- 0:06Speaker 1: Gary Gensler is back and he's here to support China.
- 0:08Speaker 2: We'll break it down for you.
- 0:09Speaker 1: My name is Paul Barrel, welcome back in the tech path.
- 0:11Speaker 1: I do want to thank our sponsor and that is Tangum.
- 0:14Speaker 1: This is the place right now in this volatile time.
- 0:18Speaker 1: Getting self custody in your plan is a key thing
- 0:21Speaker 1: and what I would do if you look at diversification,
- 0:24Speaker 1: meaning be able to reduce your risk, get into self
- 0:27Speaker 1: custy wallets. You can start to move some of your
- 0:29Speaker 1: crypto off of exchanges.
- 0:30Speaker 2: Guys.
- 0:31Speaker 1: This is one of the best deals out there in
- 0:32Speaker 1: terms of wallets. It's the one I support, we love it,
- 0:37Speaker 1: I use it. It's definitely one for you guys to get,
- 0:40Speaker 1: so check it out. Let's go over to a couple
- 0:42Speaker 1: of points right now. Breaking coming in from kobeec US
- 0:46Speaker 1: officials are planning to use negotiations with seventy plus nations
- 0:49Speaker 1: to ask them to disallow China to ship.
- 0:53Speaker 2: Goods through their country.
- 0:54Speaker 1: So this would change things dramatically if we get a
- 0:58Speaker 1: dog pile of pro coach to Chinese goods and would
- 1:03Speaker 1: maybe align the US in terms of a global trade
- 1:07Speaker 1: structure that could look quite different, which means more manufacturing
- 1:12Speaker 1: and other things in other countries that are now starting
- 1:15Speaker 1: to play ball with the US, including Japan, Korea, and
- 1:19Speaker 1: of course even Cambonia was talking about this Bangladesh. We've
- 1:21Speaker 1: started to see a lot of new manufacturing nations start
- 1:24Speaker 1: to deploy play into what Trump is trying to pitch.
- 1:28Speaker 1: This is so hard. The Chinese small businesses now have
- 1:31Speaker 1: brought to a standtil standstill by Trump's tariffs. And the
- 1:35Speaker 1: question will be a couple of things.
- 1:38Speaker 2: When you look at.
- 1:39Speaker 1: The and I don't know what the current data is
- 1:42Speaker 1: in terms of overall GDP by small business in China.
- 1:45Speaker 2: Here in the United States, it's quite large.
- 1:47Speaker 1: But if you look at their position right now, we're
- 1:50Speaker 1: worried if Trump does not change his mind, that it
- 1:52Speaker 1: will be a dangerous thing for our factories. This of
- 1:55Speaker 1: course coming in from a lot of these small businesses
- 1:58Speaker 1: her key buyers, including Walmart also in the US. We've
- 2:01Speaker 1: stopped production already, she says. All the products are in
- 2:04Speaker 1: the warehouse, so everything has come to a standstill. The
- 2:07Speaker 1: question is how much pain can China take.
- 2:09Speaker 2: On this.
- 2:12Speaker 1: In lieu of you have to remember China does a
- 2:14Speaker 1: lot of subsidies for their major business. As a matter
- 2:17Speaker 1: of fact, most of their manufacturing is subsidized. The United
- 2:21Speaker 1: States does not do that. And if China doesn't layer
- 2:24Speaker 1: this down into their small business ecosystem, we could see
- 2:30Speaker 1: some pretty big impacts. So this most likely has a
- 2:32Speaker 1: large amount of jobs that could play into this. I
- 2:35Speaker 1: want to go to a clip right quick. This is
- 2:37Speaker 1: Gavin Newsom saying maybe I need to step aside and
- 2:41Speaker 1: do something specific for tariffs.
- 2:43Speaker 3: Take a look today, I ask a lawsuit on behalf
- 2:46Speaker 3: of the state of California is suing the Trump administration.
- 2:49Speaker 3: California is the largest manufacturing state in our Union, one
- 2:53Speaker 3: of the largest training partners around the globe. No state
- 2:57Speaker 3: will be impacted more than the state of California relates
- 3:00Speaker 3: to the unilateral authority that's been asserted by the Trump
- 3:04Speaker 3: administration to impose the largest tax increase in modern American history.
