0:13
[SPEAKER_00]: The brand.
0:17
[SPEAKER_01]: With this AI thing, this is the wild wild west of IP protection that's needed.
0:23
[SPEAKER_01]: So we needed this conversation.
0:26
[SPEAKER_00]: Always saw people don't fall in love with a brand until you make sure it's not married to somebody else And somebody will say, well, I don't have a brand.
0:31
[SPEAKER_00]: I just have a business.
0:32
[SPEAKER_00]: Now you do Right, you may not intentionally be building it, but we know you at something What do you think is more important?
0:39
[SPEAKER_01]: You a brand or your amount of followers?
0:43
[SPEAKER_00]: I'm seeing big deals come with small folly like 10k You don't have to develop a multi-million dollar company.
0:52
[SPEAKER_01]: Some of them can just develop cashphrase
0:54
[SPEAKER_00]: He doesn't act, she doesn't sing, and he just has a catchphrase, and he licenses it.
0:59
[SPEAKER_00]: Can you guess what it is?
1:01
[SPEAKER_01]: Catchphrase, no.
1:04
[SPEAKER_00]: Let's get ready to rumble.
1:05
[SPEAKER_01]: War.
1:07
[SPEAKER_00]: He's made over $400 million.
1:08
[SPEAKER_00]: How do you protect, like, what's the purpose?
1:11
[SPEAKER_01]: What can you do?
1:12
[SPEAKER_01]: What can't you do with AI?
1:13
[SPEAKER_01]: With people's images?
1:14
[SPEAKER_01]: Like, what is the rules as an entrepreneur?
1:18
[SPEAKER_01]: Like, like, like, what can I do?

1:46
[SPEAKER_01]: I've written over 40 books.
1:48
[SPEAKER_01]: Seven of them have been bestseller and I sold over 250,000 copies.
1:53
[SPEAKER_01]: But listen, I also help a lot of my clients take their expertise and put it into a story that creates multiple streams of income from that.

[SPEAKER_01]: So I want to help you do the same thing.
2:03
[SPEAKER_01]: So text me, my book, to 646-687-4152.
2:05
[SPEAKER_01]: All right, let's get back to the show.
2:26
[SPEAKER_01]: All right, so welcome to another episode of Inside The Vault with Ask Cash.

[SPEAKER_01]: The greatest money my says show on the plan.
2:33
[SPEAKER_01]: Listen, most entrepreneurs are building brands, but they don't actually own them.
2:40
[SPEAKER_01]: And in the AI era, if you do not protect your name, your face, your voice, or your intellectual property, somebody else will monetize it before you do.
2:52
[SPEAKER_01]: Today's guests has protected Grammy Award winners, Super Bowl champions, viral personalities and multi-million dollar brands from losing everything, not because they were a talented, but because they warrant protected.
3:08
[SPEAKER_01]: Kendra Stevens isn't just a lawyer, she's the firewall between influence and theft, between
3:19
[SPEAKER_01]: In a world where AI can clone your voice, deep-fake your image, and file trademarks faster than you could google yourself.
3:27
[SPEAKER_01]: She understands the real game behind brand ownership.
3:31
[SPEAKER_01]: If you think your LLC means you're protected or that posting online makes you safe.
3:37
[SPEAKER_01]: This episode might save your entire future and wait until you hear what she has to say about AI trademarks and the no-fakes at
3:46
[SPEAKER_01]: Because if you missed this shift, you won't just lose content, you will lose control, ladies and gentlemen, round of applause for Dr. Lawyer, Kendrick.
3:57
[SPEAKER_01]: Steve, it's a lie.
3:59
[SPEAKER_01]: Not the doctor.
4:01
[SPEAKER_01]: You won't do it.
4:04
[SPEAKER_01]: It's a lie.
4:04
[SPEAKER_01]: It's a lie.
4:06
[SPEAKER_00]: I love it.
4:06
[SPEAKER_00]: Yeah, I'll take as.
4:07
[SPEAKER_00]: Yes, yes.
4:09
[SPEAKER_00]: Thank you so much for having me.
4:10
[SPEAKER_01]: I appreciate you.
4:11
[SPEAKER_00]: I appreciate you having me here today.
4:13
[SPEAKER_01]: You know, one of the things I wanted to do,
4:16
[SPEAKER_01]: is you know for a long time I've been like highlighting the people that are in front of camera like people who know the names of this that but there's a lot of like power players behind the scenes that I think my audience and a lot of people can benefit from and you are one of those people like you've been
4:37
[SPEAKER_01]: instrumental and so many of the people that we know we see in their lives.
4:44
[SPEAKER_01]: You've helped protect them, you've helped grow their brands.
4:47
[SPEAKER_01]: And I don't think lawyers trademark lawyers don't think attorneys get the credit that they deserve.
4:53
[SPEAKER_01]: But now more than ever when I tell you.
4:56
[SPEAKER_01]: With this AI thing, this is the wild wild west of IP protection is needed.
5:03
[SPEAKER_01]: So we needed that in this conversation.
5:06
[SPEAKER_01]: But before we start there, for those who don't know who is, can't understand this.
5:11
[SPEAKER_00]: Ooh, that's a good one.
5:12
[SPEAKER_00]: I am the brand protector for entrepreneurs and entertainers and professional athletes, right?
5:17
[SPEAKER_00]: I help my clients protect their brands to increase their profits.
5:21
[SPEAKER_00]: My goal for my clients is that they retire wealthy, but that their IP can pay them, right?
5:27
[SPEAKER_00]: Their trade marks, their copyrights can pay them.
5:30
[SPEAKER_00]: Not just while they're here long after they're gone, right?
5:32
[SPEAKER_00]: That's their legacy.
5:34
[SPEAKER_00]: And so that's my goal for them to make sure that's protected and generating income for them.
5:39
[SPEAKER_01]: Talk to me like like I want to get right like to the sauce, right?
5:43
[SPEAKER_01]: Yeah, and I and I'll you know, I'll tell you a funny story, and I didn't even know if I could get in trouble for this or that, but I took it down anyway, but funny story, right?
5:54
[SPEAKER_01]: So, you know, this has been going online for like a long time around like Jay Z not doing like podcast interviews and a lot of stuff or whatever.
6:04
[SPEAKER_01]: And so even you know, you know,
6:06
[SPEAKER_01]: got on the, you know, was like, yeah, man, I was trying to get him on here.
6:09
[SPEAKER_01]: And he's like, yo, he's not coming, you know, fat Joe with Jada Kiss and then was like, yo, hold this a professional cover or whatever.
6:15
[SPEAKER_01]: So I'm like, I cool.
6:17
[SPEAKER_01]: So I saw somebody crop his face, right?
6:22
[SPEAKER_01]: Like they, they use the JZ photo, they crop this face.
6:25
[SPEAKER_01]: And they made it seem like they were standing together.
6:27
[SPEAKER_01]: After it was funny, right?
6:29
[SPEAKER_01]: Because the person was a bad crop, they had the head, you know, they had the head, like you could tell it was a bad crop, right?
6:37
[SPEAKER_01]: So after it was funny, so I said, you know what, I'm gonna do the same thing.
6:40
[SPEAKER_01]: I'm gonna crop the picture of Jay, but I'm gonna get promotion for my podcast.
6:44
[SPEAKER_01]: I'm going to, you know, anytime I record my podcast, I do, I do pictures, pictures, pictures of every all the guests.
6:50
[SPEAKER_00]: Yeah.
6:51
[SPEAKER_01]: I crop Jay.
6:53
[SPEAKER_01]: I use AI and I said put them next to me and it looked like every little rare auto.
6:58
[SPEAKER_01]: I saw it.
6:58
[SPEAKER_01]: It looked real.
6:59
[SPEAKER_01]: It looked like me and Jay in the off like he did this.
7:01
[SPEAKER_01]: He did this, right?
7:03
[SPEAKER_01]: You know what I tell you first and foremost, it went viral, right?
7:07
[SPEAKER_01]: It went viral.
7:08
[SPEAKER_01]: But that wasn't the thing.
7:10
[SPEAKER_01]: My business manager calls me.
7:12
[SPEAKER_00]: And he's like, oh, bro, you know the people at rock nation, I don't know if I don't know what to say this.
7:17
[SPEAKER_01]: I don't care, but I'm saying it.
7:19
[SPEAKER_01]: He's like, you know the people at rock nation, you got, you got, you got, you got, I think you should take it down.
7:24
[SPEAKER_01]: I said, what?
7:25
[SPEAKER_01]: I said, it's obvious joke.
7:26
[SPEAKER_00]: Yeah.
7:27
[SPEAKER_01]: He was like, you know, you don't even want no smoke, right?
7:29
[SPEAKER_01]: And that, not like, they didn't have that feeling.
7:31
[SPEAKER_00]: Yeah, he didn't want it.
7:32
[SPEAKER_01]: But he just was like,
7:35
[SPEAKER_01]: like the post-went viral and it looks so real that people in the building are really questioning whether all was really in Atlanta in a lower-aged casual inside the vote and so I didn't know right I'm like you know what I took it down this thing I know that but that's a scary thing
7:58
[SPEAKER_01]: where I'm trying to be obvious, like in the picture, J was short of me, like I'm six three, J, six three.
8:07
[SPEAKER_01]: So it was no, like I did obvious things that whatever.
8:10
[SPEAKER_01]: But like,
8:12
[SPEAKER_01]: could I have gotten in trouble for that?
8:15
[SPEAKER_01]: How do you protect like what's the part what can you do?
8:18
[SPEAKER_01]: What can't you do with AI with people's images?
8:21
[SPEAKER_01]: Like what is what is the rules as an entrepreneur?
8:24
[SPEAKER_01]: Like like what can I do with the audience?
8:27
[SPEAKER_00]: You know that's a great example.
8:29
[SPEAKER_00]: And I saw that pose and I said to my friend, wait, did I?
