- 0:14Speaker 1: are you familiar with the surroundings the buildings around the Amphitheater?
- 0:17Speaker 1: Answer yes, I am. Question okay, in relationship to this amphitheater,
- 0:21Speaker 1: this courtyard, where's the Hall of Flags located? Answer? It
- 0:25Speaker 1: would be directly west of the courtyard. Question okay, is
- 0:28Speaker 1: it part of the courtyard or is it just off
- 0:30Speaker 1: the courtyard? Answer? I think it's kind of the courtyard.
- 0:34Speaker 1: It butts up right against the courtyard, so it'd be
- 0:36Speaker 1: the west side of the courtyard. Question okay, so the
- 0:40Speaker 1: west of the courtyard. Is there a walkway across the
- 0:43Speaker 1: Hall of Flags? Answer there is? Question okay, and what no?
- 0:48Speaker 1: He gets cut off by the officer, an inside one
- 0:51Speaker 1: and an outside one. Question okay, so what is the
- 0:54Speaker 1: Hall of Flags then? Answer? The Hall of Flags is
- 0:57Speaker 1: kind of like a bridge between two buildings, and all
- 1:00Speaker 1: the flags throughout the world are represented in there, with
- 1:03Speaker 1: some chairs where people sit down and relax, with windows
- 1:06Speaker 1: so you can see through all the way to the
- 1:08Speaker 1: Utah Lake. Question okay. What are those two buildings that
- 1:12Speaker 1: are connected by this hall of Flags? Answer the Fugal
- 1:15Speaker 1: Building over to the Science building area. Question okay, so
- 1:18Speaker 1: you mentioned the Fugal building. Answer yes, Question where's the
- 1:22Speaker 1: Fugal Building located in a relationship to the courtyard? Answer
- 1:25Speaker 1: it's to the south of the courtyard? Question okay? Does
- 1:29Speaker 1: it run up against the courtyard? Answer? It does? Question
- 1:33Speaker 1: the building? Okay? What about the Woodbury Business Building? Where's
- 1:36Speaker 1: that in a relationship to the courtyard? Answer it's kind
- 1:40Speaker 1: of southeast and it runs up right against the courtyard
- 1:43Speaker 1: also question okay. And in a relationship to the Fugal building,
- 1:47Speaker 1: where's that Sorensen or excuse me, that business building the
- 1:50Speaker 1: Woodbury Business Building? Answer? Woodbury Business is right directly east
- 1:55Speaker 1: of the Fugal Question okay, And what about Sorenson Center?
- 1:59Speaker 1: Where is that low with respect to this courtyard? Answer?
- 2:02Speaker 1: The Sorenson Center is going to be kind of like
- 2:04Speaker 1: northeast of the courtyard. Question okay, does it run again
- 2:11Speaker 1: up against the courtyard? Answer yes it does. Question okay,
- 2:14Speaker 1: and where is it in relationship to the business building? Answer?
- 2:18Speaker 1: Woodbury Business Building is just directly south of Sorenson Question?
- 2:22Speaker 1: Directly south okay, the LOCI Center. Are you familiar with
- 2:26Speaker 1: that building? Answer? I am? Question and where is it
- 2:28Speaker 1: located on campus? Answer? Directly east of the courtyard Amphitheater area.
- 2:34Speaker 1: Question okay, does it run up to the courtyard the
- 2:36Speaker 1: low CI Center? Answer no, not really, it doesn't run
- 2:40Speaker 1: up against it. So the Sorenson Building is kind of
- 2:43Speaker 1: like right between those two. Question okay, in relationship to
- 2:46Speaker 1: the Sorenson Building. What direction is the LOSI Building? Answer east?