- 3:09Speaker 4: It hasn't been filed quite yet the complaint, but it
- 3:11Speaker 4: does appear that Gavin Newsom is trying to make this
- 3:13Speaker 4: argument that the tariffs against Mexico, Canada and China that
- 3:16Speaker 4: initial batch are harming consumers and businesses. We should say that,
- 3:21Speaker 4: of course, this is coming as a challenge to how
- 3:23Speaker 4: the President invoked IPA, the International Emergency Economics Powers Act,
- 3:27Speaker 4: and we've actually have seen some other lawsuits against this
- 3:31Speaker 4: when it comes to the so called reciprocal tariff plan
- 3:33Speaker 4: on two basis. One that the emergency evoked for that
- 3:36Speaker 4: which would be the trade and balances, doesn't rise to
- 3:39Speaker 4: the level of national emergency. In this case, it would
- 3:42Speaker 4: appear that California is saying that the fetanyl and immigration
- 3:46Speaker 4: might not rise to the level of the emergency. And then,
- 3:49Speaker 4: of course the second part of this is that AIPA
- 3:51Speaker 4: actually doesn't explicitly state that tariffs can be evoked. So
- 3:54Speaker 4: those are potentially two legal paths that we could see
- 3:57Speaker 4: happen here. But we should also importantly say that in
- 4:00Speaker 4: the past, the courts and the justice system has really
- 4:03Speaker 4: broadly given presidents the authority to invoke national emergencies and
- 4:07Speaker 4: often sides with them in these cases.
- 4:10Speaker 1: Yeah, I think that will be the case right now
- 4:13Speaker 1: from a federal tariff standpoint, is that the states will
- 4:16Speaker 1: most likely just fall in line California. This is more
- 4:19Speaker 1: of a posturing situation, which Newsom is really good at
- 4:22Speaker 1: in terms of posturing. Right now quite possibly going to
- 4:25Speaker 1: be running on the ticket very soon. So you've got
- 4:28Speaker 1: other senators and congressmen out there pushing against China.
- 4:33Speaker 2: This is Rick Scott.
- 4:34Speaker 1: Of course, he announced a bill package that is going
- 4:36Speaker 1: to be designed to protect investors American investors and crack
- 4:40Speaker 1: down on the exploitation of a lot of Chinese companies.
- 4:44Speaker 1: And mainly this is around disclosure. It's the same kind
- 4:48Speaker 1: of framework that American companies have to abide by, even
- 4:51Speaker 1: international companies have to trade on our stock exchange. China
- 4:56Speaker 1: has not necessarily been forthcoming. This is something that has
- 4:59Speaker 1: been worked on for quite some times. This came from
- 5:02Speaker 1: a tweet right here from Scott saying congratulations Trump's nominie
- 5:06Speaker 1: for the SEC chair Paul Atkins, this of course being
- 5:09Speaker 1: the situation where Paul Atkins, if you'll remember, has also
- 5:12Speaker 1: already been on record saying that he is interested in
- 5:16Speaker 1: getting the Chinese companies delisted primarily because of their trading tactics.
- 5:20Speaker 1: So this could mean a lot of the Chinese companies
- 5:25Speaker 1: could start to disappear off of the S and P
- 5:27Speaker 1: five or the New York Stock Exchange.
- 5:29Speaker 2: This will be a big deal.
- 5:30Speaker 1: And I think this is a completely separate issue than tariffs,
- 5:35Speaker 1: because it is more of a regulatory alignment of how
- 5:39Speaker 1: companies have to act to be able just to trade
- 5:41Speaker 1: on stock exchange that I think will go through.
- 5:44Speaker 4: Now.
- 5:44Speaker 1: It's very possible also that this could be incorporated somehow
- 5:49Speaker 1: into a tariff negotiation that I would not like because
- 5:53Speaker 1: even though the SEC, I mean, listen, there's inside trader
- 5:56Speaker 1: going all the time, trading going all the time, there's
- 5:58Speaker 1: a lot of companies that are out abiding by.
- 6:00Speaker 2: The rules that the SEC overlooks.
- 6:02Speaker 1: Yes, we see that, but to do it kind of
- 6:06Speaker 1: lockstock like what we're seeing right now with these Chinese
- 6:08Speaker 1: companies would be the key. Now, Gary Ginsler has come
- 6:12Speaker 1: back to say, I think there might be a better way.