8:35
[SPEAKER_00]: I saw it, but we scroll so fast, right, and common sense and common.
8:41
[SPEAKER_00]: So even though we look at AI images all the time, we can point them out.
8:47
[SPEAKER_00]: Some people can, right?
8:49
[SPEAKER_00]: And so, even though you minute as a joke, by it being integrated in your promotion, it almost looked like you did in a way that, right?
8:57
[SPEAKER_00]: So if it looks like it can be implied, you're going to get that feedback.
9:03
[SPEAKER_00]: So you always want to make it very clear, so jokes something to make it more obvious.
9:08
[SPEAKER_00]: Yeah, it's a joke.
9:10
[SPEAKER_00]: I would love to have him.
9:11
[SPEAKER_00]: Yeah.
9:12
[SPEAKER_00]: Using his actual image, yeah, you're potentially opening that door.
9:16
[SPEAKER_00]: So your business manager was looking out for him.
9:19
[SPEAKER_00]: right because that's where we get into the, you know, celebrities now stepping in and protecting their voice, right?
9:27
[SPEAKER_00]: The way they say things like I was telling you earlier about Matthew McConaughey, but his alright alright alright, right?
9:33
[SPEAKER_00]: He went ahead and protected that because that was his thing.
9:36
[SPEAKER_00]: Now they want to protect not just their image, not just their likeness, but their sound.
9:41
[SPEAKER_00]: So imagine how you done an AI interview with JZ and people are doing that and
9:47
[SPEAKER_00]: that door.
9:47
[SPEAKER_01]: Like a AI interview like I could I could say jazzy's voice.
9:52
[SPEAKER_01]: Hmm.
9:53
[SPEAKER_00]: And then that would that already happened to a comedian that he's they can use AI to interview with your ghost.
10:00
[SPEAKER_00]: Right.
10:01
[SPEAKER_00]: And so the comedian they used his voice they had a whole hour long podcast comedy special with him.
10:08
[SPEAKER_00]: He's dead.
10:09
[SPEAKER_00]: His family had to take them to court to get it deleted.
10:12
[SPEAKER_00]: Right?
10:13
[SPEAKER_00]: So AI is moving extremely fast.
10:15
[SPEAKER_00]: The law is not as fast, right?
10:18
[SPEAKER_00]: We're they're trying to catch up with it.
10:20
[SPEAKER_00]: That's why I was telling you about the no fake app where they're looking it hasn't passed it's in Congress, right?
10:26
[SPEAKER_00]: That they they're looking to help protect
10:28
[SPEAKER_00]: not just celebrities but all individuals from AI recreating them, right?
10:34
[SPEAKER_00]: Recreating your voice, making a hyper-realistic that people can't tell the difference.
10:38
[SPEAKER_00]: Some of these AI, you really can't tell them.
10:42
[SPEAKER_00]: Yeah, it's really, really good and it's only getting better because we're training them.
10:47
[SPEAKER_00]: We're training them right on the features and the voice and the movement and the sound.
10:52
[SPEAKER_00]: And so those are things that you do want to protect, right?
10:55
[SPEAKER_00]: If you are a celebrity entertainer, even an influencer, in the contracts, we're now putting digital protections for your digital double-game, or for your digital twin, that they can't now take your content you created for them and then use it to train the AI to
11:14
[SPEAKER_00]: Yeah, it's bad.
11:15
[SPEAKER_01]: Oh, I didn't think about that.
11:17
[SPEAKER_01]: And, you know, it's funny that you say that because that's the sort of like the liability with me.
11:24
[SPEAKER_01]: Like, I don't remember, I mean, still, I can't find this person, but there's still somebody who runs ads.
11:32
[SPEAKER_01]: using my image, voice, they call themselves something else, but they're selling like cryptocurrency.
11:40
[SPEAKER_01]: And the problem with what they're doing is I'm a parkaster.
11:45
[SPEAKER_00]: Yes.
11:45
[SPEAKER_01]: So I have hours and hours and hours of content.
11:49
[SPEAKER_01]: That's free.
11:50
[SPEAKER_01]: available on the internet that they can train AI and I don't even know if I should say this, but like I remember I was working with a client, right?
12:02
[SPEAKER_01]: And this is all permission based though, but this is how you know you can get away with it.
12:07
[SPEAKER_01]: I was working with a client and a client got older, so they don't sound the same, but you know I'm a publisher and they wanted to turn their book into a
12:20
[SPEAKER_01]: And so, in my mind, I'm like, how can I do how can I do it?
12:24
[SPEAKER_01]: So what I did was I took one of their older interviews with a sounded like themselves.
12:30
[SPEAKER_01]: I edited out the host that was asking them the questions and even though it wasn't cohesive, I had like a 30 minute block of them just talking and I trained the AI using that block.
12:48
[SPEAKER_01]: Again, I got the permission to do it.
12:50
[SPEAKER_00]: Yeah, it's authorizing.
12:51
[SPEAKER_01]: Don't imagine somebody who doesn't have permission to do it.
12:54
[SPEAKER_01]: Exactly.
12:55
[SPEAKER_01]: Right.
12:55
[SPEAKER_01]: Imagine, you know, and like you said from a content perspective, imagine, you know, like, like I have access to the agent, and I have a digital clone of mine.
13:06
[SPEAKER_01]: So imagine the things that it can have other people say on authorize how are we protected by that?
13:13
[SPEAKER_01]: All we protected.
13:14
[SPEAKER_00]: That's where your trademars come in.
13:16
[SPEAKER_00]: This is now going beyond, let me register a name, let me register a logo.
13:21
[SPEAKER_00]: You need to now register your sound, like your catchphrases.
13:25
[SPEAKER_00]: Exactly how you say, I'm your cadence, right?
13:27
[SPEAKER_00]: You need to start protecting that.
13:29
[SPEAKER_01]: Yeah.
13:29
[SPEAKER_00]: I always just tell people, you want to think of your brand 360 experience.
13:35
[SPEAKER_00]: sound, right?
13:36
[SPEAKER_00]: What they're hearing, what they're feeling, what they're smelling on top of the name and the logo.
13:42
[SPEAKER_00]: Because the more you can protect in that space, come on, money you're going to make, right?
13:47
[SPEAKER_00]: They are, for example, Verizon has a trademark on the scent in their stores.
13:52
[SPEAKER_01]: The sense?
13:52
[SPEAKER_00]: Yeah, I heard it's sort of about that.
13:54
[SPEAKER_01]: Yeah.
13:55
[SPEAKER_00]: Right?
13:55
[SPEAKER_00]: And so you're thinking to yourself like, well, why?
13:57
[SPEAKER_00]: Well, they must have did research to realize, hey, if we make our stores melt this way, my either increase sales.
14:04
[SPEAKER_00]: It might have something to do with the atmosphere.
14:06
[SPEAKER_00]: Make people more friendly.
14:07
[SPEAKER_00]: I've never really enjoyed going into the store.
14:10
[SPEAKER_00]: So, you know, there's some, there's a reason they're generating money.
14:13
[SPEAKER_00]: They're protecting that, right?
14:15
[SPEAKER_00]: Set matters.
14:16
[SPEAKER_00]: Right?
14:17
[SPEAKER_00]: Or for example, you know, I watch Netflix that sound that Netflix make whenever you open it up.
14:22
[SPEAKER_00]: That's sound.
14:23
[SPEAKER_00]: I'm my hair and my kid on Netflix from downstairs because I can hear that sound.
14:28
[SPEAKER_00]: And so you need to be thinking like that, right?
14:31
[SPEAKER_00]: Even the way you say your name, right?
14:34
[SPEAKER_00]: You need to protect that.
14:35
[SPEAKER_00]: So people need to understand these are not just legal documents.
14:39
[SPEAKER_00]: These are assets.
14:40
[SPEAKER_00]: Right.
14:41
[SPEAKER_00]: When you start thinking like a corporation, you start realizing these are assets.
14:45
[SPEAKER_00]: What do you do with assets?
14:46
[SPEAKER_00]: You use it to get funding.
14:47
[SPEAKER_00]: Right.
14:48
[SPEAKER_00]: You can sell it.
14:49
[SPEAKER_00]: You can transfer.
14:50
[SPEAKER_00]: You can license it.
14:51
[SPEAKER_00]: Right.
14:52
[SPEAKER_00]: And so when you start thinking like that, you start moving into the space of building a brand portfolio.
14:57
[SPEAKER_00]: And then just want off because there's so much about your brand as long as you're living and your business is going, your brand is going, you're going to consistently need to protect certain things.
15:08
[SPEAKER_01]: Yeah.
15:08
[SPEAKER_01]: Yeah.
15:08
[SPEAKER_01]: Yeah.
15:08
[SPEAKER_01]: Yeah.
15:09
[SPEAKER_01]: Yeah.
15:09
[SPEAKER_01]: Yeah.
15:09
[SPEAKER_01]: Yeah.
15:09
[SPEAKER_01]: what at what point though, right?
15:11
[SPEAKER_01]: So we have like, um, you know, brands that are just starting out or brands that, um, may not have sort of like the success that they desire yet.
15:25
[SPEAKER_01]: You know, what would you say is, is the point where you're like, nah, you should be trademarking, you know, your name and your likeness.
15:32
[SPEAKER_01]: Yeah.
15:32
[SPEAKER_00]: I like to say, the best time was before you start.
15:35
[SPEAKER_01]: Okay.
15:36
[SPEAKER_00]: The next best time is today because think of it as in you are building your building your business on a brand that you don't own.
15:45
[SPEAKER_00]: So your brand is the foundation.
15:47
[SPEAKER_00]: Your brand is all the outside all the things that we're seeing about your business.
15:52
[SPEAKER_00]: Without it, do you have a business?
15:54
[SPEAKER_00]: Right.
15:54
[SPEAKER_00]: And somebody will say, well, I don't have a brand.
15:56
[SPEAKER_00]: I just have a business.
15:57
[SPEAKER_00]: No, you do.
