- 0:13And I'm your host, Will Walden. SpaceX faces allegations for
- 0:17federal labor officials for unlawfully terminating 8
- 0:20employees in 2022. Now, these employees had
- 0:23distributed a letter critical of Spacex's founder Elon Musk,
- 0:27particularly over his handling of sexual harassment claims and
- 0:30his behavior on social media. And this development adds to a
- 0:34series of legal challenges confronting Musk's other
- 0:36enterprises as well, including X or Twitter and also Tesla.
- 0:41Now, the National Labor Relations Board of the MLRB
- 0:44complaint focuses on the employees effort to distance
- 0:48SpaceX from Musk's controversial social media statements,
- 0:51including his response to sexual harassment allegations.
- 0:54Now this letter, supported by a group of over 13,000 SpaceX
- 0:58staff, also urged the company to revise and uniformly enforce its
- 1:02harassment policies. Gwen Shotwell, Spacex's
- 1:05President and CEO, along with other executives, allegedly
- 1:08restricted the distribution of this letter, a move the Labor
- 1:11board deems illegal. And the NLR BS actions aim to
- 1:15secure remedies like reinstatement and back pay for
- 1:18the dismissed workers, emphasizing the importance of
- 1:21employee rights in corporate settings.
- 1:23Now Paige Holland, Thailand, one of the discharge employees
- 1:26express hope for accountability of SpaceX.
- 1:29They criticized the company's treatment of its workforce.
- 1:32They said at SpaceX, the Rockets may be reusable, but the people
- 1:36who build them are treated as expendable.
- 1:39And Spacex's lack of immediate response to these allegations
- 1:43fits kind of in a pattern that Elon Musk does.
- 1:45This approach was evident his reactions on X or Twitter, where
- 1:49he drastically reduced the workforce of that company,
- 1:52including firing internal critics from day one.
- 1:55And the labor board's accusation against SpaceX mirrors a similar
- 1:59case involving Tesla. Tesla faced NLRB scrutiny for
- 2:03illegally firing a worker engaged in union activities, a
- 2:07decision that was upheld by a federal court.
- 2:10Now this pattern of Labor disputes across must company
- 2:13raises questions with the NLRB. And adding to Spacex's legal
- 2:18challenges, the Justice Department sued the company for
- 2:21alleged hiring discrimination against asylum seekers and
- 2:25refugees. This case is currently hindered
- 2:27by an injunction, but it contributes to the growing
- 2:30scrutiny of Spacex's employee practices.
- 2:33Now, the controversy of SpaceX intensified following a 2021
- 2:36essay by a former employee detailing unaddressed sexual
- 2:40harassment. This incident, alongside a
- 2:42separate $250,000 harassment claim settlement involving Musk,
- 2:47which he denied and mocked on Twitter, has put a spotlight on
- 2:50the company's culture and the policies.
- 2:52As of late, the critical letter from SpaceX employees emerged in
- 2:55this context, with Gwynn Shotwell initially appearing
- 2:58supportive of the initiative. However, the situation escalated
- 3:01with Shotwell reprimanded employees involved in the
- 3:03letters distribution, leading to the firing of several staff
- 3:07members, including organizers Tom Moline and Holland Thailand.
- 3:11And the NLR BS complaint extends beyond the firing, setting
- 3:14additional violations like a SpaceX vice president's
- 3:18criticism of the letter and implied threats to employees
- 3:21disagreeing with Musk's behavior.
- 3:24These actions, along with the senior HR officials alleged
- 3:27surveillance of the employees, shows the broader concern over
- 3:32at SpaceX. Reuters reports that the open
- 3:34letter described Musk as a distraction in embarrassment,
- 3:38highlighting the broader issue of workers rights to advocate
- 3:41for better working conditions under federal labor law.
- 3:44Now, the NLR BS involvement in this case is very significant,
- 3:48with his general counsel functioning akin to a
- 3:50prosecutor. The process potentially leading
- 3:53to a hearing before an administrative judge could
- 3:56result in orders for SpaceX to reinstate the employees with
- 3:58back pay should the firings be deemed unlawful.
- 4:03A Musk's company have faced several accusations regarding
- 4:06employee rights. For instance, X was charged by
- 4:09the NLRB for of legally dismissing an employee over
- 4:12tweets about the company's policies, and Tesla has been
- 4:16embroiled in various complaints including race discrimination
- 4:20allegations. The outcome of this case could
- 4:22have significant implications for how employee rights are
- 4:25viewed and protected at SpaceX. The focus of the NLR BS
- 4:29complaint is not just the termination of these employees,
- 4:32but also the manner in which Spacex's leadership,
- 4:35particularly CEO O Gwen Shotwell, handled the situation.
- 4:39Now, the allegation that Shotwell and other executives
- 4:42unlawfully restrict the distribution of the letter