- 2:51Speaker 1: Question east? Okay? Are you familiar with the LDS Institute
- 2:55Speaker 1: building on campus? Answer yes, I am. Question where is
- 2:58Speaker 1: that located? Answer that's going to be located north of
- 3:01Speaker 1: the Losi Building and just kind of like northeast of
- 3:04Speaker 1: the courtyard. Question okay, and there's a parking structure next
- 3:09Speaker 1: to this institute building. Answer there is? Question and where
- 3:12Speaker 1: is that? Answer that's going to be so you mentioned
- 3:16Speaker 1: the Institute building, It's going to be north of the
- 3:19Speaker 1: low CI Center. There's a parking structure that has several
- 3:22Speaker 1: levels of parking. It's going to be directly west of
- 3:25Speaker 1: the Institute building. And then they also have a parking structure,
- 3:29Speaker 1: not parking structure, parking lot to the north across that
- 3:33Speaker 1: across the road. Question okay, with respect to the parking structure,
- 3:37Speaker 1: can you describe for the court how one would enter
- 3:40Speaker 1: this parking structure driving and even walking? How do you
- 3:43Speaker 1: enter and exit the structure? Answer? So, on the north
- 3:47Speaker 1: end of the parking structure is Campus Drive. You can
- 3:50Speaker 1: drive in and exit onto level one, so that's the
- 3:53Speaker 1: ground level, and then you'd enter if you were driving in,
- 3:56Speaker 1: we're exiting back out of the campus then goes up
- 3:59Speaker 1: to level two, and on level two an exit is
- 4:03Speaker 1: what's called the heat Plant Road. In between the Institute
- 4:06Speaker 1: building and the garage is a little road and there's
- 4:09Speaker 1: an exit right there that you can drive out. You
- 4:11Speaker 1: can also if you were to park there, you could
- 4:14Speaker 1: walk out right there and exit only where I was
- 4:17Speaker 1: talking about on the southeast side you can walk out
- 4:20Speaker 1: there or on the north end of the garage there
- 4:22Speaker 1: are some stairs that go up all the levels and
- 4:25Speaker 1: it goes down to the bottom level and across the
- 4:27Speaker 1: street through a tunnel to the LDS Institute building, and
- 4:31Speaker 1: then when you pop up on level two you can
- 4:33Speaker 1: walk over to the Institute building. Question okay, can you
- 4:37Speaker 1: describe how long of a walk it would have been
- 4:39Speaker 1: from that parking structure to get to the courtyard on
- 4:42Speaker 1: campus approximately. Answer a couple of minutes, because when you
- 4:47Speaker 1: go that far southeast exit, you can walk directly almost
- 4:50Speaker 1: to the courtyard. You can also walk along the south
- 4:53Speaker 1: end of the LDS Institute building up towards loc building. Question. Okay, officer,
- 4:59Speaker 1: I'm going to turn your t to state exhibit number one.
- 5:02Speaker 1: It should come up on your monitor there. Let me
- 5:04Speaker 1: know when you can see it. Answer, I can see it.
- 5:06Speaker 1: Question and just for staff, let's go ahead and not
- 5:10Speaker 1: publish it until it's admitted into evidence. So we're going
- 5:13Speaker 1: to take it off the monitor. But for the witness,
- 5:15Speaker 1: he should be able to see the exhibit. Judge graph.
- 5:18Speaker 1: That's fine, so table monitors witness, but not the main monitor.
- 5:22Speaker 1: Thank you. All right, mister Grunender, thank you, Thank you. Judge.
- 5:26Speaker 1: Did you see plaintiffs exhibit number one? Officer? Answer? I do.
- 5:30Speaker 1: Question and do you recognize that exhibit? Answer? Yes, I do.
- 5:34Speaker 1: Question what is that? Answer? This is an area of
- 5:37Speaker 1: the building plus the courtyard in the middle of all
- 5:40Speaker 1: the grassy area, so this is an area of the
- 5:43Speaker 1: campus at Utah Valley University. Question is it a photograph? Answer? Yes, sir,
- 5:48Speaker 1: question Okay, are you familiar then with what's depicted in
- 5:52Speaker 1: this photograph? Answer yes, i am. Question does it fairly
- 5:56Speaker 1: and accurately portray this area of campus? Answer yes it does.
