Transcript
- 0:00All right, we are live Charlie Marlowe here on the Kenny
- 0:03Wallace YouTube channel had to go live. 3 massive NASCAR news
- 0:09stories all breaking today. On Wednesday, you see in the
- 0:13headline Chase Briscoe penalty overturned, Austin Syndrich
- 0:18penalized, and also NASCAR sues 2311 racing.
- 0:23That is a counter suit. So let's break it all down here.
- 0:27I'll go quick. I'm sure Kenny Wallace is going
- 0:29to weigh in on this as well, but let's work backwards.
- 0:33Chase Briscoe, the penalty overturn, I'm going to go right
- 0:37to nascar.com. Here's the headline.
- 0:42Appeals panel overturns, L2 level penalty to the number 19
- 0:47team, of course of Chase Briscoe.
- 0:49Remember, this is going back to the Daytona 500 where Chase
- 0:54Briscoe was on the pole. So I'm just going to read a
- 0:58little bit from this article. The National Motorsports Appeals
- 1:01panel on Wednesday overturned the L2 level penalty levied
- 1:04against the Joe Gibbs Racing #19 team stemming from the season
- 1:09opening race at Daytona International Speedway.
- 1:13So this is Chase Briscoe, of course.
- 1:16OK. The spoiler base was found to be
- 1:19modified on the 19 car. The spoiler base is a single
- 1:24source part and cannot be modified.
- 1:26But in overturning the ruling, the three member panel
- 1:30determined. So here's the quote.
- 1:33The panel believes that the elongation of some of the holes
- 1:37on the number 19 cup car spoiler base is caused by the process of
- 1:43attaching that specific spoiler base to the rear deck and not
- 1:47modification of the single source part.
- 1:52OK, now remember now, Brisco initially, folks had a huge
- 1:57penalty, all right? He was docked 100 driver points,
- 2:02ten playoff points. JGR was fined $100,000 and
- 2:08deducted 100 owner points as well as ten playoff points.
- 2:12Crew chief James Small was suspended for four races.
- 2:16So all of that now is rescinded following this appeal.
- 2:21We have 116 people watching live.
- 2:24Appreciate that. So with the ruling overturned,
- 2:28Briscoe is now 15th in the Cup Series standings with 72 points
- 2:33earned this season. And then prior to the panel's
- 2:36decision, Briscoe was 40th in Cup standings.
- 2:41So Briscoe goes to X and he says biggest points day of my career.
- 2:46We're back. He posted it on social media and
- 2:49he says, quote, in all seriousness, thank you to NASCAR
- 2:52for giving us the option to show our evidence and huge thank you
- 2:56to everyone at Joe Gibbs Racing who put in countless hours to
- 2:59put everything together. The three member panel was
- 3:04comprised of Dixon Johnston, Hunter Nickel and Kathy Rice.
- 3:10All right, we also have a quote from Joe Gibbs Racing on this
- 3:16penalty being overturned. Joe Gibbs Racing quote, We
- 3:20appreciate the process NASCAR has in place that allowed us the
- 3:23opportunity to present our explanation of what led to the
- 3:26penalty issued to our number 19 team, team owner Joe Gibbs said
- 3:30in the statement. Quote, we are thankful for the
- 3:33consideration and ruling by the National Motorsports Appeals
- 3:36Panel. It is obviously great news for
- 3:39our nineteen team and everyone at Joe Gibbs Racing.
- 3:43We look forward to focusing on the remainder of our season
- 3:46starting this weekend in Phoenix.
- 3:48All right, so that's the first story.
- 3:51The appeals panel overturns the penalty issued to Chase Briscoe
- 3:56on the number 19 team from Daytona.
- 3:59That is story #1 but as I said, three massive NASCAR stories.
- 4:06Briscoe. You also have Austin Sindrick
- 4:08being penalized and then NASCAR countersuing 2311 racing and
- 4:13front row and Michael Jordan, all that.
- 4:14I'll get to that at the end here, but let's go to Austin
- 4:18Sindrich now. OK, so Austin Sindrich, this is
- 4:22stemming of course from CODA just over the weekend.
- 4:28So Sindrich penalized after CODA and also the number 5 Hendrick
- 4:34team that's Kyle Larson hit with suspensions.
- 4:38So Austin Sindrich, there was the incident with Ty Dillon in
- 4:43the Cup race Sunday at Circuit of the Americas also.