- 6:15Speaker 2: Here's my opinion. Take a look.
- 6:18Speaker 5: But China for twenty years was not really following out rules.
- 6:23Speaker 5: But we were successful negotiating with China that they behaved
- 6:28Speaker 5: and they followed the rules, and we treated China with
- 6:32Speaker 5: respect but with firmness, and as long as I was there,
- 6:36Speaker 5: they entered into a fifty page agreement and they have
- 6:40Speaker 5: been abiding by those agreements.
- 6:43Speaker 1: You know, it's so interesting coming from the guy who's
- 6:46Speaker 1: been delisting crypto companies left and right, you know, in
- 6:50Speaker 1: terms of just being able to, at least regulatory wise,
- 6:54Speaker 1: there is framework in place for stock companies to trade
- 6:58Speaker 1: a publicly traded stock, and that I think is kind
- 7:02Speaker 1: of the two face scenario that plays out with Gensler
- 7:05Speaker 1: not a fan of what he's talking about, and again
- 7:07Speaker 1: he is really wrong here. This is O'Leary coming in
- 7:11Speaker 1: and explaining exam Now, this is actually what's happening right now.
- 7:14Speaker 2: Take a look.
- 7:16Speaker 6: If you go and look on the NASDAQ or the
- 7:18Speaker 6: New York Stock Exchange, there's eight hundred billion dollars worth
- 7:21Speaker 6: the market capitalization of Chinese companies that don't comply by
- 7:24Speaker 6: American gap laws.
- 7:25Speaker 2: I have to comply.
- 7:27Speaker 6: I have to pay millions of dollars to actually comply
- 7:29Speaker 6: with the rules of the SEC and all the other regulators.
- 7:32Speaker 6: The Chinese guys don't, and they get to raise money.
- 7:34Speaker 6: So when I'm trying to raise dollars, I'm competing with
- 7:36Speaker 6: the Chinese company that doesn't even comply. I mean, how
- 7:39Speaker 6: is that even legal?
- 7:41Speaker 3: Donald Trump said your speed dial? Does he get this? Yes?
- 7:44Speaker 6: And the good news there is they just brought a
- 7:46Speaker 6: new sheriff into town. His name is Paul Atkins. He's
- 7:50Speaker 6: the new head of the SEC and he will finally
- 7:54Speaker 6: make these companies comply. There's a law on the books
- 7:57Speaker 6: that was brought out up four years ago by Rick Scott,
- 8:00Speaker 6: Senator from Florida that says, if you're a Chinese company
- 8:02Speaker 6: you're not complying with GAP, you have twenty four thirty
- 8:05Speaker 6: six months to apply. Then he's tightened the law, made
- 8:07Speaker 6: it twenty four months and if you don't apply, you're delisted.
- 8:09Speaker 6: So I'm asking and I went to the Hill last week.
- 8:13Speaker 6: I said to Atkins.
- 8:14Speaker 2: Hey, are you going to force this law?
- 8:17Speaker 6: And he said, yeah, We're going to start delisting these
- 8:18Speaker 6: companies finally. And that Rick Scott sent him a letter
- 8:21Speaker 6: he made public last week saying, hey, look, do your job,
- 8:24Speaker 6: because if you don't, I'm going to make a lot
- 8:26Speaker 6: of noise. And I think that's what Atkins is going
- 8:28Speaker 6: to do.
- 8:30Speaker 1: That could be the first thing we see come out
- 8:32Speaker 1: of the SEC and Paul Atkins's office is a delisting
- 8:36Speaker 1: of these Chinese stocks. Now, Gary Ginsler talks about this
- 8:39Speaker 1: a little further around the time frame, because ninety days
- 8:42Speaker 1: is kind of where we are right now, and whether
- 8:44Speaker 1: or not this is going to end, well, take a look.
- 8:48Speaker 5: I think it's not going to end well, Andrew. I
- 8:51Speaker 5: think it's it's going to be a bit of a quagmire.
- 8:54Speaker 5: My experience is that they're tough negotiators, don't get me wrong,
- 8:59Speaker 5: and they're looking out for their advantage. But the best
- 9:03Speaker 5: way to handle the situation is to be consistent, to
- 9:08Speaker 5: be honorable and treat them with dignity, and to take
- 9:11Speaker 5: the toughest messages private and one on one. And they
- 9:16Speaker 5: sort of think that they time is on their side.