15:58
[SPEAKER_00]: Right, you may not intentionally be building it, but we know you as something.
16:03
[SPEAKER_00]: Even if it's just, oh, it's just the white bottle that they use for water.
16:07
[SPEAKER_00]: Oh, you know that white water, right?
16:09
[SPEAKER_00]: If it's just they use red all the time.
16:12
[SPEAKER_00]: Okay, if I hand you a purple bag, you know what's in it?
16:15
[SPEAKER_00]: What's in that purple bag?
16:16
[SPEAKER_00]: Who uses that purple bag?
16:18
[SPEAKER_00]: liquor, royal, you know.
16:20
[SPEAKER_00]: So things that you might not even see the label, but you can see it.
16:23
[SPEAKER_00]: You have on some red bottom.
16:25
[SPEAKER_00]: I know your Jordans.
16:26
[SPEAKER_00]: I didn't even need you to turn around.
16:28
[SPEAKER_00]: I knew that design was a pair of Jordans.
16:30
[SPEAKER_00]: So people need to understand that you are still building a brand.
16:34
[SPEAKER_00]: It may not be intentionally, but you are still building it.
16:37
[SPEAKER_00]: Your business has a brand.
16:39
[SPEAKER_00]: That was the foundation of the business.
16:40
[SPEAKER_01]: Yeah.
16:41
[SPEAKER_00]: So, and especially if your LLC is the same name most of the time, it is.
16:45
[SPEAKER_00]: Both small businesses, most entrepreneurs are going to use their brand name for their LLC name.
16:50
[SPEAKER_00]: And when they get sued, if they get sued, excuse me, I don't want to call it upon me.
16:55
[SPEAKER_00]: I believe in manifesting good stuff.
16:57
[SPEAKER_00]: But if you get sued, then you have to not just rebrand, but you have to change your LLC.
17:01
[SPEAKER_00]: Yeah.
17:01
[SPEAKER_00]: Right rebranding can cost you six bigger set of figures.
17:05
[SPEAKER_01]: That's a fuck.
17:05
[SPEAKER_00]: Right, middle ones, 10,000, maybe, we're not even talking about your time.
17:10
[SPEAKER_00]: Oh, let's not even get into the heartache.
17:11
[SPEAKER_00]: Some people give up completely on their business because they have to rebrand and they can't afford the cost of it.
17:16
[SPEAKER_01]: Yeah, for sure.
17:17
[SPEAKER_00]: You know, so those are all things that they have to consider.
17:19
[SPEAKER_00]: So, you know, you might be thinking, okay, well, I have to pay 1,000 or 7 something or, you know, a couple hundred bucks to get this search and this clearance done, but think ahead.
17:30
[SPEAKER_00]: If you don't now, you're looking at $10,000, $100,000, $7 figures and losses, it adds up.
17:35
[SPEAKER_00]: Yeah, now 100% so let's start.
17:45
[SPEAKER_01]: with just understanding who you are, understanding like your career, you know, you represented celebrities, high level entrepreneurs, what was the first moment in your career when you realized that talent means nothing if it's not protected?
18:00
[SPEAKER_00]: Oh, I don't think I could talk about that one.
18:06
[SPEAKER_00]: I'm so lucky to be behind the scenes on so much stuff.
18:10
[SPEAKER_00]: We have to talk stories all fine.
18:12
[SPEAKER_00]: I was saying, I'm trying to think of one.
18:13
[SPEAKER_01]: Can you give me your arms ready?
18:14
[SPEAKER_01]: No, I want that one.
18:15
[SPEAKER_01]: The one that you can't talk about.
18:17
[SPEAKER_01]: But you can't just give me high level though.
18:21
[SPEAKER_01]: You don't have to say, he's she, you don't have to say, you know what I mean?
18:28
[SPEAKER_00]: one of them was in a lawsuit.
18:30
[SPEAKER_00]: Okay.
18:30
[SPEAKER_00]: We did the application.
18:32
[SPEAKER_00]: It was an entertainer.
18:35
[SPEAKER_00]: Yeah.
18:35
[SPEAKER_00]: And he's been around for years.
18:38
[SPEAKER_00]: And it ended up being in a lawsuit.
18:39
[SPEAKER_00]: I mean, we got the mark for our client, but it ended up being in a lawsuit.
18:43
[SPEAKER_01]: Yeah.
18:44
[SPEAKER_00]: and the crazy part about it is the people behind the lawsuit weren't even originally like connected to the brand.
18:52
[SPEAKER_00]: It just got really messy.
18:53
[SPEAKER_00]: What I would say is that in the US, you have to understand where you are.
18:58
[SPEAKER_00]: So if you're watching this in the United States, we have common law rights, right?
19:02
[SPEAKER_00]: You own your trademark on their common law by using it first.
19:06
[SPEAKER_00]: It doesn't automatically mean it's not a conflict with anyone else.
19:09
[SPEAKER_00]: It just means that's where
19:12
[SPEAKER_00]: when you file for federal registration, it then becomes who files first in federal because if you waited long to file and you owned it first but someone else filed before you end up in a battle and most people can't afford it, right?
19:27
[SPEAKER_00]: So I wouldn't necessarily say talent, I would say having the right people on your team that understand so little of our first example, I'll give you this one, like LeBron James, like you got to have money to play this game sometimes.
19:38
[SPEAKER_00]: So remember, like more than an athlete, remember that whole phrase.
19:41
[SPEAKER_00]: that up in jibble and so there was actually a brand that owned it on the registration prior to LeBron and so they were like, hold on, LeBron trying to file for this, let's fight with him.
19:53
[SPEAKER_01]: Yeah.
19:54
[SPEAKER_00]: They started fighting with LeBron and then both of them ended up not being the ones that owned it first.
20:00
[SPEAKER_00]: There was someone else that had a prior ownership on their common law so then they stepped up.
20:05
[SPEAKER_00]: They're like, hold on, I own it.
20:06
[SPEAKER_00]: What are y'all doing, right?
20:08
[SPEAKER_00]: Well, LeBron seems to say, hey, we don't need a fight with all of you.
20:11
[SPEAKER_00]: We just need a fight with one of you and you own priority, right?
20:14
[SPEAKER_00]: So let's get those rights from you.
20:16
[SPEAKER_00]: Let's pay you.
20:17
[SPEAKER_00]: Let's pay you.
20:18
[SPEAKER_00]: Let's settle with you.
20:19
[SPEAKER_00]: Let's step into your shoes.
20:21
[SPEAKER_00]: Now we have priority, goodbye to the other priority, right?
20:26
[SPEAKER_00]: And so you got to have the right team.
20:28
[SPEAKER_01]: Yeah.
20:28
[SPEAKER_00]: I would also say you got to be willing to fight.
20:30
[SPEAKER_00]: If you're not willing to pay the money up front for an attorney, you better be willing
20:37
[SPEAKER_00]: attached it to your product or your service, and now you're invested.
20:41
[SPEAKER_00]: Always sell people don't fall in love with a brand until you make sure it's not married to somebody else.
20:45
[SPEAKER_01]: That's it.
20:46
[SPEAKER_00]: Hey, because now you the side piece fighting for somebody else's business now going to be is not going to be pretty.
20:51
[SPEAKER_00]: Right.
20:53
[SPEAKER_01]: Have you, have you, have you had any situations where you had a client like lose a brand?
20:58
[SPEAKER_01]: Like.
21:00
[SPEAKER_01]: Yes, like they what they had because I mean the most famous one that I know of is Biggie Smalls Like I know that because I'm you know, I'm a you're a recipes, but I remember Prior to him coming out with an album we all knew him as Biggie Smalls to the to the fact that
21:20
[SPEAKER_01]: As I say, Biggie Smalls, everybody knows that name, actually.
21:23
[SPEAKER_01]: But you don't know that there's nothing that says Biggie Smalls.
21:29
[SPEAKER_01]: Everything says the notorious BIG, because if I remember the case correctly, there was a rock and roll group.
21:37
[SPEAKER_01]: called Biggie Smalls, who had the trademark for Biggie Smalls.
21:42
[SPEAKER_01]: So when they tried to come out with the album and put his name as Biggie Smalls, it was like nope.
21:47
[SPEAKER_01]: And so they had to change his name to the notorious BIG.
21:51
[SPEAKER_01]: And they did a great job in navigating and maneuvering, because again, right, you took a 26.
22:00
[SPEAKER_01]: If you say Biggie Smalls, you still think,
22:03
[SPEAKER_01]: I'm not telling you.
22:07
[SPEAKER_01]: No show is BIG, but there's a case that you've worked on where somebody lost their brand.
22:13
[SPEAKER_00]: So I had a client that actually contacted me, right?
22:16
[SPEAKER_00]: He was on a network show.
22:18
[SPEAKER_00]: He had a show with his name on it.
22:20
[SPEAKER_00]: And his assistant was like, hey, our previous attorney messed up.
22:23
[SPEAKER_00]: They did not renew our trademark in time.
22:25
[SPEAKER_00]: When you don't renew your trademark in time, his gone, you got to go to the back of the line and start over.
22:30
[SPEAKER_00]: So when they filed, they got rejected.
22:32
[SPEAKER_00]: They're like, how could we get rejected?
22:34
[SPEAKER_00]: We owned it previously, right?
22:36
[SPEAKER_00]: And the USPTO doesn't care.
22:38
[SPEAKER_00]: They're like, well, now you're at the back of the line.
22:42
[SPEAKER_00]: we had to fight that application.
22:45
[SPEAKER_00]: It didn't work out.
22:46
[SPEAKER_00]: Circle the block again.
22:48
[SPEAKER_00]: We refile because they were in the wrong class.
22:50
[SPEAKER_00]: If you don't know trademark search registered in classes, classes are categories that use to classify your products or service.
22:56
[SPEAKER_00]: Sorry, I got to educate you in and to change.
22:58
[SPEAKER_00]: Can't help much.