- 6:00Speaker 1: Question Okay, can you tell the court what direction the
- 6:02Speaker 1: camera's facing when this photograph was taken? Answer it's kind
- 6:06Speaker 1: of facing north and a little to the east. Question okay,
- 6:10Speaker 1: does it depict a number of the buildings that we've
- 6:12Speaker 1: talked about today? Answer yes it does. Question for example,
- 6:16Speaker 1: the Hall of Flags. Does it show the Hall of Flags?
- 6:18Speaker 1: Answer yes, it does. Question the walkway of it the
- 6:22Speaker 1: Hall of Flags? What about the Sorenson Center Does it
- 6:24Speaker 1: show that? Answer yes it does. Question the Woodbury Business Building, Yeah,
- 6:29Speaker 1: answer yes it does. Question the Fugal Building Yes. Question
- 6:34Speaker 1: what about the low C Center? Can you see that
- 6:35Speaker 1: from this photograph? Answer yes. Question is this photograph a
- 6:40Speaker 1: fair and accurate depiction of this area of the UVU campus?
- 6:44Speaker 1: On September tenth, twenty twenty five. Answer yes. Question, Your honor,
- 6:49Speaker 1: the state offers State Exhibit number one. Kathy Nester jumps in,
- 6:53Speaker 1: who is a lawyer or one of the lawyers for
- 6:55Speaker 1: Tyler Robinson? Your honor? We would object a failure to
- 6:59Speaker 1: lay a foundation for Oh I'm sorry, Judge Graf jumps in.
- 7:04Speaker 1: It's a little bit tricky because that microphone, So she
- 7:07Speaker 1: gets back to it, your honor, We would object to
- 7:09Speaker 1: the inability to authenticate. There's not been a foundation laid
- 7:13Speaker 1: that this officer took this photo can verify when it
- 7:16Speaker 1: was taken or by whom it was taken, So we
- 7:18Speaker 1: would object, Judge graph mister Grunader. Grunader, would you like
- 7:25Speaker 1: us to argue now or approach the bench? Judge graph
- 7:28Speaker 1: well as it relates to this all your argument, Grunander, Okay, Judge.
- 7:33Speaker 1: First of all, it's very clear, well established law that
- 7:36Speaker 1: the person who took the photograph is not required to
- 7:38Speaker 1: be present to lay foundation for it. What's required for
- 7:42Speaker 1: foundation is that the witness has knowledge of what's depicted
- 7:45Speaker 1: in the photograph and can testify to its accuracy. And
- 7:49Speaker 1: that's exactly what this officer has done. We laid an
- 7:52Speaker 1: ample amount of foundation about this area of campus. He's
- 7:55Speaker 1: confirmed that it depicts this area of campus that was
- 7:58Speaker 1: previously described. He confirmed the buildings that he can see
- 8:01Speaker 1: there be also confirmed that it was an accurate depiction.
- 8:04Speaker 1: On September tenth, twenty twenty five. Judge Graff, thank you.
- 8:08Speaker 1: Any further argument, Miss Nestor, Kathy Nester, we did file
- 8:15Speaker 1: a standing objection at the beginning of the hearing. I
- 8:17Speaker 1: would just refer to our standing objection as well. I
- 8:20Speaker 1: know that this is not there's no written testimony in this,
- 8:23Speaker 1: but just out of an abundance of caution, I would
- 8:25Speaker 1: also refer to our standing objection. Judge Graf, thank you,
- 8:29Speaker 1: Miss Nestor. All right, Having considered the arguments, I find
- 8:32Speaker 1: I'm going to overrule the objection and admit exhibit one.
- 8:36Speaker 1: This witness has firsthand knowledge of the location as well
- 8:39Speaker 1: as the building locations the foundation has been laid. He
- 8:43Speaker 1: also stated it was a fair and accurate representation of
- 8:46Speaker 1: what's being depicted here, and for those reasons, the defense
- 8:49Speaker 1: objection is overruled. State's Exhibit one is admitted into evidence
- 8:55Speaker 1: and may be published to the courtroom. Grunader okay, So
- 8:59Speaker 1: the state would move to publish that to the courtroom.