- 4:49So Kyle Larson's team had two pit crew suspensions after a
- 4:53lost wheel during the race. But the big story here is the
- 4:57Cindric penalty and the fact that he wasn't suspended.
- 5:01So this is the incident with Cindric, right?
- 5:06Rearing Ty Dillon of colleague OK, so Cindric loses 50 driver
- 5:13points. He was fined $50,000.
- 5:16So he's dropped from 11th to 35th in the standings.
- 5:21OK, NASCAR did not give him the one race suspension, something
- 5:25it did previously when drivers intentionally wrecked other
- 5:28vehicles like Bubba Wallace on Kyle Larson in 2022.
- 5:32If you remember that at Vegas and with Chase Elliott on Denny
- 5:35Hamlin 2023 at Charlotte. And I'm, I'm kind of
- 5:40paraphrasing, but also reading from thisnascar.com article, you
- 5:43guys can go to nascar.com as well.
- 5:45So M40, NASCAR managing director of racing communications, you
- 5:50got this new podcast, Hauler Talk, which is really
- 5:53interesting to hear the way they explain these penalties and
- 5:56overturning them and all that. So M40 says the reasoning
- 6:01Cindrick wasn't suspended, including the race, was being on
- 6:06a road course with lower speeds and tighter confines already and
- 6:10that the incident didn't lead to a caution flag.
- 6:12So the previous two incidents that led to those suspensions,
- 6:15that's what I was talking about with Bubba Wallace, 2022 Vegas
- 6:19and Chase Elliott, 2023 Charlotte.
- 6:22OK, Those suspensions occurred on one and a half mile
- 6:26speedways. OK.
- 6:28So let me just see if I get any more information on this.
- 6:31I'm just kind of floating around X and see what everybody's
- 6:34saying about this. OK, so this is this is M40
- 6:38again. This is exactly what he said on
- 6:40that podcast Hauler talk. All right, and thank you guys
- 6:43for joining us here. I've got 142 of you watching
- 6:47live and I appreciate that. And I'm sure Kenny Wallace is
- 6:49going to weigh in pretty soon. But Kelly Crandall, she
- 6:54transcribed the quote from Hauler talk.
- 6:57So here it is. Quote this is on the Austin
- 6:59Syndrich penalty. The reason we landed on a points
- 7:02and fine, we take every situation, every violation as
- 7:06its own unique incident. And I know probably fans don't
- 7:09love hearing that sentence and it's said a lot, but it's said
- 7:12because it has to be said. It's said because it's true.
- 7:16Sure, we do look at past instances to help inform us,
- 7:19educate ourselves on how we should handle each subsequent
- 7:21one, but each incident is very different, maybe not very
- 7:25different, but each is at least a little bit different and often
- 7:28times very different. In this case, we did feel it was
- 7:31significantly different than the previous two.
- 7:33Talking about course Bubble Walls and Chase Elliott, I've
- 7:36mentioned that several times and the reasons are you look at it,
- 7:40it is a road course with lower speed, tight confines to begin
- 7:43with and the result didn't even draw a caution.
- 7:46Now obviously the caution flag doesn't come out as quickly on
- 7:50road courses anyway, but that did not draw a caution.
- 7:53So those were really the reasons why we chose to err on the side
- 7:57of letting him race this weekend in Phoenix M40 on the Austin
- 8:03Syndrich penalty, why he was penalized, why he was not
- 8:06suspended for one race. All right, so I read you there
- 8:12discussed there the first two big stories Chase Briscoe his
- 8:17penalty at Daytona overturned and that freaking never happens.
- 8:22Austin Syndrich was penalized for his actions at CODA when he
- 8:27right reared Ty Dillon, but he will not be suspended a race did
- 8:31drop a ton in the standings in the point standings.
- 8:35All right and then the other story I'm working backwards.
- 8:39This one happened earlier in the day and basically it's the fact
- 8:43that NASCAR is now counter suing 2311 racing, front row
- 8:50Motorsports, the groups, the teams that are suing them, of
- 8:54course, for monopolistic practices.
- 8:57You've heard about this. It's been going on since what
- 9:00the last week of the season, I believe is when we heard news of
- 9:03this. So I'm going to go to Jeff
- 9:05Glock's ex. He's a teammate, right?
- 9:08Jeff Glock we're dirty MO media teammates Kenny Wallace and and
- 9:12everybody involved. So basically here's what's going
- 9:15on here. All right, OK.
- 9:20And I'll just read a couple of them.