22:59
[SPEAKER_00]: So when we refiled it, we put them in the right class because they were in the wrong class when we were trying to fight to make it work, right?
23:07
[SPEAKER_00]: And then again, getting refused, just so you know, majority of trademarks are getting rejected, what's we call likelihood of confusion because there's an increase in the number of people they're filing for trademarks.
23:19
[SPEAKER_00]: So there's a high probability you're going to end up in this situation.
23:23
[SPEAKER_00]: So we are now fighting.
23:25
[SPEAKER_00]: We're fighting to get this man, his brand.
23:27
[SPEAKER_00]: It went on and on and on.
23:29
[SPEAKER_00]: I would say about three years of on off fighting.
23:34
[SPEAKER_00]: The brand that the examiner kept saying, hey, you can't register because this brand is a conflict with that brand.
23:41
[SPEAKER_00]: We finally got it through.
23:43
[SPEAKER_00]: I did, I was like, listen, sir.
23:45
[SPEAKER_00]: This is his assistant had died.
23:48
[SPEAKER_00]: He had lost the, like, I mean, this case is good.
23:51
[SPEAKER_00]: This case is gone crazy and we're going through it, we're taking me through it and I said this is my last ditch effort for you If this doesn't work then we have to go to the T-Tap which is litigation in a USB-TL he said go ahead Can you do your best
24:06
[SPEAKER_00]: Did my final listen I'm a fight this I'm pulling all the strings this is the best argument I could come up away from the depths of my souls I tapped into my ancestors at this point we get it approved we get approved we get through the examiner she's like yes love it good we get through the examiner we get to what's the next phase which is called publication
24:26
[SPEAKER_00]: Do you know the network that he had the show on over 10 years ago then opuls the application and I was like I could throw this pillow.
24:36
[SPEAKER_00]: I was so mad the day I logged in and I was like
24:40
[SPEAKER_00]: Who's opposing this and it was the network and I called him I said listen the network is now stepping up to bat He's like are you kidding?
24:48
[SPEAKER_00]: Wow, right cuz they can oppose it It before I guess so then he we had to do some calling around the network was like okay You know, yes, we because he was using it before he got on the shot right so he already had it trying to claim it like no
25:03
[SPEAKER_00]: because they had to show with the same name again, read your contract, right?
25:07
[SPEAKER_00]: And so, but the show has been off the air for years.
25:10
[SPEAKER_00]: They're not using it.
25:10
[SPEAKER_00]: They don't have another show.
25:11
[SPEAKER_00]: So, they finally were like, okay, we were able to get in contact with the right person.
25:16
[SPEAKER_00]: They backed off, right?
25:17
[SPEAKER_00]: Had that not happened, he was still be fighting.
25:20
[SPEAKER_00]: And so, now we're moving forward to registration.
25:22
[SPEAKER_00]: Yeah.
25:23
[SPEAKER_00]: Like,
25:24
[SPEAKER_01]: Wow.
25:25
[SPEAKER_00]: Right, but this is why you need to have the right attorney.
25:27
[SPEAKER_01]: Right, I agree.
25:28
[SPEAKER_01]: I agree.
25:29
[SPEAKER_01]: And, and that's also why you have that the right protections, though, too, because again, if you're building something, you know, and it could easily be taken from you if you don't build it the right way.
25:40
[SPEAKER_01]: Yeah.
25:41
[SPEAKER_01]: I mean, even inside the vault with Ashcars, like I remember,
25:44
[SPEAKER_01]: Um, you know, early on, I had like disputes, right?
25:48
[SPEAKER_01]: Cause when I started to show, um, it was three of us that started to show together.
25:52
[SPEAKER_01]: Um, and, you know, we, you know, a lot of, you know, some of us didn't see either eye or we decided to go in different directions.
26:00
[SPEAKER_01]: Um, but one of their partners was was was almost like, no, you can't.
26:04
[SPEAKER_01]: You can't do nothing with it because I own it.
26:06
[SPEAKER_01]: I'm like,
26:07
[SPEAKER_01]: Maybe let me see and you know and when we did the research there's other shows that were called inside of all What made this show unique is because it's called inside of the board with Ashcast Well Ashcast enterprises owns the trademark for Ashcast So technically Right the the license that Ashcast enterprises gave this show to use so yeah
26:33
[SPEAKER_00]: Oh, we, Kiwi, but do you know how common that is?
26:36
[SPEAKER_01]: Hmm.
26:37
[SPEAKER_00]: How common those group projects turned into lawsuit?
26:40
[SPEAKER_01]: 1,000%.
26:41
[SPEAKER_00]: Because you have to have that right.
26:43
[SPEAKER_00]: It's good for you to have own your name.
26:45
[SPEAKER_00]: Had you not, we would be fighting, right?
26:47
[SPEAKER_00]: So that brings me back.
26:48
[SPEAKER_00]: I think there was a case.
26:50
[SPEAKER_00]: And he actually gave some consent to his mom.
26:52
[SPEAKER_00]: He's an MBA player and Luca, right?
26:54
[SPEAKER_00]: And he, his mom registered a trademark.
26:56
[SPEAKER_00]: He gave her consent.
26:57
[SPEAKER_00]: She registered a trademark.
26:58
[SPEAKER_00]: He was young at the time.
26:59
[SPEAKER_01]: Yeah.
26:59
[SPEAKER_00]: when he started building his empire so he starts trying to register all these other names that trademark his mom had register was holding him up but he had given her consent and he tried to revoke consent they have to settle it out but you have to have those documents in place because had you not signed that then ash cash would be attached to it even though you originally owned it this is why not only is the trademark important to help people trade marks your contracts are important those clauses are important those
27:28
[SPEAKER_00]: I always tell people like, how long we license in this world?
27:30
[SPEAKER_00]: Three things I look for in a contract.
27:32
[SPEAKER_00]: How do we terminate this?
27:33
[SPEAKER_00]: When you get paid and how long we license it?
27:36
[SPEAKER_00]: There's a way out.
27:37
[SPEAKER_00]: You never want to give someone the ability to use your name into perpetuity.
27:42
[SPEAKER_00]: You never want to give them worldwide non-exclusive licensing.
27:46
[SPEAKER_00]: These things are important, especially when you're thinking, you're a media mogul, let's not even play with it.
27:52
[SPEAKER_00]: Ash Cash is a media mogul, right?
27:54
[SPEAKER_00]: You have your name, you have your shows.
27:56
[SPEAKER_00]: you have things are connected to you.
27:59
[SPEAKER_00]: So you have to be careful those contracts specifically state.
28:02
[SPEAKER_00]: This is what it's going to be licensed for.
28:04
[SPEAKER_00]: Not just Ash Cash, but how long you're going to be associated and connected to it, too, right?
28:09
[SPEAKER_00]: Because not only is it the name, but it's also you, your name, your image and your light lens.
28:14
[SPEAKER_00]: Yeah.
28:15
[SPEAKER_01]: Yeah, one of the
28:18
[SPEAKER_01]: And at what point did you go from?
28:20
[SPEAKER_01]: Because a lot of people, like, I am a trademark attorney, you're definitely more than that, right?
28:27
[SPEAKER_01]: Like, at what point did you go from hammered trademark attorney to like, I'm a strategic brand architect, like when the desk was happy.
28:36
[SPEAKER_00]: You know, it's funny that you mentioned that I kind of got pushed into it, but naturally, my background is in business.
28:44
[SPEAKER_00]: So my bachelor's degrees in business marketing management.
28:48
[SPEAKER_01]: Okay.
28:48
[SPEAKER_00]: So I went to law school and then I did my MBA at the same time.
28:51
[SPEAKER_00]: So I've always been in the business space, right?
28:54
[SPEAKER_00]: And so, and I didn't ask me why I decided to double degree, I don't recommend it, but I ate type personality over a cheever here.
29:01
[SPEAKER_00]: I am.
29:01
[SPEAKER_01]: Yeah, yeah.
29:02
[SPEAKER_01]: So,
29:03
[SPEAKER_00]: I did it and so I've always functioned as a business on our marketing person that also has the legal on top.
29:11
[SPEAKER_00]: So instead of consistently looking for ways to say, no, I look for ways to how do we get to the back, how do we but still protect you?
29:19
[SPEAKER_00]: I think that makes a difference in how I enter the room, how I look at contracts, right?
29:23
[SPEAKER_00]: I think one of the
29:25
[SPEAKER_00]: You know, I've worked with T.S.
29:26
[SPEAKER_00]: Maximus.
29:26
[SPEAKER_00]: We were here when she did her interview with you and I always remember if in looking at the contract when she got the contract from Beyonce's team and I'm like Madison.
29:35
[SPEAKER_00]: Yes, I do this, but we also now need to bring in our licensing person.
29:40
[SPEAKER_00]: Um, you have to have people on your team that's not afraid to say, okay, we need someone that's specifically focuses on that.
29:46
[SPEAKER_00]: Yeah, licensing right when I have another client, although I'm overseeing your entire brand we're going to bring in that strategic question because you're going to be looking for your money and we need to make sure a licensing looks right.
29:57
[SPEAKER_00]: I have another client who I could say the network that I'm not going to say here.
30:01
[SPEAKER_00]: Okay, right and contract it has a lot of things in it.
30:07
[SPEAKER_00]: Mm-hmm.
30:08
[SPEAKER_00]: And, you know, being able to navigate her contract to make sure that she can't appear in other places, that's important.
30:16
[SPEAKER_00]: Right?
30:16
[SPEAKER_00]: But if you don't have an attorney to say, let me look at this.
30:19
[SPEAKER_00]: How long you holding her for?
30:21
[SPEAKER_00]: Right?
30:23
[SPEAKER_00]: What else you got?
30:23
[SPEAKER_00]: No, right?
30:24
[SPEAKER_00]: That has to have the ability to negotiate it.
30:27
[SPEAKER_00]: Mind you, Cash, Cash.
30:27
[SPEAKER_00]: I don't mind.