- 9:03Speaker 1: Judge grass so granted. Gruner Grunader, Officer Bagley, are you
- 9:08Speaker 1: able to see the monitor that's here in the court
- 9:11Speaker 1: that's pointed towards the gallery? Answer? Yeah, question from where
- 9:15Speaker 1: you're seated. Are you comfortable in describing where the courtyard
- 9:18Speaker 1: is on that photograph on that exhibit answer yes, question
- 9:22Speaker 1: and for the record, where's it located? Answer? So all
- 9:26Speaker 1: the grass it looks like a triangle the amphitheater. Look,
- 9:29Speaker 1: that's going to be the courtyard Amphitheater area. It's got
- 9:32Speaker 1: the tent in it, the white tent that's at the
- 9:34Speaker 1: bottom on the far left of the picture. That would
- 9:37Speaker 1: be the courtyard area that's surrounded by buildings more of
- 9:40Speaker 1: the grass area. Question I'm going to approach, Well, I'm
- 9:44Speaker 1: just going to when you look at the exhibit. To
- 9:46Speaker 1: the left of the photograph, there's a walkway there. What's
- 9:49Speaker 1: that walkway? Answer? So the red brick walkway that's going
- 9:53Speaker 1: north to the top of the picture on the far
- 9:55Speaker 1: left is going to be the Hall of Flags the
- 9:57Speaker 1: outside of it. Question okay. And on the bottom of
- 10:00Speaker 1: this photograph there's a white roof building. It's the largest
- 10:04Speaker 1: building at least as far as what's depicted in this exhibit. Answer, yeah,
- 10:08Speaker 1: question what building is at answer? That would be the
- 10:11Speaker 1: fugl building question okay. And just to the right of that,
- 10:15Speaker 1: so that would be the east of the Fugle building.
- 10:17Speaker 1: What building is at? Answer? The other red brick pathway area,
- 10:21Speaker 1: that's the Woodbury Business Building. Answer okay. And if I
- 10:25Speaker 1: were to walk north so left on this photograph with
- 10:28Speaker 1: respect to that red brick walk way area, there's another
- 10:31Speaker 1: building sort of a triangular in shape the rooftop. What
- 10:34Speaker 1: building is at? Answer with the white rooftop, that would
- 10:37Speaker 1: be the Sowrenson building. Question the Sowarrenson building. And what
- 10:41Speaker 1: about the Low C building you've described that? Where's that
- 10:44Speaker 1: located in this photograph? Question? If you go to the
- 10:47Speaker 1: triangle white roof, if you go directly to the right,
- 10:50Speaker 1: so the right side of the picture, that is going
- 10:52Speaker 1: to be the Low C building. It's got several levels.
- 10:56Speaker 1: Question is it to the right and up a little
- 10:59Speaker 1: bit as well? And he yes? Question okay, And that
- 11:02Speaker 1: would be east on this photograph. Is that correct? Answer?
- 11:06Speaker 1: It's not the gravel rooftop. Question, gravel rooftop? Okay. I
- 11:09Speaker 1: referred you to the LDS Institute building. Are you able
- 11:13Speaker 1: to see that in the photograph? Answer? Yes you are.
- 11:15Speaker 1: Question and where is that located? Answer? That's just going
- 11:19Speaker 1: to be directly north of the Low C building. It's
- 11:21Speaker 1: going to be that other white roof building on the
- 11:24Speaker 1: far top of the picture. Question, okay, thank you, officer.
- 11:27Speaker 1: We can take that down your honor. As far as
- 11:30Speaker 1: the publication, Officer Bagley, I'm going to take you back
- 11:34Speaker 1: to the date of September tenth, twenty twenty five. Do
- 11:37Speaker 1: you recall that day? Generally? Answer I do. All right, folks,
- 11:42Speaker 1: we're gonna wrap up right here, and in the next
- 11:44Speaker 1: episode dealing with the topic, we're gonna pick up where
- 11:46Speaker 1: we left off. All the information that goes with this
- 11:49Speaker 1: episode can be found in the description box.