- 9:21Jeff Glock posts on XA new 30 page court filing shows NASCAR
- 9:26has counter sued 2311 and front row.
- 9:30So 2311 Racing and Front Row Motorsports and named long time
- 9:34Michael Jordan business partner Curtis Polk as a defendant
- 9:37saying all three willfully. This is quote willfully violated
- 9:42the antitrust laws by orchestrating anti competitive
- 9:46collective conduct. OK, so we also have a statement
- 9:52from the attorney for 2311 racing in Front Row Motorsports.
- 9:57This is Jeffrey Kessler. He says, quote, today's
- 10:01counterclaim by NASCAR is a meritless distraction and a
- 10:04desperate attempt to shift attention away from its own
- 10:07unlawful monopolistic actions. NASCAR agreed to the joint
- 10:11negotiations that they now attack.
- 10:13When those joint negotiations failed, they used individual
- 10:16negotiations to impose their charter terms, which most of the
- 10:19teams decided they had no choice but to accept.
- 10:23My client's lawsuit has always been about transforming NASCAR
- 10:26into a more competitive and fair sport for the benefit of
- 10:29drivers, fans, sponsors and teams.
- 10:31Because of their love of the sport, every major sport goes
- 10:35through a transition to competition when antitrust
- 10:38claims are asserted, and that moment has come for NASCAR.
- 10:41Today's baseless filing changes nothing.
- 10:44We are confident in the strength of our case and look forward to
- 10:47presenting it at trial. Again, that is from 2311 Racing
- 10:51Front Row Motorsports attorney Jeffrey Kessler.
- 10:54That was posted by Jeff Gluck of the Athletic and Dirty MO Media,
- 10:58our teammate, he posted on X about three hours ago or so.
- 11:04I know Bob Pockras was also weighing in on this.
- 11:07Apparently, this has more to do with what's going to be
- 11:09happening in the offseason with a potential trial.
- 11:13So let me just find what Bob Progress tweeted about this and
- 11:20I will wrap it up. We won't go too long here,
- 11:22folks. I appreciate 163 of you watching
- 11:25big NASCAR Newsday, of course. So here we go.
- 11:32Here we go. Doo Doo, Doo, Doo, Doo, Doo, Doo
- 11:34Doo. Can you tell I'm stalling?
- 11:37Here we go. OK, so NASCAR is not asking for
- 11:41an immediate injunction as far as eliminating guaranteed
- 11:45starting spots for 2311 racing in Front Row Motorsports.
- 11:50OK, That would all be part of the trial in December if it gets
- 11:53there. That's what Bob Procras tweeted.
- 11:57OK, so NASCAR is asking for an injunction eliminating
- 12:01guaranteed starting spots for the charter teams.
- 12:04So basically saying like, if you're going to sue us, why do
- 12:07you have a guaranteed spot? But again, that would not impact
- 12:10this 2025 season. This is all moving forward 2026
- 12:15and we'll see what happens if there is actually a trial coming
- 12:18up in December. And Bob Pockras also posting, he
- 12:22says, because somebody else, this is this is what I like
- 12:26because I'm not a lawyer. I'm guessing a lot of you guys
- 12:29aren't lawyers. So somebody said to Bob Pockras,
- 12:32explain this to me like I'm five.
- 12:34And he says NASCAR alleges that the way Curtis Polk went about
- 12:38trying to organize a boycott during negotiations and other
- 12:42tactics and the team's trying to sue for better contract terms is
- 12:47a violation of antitrust law. So basically, they're both
- 12:50saying this is against antitrust, right?
- 12:542311 racing, Front Row Motorsports, That's Michael
- 12:57Jordan. That's Denny Hamlin.
- 12:59What Bob Jenkins from Front Row Motorsports, they're suing
- 13:02NASCAR alleging monopolistic practices and then now here we
- 13:07are about what, 6-7 months later, whatever it is NASCAR
- 13:11with their counter suit that we have just discussed and it was
- 13:16it was announced today. I appreciate all you guys
- 13:19jumping on here. Let's see, I'll read a couple
- 13:21comments. Andy Barker says figures NASCAR,
- 13:27too bad they can't charge NASCAR with penalties.
- 13:31K2 says, hey, Charlie, thanks for the update.
- 13:33I'm not a reporter. I'm just kind of reading what's
- 13:35going on. So again, all the credit to Jeff
- 13:38Glock, Bob Pocras and the first couple stories.