30:28
[SPEAKER_00]: I love what I do.
30:28
[SPEAKER_00]: I love contracts.
30:28
[SPEAKER_00]: I love breathing into it.
30:29
[SPEAKER_00]: But I'm, I'm also a mom, right?
30:30
[SPEAKER_00]: So I'm over here.
30:30
[SPEAKER_00]: Like, what's the news contract?
30:31
[SPEAKER_00]: I got the soccer game.
30:32
[SPEAKER_00]: Yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah
30:42
[SPEAKER_00]: So those things are going to be able to navigate with you.
30:47
[SPEAKER_00]: Even if you come in with your general counsel, they have to understand your long-term vision of where you want your brand to go.
30:53
[SPEAKER_00]: What do you want to be in five years in 10 years?
30:56
[SPEAKER_00]: Because we're on the team, right?
30:58
[SPEAKER_00]: I'm on the team with you.
30:59
[SPEAKER_00]: And I have to, when I'm going into negotiate, I'm either coming in to negotiate swinging, or I'm coming in to negotiate collaborating, because this is what my client is telling me she wants to do.
31:10
[SPEAKER_00]: And this is what we're looking at long-term.
31:13
[SPEAKER_01]: What do you think is more important, like your brand or your amount of followers?
31:24
[SPEAKER_00]: That's a good one.
31:25
[SPEAKER_00]: It depends.
31:27
[SPEAKER_00]: I would say it depends, because some people follow or matter more, but I'm seeing big deals come with small, like 10K.
31:38
[SPEAKER_00]: They're getting
31:42
[SPEAKER_00]: right?
31:42
[SPEAKER_00]: So sometimes it depends.
31:44
[SPEAKER_00]: I think what's the number we're looking at really is engagement.
31:47
[SPEAKER_01]: Yeah.
31:48
[SPEAKER_00]: Right.
31:48
[SPEAKER_00]: But your brand is always going to be most important to me because you can go anywhere with that brand.
31:53
[SPEAKER_01]: Yeah.
31:53
[SPEAKER_00]: Right.
31:53
[SPEAKER_00]: You can go on any platform.
31:55
[SPEAKER_00]: They will look for ash cash inside the vault or whatever you want to, you know, because of your brand.
32:01
[SPEAKER_01]: Yeah.
32:01
[SPEAKER_00]: I think the brand is what makes people stand in line for joy to do.
32:05
[SPEAKER_00]: Yeah.
32:05
[SPEAKER_00]: The brand is what used to make people stand outside waiting for the Apple iPhone drop, right?
32:10
[SPEAKER_00]: The brand.
32:11
[SPEAKER_00]: And when you think long-term, that's what's going to keep you making money.
32:16
[SPEAKER_00]: Why did Bell Sout rebrand and become AT&T?
32:19
[SPEAKER_00]: AT&T had the stronger brand.
32:21
[SPEAKER_00]: Right y'all are the, I don't know if people ever remember though, but what was the, the cell phone company was called singular AT&T had gone bankrupt there brand was valuable and I'll tell people you may be a sucky business owner, but if you can brand
32:37
[SPEAKER_00]: your brand if your brand is valuable you can still make money right your brand or some people will never own a house and that's okay but you can own your brand you can own your creation right I think there's the catchphrase that makes I you should know this by now
32:54
[SPEAKER_00]: He makes over $400 million, she doesn't sing, he doesn't act, okay, and he just has a catchphrase, and he licenses it.
33:04
[SPEAKER_00]: And he makes more of that catchphrase than he does in his main job.
33:07
[SPEAKER_01]: Wow.
33:08
[SPEAKER_00]: Can you guess what it is?
33:10
[SPEAKER_01]: Catchphrase, no.
33:13
[SPEAKER_00]: Let's get ready to rumble.
33:14
[SPEAKER_01]: War, yeah, that's a fact.
33:18
[SPEAKER_00]: So some people are literally sitting on.
33:21
[SPEAKER_00]: He will just sit out, he owns it.
33:23
[SPEAKER_00]: Whenever it appears in a movie, he's getting a licensee money.
33:27
[SPEAKER_00]: Yeah, and some of y'all are sitting on cash phrases.
33:30
[SPEAKER_00]: You don't have to develop a multi-million dollar company.
33:33
[SPEAKER_00]: Some of y'all could just develop cash phrases.
33:35
[SPEAKER_00]: I've come across cash phrases all this time.
33:37
[SPEAKER_00]: I'm so ashamed.
33:37
[SPEAKER_00]: I'm like, that's some pretty good cash phrase.
33:39
[SPEAKER_01]: Yeah, yeah, yeah, yeah, yeah.
33:40
[SPEAKER_01]: But like, hello.
33:41
[SPEAKER_01]: No, I mean, I mean, funny enough, I don't know if I should say this is the word, whatever.
33:46
[SPEAKER_01]: We family now, but a bunnies is your birthright like I own that I didn't make it up though You know, and I I've owned it for years because I remember I forget I'm not gonna say why I watched it But I I just remember in the love attraction space.
34:02
[SPEAKER_01]: Yeah, um, there was so many People were saying it's over and over and over again a bunnies your birthright bunnies your birth and I was like you're that's a powerful saying
34:13
[SPEAKER_01]: And so, I was like, yo, like, when I started to create my businesses around a abundance being a birthright, I wanted to create, you know, merch with it, the AC, which is my logo, my ash cash logo, but I started making it the abundance community.
34:31
[SPEAKER_01]: I said, I need to, I need to protect that saying, and I did, and I'm, and to the point
34:42
[SPEAKER_01]: You know what I'm saying and you trigger in my lawyer sense of not even going after people he means that he does he does monitor his brand and he intends to enforce it when he gets it No, so I mean my question what I actually do to right because what I've been taught is Even if somebody isn't is is infringing on your copyright let them cook
35:07
[SPEAKER_01]: So that like is that your limitation or why are we doing that so like let me I'm actually right let's just say for instance I don't know somebody has a shirt That's as abundance is your girlfriend and it's not mine right and I can immediately because when I see it I can immediately be like nope season this is not I need that
35:29
[SPEAKER_01]: or I could wait to Beyonce with it.
35:34
[SPEAKER_01]: And then millions of people get it.
35:36
[SPEAKER_00]: I can't go after them, but then.
35:38
[SPEAKER_00]: Don't do that, don't do that.
35:40
[SPEAKER_01]: Don't do that.
35:41
[SPEAKER_01]: Right.
35:41
[SPEAKER_01]: That puppy got you on this.
35:43
[SPEAKER_01]: That's how he got you.
35:44
[SPEAKER_00]: You are required to monitor and enforce your rights.
35:48
[SPEAKER_00]: So you can't look and wait for the Beyonce and then go, well, Beyonce's team is gonna go, but you didn't enforce it over there to Joe Smell.
35:55
[SPEAKER_01]: Yeah.
35:56
[SPEAKER_00]: You're not enforcing your mark.
35:58
[SPEAKER_00]: Don't come over here.
35:59
[SPEAKER_00]: You're not enforcing it over here.
36:00
[SPEAKER_00]: Don't come over here.
36:01
[SPEAKER_01]: Yeah.
36:01
[SPEAKER_00]: You got to enforce it.
36:03
[SPEAKER_01]: You got to vote vote vote vote.
36:05
[SPEAKER_01]: But what if I guess my whole thing is.
36:08
[SPEAKER_01]: bigger small.
36:09
[SPEAKER_01]: No, no, but I'm sad.
36:10
[SPEAKER_01]: But what I'm saying is what I say beyond say where's it?
36:13
[SPEAKER_01]: Not that.
36:14
[SPEAKER_01]: Okay.
36:14
[SPEAKER_01]: I'm saying beyond saw you in a way for Beyonce to wear to then sue that right because because now was popular.
36:20
[SPEAKER_00]: No, no, no, don't do that.
36:21
[SPEAKER_00]: Don't do that.
36:22
[SPEAKER_01]: As soon as you are aware of it, you need to enforce it.
36:26
[SPEAKER_00]: And there's also like a loophole on that too.
36:29
[SPEAKER_00]: So people love to put things on the front
36:36
[SPEAKER_00]: The exact words are slipping my mind, but it's more about the design.
36:41
[SPEAKER_00]: What is really what we're looking at is what's in the tag.
36:44
[SPEAKER_00]: The tag is the brand.
36:46
[SPEAKER_00]: Think about that because in front of the shirt can say whatever, but the tag might have hands.
36:50
[SPEAKER_00]: If you're really a brand, your tag would have your brand name on it because that's saying you own the shirt, right?
36:56
[SPEAKER_00]: So then there is a loophole for that actually there was a lawsuit about that where there are like, well, we were just using as a design.
37:03
[SPEAKER_00]: We weren't using it as the shirt.
37:06
[SPEAKER_00]: That's why you notice like when we file the trademark, we do like, oh, it's a little thing here.
37:10
[SPEAKER_00]: Because then it's not fanciful.
37:12
[SPEAKER_00]: It's not the design, but it is like the actual brand itself.
37:15
[SPEAKER_00]: So there.
37:16
[SPEAKER_00]: They're certain loopholes, however, I'm going to tell you Ash Cash, not him.
37:21
[SPEAKER_00]: Yeah, you need to because they're going to say, you're not policing your mark, right?
37:25
[SPEAKER_00]: And so then there's a defense where we're saying, hey, because of that, you're weren't enforcing your mark.
37:32
[SPEAKER_00]: I was able to build this and do this and carry on.
37:36
[SPEAKER_00]: You can't pull up now because it's detrimental to me.
37:38
[SPEAKER_01]: Right.
37:39
[SPEAKER_00]: Now you hurt me but you like wait a minute now this is my brand so you don't want to wait you always want to pull up.
37:45
[SPEAKER_00]: If I pull up and they make no money I can't shoot up that images and you need to pull up to shut it down because what you have happening is your brand is losing its brand.