- 9:19Speaker 5: I'm not saying it always is, but that's how they
- 9:22Speaker 5: think is time's on their side and they can outweigh
- 9:25Speaker 5: the volatility of the policy on the other side. But
- 9:29Speaker 5: I don't think it's going to be that easy. I
- 9:31Speaker 5: think ninety days to kind of negotiate with dozens of countries,
- 9:36Speaker 5: big consequential agreements, and then China is watching all this,
- 9:41Speaker 5: and don't forget the real instability for businesses and thinking
- 9:47Speaker 5: about their investments. They're pulling back. They have to be
- 9:51Speaker 5: much more careful about their investments. And then don't forget
- 9:54Speaker 5: about the deep instability in the stock market and the
- 9:58Speaker 5: US treasury markets are some of our considerations, of course,
- 10:03Speaker 5: as our economy weekends and our markets are far more uncertain, all.
- 10:09Speaker 1: Right, So I don't know if I agree with that
- 10:10Speaker 1: in the sense that they have time on their hands,
- 10:13Speaker 1: because I feel like they have because of the trade
- 10:15Speaker 1: imbalance right now. Remember they're almost five to one on
- 10:18Speaker 1: trade to the US versus US to China. And if
- 10:21Speaker 1: you if you start to see a weakening of supporting
- 10:24Speaker 1: of those companies, which we're already starting to see coming
- 10:26Speaker 1: out of the Trump administration, eventually this is going to
- 10:29Speaker 1: press I would say.
- 10:31Speaker 2: On the other side.
- 10:32Speaker 1: Now, granted, yeah, there's always certain sectors of the industry
- 10:35Speaker 1: that most likely will get affected, but this is just
- 10:38Speaker 1: another blow has nothing to do with tariffs in terms
- 10:42Speaker 1: of how these stocks are going to play out on
- 10:44Speaker 1: the New York Stock Exchange and whether or not they
- 10:46Speaker 1: can just even come to the level of regulatory alignment
- 10:50Speaker 1: that every other company on elicted on the Stock Exchange
- 10:54Speaker 1: has to abide. Bye to O'Leary's point, Now he gets
- 10:57Speaker 1: into another statement in here. This is Gensler where he
- 11:02Speaker 1: starts to talk about, now the betting markets.
- 11:05Speaker 2: This is so crazy.
- 11:06Speaker 1: Take a look how they're on robin Hood.
- 11:09Speaker 7: You can bet on sports outcomes. It's kind of getting
- 11:11Speaker 7: you close to the sports betting piece of it. But
- 11:12Speaker 7: prediction markets would be kind of a fun to look,
- 11:15Speaker 7: be fun if CNBC could host prediction markets, you know,
- 11:17Speaker 7: should we be able to, should they be broadly legal
- 11:19Speaker 7: in this country?
- 11:22Speaker 5: Well, Kelly, I used to be honored to share another agency,
- 11:25Speaker 5: the Commodity Futures Trading Commission, and we told a lot
- 11:28Speaker 5: of look at that ten fifteen years ago, and I
- 11:30Speaker 5: know more recently, and I think that it does help
- 11:34Speaker 5: people hedge certain risk. If you're hedging a risk of
- 11:38Speaker 5: weather events and you're hedging a risk with regard to
- 11:43Speaker 5: non non traditional financial risk and so forth.
- 11:46Speaker 8: Will it just be fun?
- 11:47Speaker 7: Do you have to give a sedge a risk? Could
- 11:49Speaker 7: I just pay, you know, spend a dollar saying this
- 11:51Speaker 7: is what I think is going to happen with I
- 11:53Speaker 7: don't know, March madness.
- 11:55Speaker 2: Dictator risks.
- 11:58Speaker 5: No, No, I understand that, and I think that it
- 12:01Speaker 5: can be fun. I get it, and it can be fun.
- 12:05Speaker 1: Gary Gensler said, it can be fun.
- 12:08Speaker 2: What's going on? Man?
- 12:09Speaker 1: He's now out there, tieless man, just living the life.
- 12:12Speaker 1: I guess Gary. One thing to take a look at, though,
- 12:15Speaker 1: back on tariffs is you've got to look at the
- 12:17Speaker 1: pressure coming in from China. Let me kind of zoom
- 12:19Speaker 1: in on that for you guys, or excuse me from Japan.
