33title of that article is is dating during divorce Okay?
- 0:38So as a follow up to the episode today, going
- 0:40over to Familawheadquarters dot com and read that article from
- 0:44more information all Right, Dating during divorce common question lots
- 0:48of individuals ask when going through a divorce. Lots of
- 0:53clients want to know is this okay? Is this not okay?
- 0:57Should I date? Should I not date? Lots of individuals
- 1:01feel the need to connect with somebody while they're going
- 1:05through a divorce. I mean, the reality is, if you
- 1:07think about it, is like a guy going through divorce
- 1:09is only going to be able to hang out with
- 1:11their guy friends so much. I mean, they're not going
- 1:14to be able to do it all the time. The
- 1:15same with ladies. You know, hanging out with the lady
- 1:17friends all the time is going to be tough. You know,
- 1:20they've got other things going on, and so the need
- 1:23to connect, the need to date, in a way, comes
- 1:26from this feeling of emptiness. It comes from the feeling
- 1:29of loneliness. All of a sudden, they're going through divorce
- 1:31where they don't have their kids. They're spending a bunch
- 1:34of time by themselves. When somebody's spending a bunch of
- 1:36time by themselves, They're in their thoughts, you know, they
- 1:39can spin in a way, worrying about the divorce and
- 1:43worrying about the outcome of it. So in a lot
- 1:45of ways, individuals may just be looking for sort of
- 1:48a distraction. They might be looking for something fun during
- 1:52their divorce that takes their mind off the divorce itself,
- 1:56which can be overwhelming, it can be stressful, and so
- 2:01this is where a lot of it comes from. Now,
- 2:03maybe other individuals have other motivations for wanting to date.
- 2:06I mean, maybe they're looking to get re very quick
- 2:08or get into a serious relationship quick. Everybody's different. But
- 2:12I mean, the truth of the matter is, this is
- 2:15a very very common question that lots of individuals ask,
- 2:18so is dating during divorce a good idea? Look, the
- 2:20textbook answer to that question is it's not a good idea.
- 2:25Any legal textbook answer is going to say, wait until
- 2:31after the divorce is finished to begin dating. So this
- 2:34is the textbook answer. I mean, this is the answer
- 2:37I would give anybody else if they want to be
- 2:39as safe as possible, wait until after the divorce is
- 2:43over to begin dating. And so then lots of individuals say, well,
- 2:47why why do I need to wait? Well, the truth
- 2:51of the matter is if somebody begins dating and they
- 2:54get into a relationship with somebody, it's possible that the
- 3:00other spouse could think, oh no, this was going on
- 3:03before the divorce was filed, and maybe my spouse was
- 3:06having an affair the whole time. They say, this relationship
- 3:09only began after we separated and the divorce began, But
- 3:13oh no, I don't believe them. I think that this
- 3:15affair was going on for a long time, and maybe
- 3:18this was kept hidden from me. Okay, this is where
- 3:20a lot of individual's minds might go. And so then
- 3:23what can happen is a new significant other ends up
- 3:25being subpoened and they get subpoened as to maybe child
- 3:29cussy issues, financial issues, you name it, and it can
- 3:32really make a mess of things if that were to occur. Okay,
- 3:36So that is risk number one that it just muddies
- 3:39the water and potentially complicates things. If a new significant
- 3:43other ends up being introduced to the kids, this could
- 3:47be potentially problematic as well. The other spouse might argue
- 3:51this is harmful the kids. The kids are still just
- 3:53reeling from the divorce and getting used to that. Now
- 3:56they're being introduced to a new significant others so soon,
- 4:00and so this can cause the divorce to become more
- 4:03complicated if the other spouse is not approving of the
- 4:06fact that there's an introduction having taken place, right, and
- 4:11so this can muddy the waters. Others would also argue
- 4:13this which is looking individuals should heal from the divorce fully,
- 4:18let that percolate, let that transpire, let them move on
- 4:21from it before they enter into new relationships or begin dating,
- 4:25because if not, they could just be jumping from the
- 4:27marriage into a new relationship and maybe they haven't put
- 4:30a whole lot of thought into it, and that maybe
- 4:32this isn't a good thing. It could just lead to
- 4:34more breakups and more drama and more problems. So this
- 4:39is another common reason a lot of individuals or lawyers
- 4:44will tell people, hey, don't begin dating until after the divorce. Okay,
- 4:49better to wait until after it's over. Okay. So there
- 4:53could be other reasons that that lawyers give their clients
- 4:56or that counselors give their clients, you know, to wait
- 4:59to eight until after the divorce is over. But these
- 5:01are some of the big ones that I've seen. Okay.
- 5:04In saying this, though, a lot of individuals are still
- 5:07not really moved and they're hoping that there is some
- 5:10kind of window where they can begin dating again. This
- 5:14goes back to what I was saying at the beginning.
- 5:16When going through a divorce, Okay, there can be feelings
- 5:19of emptiness. An individual can feel very lonely, especially if
- 5:23they don't have the kids with them, you know. So
- 5:25now they're in let's say they've separated, they're living by themselves,
- 5:28they don't have their kids with them, Okay. It's hard
- 5:32to hang out with your plutonic friends. Only so much
- 5:34so if your guy, you got your guy friends, Okay,
- 5:36they can't hang with you all the time. Your lady
- 5:39got your lady friends. They can't hang with you all
- 5:41the time. So then individuals are sitting at home and
- 5:43they're spinning, they're thinking about their divorce or in their thoughts,
- 5:47and it's just like, gosh, having a distraction in the
- 5:50minds of many would be a good thing. And so
- 5:52they're still thinking, is it terrible if I begin dating?