37:57
[SPEAKER_01]: All right, gosh, you can hear those things.
37:58
[SPEAKER_00]: Grand value, the more, that's why Louis Vuitton and Gucci that don't mind shutting down the people in canow street.
38:05
[SPEAKER_00]: Everything that's the name of it, right?
38:08
[SPEAKER_00]: They do that.
38:09
[SPEAKER_00]: Why did they do that?
38:10
[SPEAKER_00]: Because brand value matters.
38:12
[SPEAKER_00]: So the more people you let use it without authorization, the more value your brand is losing.
38:18
[SPEAKER_00]: So that's why, right?
38:19
[SPEAKER_00]: It's not that they want their money.
38:21
[SPEAKER_00]: They want to make sure their brand value doesn't decrease.
38:23
[SPEAKER_01]: Yep, not got it, got it.
38:25
[SPEAKER_01]: In this world of AI, what can you protect and what can't you're meaning?
38:31
[SPEAKER_01]: You know, I don't know, a lot of us use AI for a lot of our intellectual property.
38:36
[SPEAKER_01]: So, you know, a lot of it is, I'm not, AI is not creating it for me, it's helping me.
38:44
[SPEAKER_01]: Once AI has helped me with a complete work, what's fair game to copyright and what is not fair game copyright?
38:54
[SPEAKER_00]: That is such a great area right now because there's a argument of, well, how much of the AI helped you with it, right?
39:01
[SPEAKER_00]: How much did you input?
39:02
[SPEAKER_01]: Yeah.
39:03
[SPEAKER_00]: How much instructions did you give the AI to output?
39:07
[SPEAKER_00]: It's gray.
39:08
[SPEAKER_00]: Yeah.
39:09
[SPEAKER_00]: The copyright hasn't picked up on it, excuse me.
39:12
[SPEAKER_00]: Yeah.
39:14
[SPEAKER_00]: So my recommendation for my clients if you want original works, you need to do those works.
39:21
[SPEAKER_00]: um, as far as the AI tools, they're going to get to a point.
39:25
[SPEAKER_00]: I'm sure they are where they're going to check to see how much AI was used.
39:29
[SPEAKER_00]: Yeah.
39:30
[SPEAKER_00]: Because there are tools I can check to see if AI helped you, but they're not.
39:34
[SPEAKER_00]: So there's going to come a point where they're going to start shutting you guys down.
39:37
[SPEAKER_00]: Not you guys as in, you know us, but anyone that's just using AI and just straight off trying to copy right AI.
39:44
[SPEAKER_01]: Yeah.
39:45
[SPEAKER_00]: But it's a great area.
39:47
[SPEAKER_00]: Just like the area
39:51
[SPEAKER_00]: You're like, well, the person that owns the monkey, right?
39:54
[SPEAKER_00]: Or who owns the AI, who owns it if we take a selfie and I take it with my phone, well, who's finger was on the trigger, right?
40:01
[SPEAKER_00]: So it's going back to that.
40:03
[SPEAKER_00]: So think about who's finger is on the trigger.
40:05
[SPEAKER_00]: Like, what was the input?
40:07
[SPEAKER_00]: How much of you did you put in it, right?
40:10
[SPEAKER_00]: Instead of just write me a 5,000 word essay, like, wait, what did you put in here, right?
40:16
[SPEAKER_00]: Yeah, you have to consider that because it has to be your original word.
40:20
[SPEAKER_00]: I almost put out at some of the AI tools actually have in their licensing about like what you can own from what it generates to you need to read your licensing agreements Okay, that's good to know.
40:31
[SPEAKER_01]: That's good to know.
40:32
[SPEAKER_01]: Yeah, because again like there's a lot of people you know I like even like for me in the book publishing world.
40:38
[SPEAKER_01]: Yeah, like I know that there are a lot of authors who are using
40:43
[SPEAKER_01]: A.I.
40:44
[SPEAKER_01]: and you could tell that they use an AI.
40:47
[SPEAKER_01]: I was even talking to a publisher actually that works at one of the big publishing companies.
40:52
[SPEAKER_01]: And he was like, if you use AI at all, like even a sentence, you like they can't even publish it.
40:59
[SPEAKER_01]: Like it can't, you know?
41:00
[SPEAKER_00]: And then they're really strict.
41:01
[SPEAKER_01]: Yeah, yeah, yeah, yeah.
41:04
[SPEAKER_01]: All right, that's about for Foley O'Manville, what separates Grill Brand Empire from someone who owns like a logo, right?
41:13
[SPEAKER_01]: Like, what's that thing that differentiates them?
41:15
[SPEAKER_01]: Because I know a lot of people, like, I know you said, you know, you want to protect your brand and there's people who, you know, will just jump out the window and just like, they're protecting everything.
41:26
[SPEAKER_01]: But like, I, what's the difference between, hey, you know what, you're protecting this, but this, you just on a logo.
41:33
[SPEAKER_01]: and this person over here has the actual portfolio.
41:36
[SPEAKER_00]: The things.
41:37
[SPEAKER_00]: So it's like for some people, they might just protect a name, right?
41:41
[SPEAKER_00]: They say, oh, can't you?
41:41
[SPEAKER_00]: I just want to protect the name.
41:43
[SPEAKER_00]: Someone that's doing portfolio management, they're coming back to me every, probably every month.
41:48
[SPEAKER_00]: And they're like, hey, I came up with this.
41:50
[SPEAKER_00]: I want to protect this, this and this before I go, we're here and get funding on this.
41:54
[SPEAKER_00]: Sometimes it is a matter of domains.
41:57
[SPEAKER_00]: We talked about that.
41:58
[SPEAKER_01]: Yeah.
41:59
[SPEAKER_00]: It's not just owning the trademark.
42:02
[SPEAKER_00]: It's owning all of the assets that are connected to the brand, the social media, the domains, the logo, right?
42:09
[SPEAKER_00]: The slogans, all of those things are part of it.
42:12
[SPEAKER_00]: So if you're just stopping at the name, you're not really building out the forefoot fully up.
42:17
[SPEAKER_00]: You have all these other triggers, all these different points that people are touching upon your brand that you are investing money in time to put out there and you're just leaving it there, right?
42:28
[SPEAKER_00]: When you're thinking portfolio, you ask you my start off with the name you might do a logo, but you have your slogan.
42:34
[SPEAKER_00]: You have your hashtag.
42:36
[SPEAKER_00]: You have your user name on social media.
42:39
[SPEAKER_00]: You have your domain.
42:40
[SPEAKER_00]: You can register trademarks on domains, right?
42:43
[SPEAKER_00]: You might have a color that you're using.
42:46
[SPEAKER_00]: Right, all of these things are part of your branding.
42:49
[SPEAKER_00]: T-mobile owns that pink.
42:51
[SPEAKER_00]: Ain't no other cell phone company coming out with a pink.
42:54
[SPEAKER_00]: Target owns that red.
42:56
[SPEAKER_00]: You should own your color.
42:58
[SPEAKER_00]: What is your extra computer color?
42:59
[SPEAKER_00]: I always see you in blue for the most private time.
43:01
[SPEAKER_01]: On his blue.
43:02
[SPEAKER_00]: Yeah, I love them.
43:03
[SPEAKER_00]: Yeah, yeah.
43:04
[SPEAKER_00]: Right.
43:04
[SPEAKER_00]: I like a good blue too.
43:06
[SPEAKER_01]: Yeah.
43:06
[SPEAKER_00]: Which is funny.
43:07
[SPEAKER_00]: We're both in black.
43:07
[SPEAKER_00]: We normally move blue.
43:09
[SPEAKER_01]: Right.
43:10
[SPEAKER_01]: But look at this though.
43:11
[SPEAKER_01]: I just started seeing that I wanted to check.
43:13
[SPEAKER_01]: But look, I don't own that.
43:14
[SPEAKER_01]: Can I take it?
43:16
[SPEAKER_01]: They just, they try to sell it to me.
43:18
[SPEAKER_00]: How much are they up?
43:19
[SPEAKER_01]: I don't know.
43:20
[SPEAKER_00]: But okay, so here's my thing.
43:22
[SPEAKER_00]: I'll talk about the play on the lady lawyer, so I are on the trademark the lady lawyer, right?
43:26
[SPEAKER_00]: Someone owned the domain the lady lawyer.
43:29
[SPEAKER_00]: Yeah.
43:29
[SPEAKER_00]: They were trying to sell it for like 150,000 dollars.
43:32
[SPEAKER_00]: They never did anything with it.
43:33
[SPEAKER_01]: Yeah.
43:34
[SPEAKER_00]: And I was like, okay, I looked at it, so okay, it's inspiring.
43:37
[SPEAKER_00]: Let's do a back order on the domain.
43:39
[SPEAKER_00]: When it aspires, let's see if we can get it.
43:42
[SPEAKER_00]: We got it for $50.
43:44
[SPEAKER_00]: So they might, you might make an offer and they might say absolutely not, they're not doing anything.
43:49
[SPEAKER_01]: Yeah.
43:50
[SPEAKER_00]: And you make an offer do the back order, so if it expires, you can then get it, because eventually they might say forget it.
43:56
[SPEAKER_01]: This is like the OSTO.
43:58
[SPEAKER_00]: No, no, it's not go daddy, whoever registered it.
44:01
[SPEAKER_00]: So if you go to who is, I go to see one of the other things is to do the other play.
44:06
[SPEAKER_00]: Register everything else around it.
44:07
[SPEAKER_00]: The Ash Cash Cash.net.
44:10
[SPEAKER_00]: Ash Cash.USA.
44:12
[SPEAKER_00]: Biz.
44:13
[SPEAKER_00]: And you locked down all those other asses because that's a part of your portfolio.
44:16
[SPEAKER_00]: Yeah.
44:18
[SPEAKER_00]: you might even lock down ash cash abundance or what all the things are connected to you and build that portfolio.
44:25
[SPEAKER_01]: And that's why my web site is I am ash cash because because this wasn't available.