- 12:22Speaker 1: Japan's government pension fund now says it switched its foreign
- 12:25Speaker 1: equities investment benchmark to exclude domestic Chinese shares, So they've
- 12:32Speaker 1: already made the move. I imagine that we're most likely going
- 12:35Speaker 1: to see that starting to make its way into the
- 12:39Speaker 1: strategies right now fund managers, probably immediately as we start
- 12:44Speaker 1: to see the pressure escalate on this delisting as we
- 12:47Speaker 1: go forward. All right, I want to go to one
- 12:48Speaker 1: more clip here. This is Trump versus China on the
- 12:51Speaker 1: trade deficit.
- 12:52Speaker 2: Take a look.
- 12:53Speaker 8: He's not going to balance the budget the trade deficit.
- 12:55Speaker 8: Balancing the trade deficit would take a multi year recession.
- 12:58Speaker 8: I think there is an inconsistency of what he trying
- 13:00Speaker 8: to deliver. You cannot have a much narrower trade deficit
- 13:04Speaker 8: and to have lower bond yields and have a weaker dollar.
- 13:08Speaker 8: That is an impossible and.
- 13:10Speaker 7: Have a government deficit of eight percent of GDP.
- 13:13Speaker 8: Right that something has to break there absolutely. And also
- 13:16Speaker 8: as much as countries are queuing up apparently to say
- 13:20Speaker 8: that they will invest more in the US, and we've
- 13:22Speaker 8: had announcements from Japan and Taiwan. Actually, if you are
- 13:26Speaker 8: investing now, and I remember a lot of countries have
- 13:28Speaker 8: been investing in the US for the last three years,
- 13:31Speaker 8: helped by the Inflation Reduction Act and the Chips Act.
- 13:34Speaker 8: But now if you're building plant in the US, you're
- 13:37Speaker 8: paying tariffs on a lot of the building materials and
- 13:40Speaker 8: other areas that you are doing. So he is making
- 13:43Speaker 8: the costs of producing in the US more expensive, and
- 13:47Speaker 8: particularly as we go into twenty twenty six, you are
- 13:50Speaker 8: going to see a lot of those savings going into
- 13:54Speaker 8: European investments. And there's still a lot of credibility in
- 13:58Speaker 8: US institutions into terms of perhaps not the same yields
- 14:01Speaker 8: that you got out of the US, but you don't
- 14:03Speaker 8: have the same growth performance in the US uncertainty and
- 14:09Speaker 8: I guess conviction that the US dollar is going to
- 14:12Speaker 8: be persistently strong now the euro is actually a bit stronger, all.
- 14:16Speaker 1: Right, So that I kind of agree with that in
- 14:18Speaker 1: the position that yes, there are some trickle down effects
- 14:21Speaker 1: on how this is going to roll into a lot
- 14:23Speaker 1: of the manufacturing that could be brought stayside. But really,
- 14:27Speaker 1: when you look at the situations that play out with
- 14:30Speaker 1: a lot of these I think is going to boil
- 14:32Speaker 1: down to one simple thing, and that is whether or
- 14:35Speaker 1: not Trump will hold through on this, because that is it's.
- 14:39Speaker 2: Kind of a situation right now, who's going to flinch first.
- 14:42Speaker 1: I think that they are going to come to an
- 14:44Speaker 1: agreement and I think this has all been a negotiation
- 14:47Speaker 1: ploy now. Granted, I know a lot of people are saying, man,
- 14:49Speaker 1: there's a lot of irons in the fire for this
- 14:51Speaker 1: just to be negotiations. But I think they are going
- 14:53Speaker 1: to back off these now. Granted, it's still showing up
- 14:57Speaker 1: as one of the most highest in terms of volatility
- 15:01Speaker 1: US Economic Policy Uncertainty Index source to its highest level
- 15:04Speaker 1: in history. This is where it gets crazy because that
- 15:08Speaker 1: slows the market down dramatically. A lot of investors as
- 15:12Speaker 1: well as a lot of companies are pausing much of
- 15:16Speaker 1: their strategies because they're kind of in a wait and
- 15:18Speaker 1: see moment to see how the White House is going
- 15:21Speaker 1: to close this deal. This can't go on for much
- 15:25Speaker 1: longer because I think the pressure on the White House
- 15:27Speaker 1: is going to get a little bit out of control.