- 13:41I was just taking it directly from nascar.com.
- 13:45Let's see, here we go. Go Fast.
- 13:50Racing 88 says they should treat everyone how they treated Bubba
- 13:53Wallace and Chase, no questions asked.
- 13:56Right? And that's why M40 went out of
- 13:57his way to explain why in their opinion, this one was different
- 14:01with Austin Syndrich being on a road course at CODA.
- 14:04No caution being thrown. That was their explanation.
- 14:07This is not my opinion. That was their explanation to
- 14:09why Austin Syndrich was not suspended a race and why Bubba
- 14:13Wallace and Chase were at the mile and a half tracks.
- 14:17Let's see, Douglas Paulson says they should not be penalized,
- 14:23penalizing based on the result, but simply the action.
- 14:27Jamie Williams says hi. Well, hi, Jamie, how you doing?
- 14:31Boom, There you go. I didn't leave it up there long
- 14:33enough. Let's see, we got to go fast
- 14:37racing again. The rule book should always be
- 14:40the same. If I right hook a guy at my
- 14:41local track, I get kicked out. So the next week if someone does
- 14:45it, they also should be kicked out.
- 14:46I get that. All right.
- 14:50People are alleging Rodger sent NASCAR a big fat check for no
- 14:56penalty. You always got to love the
- 14:58conspiracy theories. We love it.
- 15:00It's fun. Come on.
- 15:03It's part of it. Who's your daddy?
- 15:05Says they make up rules of rules as they go.
- 15:09I understand why people think that way as well, especially
- 15:12with the what? The cutting of the turns during
- 15:15CODA, which they basically kind of they basically switched that
- 15:19on the fly this past weekend at CODA.
- 15:22Let's see, Old Hickory. Andy Jackson says all these
- 15:27young bucks ain't drivers. Kale Yarborough was There you
- 15:30go. Center Hill card says, hey
- 15:32Charlie, well, how you doing? OK, JWC 9/24, I don't know what
- 15:40else 2311 racing wants. NASCAR is making sure they're
- 15:43there every week guaranteed, and they get their share.
- 15:45No one is forcing them to put cars out every week.
- 15:50Let's see, we got Lulap. NASLA.
- 15:54It's an open book with plenty of extra pages.
- 15:57The NASCAR rule book. Get one at your local bookstore.
- 16:00How about that? Tim Ferguson says probably 5
- 16:04years from now NASCAR will just distribute completely ready to
- 16:08race cars and tell the drivers to hop in.
- 16:10How about that? Let's see Donald Ulrich.
- 16:14What 2311 did was like the guys in the playground getting
- 16:18together and going after the bully.
- 16:20In this case, Donald thinks the bully is NASCAR and 2311 rallied
- 16:25the troops to the front row to go after him.
- 16:28All right, Griswold says go. Todd Gilligan.
- 16:32Todd Gilland and front row All right, I'll tell you what I
- 16:35said. I wasn't go very long.
- 16:36I appreciate all you guys watching big news stories you
- 16:40see in the title. Chase Briscoe penalty overturned
- 16:43at Daytona. He's all good.
- 16:45Austin Syndrich was penalized but not suspended for a race.
- 16:49He just drops big time in the standings.
- 16:52And also NASCAR counter suing 2311 Racing and Front Row
- 16:56Motorsports for basically what not monopolistic actions.
- 17:02I got to get the the perfect word here, OK, Because I don't
- 17:06want to, I don't want to speak out of school here.
- 17:09Monopolistic practices is what 2311 Racing and Front Row
- 17:13Motorsports are accusing NASCAR of.
- 17:15They're basically saying that Front Row and 2311 engaged in
- 17:24what? Let's see, practices that are a
- 17:28violation of antitrust law by organizing the boycott during
- 17:32negotiations and other tactics and the team's trying to sue for
- 17:35better contract terms in their opinion, NASCAR's that is a
- 17:40violation of antitrust law. So this whole deal to he said
- 17:42she said antitrust case. I'm no lawyer.
- 17:46I have no idea what's going on. Hopefully we don't talk about
- 17:49this a ton during the season and there could be a trial coming up
- 17:52in December. All right, thank you, everybody.
- 17:54Please comment like subscribe. As I said, I'm sure Kenny
- 17:57Wallace will be weighing in on all these topics.
- 18:00Charlie Marlowe signing off. Thanks for watching.
- 18:03We'll see you guys later.