44:31
[SPEAKER_01]: And I was like, all right, let me just do I am ash cash in column.
44:34
[SPEAKER_01]: You know what?
44:34
[SPEAKER_00]: dot code like all of those things are dots a part of portfolio building right official ash cash all the different things ash cash USA all those domains used to and I know we were like Kendra I got all that money you registered one at a time don't need to do it all that once it's as you're building you add more to that portfolio and then you add the
44:58
[SPEAKER_00]: Cash cash.
44:59
[SPEAKER_01]: Did you try to get that a lift?
45:00
[SPEAKER_01]: Yeah, because I think you said a little of line, you told me like Nike, right?
45:05
[SPEAKER_01]: Like they all, I hate Nike like yeah.
45:07
[SPEAKER_00]: They own the derogatory marks too.
45:09
[SPEAKER_00]: That is a part of protecting your brain.
45:12
[SPEAKER_00]: Wow.
45:12
[SPEAKER_00]: Because here's the thing, if you registered a derogatory, where do you point them?
45:16
[SPEAKER_00]: Back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back to, back
45:43
[SPEAKER_01]: Yeah, well, we start thinking about entrepreneurs who, you know, most people, you know, most businesses don't become profitable immediately.
45:52
[SPEAKER_01]: It's trying to figure it out, like realistically though, right?
45:56
[SPEAKER_01]: What is the cost of protecting your brand, right?
46:00
[SPEAKER_01]: Like that range.
46:02
[SPEAKER_01]: And
46:03
[SPEAKER_01]: Oh, am I doing it the moment I'm I make some money like like what is that thing when I when when I could take $3,000 put it to its ads and make more money or would I take that $3,000 to protect protect the name that they make you know money.
46:22
[SPEAKER_00]: you know, there is a part of your taxes called illegal expenses for a reason.
46:29
[SPEAKER_00]: They expect you to spend on legal.
46:31
[SPEAKER_00]: Yeah.
46:31
[SPEAKER_00]: So although it sounds really heavy because you're like, I've want to hustle, then you're creating a hustle, not a brand.
46:38
[SPEAKER_00]: At some point, you know, everyone's turning point is different.
46:41
[SPEAKER_00]: I have clients that will hit me up before they do anything.
46:44
[SPEAKER_00]: I have clients that will hit me up once they get to 10K.
46:52
[SPEAKER_00]: I already know what I'm going to tell you to do is before you start always try to do it before you start or because now you're making that money you pay for that Facebook ad you accidentally end up showing up on the person that owns the brand and it's not even just like the exact name you're using.
47:09
[SPEAKER_00]: It might be a translation, a derivative of, right?
47:12
[SPEAKER_00]: You might be using Ash Cash Ears.
47:15
[SPEAKER_00]: right in your ash cash and you're like, oh, no, it's there.
47:18
[SPEAKER_00]: What we know about this ash cash ears.
47:20
[SPEAKER_00]: All of these things play a part.
47:22
[SPEAKER_00]: And so you have to consider your level of risk.
47:25
[SPEAKER_00]: How much are you willing to risk?
47:27
[SPEAKER_00]: Because the lawsuit can be $10,000.
47:29
[SPEAKER_00]: Your rebranding could be $10,000.
47:31
[SPEAKER_00]: Or the lawsuit could be $100,000.
47:33
[SPEAKER_00]: Or it can be $7 figures.
47:35
[SPEAKER_01]: Yeah.
47:36
[SPEAKER_00]: What is the level of risk you're willing to accept?
47:38
[SPEAKER_01]: Right.
47:39
[SPEAKER_01]: It's funny because like one thing that you mentioned just now that I actually saw I think this was right around maybe like 2020 around the George Floyd incident I wanted to anybody was like, um, you know, Black Lives Matter and things in that nature.
47:56
[SPEAKER_01]: You know, I wanted to write a book called Black Wealth Matters, right?
48:01
[SPEAKER_01]: And so I started to do the research
48:07
[SPEAKER_01]: actually own the trademark for wealth matters.
48:11
[SPEAKER_00]: Oh.
48:12
[SPEAKER_01]: And so even though you're in it, it's a different context, I couldn't get the book done, because it would have been in prison on there right, of wealth matters.
48:20
[SPEAKER_01]: So if I would have done black wealth matters, it's still what it is still.
48:23
[SPEAKER_00]: Exactly.
48:24
[SPEAKER_00]: That wasn't enough of a modifier.
48:26
[SPEAKER_00]: The only way that works is if you're in different classes.
48:28
[SPEAKER_00]: Yeah.
48:28
[SPEAKER_00]: So there's Pandora, radio, and Pandora bracelet.
48:31
[SPEAKER_01]: Right.
48:31
[SPEAKER_00]: they can coexist.
48:33
[SPEAKER_00]: But if they're doing something that's a derivative or the same class as you, you're likely to get rejected.
48:39
[SPEAKER_01]: Yeah.
48:40
[SPEAKER_00]: I almost forgot to tell you about the domain thing about Nissan.com.
48:43
[SPEAKER_00]: Just because you own your LLC doesn't mean you have rights to the domain, and it doesn't mean you have rights to the social media.
48:50
[SPEAKER_00]: Again, this is part of the portfolio building, right?
48:52
[SPEAKER_00]: Nissan, the car company didn't own Nissan.com.
48:55
[SPEAKER_00]: It was owned by the computer company and they had a long battle for years to try to get that domain So domains are important.
49:03
[SPEAKER_00]: So they're sleeping on that like as you can get it get it because they've been fighting for just like Your social media handle right Chanel for inkling even my social media like everything is I am ask out Yeah, just like you mentioned abundance is my bird right you're like everybody using this thing.
49:18
[SPEAKER_00]: You caught it.
49:19
[SPEAKER_00]: You're like you know
49:21
[SPEAKER_00]: that's the same way someone else is going to feel about what ever else somebody else creates.
49:25
[SPEAKER_00]: So are you going to wait for someone else?
49:27
[SPEAKER_00]: And then the thing is when you call the lawyer in the middle of the crisis, it's like trying to get you're in a car.
49:34
[SPEAKER_00]: So then it's like you're trying to get your car insurance at that time.
49:37
[SPEAKER_00]: Guy, you're going to be like, what you call me for?
49:39
[SPEAKER_00]: You should
49:42
[SPEAKER_00]: Right, same thing.
49:44
[SPEAKER_00]: You're calling me in and now it's expensive and now we're dealing with this hardache and now we're dealing with this issue, you know, we have one client that They could have stopped this a long time ago.
49:55
[SPEAKER_00]: They saw the brand using their name
49:58
[SPEAKER_00]: After the brand reach out and said, oh, can we coax this?
50:00
[SPEAKER_00]: They're like, no, the brand went and registered it overseas.
50:04
[SPEAKER_00]: Wow.
50:04
[SPEAKER_00]: Got to deal with the major company.
50:07
[SPEAKER_00]: I'm not even going to say the name.
50:08
[SPEAKER_00]: The company was like, while they on the registration overseas.
50:11
[SPEAKER_00]: So we're going to use that international registration.
50:15
[SPEAKER_00]: And yeah, we're going to sidestep you.
50:17
[SPEAKER_00]: I even know you've built it for you.
50:19
[SPEAKER_01]: Right.
50:19
[SPEAKER_00]: So there's so much at play in this branding thing and I think with the internet with social media It's level things for some of us, but it's also made the risk higher if you're building a branch
50:32
[SPEAKER_01]: And so it's so cost wise, right?
50:35
[SPEAKER_01]: So two, two, two, one, since I have you.
50:37
[SPEAKER_01]: Yeah.
50:37
[SPEAKER_01]: Cost wise, what is the average cost of it?
50:40
[SPEAKER_01]: Number two.
50:41
[SPEAKER_01]: Number two, do you do like brand assessments, right?
50:45
[SPEAKER_01]: Like, would you look at a brand and say, all right, based on your brand, here are all the things that you should be doing to protect a brand.
50:52
[SPEAKER_00]: Yeah, we do brand assessments.
50:54
[SPEAKER_00]: That's one of the things that we do.
50:57
[SPEAKER_00]: One of the things I would say is when people think cost, we vary, right?
51:01
[SPEAKER_00]: There are some attorneys that are flat feet, some attorneys that are hourly, right?
51:04
[SPEAKER_00]: We break ours down in three steps.
51:06
[SPEAKER_00]: So we break it down in your search.
51:08
[SPEAKER_00]: You pay for your search first to make sure everything clears.
51:11
[SPEAKER_00]: Then you pay for your application preparation and then you pay your filing fee for the government.
51:15
[SPEAKER_00]: So it's not like boom, here's this big bill, right?
51:19
[SPEAKER_00]: The economy has changed, we understand that, right?
51:21
[SPEAKER_00]: So it can vary, you can see, trade my application companies that charge 700, 300, 2000, 3000, it all varies.
51:30
[SPEAKER_00]: You're also your fee can go up depending on how many classes you're registering for.
51:34
[SPEAKER_00]: Right, so let's say at minimum, you need at least one class, but you coming, you big baller, you want 10 classes, awesome.
51:40
[SPEAKER_00]: Each class is $350.
51:42
[SPEAKER_00]: That's $3,500 alone in just your filing fee.
51:46
[SPEAKER_00]: Right, so you have to consider that.
51:47
[SPEAKER_00]: I always say think of it as your brand is living, you're operating, you're making money, start where you are, grow.
51:55
[SPEAKER_00]: Add on as you grow right keep because as long as you're in business you're doing things You're going to expand and you're gonna grow in other areas and just grow from there So if there is I've had people like contact me that use legal zoom and all these different things They're like I don't have an attorney.
52:10
[SPEAKER_00]: I don't have this the feet first it started at 400 now It's that 5,000 because this and that is happening right?
52:15
[SPEAKER_00]: So it all depends, you just actually are attorney that you're interviewing, like, okay, well, what is your process?