- 15:29Speaker 1: And that's what worries me is when the pressure comes in,
- 15:32Speaker 1: Trump is one of those who reacts not well to
- 15:36Speaker 1: when he is wrong, and he kind of doubles down.
- 15:39Speaker 1: So how much pain can he go through? I've been
- 15:41Speaker 1: surprised at how much pain he can go through in
- 15:43Speaker 1: the past. If you read his book, he went through
- 15:45Speaker 1: a lot of pain during these negotiations, but he held
- 15:48Speaker 1: The difference is is now he's doing it with the
- 15:51Speaker 1: American people going through pain, So maybe the response is
- 15:54Speaker 1: going to be a little bit different. Again, there's a
- 15:57Speaker 1: lot of different working parts here that still are yet
- 16:00Speaker 1: to go, and I think everybody's looking at it right now,
- 16:03Speaker 1: maybe on a little bit more short term alignment. How
- 16:06Speaker 1: should you play the market if you're looking at it
- 16:08Speaker 1: today over the next sixty ninety days, because we're in
- 16:12Speaker 1: a very interesting state of flux right now.
- 16:16Speaker 2: We had this guy on the show not too long ago.
- 16:18Speaker 1: He's an analyst by the name of Christophermilion, and he
- 16:21Speaker 1: has different analysis.
- 16:22Speaker 2: Take a look.
- 16:23Speaker 9: I don't think we're going to go down in April.
- 16:25Speaker 9: I do think the market is set to bounce for
- 16:28Speaker 9: a few weeks. But I do think maybe the sell
- 16:30Speaker 9: in May and go away. We'll come into play from
- 16:32Speaker 9: where prices right now. On the SP five hundred, we
- 16:35Speaker 9: could drop about sixteen percent. That would be the next
- 16:37Speaker 9: pivot low on the chart, and that's what the fibonacci
- 16:40Speaker 9: and the short term technicals right now are pointing to.
- 16:44Speaker 9: With that said, the caveat is, I do believe it's
- 16:46Speaker 9: popped and it's putting in a little pattern here and
- 16:48Speaker 9: it is going to try and push higher. So as
- 16:51Speaker 9: if it does that, we have to reanalyze and recalculate.
- 16:54Speaker 9: But there could be a sixteen percent drop over the
- 16:57Speaker 9: next couple weeks. To be honest, that's what happened in
- 17:00Speaker 9: two thousand and eight. It actually would reverse like right
- 17:03Speaker 9: now and hit those new lower loves and then put
- 17:06Speaker 9: in a multi month bounce. So it said, this is
- 17:09Speaker 9: why we're on the sidelines. There are massive mixed signals, all.
- 17:13Speaker 1: Right, So sidelines massive mixed signals. What he's looking at
- 17:17Speaker 1: right there was the SPX. So if it does come
- 17:21Speaker 1: off the top sixteen percent, he's talking about around a
- 17:24Speaker 1: forty five hundred SMP. So that's a problem, but it
- 17:27Speaker 1: could be good for bitcoin because we're holding at eighty
- 17:30Speaker 1: five right now sideways for about four days here. If
- 17:33Speaker 1: that were to jump up to ninety, let's take a
- 17:35Speaker 1: look at the ninety five range from where we're trading
- 17:38Speaker 1: just right now. I'm talking about a thirteen percent move here,
- 17:41Speaker 1: so that would be significant in terms of the market.
- 17:44Speaker 1: It would heat up the all coins very quickly. I
- 17:48Speaker 1: kind of agree with him. If that were to occur,
- 17:50Speaker 1: may would be a possible pullback. That's again if you're
- 17:53Speaker 1: not financial advice, but if you're trading in and out
- 17:56Speaker 1: doing things like that, if you're looking long term, all
- 17:58Speaker 1: of this is really just whether the tariff war look
- 18:01Speaker 1: to twenty six and twenty seven on your exits. Many
- 18:05Speaker 1: people are playing the game right now and they're looking
- 18:08Speaker 1: for small entries based on these market retraces as they
- 18:12Speaker 1: start to happen.
- 18:13Speaker 2: We're going to.