- 5:55I know I shouldn't, but is it really going to
- 5:57be awful if I do? Again, the textbook answer any
- 6:01lawyer would give their client as you should wait. All right,
- 6:05that's the textbook answer. That's the safest approach. All right.
- 6:08But for those who are still like, I hear that,
- 6:11but I still want to date. I still feel a
- 6:14desire to date. I still feel like if I date
- 6:16and I just strack myself from the divorce, then this
- 6:20is going to be actually better because I'm going to
- 6:22be happier because I'm enjoying life and I'm not just
- 6:25obsessing over the divorce. So this is again where a
- 6:27lot of people are going, and a lot of people
- 6:29are thinking, okay, And so look for individuals who hear
- 6:34all this and they're like, look, I'm going to date.
- 6:37I feel like I need a date. I'm just not
- 6:39going to sit at home and pout over this divorce.
- 6:41I feel like I need to get out there. Look,
- 6:44there's some things individuals can do if they're going to
- 6:46date that can really minimize a risk. Okay, and let
- 6:50me give you these, which is, Look, it's important to
- 6:53be separated first. If you're still living in the same
- 6:56home with your spouse, not a great time to begin dating, right.
- 6:59I mean, house is gonna see you coming and going
- 7:02and leaving and all these different things, and that can
- 7:05raise questions right there. So typically, if a person's not
- 7:09going to wait until they're divorced, at least wait till
- 7:11you're physically separated, all right. Don't introduce a new significant
- 7:15other to the kids while the divorce is betting so zich.
- 7:17If an individual is going to date, okay, but don't
- 7:20do intros with the kids until after the divorce is over.
- 7:23Not a good thing. If you do that, you can
- 7:25really make the divorce a lot more complicated, and there
- 7:28can be arguments you're harming the kids psychologically or something
- 7:30like that. So don't do intros until after the divorce
- 7:33is over. Okay. Don't have overnight visitors over while you've
- 7:38got the kids as well. Right, so you got a
- 7:39new boyfriend, you got a new girlfriend, Okay, don't have
- 7:42them stay the night it's your place while the kids
- 7:46are with you during the divorce. Like, that's a bad
- 7:48idea that can really cause a divorce to blow up. Okay,
- 7:53don't do that. Don't post about it online. Be discreet.
- 7:57Right so you got a new boyfriend, you got a
- 7:59new girlfriend, and you're excited about it. Okay, great, but
- 8:02don't be posting about it and put it out in
- 8:04the public sphere. Be discreet, keep it private. And if
- 8:09you do that, then it might not even become known
- 8:15to your spouse and might not even become an issue.
- 8:17All right. So again for individuals that are just like, look,
- 8:21I'm just going to date. I'm willing to assume the risk.
- 8:25These are some tips that I think are important, which
- 8:28is waiting till physical separation, not introducing any significant others
- 8:32to the kids, not having overnight visitors while you have
- 8:35the kids, and being discreet by not posting about it
- 8:37online or faunting this new relationship. Like, these are all
- 8:41important things to do. The other thing I would say
- 8:43is this, But a lot of individuals ask this question
- 8:47and they want to know if they can begin dating
- 8:49or not. What they say is, look, my spouse is
- 8:52already dating. You know, my spouse already has a new
- 8:54boyfriend or girlfriend. You know, they're out there dating, and
- 8:58everybody knows dating. Why can't I begin dating? Okay, Obviously,
- 9:03this argument, in a way, you know, cannot be the greatest.
- 9:08It's you know, it can be an argument like, well,
- 9:10they're doing it, so I can do it kind of thing,
- 9:12and sometimes that's not the best argument to make in
- 9:15any area of life. But in this specific area, if
- 9:20the other spouse is dating, and they're openly dating, then
- 9:23I do think in a way it's hard for them
- 9:25to make an issue of you dating when they're doing
- 9:29it themselves, right, And so I do think the risk
- 9:32if this becoming a giant issue is even a little
- 9:34bit smaller if the other spouse is already dating. Though, again,
- 9:38if you're going to begin dating again, keep in mind
- 9:41the things I talked about, which is the waiting until
- 9:43physical separation, not introducing any significant others new significant others,
- 9:49new boyfriends or girlfriends of the kids, not having the
- 9:51overnight visitors, and not flaunting it in these kinds of things. Okay,
- 9:55So again, dating a divorce, very very important topic, very
- 9:58very common topic. Again, the textbook answer is not to
- 10:01do it, to wait until after the divorce, but look
- 10:05for a lot of individuals, that's tough stuff, particularly when
- 10:08a divorce could take many months, could take more than
- 10:11a year. I've seen cases come close to take it
- 10:14two years. So for a lot of individuals, it's like, well,
- 10:17I can't put my life on hold forever. So you know,
- 10:20in hearing this, if individuals are like, well, I'm just
- 10:22going to date anyway, it's best to follow some of
- 10:25the tips I've given here today and not flaunt this
- 10:29relationship and make it a big deal, because if you
- 10:32do it, it can really complicate the divorce and result
- 10:36in more problems that a lot of individuals probably aren't anticipating.
- 10:41All right, well, this is the topic again, dating during divorce.