52:22
[SPEAKER_00]: You know, where do we go from here?
52:24
[SPEAKER_00]: If there is a problem, are you going to leave me?
52:26
[SPEAKER_00]: You want to stay with me?
52:27
[SPEAKER_00]: You know, 21 questions.
52:32
[SPEAKER_00]: Are you going to be with me when things get for a free month?
52:35
[SPEAKER_00]: You know, and just get find that out because it can get rough.
52:39
[SPEAKER_00]: I always tell people three things, prayer patients and positivity, right?
52:42
[SPEAKER_00]: This process is not always easy, sometimes it will take you through it.
52:48
[SPEAKER_00]: And so you have to be willing to trust in your attorney to get you where you want to go.
52:52
[SPEAKER_00]: It might look crazy to you, it might look ridiculous at some point.
52:56
[SPEAKER_00]: But if you trust in your attorney's abilities,
52:59
[SPEAKER_00]: And you know that your attorney's gonna look out for you and do what they need to do.
53:03
[SPEAKER_00]: You're gonna get there.
53:04
[SPEAKER_00]: It may not be 18 months It may not be in two two weeks, but it might take two years.
53:11
[SPEAKER_00]: It might take three years I'm one of those people that was like, okay, we didn't get it that way.
53:16
[SPEAKER_00]: Okay, let's let's circle a block.
53:17
[SPEAKER_00]: Okay, let's see another strategy.
53:18
[SPEAKER_00]: Okay, let's let's see what else is there
53:21
[SPEAKER_00]: what else can we do right because that's my belief like I want to see you on your brand what are the other options what do we need to tweak what do we need to do and if you can come to me before you invest a lot of money in the brand then we have the ability to have even more options right so it all depends pull out pull out your crystal ball
53:51
[SPEAKER_01]: AI, IP protection, like what is, like, like, 10 years from now.
54:01
[SPEAKER_01]: What does Kendra, like, what are you envisioning this is going to be?
54:06
[SPEAKER_00]: You know, 10 years from now, I feel like we're going to need more protection.
54:12
[SPEAKER_00]: And here's why, although AI is great, people need that human connection.
54:16
[SPEAKER_00]: It's still going to matter, right?
54:19
[SPEAKER_00]: AI is never going to be able to replace ash, cash completely.
54:23
[SPEAKER_01]: Yeah.
54:24
[SPEAKER_00]: as an individual to be able to feel you and be like, oh my gosh, he's human, his pulse, right?
54:29
[SPEAKER_00]: That's so important.
54:31
[SPEAKER_00]: So AI is going to be useful, but it's not going to replace the need for that human connection.
54:38
[SPEAKER_00]: That part.
54:39
[SPEAKER_00]: So influencers are still going to matter.
54:40
[SPEAKER_00]: It's still going to be a multi-billion dollar industry.
54:43
[SPEAKER_00]: It's growing.
54:44
[SPEAKER_00]: Right, because and brands are investing and more people are picking up their cameras and creating content and they're because they're so we're all unique, right?
54:52
[SPEAKER_00]: And so there's so many different variations of you that you could find online.
54:56
[SPEAKER_01]: Yeah.
54:57
[SPEAKER_00]: So influencing is still going to be around.
54:59
[SPEAKER_00]: It may change.
55:00
[SPEAKER_00]: AI tools may still be useful for them, but the fact of the matter is you are not going to be able to replace the whole human experience in human connection.
55:11
[SPEAKER_00]: with AI.
55:11
[SPEAKER_00]: In fact, it's going to make it more.
55:13
[SPEAKER_00]: It's going to be like, oh, she was a real influencer.
55:15
[SPEAKER_00]: She wasn't an AI influencer.
55:17
[SPEAKER_00]: I can meet her in real life.
55:19
[SPEAKER_00]: I can touch her.
55:21
[SPEAKER_00]: That's going to be key.
55:22
[SPEAKER_00]: Right.
55:22
[SPEAKER_00]: Because the AI agents and chat bots and influencers, people know they're not real.
55:28
[SPEAKER_00]: They might be entertained by them, but they're not connecting with them.
55:32
[SPEAKER_00]: I need to be able to be like, oh, I'm a pull-up on Ashcash, but I'm a me-hand real life.
55:37
[SPEAKER_00]: And those things are actually going to make real, like human being influencer more money.
55:43
[SPEAKER_01]: Yeah, 1,000%.
55:44
[SPEAKER_01]: That's funny.
55:45
[SPEAKER_01]: So look, I'm glad that you said that because that's where that's what I feel, like even like, we're my studio now.
55:52
[SPEAKER_01]: You know, I have a building out of an event space, things in that nature.
55:55
[SPEAKER_01]: Like, that's my vision, like, my foresight as well.
55:59
[SPEAKER_01]: I'm like, hmm, I'm saying,
56:01
[SPEAKER_01]: With all this AI happening, I think that there's going to be an appetite, right?
56:05
[SPEAKER_01]: Because you know, I study business as well, and I know the law of supply and demand, right?
56:10
[SPEAKER_01]: And so whenever the supply goes up, right?
56:15
[SPEAKER_01]: It's like, you know what I'm saying?
56:17
[SPEAKER_01]: If there's so much of the supply,
56:19
[SPEAKER_01]: then it does it cost that much, right?
56:21
[SPEAKER_01]: And so we're in and date in the world with so much AI that AI is gonna be more than actual human influence, which means that the supply of human influence is gonna be smaller compared to AI influence, which means that the demand for real human influence is gonna increase, and I'm like, man, I wanna be at the cusp of it.
56:45
[SPEAKER_01]: Yeah, yeah, you get it.
56:47
[SPEAKER_00]: You get it in those words more of the protections are going to place because then it's the mashup.
56:52
[SPEAKER_00]: It's like, oh, these 10 girls are doing good.
56:54
[SPEAKER_00]: Let's make an AI that mingots these 10 girls that are at the top of TikTok and you're like, hold on.
57:00
[SPEAKER_00]: You know, wait, is that my eyebrows?
57:02
[SPEAKER_00]: This is a high-grade, right?
57:04
[SPEAKER_00]: So that's where the protections are going to be even more important because they're pulling from what they're seeing as popular and the these algorithms which is AI are looking for that they're looking to replicate that so that it can get those views and engagement but at some point it's going to like you said be oversaturated where people are going to i'm logging off i'm putting my phone down let me go to this live event let me reconnect with
57:33
[SPEAKER_01]: Yeah, and I love it love it any any like anything I missed.
57:38
[SPEAKER_01]: I don't know we had a great conversation So anything I miss anything that I um you know any tips you want to leave my entrepreneur's my Insiders my influencers
57:48
[SPEAKER_00]: trademark trademark trademark.
57:50
[SPEAKER_00]: I think people have this connotation like I need to be a millionaire.
57:54
[SPEAKER_00]: I need to like, no, you need to trademark.
57:56
[SPEAKER_00]: So you can get the million.
57:58
[SPEAKER_00]: Yes.
57:58
[SPEAKER_01]: Right.
57:59
[SPEAKER_00]: When you have your trademark and you know it, it brings a set of confidence and security.
58:05
[SPEAKER_00]: When you're building and hustling without it, you're like, is it my brand?
58:09
[SPEAKER_00]: I think it's my brand.
58:10
[SPEAKER_00]: When you have that confidence, like, boom, here's my trademark registration certificate.
58:14
[SPEAKER_00]: What's up?
58:15
[SPEAKER_00]: Yeah.
58:15
[SPEAKER_00]: Right.
58:15
[SPEAKER_00]: When you don't have it, you are still not able to give it a hundred percent.
58:20
[SPEAKER_01]: Yeah.
58:20
[SPEAKER_01]: Right.
58:21
[SPEAKER_00]: Businesses that have their names registered, that have their trademark have more trust for their customers.
58:27
[SPEAKER_00]: And they are able to grow faster.
58:30
[SPEAKER_00]: They generate more revenue because of that confidence.
58:33
[SPEAKER_00]: I agree.
58:34
[SPEAKER_00]: It's not just illegal thing.
58:35
[SPEAKER_00]: It's a mental thing and it makes a huge difference.
58:38
[SPEAKER_00]: Eight out of 10 businesses have their brands stolen.
58:40
[SPEAKER_00]: There's a high probability you're going to be in that mix.
58:43
[SPEAKER_00]: You're going to need that paperwork.
58:44
[SPEAKER_01]: That's true.
58:45
[SPEAKER_01]: And you talked earlier about like manifestation.
58:47
[SPEAKER_01]: I also think that protecting your brand is like a level of manifestation, right?
58:52
[SPEAKER_01]: If you're just starting on a brand and you're telling yourself, oh, I don't want to, you know, I'm not going to protect this brand until what are you signaling to the universe?
59:01
[SPEAKER_01]: Like, what are you telling the universe about your brand?
59:04
[SPEAKER_01]: What are you telling the universe about how big the brand you believe is going to be, right?
59:08
[SPEAKER_01]: And so if you want to manifest, you know, a multi-million dollar
59:15
[SPEAKER_01]: You can't wait, you can't wait until it's the most I'm million dollar brand and you know to do that You have to do it prior to because you're signaling to your universe.
59:23
[SPEAKER_01]: No, this is a great idea You gave me this idea.
59:26
[SPEAKER_01]: I'm gonna protect this idea by on course
59:29
[SPEAKER_00]: I love that.
59:29
[SPEAKER_00]: Here's what you'll say up there.
59:31
[SPEAKER_00]: You close the door on that one.
59:32
[SPEAKER_01]: All right.
59:33
[SPEAKER_01]: Let's go.
59:34
[SPEAKER_01]: We got Kendra Stevens in the building.

59:48
[SPEAKER_00]: I do coach aluminum amount of clients, but oh, she had a big dog.
59:52

[SPEAKER_01]: She said, look, look, that's cold one four.
59:55
[SPEAKER_01]: I don't know if you could afford me.
59:58
